42ND SESSION OF THE UN HUMAN RIGHTS COUNCIL

INTERNATIONAL SAFE ABORTION DAY – 28 SEPTEMBER 2019

 

Please note that a shorter version of this statement was delivered orally on 23 September 2019 to fit the time requirements of the Human Rights Council.

 

Thank you, President. I deliver this statement on behalf of 317 organizations[i] and 506 individuals.[ii]

 

In the Vienna Declaration and Programme of Action, States explicitly agreed to prioritize the realization of women’s human rights and recognized that all human rights are universal, indivisible, interdependent and interrelated. Yet, 26 years later, women and girls’ human rights and bodily autonomy continue to be routinely violated, including through the denial, criminalization and stigmatization of access to safe and legal abortion – all of which is rooted in the discrimination, oppression, violence and coercion affecting the material conditions that shape people’s lives and ability to exercise their bodily autonomy and human rights.

 

In 1994, Black feminists came together as the Women of African Descent for Reproductive Justice, in reaction to the white supremacy, colonialism and capitalism they observed shaping reproductive politics and inherent in the broader population control narratives. Reproductive justice is centered on the rights to bodily autonomy and self-determination, and to parent and not to parent in safe and healthy environments.[iii] It is rooted in an intersectional analysis and moving beyond an individualistic conception of “choice” to instead place emphasis on the material conditions necessary to exercise reproductive rights. Reproductive justice also addresses the legacy of population control informed by white supremacy and replacement theory, which has resurfaced in current populist politics.

Reproductive justice is achieved when all people are able to enjoy their right to bodily autonomy and sexual and reproductive self-determination. It requires people to enjoy economic, social, and cultural rights and freedoms, and the ability to make and exercise choices not limited by oppression, discrimination, stigma, coercion, violence, lack of opportunities or possible consequences. Treaty bodies and special procedures have echoed this need and recognized that the realization of women’s reproductive rights depends on the material conditions in which they are born, grow, live, work and age, and on power structures and resource distribution at all levels[iv] – in other words, the social and other determinants of health.[v] These include access to housing, safe drinking water, effective sanitation systems, access to justice, and freedom from violence, among other factors, and impact the agency that individuals can exercise with respect to their sexual and reproductive health.[vi] Our discussions on abortion and sexual and reproductive rights cannot continue ignoring these factors.

The realization of reproductive justice, the right to bodily autonomy and substantive equality also requires freedom from control and interference by State and non-State actors, including private companies, donors and multinational corporations, including criminalization of sexual and reproductive behaviors and decisions, restrictive abortion laws, punitive sanctions, and legal restrictions to regulate women’s control over their own bodies.[vii] These laws, policies and practices typically target and disproportionately impact women of color, women from the Global South, women with disabilities, women living in poverty, migrant women, ethnic minorities and indigenous women, women living with HIV, young women and adolescents, sex workers and gender-non-conforming persons based on racial, class, disability and gender stereotypes.[viii]

Today, on 28 September, International Safe Abortion Day, we urge States to respect, protect and fulfill women and girls’ human rights and realize reproductive justice for all. We call on states to:

  • Ensure access to available, accessible, acceptable and quality sexual and reproductive health services as part of universal health coverage and public health systems, including modern contraceptive options, comprehensive abortion and post-abortion care, financed adequately through taxation and free from control from other governments, multilateral agreements and transnational corporations.
  • Remove all legal and social barriers to safe abortion, including its criminalization, which is broader and including sanctions and no sanction regimes, and commit to providing safe abortion services on request.
  • Address social and other determinants of health in law and practice from an intersectional perspective to ensure that they enable all individuals to effectively enjoy their sexual and reproductive rights.[ix]
  • Hold private companies and multinational corporations accountable for unethical research practices, violations and abuses of women and girls’ reproductive rights and bodily autonomy.
  • Prioritize the meaningful participation of local movements, women human rights defenders and feminists demanding accountability for sexual and reproductive health and rights violations, and center their demands and recommendations for the realization of reproductive justice.

[성 명]

청주시는 노인전문병원 노동자들에 대한 노조탄압 중단하고 고용승계 보장하라!!

청주시는 2009년 157억을 투입하여 청주시 노인전문병원을 설립했으나 곧바로 민간병원에 위탁하였고, 이로 인해 공공의료는 훼손되고 소속 노동자들의 노동환경은 악화되었다. 이에 노동자들은 노조를 설립하고 의료공공성 강화와 노동환경 개선을 요구했으나 청주시와 수탁기관은 병원폐쇄와 전원해고로 대응하였다. 사회복지시설에서 절대 일어나서는 안 되는 일들이 하루가 멀다 하고 벌어지고 있다. 오늘 청주시는 또 다시 공공의료와 고용승계를 요구하는 노동자의 목소리를 철저히 묵살하고 그들의 소박한 농성장마저 강제철거하였다.

청주시 노인전문병원은 구 노인복지법상 노인복지시설이자 사회복지사업법에 따른 사회복지시설이다. 노인복지법과 사회복지사업법은 노인의 보건복지증진과 사회복지증진을 그 입법목적으로 규정하고 있고, 사회복지사업법은 노인전문병원과 같은 복지시설은 지자체가 직접 운영하거나 사회복지법인 또는 비영리법인에게만 위탁하도록 규정하고 있다. 또한 사회복지사업법 시행규칙 제21조의2 제1항 제5호의2에 따르면 복지시설의 위탁계약 체결시 고용승계에 관한 사항을 반드시 포함하도록 하고 있다. 결국 이러한 규정들을 종합하면 청주시는 위탁계약체결시 노인전문병원의 안정적인 운영을 위해 소속 노동자들의 고용승계가 보장해야 한다.

그럼에도 법치행정에 충실해야 할 청주시는 이를 무시하고 있다. 오히려 위와 동일한 내용의 법제처의 의견마저 은폐하며 자신들은 고용승계에 대한 책임이 없다고 오리발을 내밀고 있다. 청주시는 위와 같은 직무유기를 멈추고 당장 노동자들의 고용승계에 나서야 한다.

오늘 청주시의 행정대집행도 그 위법의 정도가 심각하다. 청주시는 설 연휴를 코앞에 둔 오늘 새벽 노동자들의 소박한 공간인 농성장을 군사작전하듯 행정대집행을 통해 모두 철거하였다. 청주시의 행정대집행은 의무이행을 위한 충분한 시간도 주지 않은 상태에서, 대집행영장이나 증표 제시도 없이 막무가내로 이루어졌고, 대집행이 법으로 금지된 일몰 전부터 실시하는 등 법 절차를 완전히 무시하였다. 근본적으로 행정대집행은 심각한 공익침해가 있어야 가능함에도 이를 완전히 무시하였다.

청주시의 작금의 행태는 공공의료에 역행하는 것은 물론 건전한 노사관계 구축에도 반한다. 청주시는 위법한 행정대집행에 몰두할 것이 아니라 법에 정해진대로 노동자들의 고용승계를 보장하면 된다. 반드시 필요한 일이고, 어려운 일도 아니다. 노인전문병원의 안정적인 운영과 공공의료 구축을 위해서라도 청주시는 위법행정을 당장 중단하고, 노동자들의 고용승계를 보장하라!

[보도자료] 사드체계 배치사업, 환경영향평가에 대한법적 검토 의견 제출
– 사드체계 배치사업은 전략환경영향평가, 환경영향평가 대상 사업
– 소규모환경영향평가로 갈음할 수 없음

 

1. 민주언론을 위한 귀 언론사의 노고에 감사드립니다.

 

2. 우리 모임은 수차례 사드 체계 배치 문제가 헌법과 법률의 수호 문제라는 점을 밝힌 바 있고, 새로운 정부는 사드 체계 배치 문제에 대해 민주주의와 소통의 관점에서 필요한 절차를 모색 중입니다.

 

3. 그러나 국방부는 여전히 헌법과 법률에 맞지 않는 주장을 반복하며, 국민들에게 그릇된 정보를 제공하고 있습니다. 이에 우리 모임에서는 논란이 되고 있는 환경영향평가와 관련한 규범적 검토의견을 아래와 같이 발표합니다. 아래 의견은 법령과 기존의 판례 및 각 부처들이 진행했던 사례들을 망라한 것입니다.

 

4. 사드 체계 배치와 관련하여 헌법과 국민주권의 차원에서 철저하게 검토되고 조사되기를 바랍니다.

 

5. 의견서 개요

 

 가. 국방부의 주장

국방부는 사드체계 배치사업 환경영향평가와 관련하여 “미측에 공여된 부지에 설치되는 사드체계 배치사업은 미측 사업으로 국내법상의 환경영향평가법 적용 대상이 아니”나 “한․미 합의를 통해서 우리 국민의 불안감 해소와 안전보장을 위하여 「환경영향평가법」의 절차를 준용하여 소규모 환경영향평가를 실시하고 있으며 평가 완료 후 군사보안 사항을 제외하고 그 결과를 공개할 것입니다”라고 함. 2017. 6. 1.에는 사업면적은 10만 제곱미터이므로 ‘소규모환경영향평가’ 대상에 해당된다고도 함.
나. 그러나 사드배치사업은 전략환경영향평가와 환경영향영향평가 대상사업

  1) 사드체계 배치사업은 전략환경영향평가 실시 대상사업

사드체계 배치사업은 「국방·군사시설 사업에 관한 법률」(이하 ‘국방시설사업법’이라고 함) 제4조에 따른 사업 시행면적이 33만 제곱미터 이상인 사업으로서, 전략환경영향평가 실시 대상 사업임.

   가) 사드체계 배치사업은 토지의 취득방식과 무관하게 국방시설사업법이 적용됨.

국방부는 국방시설사업법이 ‘토지 등을 수용’하는 경우에만 적용되고, 사드부지는 ‘교환계약’을 통해 확보했기 때문에 법이 적용 안된다고 주장함.
그러나 국방시설사업법에 외국군대의 시설도 국방군사시설이라고 규정하고 있고, 법에 ‘토지 등의 수용’의 경우에만 적용한다는 말도 없음. 오히려 국방시설사업법상의 승인 절차를 설명하는 「국방․군사시설 사업에 관한 법률에 따른 승인 등에 관한 훈령」은 사업계획 승인 업무 절차에서 명확히 ‘토지 등의 수용 또는 사용’을 포함하는 경우와 그렇지 않은 경우의 승인 업무절차를 구분하고 있음. 환경부 역시 질의회신에서 “국방시설사업법 제4조의 사업계획의 경우 토지수용여부와 관계없이 전략환경영향평가 대상”이라고 하였음.

   나) 사드체계 배치사업은 “사업시행 면적이 33만 제곱미터 이상인 사업”에 해당함.

사업시행면적과 관련하여서 국방부는 공여된 면적이 ‘328,779 제곱미터’이기 때문에 전략환경영향평가 대상이 아니라고 주장하고 있음. 그러나 국방부는 2017. 2. 28. 주한미군의 사드배치를 위한 목적으로만 148만 제곱미터를 확보하였고, 취득한 부지 전체에 철조망을 치고 군사기지로 조성하였으며, 이를 기초로 「군사기지 및 군사시설 보호법」(이하 ‘군사기지법’이라고 함)을 적용하여 경찰에 시설보호 요청을 하였음. 주한미군에게 공여하기로 한 토지의 면적이 곧 사업시행 면적은 아님. 법원 역시 ‘도창리 백골종합훈련장 피탄지조성사업계획’과 관련하여 공사면적과 무관하게 전체 사업계획 면적을 대상사업 면적이라고 보고 전체에 대해서 사전 환경영향평가를 실시하지 않은 것이 위법하다고 판시하였음(대법원 2006. 6. 30. 선고 2005두14363 판결).

   다) 즉, 사드 배치와 관련한 사업시행 면적은 33만 이상 제곱미터라고 볼 수밖에 없고, 따라서 전략환경영향평가를 사드체계 배치 여부를 결정할 때 하였어야 했음.

 다. 설령, 사업시행면적이 33만 제곱미터 미만이라고 할지라도 소규모환경영향평가가 아닌 환경영향평가를 실시하여야 함.

환경영향평가법상의 환경영향평가에는 전략환경영향평가, 환경영향평가, 소규모환경영향평가가 있음. 설령 국방부의 주장대로 설령 사업시행면적이 33만 제곱미터 미만이라고 하더라도 소규모환경영향평가가 아닌 환경영향평가를 실시하여야 함. 환경영향평가법 및 시행령에 의하면 군사기지법상의 군사기지 안에서 시행되는 사업면적 20만 제곱미터 이상인 사업이거나 혹은 20만 제곱미터의 군사시설 설치사업은 환경영향평가를 하여야 함. 사드배치가 군사기지에서 이루어지는 사업이 분명하고, 군사시설에 해당함은 국방부가 이미 인적하고 있으며, 그 면적은 앞에서 언급한 것처럼 적어도 20만 제곱미터 이상임은 분명하므로 환경영향평가 실시 대상 사업임.

 라. 소규모 환경영향평가로 사드 배치 사업에 대한 환경영향평가를 갈음할 수 없음.

소규모 환경영향평가는 “환경보전이 필요한 지역이나 난개발(亂開發)이 우려되어 계획적 개발이 필요한 지역에서 개발사업을 시행할 때에 입지의 타당성과 환경에 미치는 영향을 미리 조사·예측·평가하여 환경보전방안을 마련하는 것”을 말하고(환경영향평가법 제2조 제3호), 사드체계 배치사업은 환경보전이 필요한 지역이나 난개발이 우려되어 계획적 개발이 필요한 지역에서 시행되는 개발사업이 아니어서 그 요건에 해당하지 않음(환경영향평가법 시행령 [별표4] 참조). 소규모환경영향평가는 환경영향평가서에 포함될 항목이 적고, 환경영향평가서 초안에 대한 주민 의견 수렴 절차가 존재하지 않으므로 사드 배치 사업에 대한 환경영향평가의 목적을 달성할 수 없음.

 마. 결론

사드체계 배치와 관련하여 반드시 실시했어야 하는 적법절차에 대한 철저한 조사가 필요. 그 과정에서 배제된 주민들과 국회, 국민들의 충분한 토론이 필요함. 이것은 헌법과 국민주권의 차원에서 반드시 필요하고, 그 결과에 따라 사드 문제를 해결하여야 함.

제12대 민변 회장, 감사 선출

〇 민주사회를 위한 변호사모임은 오늘 제12대 회장 및 감사 선거를 통해 회장으로 정연순 변호사를, 감사로 한경수, 고은아 변호사를 선출하였습니다. 이번 선거는 민변 창립 이후 첫 회장 경선이라는 점에서 의미가 있었고 특히 선거 과정에서 민변의 나아갈 방향 및 우리 사회에서 민변의 역할에 대하여 회원들의 목소리를 들을 수 있는 소중한 기회였습니다.

〇 이번 선거에서는 총 선거권자 940명 중 투표자 655명이 참여(69.58%)하였으며, 회장 당선인 정연순 변호사는 그 중  400표를 얻어 61.07% 지지로 당선되었습니다. 당선인의 임기는 2016. 5. 28부터 시작되어 2년 동안 회장직을 수행하게 됩니다.

〇 회장으로 선출된 정연순 변호사는 민변 역사 30년의 경험을 모아 의제개발과 대안제시능력을 강화하는 한편 시민과 함께 하는 민변이 되기 위해 공익변론센터를 안착시켜 공익소송을 더욱 활성화하고 인권탄압현장에 대해 더욱 공고히 결합하는 한편  회원1000명 시대를 맞이하여 민변을 혁신하고 지부와 위원회자료를 축적해서 회원들의 활동을 적극 지원하겠다는 공약을 제시한 바 있습니다.

〇 이번 선거에 보여준 관심에 감사드리며 앞으로 민변은 우리 사회의 민주주의 발전과 인권 옹호를 위하여 주어진 사명을 다할 것을 다시 한 번 약속드리는 바입니다.

형사미성년자 연령을 13세로 낮추는 정책에 반대한다.

 

1. 최근 언론에서 형사미성년자가 강력범죄를 저지른 사건이 잇달아 보도되면서 형사미성년자 연령을 낮춰야 한다는 여론이 높아졌다. 20만 명 이상의 시민이 형사미성년자 연령을 낮춰달라는 청와대 국민 청원에 참여했다이에 정부는 형사미성년자 연령을 13세로 하향하는 내용의 형법 및 소년법 개정을 추진하겠다고 밝혔다우리 모임은 정부의 형사미성년자 연령을 13세로 낮추려는 입장 표명에 대해 다음과 같은 이유로 심각한 우려를 표한다.

 

2. 형사미성년자 연령 하향 정책의 추진 근거로 제시된 소년범죄의 저연령화’ 진단은 충분한 검증에 기반하고 있지 않다정부는 2018년 상반기 청소년 범죄 통계를 보았을 때 형사미성년자 중 10~13세가 저지른 범죄가 전년 동기 대비 7.9% 늘었고 13세 범죄만 보면 14.7% 증가했다고 진단하나한 해의 통계만을 바탕으로 소년범죄가 저연령화되고 있다고 결론짓는 것은 섣부르다. 2008년부터 2016년까지의 검찰에서 사건 처리된 전체 소년범죄자 중 14세 미만 범죄가 차지하는 비율은 2008년에는 2.8%, 2009년에는 1.8%, 2010년에는 0.4%, 2011년에는 0.4%, 2012년에는 0.8%, 2013년에는 0.5%, 2014년에는 0.04%, 2015년에는 0.1%, 2016년에는 0.1%로 지속적으로 줄어들거나 크게 증가하지 않았다실제 범죄발생건수 또한 2014년 이후 두 자리 숫자에 머물고 있다[1]1). 경찰통계에서도 촉법소년의 수는 2012년 12,799명을 기점으로 해마다 줄어들어 2016년에 6,788명에 그치고 있다[2]2).

 

3. 한편 저연령 소년범죄를 강력하게 처벌하는 엄벌주의적 정책은 소년사범에 대한 효과적이고 적절한 대처가 아니다오히려 형사처벌을 확대하고 강화하였던 외국의 사례를 보면 형사처벌의 확대 및 강화를 통해 소년범죄의 감소라는 목표는 달성되지 않았다는 사실을 확인할 수 있다대표적인 사례가 미국의 형사이송제도이다형사이송제도란 미성년자라 하더라도 특정 범죄를 저질렀거나 재범의 위험이 크다면 소년법원이 아니라 형사법원으로 이송해 성인과 동일하게 처벌하는 제도이다이 제도를 통해 형사이송이 가능한 연령이 낮아졌고 대상 범죄 종류가 확대되었다청소년 범죄에 대한 엄벌주의 정책이 확대된 것이다. 1979, 14개 주에서만 시행되었던 것이 1995년에는 21개 주로, 2003년에는 31개 주로 확대되었다하지만 엄벌주의 정책에도 불구하고 당시 미국의 소년 범죄자 재범률 억제 정책은 실패했다형사 이송되어 성인과 동일하게 처벌받은 소년들은 소년법원에서 교육과 보호처분을 받은 소년범들과 비교하였을 때 이후 재범 범죄의 수가 더 많았고 재범이 발생하기 까지 걸린 시간도 더 짧았다더욱이 형사이송제도를 통해 성인 형사재판으로 이송되었던 소년범들은 대부분 사회경제적으로 취약하고 빈곤한 가정의 출신이었다형사사법제도의 모순과 불평등이 형사이송제도 내에 고스란히 반영됐던 것이다결국 미국은 2004년부터 형사이송 연령을 다시 높이고 형사이송의 범위를 축소하는 정책을 선택했다.1)

일본의 경우, 1997년 초등학생을 무참히 살해한 사카키바라 사건을 계기로 2000년에 소년형사처벌 연령을 16세에서 14세로 낮췄고, 2003년 남아유괴살인사건, 2004년 초등학교 동급생 살인사건 등을 계기로 2007년에 소년원 송치연령을 14세에서 12세로 하향했다. 2014년에는 소년에 대한 유기형의 상한을 15년에서 20년으로 인상하기도 하였다그러나 일본 정부의 이러한 입법조치에도 불구하고 이후 소년범죄가 줄었다고 결과는 보고되지 않고 있다.2)  

 

4. 또한 형사미성년자 연령을 13세로 낮추는 것은 아동인권에 관한 국제인권 기준에 부합하지 않는다. UN 아동인권위원회는 유엔아동권리협약 제40조에 근거하여 당사국에 대해 형법위반능력이 없다고 추정되는 최저연령의 설정을 촉구해왔다특히 12세 이하로 형사책임 연령을 인하한 국가에 대해서는 형사책임연령의 상향조정을 지속적으로 권고해왔다이러한 유엔의 권고에 따라 형사미성년자 연령을 14세로 채택한 국가는 2004년 27개에서 2010년 33개로 늘었으며, 16세로 채택한 국가도 11개에서 15개로 증가했다[표 3]3). 또한 소년사법운영에 관한 유엔최저기준규칙(United nations Standard Minimum Rules for the Administration of Juvenile Justice: Beijing Rules)’ 4조 역시 소년의 형사책임연령이라고 하는 개념을 인정하고 있는 법제도에 있어서 그 개시연령은 정서적정신적지적 성숙에 관한 사실을 고려하여 너무 낮은 연령으로 정해져서는 안 된다고 규정하고 있다3).

 

5. 한편 형사미성년자 연령 하향을 통해 형사처벌 할 수 있는 연령을 낮추게 되면 어린 소년범에 대한 낙인효과가 확대되어 소년의 사회화가 더욱 어려워지게 되는 부정적 효과가 야기된다사법기관의 공식적 낙인이 붙은 소년은 사회로 온전히 복귀하여 자신의 꿈을 펼칠 수 있는 기회가 제한될 가능성이 높다이로 인해 부정적 낙인과 그 차별 효과를 경험한 소년은 각종 불법적인 수단에 접촉할 가능성이 높아지고 그 결과 유사한 범죄자들로부터 범죄를 학습하여 상습적인 범죄자가 될 확률이 커지게 된다4)이는 결국 소년의 인권을 보호하고 사회복귀를 도모하는 소년사법의 이념에도 정면으로 반하는 결과를 초래한다.

 

6. 형사미성년자 연령을 낮춤으로써 저연령 소년들의 비행 문제를 일거에 해결할 수 있다는 접근은 엄벌주의를 요구하는 여론을 달랠 수 있으면서 추가적 비용 부담 또한 필요가 없기 때문에 손쉬운 대안으로 부각된다하지만 이는 소년의 건전한 교화와 사회복귀라는 소년사법의 이념과 목표에 부합하지 않는다저연령 소년들의 비행을 범죄로 간주하여 그에 준하는 처벌을 가하는 것은 국가가 이들을 곧바로 범죄예비군으로 편성하여 범죄자가 되는 컨베이어벨트 위에 올려놓는다는 의미 이외에 다른 어떤 형사정책적 고려도 없는 것이기 때문이다5)정부는 가해자 엄벌이라는 손쉬운 방법에 기대는 대신 피해자 보호와 피해회복을 위한 진지한 정책적 고민을 해야한다우리 모임은 정부가 소년범에 대한 사회 일각의 처벌만능주의 여론에 휩쓸리지 말고소년범을 양산하는 사회적 환경을 개선하고 기존 소년법상의 소년 보호처분조치의 다양화 및 내실화에 힘써줄 것을 강력하게 요구한다우리 모임은 소년범죄에 대한 충분하고 신중한 검토 없이 추진되는 정부의 형사미성년자 연령 하향 정책에 반대한다.

노동개악 2대 불법지침의 법적 효력을 부인한 국가인권위원회 의견표명 의결!

박근혜정부는 노동개악정책을 밀어붙이기 위해

법치주의를 훼손한 불법지침의 무효를 인정하고 당장 철회하라

2016. 8. 25. 국가인권위원회는 상임위원회에서 고용노동부의 공정인사지침과 취업규칙 해석운영지침은 법적 구속력이 없음을 명시적으로 표명키로 의결하였다.

올해 초 박근혜정부는 저성과를 이유로 한 일반해고를 유도하고 노동자 집단의 동의없이 근로조건을 불이익하게 변경할 수 있도록 한 노동개악 양대지침(공정인사지침과 취업규칙 해석운영지침)을 내놓았다. 이에 2016. 2. 2. 양대노총은 사용자가 근로기준법이 정한 해고제한법리와 취업규칙 불이익변경의 절차적 제한을 묵살하여 노동법의 근간을 무너뜨리는 정부의 양대지침은 위헌ㆍ위법한 불법지침으로서 원천 무효임을 선언하며, 국가인권위원회에 정부의 양대지침의 불법성에 대한 의견표명 및 정부의 지침철회를 촉구하는 정책권고를 요청하였다.

국가인권위원회는 고용노동부가 ‘지침’이라는 이름을 사용하여 하급 행정기관에 시달하면서 해고 및 취업규칙에 관한 사업장 지도ㆍ감독을 하도록 지시하고 있어, 마치 노사관계 일반에 구속력 있는 행정규칙으로 오해하게 할 우려가 있음을 지적하여, 사법적 효력이 없음을 재확인하였다.

또한 국가인권위원회는 마치 법원이 저성과만을 이유로 일반해고가 가능하다고 인정하였다거나 정부가 추진하고 있는 직무성과급 임금체계 변경이나 임금피크제 도입시 근로자 과반의 동의 없이 취업규칙을 불이익하게 변경할 수 있다고 판결했던 것 마냥 판례를 왜곡하는 행정지침을 배포함으로써, 사용자들이 사업장의 자치규범을 개악하기 위해 노동자들을 압박하는 수단으로 악용될 위험을 직시하면서 노동부의 지침은 구속력 있는 행정규칙이 아님을 명확히 알리도록 하였다.

그러나 박근혜 정부의 불법지침은 단지 사법적 효력이 없는 지침의 오남용 문제가 아니다. 노동법이 명시하고 있는 노동기본권에 대한 보호법제는 국회의 법개정을 필요로 함에도 박근혜정부는 사업장에 노동시장구조개악을 강행하기 위해, 국회의 입법이나 법원의 사법적 판단이 아닌 사업장의 관행을 사실상 장악하기 위한 방편으로 각종 가이드라인이나 행정지침들을 쏟아내고, 사업장의 안정적인 노사관계를 교란시켜 쉬운 해고와 근로조건의 불이익변경을 속전속결로 현장에 밀어붙이려고 하였다.

따라서 박근혜정부의 불법지침 활용은 노동개악정책의 현실적인 장악을 위해 국회의 입법권한을 무시하고 법원의 판례를 아전인수격으로 해석한 것으로, 단지 실수나 우연한 오남용이 아니라 의도적인 삼권분립의 훼손이자 법치주의에 대한 침해이다.

노동개악을 강행하려는 불법지침들이 법적 구속력이 없음을 지적한, 국가인권위원회의 의견표명은 지극히 당연한 판단이다. 나아가 이번 국가인권위원회의 의견표명에서는 정부가 판례에 대한 자의적 해석을 통해 사업장의 노동관행을 교란시킬 위험이 있다는 점을 지적한 것에서 알 수 있듯이, 박근혜정부의 노동개악지침들은 명시적인 노동법의 내용을 무력화시켜 안정적인 노동법질서를 해치는데 행정부의 권한을 남용한 노골적인 위법한 행정작용임이 만천하에 드러났다. 지금이라도 박근혜정부는 해고제한법리과 근로조건에 대한 노동자 집단적 자치를 보장해온 노동법의 근간을 무너뜨리려는 노동개악 시도를 즉각 중단하고 불법지침을 스스로 철회할 것을 강력 촉구한다.
