42ND SESSION OF THE UN HUMAN RIGHTS COUNCIL

INTERNATIONAL SAFE ABORTION DAY – 28 SEPTEMBER 2019

 

Please note that a shorter version of this statement was delivered orally on 23 September 2019 to fit the time requirements of the Human Rights Council.

 

Thank you, President. I deliver this statement on behalf of 317 organizations[i] and 506 individuals.[ii]

 

In the Vienna Declaration and Programme of Action, States explicitly agreed to prioritize the realization of women’s human rights and recognized that all human rights are universal, indivisible, interdependent and interrelated. Yet, 26 years later, women and girls’ human rights and bodily autonomy continue to be routinely violated, including through the denial, criminalization and stigmatization of access to safe and legal abortion – all of which is rooted in the discrimination, oppression, violence and coercion affecting the material conditions that shape people’s lives and ability to exercise their bodily autonomy and human rights.

 

In 1994, Black feminists came together as the Women of African Descent for Reproductive Justice, in reaction to the white supremacy, colonialism and capitalism they observed shaping reproductive politics and inherent in the broader population control narratives. Reproductive justice is centered on the rights to bodily autonomy and self-determination, and to parent and not to parent in safe and healthy environments.[iii] It is rooted in an intersectional analysis and moving beyond an individualistic conception of “choice” to instead place emphasis on the material conditions necessary to exercise reproductive rights. Reproductive justice also addresses the legacy of population control informed by white supremacy and replacement theory, which has resurfaced in current populist politics.

Reproductive justice is achieved when all people are able to enjoy their right to bodily autonomy and sexual and reproductive self-determination. It requires people to enjoy economic, social, and cultural rights and freedoms, and the ability to make and exercise choices not limited by oppression, discrimination, stigma, coercion, violence, lack of opportunities or possible consequences. Treaty bodies and special procedures have echoed this need and recognized that the realization of women’s reproductive rights depends on the material conditions in which they are born, grow, live, work and age, and on power structures and resource distribution at all levels[iv] – in other words, the social and other determinants of health.[v] These include access to housing, safe drinking water, effective sanitation systems, access to justice, and freedom from violence, among other factors, and impact the agency that individuals can exercise with respect to their sexual and reproductive health.[vi] Our discussions on abortion and sexual and reproductive rights cannot continue ignoring these factors.

The realization of reproductive justice, the right to bodily autonomy and substantive equality also requires freedom from control and interference by State and non-State actors, including private companies, donors and multinational corporations, including criminalization of sexual and reproductive behaviors and decisions, restrictive abortion laws, punitive sanctions, and legal restrictions to regulate women’s control over their own bodies.[vii] These laws, policies and practices typically target and disproportionately impact women of color, women from the Global South, women with disabilities, women living in poverty, migrant women, ethnic minorities and indigenous women, women living with HIV, young women and adolescents, sex workers and gender-non-conforming persons based on racial, class, disability and gender stereotypes.[viii]

Today, on 28 September, International Safe Abortion Day, we urge States to respect, protect and fulfill women and girls’ human rights and realize reproductive justice for all. We call on states to:

  • Ensure access to available, accessible, acceptable and quality sexual and reproductive health services as part of universal health coverage and public health systems, including modern contraceptive options, comprehensive abortion and post-abortion care, financed adequately through taxation and free from control from other governments, multilateral agreements and transnational corporations.
  • Remove all legal and social barriers to safe abortion, including its criminalization, which is broader and including sanctions and no sanction regimes, and commit to providing safe abortion services on request.
  • Address social and other determinants of health in law and practice from an intersectional perspective to ensure that they enable all individuals to effectively enjoy their sexual and reproductive rights.[ix]
  • Hold private companies and multinational corporations accountable for unethical research practices, violations and abuses of women and girls’ reproductive rights and bodily autonomy.
  • Prioritize the meaningful participation of local movements, women human rights defenders and feminists demanding accountability for sexual and reproductive health and rights violations, and center their demands and recommendations for the realization of reproductive justice.

[성명] 심야 군사작전 사드장비 반입 규탄한다.

 

 

오늘 2017. 4. 26. 새벽 주한미군과 국방부가 심야에 기습적으로 성주 골프장에 사드장비를 반입했다. 자정에 왜관 캠프 캐롤을 출발한 사드 장비들은 새벽 2시 성주군 초전면 소성리에 도착했고, 이들은 한국 경찰 8,000여명이 주민 수 백명을 마구잡이로 진압하는 동안 성주 골프장이었던 사드 배치 부지로 진입했다.

 

민주주의의 꽃이라는 대통령 선거의 핵심 쟁점인 사드 배치를 막무가내로 진행하는 것은 도저히 용납할 수 없다. 이는 명백한 선거개입이며 국민들의 선택권을 가로막는 국민주권 파괴행위이다.

 

사드배치는 처음부터 적법절차를 완전히 무시한 것이었다. 국방부는 처음부터 국민들과 적법절차를 무시하기 위해 온갖 변명을 일삼았다. 국회의 동의가 필요 없다고 강변하거나, 주민들을 상대로 단 한차례의 설명회나 공청회를 갖지 않은 것은 물론이고, 민주당 사드 특별위원회가 미군에게 공여한 행위가 「국유재산특례제한법」위반 소지가 있으니 검토하라는 기자회견을 하자마자 사드를 전격적으로 배치한 것이다. 인간의 존엄성을 침해한 적법절차 위반과 관련하여 법원에 계류중인 소송이 다수인데, 오늘 국방부는 행위는 법원의 판단 따위야 개의치 않겠다는 태도를 그대로 드러낸 것이다.

 

지금 사드 장비를 성주 골프장이었던 자리에 들여놓았다고 해서 안심하지 말아라. 우리에게는 주권과 사법주권이 있고, 불의한 대통령을 탄핵시킨 국민이 있다. 국민을 상대로 군사작전을 하여 사드장비를 도둑 반입한 행위가 범죄행위임은 조만간 드러날 것이다.

정부, 론스타 5조원 소송 증인 명단 공개 거부

-사생활의 비밀과 자유 침해 우려 이유로

 

정부가 론스타 5조원 소송 2차 증인 명단을 공개하라는 민주사회를 위한 변호사 모임(민변)의 청구를 거부했다. 민변은 지난 16일, 공공기관의 정보공개법에 따라 론스타 5조원 소송의 2차 구술 심리 증인 명단 공개를 요구했다. 2차 심리는 미국 워싱턴 DC에서 지난 6.29.(월)부터 7.7.(화)까지 진행되었다.

 

정부는 지난 24일 민변에 비공개 통지서를 보내어 중인 명단 비공개를 결정했다. 정부의 비공개 사유는 중재 재판에 영향을 미칠 우려가 있고, 증인들이 공개될 경우 사생활의 비밀과 자유를 침해할 우려가 있다는 것이다.

 

이에 대해 민변 국제통상위원회 위원장 송기호 변호사는, 지난 6월에 이미 종료된 2차 심리 증인 명단이 지금 공개된다고 해서 그것이 재판에 영향을 미친다고 할 수 없다고 반박했다. 또한 증인의 사생활보다 납세자인 국민의 알권리가 더 중요하다고 밝혔다.

 

민변은 정부의 거부에 대하여, 오늘 자로 공공기관의 정보공개법에 따라 2차 심리 증인 명단 비공개에 대해 이의신청을 접수했다. 민변은 이의신청서에서 론스타의 국제 중재는 단순한 민사 사건이 아니라 5조원의 재정이 걸린 공공 사안으로서 헌법의 재판 공개 원칙을 따라야 한다고 밝혔다. 또한 투자자 국가 국제중재는 유엔에서도 투명성과 공개를 원칙으로 정하고 있으므로 2차 심리 증인 명단 공개를 요구했다.

[성명] 여성가족부는

대전광역시 성평등기본조례 개정 요청을 철회하여

실질적 양성평등정책의 의미를 실현시켜야 한다

 

 

여성가족부는 8월 4일 대전광역시에 보낸 공문을 통해서 새 양성평등기본법이 성소수자와 관련된 내용을 포함하고 있지 않으므로 대전광역시의 성평등기본조례 중 성소수자 관련 내용을 규정하는 것은 입법취지에 반하므로 개정을 요청하였다. 하지만 이는 성주류화정책의 의미를 이해하지 못한 처사이며 실정법상 성적지향·성별정체성 차별의 소지가 있고 한국이 국제사회에 천명한 실질적 양성평등구현 약속에 반하는 일이므로 이 요청은 철회되어야 한다.

 

김희정 여성가족부 장관은 올해 3월 뉴욕에서 열린 제59차 유엔여성지위위원회의 기조연설에서 한국의 북경행동강령 이행 노력을 설명하며 “북경행동강령 채택 직후 제정된 여성발전기본법(1996년)을 양성평등으로의 여성정책 패러다임 변화를 반영하여 양성평등기본법(2015년 7월 1일 시행)으로 개정하였으며 실질적인 양성평등구현을 위한 다양한 정책을 발굴하여 시행할 계획”이라고 밝혔다. 이렇게 여성가족부는 새 양성평등기본법이 성주류화(gender mainstreaming)정책을 실현시키는 차원의 입법이라는 것을 국제사회 앞에서 천명했다.

 

성주류화정책은 북경행동강령 이후 각 국가에 도입되었다. 유엔경제사회이사회는 성주류화 개념에 대하여 ‘여성과 남성을 위한 제도, 정책 또는 프로그램을 포함한 모든 실행 계획의 이행을 모든 분야와 모든 수준 내에서 평가하는 과정이다. 이는 모든 정치, 경제, 사회적 영역의 정책과 프로그램의 고안, 이행, 감시와 평가에 있어 여성과 남성의 관심과 경험을 통합함으로써 여성과 남성이 동등한 혜택을 받고 불평등이 조장되지 않도록 하기 위한 하나의 전략이고. 그리하여 궁극적인 목적은 성 평등을 이루는 것이다’라고 정의하고 있다(유엔경제사회이사회의 합의결정 1997/2). 또한 세계경제포럼 같은 국제경제기구들은 성평등은 ‘옳은 일’이기도 하지만 성에 기반한 차별과 배제를 제거하는 것이 국가와 사회가 가진 자원을 최대한으로 활용할 수 있게 하여 국가 발전의 원동력이 되기 때문에 중요한 국가적 또는 초국가적 목표로 보고 있다.

 

이렇게 성주류화정책은 궁극적으로 국가적 성평등의 목표를 달성하기 위한 주요 전략이자 수단일 뿐이다. 그런데 최근의 성주류화정책은 교차성(intersectionality)과 차별금지주류화에 주목하고 있다. 여성이든 남성이든 그 자체로 모두 ‘균질한’ 집단이 아니기 때문이다. 개인의 정체성은 성별 외에도 연령, 인종, 장애, 성적지향 등을 포함한다. 이 차이와 다양성을 무시한 성주류화 정책은 잘 작동하지 않는다는 것이 많은 국가들의 성주류화정책에서 드러났다. 이주여성, 장애여성 등의 집단을 특별히 보호하는 정책은 이미 여성가족부의 실질적 양성평등정책의 한 부분이다.

 

좋은 사례로는 유럽에서도 스웨덴이 대표적이다. 스웨덴에서 성주류화는 독립된 정책이 아니라 더 넓고 포괄적인 평등정책의 맥락 하의 목표를 쟁취하는 전략이다. 스웨덴은 세계경제포럼이 발표한 2014년 성평등 순위에서 전체 142개국 중 4위를 차지하였다. 세계 최하위권인 117위의 한국과는 큰 격차가 있다. 대전시는 성평등조례를 준비하며 주한스웨덴대사의 강연 행사도 가져 비교사례로 참고한 것으로 알려졌다.

 

이렇게 지방자치단체가 좋은 성주류화정책을 입안하려고 하는 것을 여성가족부가 막는 것은 이해하기 어렵다. 모법에서 명시적으로 언급하지 않은 교차적 차별금지사유가 지방의 성평등조례에서 고려되는 것은 위법의 문제는 아니다. 입법 과정에서 법제명의 채택에 대한 논란은 다소 있었지만 이런 방식으로 성적지향 등 성평등과 관련된 개념의 적극적 배제가 논리적으로 가능하다고 보이지도 않으며 실질적 양성평등을 꾀한다는 입법 취지에도 맞지 않는다.

 

국제동성애자인권위원회(IGLHRC)의 2010년 ‘비이성애규범적 여성에 대한 성적지향 성별정체성에 기반한 폭력’ 보고서에 의하면 특히 아시아의 성소수자 여성은 정신병원 강제입원 등 원 가족에 의한 박해, 교정 강간, 학교와 직장에서의 성희롱, 주거에서의 강제추방, 언론의 낙인 등 성별고정관념에 기반한 폭력과 차별에 시달리고 있다. 성평등 사회를 위해 시급히 해결되어야 하는 중대한 문제들이다. 2015년 4월 도입된 도쿄 시부야 성평등조례는 남녀인권과 성적소수자인권의 존중을 표방하고 있는데 정식명칭은 ‘시부야 구 남녀 평등과 다양성을 존중하는 사회를 추진하는 조례’이다.

 

성주류화정책은 일견 성중립적으로 보이는 정책과 결정에 성인지적인 요소를 도입하여 여성과 남성의 진정한 평등을 이끌어내자는 것이다. 그 시야가 좁다면 제대로 작동할 수 없다. 한국의 여성가족부는 세계 최하위 수준의 한국 성평등지수를 살펴볼 때 지금 지방자치단체의 양성평등정책에의 노력을 방해할 상황이 아니다. 여성가족부는 이제 한국이 성에 기반한 고정관념과 차별에서 자유로운 사회가 될 수 있도록 실질적 양성평등을 위하여 더욱 노력할 책무가 있다.

 

성주류화정책을 이해하지 못한 이번 요청은 취소되어야 한다. 설마 이것이 김희정 장관이 여성지위위원회에서 피력한 실질적 양성평등의 실현은 아닐 것이다. 앞으로 양성평등기본법의 취지를 살리는 정책의 입안을 촉구하며 지방자치단체마다 그에 맞는 성평등조례의 입법을 기대한다.

‘긴급조치 발동은 고도의 정치행위라는

대법원 판결에 대한 헌법소원 제기‘ 기자회견

 

1. 귀 언론사의 무궁한 발전을 기원합니다.

2. 헌법재판소는 2013. 3. 21. 긴급조치 제1, 2, 9호가 입법목적의 정당성과 방법의 적절성을 갖추지 못하였을 뿐 아니라 죄형법정주의에 위배되고 참정권, 표현의 자유, 집회·시위의 자유, 영장주의 및 신체의 자유, 학문의 자유 등 국민의 기본권을 지나치게 제한하거나 침해했다며 위헌 결정 선고하였습니다. 그리고 대법원도 “긴급조치 제9호가 해제 내지 실효되기 이전부터 이는 유신헌법에 위반되어 위헌무효이고, 나아가 긴급조치 제9호에 의하여 침해된 기본권들의 보장 규정을 두고 있는 현행 헌법에 비추어 보더라도 위헌무효”라고 판시하였습니다.

3. 그런데 대법원은 2014. 10. 27. 위헌 결정으로 소급하여 효력을 상실한 대통령긴급조치’(긴급조치 제9호)에 근거하여 수사를 진행하고 공소를 제기한 수사기관의 직무행위나 유죄판결을 선고한 법관의 재판상 직무행위가 불법행위에 해당한다고 보기 어렵다며 박정희의 수족노릇을 해온 수사기관, 검찰, 과거 사법부에게 사실상 면죄부를 주었습니다. 뿐만 아니라 2015. 3. 26.에는 “유신헌법에 근거한 대통령의 긴급조치권 행사는 고도의 정치성을 띤 국가행위로서 대통령은 국가긴급권의 행사에 관하여 원칙적으로 국민 전체에 대한 정치적 책임을 질 뿐 국민 개개인의 권리에 대한 관계에서 민사상 불법행위를 구성한다고 볼 수 없다”고 하여, 과거 긴급조치의 공범으로서 부역하였던 역사를 되풀이 하고 있습니다.

4. 지난 7. 23. 대법원은 긴급조치 제1호 위반으로 유죄선고를 받았던 백기완 선생의 국가배상청구에 대하여 단 4줄의 이유만으로 간단히 상고기각 판결을 선고하였습니다.

5. 이에 백기완 선생님을 청구인으로 하여, 헌법재판소의 위헌결정 취지에 반한 대법원 판결과 법원 재판을 제외한 헌법재판소법의 위헌성을 함께 제기할 계획입니다. 오는 8월 24일(월) 오전 10시 30분, 헌법재판소 정문 앞에서 민변 긴급조치 변호단, 긴급조치피해자 대책위, (사)민청학련계승사업회는 ‘긴급조치 발동은 고도의 정치적 행위라는 대법원 판결에 대한 헌법소원 제기’ 기자회견을 개최하고자 합니다.
