2월 4일 런던 시리아 공여국 회의 개최를 앞둔 가운데, 턱없이 부족한 국제적 지원과 레바논 정부의 차별 정책으로 인해 레바논의 난민 여성에 대한 착취와 인권침해를 더욱 부추기는 환경이 조성되고 있다고 국제앰네스티가 보고서를 통해 밝혔다.

보고서 <‘안전한 곳을 원해요’: 레바논에서 소외되고 보호받지 못하는 시리아 난민 여성(영문)>은 레바논 정부가 난민들의 체류 기간 연장을 거부하고, 국제적 재정 지원도 한계에 달하면서 불안정한 상황에 놓인 난민 여성들이 집주인과 고용주, 심지어 경찰과 같은 권력자들에 의해 착취당할 위험에 빠졌다고 지적하고 있다.

2015년부터 레바논은 유엔난민기구(UNHCR)를 통한 더 이상의 시리아 난민 수용을 중단하고, 난민들이 체류 기간을 연장하기 더욱 어려워지는 신규 규정을 도입했다. 합법적인 체류가 아닐 경우 임의 체포, 구금, 강제 송환까지 당할 수 있어 많은 난민이 인권침해 사실을 경찰에 신고하지 못하고 있다.

레바논에 거주하는 시리아 난민 가정 중 20%는 여성이 세대주다. 시리아에서 남편이 살해, 구금, 강제 실종, 또는 납치된 뒤로 여성이 가족의 생계를 책임지게 된 경우도 있다.

램지 조사관은 “레바논의 시리아 난민 대부분이 주로 절박한 상황에서 살아가고자 분투하고 있다. 식량이나 집, 일자리를 구하는 데도 만연한 차별과 큰 역경에 마주하게 된다. 이러한 상황에서 여성 난민들의 삶은 이보다 더 힘겨운 경우가 많은데, 특히 가족의 생계를 책임져야 하는 여성들은 직장과 거리에서 괴롭힘과 착취, 인권침해의 대상이 될 위험이 매우 크기 때문”이라고 말했다.

가난과 고용주, 집주인의 착취

시리아 난민 가정 약 70%가 레바논의 빈곤선에 한참 미치지 못하는 생활을 하고 있다. 시리아 난민 사태에 대한 유엔의 인도주의적 지원은 만성적인 재정 부족에 시달리고 있다. 지난해 유엔이 받은 국제 지원금은 레바논에서의 활동을 위해 필요하다고 요청한 액수의 57%에 불과했다. 이처럼 심각한 재정 부족으로 세계식량계획 역시 가장 취약한 난민들에게 제공하던 월간 식비를 2015년 중반부터 미화 30달러에서 13.5달러로 삭감해야 했다. 2015년 말 자금 투입으로 21.60달러로 인상되긴 했으나 하루 0.72달러에 불과한 금액이다. 국제앰네스티가 인터뷰를 나눈 여성 4명 중 1명은 지난해부터 식비를 받지 못했다.

많은 난민 여성들이 레바논의 높은 물가와 식비, 집세를 감당하기 어렵다고 했다. 이 때문에 난민 여성들은 착취의 대상이 될 위험에 노출되기 쉽다. 남성들이 부적절하게 성적인 접근을 하거나, 재정적 및 기타 지원을 대가로 성관계를 요구하는 경우도 있다고 한다.

난민 차별이 만연한 레바논에서 간신히 일자리를 구해 생계를 이어갈 수 있게 되더라도 난민 여성들은 고용주로부터 극도로 낮은 급료를 받으며 착취를 당하고 있다고 전했다. 시리아의 팔레스타인 난민 ‘하난(가명)’은 “고용주들은 우리가 절박한 상황에서 아무리 낮은 급료를 준다고 해도 받아들일 수밖에 없다는 걸 알고 있다”고 했다.

시리아에서 온 팔레스타인 난민인 56세 ‘아스마’는 베이루트 남부 교외에 있는 난민캠프 샤틸라에 거주하고 있다. 그녀는 딸들이 성추행을 당할까 걱정되어 직장에 다니는 것을 허락하지 않았다고 한다. “딸이 한 상점에서 일했었는데, 점장이 추행하고 만지기 일쑤였어요. 그래서 지금은 딸들에게 일하지 말라고 했습니다.”

고용주의 행동이 부적절하다고 느껴 직장을 그만두거나 일을 시작하지 않았다고 밝힌 여성들도 다수였다.

집세를 지불할 만큼 충분한 돈을 구하는 것도 상당히 힘든 일이다. 시리아 난민 최소 58% 이상이 임대아파트나 임대주택에 거주하고, 나머지는 다 허물어져 가는 건물이나 비공식 정착지에서 살아가고 있다. 그러나 많은 여성들이 지나치게 비싼 집세를 감당하지 못하고 결국 누추한 건물에서 살게 되었다고 말했다.

램지 조사관은 “적은 급료를 받고 일을 하거나, 불결하고 쥐가 들끓으며 물이 새는 집에서 사는 등, 재정적 불안정으로 인해 난민 여성들은 엄청난 어려움에 처하고, 권력자의 위치에 있는 사람들은 이들을 쉽게 이용할 수 있다”고 말했다.

합법적 지위 상실로 위험 더욱 커져

레바논 정부는 2015년 1월부터 번거로운 관료제적 절차와 비싼 비용을 부과해 난민들이 체류 기간을 연장하기 어렵게 하는 정책을 시행하고 있다. 합법적인 체류 허가가 없는 시리아 난민들은 체포될 것을 우려해 인권침해 사실을 경찰에 신고하지 못하는 경우가 많다.

국제앰네스티와 인터뷰를 나눈 난민 여성 대다수가 체류 허가가 없기 때문에 레바논 정부에 범죄를 신고하지 못한다고 밝혔다. 베이루트 인근의 난민캠프에서 딸 3명과 함께 사는 시리아의 팔레스타인 난민 ‘하난’은 버스 기사에게 성추행을 당했다고 경찰에 신고했지만, 거절을 당했다고 했다. ‘법적 지위’가 없으므로 신고할 자격이 없다는 것이다.

램지 조사관은 “인터뷰를 나눈 여성들이 체류 허가가 없다는 이유로 도움이나 보호를 요청할 곳이 아무 데도 없다는 사실 때문에 이들에 대한 괴롭힘과 착취가 더욱 심각해졌다는 것은 매우 명백하다”고 말했다.

또 다른 시리아 여성은 경찰에 알린 이후로 괴롭힘의 대상이 됐다고 밝혔다.

“한동안 경찰들이 우리 집 앞을 지나가거나 우리를 불러내면서 데이트를 하자고 말하곤 했어요. 우리 신고를 받았던 경찰관 3명과 같은 사람들이었죠. 합법적인 [체류] 허가가 없다는 이유로 우리를 위협했어요. 데이트해 주지 않으면 감옥에 보내겠다는 말도 했어요.”

레바논은 인구 1인당 수용하고 있는 난민 수가 세계에서 가장 많은 국가이며 국제사회가 충분한 지원을 하지 못하고 있는 것은 사실이지만, 이 때문에 난민을 착취와 인권침해로부터 보호하지 않는 것이 정당화될 수는 없다.

램지 조사관은 “몰려드는 난민으로 인한 레바논의 부담이 상당하긴 하지만, 이것이 정부가 엄격한 제한을 부과하고 난민을 위험으로 몰아넣을 정당한 이유라고 할 수는 없다”며 “레바논 정부는 공포와 위협이 만연한 분위기를 조성하기보다, 난민 여성들이 보호받을 수 있도록 보장하고, 레바논의 모든 난민이 제재 없이 쉽게 체류 기간을 연장할 수 있도록 시급히 정책을 수정해야 한다”고 말했다.

국제적 지원이 반드시 필요

레바논 난민에 대한 국제적인 재정 지원 부족은 난민 여성들을 가난과 불안정한 위치에 놓이게 하고, 이 때문에 더욱 큰 위험에 노출되게 만드는 직접적인 요인이다.

유엔난민기구는 각국에 수용된 시리아 난민 중 45만 명에 해당하는 최소 10%가 취약한 상태로, 다른 지역의 국가로 재정착해야 할 필요성이 시급하다고 파악했으며, 특히 여성들은 ‘가장 취약한’ 난민의 기준에 포함될 위험이 있다고 보고 있다.

국제앰네스티는 국제사회에 재정착지를 확충하고, 시리아 난민들에게 안전한 출국 경로를 제공할 것을 촉구한다.

더불어 재정 지원을 확대하고, 이번 주 개막하는 공여국 회의를 통해 유엔이 2016-2017년 시리아 위기를 지원하기 위해 요청한 기금을 채울 것을 약속해야 할 것이다.

캐트린 램지 조사관은 “유럽연합과 영국, 걸프 지역 국가와 미국 등 세계적인 부유국으로 꼽히는 국가들은 특히 다른 어느 국가보다도 난민 위기 해소를 위해 더 많은 역할을 해야 한다. 시리아와 난민들에 대한 인도적 지원을 확대함은 물론, 더욱 많은 난민을 재정착시킴으로써 난민 위기의 책임을 공유해야 할 것”이라며 “또한 레바논과 같은 난민 수용국과 공조해 난민이 합법적으로 체류 허가를 받고 필수 서비스를 받을 수 있도록 장벽을 제거해야 하며, 위험에 처한 여성을 포함해 모든 난민이 인권침해 대상이 되지 않도록 도와야 한다”고 말했다.

Syrian refugee women in Lebanon face heightened risk of exploitation and sexual harassment

Shortfalls in international assistance and discriminatory policies imposed by the Lebanese authorities are creating conditions that facilitate the exploitation and abuse of women refugees in Lebanon, said Amnesty International in a new report published ahead of the Syria Donors Conference in London on February 4.

The report, ‘I Want a Safe Place’: Refugee Women from Syria Uprooted and Unprotected in Lebanon, highlights how the Lebanese government’s refusal to renew residency permits for refugees and a shortage of international funding, leaves refugee women in a precarious position, and puts them at risk of exploitation by people in positions of power including landlords, employers and even the police.

“The combination of a significant shortage in international funding for the refugee crisis and strict restrictions imposed on refugees by the Lebanese authorities, is fuelling a climate in which refugee women from Syria are at risk of harassment and exploitation and are unable to seek protection from the authorities,” said Kathryn Ramsay, Gender Researcher at Amnesty International.

In 2015, Lebanon stopped the UN Refugee Agency (UNHCR) from registering any more Syrian refugees and introduced new regulations making it difficult for refugees to renew their residency status. Without proper legal status they face arbitrary arrest, detention and even deportation leaving many afraid to report abuse to police.

Twenty percent of Syrian refugee households in Lebanon are headed by women. In some cases women became the main income providers supporting the family after their husbands were killed, detained, forcibly disappeared or abducted in Syria.

“The majority of refugees from Syria in Lebanon – are struggling to survive in often desperate conditions. They face widespread discrimination and major obstacles in obtaining food, housing or a job. For women refugees surviving in such circumstances can often be even more difficult, with many – particularly women who are the heads of their households – at increased risk of harassment, exploitation and abuse at work and in the streets,” said Kathryn Ramsay.

Poverty, exploitation by employers and landlords

Around 70 percent of Syrian refugee families are living significantly below the Lebanese poverty line. The UN humanitarian response to the Syria refugee crisis has consistently been underfunded. Last year the UN only received 57 percent of the funds it requested for its work in Lebanon. The severe shortage of funds forced the World Food Program to reduce the monthly food allowance provided to the most vulnerable refugees from $30 to $13.50 in mid-2015. After an injection of funding in late 2015, it was increased to $21.60- just $0.72 a day. A quarter of the women Amnesty International spoke to had stopped receiving payments for food over the last year.

Many refugee women said they struggle to meet the high cost of living in Lebanon and to afford food or rent which has exposed them to greater risk of exploitation. Some said that they received inappropriate sexual advances from men or offers of financial or other assistance in exchange for sex.

In a climate of widespread discrimination against refugees in Lebanon, refugee women who managed to find jobs to support themselves reported being exploited by employers who paid excessively low wages.

“They know we will agree to whatever low wage they offer because we are in need,” said “Hanan” a Palestinian refugee from Syria whose name has been changed to protect her identity.

“Asmaa,” a 56-year-old Palestinian refugee from Syria living in Shatila, a refugee camp in Beirut southern suburbs said she did not permit her daughters to work for fear they would face harassment: “My daughter worked in a store. The manager harassed her and touched her. That is why I don’t let my daughters work now.”

Several women also said they had left a job or not taken a job because they felt the employers’ behavior had been inappropriate.

Finding enough money to pay for accommodation is another significant challenge. At least 58 percent of Syrian refugees live in rented apartments or houses, others live in dilapidated buildings and informal settlements. Yet many women said they were unable to afford the exorbitant rents and found themselves in squalid accommodation.

“Whether they are underpaid at work or living in dirty, rat-infested, leaking homes, the lack of financial stability causes immense difficulties for women refugees and encourages people in positions of power to take advantage of them,” said Ramsay.

Lack of legal status increases risks

Burdensome bureaucratic procedures and high costs for refugees to renew their residence permits, introduced by the Lebanese government in January 2015, have prevented many refugees from being able to renew their residency permits. Without a valid residence permit, refugees from Syria often fear arrest and fail to report abuse to the police.

The majority of refugee women who spoke to Amnesty International said the lack of a residence permit stopped them from reporting a crime to the Lebanese authorities. “Hanan,” a Palestinian refugee from Syria who lives in a refugee camp near Beirut with her three daughters, said she went to the police to complain when a bus driver harassed her and was turned away. They told her she was not eligible to present a complaint because she lacked “legal status.”

“It was very clear to the women we spoke to that the harassment and exploitation they face is made even worse by the fact they have nowhere to turn to for help and protection because they lack valid residence permits,” said Ramsay.

Another Syrian woman told Amnesty International said she became a target for harassment after going to the police: “After a while the police would pass by our house or would call us and ask us to go out with them. It was the same three police officers who took our report. Because we don’t have legal [residence] permits, the officers threatened us. They said that they would imprison us, if we didn’t go out with them.”

Lebanon has more refugees per capita than any other country in the world and the international community has failed to support the country, however this is no justification for not offering protection to refugees from exploitation and abuse.

“The influx of refugees has placed a considerable strain on Lebanon, but this is no excuse for the stringent restrictions the authorities have imposed on refugees which are putting them in danger,” said Ramsay. “Instead of contributing to the climate of fear and intimidation the Lebanese authorities must urgently amend their policies to ensure women refugees are protected, and that all refugees in Lebanon are able to easily renew their residence permits without restrictions.”

International support crucial

The lack of international funding and support for refugees in Lebanon is a direct factor contributing to the poverty and precarious circumstances of refugee women which has exposed them to greater risks.

UNHCR has identified at least 10 percent of the Syria refugee population in host countries, the equivalent of 450,000, as vulnerable and in urgent need of resettlement in another country outside the region. UNHCR considers women and girls at risk as among those who meet the criteria of “most vulnerable” refugees.

Amnesty International is calling on the international community to increase the number of resettlement places and other safe routes out of the region offered to refugees from Syria.

In addition, they must boost financial assistance and use this week’s donor conference to pledge to fulfil the UN’s funding requirements for assistance for the Syria crisis for 2016-2017.

“The world’s wealthiest countries, from the EU including the UK, Gulf states and the USA, among others all need to do much more to alleviate this crisis. As well as boosting humanitarian support to those in Syria and refugees in the region they must also offer to share responsibility for the crisis by resettling more refugees,” said Ramsay.

“They must also work with host countries such as Lebanon to remove barriers to legal registration for refugees and access to vital services and help ensure all refugees, including women at risk do not face abuse.”

지난 11월 14프랑스 파리에서 민간인에 대한 끔찍한 공격이 발생했다이에 프랑스는 테러와의 전쟁을 선포했다미국러시아 역시 테러를 뿌리뽑아야 한다며 시리아 폭격을 강화할 것이라 밝혔다그러나 그들 스스로가 벌이는 테러와의 전쟁이 바로 테러의 원인임을그들은 망각하고 있다.


우리는 파리 테러를 일으킨 이슬람국가(IS)가 탄생한 원인을 알고 있다미국은 2003년 후세인 정권을 축출하고 종파 간 분열 정책으로 점령에 대한 저항을 무력화하고자 하였다수니파 주민들이 해고되고 공직에서 추방되는 동안 미국은 시아파 세력들을 군과 정부 요직에 앉혔다수니파 주민들의 불만이 커졌고미국이 후원한 이라크 정부의 종파주의적 정책 때문에 종파 갈등은 전례 없는 수준으로 격화했다이라크인들은 2012년 말 이라크의 봄’ 등의 운동을 통해 거듭 종파적 갈등을 극복하려 했지만 그때마다 돌아온 것은 이라크 정부의 가혹한 탄압이었다이런 불만 속에 생겨난 것이 바로 수니파 이슬람주의 조직, IS.


시리아 내전 상황은 매우 복잡하다. 45년간 독재를 해온 아사드 정권과 2011년 민중봉기 때부터 아사드에 맞서 온 반군 세력이 있다여기에 IS가 세력을 넓힌 상황이다복잡한 갈등선과 이에 따른 상호간의 증오테러 행위를 외세의 군사적 개입으로 해결할 수 있는가이라크에서의 실책을 반복하지 않는다는 근거가 대체 어디에 있는가?


오바마 미 대통령은 자신만만하게도 이라크전쟁을 반면교사로 삼아야 하고시리아에는 절대 지상군을 투입하지 않겠다고 밝힌 바 있다그러나  이미 특수부대파견을 결정하는 등 자신의 말을 뒤집었다현재 미국과 러시아프랑스의 폭격은 IS와 민간인을 가리지 않은 채 진행되고 있다얼마 전 국내 언론의 인터뷰에서도 국내 거주 시리아인이 땅에서는 IS가 괴롭히지만정부군과 미국과 러시아의 비행기 폭격까지 받아서 불안한 상황이라 증언하기도 했다폭격은 외부 세력은 시리아 사람들을 죽이러 왔고당신들을 지켜줄 사람은 우리밖에 없다고 선전하는 IS의 세력을 키워주고 있다.


지상군 투입 역시 대안은 아니다많은 군사 전략가들이 ‘IS는 시리아 내전의 효과일 뿐이라며 좀 더 강력하게 개입해야 한다고 주장한다그러나 이라크와 아프가니스탄에서 봤듯이 지상군 투입은 해당 지역을 안정시키지는커녕 현지인들의 고통만 가중시킬 뿐이다심지어 내전을 더욱 확장시킬 위험도 있다.


국제사회가 힘을 합쳐 시리아 내전의 정치적 해법을 내면 문제가 해결될 것이라는 주장이 있다그러나 이 역시 실패할 가능성이 크다당장 미국과 러시아는 아사드 정권의 존치 문제로 대립하기 때문이다. 11월 14일 파리 테러 직후 각국 외무장관들이 모인 시리아 국제회의에서 내년 1월까지 내전 당사자들이 정전협약을 맺게 하고 과도정부 구성 및 UN 주관 하의 선거를 실시한다고 합의했지만그 과정에서 평범한 시리아인들의 의견은 철저하게 무시됐다현지인들의 바램과 의견을 무시한 채 총칼로는 질서를 세울 수 없다는지난 15년 간 미국의 대테러전쟁이 남긴 교훈을 우리는 똑똑히 기억해야 한다시리아인들은 자신들이 원하는 사회를 자신들의 손으로 만들 능력과 권리가 있다.


한편한국의 박근혜 대통령은 G20 정상회의에서 테러리즘은 암적 존재라며 ‘"폭력적 극단주의 대응역량을 강화할 것이라 밝혔다이미 한국은 파병으로 미국의 이라크 점령을 지원했고, 1년여 전부터 미국의 시리아·이라크 개입을 재정적으로 지원함으로써, IS가 지목한 십자군 동맹의 일원으로 언급되고 있다한국인들의 안전보다 전쟁 지원을 더 우선시하겠다는 것이다이미 국군 동명부대는 IS의 활동 반경에 포함되는 레바논에 주둔 중이라 전혀 안심할 수 없는 상황인데도더 많은 파병을 부추길 국군해외파병법을 정부와 여당이 계속해서 조금씩 밀어붙이는 것도 불길하다.


또한 시리아 난민 사태에 대해서는 국제 인도주의 체제 전반에 심각한 도전이고 부담과 책임을 국제사회가 함께 공유해야 하며 한국은 인도적 지원을 확대하겠다고 밝힌 바 있다그러나 박근혜 대통령이 내놓은 해결책은 테러방지법으로 시민사회에 대한 통제를 강화하고 난민을 잠재적 범죄자 취급하는 것이었다.


파리 테러를 빌미로 대테러방지법안을 통과시켜야 한다는 주장이 나오고 있다이미 정부는 10여 년 전부터 국정원 기능을 대폭 강화하는 것을 골자로 한 테러방지법 제정을 시도해 왔다이번에 논의되는 테러방지법도 대테러활동 실무를 집행하는 대테러센터를 국가정보원장 소속으로 설치하고 각종 금융거래 및 통신정보를 수집하고 위험인물을 추적할 수 있게 만든다고 한다그러나 이는 과거 대선 개입 의혹개인정보 감청 의혹조차 해소하지 못한 국정원의 권한을 대폭 확대하는 것이다또한 박근혜 대통령은 11월 14일 민중총궐기에 나선 시민들을 IS에 빗대며 이들을 마치 잠재적인 테러리스트인 것처럼 취급하기도 했다이런 상황에서 대테러방지법과 정부여당이 준비 중인 관련 법안들이 통과된다면 시민사회에 대한 무제한적인 감시와 탄압이 자행될 공산이 크다집회 및 시위정치적 행동에 대한 최소한의 민주적 권리조차 없애려는 이러한 시도는 반드시 중단되어야 한다.우리는 테러 위험에서 벗어나는 진정한 방법은 테러방지법 제정이 아니라 정부가 중동 등지의 전쟁을 지원하는 정책을 포기하는 것임을 분명하게 밝힌다.


11월 18이병호 국정원장은 시리아 난민 200명이 왔고 65명은 공항에서 대기 중인데 철저히 감시하고 있다’, ‘국내에서도 이슬람 노동자 중에서 IS에 호감이 있는 사람이 발견되고 있다며 마치 시리아 국적자와 무슬림 모두를 잠재적 테러리스트 취급을 하는 발언을 했는데심지어 법무부가 오보 취지로 별도의 설명자료를 내야 할 만큼 사실관계조차 허점이 많았다또한 같은 날 알 카에다의 시리아 지부인 알 누스라 전선을 추종했다며 인도네시아 이주노동자를 체포하기도 했다그러나 증거는 고작 알 누스라 전선의 깃발을 들고 찍은 사진과 집에서 발견된 장난감 BB탄 총 뿐이었다테러와 어떠한 연관이 있는지조차 제대로 밝히지 않은 채 이주민을 마녀사냥하는 것은 정부의 진정한 목적이 따로 있다는 것을 보여 준다.

네팔 정부가 6월 22일부로 지진피해 구호 기간을 선포하면서, 비용과 시간이 많이 드는 통관 절차를 거부하겠다고 결정한 것은 가장 소외된 사람들에게 절박하게 필요한 구호물자를 제공하지 못하는 결과로 이어질 수 있다고, 국제앰네스티가 25일 열리는 네팔 재건에 관한 국제회의를 앞두고 밝혔다.

여성과 어린이, 카스트 제도의 최하층인 달리트 계급, 선주민, 오지 주민들은 재건 과정에서 소외될 위험이 가장 큰 사람들이다.

리처드 베넷(Richard Bennett) 국제앰네스티 아시아국장은 “수많은 네팔 국민들이 여전히 지진 구호 물자가 절실히 필요한 상태다. 네팔 정부가 지적한 바와 같이, 우기가 시작되었는데도 수만 명은 여전히 적절한 피난처조차 없고, 농작물 추수까지는 3개월을 더 기다려야 하기 때문에 식량도 결코 충분하지 않은 상황”이라며 “가장 절실한 사람들에게 구호물자가 제공되는 것이 무엇보다 우선되어야 한다. 긴급 구호 물자의 반입을 신속하게 하려면, 일반 통관 절차를 포기하는 것이 마땅할 것”이라고 밝혔다.

유엔 발표에 따르면, 지난 4월 25일 발생한 대지진과 그 여파로 가장 큰 피해를 입은 14개 지역에서 약 280만 명이 인도적 지원을 필요로 하는 상태다. 약 80만 채의 가옥이 더 이상 주거가 불가능한 상태가 되었고, 10만 명 이상이 임시 거주지에서 생활하고 있지만, 이보다 훨씬 더 많은 수의 이재민들이 파괴된 집 근처에 임시 거처를 짓거나 친척과 함께 살고 있다.

주로 선주민에 속하는 수만 명은 대부분 도보 또는 헬리콥터로만 갈 수 있는 북부의 오지에 살고 있다. 이들은 응급주택의 생산 부족과 반입량 병목현상으로 최소한의 지원만을 받는 데 그치고 있다. 산사태로 인해 이주를 해야 하는 마을도 많다.

네팔 정부는 특히 여성과 어린이들이 성폭력과 인신매매, 조혼, 아동노동의 위험에 더욱 노출되고 있다고 경고했다.

국제앰네스티는 6월 2일 발표한 브리핑을 통해, 일부 개인과 단체가 사회 및 정치적 연줄을 이용해 구호물자를 받는 데 더욱 이익을 취하고 있으며 정작 가장 필요로 하는 사람들에게는 전달되지 못하고 있는 실태를 관찰했다.

국제앰네스티는 공여국들에게 구호에서 회복 절차로의 점진적 이행 과정을 효과적으로 모니터링하고, 가장 절박한 사람들이 간과되지 않도록 할 것을 촉구했다. 또한 네팔 국립인권위원회와 여성아동복지부가 공동 운영하고, 지진 피해자 인권 보호를 위해 인도주의적으로 대응하는 ‘보호영역(Protection Cluster)’ 협력단체에 대해 더욱 직접적인 지원을 제공해야 한다.

리처드 베넷 국장은 “재건사업이 엄청난 난관이라는 점을 인정하며, 공여국들은 중요한 역할을 수행하게 될 것이지만, 그 과정이 구호물자의 반입 경로를 축소해가면서까지 이루어져서는 안 된다. 가장 절박한 처지의 사람을 도움으로써 인권 보호라는 공동 책임을 함께 나누는 것이 인도주의적 원칙임에는 변함이 없다”고 말했다.

Nepal: Reconstruction must not leave behind those most affected by the earthquake

The Nepali government’s decision to declare the post-earthquake relief period over as of 22 June, along with its refusal to waive costly and time-consuming customs duties and procedures, could leave the most marginalized people without access to desperately needed aid, Amnesty International said ahead of tomorrow’s International Conference on Nepal’s Reconstruction.

Women, children, Dalits, Indigenous Peoples and those in very remote areas are most at risk of being left behind.

“Countless people in Nepal are still in desperate need of relief following the earthquake. As the government has pointed out, hundreds of thousands still lack adequate shelter even as the monsoon has started, while food is by no means secure for people who must wait another three months for the next harvest,” said Richard Bennett, Asia Director at Amnesty International.

“Getting aid to those who need it most must be the top priority. In order to expedite the import of emergency relief materials, particularly for shelter, the government should waive normal customs duties.”

According to the UN, some 2.8 million people remain in need of humanitarian assistance in 14 of Nepal’s most severely affected districts following the 25 April earthquake and its aftershocks. Nearly 800,000 homes are no longer habitable. More than 100,000 people are living in temporary settlements, but a much larger number of homeless are living in makeshift shelters near their destroyed homes or with relatives.

Hundreds of thousands, mainly members of indigenous communities, live in remote northern areas, many of which are only accessible on foot or by helicopter. They have received minimal assistance for emergency housing, due in part to production shortages and bottle-necks on imports. Many communities may face relocation due to landslides.

The Nepali government has warned that women and children in particular face a growing risk of sexual and gender-based violence, human trafficking, child marriage, and child labour.

In a briefing released on 2 June, Amnesty International observed that some individuals and groups benefitted from social and political connections in receiving aid, rather than it being delivered to those most in need.

The organization called on donors to ensure effective monitoring of a gradual transition from relief to recovery, ensuring that those most in need are not left behind. This should include more direct support to the Protection Cluster, the coordinating body co-led by the National Human Rights Commission and the Ministry of Women, Children and Social Welfare, responsible for ensuring that the humanitarian response protects the human rights of victims.

“We appreciate the enormous challenge of reconstruction and donors will play a crucial role in this – but this must not be at the expense of narrowing the channels of relief. The humanitarian imperative has not changed: we all share the collective burden of protecting human rights by assisting those most in need,” said Richard Bennett.

2016년 1월 1일 이후 최소 52명에게 사형을 선고했던 이라크는 2월 18일 바그다드에서 높은 관심 속에 진행된 반 테러 재판에서도 사형을 선고하며 40명의 사형수가 새로 추가됐다.

제임스 린치(James Lynch) 국제앰네스티 중동북아프리카 부국장은 “이라크 법원이 단 6주 만에 92건의 사형을 선고한 것은 이라크 사법제도의 현 상황을 보여주는 안타까운 지표”라며 “많은 피고인들이 재판 과정에서 범죄를 ‘자백’하라며 고문을 당했다고 주장하는 등 대다수의 재판이 매우 불공정하게 이루어졌다. 이와 같은 의혹에 대해 시급히 조사를 진행하고, 공정재판에 대한 국제기준이 명시한 바에 따라 재심이 이루어져야 할 것”이라고 말했다.

이날 재판은 2014년 티크리트 근방 스파이커 부대에서 무장단체 자칭 ‘이슬람국가(IS)’ 소속 조직원들에 최소 1,700명 이상이 무참히 살해되었던 ‘스파이커 기지 참사’ 사건의 관련자 47명에 대한 것이었다.

이라크 연방법무부는 이들 중 40명에게 2005년 제정된 반테러법(anti-terrorism law)에 따라 사형이 선고됐고, 7명은 증거 부족으로 석방되었다고 확인했다.

‘스파이커 기지 참사’ 사건과 관련해 이라크 정부가 구속영장을 발부한 것만 600건이 넘는다. 이라크중앙형사재판소(CCCI)는 ‘스파이커 참사’와 관련된 모든 사건을 통합해 한 사건으로 다룰 예정이라고 발표하며 집단 재판의 가능성을 시사했다.

2014년 7월에는 2005년 제정된 테러방지법에 따라 ‘스파이커 참사’ 사건의 관련자 24명에게 교수형이 선고됐다.

국제앰네스티는 이라크 정부에 사형 선고 승인을 중단할 것과, 즉시 사형 폐지를 위한 사형집행 유예를 공식적으로 선포할 것을 촉구한다.

배경
이라크에서는 사형이 선고되려면 대통령의 승인이 필요하다. 잘랄 탈라바니 전 이라크 대통령은 모든 사형 선고에 대해 승인을 거부하면서 600건 이상이 계류되기도 했다.

지난해 취임한 푸아드 마숨 대통령은 스파이커 참사를 계기로 사형 선고를 승인하라는 국회와 여론의 상당한 압박에 시달렸고, 대통령 집무실에 계류 사건을 전담하는 특별위원회가 설치되었다. 2015년 7월 국제앰네스티는 마숨 대통령에 사형 집행으로 이어지게 될 사형 선고 승인을 중단할 것을 요청했다. 이렇게 사형이 선고된 사람 중 많은 수가 매우 불공정한 재판을 거쳤다.

Iraq: Shocking surge in 2016 death sentences tops 90 as ‘terror’ trial closes

The 40 death sentences handed down today in Iraq after a fundamentally flawed mass trial show a reckless disregard for justice and human life, said Amnesty International and brings the total sentenced in 2016 close to 100.

Iraq’s courts have imposed at least 52 death sentences since 1 January 2016. Today a further 40 individuals were sentenced to death as the verdict of a high-profile anti-terror trial is delivered in Baghdad.

“For Iraqi courts to hand down 92 death sentences in just six weeks is a grim indicator of the current state of justice in the country,” said James Lynch, Amnesty International’s Middle East and North Africa Deputy Director.

“The vast majority of the trials have been grossly unfair, with many of the defendants claiming to have been tortured into ‘confessing’ the crimes. These allegations must be urgently investigated and a re-trial that meets international fair trial standard should be ordered.”

Today’s trial involved 47 individuals accused of involvement in the Speicher massacre, in which at least 1,700 military cadets from Speicher Military camp, near Tikrit, were brutally killed by militants from the armed group calling itself Islamic State (IS) in June 2014.

Iraq’s Federal Judicial Authority confirmed that 40 people were sentenced to death under the 2005 anti-terrorism law and seven were released due to lack of evidence.

More than 600 arrest warrants were issued by the Iraqi authorities in connection with the Speicher massacre. The Central Criminal Court of Iraq (CCCI) went on to announce that it would consolidate all cases relating to the Speicher crimes into one case – opening the door to mass trials.

In July 2014, 24 men were sentenced to death by hanging under the 2005 Anti-Terrorism Law in connection with the massacre.

“These mass, expedited trials raise serious questions about whether the Iraqi authorities really want to uncover the truth behind these abhorrent attacks, or whether they simply want to create the illusion that justice has been done. Once again we are seeing basic human rights trampled upon as the authorities circumvent fair trials in the name of national security,” said James Lynch.

Amnesty International is calling on the Iraqi authorities to halt the ratification of death sentences and immediately establish an official moratorium on executions with a view to abolishing the death penalty.

Background

Before a death sentence can be carried out, the President of Iraq must ratify it. Former President Jalal Talabani refused to ratify any death sentences leading to a backlog of more than 600 cases.

Last year, the new President Fuad Ma’sum came under significant pressure from MPs and the public to ratify death sentences, particularly following the Speicher massacre. A Special Committee was set up in the Presidency Office to manage the backlog. In July 2015 Amnesty International called on the Iraqi President to halt the ratification of death sentences that would pave the way for executions. Many of those sentenced to death have been subject to grossly unfair trials.

박근혜 대통령 측이 국회의 탄핵소추 사유를 부정하면서 탄핵이 종북과 친노세력에 의해 추진됐다는 새로운 논리를 내세웠다.

1월 5일 열린 박근혜 대통령 탄핵심판 2차 공개변론에서 대통령 측은 촛불집회를 종북세력이 주도하고 있다고 주장했다. 이러한 주장의 근거로 집회를 민주노총이 주도했고, 현장에서 불리는 노래 중 하나의 작곡가가 김일성을 찬양한 전력이 있다는 점을 들었다. 대통령 측은 촛불은 “도심을 무법천지로 만든, 대한민국에 대한 선전포고”라고 주장했다.

국회 소추위원단 박주민 의원은 이러한 주장에 대해 “박근혜 대통령 지지층을 결집시키는 의미가 있는 색깔론이고 정치적인 공세”라고 평가했다. 이날 공개변론을 방청한 유윤식 씨(서울 대치동)는 “피청구인측 대리인이 종북 프레임을 가지고 이념 갈등을 유발했다”며 “이 얘기를 들으러 아침부터 추위에 고생을 했나 자괴감이 든다”고 말하기도 했다.

대통령 측은 박근혜-최순실 게이트의 진실 규명을 주도해온 언론도 종북세력으로 평가했다. “북한 노동신문이 남한 언론을 가리켜 정의와 진리의 대변자라고 칭찬하고 있다”며 북한 신문이 극찬하는 언론 보도를 증거로 채택한다면 중대한 헌법위반이라고 주장했다. 대통령 측은 앞으로 모든 언론 보도의 증거 채택에 동의하지 않을 것이라고 말하면서 재판부가 이미 증거로 채택한 언론보도도 철회하고 싶다고 덧붙였다.

대통령 측은 검찰과 특검수사에 대해서는 친노세력이 주도했다는 주장을 내놓았다. 검찰 특별수사본부의 본부장을 맡은 이영렬 서울중앙지검장에 대해서는 노무현 정부 때 사정비서관이었던 경력을 문제 삼았다. 특검의 윤석열 수사팀장에 대해서는 노무현 정부에서 검사로 특별 채용된 경력을 언급하며 수사가 공정하지 못하다고 주장했다. 검찰과 특검 수사는 친노세력이 주도한 편향된 수사이므로 받아들일 수 없다는 주장으로 해석된다.

당초 2차 변론에서 채택된 증인은 이재만, 안봉근, 이영선, 윤전추 등 4명이지만, 이날 증인 신문은 윤전추 행정관 1명에 대해서만 진행됐다. 이재만, 안봉근 전 비서관은 사실상 잠적 상태로 증인출석요구서조차 송달되지 못했다. 재판부는 이들에게 한 번 더 출석을 요구할 예정이지만 출석 여부는 불투명하다.

학교를 대상으로 사우디아라비아 주도 연합군이 여러 차례 공습을 가하면서 국제인도법을 위반하고, 예멘 어린이 수천 명의 교육받을 기회를 가로막고 있다고 국제앰네스티가 11일 새롭게 발표한 브리핑을 통해 밝혔다. 사우디 주도 연합군은 미국과 영국 등의 국가로부터 무기 공급을 받고 있다.

브리핑 <‘폭격 당한 아이들’: 공격받는 예멘 학교>는 예멘 현지 조사를 바탕으로, 2015년 8월과 10월 사이 학교를 대상으로 5차례의 공습이 벌어져 민간인 5명이 숨지고 어린이를 포함해 14명이 다친 사건에 대해 다루고 있다. 공습 당시 학교에 학생들은 없었지만, 폭격으로 인해 학교 건물이 심각한 피해를 입거나 파괴되면서 학생들에게 장기적인 영향을 미치게 되었다.

최근 예멘 현지 조사를 마치고 돌아온 라마 파키흐(Lama Fakih) 국제앰네스티 위기대응 상임고문은 “사우디아라비아 주도 연합군은 군사적인 목적이 아닌 교육적 목적으로 운영되던 학교를 대상으로 연이어 불법 공습을 가했고, 이는 명백한 전쟁법 위반”이라며 “학교는 주민들의 삶에 중심적인 존재로, 어린이들에게 안전한 공간이어야 한다. 예멘의 어린 학생들은 강제로 이러한 공습의 대가를 치르게 되었다. 혹독한 분쟁을 견뎌야 하는 것만으로 모자라, 장기간 교육을 받지 못한다는 격변과 혼란에 직면한 것이다. 아마도 평생 동안 감당해야 할 부담이 될 것”이라고 밝혔다.

어떤 학교는 공습을 한 번 이상 당한 경우도 있어, 이러한 공습이 의도적으로 학교를 노려 이루어졌음을 시사하고 있다.

파키흐 상임고문은 “군사적 표적이 아닌 학교를 의도적으로 공격하고, 적대행위에 참여하지 않은 민간인에게 직접 공격을 가하는 것은 전쟁범죄”라고 말했다.

사나아 지역과 하자, 호데이다 지역의 학교들이 피해를 입으면서 6,500명이 넘는 학생들의 학교 교육이 심각한 차질을 겪게 되었다. 어떤 지역은 유일한 학교가 파괴되기도 했다. 5건의 공습 모두 피해 학교가 군사적 목적으로 이용되었다는 증거는 전혀 발견되지 않았다.

2015년 10월 사나아 지역 베니 후샤야시의 ‘과학과 신앙’ 학교는 불과 수 주 만에 4차례의 공습을 당했다. 그 중 3번째 공격은 민간인 사망자 3명과 10명 이상의 부상자를 냈다. 마을에 단 하나뿐이었던 이 학교는 학생 1,200명의 배움터였다.

하드란 마을의 케이르 학교 역시 여러 차례 공습을 당하면서 재건이 불가능할 정도로 큰 피해를 입었다. 이 마을은 학교 외에도 민간 주택 2채가 폭격을 당해 어린이 2명이 숨지고 그 어머니가 부상을 입었으며, 근처 이슬람 사원 역시 폭격으로 기도를 하고 있던 남성 1명이 숨지고 1명이 다치기도 했다.

국제앰네스티는 이번 브리핑에서 다룬 5건의 공습에 대해 독립적이고 공정하게 조사할 것과 책임자를 처벌할 것을 촉구했다. 또한 불법 공습으로 인한 피해자와 그 가족들에게 충분한 보상을 제공할 것을 연합군에 요청했다.

파키흐 상임고문은 “불법 공습으로 의심되는 사례가 계속해서 증가하고 있음에도 사우디아라비아 주도 연합군과 그 지원국들이 이를 조사하지 않는 것은 이번 전쟁이 예멘 민간인들에게 초래한 참담한 결과를 냉담히 무시하고 있음을 시사한다”며 “다음 주 예정된 평화회담의 결과와는 상관없이, 이러한 불법 공습에 대한 독립적인 조사에 착수하고 책임자를 처벌하는 것이 무엇보다 중요하다”고 말했다.

이번 분쟁으로 예멘의 교육제도 전반이 피해를 입고 있다. 유엔아동기금(UNICEF)에 따르면 예멘 어린이의 최소 34%가 2015년 3월 첫 공습이 시작된 이후 학교에 가지 못했다. 사나아에 위치한 예멘 교육부가 국제앰네스티에 제공한 자료에 따르면 학교 254곳은 완전 파괴, 608곳은 부분적으로 피해를 입었으며 421곳은 분쟁으로 국내실향민이 된 사람들을 수용한 탓에 현재 운영되지 못하는 학교는 1,000곳이 넘는다.

학교에 대한 공습은 사상자를 발생시킬 뿐만 아니라 주민들을 공포로 몰아넣고, 학생들이 심리적 트라우마를 겪는 원인이 되고 있다.

“지금 우리는 두려움과 공포 속에서 살고 있어요. 오늘도 비행기를 봤는데 너무 무섭고 겁이 났어요.” 지난 8월 연합군의 폭격으로 파괴된 호데이야 시 만수리야 마을의 알아스마 학교에 다니던 12세 어린이의 말이다.

호데이야 시에 위치한 또 다른 학교인 알샤이메 여학교는 학생 3,200명을 수용하던 곳으로, 이 학교의 교장은 2015년 8월 며칠 사이에 연달아 2번 폭격을 당하면서 2명이 숨졌던 당시의 공포를 이렇게 전했다. 공습 당시 학생들은 학교에 없었지만 이로 인해 남성과 여성 각각 1명이 숨졌다.

“인간성의 종말이라고 생각했어요. 배움의 전당인 학교가 이런 식으로 사전 경고도 없이 폭격을 당하다니… 인간성이란 건 어디 있나요? … 이런 장소를 폭격하는 건 어떤 전쟁이라도 불법이에요.”

공습에 앞서 소셜미디어를 비롯한 온라인상에서 학교가 무기 저장고로 사용되고 있다는 내용의 루머가 퍼졌으나, 교장은 이러한 루머가 사실이 아니며, 이에 따라 학교 전체를 수색했지만 무기는 전혀 발견되지 않았다고 국제앰네스티에 밝혔다.

예멘에서 여러 분쟁 당사자들이 학교를 군사적 목적으로 이용하는 경우는 상당수 있었지만, 이번 브리핑에서 다룬 5건의 사례에서는 무기의 흔적이나 2차 폭발의 증거, 이외에 군사적 목적으로 사용되었음을 암시하는 증거를 전혀 찾을 수 없었다.

정부군과 비정부 무장단체 모두 군사적 목적 또는 인근의 군사 작전을 위해 학교를 이용하는 것을 자제하고, 이 때문에 학교가 정당한 군사적 목표 또는 공격 대상이 됨으로써 민간인을 위험에 빠뜨리고 어린이 교육에 장기적으로 부정적인 영향을 미치지 않도록 해야 한다.

올해 초 채택된 무력분쟁 시 어린이에 관한 유엔 안전보장이사회 결의안 2225호는 분쟁의 모든 당사자에 대해 “학교의 민간적 특성을 존중”할 것을 촉구하고, 또한 학교를 군사적으로 이용할 경우 학교가 국제법상 정당한 공격 대상이 됨으로써 어린이의 안전을 위협할 수 있다는 점에 대해 심각한 우려를 표하고 있다.

국제앰네스티의 이번 브리핑 역시 미국, 영국 등 사우디아라비아 주도 연합군에 무기를 공급하는 모든 국가에 대해, 전쟁범죄 등 국제법 위반행위를 저지르는 데 이용될 무기의 이전을 모두 시급히 중단해야 한다고 강조하고 있다. 특히, 연합군에 무기를 공급하는 국가들은 범용 폭탄과 전투기, 전투헬리콥터 및 관련 부품과 구성요소의 이전을 중단해야 한다.

지난달 미국 국방부는 사우디아라비아에 MK89 시리즈의 범용 폭탄을 포함해 총 12억 9,000만달러 규모의 무기 이전을 승인했다. 해당 무기가 불법 공습에 이용되어 민간인 사망자 수백 명을 발생시켰다는 국제앰네스티의 발표에도 불구한 일이었다.

파키흐 상임고문은 “사우디아라비아 주도 연합군 소속 국가들이 전쟁법과 국제인도법을 위반하고 있다는 명백한 증거가 있음에도 미국을 비롯한 동맹국들이 이들에 대한 무기이전을 허가하고 있다는 것은 그야말로 충격적인 일이다. 이러한 무기 이전은 모두 즉시 중단되어야 한다”고 말했다.

영국과 같은 무기거래조약의 당사국들은 이전된 무기가 민간인, 민간 표적을 공격하거나 국제인도법을 위반하는 데 쓰인다는 것을 알고 있을 경우 이러한 무기의 이전을 허가하는 것이 금지되어 있다.

Bombing of schools by Saudi Arabia-led coalition a flagrant attack on future of Yemen’s children

Saudi Arabia-led coalition forces have carried out a series of air strikes targeting schools that were still in use, in violation of international humanitarian law, and hampering access to education for thousands of Yemen’s children, said Amnesty International in a new briefing published today. The coalition forces are armed by states including the USA and UK.

The briefing ‘Our kids are bombed’: Schools under attack in Yemen, investigates five air strikes on schools which took place between August and October 2015 killing five civilians and injuring at least 14, including four children, based on field research in Yemen. While students were not present inside the schools during the attacks, the strikes caused serious damage or destruction which will have long-term consequences for students.

“The Saudi Arabia-led coalition launched a series of unlawful air strikes on schools being used for educational – not for military – purposes, a flagrant violation of the laws of war,” said Lama Fakih, Senior Crisis Advisor at Amnesty International who recently returned from Yemen.

“Schools are central to civilian life, they are meant to offer a safe space for children. Yemen’s young school pupils are being forced to pay the price for these attacks. On top of enduring a bitter conflict, they face longer term upheaval and disruption to their education – a potentially lifelong burden that they will be forced to shoulder.”

In some cases the schools were struck more than once, suggesting the strikes were deliberately targeted.

“Deliberately attacking schools that are not military objectives and directly attacking civilians not participating in hostilities are war crimes,” said Lama Fakih.

The damage has severely disrupted the schooling of the more than 6,500 children who attend classes at the schools in Hajjah, Hodeidah and Sana’a governorates. In certain cases the schools had been the only ones in the area. No evidence could be found in any of the five cases to suggest the schools had been used for military purposes.

In October 2015 the Science and Faith School in Beni Hushayash, Sana’a was attacked on four separate occasions within the space of a few weeks. The third strike killed three civilians and wounded more than 10 people. The school, which was the only one in the village, was providing education to 1,200 students.

The Kheir School in the village of Hadhran, Beni Hushaysh, also suffered multiple air strikes causing extensive damage rendering it unusable. Other air strikes on the same village struck two civilian homes, killing two children and injuring their mother, and a nearby mosque, killing one man and injuring another, who were praying at the time of the attack.

Amnesty International is calling for the five attacks highlighted in this briefing to be investigated independently and impartially and for those responsible to be held accountable. It is also asking the coalition to provide full reparation to victims of unlawful attacks and their families.

“The lack of investigations by the Saudi Arabia-led coalition, and those who provide them with arms and other support, into a growing list of suspected unlawful attacks suggests a chilling apathy for the devastating consequences this war has wrought on civilians in Yemen,” said Lama Fakih.

“Regardless of the outcome of planned peace talks next week it is crucial that independent investigations into these and other unlawful strikes are undertaken and that those responsible are held to account.”

The country’s entire education system has suffered as a result of the conflict. According to UNICEF (United Nations International Children’s Emergency Fund) at least 34% of children in Yemen have not been to school since the air strikes first began in March 2015. The Sana’a based Ministry of Education has also shared data with Amnesty International reflecting that more than 1,000 schools are out of operation: 254 completely destroyed, 608 partially damaged and 421 being used as shelters for people internally displaced by the conflict.

As well as killing and injuring people, the attacks on schools have terrified civilians and caused students to suffer psychological trauma.

“Right now we are living in fear and terror. Today I saw the plane and I was very afraid and terrified,” said one 12-year-old child who attends al-Asma school in Mansouriya, Hodeidah which was destroyed in a coalition bombing in August.

The director of another school in Hodeidah city, the al-Shaymeh Education Complex for Girls, which catered for some 3,200 students described her horror after the school came under attack twice within a matter of days in August 2015 killing two people. No students were present at the school during the attack, but a man and woman were killed.

“I felt that humanity has ended. I mean, a place of learning, to be hit in this way, without warning… where is humanity? …It is supposed to be illegal in any war to strike such places,” she said.

Prior to the attack, rumours had circulated online, including in social media, suggesting the school had been used to store weapons, but the director told Amnesty International this was untrue and that the school had been searched following the rumours- no weapons were found.

Although there have been occasions where schools in Yemen have been used for military purposes by the various parties to the conflict, in all five of the cases highlighted in this briefing no weapon remnants, evidence of secondary explosions or any other evidence was found by Amnesty International to indicate that the schools had been used for military purposes.

Both state and non-state armed groups should refrain from using schools for military purposes or operating nearby, which can have the effect of making them schools lawful military targets and subject to attack, consequently putting civilians at risk and having long-term adverse impact on children’s access to education.

UN Security Council Resolution 2225 on children in armed conflict adopted earlier this year calls on all parties to conflict to “respect the civilian character of schools” and also expresses serious concern that the military use of schools may render them legitimate targets of attack under international law and would endanger the safety of children.

Amnesty International’s briefing also highlights the urgent need for all states who supply arms to the Saudi Arabia-led coalition, including the USA and UK, to suspend all transfers of weapons which are being used to commit violations of international law, including war crimes, to those carrying out attacks. In particular, states supplying arms to coalition forces should suspend transfers of general purpose bombs, fighter jets, combat helicopters and their associated parts and components.

Last month the US State Department approved an arms transfer worth $1.29 billion to Saudi Arabia, which includes the transfer of general purpose bombs from the Mark/ MK89 series, despite the fact that Amnesty International has documented their use in unlawful air strikes that have killed scores of civilians.

“It is simply appalling that the USA and other allies of the Saudi Arabia-led coalition have continued to authorise arms transfers to members of the coalition, despite the clear evidence that they are not complying with the laws of war – international humanitarian law. All such transfers must halt immediately,” said Lama Fakih.

“States supplying weapons to the coalition must also use their influence to press coalition members to act in compliance with their international obligations and to investigate violations of international humanitarian law.”

Countries such as the UK, that are party to the Arms Trade Treaty, are prohibited from authorizing an arms transfer if they have knowledge that the arms would be used to commit attacks against civilians, civilian objects or other violations of international humanitarian law.
