42ND SESSION OF THE UN HUMAN RIGHTS COUNCIL

INTERNATIONAL SAFE ABORTION DAY – 28 SEPTEMBER 2019

 

Please note that a shorter version of this statement was delivered orally on 23 September 2019 to fit the time requirements of the Human Rights Council.

 

Thank you, President. I deliver this statement on behalf of 317 organizations[i] and 506 individuals.[ii]

 

In the Vienna Declaration and Programme of Action, States explicitly agreed to prioritize the realization of women’s human rights and recognized that all human rights are universal, indivisible, interdependent and interrelated. Yet, 26 years later, women and girls’ human rights and bodily autonomy continue to be routinely violated, including through the denial, criminalization and stigmatization of access to safe and legal abortion – all of which is rooted in the discrimination, oppression, violence and coercion affecting the material conditions that shape people’s lives and ability to exercise their bodily autonomy and human rights.

 

In 1994, Black feminists came together as the Women of African Descent for Reproductive Justice, in reaction to the white supremacy, colonialism and capitalism they observed shaping reproductive politics and inherent in the broader population control narratives. Reproductive justice is centered on the rights to bodily autonomy and self-determination, and to parent and not to parent in safe and healthy environments.[iii] It is rooted in an intersectional analysis and moving beyond an individualistic conception of “choice” to instead place emphasis on the material conditions necessary to exercise reproductive rights. Reproductive justice also addresses the legacy of population control informed by white supremacy and replacement theory, which has resurfaced in current populist politics.

Reproductive justice is achieved when all people are able to enjoy their right to bodily autonomy and sexual and reproductive self-determination. It requires people to enjoy economic, social, and cultural rights and freedoms, and the ability to make and exercise choices not limited by oppression, discrimination, stigma, coercion, violence, lack of opportunities or possible consequences. Treaty bodies and special procedures have echoed this need and recognized that the realization of women’s reproductive rights depends on the material conditions in which they are born, grow, live, work and age, and on power structures and resource distribution at all levels[iv] – in other words, the social and other determinants of health.[v] These include access to housing, safe drinking water, effective sanitation systems, access to justice, and freedom from violence, among other factors, and impact the agency that individuals can exercise with respect to their sexual and reproductive health.[vi] Our discussions on abortion and sexual and reproductive rights cannot continue ignoring these factors.

The realization of reproductive justice, the right to bodily autonomy and substantive equality also requires freedom from control and interference by State and non-State actors, including private companies, donors and multinational corporations, including criminalization of sexual and reproductive behaviors and decisions, restrictive abortion laws, punitive sanctions, and legal restrictions to regulate women’s control over their own bodies.[vii] These laws, policies and practices typically target and disproportionately impact women of color, women from the Global South, women with disabilities, women living in poverty, migrant women, ethnic minorities and indigenous women, women living with HIV, young women and adolescents, sex workers and gender-non-conforming persons based on racial, class, disability and gender stereotypes.[viii]

Today, on 28 September, International Safe Abortion Day, we urge States to respect, protect and fulfill women and girls’ human rights and realize reproductive justice for all. We call on states to:

  • Ensure access to available, accessible, acceptable and quality sexual and reproductive health services as part of universal health coverage and public health systems, including modern contraceptive options, comprehensive abortion and post-abortion care, financed adequately through taxation and free from control from other governments, multilateral agreements and transnational corporations.
  • Remove all legal and social barriers to safe abortion, including its criminalization, which is broader and including sanctions and no sanction regimes, and commit to providing safe abortion services on request.
  • Address social and other determinants of health in law and practice from an intersectional perspective to ensure that they enable all individuals to effectively enjoy their sexual and reproductive rights.[ix]
  • Hold private companies and multinational corporations accountable for unethical research practices, violations and abuses of women and girls’ reproductive rights and bodily autonomy.
  • Prioritize the meaningful participation of local movements, women human rights defenders and feminists demanding accountability for sexual and reproductive health and rights violations, and center their demands and recommendations for the realization of reproductive justice.

집회·시위의 자유를 확인한 법원의 결정을 환영한다

 

서울행정법원 제6행정부(재판장 김정숙 판사)는 12. 3. 오후, 백남기농민쾌유와 국가폭력규탄 범국민대책위원회(이하 ‘범대위’)가 서울지방경찰청장에 대하여 제기한 옥외집회 금지통고 처분의 효력정지가처분 신청을 인용하는 결정을 하였다.

 

재판부는 옥외집회 금지통고 처분의 효력이 계속될 경우 범대위가 예정된 시각에 집회를 개최할 수 없게 되어 범대위가 회복하기 어려운 손해를 입을 수 있는 반면, 집회가 집단적인 폭행, 협박, 손괴, 방화 등으로 공공의 안녕 질서에 직접적인 위협을 끼칠 것이 명백하거나 집회 개최장소와 주변 도로의 교통 소통에 장애를 발생시켜 심각한 교통 불편을 줄 우려가 있다고 단정할 수 없다고 보았다.

 

위와 같은 재판부의 결정은 헌법상 기본권인 집회·시위의 자유가 우리 사회에 살아있음을 확인한 것으로, 집회·시위를 마치 허가제처럼 운영하고 있는 공권력에 대한 준엄한 경고이다. 경찰은 법원의 결정에 따라 위 집회를 충실히 보장하고, 차벽 설치·물포 및 최루액 살수 등 집회 참가자들을 위협하는 일체의 행위를 중단해야 할 것이다.

 

우리 모임은 집회·시위의 자유를 확인한 법원의 결정을 다시 한 번 환영하며, 광장에서 시민들의 목소리가 자유롭게 울려퍼질 수 있도록 공권력남용 감시에 최선을 다할 것이다.

[국가배상 책임을 인정한 판결에 관한 논평]

[긴급조치변호단][논평] 긴급조치 발령행위는 입법행위와 달리
국가배상 책임을 져야할 불법행위다

 

1. 긴급조치 발령행위는 고도의 정치행위로서 국민 개개인에 대하여 국가배상 책임이 인정되지 않는다는 대법원 판결(대법원 2014.10.27.선고 2013다217962판결, 2015.3.26.선고 2012다48824판결)이 선고 된 후, 하급심 판결들은 과거 1970년대 긴급조치 판결들이 그러하듯이 고뇌 없이 손쉽게 ‘정찰제 기각판결’을 해왔다.

2. 그러던 중 지난 2.4 광주지방법원 민사 제13부(2013가합11470판결, 마은혁 부장판사, 오수빈 판사, 허준기 판사)는 긴급조치를 비방하는 유인물을 제작·배포하였다는 등의 이유로 유죄판결을 받은 전북대 대학생 피해자들이 청구한 국가배상사건에서, 대법원 판결을 조목조목 비판하면서 아래와 같이 국가배상 책임을 인정하였다.

3. 즉, 대통령은 구 국가공무원법 (1978.12.5.법률 제3150호로 개정되기 이전의 것) 상 별정직 공무원이고, 긴급조치 제9호 발령행위는 구 국가배상법에서 정하는 직무행위이라고 전제한 후,

① 대통령의 긴급조치 제9호 발령행위가 위법한지 여부를 판단하기 위해서는 개별 국민의 권리를 보호하기 위한 것인지 여부, 그리하여 긴급조치를 발령하는 과정에서 대통령에게 위 개별 국민의 권리에 대응하여 개별 국민에 대해 부담하는 법적의무가 존재하는지 여부가 문제되는데,

② 입법행위는 다수결 원리에 따라 통일적인 국가의사를 형성하는데 반해 대통령은 대통령 1인의 배타적 판단에 따라 그 의사를 형성하는 점, 입법과정의 문제들은 언론, 선거에 의한 정치적 평가에 맡겨 정치적 책임을 추궁하고 면책특권을 갖는데 반해 대통령은 재직 중 형사상 불소추권을 부여할 뿐 면책특권에 상응하는 특권을 부여하지 않는 점, 입법의 방법을 선택할 수 있는 자유 내지 재량이 있으므로 구체적인 입법행위의 적부를 법적으로 평가하는 것은 원칙적으로 허용되지 않는다고 볼 수 있는데 반해, 긴급조치는 헌법 유신헌법 제53조에 발령요건, 목적을 명시하고 있는데, 대법원이 내용적으로 위헌일 뿐만 아니라 그 발동요건, 목적의 한계를 넘었다고 평가하는 것은 그 발령권자인 대통령이 유신헌법 제52조에서 정한 요건과 목적상 한계를 준수하지 않고 긴급조치 제9호를 발령하였다는 평가를 전제로 하고 있다고 볼 수 있는 점을 종합하면,

대통령의 이러한 권력행사가 국민개개인에 대한 관계에서 민사상 불법행위를 구성한다고 볼 수 없다고 한 것은 대통령의 긴급조치권 행사와 국회의원의 입법행위의 차이를 간과하고 입법행위 판결의 법리를 무비판적으로 원용한 것으로 잘못이라고 하지 않을 수 없다.

③ 긴급조치 제9호를 발령할 당시 대통령에게는 유신헌법 제8조, 제53조에 의하여 헌법에 정하여진 긴급조치의 요건과 한계를 준수하여 국민의 기본권을 보장하여야 할 사익 보호성 있는 직무상 의미가 있었음에도 대통령이 이를 다하지 않은 채 발령요건을 갖추지 아니하고 목적상 한계를 벗어나 국민의 자유와 권리를 지나치게 제한함으로써 헌법상 보장된 원고들을 포함한 국민의 기본권을 침해하는 내용의 긴급조치 제9호를 발령한 행위는 위법행위라고 할 것이고,

④ 설령 긴급조치 제9호의 발령과 관련하여 대통령은 원칙적으로 국민 전체에 대한 관계에서 정치적 책임을 질 뿐 국민 개개인의 권리에 대응하여 법적 의무를 지는 것이 아니라고 하더라도, 긴급조치 제9호의 내용이 헌법의 문언에 명백히 위배됨에도 불구하고 대통령이 굳이 긴급조치 제9호를 발령한 행위는 구 국가배상법 제2조 제1항 소정의 위법행위에 해당된다고 봄이 타당하다고 판시하였다.

4. 그러면서, 재판부는 사정이 이러함에도 이제 와서 새삼 긴급조치 제9호의 위헌성이 명백한 점을 부인하는 것은 법치주의의 최후의 보루로서 국민의 기본권 보장을 위한 사법심사를 충실히 수행한 판결로 평가받고 있는 대법원 2010. 12. 16. 선고 2010도5986 전원합의체 판결과 대법원의 긴급조치 위헌 결정의 역사적 의미를 훼손하는 일이라 하지 않을 수 없다고 대법원 판결을 비판하였다.

5. 이번 판결은 당시 유신헌법에 명백히 위배된 긴급조치를 발령하는 행위는 국가배상법상 소정의 위법행위라고 판시함으로써 종래 대법원 판결이 입법행위에 대한 국가배상 책임 판결을 긴급조치 발령행위에 그대로 의율 적용하여 국가배상책임을 부인한 판결을 정면으로 반박한 것이다. 특히 입법부의 입법행위와 달리 대통령 등 행정기관이 국민 개개인에 대한 관계에서 불법행위 책임을 지는 기준을 설시하였다는 점에서 그 의미가 있다.

6. 지난 2015. 9. 11. 서울중앙지방법원(민사 제11부. 2013가합544225판결, 김기영 부장판사,정순열, 이호연 판사)도 긴급조치 발동행위에 대한 국가배상 책임을 인정한 바 있다. 최근 하급심재판부가 판결로써 대법원 판결들의 법리적 문제점과 더불어 역사적 책임을 추궁한 것은 너무나 당연하지만 아직까지 과거 사법부의 오류를 시정하려는 고뇌어린 판결이 적다는 점은 아쉬움을 넘어 개탄스러울 따름이다.

7. 모임은 하급심 판결을 뒤늦게나마 환영하면서, 역사적・사법적 책임을 다하는 대법원 판결을 촉구하는 바이다.

고용노동부는 얼마나 더 헌법을 무시할 것인가
- 이주노조 설립을 가로막는 고용노동부의 행태를 규탄한다.

대법원은 지난 6월25일 전원합의체 판결을 통하여 서울경기인천 이주노동자 노동조합(이하‘이주노조’)이 노동조합 및 노동관계조정법(이하 ‘노조법’) 상 노동조합에 해당한다는 취지의 판결을 하였다. 8년의 기다림 끝에 선고된 해당 판결은 우리 헌법과 노동법에 비추어 볼 때 지극히 상식적이고 당연한 것이었다. 이 판결을 통해 모든 노동자는 그가 외국인인지 아닌지, 취업 중인지 아닌지 여부와 무관하게 노동3권의 주체임이 분명히 확인되었다. 그러나 고용노동부는 최근 이주노조에 대하여 또 다시 설립신고증을 내주지 않으면서, 헌법과 사법부의 판결을 무시하는 초법적, 정치적 행태를 보여주고 있다. 우리는 고용노동부의 이러한 행태에 대해 개탄하지 않을 수 없다.

현재 고용노동부는 이주노조가 대법원 판결 이후 제출한 노조설립신고에 대하여 두 차례에 걸쳐서 보완요구를 하면서 설립신고서를 수리하지 않고 있다. 고용노동부는 이주노조의 규약에 있는 ‘이주노동자 합법화’, ‘노동허가제 쟁취’라는 목적이 노조법 상에서 노조설립 결격사유로 규정하고 있는 ‘주로 정치운동을 목적으로 하는 경우’ 에 해당될 수 있다고 보면서 위와 같은 행태를 보이고 있다.

그러나 고용노동부의 이러한 주장은 타당하지 않다. 우리는 고용노동부가 어떤 꼬투리를 잡아서라도 이주노조를 인정하지 않으면서 종국에는 이주노조의 설립을 무산시키려고 작정을 했다고 보지 않을 수 없다. 노동조합 및 노동관계조정법 제2조에서 규정한 노동조합이라 함은 “근로조건의 유지 개선 뿐 아니라 근로자의 경제적 사회적 지위의 향상을 도모하는 것을 목적으로 하는 단체”를 말한다. 따라서 이주노동자의 근로조건 향상 등을 위해 활동하는 이주노조의 성격상 ‘이주노동 합법화’와 ‘노동허가제 쟁취’를 자신의 활동목적에 포함하는 것이야 말로 노조법에서 인정하는 노동조합의 목적에 부합하는 것이다. 어느 노조의 규약에 저런 정도의 선언적 내용이 포함되어 있지 않는가?

고용노동부의 위와 같은 입장은 지난 6월25일 대법원 판결에서 유일한 반대의견이었던 민일영 대법관의 견해에 근거한 것으로 추정된다. 민일영 대법관은 “규약에 ‘이주노동자 단속추방 반대, 이주노동자 합법화’등이 목적 중의 하나로 기재되어 있는 점이 이주노조를 ‘주로 정치운동을 목적으로 하는 단체’임을 추단할 수 있는 객관적인 사정”에 해당한다고 보았다. 그러나 이 의견은 소수의견에 불과하였고, 다수의 대법관은 이런 소수의견에 개의치 않고 이주노조에 대한 설립신고증 반려가 위법하다고 판결하였다. 그렇다면 위와 같은 의견은 더 이상 재고될 수 없는 것이다. 그런데도 고용노동부는 위와 같은 논리를 전개하고 있으니 억지 주장이라는 표현 외에 어느 표현이 그에 적합하겠는가?

한편 고용노동부가 거듭 규약상의 명목을 이유로 수정보완요구를 하는 것은 노조법상 부여된 노동조합 설립신고에 대한 심사권한을 남용하는 것이기도 하다. 현재 노조법상 부여된 설립신고에 대한 심사제도는 허가제로 운영되어서는 안 된다는 것이 헌법재판소와 대법원의 일치된 견해이다. 따라서 노동조합이 민주성과 자주성을 상실할 경우에만 국한하여 설립신고를 반려할 수 있으며, 그렇지 않은 경우에는 심사권한의 행사에 있어서 극도의 신중을 기해야 한다. 그러므로 설립신고서나 규약 내용에 법률상의 기재사항이 누락되어 있지 않는 한 행정청의 수정보완 요구는 자제되어야 한다. 사정이 이런데도 고용노동부가 이주노조에 대해 두 차례에 걸쳐 수정보완 요구를 하는 것은 심사권한의 범위를 일탈·남용한 것이라고 볼 수밖에 없다.

이처럼 고용노동부의 최근 행태는 어떤 근거로도 정당화 될 수 없다. 고용노동부는 노조법과 판결의 취지대로 설립신고서를 수리하여야 한다. 고용노동부가 그리 하지 않고 헌법과 대법원의 판결에 의하여 인정된 이주노동자의 노동3권을 지속적으로 훼손할 경우에는 고용노동부의 존재근거와 존립목적이 무엇인지 묻지 않을 수 없다. 이주노동자들이 주축이 된 노동조합이 우리 사회에 존재하는지 여부는 우리 사회의 민주성과 국제성을 판단할 수 있는 시금석이다. 그것은 또한 문명과 야만의 경계를 가르는 것이기도 하다. 우리는 고용노동부가 노동조합 설립신고 심사권한을 정치적 목적으로 오남용 하지 않기를 간절히 바라며 이런 행태가 지속될시 끝까지 투쟁할 것임을 다시 한 번 천명한다.

청주시는 노인전문병원 노동자들에 대한 노조탄압 중단하고 고용승계 보장하라!!

청주시는 2009년 157억을 투입하여 청주시 노인전문병원을 설립했으나 곧바로 민간병원에 위탁하였고, 이로 인해 공공의료는 훼손되고 소속 노동자들의 노동환경은 악화되었다. 이에 노동자들은 노조를 설립하고 의료공공성 강화와 노동환경 개선을 요구했으나 청주시와 수탁기관은 병원폐쇄와 전원해고로 대응하였다. 사회복지시설에서 절대 일어나서는 안 되는 일들이 하루가 멀다 하고 벌어지고 있다. 오늘 청주시는 또 다시 공공의료와 고용승계를 요구하는 노동자의 목소리를 철저히 묵살하고 그들의 소박한 농성장마저 강제철거하였다.

청주시 노인전문병원은 구 노인복지법상 노인복지시설이자 사회복지사업법에 따른 사회복지시설이다. 노인복지법과 사회복지사업법은 노인의 보건복지증진과 사회복지증진을 그 입법목적으로 규정하고 있고, 사회복지사업법은 노인전문병원과 같은 복지시설은 지자체가 직접 운영하거나 사회복지법인 또는 비영리법인에게만 위탁하도록 규정하고 있다. 또한 사회복지사업법 시행규칙 제21조의2 제1항 제5호의2에 따르면 복지시설의 위탁계약 체결시 고용승계에 관한 사항을 반드시 포함하도록 하고 있다. 결국 이러한 규정들을 종합하면 청주시는 위탁계약체결시 노인전문병원의 안정적인 운영을 위해 소속 노동자들의 고용승계가 보장해야 한다.

그럼에도 법치행정에 충실해야 할 청주시는 이를 무시하고 있다. 오히려 위와 동일한 내용의 법제처의 의견마저 은폐하며 자신들은 고용승계에 대한 책임이 없다고 오리발을 내밀고 있다. 청주시는 위와 같은 직무유기를 멈추고 당장 노동자들의 고용승계에 나서야 한다.

오늘 청주시의 행정대집행도 그 위법의 정도가 심각하다. 청주시는 설 연휴를 코앞에 둔 오늘 새벽 노동자들의 소박한 공간인 농성장을 군사작전하듯 행정대집행을 통해 모두 철거하였다. 청주시의 행정대집행은 의무이행을 위한 충분한 시간도 주지 않은 상태에서, 대집행영장이나 증표 제시도 없이 막무가내로 이루어졌고, 대집행이 법으로 금지된 일몰 전부터 실시하는 등 법 절차를 완전히 무시하였다. 근본적으로 행정대집행은 심각한 공익침해가 있어야 가능함에도 이를 완전히 무시하였다.

청주시의 작금의 행태는 공공의료에 역행하는 것은 물론 건전한 노사관계 구축에도 반한다. 청주시는 위법한 행정대집행에 몰두할 것이 아니라 법에 정해진대로 노동자들의 고용승계를 보장하면 된다. 반드시 필요한 일이고, 어려운 일도 아니다. 노인전문병원의 안정적인 운영과 공공의료 구축을 위해서라도 청주시는 위법행정을 당장 중단하고, 노동자들의 고용승계를 보장하라!
