멕시코는 일상적이고 만연하게 일어나는 실종과 고문, 집단 매장, 잔인한 살인 사건으로 급속히 확산되는 인권 위기에 신음하고 있다.

프란치스코 교황의 첫 멕시코 방문을 앞두고 있는 가운데, 교황이 멕시코 땅을 밟기 전 반드시 알아두어야 할 다섯 가지 사실을 짚어본다.

1. 소위 “범죄조직과의 전쟁”이라는 명목으로 수천 명이 목숨을 잃었지만, 정확한 사망자 수를 아는 사람은 아무도 없다.
멕시코 정부는 제대로 된 계획 없이, 너무나 비효율적으로 이루어진 범죄조직 소탕 작전으로 군경과 충돌하면서 숨지거나 부상 당한 사람들의 정확한 통계를 2년째 공개하지 않고 있다.

2. 지난 10년 동안 27,000명 이상이 실종되었다.
2014년 9월 지방 대학생 43명이 실종된 비극적인 사건을 계기로 실종 사건이 급속히 확산되고 있는 실태가 폭로되었다. 정부 통계에 따르면 지금도 행방을 알 수 없는 사람의 수는 27,000명 이상으로, 이 중 거의 절반에 가까운 사람들이 2012년 페냐 니에토 대통령이 취임한 이후 실종되었다.

3. 멕시코는 언론인에게 매우 위험한 국가다.
독립적 단체인 국경없는기자회(Reporters without Borders)는 서반구에서 언론인이 활동하기에 매우 위험한 국가 중 하나로 멕시코를 꼽았다. 멕시코 전역에서 언론인이 위협을 받거나 공격을 당하고 심지어 살해당하기까지 하는 사건이 일상적으로 벌어지고 있으며, 2015년 한 해에만 취재 활동으로 기자 3명이 목숨을 잃었다.

4. 고문이 더욱 만연해지고 있다.
멕시코 전역에서 고문과 부당대우는 통제할 수 없는 수준으로 만연하게 이루어지고 있다. 멕시코 검찰청의 발표에 따르면, 2013년과 2014년 사이 연방 정부에 보고된 고문과 부당대우 사례는 1,165건에서 2,403건으로 배로 증가했다. 이 중 조사가 이루어진 사례는 거의 없다.

1. Thousands of people have been killed in the context of the so-called “war against organized crime”, but no one knows exactly how many
For the second year in a row, the Mexican authorities have failed to publish any statistics on the number of people killed or wounded in clashes with the police and military forces, as part of their ill-conceived and utterly ineffective fight against organized crime.

Across Mexico, journalists are routinely threatened, attacked and even killed, with three murdered because of their work in 2015 alone.

4. Torture is increasingly widespread
Torture and other ill-treatment is out of control across Mexico. Between 2013 and 2014, the number of reports of torture and other ill-treatment at the federal level doubled from 1,165 to 2,403, according to the country’s Attorney General’s Office. Very few cases are ever investigated.

5. And justice is so rare it is almost a foreign concept
For decades, Mexico’s judicial system has been utterly incapable of investigating the tens of thousands of reports of human rights abuses from every corner of the country.

Of the thousands of reports of torture registered between 2005 and 2013, federal courts only dealt with 123 cases, with just seven resulting in convictions under the federal law.

‘박근혜-최순실 게이트’의 국정농단 세력이 성신학원 이사들에게 외압을 행사, 각종 비리로 퇴진 요구에 시달리는 심화진 성신여대 총장을 지난해 연임시킨 사실이 처음 드러났다.

심 총장은 서울 운정캠퍼스 부지를 매입하면서 땅 주인으로부터 자신의 아들 2명 명의로 각각 1억5천만 원씩 3억 원의 뒷돈을 받았다. 심 총장은 또 학생들의 등록금중 수억 원을 자신과 측근들의 소송비용으로 유용하는 등 교육자로서의 자질을 의심받았지만 아무런 문제없이 대학 총장으로 다시 선임돼 그 배경에 의혹이 일었다.

현삼원 성신학원 이사는 “황우여 전 사회부총리겸 교육부 장관이 지난해 7월 송인준 성신학원 이사장에게 전화를 걸어 ‘성신여대 총장 선임과 관련해 청와대 교문 수석의 지시를 따르라’며 외압을 가했다”고 13일 뉴스타파에 폭로했다.

현 이사는 지난 8월 정기 이사회가 열리던 날 송 이사장을 만나 “너무 섭섭하다. 황 장관이 당신을 믿었는데 심 총장을 연임시킬 수 있느냐”며 따져 묻자, 송 이사장이 “실은 말이야. 황 장관한테 전화를 받았는데, 황 장관 얘기가 교문 수석이 전화할 것이니까 거기에 따르면 된다. 사실 그렇게 된거야”라는 답변을 들었다고 말했다.

송인준 이사장은 처음에는 “청와대와 박백범 이사 등으로부터 어떠한 연락도 받지 않았다”고 외압 의혹을 전면 부인했다. 하지만 그는 뉴스타파 취재진에게 전화를 걸어 “황우여 전 장관으로부터 전화를 받았고, 성신여대 총장 선임과 교문수석이 전화할 것이라는 내용이었다”고 털어놨다.

당시 청와대 교문수석은 김상률 숙명여대 교수로 박근혜-최순실 게이트의 핵심인물 중 한 명인 차은택의 외삼촌이다.

하지만 교문 수석이 직접 송인준 이사장에게 전화한 것은 아니고 대신 교육부에서 파견된 박백범 성신학원 이사가 교문수석의 의중을 전달하는 창구역할을 했다.

이에 대해 김 전 수석은 진행 상황만 보고 받았을뿐이라며 자세한 이야기는 공무상 비밀누설죄에 해당한다고 답변을 피했다.

심화진 총장은 지난 2012년 해임위기에 몰렸을 때 나경원 의원의 측근 2명으로부터 도움을 받아 위기를 넘긴 바 있다. 이 때문에 나경원 의원 딸의 부정 입학을 계기로 이른바 ‘상부상조’하는 관계가 형성된 것 아니냐는 의혹을 샀다.

친아버지에게 성폭행을 당하고 임신한 11세 소녀는 아이를 낳을 수밖에 없다. 마찬가지로, 출산으로 인한 사망이나 사산 위험이 매우 높은 여성이라도 중절 수술을 받을 수 없다. 폴란드 의회에서 금주 말 논의될 예정인 신규 법안이 통과될 경우 벌어질 일들이다. 이 법안이 통과되면 폴란드에서는 낙태가 거의 전면 금지된다.

오는 20일 바르샤바와 런던 및 세계 주요 도시에서는 폴란드의 법 개정안을 반대하는 사람들이 한자리에 모여 시위를 벌이며 전세계적인 행동에 나설 예정이다. 이 법안은 낙태 시술을 요구하거나 받은 여성을 범죄자로 만들 뿐만 아니라, 낙태를 하도록 돕거나 권한 사람은 누구나 3년에서 5년의 징역형에 처해지도록 형기를 더욱 늘리려는 목적으로 마련되었다.

폴란드의 낙태규제법은 이미 유럽 국가 중에서도 매우 엄격한 수준으로, 강간 또는 근친상간에 의한 임신이거나, 태아가 심각하게 회복 불가능한 장애가 있거나 목숨이 위태로운 불치의 질환을 앓는 것으로 진단되었거나, 산모의 생명 또는 건강이 위험할 경우에만 낙태를 허용하고 있다. 이번 법안이 통과되면 의료 전문가가 산모의 생명을 구하기 위해 반드시 필요하다고 판단한 경우를 제외하고 모든 경우의 낙태가 금지된다. 의학적인 이유로 수행하는 낙태 시술이 합법적이려면 산모의 생명이 얼마나 위태로워야 하는지에 대해 명확한 기준이 없어, 의사들은 최대한 시간을 오래 끌어야 할 책임을 지게 된다.

“임신 32주로 전자간증을 앓는 환자가 있다면 저는 아무것도 하지 못하고 산모와 아이가 죽어가기만을 기다려야 할 겁니다.” 로무알드 데브스키(Romuald Debski) 교수는 지난 4월 국회 토론회에서 이렇게 설명했다. “자궁 외 임신으로 출혈이 발생했다면 중절 수술을 할 수 있지만, 출혈이 없다면 당장의 생명의 위험이 없기 때문에 환자가 죽어가기 시작할 때까지 기다려야 하는 것입니다.”

이 법안에 따르면 의도치 않게 ‘태내의 아이’를 사망에 이르게 한 경우 최대 3년의 징역에 처해질 수 있다. 이는 의료인들에게 큰 영향을 미쳐, 환자에게 적절한 치료와 정보, 조언을 제공할 수 있는 역량을 저해함으로써 여성의 건강과 생명이 위태로워지는 결과로 이어질 수 있다.

최근 수년간 폴란드의 낙태규제법은 유럽인권재판소에 여러 차례 제소되었다. 유럽인권재판소는 14세 강간 피해자 사건을 포함한 3개 사건에 대해, 여성이 안전하고 합법적인 낙태 시술을 받지 못하도록 용납 불가능한 이유로 가로막는 것은 유럽인권보호조약에 명시된 폴란드의 의무를 위반하는 것이라고 판결했다.

공식 통계에 따르면 매년 폴란드에서 이루어지는 합법적인 낙태 시술은 약 1,000건이다. 그러나 해외에서의 중절 수술이나 불법 낙태 시술은 포함되지 않은 수치로, 여성인권단체들은 실제로 이루어지는 낙태 시술은 약 15만 건에 이를 것이라고 추정하고 있다.

지금 의사들은 합법적인 낙태 시술도 꺼리고 있어요. 자신들에게 낙인이 찍히고, 병원에까지 악영향을 미치게 될 위험에 처할까 두려운 거죠. 범죄자로 몰리는 것도 무서운 거고요.

유럽인권재판소의 판결을 고려할 때 폴란드의 현행 관행에 개선이 필요한 것은 명백하며, 이보다 강력한 규제를 시행한다면 더욱 넓은 범위의 국제적, 지역적인 인권 의무를 침해하게 될 것이다. 또한 이러한 규제는 국제법을 위반하는 퇴보적인 조치에 해당하기도 한다.

수천, 수만 명의 여성들이 여성인권을 위한 투쟁에 참여했고, 여기에는 크리스티나가 속한 여성가족계획연합과 같은 단체들의 기념비적인 활동이 큰 몫을 했다. 최근 수개월 동안 폴란드 곳곳의 거리에 쏟아져 나온 시위대는 철사 옷걸이를 높이 들었다. 중절 수술을 받기 위해 해외로 나갈 여유가 없는 여성들이 원시적이고 위험한 자가 낙태 수단에 의존할 수밖에 없음을 보여주기 위해서였다.

부풀려진 이야기가 아니다. 이와 비슷하게 매우 엄격한 수준의 낙태금지법이 존재하는 다른 나라의 사례만을 들여다봐도 그 부정적인 영향을 확인할 수 있다. 아일랜드, 엘살바도르, 니카라과, 파라과이를 대상으로 한 국제앰네스티 조사 결과, 모든 대상 국가에서 여성들은 안전하고 합법적인 낙태가 제한됨에 따라 엄청난 피해를 입었다. 건강과 안녕, 심지어는 목숨까지 잃어야 했다.

폴란드 국회는 법안에 대한 논의를 오는 21일 시작할 예정이며, 이 법안이 통과된다면 며칠 안에 일사천리로 절차가 처리될 것이다. 이렇게 될 경우 국제인권조약 및 협약을 위반함은 물론, 여성에게 임신을 중절하고 감옥에 갈 것인지, 임신을 유지하고 목숨을 걸 것인지의 잔혹한 선택만을 남기게 된다.

또한 치열한 투쟁 끝에 세운 원칙을 정면으로 역행하는 것이기도 하다. 그 원칙이란, 여성의 몸과 건강에 대한 판단은 의사와의 상의를 거쳐 여성들 스스로가 하는 것이지, 정치인들의 몫이 아니라는 것이다.

Pregnant at 11, a girl raped by her own father, will have no choice but to give birth. Equally, a woman at high risk of dying in childbirth or of carrying a dead baby, will not be able to seek a termination. This will be the impact of new legislation due to be debated on in the Polish parliament later this week which, if passed, would usher in an almost complete ban on abortion.

On Sunday in Warsaw, London and other cities, protesters will gather for a global day of action opposing the amendment to Poland’s law. The law seeks to not only criminalize women and girls who have sought or had an abortion, but also increase the maximum jail term for anyone who assists or encourages them have an abortion from three to five years.

Poland’s abortion law is already one of the most restrictive in Europe, with abortion only permitted in cases of rape or incest, when the fetus is diagnosed with severe and irreversible disability or an incurable illness threatening its life, or when the woman’s life or health is in danger. The proposed legislation would impose a prohibition in all circumstances other than in cases where medical health professionals deem it necessary to save a woman’s life. This will inevitably place women’s health at risk, and put doctors in impossible situations. With no clear guidelines about how close to death a woman or a girl must be for performing an abortion for medical reasons to be lawful, the onus will be on doctors to delay for as long as possible.

“If I have a 32-week pregnant patient with pre-eclampsia, I have to wait for her and her child to start dying before I can take action,” explained Professor Romuald Dębski during a debate in Parliament last April. “If there is an ectopic pregnancy and bleeding, I can perform a termination. But if there is no bleeding – no immediate risk to life – I have to wait until she starts dying.”

Under the proposed law, inadvertently causing the death of the ‘conceived child’ carries a prison term of three years maximum. This is likely to have a chilling effect on medical professionals, undermining their ability to provide adequate medical care, information and advice to their patients thus putting women’s and girls’ health and lives at risk.

In recent years Poland’s abortion laws have been challenged in the European Court of Human Rights (ECHR). The court found that in three cases – including in the case of a 14 year-old rape victim – unacceptable obstacles to women’s and girls’ access to safe and legal abortion breached Poland’s obligations under the European Convention on Human Rights.

Official figures suggest that around 1,000 legal abortions are performed in Poland each year. However, the available data does not account for backstreet abortions and terminations abroad. Women’s rights organizations estimate that the true figure may be as high as 150,000.

“Currently doctors are scared to perform legal abortions,” says Krystyna Kacpura, Director of Federation for Women and Family Planning. “They are scared of being stigmatised, of putting their hospitals at risk of repercussions. They are also scared of criminalisation.”

In the light of the ECHR rulings it is evident that current practices in Poland need reforming and any further restrictions would further violate a wide range of international and regional human rights obligations. Such restrictions would also constitute a retrogressive measure in contravention to international law.

Hundreds of thousands of women have joined the fight for their rights, largely thanks to monumental work of organisations such as Krystyna’s. At demonstrations that have spilled out across Poland’s streets in recent months protesters held up coat hangers as a reminder of the primitive and dangerous methods of self-induced abortion women would be compelled to resort to, especially those who cannot afford to travel abroad for a termination.

This is not scaremongering. One only has to look at other countries where similarly draconian laws exist to see their negative impact. Amnesty International’s research in Ireland, El Salvador, Nicaragua, and Paraguay has shown that in all these countries women and girls pay a high price for restrictions on safe and legal abortion. They pay with their health, their well-being and even with their lives.

_Parliament will start to debate the Bill on Wednesday and, if passed, the new legislation could be rushed through in a matter of days. If this happens it would result in a breach of international human rights treaties and conventions, leaving women with a stark choice: terminating a pregnancy and going to jail or continuing with the pregnancy and risking their lives.

It would also run counter to a hard-fought principle. Namely, that decisions about women’s bodies and health should be made by women themselves, in consultation with their doctors, and not by politicians.

브라질 수도 리우데자네이루의 헌병대가 “일단 쏘고 보는” 방침을 따르는 듯하면서 살인율 급증에 큰 영향을 끼치고 있으나, 이를 조사하거나 기소하는 일은 거의 없다고 국제앰네스티가 밝혔다. 국제앰네스티는 2016 리우 올림픽 개최를 1년 앞둔 8월 3일 이에 대해 독점 준비한 통계 및 분석 내용을 발표했다.

보고서 <”내 아들을 죽였다”: 리우데자네이루의 경찰에 의한 살인>은 지난 5년간 리우데자네이루에서 벌어진 살인 사건 중 최소 16%를 차지하는 1,519건의 가해자가 근무 중인 경찰관이었다고 폭로했다. 특히 국제앰네스티는 리우 북부 아카리의 빈민촌에서 2014년 한 해 동안 경찰이 저지른 살인 사건 10건 중 최소 9건 이상이 비사법적 살인이었음을 강력히 시사하는 증거를 확보하기도 했다.

아틸라 로크(Atila Roque) 국제앰네스티 브라질지부 사무국장은 “리우데자네이루는 두 얼굴을 지닌 도시다. 한 편에서는 세계인들을 놀라게 할 호화로움과 화려함이 존재하면서도 다른 한 편에서는 가난한 젊은 흑인 상당수가 경찰에게 살해되고 있다”며 “심각한 치안위기를 해소하려다 실패로 돌아간 브라질의 ‘마약과의 전쟁’ 은 끔찍한 역효과를 일으키며 고통과 참상만을 남기고 있다. 폭력적이고 자원 부족 상태인 경찰, 너무나 가난하고 소외되어 주목받지 못하는 지역사회, 인권침해에 대한 정당한 재판과 보상이 계속해서 이루어지지 못하는 형사사법제도가 뒤섞이면서 너무나 많은 사람들이 희생되었다”고 말했다.

이러한 살인 사건에 대해 조사가 이루어지는 경우는 거의 없다. 경찰 개입으로 사망자가 발생할 경우, 해당 살인 사건이 자기방어 행위였는지, 형사기소가 필요한 사건인지를 결정하기 위해 행정보고서를 작성한다. 실제로는 대부분의 사건이 ‘정당방위에 의한 사망’으로 보고되어, 이에 대한 독립적인 조사 및 가해 경찰이 민간 법원에 서는 것을 막는 경우가 많다.

실제로는 전혀 그렇지 않음에도 경찰에 의한 살인 사건을 정당방위로 분류함으로써 브라질 정부는 실질적으로 피해자들에게 사망의 책임을 돌리고 있다. 이러한 방법은 비사법적 처형을 무마하기 위한 연막으로 쓰이기도 한다. 경찰이 피해자를 범죄조직과 연관시킬 경우 조사가 이루어지더라도 살인의 정황을 알아보기보다는 정당방위로 인한 사망이라는 경찰의 증언을 뒷받침하려는 의도에서 조사하는 것이 보통이다.

또한 국제앰네스티는 경찰관들이 충분한 주의 없이 시신을 옮기거나, 시신 옆에 무기나 다른 ‘증거물’을 가져다 놓는 등 사건 현장이 훼손되는 경우가 빈번하다는 사실도 파악했다. 피해자가 마약 밀매와 관련되었다는 의혹이 있을 경우, 살인을 정당화하기 위해 피해자의 전과에 집중해 조사하는 경향도 있다.

10세 소년 에두아르도 데 헤수스는 2015년 4월 2일 알레망 빈민가에서 자신의 집 앞 현관문에 앉아 있다가 경찰에게 목숨을 잃었다.

에두아르도의 어머니인 40세의 테레신하 마리아는 불과 몇 초만에 모든 일이 벌어졌다고 했다.

“총소리와 비명소리가 들리자마자 밖으로 뛰어나왔는데, 아들이 쓰러져있는 끔찍한 장면을 목격하게 됐어요”

아들의 시신 앞에 줄지어 서 있는 경찰에게 테레신하가 항의하자, 그 중 한 명이 그녀의 머리에 총을 겨누고는 “당신 아들을 죽인 것처럼 당신도 죽일 수 있다. 도둑놈의 아들을 죽였으니까”라고 말했다고 한다.

테레신하는 경찰들이 사건 현장을 거의 순식간에 정리해 버렸다고 했다. 경찰은 에두아르도의 시신을 치워 버리려고도 했지만 동네 사람들이 나서서 막았다. 어떤 경찰은 시신 옆에 총을 가져다 놓고 에두아드로에게 책임을 덮어씌우려 하기도 했다.

사건 다음 날, 에두아르도를 살해한 가해 경찰들은 직위해제되고 살해 흉기는 법의학적 분석을 위해 압수되었다. 이 사건은 경찰의 살인 담당 부서에서 조사되고 있다. 그러나 대부분의 경우 제대로 조사가 이루어지지 않고, 가해자들이 기소되는 경우도 거의 없는 것이 현실이다.

에두아르도가 살해된 이후 가족들은 협박을 당했고, 보복의 위험 때문에 살던 곳을 떠나 이사를 가야만 했다.

아틸라 로크 국장은 “경찰이 빈민가에서 이루어지는 작전 중에 주민들을 괴롭히거나 활동가들을 위협하는 등의 공포 전략을 취하는 것은 리우데자네이루의 치안 문제를 전혀 해결하지 못한다. 이를 해결할 수 있는 유일한 방법은 살인 사건 감소를 위해 일관된 전략을 취하고, 모든 인권침해행위가 철저히 조사되고 가해자들이 처벌받을 것임을 보장하는 것뿐이다.

Brazil: ‘Trigger happy’ military police kill hundreds as Rio prepares for Olympic countdown

Military police in Rio de Janeiro who seem to follow a “shoot first, ask questions later” strategy are contributing to a soaring homicide rate but are rarely investigated and brought to justice, Amnesty International said as it published exclusive statistics and analysis ahead of the one-year countdown to the 2016 Rio Olympic Games.

The report “You killed my son: Killings by military police in Rio de Janeiro” reveals that at least 16% of the total homicides registered in the city in the last five years took place at the hands of on-duty police officers – 1,519 in total. Only in the favela of Acari, in the north of the city, Amnesty International found evidence that strongly suggests the occurrence of extrajudicial executions in at least 9 out of 10 killings committed by the military police in 2014.

“Rio de Janeiro is a tale of two cities. On the one hand, the glitz and glamour designed to impress the world and on the other, a city marked by repressive police interventions that are decimating a significant part of a generation of young, black and poor men,” said Atila Roque, Director at Amnesty International Brazil.

“Brazil’s failed ‘war on drugs’ strategy to tackle the country’s very real drug and violence public security crisis is backfiring miserably and leaving behind a trail of suffering and devastation. Too many lives are lost to the toxic cocktail of a corrupt violent and ill-resourced police force, communities so poor and marginalized they are hardly visible and a criminal justice system that constantly fails to deliver justice and reparations for human rights violations.”

According to Amnesty International’s research, military police across Rio de Janeiro has regularly used unnecessary and excessive force during security operations in the city’s favelas. The majority of victims of police killings registered from 2010 to 2013 are young black men of between 15 and 29 years of age.

Such killings are hardly investigated. When a person is killed as a result of police intervention, a civil police officer files an administrative report to determine if the killing was in self-defence or if a criminal prosecution is required. In practice, many cases are filed as “resistance followed by death”, which prevents independent investigations and shields the perpetrators from the civilian courts.

By listing police killings as the result of a confrontation, even when there was never one, the authorities effectively blame the victims for their own deaths. This is often used as a smokescreen to cover up for extrajudicial executions. In cases where the police links the victim to criminal gangs, the investigation usually intends to support the testimony of the police that the killing occurred in self-defence instead of determining the circumstances of the homicide.

Amnesty International also found that crime scenes are frequently altered – police officers remove the body without due diligence and place weapons or other “evidence” next to the body. In cases where the victim is allegedly connected to drug trafficking, the investigation tends to focus on the victim’s criminal profile to legitimize the killing.

Eduardo de Jesus, 10, was killed by military police as he sat by his home door in the Complexo do Alemão favela on 2 April 2015.

According to his mother, Terezinha Maria de Jesus, 40, everything happened in a matter of seconds.

“I just heard a bang and a cry … When I ran outside I came across the horrible scene of my fallen son there,” she said.

When she confronted the row of military police officers standing in front of her son’s dead body, one of them pointed his rifle at her head and told her: “Just as I killed your son, I might as well kill you because I killed a bandit’s son”.

Terezinha said the crime scene was almost immediately dismantled by the police. They tried to take Eduardo’s body away but the community prevented them from doing it. One of the officers tried to place a gun next to the body to incriminate him.

The day after Eduardo’s death, the agents responsible for the shot that killed him were dismissed from the force and had their weapons taken for forensic analysis. The case is being investigated by the police force’s homicide division. But the reality is that most cases are not duly investigated and those responsible rarely face justice.

Since the killing, Eduardo’s family has received threats and were forced to move from their home for fear of reprisals.

“The military police’s strategy of fear when it comes to their operations in the city’s favelas, including harassing residents and threatening activists, will not resolve the city’s security problems. The only thing that will is a concerted strategy to reduce homicides and a guarantee that all human rights violations are thoroughly investigated and those responsible are brought to justice,” said Atila Roque.
