42ND SESSION OF THE UN HUMAN RIGHTS COUNCIL

INTERNATIONAL SAFE ABORTION DAY – 28 SEPTEMBER 2019

 

Please note that a shorter version of this statement was delivered orally on 23 September 2019 to fit the time requirements of the Human Rights Council.

 

Thank you, President. I deliver this statement on behalf of 317 organizations[i] and 506 individuals.[ii]

 

In the Vienna Declaration and Programme of Action, States explicitly agreed to prioritize the realization of women’s human rights and recognized that all human rights are universal, indivisible, interdependent and interrelated. Yet, 26 years later, women and girls’ human rights and bodily autonomy continue to be routinely violated, including through the denial, criminalization and stigmatization of access to safe and legal abortion – all of which is rooted in the discrimination, oppression, violence and coercion affecting the material conditions that shape people’s lives and ability to exercise their bodily autonomy and human rights.

 

In 1994, Black feminists came together as the Women of African Descent for Reproductive Justice, in reaction to the white supremacy, colonialism and capitalism they observed shaping reproductive politics and inherent in the broader population control narratives. Reproductive justice is centered on the rights to bodily autonomy and self-determination, and to parent and not to parent in safe and healthy environments.[iii] It is rooted in an intersectional analysis and moving beyond an individualistic conception of “choice” to instead place emphasis on the material conditions necessary to exercise reproductive rights. Reproductive justice also addresses the legacy of population control informed by white supremacy and replacement theory, which has resurfaced in current populist politics.

Reproductive justice is achieved when all people are able to enjoy their right to bodily autonomy and sexual and reproductive self-determination. It requires people to enjoy economic, social, and cultural rights and freedoms, and the ability to make and exercise choices not limited by oppression, discrimination, stigma, coercion, violence, lack of opportunities or possible consequences. Treaty bodies and special procedures have echoed this need and recognized that the realization of women’s reproductive rights depends on the material conditions in which they are born, grow, live, work and age, and on power structures and resource distribution at all levels[iv] – in other words, the social and other determinants of health.[v] These include access to housing, safe drinking water, effective sanitation systems, access to justice, and freedom from violence, among other factors, and impact the agency that individuals can exercise with respect to their sexual and reproductive health.[vi] Our discussions on abortion and sexual and reproductive rights cannot continue ignoring these factors.

The realization of reproductive justice, the right to bodily autonomy and substantive equality also requires freedom from control and interference by State and non-State actors, including private companies, donors and multinational corporations, including criminalization of sexual and reproductive behaviors and decisions, restrictive abortion laws, punitive sanctions, and legal restrictions to regulate women’s control over their own bodies.[vii] These laws, policies and practices typically target and disproportionately impact women of color, women from the Global South, women with disabilities, women living in poverty, migrant women, ethnic minorities and indigenous women, women living with HIV, young women and adolescents, sex workers and gender-non-conforming persons based on racial, class, disability and gender stereotypes.[viii]

Today, on 28 September, International Safe Abortion Day, we urge States to respect, protect and fulfill women and girls’ human rights and realize reproductive justice for all. We call on states to:

  • Ensure access to available, accessible, acceptable and quality sexual and reproductive health services as part of universal health coverage and public health systems, including modern contraceptive options, comprehensive abortion and post-abortion care, financed adequately through taxation and free from control from other governments, multilateral agreements and transnational corporations.
  • Remove all legal and social barriers to safe abortion, including its criminalization, which is broader and including sanctions and no sanction regimes, and commit to providing safe abortion services on request.
  • Address social and other determinants of health in law and practice from an intersectional perspective to ensure that they enable all individuals to effectively enjoy their sexual and reproductive rights.[ix]
  • Hold private companies and multinational corporations accountable for unethical research practices, violations and abuses of women and girls’ reproductive rights and bodily autonomy.
  • Prioritize the meaningful participation of local movements, women human rights defenders and feminists demanding accountability for sexual and reproductive health and rights violations, and center their demands and recommendations for the realization of reproductive justice.

[논 평]

이주노조 합법화 판결을 환영하고 대법원의 8년 직무유기를 규탄한다.

 

대법원은 오늘 전원합의체 판결을 통해 서울경기인천 이주노동자 노동조합이 노동조합 및 노동관계조정법(이하 ‘노조법’)에 따른 노동조합에 해당한다는 취지로 고용노동부의 상고를 기각하는 판결을 하였다. 노동3권을 보장하고 있는 헌법 제33조, 외국인의 지위를 보장한 헌법 제6조, 국적에 따른 근로조건의 차별대우를 금지한 근로기준법 제5조, 인종차별금지를 금지한 노조법 제9조 등에 비춰볼 때, 위 판결은 지극히 타당하고 상식적인 판결이라고 할 수 있다. 그런데 위 판결이 나오기까지 대법원에서만 무려 8년이라는 시간이 흘렀다.

 

시간을 10년 전으로 돌려보자. 2005년 4월 24일 서울·경기·인천지역에서 취업해 일하고 있던 이주노동자 99명은 지역별 노동조합인 서울경기인천이주노동자노동조합(이하 ‘이주노조’)를 설립하고, 같은 달 5월 설립신고서를 고용노동부에 제출했다. 같은 해 6월 서울지방고용노동청장은 노조 임원 및 조합원 일부가 출입국관리법상 취업 및 체류자격이 없는 외국인이므로 노조법상 노동조합으로 볼 수 없다며 설립신고서를 반려했다.

 

이주노조는 고용노동부의 노조설립신고 반려처분이 법적 근거가 없을 뿐만 아니라, 노동하는 노동자라면 누구나 보장받아야 할 헌법상 권리인 노동3권을 출입국관리법상 체류자격이 없다는 임의적 상황에 따라 차별하는 처분은 위법 · 무효이므로 취소되어야 한다고 주장하며 행정소송을 제기하였다. 2006년 2월 7일 서울행정법원 제13행정부(재판장 김태종 판사)는 서울지방고용노동청의 주장을 그대로 수용하여 원고 청구를 기각했으나, 2007년 2월 1일 항소심인 서울고등법원 제11특별부(재판장 김수형 판사)는 1심 판결을 취소하고, 설립신고서 반려처분이 법적근거가 없는 것으로 위법하므로 취소한다고 판결했다. 2007년 2월 23일 고용노동부가 상고하여 대법원에서 심리가 시작된 이 사건은 대법원의 최장기 미제사건 기록을 갱신하며 무려 8년 동안이나 계류되어 왔다. 김황식 전 대법관, 후임 양창수 전 대법관을 거쳐 권순일 현 대법관에 이르기 까지 주심 대법관만 3명을 거쳤다.

 

이번 대법원 전원합의체 판결의 결과는 지극히 당연한 것이다. 내국인 노동자들이 형사처벌을 받았다고 하여 노동조합 가입자격이 제한되거나, 이미 가입된 노동조합의 실체가 부정되는 것이 아닌 것처럼, 이주노동자들이 출입국관리법에 따른 체류자격이 없더라도 자신의 노동을 제공하여 생계를 유지하는 한, 헌법상 노동3권이 제한될 이유가 전혀 없는 것이다. 올해 제323차 국제노동기구(ILO) 이사회에서 채택된 제374차 결사의자유위원회 보고서에서는 8년째 계류된 이주노조 설립신고 상고심을 더 이상 지체하지 말고, 이주노동자들이 자신의 체류자격에 상관없이 결사의 자유에 대한 권리와 단체교섭권을 전적으로 보장받을 수 있도록 할 것을 한국 대법원과 정부에 촉구하기도 했다.

 

대법원의 8년에 걸친 심리 지연으로, 이주노조는 모진 수난을 겪었다. 아노아르 후세인(방글라데시) 초대 위원장을 비롯해 미셀 카투이라(필리핀) 4대 위원장에 이르기까지 이주노조 주요 임원들은 법무부 출입국관리소에 표적단속 되어 강제추방 당하거나, 입국이 거부되었다. 그럼에도 이주노조는 노동조합임을 포기하지 않았다. 노동자의 자주적인 단결을 통해, 이주노동자의 문제를 이주노동자 스스로 바꿔보겠다는 창립정신으로 끈질기게 싸워왔다. 우리 모임은 이주노조의 지난 10년 동안의 헌신적인 투쟁에 경의를 표하며 깊은 연대의 마음을 표한다.

 

지연된 정의는 정의가 아니다. 이 사건 판결 어디에도, 대법원이 지난 8년 동안 고심한 흔적은 도저히 찾아볼 수 없다. 대법원은 오히려 사회적 약자인 이주노동자들이 자신의 정당한 노동권을 보장받지 못하는 현실에 눈 감았다. 한국경제의 가장 밑바닥을 책임지고 있는 이주노동자들에 대한 폭력과 비인간적인 처우를 개선해 달라는 목소리를 8년 동안 외면했다. 이는 인권의 보장과 정의의 구현이라는 사법부의 존재목적을 스스로 부정하는 것이다. 최고법원의 권위와 존엄은 법원에 출입하려는 이주노조 조합원들의 투쟁조끼를 억지로 벗겨내려는 것이 아니라, 인권보장을 위한 최후의 보루라는 스스로의 목적에 충실할 때 비로소 인정될 수 있음을 대법원이 지금이라도 깨닫길 바란다.

민변, 백남기 농민 살수행위 당시

살수차가 촬영한 동영상 확보를 위한 증거보전 신청

 

1. 민주언론을 위한 귀 언론사의 노고에 감사드립니다.

 

2. 백남기 농민이 지난 11월 14일 경찰의 위법한 직사살수로 의식을 잃은 지 3주가 다 되어 가고 있습니다.

 

3. 그 동안 우리 모임은 위법한 직사살수 행위(이하 “본건 살수행위”)와 관련된 경찰들을 고발하였고, 참여연대 등 시민단체들은 시민 1만 여 명의 의사를 모아 수사촉구를 하기도 하였습니다. 그러나 본건 살수행위에 대해 검찰과 경찰의 수사가 제대로 진행되고 있다는 이야기는 들리지 않고, 경찰청장은 관련 동영상 분석에 보다 많은 시간이 필요하다는 이야기만을 하고 있을 뿐입니다.

 

4. 이에 우리 모임은 오늘 백남기 농민의 따님의 요청에 의하여 본건 살수행위 당시 살수차가 촬영한 동영상을 확보하기 위한 증거보전신청을 하였습니다. 이 증거보전신청은 앞으로 있을 국가배상청구를 위한 증거를 사전에 확보한다는 의미이지만 이 사건의 진상을 규명하는데도 도움이 될 것으로 보입니다.

 

5. 아울러 법원은 신속한 결정으로 국민의 생명을 위태롭게 한 경찰의 불법행위와 관련한 증거를 확보할 수 있게 하여 국민의 기본권 보장에 무관심하지 않다는 것을 보여주길 바라는 바입니다.

인신보호구제신청 사건 재판부 보정명령 관련 통일부 긴급 면담

2. 민변 통일위원회 소속 변호사들은 지난 5월 26일 오후 통일부에 인신보호구제청구 북측 가족들과 수용 중인 종업원들의 가족관계증명 서류를 확보하기 위하여 북한주민접촉신고를 하였습니다.

 

3. 한편 지난 24일 민변 통일위에서 제기한 인신보호구제신청 사건에서 담당 재판부는 1) 위임장을 작성한 가족들과 피수용자들의 가족관계를 증명할 서류 등으로 가족관계를 소명할 것(5.31.자) 2) 민변 통일위 변호사들에 대한 위임의사를 소명할 것(6.1.자)을 내용으로 하는 각 보정명령을 하였습니다.

 

4. 인신보호구제신청 사건 담당 재판부의 보정명령 시한은 6월 13일이고, 시간이 매우 촉박합니다. 시급히 위 보정명령에 필요한 자료를 제출하기 위하여는 통일부의 신속한 북한주민접촉신고 수리가 필요한 상황입니다.

 

5. 이에 민변 통일위원회 소속 변호사들은 북한주민접촉신고 담당 부서인 통일부 이산가족과 담당자들과 긴급 면담을 신청하여 오늘 오후 3시 정부종합청사 내에서 면담을 갖고 보정명령 관련 통일부의 신속한 협력을 요청할 계획입니다.

민변, 론스타 5조원대 청구 실체를 공개하라는 소송 제기 

1. 민주사회를 위한 변호사모임(이하 ‘민변’, 회장 한택근)은 2015년 5월 29일 정부를 상대로 론스타와 대한민국 간 국제중재(ISDS)에서 론스타가 청구하고 있는 약 5조1,000억 원의 산출 근거를 밝히라는 정보공개소송을 제기하였다.

2. 이날 오전 10시 민변은 김기준 의원(새정치민주연합) 등 23명의 국회의원과 론스타공동대책위원회(집행위원장 김득의)와 공동으로 국회 정론관에서 기자회견을 열고 이렇게 밝혔다.

3. 이날 미국 워싱턴 DC에서는 론스타 국제중재의 2차 구술심리(hearing)가 시작된다. 민변은 이 2차 심리의 참관을 신청하였으나, 정부는 지난 1차 심리의 참관을 거부한 데 이어 또 다시 민변의 참관을 거부하였다. 김제남 의원(정의당)도 2차 심리의 참관을 신청하였으나, 정부는 이 또한 거부하였다.

4. 앞서 지난 5월 26일 민변은 정부에 론스타가 청구하는 약 5조1,000억 원의 산출 근거를 밝히라고 정보공개를 청구하였으나, 정부는 이마저도 거부하였다.

4. 민변은 이날 “오늘 론스타 국제중재 심리에 참관하지 못한 채, 론스타 5조원대 청구의 실체를 밝히라는 정보공개소송을 제기하게 되어 매우 비통하다”면서 “정부가 론스타 국제중재의 내용을 비공개하는 것은 법치주의의 근간을 흔드는 일”이라고 강력하게 비판하였다.

5. 한편 이날 공동 기자회견에는 국회의원 김기준, 김상희(이상 새정치민주연합), 김제남, 박원석(이상 정의당), 송기호 민변 국제통상위원장, 김득의 론스타공대위 집행위원장, 전성인 홍익대 교수 등이 참석하였다.

[기자회견문]

론스타 5조원 실체를 공개하라는 소송을 제기하며

정부는 론스타 5 원대 청구금액의 실체를 밝혀라!

1. 오늘 5조원대의 국가 재정이 걸려 있는 론스타와 대한민국 사이의 국제중재(ISDS)의 두 번째 구술 심리(hearing)가 미국 워싱턴 DC 국제투자분쟁중재센터(ICSID)에서 시작된다.

 한국의 납세자를 대표하는 국회의원과 법률단체인 민주사회를 위한 변호사모임(민변)은, 오늘 이 국제중재 심리에 참관하지 못한 채, 론스타 5조원대 청구의 실체를 밝히라는 정보공개 소송을 제기하게 되어 매우 비통하다.

김제남 의원과 민변은 이달 초 ICSID 규칙*에 따라 두 번째 심리의 참관을 신청하였다. 그러나 한국 정부는 참관을 거부했다. ICSID 사무총장이 지난 18일 “당사자들이 민변의 방청을 반대하여, 민변은 방청을 할 수 없게 되었습니다”라는 내용의 전자우편 통지문을 김제남 의원과 민변에 보낸 것이다.

민변은 또한 지난 5월 26일 정부에 론스타가 청구하는 5조원대의 계산 내역을 밝히라고 정보공개를 청구하였다. 그러나 정부는 이를 거부하였다. 민변은 이의신청도 해보았으나, 정부는 이마저도 거부하였다.

우리 국회의원과 민변은 국민의 참관을 거부한 정부의 조치에 강력히 항의하며, 론스타 5조원대 청구금액의 실체를 밝힐 것을 정부에 거듭 요구한다.

2. 론스타 사건의 본질은 무엇인가? 무엇보다도, 이 사건에는 5조원대의 막대한 국가 예산 지출이 걸려 있다.

또한, 페이퍼컴퍼니를 악용해 한국경제를 파고드는 투기자본에 대한 대한민국 대법원의 실질과세원칙이 공격을 당하는 엄중한 사건이다. 더 나아가, 이 사건은 한국 법치주의의 근간마저도 뿌리째 뒤흔들고 있다.

론스타는 지난 22일 또 다시 대법원에 상고해서 한국 국세청이 스타타워 빌딩 매각차익에 부과한 1,002억여 원의 세금을 다투고 있다. 론스타는 한국 법원의 1심과 2심에서 패소하자, 대법원에 상고한 것이다. 그러면서도 론스타는 이 세금이 부당하다면서 한국을 워싱턴 국제중재에 회부했다. 이처럼 론스타는 한국 법원과 국제중재라는 두 가지 무기를 마음껏 사용하고 있다. 이 과정에서 한국의 법치주의가 큰 혼란에 빠져 있다.

한국 국세청의 과세에 맞서 한국 법원에 조세 소송을 제기했다가 패소한 벨기에 페이퍼컴퍼니가, 도대체 어떻게 국제중재에서 세금을 돌려 달라는 주장을 할 수 있는가!

3. 정부는 ‘재판 공개’라는 근대사법의 가장 기본적인 원칙**마저 부인하고 있다.

도대체 무엇이 두려워, 론스타의 5조원 대 청구의 실체조차 밝히지 않은 것으로 모자라, 어두운 암흑 속에서 국제중재를 진행하려고 하는가?

일부 관료들이 민변의 참관이 중재 결과에 영향을 줄 수 있으므로 이를 거부한다고 발언한 것은, 법치주의를 통하여 통제를 받아야 할 관료들이 오히려 사법작용마저 자신들의 발밑에 두고 좌지우지 하겠다는 전체주의와 다르지 않다.

근대 문명국가 중 그 어느 국가에서 관료들이 재판 절차의 공개 여부를 결정하는가? 근대 시민이라면 그 누가 방청 여부에 따라 결과가 달라질 수 있다는 재판을 공정한 사법절차라고 부를 것인가?

4. 우리 국회의원과 민변은 대한민국의 법치주의와 근대 사법 문명이 허용하는 모든 합법적 수단을 다하여 론스타 사건에 대한 정부의 대응을 점검할 것이다.

거듭 정부에 론스타 5조원대 청구금액의 실체를 밝힐 것을 강력히 요구한다.

[논평]야쿠르트 위탁판매원의 근로자성을 부인한

대법원의 퇴행적 판결을 규탄한다.

 

대법원(주심 대법관 박보영)은 2016. 8. 24. 야쿠르트 위탁판매원의 퇴직금 청구 사건에서 ‘근로기준법상의 근로자에 해당하지 않는다’는 원심 판결을 확정하였다(2015다253986). 우리 모임은 대법원의 퇴행적 판결에 큰 실망을 표하며, 이른바 ‘특수고용 노동자’들의 불안정하고 열악한 지위를 간과하고 2006년 이후 조금이나마 개선되었던 근로자성 관련 판례 법리를 역행한 것임을 지적하고자 한다.

위 사건에서 대법원은, 새로운 설시를 하지 않은 채 하급심을 그대로 승인하여 상고기각 판결을 하였고, 출퇴근 시간, 수수료 지급 형태 등을 주된 근거로 삼은 다음, 취업규칙이나 복무규정이 적용되지 않은 점도 사유로 언급하면서, 야쿠르트 위탁판매원의 근로자성을 부인하였다. 그러나 이는 대법원이 2006년 시간강사 판결(대법원 2006. 12. 7. 선고 2004다29736 판결)에서 근로자성의 판단지표를 구체적 지휘·감독에서 ‘상당한’ 지휘·감독으로 바꾸고, 취업규칙 적용 여부에 대해서 “사용자가 경제적으로 우월한 지위에서 사실상 임의로 정할 수도 있는 것이므로 이 요소가 인정되지 않는다고 하여 근로자성을 부정해서는 안 된다”고 하면서 기준을 완화한 흐름에도 역행하는 기준 적용이다. 또한 여전히 현실의 다양한 취업, 고용형태 및 그 변화에 적절하게 대응하지 못하는 화석화된 판단이라고 할 수 있다.

노동법 적용을 면하고 사용자 책임을 회피하기 위한 비전형적 고용 형태가 사회전체로 확대되고, 일자리는 점점 더 불안정하고 열악해지고 있는 현실인데도, 법원이 여전히 사회·경제적 종속성의 문제와 근무형태의 실질에 눈 감으며, 드러난 형식에 따라 노동자 보호를 외면하고 있다는 것은 매우 유감이다. 특히 여성 노동자들이 변칙적이고 불안정한 일자리에 내몰리고 있음에도 불구하고, 여성 집중 직종(골프장 캐디, 보험모집원, 학습지교사 등)에 대해서는 이를 마치 여유로운 부업이라도 되듯 부수적이고 이차적인 것으로 취급하면서 근로자성을 쉽게 부인하는 선입견이 이번 판결에도 그대로 투영된 것이라는 점에서 심각한 우려를 표한다(대법원 공보관실은 같은 날 보도자료에서 “이른바 야쿠르트 아줌마”라는 표현을 명시적으로 사용함으로써, 그러한 편견을 드러내었다).

특수고용 노동자들의 현실을 외면하고, 노동법상 사용자책임을 회피하는 사용자의 탈법에 면죄부를 주어 왔던 법원이, 진전이 없는 정도가 아니라 2006년 이후 판례 흐름보다도 못한 판결로 다시 한 번 큰 실망을 주었다. 부디 이러한 퇴행을 중단하고, 노동관계의 실체를 진지하게 탐구하여, “계약의 형식보다는 그 실질에 있어 임금을 목적으로 종속적인 관계에서 근로를 제공하였는지 여부에 따라 판단하여야 한다”는 스스로의 기준을 제대로 적용할 것을 간절히 촉구한다.
