42ND SESSION OF THE UN HUMAN RIGHTS COUNCIL

INTERNATIONAL SAFE ABORTION DAY – 28 SEPTEMBER 2019

 

Please note that a shorter version of this statement was delivered orally on 23 September 2019 to fit the time requirements of the Human Rights Council.

 

Thank you, President. I deliver this statement on behalf of 317 organizations[i] and 506 individuals.[ii]

 

In the Vienna Declaration and Programme of Action, States explicitly agreed to prioritize the realization of women’s human rights and recognized that all human rights are universal, indivisible, interdependent and interrelated. Yet, 26 years later, women and girls’ human rights and bodily autonomy continue to be routinely violated, including through the denial, criminalization and stigmatization of access to safe and legal abortion – all of which is rooted in the discrimination, oppression, violence and coercion affecting the material conditions that shape people’s lives and ability to exercise their bodily autonomy and human rights.

 

In 1994, Black feminists came together as the Women of African Descent for Reproductive Justice, in reaction to the white supremacy, colonialism and capitalism they observed shaping reproductive politics and inherent in the broader population control narratives. Reproductive justice is centered on the rights to bodily autonomy and self-determination, and to parent and not to parent in safe and healthy environments.[iii] It is rooted in an intersectional analysis and moving beyond an individualistic conception of “choice” to instead place emphasis on the material conditions necessary to exercise reproductive rights. Reproductive justice also addresses the legacy of population control informed by white supremacy and replacement theory, which has resurfaced in current populist politics.

Reproductive justice is achieved when all people are able to enjoy their right to bodily autonomy and sexual and reproductive self-determination. It requires people to enjoy economic, social, and cultural rights and freedoms, and the ability to make and exercise choices not limited by oppression, discrimination, stigma, coercion, violence, lack of opportunities or possible consequences. Treaty bodies and special procedures have echoed this need and recognized that the realization of women’s reproductive rights depends on the material conditions in which they are born, grow, live, work and age, and on power structures and resource distribution at all levels[iv] – in other words, the social and other determinants of health.[v] These include access to housing, safe drinking water, effective sanitation systems, access to justice, and freedom from violence, among other factors, and impact the agency that individuals can exercise with respect to their sexual and reproductive health.[vi] Our discussions on abortion and sexual and reproductive rights cannot continue ignoring these factors.

The realization of reproductive justice, the right to bodily autonomy and substantive equality also requires freedom from control and interference by State and non-State actors, including private companies, donors and multinational corporations, including criminalization of sexual and reproductive behaviors and decisions, restrictive abortion laws, punitive sanctions, and legal restrictions to regulate women’s control over their own bodies.[vii] These laws, policies and practices typically target and disproportionately impact women of color, women from the Global South, women with disabilities, women living in poverty, migrant women, ethnic minorities and indigenous women, women living with HIV, young women and adolescents, sex workers and gender-non-conforming persons based on racial, class, disability and gender stereotypes.[viii]

Today, on 28 September, International Safe Abortion Day, we urge States to respect, protect and fulfill women and girls’ human rights and realize reproductive justice for all. We call on states to:

  • Ensure access to available, accessible, acceptable and quality sexual and reproductive health services as part of universal health coverage and public health systems, including modern contraceptive options, comprehensive abortion and post-abortion care, financed adequately through taxation and free from control from other governments, multilateral agreements and transnational corporations.
  • Remove all legal and social barriers to safe abortion, including its criminalization, which is broader and including sanctions and no sanction regimes, and commit to providing safe abortion services on request.
  • Address social and other determinants of health in law and practice from an intersectional perspective to ensure that they enable all individuals to effectively enjoy their sexual and reproductive rights.[ix]
  • Hold private companies and multinational corporations accountable for unethical research practices, violations and abuses of women and girls’ reproductive rights and bodily autonomy.
  • Prioritize the meaningful participation of local movements, women human rights defenders and feminists demanding accountability for sexual and reproductive health and rights violations, and center their demands and recommendations for the realization of reproductive justice.

[보도자료] 인신구제청구 사건의 재판부 기피신청에 대한 법원의 기각결정에 대한 변호인단 입장 및 향후 인신구제청구 사건의 변론 진행 방향

1. 정부 당국이 지난 4. 7. 집단 입국하였다는 북한 해외식당 종업원들에 대하여 우리 변호인단이 제기하였던 인신구제청구사건의 심문기일이 지난 6. 21. 14:00서울중앙지방법원 형사 제32단독 재판부(판사 이영제)의 심리로 진행되었는 바, 우리는 담당재판부의 이유없는 심리 비공개 및 속기·녹음신청 기각 결정, 수용자 측 답변서의 기일 당일 법정 수령 및 피수용자들 전원 불출석으로 인한 심리기일의 속행 및 피수용자들 재소환 요청 거부, 당일 무조건 심리 종결하겠다며 심리를 강행하는 등 여러 사유들로 인하여 공정한 재판을 기대할 수 없어 재판부 기피신청을 하였고, 이로 인해 재판이 즉시 중단되었다.

위 기피신청 사건은 같은 법원 형사1부에 배당되었고, 민사소송법 제45조 제2항에 의하면 기피를 당한 법관이 바로 기피신청에 대한 의견서를 제출하여야 함에도 불구하고, 위 기피신청 사건 재판부는 위 기피신청이 있은지 1개월여가 지나도록 기피를 당한 인신구제청구 사건의 담당법관이 기피신청에 대한 의견서를 바로 제출하지 아니하였음에도 불구하고, 7. 22. ‘담당재판부가 불공정한 재판을 할 우려가 없었다’는 취지로 기각결정을 하였고 위 결정은 7. 26. 우리 변호인단에 송달되었다.

 

2. 법원이 기피신청을 기각하면서 설시한 구체적인 이유들을 보건대, 우리는 하나 같이 쉽게 수긍할 수가 없으며, 법원이 ‘기각 결정’이라는 결론을 정해 놓고 그 이유를 연역적으로 풀어 썼다는 의문을 갖지 않을 수가 없다.
법원은 심리 비공개 및 속기·녹음신청 기각 결정에 대하여 공히 피수용자들 및 그 가족들에 대한 보호 필요성을 설시하면서, 심리 비공개 결정에 대하여는 당사자들 및 그 지지자들 사이의 이념 대립 등에 의한 법정 내 충돌 또는 집단적 소란 우려를, 속기·녹음신청 기각 결정에 대하여는 재판 외 목적 사용 가능성을 부가하였다. 그러나, 실제 2시간여 진행되었던 위 심문기일에서는 구제청구자와 피수용자의 가족관계, 구제청구자의 위임의사 및 피수용자 불출석 상태에서의 심리진행의 정당성에 관한 논쟁이 있었을 뿐 정작 본안과 관련하여서는 아무런 내용도 진행된 바가 없었기에 재판 외 목적 사용 가능성은 문제가 전혀 되지 않는 사정이었다.

 

3. 우리는 피수용자들 및 그 가족들에 대한 보호 필요성을 이유로 인신구제청구 사건 재판부의 심리 비공개 및 속기·녹음신청 기각 결정을 정당화한 기피신청 사건 재판부의 기피신청 기각결정에 대하여 그 부당성을 지적하지 않을 수 없다.

그와 같은 논리대로라면 애초에 인신구제청구 사건 재판부의 피수용자들에 대한 출석명령 또한 피수용자들 및 그 가족들에게 현재 내지 장래의 안위에 위해를 초래한다는 수용자 국정원측의 주장을 그대로 수용할 수밖에 없게 되는 결과를 불러올 것이다.

이는 인신보호법을 적용하여 공정한 재판을 하여야 할 법원의 의무 자체를 부인하게 되어 인신보호법원의 존재 의의를 위태롭게 하는 자승자박의 이율배반적 논리로 향후 인신구제청구 사건 심리절차에서 불공정한 재판을 할 것이라는 강한 의구심을 갖게 되는 이유가 되는 것이다.

기피신청 기각결정문에는 “위 사건에 있어 구제청구자들의 변호인들에 대한 소송위임의 적법 여부가 큰 쟁점이 되었고, 이에 재판장은 일응 그에 대한 우선적인 검토를 마친 다음 필요할 경우 다시 심문기일을 열 수도 있음을 고지하였다. 이에 비추어 볼 때, 재판장이 심문종결의 의사를 표명한 것을 가지고 불공정한 재판이 염려된다고 할 수는 없다”고 판시하였으나, 과연 향후 다시 심문기일을 열어 피수용자들을 심문기일에 소환할 수 있을지 의구심이 큰 사정이라 하겠다.

 

4. 그럼에도 불구하고, 우리는 이번 법원의 기피신청 기각결정에 대하여 즉시항고 기간 내에 즉시항고를 하지 않기로 결정하였다. 우리들의 위와 같은 불복신청을 하지 않기로 하였으므로 그동안 중단되었던 인신구제청구 사건의 본 재판절차가 재개될 것이다.

우리는 비록 인신구제청구 사건 재판부의 공정한 재판을 기대하기 어려운 사정이지만, 자발적 탈북자들의 경우와 달리 통상의 북한이탈주민보호센터에서의 예상 수용기간을 훨씬 초과하여 4개월이 넘는 기간 외부와 접촉이 차단된 고립무원의 상태에 있는 북한 해외식당 종업원들의 신병보호를 위하여 긴급을 요하는 변호인단의 변론이 필요하다고 판단하였기 때문이다.

또한 법관 앞에 인신을 내보이라는 인신보호법이 유래한 인권사적 경험의 측면에서 보나, 피의자의 방어권과 인권보호를 위하여 구속 전에 반드시 모든 피의자를 법관이 직접, 피의자의 자유로운 진술을 위해 법정에서 대면하여 구속사유를 심사하도록 발전한 우리나라의 필요적 구속영장실질심사(구속 전 피의자심문제도)의 정착과정에 비추어 보더라도 인신구제청구 사건 재판부 또한 현행 인신보호법이 규정하는 대면심사의 필요성과 중요성을 쉽사리 부인하기는 어려울 것으로 보았다.

 

5. 우리는 향후 다시 재개될 인신구제청구 절차에서 다음과 같이 수용자 국정원측의 피수용자들의 수용 여부의 적법성 및 계속 수용 여부의 필요성에 대하여 이를 확인하기 위하여 최선을 다하여 변론을 할 것이다.

가. 먼저, 다시 심문기일을 열어 법정에 피수용자들의 출석의 당위성과 필요성을 변론할 것이다.

피수용자 국정원이 임명한 북한이탈주민보호센터의 인권보호관이 피수용자 국정원의 주선 아래 피수용자들에 대한 접견 후 자발적 탈북이라고 언론에 공개적으로 확인을 해 주었을 때 그 누구도 피수용자들 및 그 가족들에게 현재 내지 장래의 안위에 위해를 초래한다고 문제를 삼은 적이 없다.

그렇다면, 애시당초 수용자 국정원측은 인신구제청구 사건에서 우리 변호단의 인신구제청구로 인하여 피수용자들 및 그 가족들에게 현재 내지 장래의 안위에 위해를 초래한다고 공격할 것이 아니라, 인신보호법 제10조 제3항에 따른 법원의 피수용자들의 출석명령에 따라 수용자 국정원은 피수용자들을 심문기일에 출석시켰어야 했다.

그러나, 국정원은 지난 심문기일에 인신보호법을 위반하여 피수용자들을 출석시키지 않았고, 오히려 수용자나 수용자가 임명한 인권보호관이 피수용자들의 의사를 대신 전달하겠다며 대변자 역할을 자임하기까지 하였다. 수용자 국정원의 피수용자 북한 해외식당 종업원들에 대한 적법 수용 여부가 쟁점이 된 인신구제절차에서 수용자 국정원이나 국정원이 임명한 인권보호관이 재차 접견을 하여 피수용자들의 의사를 대변한다는 것 자체가 인신구제절차를 방해하는 행위로써 수용자 국정원의 피수용자들에 대한 위법 수용의 개연성을 높이는 행위에 다름 아니다.

법원 또한 유엔 인권최고대표사무소가 북한 해외식당 종업원들에 대한 면담을 수차례 요청하였으나 국정원이 거부하였던 사실 및 유엔 인권최고대표사무소(유엔 북한인권 서울사무소)가 이 사건 인신구제절차의 재판진행에 대하여 지대한 관심을 갖고 모니터링을 하고 있다는 사실을 누구보다도 잘 알고 있을 것이다.

따라서 법원은 국정원에 의하여 우리 변호단 뿐만 아니라, 유엔 인권최고대표사무소의 북한 해외식당 종업원들에 대한 면담조차 거부되고 있는 특별한 사정에 비추어보더라도 피수용자들의 인권보호를 위하여 자유로운 진술이 가능하도록 심문기일 법정에 소환하여야 할 의무가 있다.

우리 변호인단 입장에서는 서울시공무원간첩조작사건의 피해자 여동생인 유가려씨는 인신구제절차 심문기일에서까지 허위자백의 내용 그대로 진술하였던 예에서 보듯 과연 피수용자들이 심문기일 법정에서 자유로운 진술이 가능한지조차 의구심을 갖고 있다.

그럼에도 불구하고, 우리는 법원의 수용자들에 대한 직접 심문의 필요성에 비추어 피수용자들의 심문기일 출석 여부를 둘러싼 논란 등의 방지하고 이 사건의 원활한 심리 진행과 신속·올바른 판단을 위하여 법원조직법 제56조 제2항에 따라 현재 피수용자들이 수용되어 있는 북한이탈주민보호센터 구내 장소를 심문기일의 개정 장소로 지정하여 현장재판의 실시를 요청하기까지 하였다.

나. 또한 우리는 향후 재개될 인신구제청구 절차를 위하여 인신구제청구의 청구원인을 추가하였다.

이 사건 피수용자들은 북한이탈주민보호법 제8조 제1항, 동법 시행령 제14조에 의하여 국가정보원장이 그 보호 여부를 결정하거나 정착 지원할 대상이 아니므로 통일부장관이 보호결정을 하고 정착지원 역시 통일부장관이 설치‧운영하는 하나원에서 이루어져야함에도 불구하고, 피수용자들은 수용자에 의하여 여전히 외부와의 접촉이 차단된 채 북한이탈주민보호센터에 계속 수용되어 있다.

수용자 국정원은 ‘보호결정’ 후 ‘정착지원’ 상태라며 수용의 근거만 달리하고 있을 뿐, 피수용자들에 대한 인신구속 상태는 보호결정 이전과 전혀 다름이 없는 바, 이와 같이 수용자가 피수용자들에 대해 계속 북한이탈주민보호센터에서 수용하는 것은 정당성이 없을 뿐만 아니라 위법하다.

이에 따라, 이 사건 수용의 위법성 및 수용 계속의 불필요성과 관련하여 이 사건 인신구제청구서가 접수된 이후인 2016. 6. 3. 수용자가 피수용자들에 대해 각 보호결정을 하고 계속 북한이탈주민보호센터에서 수용하고 있는 것은 북한이탈주민보호법 제10조 제1항 본문에 위반하여 위법한 것이라는 점을 이 사건 구제청구의 원인으로 추가하였다.

다. 끝으로 우리는 피수용자들이 외부 접촉이 가능하도록 하기 위하여 피수용자들의 조속한 하나원 이송을 위하여 최선의 변론을 다할 것이다.

인신보호법 제11조는 피수용자의 신병을 보호하기 위하여 피수용자를 현재의 수용시설에서 적당하다고 인정되는 동종 또는 유사한 다른 수용시설로 이송할 것을 수용자에게 명할 권한을 법원에 부여하고 있다.

위에서 본 바와 같이 피수용자들은 통일부장관으로부터 보호 여부를 결정받고, 보호결정을 받은 경우 위 장관이 설치·운영하는 정착지원시설(하나원)에서 현재3개월로 운용되고 있는 소정의 프로그램을 이수한 후 정착지원금 등을 받고 사회로 나가야 할 사람들이다.

그럼에도 불구하고, 피수용자들은 지난 6. 3. 수용자 국정원으로부터 보호결정을 받고 계속 북한이탈주민보호센터에 수용되어 있으며, 하나원과는 달리 여전히 외부와는 철저하게 단절·격리된 상태에 있다. 수용자에 의한 이 사건 수용이 적법·정당한 것인지를 묻는 이 사건에서 피수용자들의 신병과 안위 등을 수용자를 통해서만 확인할 수 있다는 현재의 상황 그 자체가 피수용자들에 대한 신병 보호의 필요성이 있다는 사실을 말해 주는 것이다.

이에 따라, 우리 변호인단은 법원에 인신보호법 제11조 및 동 규칙 제13조에 각 의거하여 법원에서 피수용자들의 신병보호를 위하여 일반 탈북자들이 수용되어 정착지원을 받는 – 통일부가 설치·운영하는 하나원으로 피수용자들을 이송하도록 결정하여 줄 것을 요청하였다

 

6. 입국 하루만에 사진까지 보이며 자발적 탈북사실을 알리고 신상이 공개되도록 한 국정원 등 정부당국이, 우리가 인신구제청구를 하자 우리 변호인단(민변)이 피수용자들 및 그 가족들에게 현재 또는 장래의 안위에 위해를 초래한다고 주장하는 것은 우리 변호인단(민변)을 공격대상으로 몰아가기 위한 억지논리에 불과하다.

정부당국은 지금이라도 민변에 대한 공격을 멈추고,이 사안을 둘러싼 우려와 비판의 목소리에 귀를 기울이며 인신구제절차와 유엔의 면담요청에 적극 협조해야 할 것이다.

[성 명]  산업부는 삼척화력과 포스코에너지에 대한 특혜 시도를 중단하고, 법에 따라 삼척화력의 발전사업 허가를 취소하라.

 

  1. 산업통상자원부(이하 “산업부”)는 지난 주에 미착공 신설 석탄발전소인 삼척화력 2기(합계 2.1GW)를 기존 계획대로 추진할 것임을 밝히고, 이를 8차 전력수급기본계획(안)에 반영했다. 포스코에너지가 추진하는 삼척화력은, 정부가 대선 공약에서 ‘원점 재검토’를 약속한 신규 석탄화력 9기 중에서도 아직 착공조차 되지 않은 발전소로서 취소나 연료전환이 유력했던 사업이다. 삼척화력의 추진은 기후변화 대응, 미세먼지 저감 등 새 정부가 밝혀 온 에너지 전환의 방향에 전면 역행하는 조치이다.
  2. 산업부는 처음부터 사업자의 동의 없이는 신규 석탄발전소 계획을 취소하거나 연료전환을 할 수 없다는 입장을 취하며, ‘LNG 발전소로 전환’할 것을 사업자들에게 설득하고 있다고 밝혀 왔다. 보도에 따르면, 삼척화력을 추진하기로 결정한 이후 산업부 관계자들이 ‘법을 준수하기 위해 어쩔 수 없었다’거나 ‘삼척화력이 소송을 하면 정부가 질 것이기 때문에 추진할 수 밖에 없다’는 말을 뱉어 내며 ‘법 준수’를 정책적 의사결정의 방패로 삼고 있다.
  3. 그러나, 삼척화력의 추진 경과와 관련 법령의 내용을 조금만 들여다보더라도 위와 같은 산업부의 주장이 근거 없는 변명에 불과하다는 것을 알 수 있다. 산업부가 제대로 된 법률 검토를 받아 보았는지조차 의심하지 않을 수 없다.

1) 삼척화력은 2013년 2월 제6차 전력수급기본계획에 신규 설비로 반영되고 2013년 7월에 발전사업 허가를 받은 이래, 4년 반이 가깝도록 환경영향평가조차 완료하지 못한 사업이다. 애초에 발전사업 허가를 받은 동양 그룹은 기초 인허가 밖에 없는 석탄발전 사업권을 매물로 내놓았고, 2014년 8월 포스코에너지는 이 사업권을 무려 4천억원이 넘는 금액에 인수했다.

2) 국회는 이처럼 발전사업자들이 기초 인허가만 받은 껍데기 사업권(이른바 ‘딱지’)을 수천억 원에 사고 팔면서 공사를 지연하고 국가적인 전력수급계획에 지장을 초래하는 행태를 바로 잡기 위해 2014. 10. 15.자로 전기사업법을 개정하였고, 사업자가 정당한 사유 없이 ‘공사계획 인가기간(착공기한)’ 내에 착공을 하지 못하면 발전사업 허가를 반드시 취소하여야 하는 것으로 명시하였다.

3) 석탄화력발전소의 착공기한은 발전사업 허가를 받은 날로부터 3년이다. 포스코에너지는 개정법의 부칙에 따라 한 차례 기한을 유예 받고도, 그 이후 두 차례나 기한을 도과하여 산업부가 착공기한을 두 번 연장해 준 상태이다. 이번 달 말에는 또 다시 착공기한이 도래하는데, 아직 환경영향평가 협의조차 완료되지 않은 삼척화력이 이번 달 내에 착공을 하는 것은 불가능한 상황이다. 산업부가 기한을 연장해주지 않는다면 발전사업 허가의 ‘필요적 취소사유’가 발생하게 된다.

4) 즉, 삼척화력은 이미 2016년부터 착공기한이 만료되어 법률적 취소사유가 존재하는 사업이었고, 이렇게 사업이 지연된 데에는 사업자가 사업권을 사고 팔면서 시간을 허비하고 환경영향평가를 제때 완료하지 못한 책임이 크다.

 

  1. 산업부는 일찍부터 마치 신규 석탄사업자에게 사업 추진에 대한 법적 권리가 있는 것처럼 발언하고, 이를 기정사실화 해왔다. 그러나 실패한 투자는 보상의 대상이 아니며, 국가 전력수급에 영향을 미치는 발전사업의 지연은 법에 따른 제재의 대상이다. 산업부가 포스코에너지의 입장을 대변하며 ‘법 준수’를 운운하는 것은 대기업에 대한 특혜와 결탁이 의심되는 대목이다.
  2. 현 정부는 국민에게 ‘안전하고 환경적인 에너지 시대를 열겠다’고 약속했다. 갈수록 심각해지는 기후변화, 미세먼지 문제 해결을 우선적 국정과제로 삼고 있는 현 정부가 신규 석탄발전소 7기를 계속 추진하겠다고 하는 것은 두 얼굴의 모순된 행동이 아닐 수 없다. 산업부는 미착공 삼척화력의 추진을 즉각 중단하고, 법에 따라 착공기한을 준수하지 못한 삼척화력의 발전사업 허가를 취소하기를 강력히 요구한다.

[성명] 진실은 침몰하지 않는다.제2의 세월호 참사 조사기구를 즉각 구성하라.

 

지난 12월 25일 누리꾼 <자로>가 세월호의 침몰원인과 관련하여 8시간 분량의 다큐멘터리 ″세월X″를 공개하였다. <자로>는 다큐멘터리를 통해 그 동안 검찰이 침몰원인으로 결론 낸 ‘조타수의 조타미숙’, ‘과적’, ‘고박’, ‘복원성 불량’ 은 선박의 직접적인 침몰원인이 아니라고 반박하면서, 항적도 및 진도VTS 관제영상 등을 과학적으로 분석하여 세월호 침몰원인이 직접적인 외력에 의한 것이며, 구체적으로는 잠수함 충돌 의혹이 있다는 입장을 밝혔다.

 

<자로>의 주장과 같이 세월호가 외력에 의해 침몰되었다면 세월호 참사 진상규명 작업은 원점에서부터 다시 시작되어야 한다. 자로의 다큐멘터리는 공개 이틀 만에 조회수 300만건을 넘어설 정도로 국민들의 관심도 매우 높다.

 

국방부는 다큐멘터리가 공개된 후 자로의 의혹 제기에 대하여 “사실 무근”이라고 철벽을 치고 나섰고, 해군은 “허위사실유포”라며 법적으로 강력 대응하겠다고 나서고 있다. 대한민국 국민의 한 사람으로서 표현의 자유가 있는 자가 스스로 조사한 결과를 공개하고, 참사의 원인을 밝히기 위해 합리적인 의심을 제기한 것에 대해 군은 그저 ‘허위사실’ 운운하며 자신들은 책임을 면하기 위해 급급한 모습이다.

 

세월호 참사가 발생한 지 벌써 1000일이 다 되어 가는 시점에 침몰원인과 관련하여 새로운 주장이 제기되었다는 사실 자체가 세월호 참사의 진상규명이 제대로 이루어지지 못했음을 드러내 준다. 세월호 참사의 진상규명을 요구하는 국민적 염원을 담아 만들어진 4.16 세월호 참사 특별조사위원회는 정부와 새누리당의 조직적 방해로 인하여 조사권한과 예산이 대폭 축소되었다. 그것도 모자라 제한된 상황에서도 참사의 진상규명에 매진했지만 중도에 강제해산 되었다. 특조위는 진상규명을 위해 필수적으로 필요한 선체의 인양과 조사에서도 배제되었다. 아직까지 바다 속에 남아 있는 세월호 선체는 인양과정에서 이미 심각하게 훼손되었고 언제 인양될지 기약도 없는 실정이다.

 

진실을 밝히는 가장 좋은 방법은 시민의 입에 재갈을 물리는 것이 아니라, 제기된 의혹을 햇빛에 드러내는 것이다. 이를 위해 세월호 침몰원인을 밝힐 유일한 증거인 선체의 온전한 인양이 반드시 필요하다. 또한, 이번에 새롭게 제기된 <자로>의 주장을 포함하여 여전히 해결되지 않고 남아 있는 진상규명 과제의 해결을 위한 조사기구의 구성이 시급하다. 무엇보다 새롭게 구성되는 진상조사 기구는 수사권한을 포함하여 제대로 된 진상규명을 위해 필요한 실질적인 권한이 필요하다.

 

감춰진 진실을 밝히기 위해, 유족의 눈물을 닦아주기 위해 새로운 세월호 특별법이 제정되어야 한다. 우리는 국회가 지금이라도 세월호 특별법 제정에 나설 것을 강력히 촉구한다.

민변, 한미FTA 서문 중 대미 한국투자자가 한미FTA 효과를 누리는 것을 제약하는 조항을 추가하기 위하여 한미 양측이 교환한 문서대한민국 영토 조항의 수정을 위하여 한미 양측이 교환한 문서정보공개청구소송 제기 

민주사회를위한변호사모임(회장 한택근 변호사)은 지난 2015년 3월 한미FTA 비밀해제일(2015. 3. 15.)에 맞추어 30개 분야의 협상 서류 공개를 청구하였으나, 정부는 대부분의 정보 공개를 거부하였다. 이에 민변은 2015. 6. 26. 비공개된 정보 중 ‘서문 중 대미 한국투자자가 한미FTA 효과를 누리는 것을 제약하는 조항을 추가하기 위하여 한미 양측이 교환한 문서’와 ‘한미FTA 중 대한민국 영토 조항의 수정을 위하여 한미 양측이 교환한 문서’의 정보공개를 청구하는 소송을 제기하였다. 한미FTA 체결과정을 보면, 2007. 4. 2. 한미FTA가 협상 시작 약 2년 2개월만에 타결되었고, 같은 해 5. 25. 타결된 협상문 원문이 공개되었으며, 2007. 6월 추가협의가 2차례 진행된 후 같은 해 6. 30. 양국 대표단이 한미FTA에 서명을 하였는데, <2007. 5. 25. 타결된 협상문>과 <2007. 6. 30. 서명된 협정문>이 서로 다른 점이 확인된 바 있다. 민변은 2007년 당시에도 정보공개를 청구하였으나 정부는 한미 간의 비밀유지협정을 이유로 공개를 거부하였다. 이후 민변은 한미FTA 발효 후 3년간의 비밀유지협정을 고려하여, 비밀해제일인 2015. 3. 정보공개를 청구하였으나, 정부는 다시 공개를 거부한 것이다.

정부는 ‘한미FTA 중 대한민국 영토 조항의 수정을 위하여 한미 양측이 교환한 문서’에 대하여 ‘보유 관리하고 있지 않은 정보’라는 이유로 정보 공개를 거부하였다. 그런데 외교관계에서 협상이 일단락되었다가 다시 수정하는 것은 매우 이례적이고, 이례적인 수정 과정에서 변변한 문서 하나 없이 한미 양측에서 의견을 교환하고 타결된 협상문을 변경하는 것은 상식적으로 납득하기 어렵다. 따라서 해당 문서들이 존재할 것이고 강하게 추측되는데도 정부는 “없다”고 하는 것이다. 더군다나 한미FTA 영토조항은 독도 문제와 밀접한 관련이 있어 사회적으로도 매우 중요한 사항이다. 만일 정부의 설명이 사실이라면, 몇몇 외교공무원들이 미국측 인사들과 회의록도 없이 조항을 변경하고, 독도에 대한 영토주권에 불리한 국면을 야기한 것이란 말밖에 되지 않는다.

 정부는 ‘서문 중 대미 한국투자자가 한미FTA 효과를 누리는 것을 제약하는 조항을 추가하기 위하여 한미 양측이 교환한 문서’에 대하여 “공개시 우리의 협상 전략과 대응과정이 현재 진행중인 또는 향후 협상이 예상되는 상대국에게 노출될 우려와 해석이 확정되지 않은 협정문에 대한 우리측 내부 입장 공개로 향후 분쟁발생시 불리한 증거로 활용될 우려 등이 있으므로 외교관계 등에 관한 사항으로 공개 시 국가의 중대한 이익을 현저히 해칠 우려가 인정되는 경우”라는 이유로 정보 공개를 거부하였다. 그런데 이미 협상이 완료되고 발효된 지 3년이 지난 한미FTA를 두고 ‘진행 중이거나 향후 협상이 예상되는 경우’라고 하는 것은 이해하기 어렵다. 심지어 발효 후 3년이 경과하면 관련 문서들을 공개하기로 합의가 이루어졌음에도 불구하고 정부는 정보공개를 거부하고 있는 것이다.

정부의 비공개결정은 정보공개법을 위반한 것이고 국민의 알권리를 침해하는 것이다. 법률의 제개정 과정에서도 모든 회의록이 공개되는데, 이미 법률적 효력을 발휘한지 3년이 지난 한미FTA 관련 의견 교환 문서를 공개하지 않는 것은 밀실행정과 비밀협상으로밖에 보이지 않는다.

정부는 지금이라도 한미FTA 협상 과정에 관한 정보를 투명하게 공개하여야 할 것이다.

[성명]법원의 국정원 직원 김하영의 감금 혐의에 대한

무죄 판결을 환영한다

오늘 법원(서울중앙지방법원 제30형사부, 재판장 심담 부장판사)은 2012. 12. 11. 부터 13일까지 서울 역삼동의 오피스텔 성우스타우스 607호 안에 있는 국정원 심리전단 직원 감하영을 감금하였다는 혐의로 검찰이 민주통합당(당시) 이종걸 의원 등 5명을 폭력행위등처벌에관한법률(공동감금 등) 위반죄로 기소한 사건에 대하여 무죄를 선고하였다.

우리 모임은 이 판결이 적절하다고 판단하고 다행스럽게 생각한다. 만시지탄이지만 사필귀정이다. 당시 607호 안에 있었던 국정원 직원 김하영은 수사결과 국정원 심리전단 소속으로서 2012년 대선 운동 기간 동안 인터넷 ‘오늘의 유머’ ‘보배드림’ 사이트 등을 무대로 하여 당시 야권의 대선후보였던 문재인, 안철수, 이정희 등을 원색적으로 비난하는 사이버 여론전을 펼쳤던 것으로 밝혀졌다. 또한 스스로 감금되었다고 주장하던 때인 2012. 12. 11. 밤 10시부터 그 다음날 01:08경까지 사이에 자신의 노트북안에 있던 파일 187개를 삭제하여 이 가운데 150여개를 복원이 불가능하게 만들었다는 점도 검찰 수사결과 밝혀졌다. 그 때 김하영이 국정원의 상급자들과 잦은 전화통화를 하였음도 검찰수사를 통해 밝혀졌다. 이러한 점에 비추어 보면, 당시 김하영은 국정원 심리전단 소속 요원으로서 노트북 안에 존재하는 대선개입의 증거를 없애고자 자신과 국정원의 필요에 의하여 607호 안에 머물렀던 것임이 분명하다. 오늘 법원은 김하영이 본인 의지로 607호 안에서 나오지 않은 것이라고 밝혔던바, 법원의 이러한 판단은 상식적 결론을 확인한 것에 다름 아니다.

주지하는바와 같이 2012년 대선을 앞두고 원세훈 당시 국정원장은 국정원의 심리전단을 확대개편하고 종북세력척결을 독려하면서 국정원의 조직적 선거개입을 지시하였다. 그에 대해 검찰이 국정원의 국기문란행위를 수사하고 엄정한 처벌을 하고자 하였으나, 그 뒤의 결과는 우리 모두가 아는 대로이다. 당시 검찰총수 채동욱은 축출되었고, 수사팀은 공중분해되었다. 그 결과 진실은 여전히 미궁에 빠져 있고 당시 이러한 국정원의 대선개입의 진상을 밝히라고 요구하거나 그 진실을 밝히려던 사람들은 수사의 대상이 되는 고난을 겪고 있다. 이런 전도된 정의의 원인 한 가운데에 박근혜 정권과 검찰이 자리하고 있다. 특히 검찰은 검찰의 본분에 충실하고자 했던 조직의 수장이 매우 비열한 방법으로 정권에 의하여 축출되는 수모를 겪었음에도 불구하고 그 어떤 이의제기나 저항도 없이 정권의 요구에 순응하고 있다. 급기야는 수사팀을 공중분해시켜 원세훈 사건의 공소유지도 힘들게 만들고 있다.

민주공화국을 표방하는 우리 헌법질서에서 주권자의 대의의사 표명에 정보기관이 개입하는 것은 어떤 이유로도 용납될 수 없다. 이런 이유에서 우리 모임은 국정원의 대선개입에 대하여 진상규명과 상응한 책임추궁을 일관되게 요구해 왔다. 그런 상황에서 검찰이 해야 할 일은 초기의 의지대로 국정원의 국기문란행위에 대한 철저한 수사였지 국정원 직원의 감금 혐의에 대한 기소가 아니었다. 우리 모임은 검찰이 이제라도 이 사건에 대한 공소유지를 포기하고 파기환송된 원세훈 사건의 공소유지에 총력을 경주할 것을 강력히 촉구한다.
