국제앰네스티는 버락 오바마 미국 대통령의 역사적인 쿠바 방문과 뒤이은 아르헨티나 방문을 앞두고 3국 정상이 가장 먼저 논의하길 희망하는 주요 인권사안에 대해 강조하고자 합니다.

미국

관타나모 수용소

미국 해군기지 내 테러범 수용소 관타나모 수용소 폐쇄를 위한 현 정부의 노력은 인정하지만, 오바마 대통령이 처음 약속했던 수용소 폐쇄 기한으로부터 6년이 지난 지금도 여전히 수십여 명이 석방되지 못한 채 수감되어 있다는 사실은 국제적으로 상당히 우려되는 점입니다. 미국 정부가 국제적인 공정한 재판절차에 따라 수감자들을 기소할 의도가 없다면 모두 즉시 석방할 것을 재차 촉구합니다.

2016년 2월 23일 미국 정부가 의회에 제출한 폐쇄 계획에서 관타나모 수용소 문제를 인권 사안으로 다루지 않은 점에 대해 유감을 표합니다. 이 폐쇄안은 관타나모 수용소뿐만 아니라 어디서든 고문과 강제실종 등의 국제법상 범죄 및 인권침해행위를 강력히 처벌해야 할 미국의 의무에 대해 전혀 언급하지 않았고, 그 결과 일부 수감자들을 기소나 재판 없이 미국 본토로 이송해 무기한 구금한다는 내용에 그쳤습니다.

국제앰네스티는 관타나모 수용소의 폐쇄가 단순히 인권침해행위를 타지로 옮기는 결과로 이어져서는 안 된다고 끊임없이 주장해 왔습니다. 이번 폐쇄 계획을 비롯해 관타나모 특별 군사위원회를 존치하는 것은 이러한 조건을 충족하지 못할 것입니다. 일반 형사사법제도 내에서 재판이 이루어질 수 있도록 국제적인 공정한 재판 기준을 따르지 않는 군사위원회는 폐지되어야 합니다.

미국의 대 쿠바 경제제재

미국의 경제 제재로 인해 쿠바의 인권은 특히 경제, 사회, 문화적 권리를 중심으로 너무나 오랫동안 침해됐습니다. 국제앰네스티는 미국의 경제제재로 인해 쿠바의 일반 시민들이 의약품 및 기초 생필품을 얻지 못하는 실태를 기록했고, 제재를 해제할 것을 계속해서 촉구했습니다. 쿠바와의 외교 관계를 정상화하려는 미국 정부의 노력을 환영합니다. 또한, 미국 의회에 2015 쿠바 여행자유법, 쿠바 무역법, 쿠바 전자통신진흥법 등 양당 합의 법안의 처리를 촉구합니다.

이주민과 난민

2016년 첫 라틴아메리카 국가 방문을 기해, 오바마 대통령은 쿠바와 아르헨티나의 인권 현황을 고려해야 함은 물론 미국 내 이민자와 망명신청자 수천여 명이 처한 상황을 타개하고, 미국에 입국하려는 이민자 문제에 대해 국제기준에 맞게 임해야 할 것입니다. 2015년 한 해 동안 보호자 없는 어린이 약 4만 명뿐만 아니라 4만 가구가 남부 국경지대에서 체포되었고, 많은 수가 엘살바도르, 온두라스, 과테말라, 멕시코 등지에서 폭력과 불안을 피해 온 사람들이었습니다. 이들은 미국에 체류하기를 고집하며 의료적 지원과 식량, 식수도 제대로 제공되지 않고 변호사 접견도 할 수 없는 시설에서 수개월 동안 수감됐습니다. 미국 정부는 엘살바도르, 과테말라, 온두라스 출신 이주민을 대상으로 현행 난민 재정착 프로그램을 더욱 확대할 것이라고 발표했고, 이는 분명 올바른 방향으로 진전한 것입니다. 그러나 난민 재정착을 위해 국제적으로 취해야 할 조치는 여전히 많이 남아 있습니다. 미주 지역의 인권 상황을 논의한다면 이 문제를 반드시 다뤄야 합니다.

쿠바

국제적 조사

유엔 특별조사관, 미주인권위원회 등 독립적인 인권단체와 인권기구는 수십 년 동안 쿠바에 입국하는 것이 불가능했습니다. 쿠바는 국제앰네스티가 정부로부터 입국 허가를 받지 못한 유일한 미주 지역 국가입니다.

쿠바 내 다양한 인권 사안에 대해 투명성을 높이고 독립적, 객관적인 감시와 기록이 이루어지기 위해서는 독립적인 인권단체의 입국을 허용해야 합니다. 쿠바와 국제사회 간 새롭게 대화가 진행되고 있는 것은 환영할 일이지만, 쿠바 국민의 인권을 더욱 보호하고 증진하기 위해서는 이러한 대화에 국제적 인권 단체 역시 포함되어야 합니다. 인권제도와의 협력을 통해 쿠바는 책임성과 투명성을 환영하고, 다른 미주 국가와 동일한 수준으로 철저한 조사를 받겠다는 의지를 세계에 전달할 수 있을 것입니다.

자의적 체포와 표현, 결사, 집회의 자유 탄압

최근 수년간 쿠바에서는 평화적인 시위대와 정치적 반대세력, 인권옹호자들에 대해 지속적인 탄압과 단기 자의적 체포가 이루어진 것으로 기록됐습니다. 세계 인권의 날인 2015년 12월 10일에는 정부 요원들이 평화적 활동 참여를 막기 위해 반대세력과 기자들을 가택 연금했다는 보고가 있었습니다. 국제앰네스티는 쿠바 형법에서 공무원 모욕, 공무집행 방해, 공공장소 난동 등을 명시한 조항이 표현과 집회, 결사의 자유를 탄압하는 데 이용되고 있음을 매우 우려하고 있습니다. 쿠바는 정부와 사법부가 표현의 자유를 제한하기 위해 이용하는 형법 조항들을 국제기준에 맞게 개정해야 합니다.

아르헨티나

정의회복과 불처벌 종식

1976년 아르헨티나 군사 쿠데타가 일어난 지 40년이 지나는 동안 당시 벌어졌던 심각한 인권침해를 조사하고 재판에 부치는 등 상당한 진전을 이룩했습니다.

그러나 모든 사건에 대해 증인들의 법무를 대리할 효율적인 단체가 필요한 것 등 아직 풀어야 할 과제는 남아있습니다. 독재정권의 민간인 참여 문제, 성범죄 재판 회부 문제 등 새로운 과제도 등장했습니다. 아르헨티나는 군사독재 당시의 인권침해 가해자들을 불필요한 지연 없이 재판에 회부하고, 증인의 안전과 신체적 완전성(physical integrity)을 보호하기 위해 계속해서 노력해야 합니다.

선주민 권리

아르헨티나 헌법과 국제인권법에서는 이미 선주민들의 권리를 인정하고 있지만, 수십 년 동안 아르헨티나의 선주민들은 2등 시민 대우를 받으며 인권을 무시당한 채 폭력과 박해, 차별의 대상이었습니다. 최근 들어 선주민들의 주장과 요구가 아르헨티나에서 정치적, 사회적으로 주목을 받기 시작했습니다.

지난 10년 동안 정부와 사기업, 특히 농업, 채굴 산업에 종사하는 기업들은 아르헨티나 선주민들이 대대로 살아온 거주지에 대한 토지권을 행사하지 못하도록 거대한 장벽을 세웠습니다. 유엔 선주민 특별조사관을 비롯한 국제기구는 개발계획과 천연자원 착취로 영향을 받을 지역사회와 충분히 소통하지 않은 점을 지적하기도 했습니다.

아르헨티나는 선주민과 함께 공동재산의 법적 인정에 관한 특별법 마련을 논의, 협의하고, 국제기준을 적용, 이행함으로써 선주민의 권리를 증진해야 합니다.

표현의 자유와 평화적 집회의 자유

최근 수년간 아르헨티나 정부와 보안군이 사회적 저항에 대처하는 방법은 진보와 역행을 거듭했습니다. 2016년 2월 아르헨티나 안보부는 시위를 진압하고 시위대를 징계할 것을 보안군에 지시하는 “대중 시위 시 보안군 행동지침”을 발표했습니다. 국제앰네스티는 이 행동지침이 표현의 자유와 평화적으로 시위할 권리를 심각하게 제한하는 한편, 시위를 범죄화하는 데 사법제도를 부당하게 사용하는 점이 드러났다고 보고 있습니다.

마지막으로 미국과 쿠바, 아르헨티나 3국 회담에서 생산적이고 인권중심적인 논의가 이루어지길 바랍니다. 국제앰네스티는 3국이 당면한 주요 인권과제에 대해 언제든지 더 많은 정보와 특별 권고사항을 제공할 것입니다.

OPEN LETTER FROM AMNESTY INTERNATIONAL TO USA PRESIDENT BARACK OBAMA, CUBAN PRESIDENT RAUL CASTRO, AND ARGENTINE PRESIDENT MAURICIO MACRI.

On the occasion of President Barack Obama´s upcoming historic visit to Cuba, followed by a two-day visit to Argentina,
Amnesty International would like to take this opportunity to highlight to the three Presidents a number of major human
rights concerns which we hope will be prioritized as part of your discussions.

UNITED STATES OF AMERICA

Detentions at Guantánamo Bay

While we recognize the current administration’s commitment to end the detentions in the US naval base at Guantánamo
Bay, the fact that dozens of detainees remain there more than six years after President Obama’s original deadline for
closure of the detention facility is a cause for huge international concern. We reiterate that any Guantánamo detainee
the USA does not intend to charge for prosecution in proceedings that fully comply with international fair trial standards
should be immediately released.

We regret that the government’s plan for closure submitted to the US Congress on 23 February 2016 fails to address
resolution of the detentions as a human rights issue. The plan for closure makes no reference to the USA´s obligation
to ensure accountability for human rights violations, including crimes under international law of torture and enforced
disappearance that have occurred at the base and elsewhere. The result is a proposal to relocate some individuals for
indefinite detention without charge or trial to the US mainland. We have consistently argued that closure of the
Guantánamo detention facility must not result in the transfer of human rights violations elsewhere. This proposal would
fail this test, as would the retention of military commissions for selected prosecutions. The commissions do not meet
international fair trials standards and should be abandoned in favour of trials in the ordinary criminal justice system.

The US economic embargo on Cuba

For too long, the US economic embargo has undermined human rights in Cuba, particularly economic, social and cultural
rights. Amnesty International has consistently called for lifting of the embargo and documented how it denies ordinary
Cubans access to medication and other basic commodities. We welcome the government’s efforts to re-establish
diplomatic relations with Cuba. We call on the US Congress to pass the following bipartisan bills: The Freedom to Travel
to Cuba Act of 2015, The Cuba Trade Act of 2015, and The Cuba Digital and Telecommunications Advancement Act.

Migrants and refugees

On this first visit to Latin America in 2016, we urge President Obama to not only consider the human rights situations
in Cuba and Argentina but also to address the situation faced by thousands of migrants and asylum seekers in the USA
and ensure his government fully complies with international standards regarding those seeking to enter the country.

Nearly 40,000 unaccompanied children and an additional 40,000 families were apprehended crossing the southern
border in 2015, many fleeing violence and insecurity in El Salvador, Honduras, Guatemala, and Mexico. Families and
unaccompanied children were detained for months while pursuing claims to remain in the country, many held in
facilities that did not provide proper access to medical care, food and water, and access to legal counsel. The US
government announced expansion of the current refugee resettlement program for migrants fleeing from El Salvador,
Guatemala, and Honduras, and this is a step in the right direction, but it still is a far cry from the measures that need
to be taken internationally towards resettling those displaced. This is an issue that cannot be left aside in any discussion
pertaining the human rights situation of the Americas.

CUBA

International scrutiny

Independent human rights organizations and mechanisms, including Special Rapporteurs of the UN and the InterAmerican
Commission on Human Rights, have not had access to Cuba for decades. Cuba is the only country in the
Americas which Amnesty International does not have permission from authorities to access.

In the interest of transparency and to facilitate independent and objective monitoring and reporting on a range of human
rights issues in Cuba, independent human rights organizations should be able to enter the country. While we welcome
the new dialogue between Cuba and the international community, we urge that this dialogue includes international
human rights actors, as a way to advance the protection and promotion of the human rights of the Cuban people.

Working with human rights systems, Cuba could also send a message to the world that it welcomes accountability and
transparency, and that it is willing to be held to the same degree of scrutiny as its peers across the Americas.

Arbitrary arrests and restrictions on freedom of expression, association and assembly

In recent years there have been constant reports of harassment and short-term arbitrary arrests of peaceful protestors,
political dissidents, and human rights defenders in Cuba. On 10 December 2015, International Human Rights Day,
Amnesty International received reports of dissidents and journalists placed under house arrest by state agents in order
to prevent their participation in peaceful activities. Amnesty International is seriously concerned that provisions of the
Cuban Criminal Code, such as contempt of a public official (“desacato”), resistance to public officials carrying out their
duties (“resistencia”) and public disorder (“desórdenes públicos”) are used to stifle free speech, assembly and
association. In line with international standards, Cuba must amend provisions of the Criminal Code that lend
themselves to abuse by state officials and the judiciary to restrict freedom of expression.

ARGENTINA

Access to Justice and the end to Impunity

Forty years have passed since the 1976 coup in Argentina and substantial progress has been made in investigating and
bringing the serious human rights violations that took place during that period to trial.

Challenges still remain, however, such as the need for efficient organization of all cases, including the legal and
paralegal work with witnesses. New challenges have also emerged such as the civilian participation in the dictatorship
and bringing sexual crimes to justice. Argentina must continue its efforts to bring those responsible for the human
rights violations committed during the military dictatorship to trial without unnecessary delay, and to protect the
security and physical integrity of the witnesses in these cases.

Rights of Indigenous Peoples

Argentina’s Constitution and the international human rights law already recognize the right of Indigenous peoples.
However, for decades, Indigenous peoples in Argentina have been treated like second class citizens, subjected to
violence, intimidation and discrimination with their human rights ignored. In recent years, their claims and demands
have started to gain traction on the political and social agenda in Argentina.

Over the last decade state and private interests, especially those of the agribusiness and extractive industries, have
built up enormous barriers between Argentina’s Indigenous people and their rights to their traditional lands.

International bodies, including the UN Special Rapporteur on Indigenous Peoples, have criticised the lack of consultation
with the communities that may be affected by development projects and exploitation of natural resources.

Argentina must make progress with regard to the legal recognition of communal property by discussing and consulting
a special law with the Indigenous Peoples, and must advance their rights through the practice and implementation of
standards.

Freedom of expression and right to peaceful assembly

The way in which the political authorities and security forces tackle social protest in Argentina has experienced both
progress and setbacks in recent years. In February 2016, the Ministry of Security published its “Protocol for Action of
the State’s Security Forces in Public Demonstrations” instructing the security forces to put a stop to social protests and
take criminal action against those participating. In our opinion, this places serious limitations on freedom of expression
and the right of all people to demonstrate peacefully, whilst also representing an improper use of the justice system to
criminalize protestors.

In closing, we wish you productive and human rights-focused discussions as part of your upcoming meetings. Amnesty
International stands ready to furnish the three governments with further information about some of the most pressing
human rights challenges facing the countries and our specific recommendations for addressing these.

일반적 감시의무 및 강제 저작권 삼진아웃제 금지법 발의

저작권 삼진아웃제 부분 폐지된다 - 인권침해 소지를 줄이도록 문화체육관광부 장관의 명령에 의한 ‘삼진아웃제’ 폐지

사업자에 의한 사적 검열로 발생하는 폐해를 미연에 방지하기 위해 일반적 감시의무 부과 금지

 

지난 4월 30일 국회 교육문화체육관광위원회 소속 배재정 의원은 저작권법상 정보인권 침해 논란이 있는 조항을 개선하기 위한 ’저작권법 일부개정법률안’을 발의했다. 이번에 발의한 개정안은 배재정 의원과 사단법인 오픈넷이 작년 6월 개최된 국회 저작권 대토론회를 기점으로 1년 동안 준비한 결과물이다.

 

1. 온라인서비스제공자의 일반적 감시의무 부과 금지

먼저 온라인서비스제공자에 대한 일반적 감시의무나 적극적 조사의무를 금지하는 조항을 신설했다(안 제104조의9). 저작권 보호도 중요하지만 온라인서비스제공자에게 포괄적이고 일반적인 감시의무를 부과할 경우 온라인상 모든 정보에 대한 사적 검열로 기능해, 이용자의 사생활 침해나 표현의 자유와의 충돌 우려가 크기 때문이다.

또한 정보매개자인 온라인서비스제공자에게 일반적 성격의 감시의무를 부과해서는 안 된다는 것이 국제적인 원칙이다. 우리 정부와 법원도 이를 인정하고 있으며, 한-EU FTA에서도 규정하고 있다(제10.66조 제1항). 동 조항의 신설은 이러한 원칙을 다시 한 번 확인하고 명확하게 규정하는 데 의의가 있다.

한편 현행 저작권법 제102조 제3항이 있으므로 불필요한 개정이라는 반론이 있으나, 저작권법 제102조 제3항은 제102조 제1항의 책임 제한 적용을 받기 위해 감시의무가 요구되지 않는다는 의미일 뿐, 일반적인 감시의무의 금지라고 보는 것은 잘못된 해석이다.

 

2. 문화체육관광부 장관의 명령에 의한 삼진아웃제 폐지

개정안은 그 동안 인권침해 논란이 많았던 소위 ‘삼진아웃제’도 정비하여, 한국저작권위원회의 권고에 의한 삼진아웃제는 수정하여 존치하되, 문화체육관광부 장관의 명령에 의한 삼진아웃제는 폐지했다.

삼진아웃제는 저작권을 침해하였다고 3회 이상 경고를 받은 이용자의 계정 등을 정지하는 제도인데, 디지털 환경에서 중요한 정보인권인 접속권을 제한한다는 점에서 심각한 인권침해 소지가 있어 극소수의 국가에서만 운영되고 있으며, 프랑스에서는 입법 당시부터 위헌 논란이 있었고 최근에는 불필요한 비용만 발생하고 입법취지는 달성하지 못한다는 이유로 거의 사문화되었다. 특히 행정부 명령만으로 이용자의 계정을 정지하거나 게시판 운영을 정지하는 제도는 우리나라가 유일한데, 국가인권위원회도 폐지를 권고한 바 있고, 유엔(UN)표현의 자유 특별보고관도 2011년 보고서에서 심각한 우려를 표명했으며, 국제인권단체들도 우리나라 삼진아웃제의 폐지를 촉구하는 서한을 국회에 보내기도 하였다.

지난 2013년 문화체육관광부는 국회 답변자료에서 “행정부의 판단으로 이용자의 계정을 정지하는 사례는 우리나라가 유일한 것”이며, “향후 계정정지 명령 시 사법부의 판단을 거치도록 하는 방안을 검토”하겠다고 밝힌 바 있다. 또한 2015년 답변자료에 의하면 2012년 이후 장관 명령에 의해 이용자 계정이 정지된 사례는 단 한 건도 없으며(2010년 11건, 2011년17건), 심지어 게시판 정지는 제도가 생긴 이래 단 한 건도 없었다.

배재정 의원은 “인권침해의 소지는 크면서 사실상 사문화된 행정기관의 명령에 의한 삼진아웃제는 폐지하되, 한국저작권위원회의 권고를 통한 삼진아웃제는 유지하도록 제도를 정비함에 따라, 저작권 보호라는 원래의 목적은 살리면서도 이용자의 정보인권 보호를 강화하는 계기가 될 것으로 기대한다”고 밝혔다.

나이지리아 정부가 니제르델타 지역의 원유유출 사고로 인한 기름오염 방제방법을 비약적으로 개선하겠다고 약속한 데 대해, 유출 사고의 책임자인 석유기업 쉘(Shell)역시 이에 부응해야 할 것이라고 국제앰네스티가 6일 밝혔다.

무하마두 부하리(Muhammadu Buhari) 나이지리아 대통령이 지난 5일 니제르델타 오고니랜드 지역의 방제사업에 신탁기금을 투입하겠다고 발표한 것은 환영할 일이나, 쉘의 비효율적인 방제방법이 전면 재정비되지 않는다면 그 효과는 제한적인 수준에 그칠 것이다.

니제르델타를 방문하고 돌아온 마크 더멧(Mark Dummett) 국제앰네스티 기업과인권 조사관은 “이제는 북극 원유 추출 사업을 노리고 있는 쉘이 기름 방제대책에 대한 유엔 전문가집단의 조언을 오랜 시간이 지난 지금까지도 적절히 따르지 못하고 있다는 것은 말도 안 되는 일”이라며 “쉘이 기름 방제방법을 대폭 개선하지 않는 한 부하리 대통령의 계획은 실패할 것이며, 오고니랜드 주민들은 계속해서 고통받게 될 것”이라고 말했다.

신탁기금 조성은 유엔 환경프로그램(UNEP)이 4년 전 오고니랜드의 기름오염 사고에 대해 보고서를 발표하면서 중점적으로 권고한 사항이다. UNEP는 이에 더불어 쉘의 방제방법에 대해 방법론적 검토를 거치고 유출사고에 대한 심각한 늑장 대응 문제를 해결하는 등의 개선이 시급히 이루어져야 한다고 촉구했다.

그러나 8월 유출사고 발생 현장을 방문한 국제앰네스티 조사관들은 쉘측이 최근 방제사업을 실시했다고 보고한 지역의 토양과 인근 수역에서 여전히 남아 있는 기름을 발견했다.

방제사업을 위해 조성된 기금은 오고니랜드 주민 대표단과 유엔, 나이지리아에서 원유를 추출하는 원유기업 및 나이지리아 정부가 직접 감독하게 된다. 정부는 ‘주주’들이 최초 1,000만달러를 기금에 투자할 것이라고 밝혔으나 누가 주주가 될 것인지는 분명하지 않다.

UNEP는 최소 30년까지 걸릴 수 있는 방제사업의 최초 5년간 발생하는 비용을 충당하려면 10억달러의 기금이 마련되어야 한다고 추정했으나, 이에 비해 1,000만달러는 턱없이 부족한 수준이다. UNEP는 보고서를 통해 원유기업과 정부 양측이 모두 기금 마련에 기여할 것을 권고했다.

마크 더멧 조사관은 “오고니랜드 지역은 수 년 동안 계속된 원유 유출로 황폐화되고 있지만 쉘의 방제작업은 전혀 효력을 나타내지 못하고 있다”며 “2011년 UNEP는 쉘의 오염지역 방제방법에 다수의 심각한 문제점이 존재한다고 지적한 바 있다. 그러나 직접 오염지역을 방문해 보니 여전히 기름때가 곳곳에 널려 있었다. 직접 본 바로는 그 이후로 거의 아무런 변화가 없었다”고 말했다.

배경정보

나이지리아 정부는 5일 보도자료를 발표하고, “오랫동안 미뤄져 왔던 기금마련 등의 UNEP 권고사항 적용을 빠르게 진행하기 위해 다수의 조치를 취할 것을 부하리 대통령이 승인했다”고 밝혔다.

신탁기금 조성은 나이지리아 시민단체 및 국제앰네스티를 비롯한 국제 비정부단체가 중점 요구한 사항으로, 국제앰네스티는 UNEP 보고서가 발표된 지 4년째인 2015년 8월 4일 부하리 대통령에게 이러한 기금 마련을 요청하는 합동서한을 제출했다.

쉘은 1993년 오고니랜드에서 강제 철수했으나, 여전히 이 지역에 남아 있던 쉘의 송유관에서 원유유출 사고가 발생해 이에 대한 책임이 있다.

오고니랜드는 니제르델타에서 원유 유출로 오염된 수많은 지역 중 단 한 곳에 불과하다. 국제앰네스티가 최근 통계를 분석한 결과 로열 더치 쉘(Royal Dutch Shell)과 이탈리아 다국적 거대 석유기업인 ENI는 지난해 니제르델타에서 550건 이상의 원유 유출이 있었음을 인정했다. 이에 비해 1971년부터 2011년까지 유럽 전 지역을 통틀어 발생한 원유 유출 사고는 평균적으로 한 해 10건씩에 불과했다.

Nigeria: Shell must match government’s commitment to clean oil spills

Shell must match the Nigerian government’s new commitment to tackle oil pollution in the Niger Delta by dramatically improving how it cleans up spills, Amnesty International said today.

President Muhammadu Buhari’s announcement on Wednesday of a trust fund to pay for the clean-up of the Ogoniland region in the Niger Delta is welcome, but if Shell’s ineffective clean-up methods are not fully overhauled, its impact will be limited.

“It is scandalous that Shell – which now wants the world to trust it to drill in the Arctic – has failed to properly implement the UN’s expert advice on oil spill response after so long,” said Mark Dummett, Amnesty International’s Researcher on Business and Human Rights, who has just returned from the Niger Delta.

“President Buhari’s initiative will fail, and the Ogoni people will continue to suffer, as long as Shell fails to make significant changes to the way it approaches oil spill clean-up.”

The establishment of the trust fund was a key recommendation of the United Nations Environment Programme (UNEP), which published a study on oil pollution in Ogoniland four years ago. The UNEP study also called for Shell’s clean-up methods to be urgently overhauled, including reviewing its methodology and addressing serious delays in responding to spills.

But researchers from Amnesty International investigating spill sites in the region have this month found oil on the soil and in nearby water bodies, in areas where Shell contractors are reported to have recently carried out remediation.

The fund will be overseen by representatives of the Ogoni people, the United Nations, the oil companies operating in Nigeria and the government itself. According to the government, “stakeholders” will pay an initial $10 million into the fund, but it is not clear who these stakeholders will be.

$10 million is far below the $1 billion that the UNEP said should be paid into the fund to cover the first five years of a clean-up job which could take up to 30 years. The UNEP study recommended that the contributions should be made by both the oil industry and the government.

“Ogoniland has been devastated by years of oil spills and Shell’s clean-up operations have been utterly ineffective,” said Mark Dummett.

“In 2011 UNEP highlighted numerous serious problems with the way Shell cleans up oil sites. But we have visited multiple sites and found oil pollution lying all around. From what we are seeing, little has changed since then.”

A government press statement on Wednesday said that President Buhari “approved several actions to fast-track the long delayed implementation” of the UNEP report including the establishment of the fund.

Shell was forced to leave Ogoniland in 1993, but its pipelines run through the area and it is responsible for leakages from these pipes.

Ogoniland is only one part of the Niger Delta that has been affected by oil pollution. Royal Dutch Shell and the Italian multinational oil giant ENI have admitted to more than 550 oil spills in the Niger Delta last year, according to an Amnesty International analysis of the companies’ latest figures. By contrast, on average, there were only 10 spills a year across the whole of Europe between 1971 and 2011.

폴란드의 법제도가 레즈비언, 게이, 양성애자, 성전환자, 인터섹스(LGBTI)와 그 외의 소수자들을 증오범죄로부터 보호하기에는 턱없이 부족한 수준이라고 국제앰네스티가 새로운 보고서를 통해 밝혔다. 이번 국제앰네스티 보고서는 폴란드 총선까지 2개월도 채 남지 않은 17일 공개됐다.

보고서 <증오의 표적으로, 법에 외면받다(영문)>는 폴란드의 증오범죄 관련법에서 노숙인과 장애인, LGBTI 등의 소수자들이 완전히 배제된 현실을 다루고 있다.

마르코 페롤리니(Marco Perolini) 국제앰네스티 유럽중앙아시아 차별문제 전문가는 “폴란드 법제도는 일부 소수자 집단은 보호하면서도 다른 소수자들은 방치하는 이중적인 성격이 있다. 폴란드에서 동성애자, 장애인 또는 노숙인이라는 이유만으로 공격을 당하더라도 경찰에서는 증오범죄가 아니라 일반 범죄 사건으로 다룰 것이다. 이처럼 법적 보호에 차별을 두는 위험한 조치는 즉시 개선되어야 한다”고 말했다.

폴란드의 LGBTI는 폴란드 전역에서 만연하고 뿌리 깊은 차별을 경험하고 있다. 신뢰성 있는 공식 통계는 발표되지 않았지만, 폴란드의 대표적 LGBTI 단체인 ‘동성애혐오 반대 운동’은 2014년 한 해에만 동성애자 또는 성전환자를 대상으로 발생한 증오범죄 사건이 최소 120건 이상에 이른다고 기록했으며, 실제 수치는 훨씬 더 높을 것으로 추정된다.

폴란드의 도시 슈체츤(Szczecin)의 경우, 이곳에 사는 LGBTI들은 2014년 1월 24세 게이 남성이 게이 클럽을 나서던 길에 잔인하게 폭행당해 사망하는 사건이 벌어진 뒤로 두려움 속에 살아가고 있다고 전했다. 이 남성의 시신은 얼굴이 멍으로 뒤덮이고 바지가 벗겨진 채로 근처 공사 현장에서 발견되었는데, 결국 최종 사인은 수 차례 웅덩이에 얼굴을 처박혀 익사한 것으로 밝혀졌다.

정부는 이 사건이 동성애 혐오로 인한 살인일 가능성을 무시했고, 법원은 가해자 2명에 대해 유죄를 선고하는 과정에서 일반 범죄와 다름없이 취급했다.

2015년 5월 지비에츠(Zywiec)에서는 반(反)나치 활동가이자 거리예술가인 다리우즈(Dariuz)가 자신이 그린 무지개 벽화 앞에서 “게이 매춘부”라는 욕설과 함께 발로 걷어차이고 침을 맞는 사건이 벌어졌다. 그러나 가해자에 대한 판결문에서는 이러한 욕설을 단순히 “비속어”라고 지칭했을 뿐, 동성애 혐오표현에 대해서는 전혀 언급하지 않았다.

또한 폴란드에서는 지난 수 년간 노숙인들을 대상으로 잔혹한 폭행 사건이 수 차례 벌어지기도 했다. 그러나 이러한 폭행이 최소한 일부나마 피해자의 사회경제적 위치로 인해 유발된 범죄였음에도 불구하고 경찰은 평범한 일반 범죄로 취급하고 있다.

지난 2012년 10월 제슈프(Rzeszów)에서는 가해자들이 노숙인 스테인슬로(Stanisław)를 폭행하고 몸에 불을 지르는 사건이 발생했다. 이들은 이전에도 노숙인들을 “심심해서” 공격한 적이 있다고 인정했음에도 법원에서는 범행 동기의 심각성을 판결에 반영하지 않았다.

페롤리니는 “그간 폴란드는 인종차별과 외국인혐오에 기반한 증오범죄 문제를 해결하고자 긍정적인 조치를 취해 왔다. 그러나 이들과 마찬가지로 매일 같은 공포와 괴롭힘에 시달리는 다른 소수자들은 동일한 대우를 받지 못하고 있다”며 “폴란드는 모든 소수자들이 차별로부터 동등하게 보호받도록 해야 할 국제법상 의무가 있다. 정부가 이를 다하지 못하고 있다는 사실 자체만으로도 사실상 차별과 다름없다”고 말했다.

동등한 보호가 이루어지지 않는다는 것은 곧 장애, 성적 지향성, 성 정체성, 사회경제적 지위에 대한 차별인식을 바탕으로 공격하는 문제를 해결하기 위해 특수 검사, 경찰 조정관 등과 같은 제도적 절차가 전혀 마련되지 않았다는 것이다. 또한 이와 같은 증오범죄를 예방하고, 모든 사건을 조사하고, 가해자를 기소하기 위해 실질적인 정책을 수립하려는 노력조차 전무한 상태다.

폴란드 정부는 이들 소수자들이 공격당한 사건에 대해 전국적 통계 자료를 수집하려는 제도적인 노력도 기울이지 않고 있어, 정부가 증오범죄 문제의 규모를 파악할 방도가 전혀 없다.

폴란드 형법을 개정하고자 하는 노력은 고착 상태에 빠져 있다. LGBTI와 장애인, 노약자를 증오범죄로부터 보호한다는 내용의 법안은 지난 2012년 상정되었지만 지금까지도 일부 폴란드 사회의 거센 반발에 부딪히고 있다. 2015년 한 의원은 이 법안을 “성병을 부추기는 역겨운 젠더 이념을 도입하려는 시도”라고 비난하기도 했다.

이 문제는 올해 10월 25일 열리는 폴란드 국회의원 총선거를 앞두고 계속해서 논쟁을 불러일으킬 것으로 보인다.

마르코 페롤리니는 “폴란드는 국내의 모든 소수자들이 법에 의해 동등한 보호를 받을 수 있도록 이번에야말로 반드시 구체적인 조치에 나서야 한다. 차후 구성될 새로운 정부와 의회는 무엇보다 인권을 가장 우선하고, 차별을 철폐하는 것이 최우선 목표가 되어야 할 것이다. 폴란드 안에서는 그 누구도 자신의 존재만으로 폭력적인 공격을 당할 공포 속에서 살아가서는 안 된다”고 말했다.

Poland abandoning hundreds of victims of hate crimes

Poland’s legal system falls dangerously short when it comes to protecting lesbian, gay, bisexual, transgender and intersex (LGBTI) people and other minority groups from hate crimes, Amnesty International said in a new report today less than two months ahead of general elections.

Targeted by hatred, forgotten by law shows how the state has excluded whole communities from hate crime legislation, including homeless people, people with disabilities and the LGBTI community.

“Poland has a two-tiered legal system that protects some minority groups but leaves others to fend for themselves. If you are a gay man or woman, a person with a disability or a homeless person in Poland and attacked because of who you are, the police will just treat it as an ordinary crime, not as a hate crime – this dangerous protection gap must be closed immediately,” said Marco Perolini, Amnesty International’s expert on discrimination in Europe and Central Asia.

The LGBTI community in Poland faces widespread and ingrained discrimination across the country. While there are no reliable official statistics, Campaign against Homophobia, a major Polish LGBTI organization, recorded at least 120 homophobic or transphobic hate crimes in 2014 alone, though the true figure is believed to be much higher.

In the city of Szczecin, members of the LGBTI community spoke of living in fear since a 24-year-old gay man was brutally beaten to death after leaving a gay club in January 2014. His body was found on a nearby construction site with his face covered in bruises and his trousers pulled down – the eventual cause of death was drowning, as his face had been pushed into a puddle repeatedly.

Authorities ignored the possibility that the killing could have been motivated by homophobia and the court treated the attack as a common crime when it convicted the two men responsible.

In May 2015, Dariusz, an anti-Nazi activist and street artist, was kicked and spat on in front of one of his murals depicting a rainbow in Zywiec, while verbally abused as a “faggot whore”. But in the written record of the judgment against the man responsible, the insults are simply called “vulgar”, with no mention of a homophobic motive.

Poland has also seen a number of vicious beatings of homeless people over the past years. But despite some of the attacks were at least partially motivated by the victims’ socioeconomic status, they have been treated as ordinary crimes by the police.

Stanisław, a homeless person living in Rzeszów, was beaten up and set alight in October 2012. Although the perpetrators acknowledged they had attacked other homeless people out of “boredom” in the past, the sentence did not reflect the gravity of the motivation.

“Poland has taken some commendable steps to tackle hate crimes motivated by racism and xenophobia. But it is difficult to swallow that other minority groups who live with the same daily fears and harassment have not been given the same priority,” said Marco Perolini.

“Poland has obligations under international law to ensure that all minority groups are equally protected from discrimination. The fact that authorities are failing to do so is actually discriminatory in itself.”

The protection gap means that there are no institutional mechanisms – like specialized prosecutors or police coordinators – to deal with attacks based on discrimination along the lines of disability, sexual orientation, gender identity or social and economic status. Nor are there any efforts to develop effective policies to prevent these hate crimes, investigate all cases and prosecute those responsible.

Poland lacks a systematic effort to collect data on attacks against these groups by the state, meaning that authorities have no way of knowing the scope of the problem.

Efforts to reform the criminal code have stalled, despite a bill being tabled in 2012 to protect LGBTI individuals, people with disability or older people from hate crimes. The proposal has met furious resistance from some parts of Polish society, with one MP in 2015 calling it an attempt “to introduce a sick ideology of gender which promotes sexual pathologies”.

The issue is likely to remain contentious ahead of Poland’s general elections on 25 October this year.

“Poland must once and for all take concrete steps to ensure that all minority groups in the country receive the same protection by law. The next government and parliament must make human rights a priority, and top of the list should be to end discrimination. No person in Poland should have to live in fear of violent attacks just because of who they are,” said Marco Perolini.

‘복면금지법’보다 평화로운 집회 보장이 우선이다

복면썼다는 이유만으로 집회 참가자들 ‘잠재적 범죄자’로 매도하는 것

야당은 정부여당의 기본권침해 시도 적극 막아야

 


정부여당이 이른바  ‘복면금지법’을 도입하여 폭력 집회를 근절하겠다고 한다. 박근혜 대통령까지 나서 24일 국무회의에서 지난 11월 14일 ‘민중총궐기’ 집회를 불법폭력집회라고 규정하면서 복면을 쓴 집회 참가자들을 심지어 IS에까지 비유하며 복면금지법 도입을 강하게 주문했다.

참여연대(공동대표 김균,법 인,정강자,정현백)는 폭력집회와 시위에는 단호히 반대한다. 하지만, 복면을 착용했다는 이유만으로 처벌의 대상으로 삼는 것에는 반대한다.

 

복면금지법 도입을 주장하는 취지는 분명해 보인다. 국민의 안전과 생명을 위협하는 폭력을 막자는 데 있을 것이다. 하지만 묻지 않을 수 없다. 복면을 쓰고 집회에 참석했다는 사정만으로 폭력을 행사하기 위해서라고 단정할 수 있는가? 또한 폭력행위가 있다면 현행 형법과 ‘폭력행위 등 처벌에 관한 법률’에 따라 처벌할 수 있지 않은가? 

 

무엇보다 집회와 시위에 관한 법률은 헌법에서 보장하는 기본권이다. 대한민국 헌법 제21조는 "모든 국민은 언론, 출판의 자유와 집회, 결사의 자유를 가진다"고 하면서 "집회, 결사에 대한 허가는 인정되지 아니한다"고 명시하고 있다. 뿐만 아니라 헌법재판소는 지난 2003년 “집회의 자유는 집회의 시간, 장소, 방법과 목적을 스스로 결정할 권리를 보장한다.”고 하면서 집회의 참가자는 “참가의 형태와 정도, 복장을 자유로이 결정할 수 있다. (2003.10.30. 결정, 2000헌바67·83병합)”는 점을 분명히 했다. 따라서 복면을 쓰고 집회에 참석할 것인지 아닌지조차도 헌법으로 보장되는 집회의 자유의 본질적인 내용에 포함된다는 것이다. 공권력이 사전에 복면을 쓸지 말지를 결정할 사안이 아니라는 것이다.

 

정부여당은 독일, 오스트리아, 미국 등 다른 주요 국가들에서도 복면금지법이 있다고 주장하고 있다. 하지만, 정부여당이 주장하는 복면 착용을 금지하는 이들 국가들의 집회에 대한 보장 정도가 과연 우리나라와 같은지 되묻고 싶다. 이들 나라들은 평화적인 집회는 어떤 경우에도 보장된다. 우리 집시법에서 금지하고 있는 국회의사당, 심지어 대통령이나 총리 사저, 국회의사당 근처에서도 집회가 가능하며, 우리와 같이 폭력이 벌어지기도 전에 차벽설치나 살수차 동원을 하지는 않는다. 헌법에서 명시하고 헌재에서 확인한 평화로운 집회의 자유에 대한 보장이 선행되지 않고 오로지 폭력이 예상된다는 자의적인 해석에 근거하여 복면을 금지하는 규정을 만드는 것은 선후가 뒤바뀐 발상이 아닐 수 없다. 

 

무엇보다 이는 범죄와 상관없는 대다수의 집회 참가자를 복면을 썼다는 이유만으로 잠재적 범죄자로 간주하는 것이다.‘채증' 필요성 때문이라는 주장도, 시민의 가장 기본적 자유의 실현을 행사하는데, 혹시나 있을지 모르는 '불법' 때문에 복장을 단속한다는 것은 합리적인 이유가 될 수 없다.

 

특히 우려스러운 것은 지난 11월 14일 민중총궐기 집회를 불법폭력집회로 규정하고 주최 측인 민주노총을 압수수색하는 등 공안 분위기를 조성하는 최근의 흐름이다. 대통령이 직접 집회·시위를 ‘불법’으로 모는 데 그치지 않고 테러리스트와 연계하면서 집회참가자를 범죄인 취급해, 집단적인 의사표현을 불법화하여 공포심을 조장하고 있다. 기본권 행사를 위해서는 범죄자가 될 각오를 해야 하는 상황이다.


이 과정에서 정부여당을 견제하고 누구보다 국민을 대변해야 할 야당의 역할은 중요할 것이다. 분출되는 각계각층의 집단적 요구를 폭력과 불법으로 매도하는 정부여당의 분위기에 야당이 눈치보며 은근슬쩍 끌려가는 형국이 된다면 야당은 그 존재가치가 없다 할 것이다. 이번 복면금지법을 비롯해 기본권을 제한하려는 정부여당의 각종 시도들을 야당이 나서 적극 막아야 할 것이다.

유엔, 한국정부에 영장 없는 통신자료제공제도 폐지 및 진실적시 명예훼손 폐지 권고

정부, 2019년 자유권심사 때까지 관련 법개정 등 조치 이행해야

 

유엔 시민적 정치적 권리규약 위원회(UN Human Rights Committee, 이하 유엔 자유권 위원회)가 지난 11월 5일(현지 시각) 대한민국의 시민적 정치적 권리 전반에 대한 심의 결과인 최종 권고문(concluding observation)을 발표했다. 참여연대 공익법센터(소장 박경신 교수, 고려대)는 이 중 특히 1) 수사기관의 통신자료 수집에 영장주의 도입 2) 이른바‘기지국 수사’에 대한 보호장치 마련 3) 진실적시 명예훼손죄( (형법 307조 1항, 소위“진실 명예훼손”)의 형사처벌 폐지 등 명예훼손죄의 비범죄화를 권고한 것에 주목한다. 참여연대는 대한민국 정부가 ‘시민적·정치적 권리에 관한 국제규약(자유권 규약)’에 가입한 당사국으로서 이번 유엔 자유권 위원회의 권고를 충실히 이행할 것을 촉구한다.

 

우선, 유엔 자유권 위원회는 전기통신사업법 제83조제3항에 따라 전기통신사업자에 대한 가입자 정보 요청이 수사목적이라는 포괄적 이유로 법원이 발부한 영장 없이 이루어지는 것에 대해 우려를 표했다. 또한 집회참가자들을 특정하기 위한  "기지국 수사"의 집행 및 이에 대한 불충분한 규제, 그리고 폭넓은 감청의 이용 특히 국정원에 의한 이용과 이에 대한 불충분한 규제에 대해서도 우려를 나타냈다. 

 

유엔 자유권 위원회는 국가안보 목적의 감시를 포함한 모든 감시가 자유권규약에 부합하도록 필요한 법개정을 권고했다. 특히 전기통신서비스의  가입자정보는 법원이 발부한 영장을 제시할 때만 수사기관에 제공되도록 하고 국정원의 통신수사를 감독할 수 있는 절차를 마련해야 하며 ‘기지국수사’가 자의적으로 이루어지지 않도록 보호 장치를 강화할 것을 권고했다.
 

또한 유엔 자유권 위원회는 형사상 명예훼손이 정부 행정을 비판하고 기업이익에 반하는 사람들의 기소에 이용되는 빈도가 높아지고 있다는 사실에 우려를 표했다. 오로지 ‘공익을 위하여’란 사실이 입증되지 않으면 진실한 언사마저도 형사처벌될 수 있다는 점에 대해서도 우려했다. 

 

유엔 자유권 위원회는 민법적 규제가 가능한 이상 명예훼손의 비형사화를 고려해야 하며, 형법의 적용은 가장 중한 사건들에 국한되어야 하고 자유형은 어떤 경우에도 적절한 형벌이 아님을 지적했다. 민주주의가 기능하기 위해 필요한 비판에 대해서 관용의 문화를 장려해야 함도 덧붙였다.

 

참여연대는 지난 9월 22일 대한민국 정부에 대한 유엔의 자유권 심사를 앞두고 “정보·수사기관이 전기통신사업자로부터 가입자정보를 영장 없이 제공받는 문제”와 “명예훼손죄의 비범죄화 문제”에 대해 보고서를 제출한 바 있다. 유엔 자유권 위원회는 대한민국 정부에게 2019년 11월까지 다음 국가 보고서를 제출할 것을 요구하였다. 따라서 정부는 다음 심의 때까지 법개정 등 필요한 조치를 성실히 이행해야 할 것이다. 

 

한편, 국회에는 현재 수사기관의 통신자료수집에 영장주의 도입과 수집 이후 정보주체에게 통지의무화를 주요 내용으로 하는 <전기통신사업법> 개정안, <통신비밀보호법>개정안이 상임위에 제출되어 있다. 또한 진실적시 명예훼손 폐지를 담고 있는 <형법>개정안도 제출되어 있다. 국회가 19대 임기를 마치기 전에 이를 통과시킬 것을 촉구한다.

The Committee notes with concern that according to Article 83 (3) of the Telecommunications Business Act subscriber information may be requested without warrant from any telecommunications business operator for investigatory purposes. It is also concerned about the operation and insufficient regulation in practice of so-called “base-station” investigations to identify participants at assemblies, and about the extensive use and insufficient regulation in practice of wiretapping, in particular by the National Intelligence Service (arts.17 and 21).

43. The State party should take the necessary legal amendments to ensure that any surveillance including for purposes of state security are compatible with the Covenant. 43. 당사국(대한민국)은 국가안보를 위한 감시를 포함한 모든 감시가 자유권규약에 부합하도록 보장하기 위해 필요한 법개정을 하여야 한다. 특히 가입자정보는 영장이 있을 때만 제공되도록 하고 국정원의 통신수사를 감독할 수 있는 장치를 마련해야 하며 기지국수사가 자의적으로 이루어지지 않도록 보호절차를 강화해야 한다.

46. The Committee is concerned about the increasing use of criminal defamation laws to prosecute persons who criticize government action and obstruct business interests, and of the harsh sentences, including lengthy prison sentences, attached to such legal provisions. It further notes with concern that even a statement which is true may be criminally prosecuted, except if this statement was made for the purpose of public interest alone (art. 19). 
46. 위원회는 형사상 명예훼손이 정부의 행위를 비판하거나 기업 이익을 방해하는 사람들의 기소에 이용되는 빈도가 높아지고 있음에 우려하며, 장기징역형을 포함하는 가혹한 형량에 대해서도 우려한다. 또 진실인 언사 마저도 오로지 공익을 위하여 구사되지 않는 한 형사처벌될 수 있다는 점에 대해서도 우려한다.

 


47. The State party should consider decriminalizing defamation, given the existing prohibition in the Civil Act and should in any case restrict the application of criminal law to the most serious of cases, bearing in mind that imprisonment is never an appropriate penalty It should ensure that the defence of truth is not subjected to any further requirements. It should also promote a culture of tolerance regarding criticism, which is essential for a functioning democracy.
47. 당사국은 민법에 의한 규제가 가능한 이상 명예훼손의 비형사화를 고려해야 하며, 형법의 적용은 가장 중한 사건들에 국한되어야 하며 자유형은 어떤 경우에도 적절한 형벌이 아니다. 진실의 항변에는 또다른 조건이 추가되어서는 아니된다. 민주주의가 기능하기 위해 필요한 비판에 대한 관용의 문화를 장려해야 한다. (후략)
