미국 퍼거슨, 미주리주의 거리에서 브라질 빈민가에 이르기까지 경찰의 과도한 무력과 화기 사용으로 사상자가 발생한 사건은 전세계적인 이슈가 되었다.

이외에도 시위 진압을 포함한 수많은 사례를 보면 경찰은 평화적으로 갈등을 해소할 방법을 찾기보다는 지나치게 이른 시기에 무력 사용을 선택하고 있다. 여러 국가에서 경찰이 최루가스와 고무탄 등의 무기를 동원해 자의적이고 폭력적으로 과도한 무력을 사용하면서 심각한 사상자를 발생시켰다. 많은 경우 책임이 거의 또는 전혀 없음에도 공격을 받은 피해자들은 사망하거나 중상을 입었다.

국제앰네스티는 이와 같은 법집행의 중대한 문제점에 대응하여, 경찰이 생명의 존중 및 보호와 신체의 완전성을 최우선하도록 하는 종합적인 무력사용 지침을 새롭게 발표했다.

국제앰네스티 네덜란드지부 경찰과인권 국장 아냐 비에네르트(Anja Bienert) 박사는 “전세계 수많은 국가에서 국제기준 또는 국내법을 위반하고 무력을 사용한 경찰에게 목숨을 잃거나 중상을 입는 사건이 너무나도 많이 발생하고 있다”며 “경찰이 힘들고 때로는 위험하기까지 한 임무를 수행한다는 사실은 논쟁의 여지가 없다. 그러나 정부와 경찰당국은 경찰이 합법적으로, 인권에 따라, 최후의 수단으로만 무력을 사용하도록 하는 체제를 마련하지 못하고 있다. 국제앰네스티가 이번에 마련한 지침은 이러한 허점을 보완하고, 국가정부가 경찰의 무력사용이 과도하거나 폭력적이지 않고, 자의적이거나 불법이지 않도록 하기 위해 취할 수 있는, 또한 취해야만 하는 법적 및 실전 조치를 제공하는 것이 목적”이라고 말했다.

국제앰네스티는 1990년 9월 채택된 ‘경찰의 무력과 화기사용에 관한 유엔 기본원칙’의 25주년을 기념해 ‘무력사용 – 유엔 기본원칙 이행을 위한 지침’을 발표한다. ‘유엔 기본원칙’은 생명권과 신체적 완전성을 보호할 국가정부의 의무를 이행하기 위한 주요 기준으로 인정받고 있다.

이번 지침은 전세계 모든 지역 58개국의 국내법, 내부규정, 훈련 기록의 예시를 기반으로 하고 있다. 정부가 유엔 기본원칙을 이행하고, 바르고 효과적으로 인권에 따라 정책을 시행할 수 있도록 돕고자 구체적인 결론과 권고사항을 수록했다.

무력과 화기를 사용하는 권한은 경찰이 임무를 수행하는 데 없어서는 안 될 것이지만, 그렇다고 반드시 필요한 것도 아니다. 실제로 경찰에 관한 국제기준의 기저 원칙은 반드시 필요할 경우가 아니면 무력을 사용하지 않는다는 것이다. 그러나 많은 국가에서 이러한 원칙을 지키지 못하고 있으며, 자의적이고 과도하게, 또는 불법적인 방법으로 무력과 화기를 사용하는 데 주로 의존하고 있다.

경찰의 무력과 화기 사용으로 사망자나 중상자가 발생한 사례는 전세계 모든 지역에 존재한다. 최근 수 년간 다음과 같은 사건이 발생했다.

  • 브라질에서 경찰에게 목숨을 잃은 사람들 중 과도하게 많은 수가 젊은 흑인 남성이었다.
  • 미국에서 경찰이 무장하지 않은 사람에게 발포해 사망한 사건이 다수 발생했으며, 마찬가지로 피해자 대다수가 흑인 남성이었다.
  • 방글라데시의 특수경찰은 치명적인 무력을 동원해 과도하게 작전을 수행하며, 수많은 사망자가 발생했다.
  • 바레인, 브룬디, 캄보디아, 그리스, 스페인, 터키, 베네수엘라, 우크라이나 등에서 공공집회중 최루가스, 고무탄, 때로는 화기에 이르는 무력을 동원해 심각한 사상자를 발생시켰다.

이는 국제인권의무를 따르지 않는 국내법, 결함 있는 내부규정, 훈련과 장비 부족, 지휘계통의 통제 부족, 불법행동을 한 경찰에 대한 처벌 부재 등 다양한 원인으로 인한 것이다.

국제앰네스티는 각국 정부에 이번에 새롭게 마련된 ‘무력사용 지침’을 채택해, 이러한 결함을 보완하고 유엔 기본원칙에 따라 국내법을 개정, 시행할 것을 촉구한다.

아냐 비에네르트 박사는 “유엔 기본원칙이 있다는 것은 경찰이 제한된 특정 상황에서 법과 질서를 유지하기 위해 무력을 사용할 필요가 있으며, 또한 사용할 수 있음을 인정하는 것이다. 그러나 이러한 무력은 반드시 국제인권법에 따라 사용해야 하며, 경찰에게 살인할 수 있는 권한이나 면책권을 부여하는 것처럼 받아들여져서는 안 될 것이다. 누구도 법 위에 설 수 없으며, 특히 법질서를 유지하는 것이 역할인 경찰은 더욱 그렇다”고 말했다.

Amnesty International releases new guide to curb excessive use of force by police

From the streets of Ferguson, Missouri to the favelas of Brazil, the police use of force and firearms makes global headlines when it turns fatal.

In countless other cases, including in response to demonstrations, police are too quick to use force instead of seeking peaceful conflict resolution. In many countries police deploy tear gas, rubber bullets and other weapons in arbitrary, abusive or excessive use of force, causing serious casualties, including killing and maiming people, often with little or no accountability.

Amnesty International is responding to this serious deficiency in law enforcement by publishing comprehensive new Guidelines for authorities to ensure that police give utmost priority to the respect and protection of life and physical integrity.

“All too often, in many countries around the world, people are killed or seriously injured when police use force in violation of international standards or existing national laws,” said the report’s author, Dr. Anja Bienert of Amnesty International Netherlands’ Police and Human Rights Programme.

“Nobody is disputing that police have a challenging, and often even dangerous, duty to perform. But governments and law enforcement authorities frequently fail to create a framework to ensure that police only use force lawfully, in compliance with human rights and as a last resort.

“These new Guidelines aim to close that gap and provide legal and practical measures which states can and must take to ensure police use of force is not excessive, abusive, arbitrary or otherwise unlawful. For this to happen, full accountability must be ensured for any use of force by police.”

Amnesty International is launching Use of Force – Guidelines for Implementation of the UN Basic Principles on the Use of Force and Firearms by law enforcement officials to mark the 25th anniversary of the adoption of the UN Basic Principles in September 1990. The Basic Principles are regarded as the key instrument for states to ensure compliance with their obligations to uphold the right to life and physical integrity.

The Guidelines draw on examples of national laws, internal regulations and training documents from 58 countries in all regions of the world. Their detailed conclusions and recommendations are meant to support government authorities to implement the UN Basic Principles and ensure good, effective, human rights-compliant policing.

The power to use force and firearms is indispensable for police to carry out their duties, but that does not mean it is an inevitable part of the job – in fact, the underlying principle of the international standards for police is not to use force unless it is really necessary. In many countries, police currently fall short of this mark, and often resort to the use of force and firearms in an arbitrary, excessive or otherwise unlawful manner.

In all regions of the world there are examples where deaths and serious injuries have resulted from police use of force and firearms. In recent years these include:

· killings by police in Brazil which impact disproportionately on young black men;

· numerous police shootings in the USA resulting in the death of unarmed people, likewise with a disproportionate impact on African American men;

· in Bangladesh, special police forces carrying out heavy-handed police operations with lethal force, resulting in the death of many people;

· use of tear gas, rubber bullets and other means of force, sometimes even firearms, during public assemblies, resulting in serious casualties, including in Bahrain, Burundi, Cambodia, Greece, Spain, Turkey, Venezuela and Ukraine.

This is due to a variety of reasons, including domestic laws that contradict international human rights obligations, deficient internal regulations, inadequate training and equipment, lack of command control and the absence of accountability for police who act outside the law.

Amnesty International is calling on governments to use its new Guidelines to help to address these deficiencies and to bring national law and implementation in line with the UN Basic Principles.

“The UN Basic Principles are an acknowledgement that, in certain limited circumstances, police can and will need to use force to maintain law and order. But this must be done in compliance with international human rights law and it certainly must never be seen as a licence to kill nor as granting immunity to police officials: nobody is above the law, especially those who have a duty to uphold the law,” said Dr. Anja Bienert.

프랑스 의회가 파리 테러 참사에 대응하기 위해 일사천리로 마련하고 있는 긴급조치가 프랑스의 향후 반테러 대책으로 확정되어서는 안 된다고 국제앰네스티가 19일 경고했다.

존 달후이선(John Dalhuisen) 국제앰네스티 유럽-중앙아시아 국장은 “당장은 향후에 임박한 공격으로부터 국민을 보호하는 것을 마땅히 최우선으로 해야 한다. 그러나 현재 필수적인 인권보호조치까지 희생해가며 전면적으로 공권력을 강화하는 내용의 긴급조치가 프랑스 의회에서 일사천리로 통과되고 있다. 이러한 조치는 철저히 필요한 경우에만 동원해야 하며, 향후 프랑스의 장기적인 반테러 대책으로 확정되어서는 안 된다”고 말했다.

11월 13일 발생한 파리 테러 이후 12일간의 국가 비상사태가 선포되면서 프랑스의 경찰력은 다방면으로 강화되었다. 18일에는 국가 비상사태를 3개월로 연장하고, 다수의 추가 조치를 취한다는 내용의 법안이 의회를 통과했다.

이로써 사법부의 승인 없이도 가택을 수사하거나 가택 연금에 처하는 것이 가능해졌다. 또한 단체 결성을 영구 금지할 수 있는 권한이 확대되었으며, 공공집회를 여는 것도 금지되었다.

이와 같은 예외적 조치는 일반 형법에 포함되지 않고, 시민의 자유와 인권을 제한하기 때문에 정식으로 비상사태가 선포된 경우에만 허용된다. 긴급조치는 반드시 필요한 경우에만 시행되어야 하고, 그 범위와 기간이 적절해야 한다. 가장 중요한 점은 이러한 조치가 임시여야 하고, 감시되어야 하며, 신중하게, 즉 절대적으로 필요한 경우에만 시행되어야 한다는 것이다.

존 달후이센 국장은 “시간이 흐르면서 프랑스와 유럽 전역의 경찰당국이 가해자를 처벌하고 당면한 위협을 막기 위해 최선을 다하고 있는 가운데, 일반법에 포함되지 않고 인권을 침해하는 비상시 권한의 필요성을 신중하게 재평가할 필요가 있다. 국민을 보호하기 위해 인권을 제한한다는 것은 모순”이라고 말했다.

논란이 되고 있는 올랑드 대통령의 장기적 입법개정안은 치명적인 무력 사용 규제를 재검토하고, 이미 광범위한 수준인 프랑스의 감시권한을 더욱 확대한다는 내용을 담고 있다. 또한 이중국적자의 프랑스 시민권을 박탈하고, 국경을 폐쇄하고, 안보상 위협이 될 것으로 추정되는 외국인을 조기 추방한다는 내용도 포함되어 있다. 야당 역시 국가 안보에 위협이 되는 인물을 사전에 구금할 수 있는 권한을 부여할 것을 촉구했다.

존 달후이센 국장은 “이러한 긴급조치가 연장되고 성문화된 끝에, 결국 일반법의 핵심적인 부분으로 자리잡아 천천히 인권을 좀먹은 사례를 우리는 이미 몇 번이고 목격했다. 장기적인 관점에서, 파리 테러를 일으키게 만든 유해한 사상은 프랑스가 공화국의 기본 가치를 지켜야만 타파할 수 있는 것”이라며 “올랑드 대통령은 지난 16일 의회 연설을 통해, 프랑스는 분쟁과 박해 등 파리에서 벌어진 사건과 다를 바 없이 끔찍한 현실을 피해 온 난민들을 언제나 환영할 것이라고 분명히 약속한 바 있다. 장기간이 될 테러와의 싸움에도 이와 같은 원칙적인 관점이 적용되어야 할 것”이라고 말했다.

France: Emergency measures must protect public without trampling human rights

The emergency measures being rushed through the French Parliament in the wake of the horrific Paris attacks to counter must not become a permanent fixture in France’s anti-terror arsenal, Amnesty International warned today.

“Right now the protection of the population from further imminent attack is rightly the number one priority. But the emergency powers currently being rushed through parliament provide for a sweeping extension of executive powers at the expense of essential human rights safeguards. They must be used only when strictly necessary and should not become a permanent addition to France’s anti-terror arsenal,” said John Dalhuisen, Amnesty International’s Director of Europe and Central Asia.

The 12-day state of emergency declared in the aftermath of the 13 November attacks provided for a range of additional police powers. The bill proposed yesterday extends the state of emergency for a further three months and includes a number of additional measures.

These include powers to carry out house searches and impose house arrest without the need for judicial authorization. Powers to ban associations with permanent effect have been extended and public demonstrations have been prohibited.

Only in a formally declared state of emergency can such extraordinary measures be permissible as they depart from the ordinary criminal law and curtail civil liberties and human rights. Emergency measures must be necessary and proportionate in scope and duration. Critically, they must be temporary, monitored, and employed judiciously, that is, only when absolutely required.

“As the days pass and law enforcement agencies in France and across the region work diligently to bring the perpetrators to justice and avert imminent threats, the need for emergency powers that depart from regular law and infringe on human rights will need to be carefully reassessed. It is a paradox to suspend human rights in order to defend them,” said John Dalhuisen.

Problematic longer-term legislative changes proposed by President Hollande include a review of the rules on the use of lethal force and extending France’s already sweeping surveillance powers. He has also proposed stripping citizens with dual nationality of their French citizenship, barring people from the country, and fast-tracking deportation of foreigners if they are suspected of being a security threat. Opposition politicians have also called for powers to pre-emptively detain national security suspects.

“Time and again we have seen emergency measures extended and codified until they become part and parcel of the ordinary law, chipping steadily away at human rights. In the long run, the pernicious ideology underpinning the Paris attacks can only be defeated by upholding the foundational values of the French Republic,” said John Dalhuisen.

“In his address to Parliament on Monday, President Hollande boldly affirmed France’s commitment to welcoming refugees fleeing conflict, persecution and the self-same horrors as hit the streets of Paris. This principled vision should be extended to the long-term fight against terrorism.”

경찰이 고 백남기 농민 관련 민사소송에서 법원에 일부 허위 내용이 담긴 답변서를 제출하는 등 백남기 사건과 관련해 잇따라 거짓말을 하고 있는 것으로 드러났다.

경찰은 고인의 유족들이 정부를 상대로 낸 손해배상 소송과 관련해 지난 5월 법원에 낸 답변서에서 “살수차 운용지침의 기본절차가 준수됐다”며 백남기 농민에게 물대포를 쏜 충남9호차도 살수차 운용지침을 준수했다고 주장했다.

경찰은 답변서에서 “이 사건 살수차(충남9호차)가 18시 50분경 안국사거리에서 종로구청 입구 사거리로 도착”했고, “18시 53분경 경고살수를 실시”했다고 답했다. 그런데 최근 국회 행정안전위원회 박남춘 더불어민주당 의원이 공개한 충남9호차 CCTV를 보면 이 시간대에 나오는 것은 경고살수가 아니라 분출구에서 약간의 물이 찔끔 뿜어져 나오는 정도에 불과했다.

백남기 농민에 물대포 쏜 충남9호차 ‘경고살수’했다고 허위 답변

경찰의 살수차 운용지침에 따르면 집회 시위 현장에서 살수차를 이용할 때는 먼저 경고방송을 하고, 그 뒤 경고살수를 한 후 본격살수를 해야 한다. 경고살수는 소량으로 분산살수하는 방법을 말하는데, 분산살수는 ‘물줄기가 소낙비 형태로 시위대에게 떨어지도록 좌우로 반복하여 살수하는 방법’을 말한다. 경찰이 주장한대로 경고살수가 되려면 물줄기가 소낙비 형태로 시위대에 떨어져야 하는데 영상에서 찔끔 나오는 물은 시위대 근처에 다가가지도 못했다.

충남9호차는 민중총궐기 당시, 원래 현장에 있던 기존 살수차에 연결된 물 공급 호스가 절단되면서 교체 투입된 것이다. 경찰은 기존 살수차가 이미 경고살수를 했기 때문에 그 효력이 유지된다고 주장하고 있다. 경찰 주장을 반영하더라도 충남9호차가 경고살수를 한 사실은 없는데도 법원에 낸 답변서에서 “경고살수를 실시했다”고 주장한 것이다.

백남기 농민 직사살수가 고작 13초?

경찰은 또 이 재판에서 백남기 농민에 대한 직사살수가 ‘13초’라고 주장하고 있다. 하지만 충남9호차와 광주11호차 CCTV 영상을 확인하면 백남기 농민과 백남기 농민을 구조하려는 시민들을 향해 최소 30초 가량 물대포를 쏘는 사실이 확인된다.

사고 당일 응급실에 인턴만 있어서 백 교수 불렀다?

경찰의 허위 답변은 여기에 그치지 않는다. 경찰은 백남기 농민이 쓰러진 뒤 사후 조치에 최선을 다했다는 점을 강조하면서 구은수 전 서울지방경찰청장이 “백남기 사건을 인식하자마자 서울 혜화경찰서장을 곧바로 서울대 병원으로 보내 서울대 병원장을 설득해 신경외과 전문의로 하여금 신속히 수술이 이뤄질 수 있도록 조치를 취했다”, “당시 토요일로 신경외과 전문의는 출근을 하지 않았었다”, “당시 주말 야간이어서 응급실에 인턴 밖에 없던 상황에서 서울대 병원장에게 긴급히 협조요청해 서울대 병원 신경외과 최고 전문의인 백선하가 급히 서울대 병원으로 와서 백남기의 진료 및 수술집도를 할 수 있도록 조치를 취했다”고 답변했다.

하지만 사고 당일 서울대병원에는 뇌출혈 전문인 조원상 신경외과 교수가 당직 근무를 하고 있었다. 11일 국회 교문위 국감에 출석한 백선하 교수도 유은혜 더불어민주당 의원의 질문에 당시 조원상 교수가 당직 근무를 했다고 답변했다. 서울대병원 측은 “당직이면 주말 야간까지도 근무를 하는 것인지”에 대한 기자의 질문에 “그렇다”고 확인해줬다.

당일 신경외과가 작성한 의무기록에는 “환자의 neurological status(신경학적 상태), brain(뇌) CT 소견 상 호전 어려울 것으로 생각된다”며 “신경외과적 수술을 시행한다 하더라도 예후 좋지 않을 것으로 생각된다”고 기록돼 있다.

당시 당직을 서고 있는 신경외과 의사가 수술을 해도 예후가 좋지 않을 것이라고 판단했는데도 불구하고, 당시 오병희 서울대 원장은 어쩐 일인지 당시 휴무였던 백선하 교수를 불러 수술을 시킨 것이다.

백남기 농민 쓰러지는 현장 바로 앞 경찰 추정 사람 보여

경찰은 백남기 농민이 쓰러진 사실을 사고 당일 언론에 보도된 후인 저녁 8시30분에 인지했다고 주장하고 있다. 이철성 경찰청장은 지난 6일 국회 안전행정위원회 국감에서 “농민이 쓰러진 것을 보고도 방치할 경찰은 없다”고 말했다.

하지만 광주 11호차에서 촬영된 CCTV 영상을 보면 백남기 농민이 직사살수에 쓰러져 밀려나고, 시민들이 달려가 백남기 농민을 구조할 때 취재진 뒤쪽에 경찰로 추정되는 사람들이 서 있는 장면이 보인다.

경찰의 거짓말은 최근 국감에서도 드러났다. 민중총궐기 당시 30분 단위로 작성된 상황속보 문건에 대해 경찰은 김정우 더불어민주당 의원실에 처음에는 “30분 단위 상황속보를 작성하지 않았다”고 서면 답변했다. 그러나 이철성 경찰청장은 국감에 출석해 “열람하고 파기했기 때문에 별도로 관리하지 않고 있다”며 작성 사실을 인정했다가, 이 자료들이 이미 법원에 제출됐다는 지적이 나오자 다시 “원래 열람하고 파기하도록 돼 있는데 당시 경비부서에서 추후 상황에 대비해 보관하고 있다가 법원에 제출했다”고 말을 바꿨다.

경찰은 이날 의원들에게 15시 25분부터 16시 45분 사이에 작성된 10보와 13보, 20시 30분부터 21시 사이에 작성된 19보와 20보만 제출했다. 제출되지 않은 시간대에는 백남기 농민이 물대포에 맞은 시각이 포함돼 있다.

야당 의원들은 지난 9월 열린 백남기청문회 때부터 경찰이 민중총궐기 당일 살수요원 등을 상대로 직접 조사한 청문감사보고서와 진술서 등을 제출하라고 요구하고 있다. 하지만 경찰은 제출을 거부하고 있다.

경찰의 거짓말이 이어지고 검찰의 수사도 지지부진한 상황에서 고 백남기 농민 사건 진상규명을 위한 특검을 요구하는 목소리가 높아지고 있다. 야3당은 지난 5일 상설특검법안을 공동 발의했지만 새누리당이 반대하고 있는 상황이다.

전략적으로 병원 노려 공격한 시리아와 러시아

국제앰네스티의 공습 사례 분석에 따르면, 러시아군과 시리아군이 지난 3개월 동안 알레포 북부 지역으로의 진격로 확보를 위해 조직적, 의도적으로 병원을 공격한 것으로 나타난다.

시리아 허술한 정전 협상이 타결된 이후에도 시리아 정부군과 동맹군은 의료시설에 대한 공격을 강화했다.

티라나 하산(Tirana Hassan) 국제앰네스티 위기대응국장은 “시리아군과 러시아군은 국제인도법을 명백히 위반하며 고의로 의료시설을 공격하고 있다. 그러나 정말로 끔찍한 것은 병원을 파괴하는 것이 군사 전략으로 보인다는 점이다. 최근 북부 알레포에서 의료시설에 대한 공격이 계속된 것은 의료종사자와 병원을 노린 공격 양상의 일환인 것으로 추정된다. 이러한 전략으로 시리아 분쟁이 시작된 이후 병원 수십 곳이 파괴되고 의사와 간호사 수백 명이 목숨을 잃었다”고 했다.

국제앰네스티는 지난 12주 동안 알레포 북부 지역에서 병원과 의료센터, 진료소를 의도적으로 노리고 공격한 6개 이상의 충격적인 증거를 확보했다. 시리아 각지의 의료 시설을 의도적으로 공격하는 양상이 계속해서 나타났다. 의료종사자를 포함해 민간인 최소 3명을 숨지게 하고, 44명이 부상당한 공격은 전쟁 범죄에 해당한다.

국제앰네스티는 6개 병원에서 근무한 의료진 및 터키, 시리아의 인도주의 단체와 인터뷰를 했다. 이들은 2016년 2월 해당 지역에 대한 공습이 잦아지고 치료가 시급한 민간인들이 급증하면서 어려운 상황에 처해 있다고 호소했다.

알레포 북서쪽 아나단과 흐레이탄에서 근무하는 의료진들이 국제앰네스티에 알린 내용에 따르면, 병원과 기반시설을 공격해 마을이나 도시의 주민들을 모두 내보냄으로써 지상군의 진격을 용이하게 하는 것이 시리아 정부의 전략이라고 했다.

아나단의 한 의사는 “병원, 수도, 전력시설은 언제나 가장 먼저 공격 대상이 된다. 이것이 파괴되면 주민들은 생존에 필요한 시설을 사용하지 못한다. 아나단에서도 같은 일이 벌어지고 있다. 2월 2일 야전병원과 의료센터가 공격을 당한 이후 2월 중순에 이미 주민 대부분이 아나단을 빠져나간 상태다. 야전병원은 거의 제 기능을 못하고 있고, 의료센터는 문을 닫았다. 문제는 이곳 주민 모두가 피난을 떠날 수 있는 것은 아니라는 점이다. 떠나지 못하고 남은 사람들은 의료적 지원이 절실한 노인들”이라고 말했다.

티라나 하산 국장은 “알레포 주변 반군 점령 지역의 병원은 러시아와 시리아 정부군의 가장 우선적인 공격 목표가 되었다. 전투 지역에 거주하는 민간인들은 생존에 필수적인 수단을 잃었기 때문에 피난을 떠날 수밖에 없다.”고 말했다.

국제앰네스티가 인터뷰한 모든 사람들은 공격받은 병원 주변에 군용차량이나 검문소, 군인, 전선이 전혀 없었으며, 병원은 인도적 역할만을 수행했을 뿐이라고 증언했다.

적대행위에 직접적으로 참여하지 않은 민간인과 병원 및 의료시설 등의 민간 시설을 의도적으로 공격하는 것은 국제인도법, 전쟁법 위반 행위이자 전쟁범죄에 해당한다. 전쟁법상 병원과 의료시설은 인도적 기능 외에 무기 저장고 등 “적에게 해로운 행위”를 저지르는 데 이용되는 경우가 아니고서야 특별히 보호받아야 할 대상이다.

예외의 경우라 하더라도 충분한 시간제한을 두고 사전경고가 이루어져야 하고, 이러한 경고가 무시됐을 경우에만 공격할 수 있다.

티라나 하산 국장은 “국제앰네스티는 이미 여러 차례 시리아와 러시아 정부에 국제인도법을 준수할 것을 촉구했고, 러시아 정부에는 군의 병원 공격과 인권침해행위에 대해 신뢰 있고 독립적인 조사를 진행하라고도 요청한 바 있다”며 “의료진과 의료시설은 모두 공격 대상이 아니라 존중되고 보호받아야 할 대상이다. 알레포 주 북부 지역의 병원들이 새로운 공격 전선이 되면서, 부상자와 환자들은 터키 국경에 발이 묶여 있거나 시리아 내에서 죽고 있다. 병원 치료를 받지 못하도록 국가정부가 막는 것은 용납될 수 없다. 의도적으로 병원마다 공격을 가하는 것 역시 용납할 수 없다”고 말했다.

배경과 증언

시리아 현지 단체인 시리아인권네트워크(Syrian Network for Human Rights)에 따르면 2015년 9월부터 알레포 주의 8곳을 포함해 27개 이상의 병원이 러시아와 시리아군으로부터 공격을 받았다. 시리아-미국 의학협회(Syrian American Medical Society, SAMS)는 2015년 12월 이후 알레포 지역의 병원 최소 13개가 공습 대상이 되었으며, 그 중 한 곳은 2월 15일 지대지 미사일 공격을 받았다고 국제앰네스티에 전했다. 총 14건의 공격으로 의료진 4명과 민간인 45명이 숨졌다.

인권의사회(Physicians for Human Rights)는 시리아 분쟁이 시작된 이후 분쟁당사자들에 의한 의료시설 공격이 최소 346건 이루어졌으며 이로 인해 의료진 705명이 숨졌다고 발표했다. 이러한 공격의 대다수가 시리아 정부군과 동맹군이 가한 것이었다.

국제앰네스티는 이 중 2015년 12월부터 2016년 2월 알레포 북부에서 이루어진 6건의 공습에 주목했다.

알레포 주 북부 지역 공습
2016년 1월 말, 시리아 정부군은 누불, 자흐라 지역을 봉쇄한 반정부 무장단체를 저지하기 위해 러시아군의 공습 지원을 받으며 알레포 북부에 지상공격을 감행했다. 이로 인해 누불과 자흐라는 물론 터키에서 알레포로 가는 공급 경로도 차단됐다. 2월 1일, 시리아군은 쿠르드, 아랍, 아시리아계가 연합한 시리아 민주군과 함께 같은 지역에 공격을 이어갔다.
알레포 북부에서 터키 국경과 인접한 밥 알 살람으로 피난을 온 주민들이 국제앰네스티에 전한 내용에 따르면, 2월 첫째 주부터 러시아군과 시리아군의 공습이 급증하면서 수천 명이 피난을 갈 수밖에 없었다. 공습 지역에 병원이 전혀 없어서 부상자들은 치료를 받기 위해 차로 몇 시간이나 이동해야 했다. 알레포 지역 안팎에서 근무하는 의사 및 의료진들은 인터뷰에서 공습이 시작될 때 의료시설이 가장 먼저 표적이 되었고, 이는 의료시설을 파괴해 부상자들이 치료받지 못하게 하려는 의도인 것 같다고 밝혔다.

텔 리파트
시리아 민주군에 속한 쿠르드계 무장단체인 ‘인민수비대(YPG)’가 텔 리파트를 점령하기 이틀 전인 2월 15일에 이 지역을 빠져 나왔다는 의사 2명과 활동가 1명이 앰네스티에 전한 바에 따르면, 2월 8일 이 지역에 지상공격이 시작됨과 동시에 한 주간 야전병원, 재활센터, 신장투석센터 등의 의료시설 3곳이 모두 직접적으로 미사일 공격을 받았다고 한다. 이어진 공격으로 의료진 6명과 민간인 환자 3명이 부상을 입었고, 이 지역에서 사용 가능한 의료시설은 사라지게 되었다.

야전병원과 재활센터, 신장투석센터를 관리하는 의사 “파라즈”(안전상의 이유로 가명 사용)는 “2월 초 알레포 북부 지역 마을들을 점령하며 세력을 키우기 시작한 YPG가 텔 리파트 쪽으로 진격해 왔고, 이들이 접근하자 러시아군과 시리아군은 의료시설을 공격 대상으로 삼았다. 그 결과 무차별적인 포격으로 부상을 입은 민간인들은 병원이 없어 터키 국경까지 이송되어야 했다”고 전했다.

최근 공격이 벌어지기 수 주 전인 2015년 12월 19일 오후 2시 45분에는 텔 리파트에서 특수 아동들을 치료하던 건물에 직접적인 공습이 이루어졌다. 이 곳 관리인의 말에 따르면 2014년 설립되어 알레포 북부 전역에서 매달 어린이 250명을 수용하던 곳이었다.

마스칸 마을
터키의 독립의사협회(Independent Doctors Association: IDA)에 소속된 한 의사는 알레포 북부에 위치한 마을인 마스칸에서 공습이 더욱 격렬해지고 지상공격이 임박하면서 2월 1일 이들이 지원하던 야전병원을 철수시킬 수밖에 없었다고 전했다. 의료진과 환자들이 모두 대피한 다음 날, IDA는 공습을 받아 파괴된 야전병원의 사진을 받았다.

이렇게 버려진 마을은 2월 15일 시리아 정부군이 점령했다. 국제앰네스티는 파괴된 장소의 사진과, 야전병원이 테러리스트들의 치료 장소로 쓰였다고 주장하는 시리아군의 영상을 검토했다. 국제인도법상 인도주의적 역할을 수행하는 병원과 의료시설은 보호받아야 하며, 부상당한 군인을 치료하는 경우에도 마찬가지다.

아나단
아나단에서 근무하는 의사와 한 의료인이 전한 바에 따르면, 1월 27일과 2월 2일, 러시아군 또는 시리아군의 전투기가 가한 두 차례의 공습으로 야전병원 한 곳이 일부 파괴되었고 재활센터는 사용이 불가능해졌다.

재활센터에서 일하던 한 물리치료사는 “2월 1일 공습이 더욱 심해지더니, 다음 날 아침 8시 30분에 센터 건물이 미사일 공격의 표적이 됐다. 센터에 출근하던 길에 큰 폭발이 일어난 것을 목격했고, 도착해 보니 입구에는 운전사의 시신이 있었고 환자 2명과 의료진 5명이 중상을 입은 상태였다. 이들은 아나단 밖으로 이송해야 했다. 이제 재활센터는 사용할 수 없는 상태다. 고가의 의료 장비도 상당수가 파괴되었다. 2014년부터 운영해 치료가 필요한 사람이라면 누구든 치료를 해 왔던 곳이다”라고 말했다.

흐레이탄
흐레이탄의 바그다드 병원은 2015년 12월 25일 직접 공격의 표적이 되어 심각한 피해를 입었다. 이 병원에서 근무하던 의사와 직원은 러시아군 또는 시리아군의 전투기가 병원을 직접 노려 미사일 공격을 가하면서 직원 10명과 민간인 환자 최소 20명이 부상을 입었고 병원이 폐허가 됐다고 전했다. 직원이었던 알리 하메도는 이날 공습으로 목숨을 잃었다. 공습 이후 병원은 운영되지 못하고 있다.

흐레이탄의 의사 “압둘라”(안전상의 이유로 가명 사용)는 “지하 병원조차도 안전하지 못하다. 1년 전 공습을 피할 수 있을 거란 생각에 병원을 지하로 옮겼지만 미사일은 지하층까지 관통할 수 있었다. 병원을 마련하고 부상자와 병자를 치료하기 위해 수십만 달러를 투자했지만 이제 흐레이탄에 남은 병원은 없다”고 말했다.

2월 6일 공격을 피해 흐레이탄을 떠난 한 가족은 마지막으로 도시를 떠난 것이 자신들이라고 전했다. 이 가족의 아버지는 “흐레이탄에서 평생을 살았지만 이렇게 텅 빈 모습은 본 적이 없다. 도시를 떠나지 못하는 매우 소수의 가족들이 남아 있을 뿐이다. 병원을 비롯한 도시의 기반시설이 공습으로 모두 파괴된 탓에 살기 위해 필요한 시설이 남아 있지 않다”고 말했다.

러시아 국방부는 2월 4일부터 11일 사이 알레포의 “테러리스트”를 대상으로 공습을 가했지만 민간인을 표적으로 삼은 바는 없다고 밝혔다. 민간인 수백여 명이 숨지고 민간 건물에도 여러 차례 공격이 이루어졌다는 강력한 증거가 있음에도 불구하고 러시아 정부는 시리아에서 민간인을 숨지게 하거나 민간시설을 파괴한 사실에 대해 계속해서 부인하고 있다. 2월 11일 러시아 국방부는 알레포 북부 지역의 공습이 미국 주도 연합군의 소행이라고 비난했고, 미국은 이를 부인했다. 미국 중앙사령부(CENTCOM)는 미국 주도 연합군이 2월 1일과 4일 사이 알레포 북부 마라 지역에서 무장단체 자칭 이슬람국가(IS)를 대상으로 공습을 가했다고 밝혔다.

Syrian and Russian forces targeting hospitals as a strategy of war

Russian and Syrian government forces appear to have deliberately and systematically targeted hospitals and other medical facilities over the last three months to pave the way for ground forces to advance on northern Aleppo, an examination of airstrikes by Amnesty International has found.

Even as Syria’s fragile ceasefire deal was being hammered out, Syrian government forces and their allies intensified their attacks on medical facilities.

“Syrian and Russian forces have been deliberately attacking health facilities in flagrant violation of international humanitarian law. But what is truly egregious is that wiping out hospitals appears to have become part of their military strategy,” said Tirana Hassan, Crisis Response Director at Amnesty International.
“The latest string of attacks on health facilities north of Aleppo appears to be part of a pattern of attacks on medics and hospitals, a strategy that has destroyed scores of medical facilities and killed hundreds of doctors and nurses since the start of the conflict.”

The organization has gathered compelling evidence of at least six deliberate attacks on hospitals, medical centres and clinics in the northern part of the Aleppo Countryside governorate in the past 12 weeks. The attacks, which killed at least three civilians including a medical worker, and injured 44 more, continue a pattern of targeting health facilities in various parts of Syria which amounts to war crimes.

Amnesty International researchers spoke to medical workers from the six medical facilities and several humanitarian organizations in Turkey and Syria, who described their struggle to cope with the high number of civilians in need of medical treatment following the recent escalation of airstrikes on the area in February 2016.

Several medical workers from Anadan and Hreitan, two towns north-west of Aleppo, told Amnesty International that the Syrian government’s strategy is to empty an entire town or village of residents by targeting hospitals and infrastructure to facilitate the ground invasion.
A doctor from Anadan said: “Hospitals, water and electricity are always the first to be attacked. Once that happens people no longer have services to survive. This is what happened in Anadan. By mid-February most of the residents had fled the city after the field hospital and medical centre were attacked on 2 February. The field hospital is barely operating and the centre closed. The problem is that not everyone is able to leave the city. The ones who stayed behind are elderly people who are in desperate need of medical treatment.”
“Hospitals in opposition-controlled areas around Aleppo became a primary target for the Russian and Syrian government forces. This eliminated a vital lifeline for the civilians living in those embattled areas, leaving them no choice but to flee,” said Tirana Hassan.
All of the people interviewed by Amnesty International said that there were no military vehicles, checkpoints, fighters or front lines near the hospitals that were attacked and that the hospitals were exclusively serving their humanitarian function.
Deliberate attacks on civilians not directly participating in hostilities and on civilian objects, including hospitals and other medical facilities, violate international humanitarian law (also known as the laws of war) and amount to war crimes. Under the laws of war, hospitals and medical units enjoy special protection. They only lose their protection from attacks if they are being used outside their humanitarian function to commit “acts harmful to the enemy” such as to store weapons.

Even in the case of such misuse, a warning has to be issued setting a reasonable time limit and an attack can only take place after such a warning has remained unheeded.

“We have repeatedly called on the Syrian and Russian governments to abide by international humanitarian law and have urged Russia to conduct credible, independent investigations into its forces’ attacks on hospitals and other serious violations,” said Tirana Hassan.
“All medical workers and all health facilities should be respected and protected instead of being targeted. The injured and sick people are stranded at the Turkish border or dying inside Syria because hospitals have become the new front line in the offensive on the northern part of the Aleppo Countryside governorate. There is no excuse for a government to prevent people from accessing medical care. There is no excuse for deliberately targeting hospital after hospital.”

Background and testimonies
According to the Syrian Network for Human Rights, a local monitoring group, at least 27 hospitals, including eight in Aleppo governorate, have been targeted by Russian and Syrian government forces since September 2015. The Syrian American Medical Society (SAMS) told Amnesty International that since December 2015 at least 13 hospitals had been targeted in Aleppo by airstrikes and one by a surface-to-surface missile on 15 February. A total of four medical staff workers and 45 civilians were killed in these 14 attacks.

Physicians for Human Rights has reported that, since the conflict began, at least 346 attacks on medical facilities have been carried out by parties to the conflict, with 705 health workers killed. Syrian government forces and their allies have been responsible for the overwhelming majority of these.

Amnesty International’s researchers focussed on six attacks in northern Aleppo between December 2015 and February 2016.

The offensive on the northern part of Aleppo Countryside
During the last week of January 2016, Syrian government forces supported by Russian airstrikes began a ground offensive in the northern part of the Aleppo Countryside governorate to break the siege imposed by non-state armed groups on the towns of Nubul and Zahraa. This cut off the supply route from both this area and Turkey to Aleppo city. On 1 February, the Syrian government forces and the Syrian Democratic Forces, which include Kurdish, Arab and Assyrian groups, continued their offensive in the same area.
Civilians who fled the northern part of the Aleppo Countryside governorate to the Bab al-Salam border crossing into Turkey told Amnesty International that Russian and Syrian government airstrikes escalated in the first week of February, forcing thousands of people to flee. With no functioning hospitals left in the area, many of those injured in the airstrikes were forced to drive for hours to obtain medical help. Interviews with doctors and medical workers in and around Aleppo indicate that health facilities were among the first buildings targeted in a series of airstrikes at the start of the offensive, which they believe were intended to reduce the capacity of health facilities and prevent the injured from receiving medical treatment.

Tel Rifaat
Two doctors and an activist from Tel Rifaat who left two days before the People’s Protection Unit (YPG), part of the Syrian Democratic Forces, took control of the town on 15 February told Amnesty International that all three health facilities, including a field hospital, a rehabilitation centre and a kidney dialysis centre were directly targeted by missiles during the week beginning on 8 February, just as the ground offensive on the town began. The attacks injured six members of the medical team and three civilian patients and left the population with no working medical facility.
Doctor “Faraj” (his real name has been withheld for security reasons), who manages the field hospital, rehabilitation and kidney dialysis centre, told Amnesty International:
“The Kurds started gaining control of some villages in the northern part of Aleppo Countryside at the beginning of February and they were advancing towards Tel Rifaat. As they approached, Russian and Syrian forces targeted medical facilities. As a result, the civilians injured from the indiscriminate shelling had to be transferred to the Syrian/Turkish border because the hospitals were no longer operational.”
Several weeks before the current offensive, on 19 December 2015 at 2.45pm, a direct airstrike destroyed a centre in Tel Rifaat which provided medical care for children with special needs. According to the centre’s manager, it had been set up in 2014 and received 250 children per month from all over the northern part of Aleppo Countryside.

Maskan village
A doctor from the Independent Doctors Association (IDA) in Turkey told Amnesty International that the field hospital they support in Maskan, a village in the northern part of Aleppo Countryside, had to be evacuated on 1 February because of intensifying airstrikes and an imminent ground invasion of the village. A day after the medical staff and patients evacuated, the IDA received images of the field hospital destroyed by an airstrike.

The Syrian government gained control of the deserted village on 15 February. Amnesty International reviewed the images of the destruction and a video of government forces inside the field hospital claiming that the facility was used by terrorists to treat the war wounded. International humanitarian law protects hospitals and health facilities carrying out their humanitarian function, including providing medical treatment to wounded fighters.

Anadan
Doctors and a medical worker in Anadan told Amnesty International how two airstrikes on 27 January and 2 February by Russian or Syrian warplanes partially destroyed a field hospital and rendered a rehabilitation centre out of service. A physiotherapist at the rehabilitation centre said:
“The airstrikes intensified on 1 February. The next day at 8.30am the centre was targeted by a missile. I was on my way to work when I saw and heard the explosion. When I arrived I saw the driver’s body at the entrance, two patients and five from the medical team severely injured. We had to transfer them outside of Anadan. Now the centre is out of service. We lost a lot of expensive equipment. We provided treatment to whoever is in need and we have been operating since 2014.”

Hreitan
Baghdad Hospital in Hreitan was directly targeted on 25 December 2015 and severely damaged. A doctor and another medical worker at the hospital told Amnesty International that a Russian or Syrian warplane fired missiles directly at the hospital, injuring 10 medical staff and at least 20 civilian patients, and leaving the facility in ruins. Medical worker Ali Hamedo was killed by the strike. The hospital has been unable to function since.
Doctor “Abdullah” (his real name has been withheld for security reasons) from Hreitan said: “Not even underground hospitals are safe. We moved the hospital underground a year ago assuming that it will be protected from the airstrikes. But the missiles were able to penetrate the underground levels. We have spent hundreds of thousands of dollars to equip the hospital and provide treatment to the injured and sick but now Hreitan has no more hospitals.”
A family from Hreitan who fled the attacks on 6 February told Amnesty International that they were the last ones to leave. The father said, “I have lived in Hreitan all my life and I have never seen it deserted. Very few families remained because they can’t leave the city. The airstrikes destroyed the city’s infrastructure including hospitals so there are no more services for us to be able to survive.”
According to the Russian Ministry of Defence, Russian warplanes carried out strikes on “terrorists’ objects” in Aleppo between 4 and 11 February but denied targeting civilians. The Russian authorities continue to deny killing any civilians or damaging any civilian infrastructure in Syria, despite strong evidence indicating many hundreds of such deaths and multiple attacks on civilian buildings. On 11 February, the Russian Ministry of Defence accused the US-led coalition of being responsible for the attacks on the northern part of Aleppo Countryside, an accusation denied by the USA. According to the US Central Command (CENTCOM), the US-led coalition carried out strikes on the armed group calling itself Islamic State in Mar’a in the northern part of Aleppo Countryside between 1 and 4 February.

집회는 1부 ‘백남기 농민 쾌유기원, 살인진압 공안탄압 규탄, 노동개악 저지’ 민중총궐기 대회와 2부 ‘백남기 농민 쾌유기원 민주회복 민생살리기 범국민대회’로 나뉘어 진행됐다.

최종진 민주노총 수석부위원장은 “박근혜 정부가 쉬운 해고와 평생 비정규직, 임금 삭감을 내용으로하는 노동개악을 막가파식으로 밀어붙이려하고 있다”고 비판했고, 이준식 한국사교과서 국정화저지네트워크 정책위원장은 “친일과 독재 미화에 복면을 씌우려 한다”며 역사교과서 국정화에 반대의 목소리를 드높였다.

이밖에 박주민 민변 변호사는 “국민은 정권을 쉽게 비판할 수 있어야 하고, 숨 죽이고 있는 것이 아니라 계속해서 이래라 저래라 말 할 수 있어야 한다”며 민주주의 퇴행을 꼬집었다.

유경근 세월호 참사 가족 대책협의회 집행위원장도 “대한민국은 세월호 그 자체”라며 “대한민국의 선장은 승객인 국민들의 생명과 생존권을 무시하고 있다”고 비판했다.

당초 우려와는 달리 경찰은 차벽을 설치하지 않았고 민중총궐기 대회와 행진은 평화롭게 마무리됐다. 하지만 행진 과정에서 경찰이 도로 2차선만 허용해 3.4킬로미터를 행진하는 데 3시간 넘게 걸렸다. 대학로까지 행진을 마친 시민들은 서울대병원 입구에서 백남기 농민의 쾌유를 기원하는 촛불문화제로 집회를 마무리했다.

촛불 문화제에서 백남기씨의 딸 백민주화씨는 “제 나이가 서른인데 저보다 훨씬 어린 친구들도 이 자리에 많이 나와 있는 것 같다”며 “우리 나라의 희망을 보는 것 같고 저희 아버지가 이 목소리를 듣고 자리에서 일어나실 것만 같다”며 감사의 말을 전하기도 했다.

2월 4일 런던 시리아 공여국 회의 개최를 앞둔 가운데, 턱없이 부족한 국제적 지원과 레바논 정부의 차별 정책으로 인해 레바논의 난민 여성에 대한 착취와 인권침해를 더욱 부추기는 환경이 조성되고 있다고 국제앰네스티가 보고서를 통해 밝혔다.

보고서 <‘안전한 곳을 원해요’: 레바논에서 소외되고 보호받지 못하는 시리아 난민 여성(영문)>은 레바논 정부가 난민들의 체류 기간 연장을 거부하고, 국제적 재정 지원도 한계에 달하면서 불안정한 상황에 놓인 난민 여성들이 집주인과 고용주, 심지어 경찰과 같은 권력자들에 의해 착취당할 위험에 빠졌다고 지적하고 있다.

2015년부터 레바논은 유엔난민기구(UNHCR)를 통한 더 이상의 시리아 난민 수용을 중단하고, 난민들이 체류 기간을 연장하기 더욱 어려워지는 신규 규정을 도입했다. 합법적인 체류가 아닐 경우 임의 체포, 구금, 강제 송환까지 당할 수 있어 많은 난민이 인권침해 사실을 경찰에 신고하지 못하고 있다.

레바논에 거주하는 시리아 난민 가정 중 20%는 여성이 세대주다. 시리아에서 남편이 살해, 구금, 강제 실종, 또는 납치된 뒤로 여성이 가족의 생계를 책임지게 된 경우도 있다.

램지 조사관은 “레바논의 시리아 난민 대부분이 주로 절박한 상황에서 살아가고자 분투하고 있다. 식량이나 집, 일자리를 구하는 데도 만연한 차별과 큰 역경에 마주하게 된다. 이러한 상황에서 여성 난민들의 삶은 이보다 더 힘겨운 경우가 많은데, 특히 가족의 생계를 책임져야 하는 여성들은 직장과 거리에서 괴롭힘과 착취, 인권침해의 대상이 될 위험이 매우 크기 때문”이라고 말했다.

가난과 고용주, 집주인의 착취

시리아 난민 가정 약 70%가 레바논의 빈곤선에 한참 미치지 못하는 생활을 하고 있다. 시리아 난민 사태에 대한 유엔의 인도주의적 지원은 만성적인 재정 부족에 시달리고 있다. 지난해 유엔이 받은 국제 지원금은 레바논에서의 활동을 위해 필요하다고 요청한 액수의 57%에 불과했다. 이처럼 심각한 재정 부족으로 세계식량계획 역시 가장 취약한 난민들에게 제공하던 월간 식비를 2015년 중반부터 미화 30달러에서 13.5달러로 삭감해야 했다. 2015년 말 자금 투입으로 21.60달러로 인상되긴 했으나 하루 0.72달러에 불과한 금액이다. 국제앰네스티가 인터뷰를 나눈 여성 4명 중 1명은 지난해부터 식비를 받지 못했다.

많은 난민 여성들이 레바논의 높은 물가와 식비, 집세를 감당하기 어렵다고 했다. 이 때문에 난민 여성들은 착취의 대상이 될 위험에 노출되기 쉽다. 남성들이 부적절하게 성적인 접근을 하거나, 재정적 및 기타 지원을 대가로 성관계를 요구하는 경우도 있다고 한다.

난민 차별이 만연한 레바논에서 간신히 일자리를 구해 생계를 이어갈 수 있게 되더라도 난민 여성들은 고용주로부터 극도로 낮은 급료를 받으며 착취를 당하고 있다고 전했다. 시리아의 팔레스타인 난민 ‘하난(가명)’은 “고용주들은 우리가 절박한 상황에서 아무리 낮은 급료를 준다고 해도 받아들일 수밖에 없다는 걸 알고 있다”고 했다.

시리아에서 온 팔레스타인 난민인 56세 ‘아스마’는 베이루트 남부 교외에 있는 난민캠프 샤틸라에 거주하고 있다. 그녀는 딸들이 성추행을 당할까 걱정되어 직장에 다니는 것을 허락하지 않았다고 한다. “딸이 한 상점에서 일했었는데, 점장이 추행하고 만지기 일쑤였어요. 그래서 지금은 딸들에게 일하지 말라고 했습니다.”

고용주의 행동이 부적절하다고 느껴 직장을 그만두거나 일을 시작하지 않았다고 밝힌 여성들도 다수였다.

집세를 지불할 만큼 충분한 돈을 구하는 것도 상당히 힘든 일이다. 시리아 난민 최소 58% 이상이 임대아파트나 임대주택에 거주하고, 나머지는 다 허물어져 가는 건물이나 비공식 정착지에서 살아가고 있다. 그러나 많은 여성들이 지나치게 비싼 집세를 감당하지 못하고 결국 누추한 건물에서 살게 되었다고 말했다.

램지 조사관은 “적은 급료를 받고 일을 하거나, 불결하고 쥐가 들끓으며 물이 새는 집에서 사는 등, 재정적 불안정으로 인해 난민 여성들은 엄청난 어려움에 처하고, 권력자의 위치에 있는 사람들은 이들을 쉽게 이용할 수 있다”고 말했다.

합법적 지위 상실로 위험 더욱 커져

레바논 정부는 2015년 1월부터 번거로운 관료제적 절차와 비싼 비용을 부과해 난민들이 체류 기간을 연장하기 어렵게 하는 정책을 시행하고 있다. 합법적인 체류 허가가 없는 시리아 난민들은 체포될 것을 우려해 인권침해 사실을 경찰에 신고하지 못하는 경우가 많다.

국제앰네스티와 인터뷰를 나눈 난민 여성 대다수가 체류 허가가 없기 때문에 레바논 정부에 범죄를 신고하지 못한다고 밝혔다. 베이루트 인근의 난민캠프에서 딸 3명과 함께 사는 시리아의 팔레스타인 난민 ‘하난’은 버스 기사에게 성추행을 당했다고 경찰에 신고했지만, 거절을 당했다고 했다. ‘법적 지위’가 없으므로 신고할 자격이 없다는 것이다.

램지 조사관은 “인터뷰를 나눈 여성들이 체류 허가가 없다는 이유로 도움이나 보호를 요청할 곳이 아무 데도 없다는 사실 때문에 이들에 대한 괴롭힘과 착취가 더욱 심각해졌다는 것은 매우 명백하다”고 말했다.

또 다른 시리아 여성은 경찰에 알린 이후로 괴롭힘의 대상이 됐다고 밝혔다.

“한동안 경찰들이 우리 집 앞을 지나가거나 우리를 불러내면서 데이트를 하자고 말하곤 했어요. 우리 신고를 받았던 경찰관 3명과 같은 사람들이었죠. 합법적인 [체류] 허가가 없다는 이유로 우리를 위협했어요. 데이트해 주지 않으면 감옥에 보내겠다는 말도 했어요.”

레바논은 인구 1인당 수용하고 있는 난민 수가 세계에서 가장 많은 국가이며 국제사회가 충분한 지원을 하지 못하고 있는 것은 사실이지만, 이 때문에 난민을 착취와 인권침해로부터 보호하지 않는 것이 정당화될 수는 없다.

램지 조사관은 “몰려드는 난민으로 인한 레바논의 부담이 상당하긴 하지만, 이것이 정부가 엄격한 제한을 부과하고 난민을 위험으로 몰아넣을 정당한 이유라고 할 수는 없다”며 “레바논 정부는 공포와 위협이 만연한 분위기를 조성하기보다, 난민 여성들이 보호받을 수 있도록 보장하고, 레바논의 모든 난민이 제재 없이 쉽게 체류 기간을 연장할 수 있도록 시급히 정책을 수정해야 한다”고 말했다.

국제적 지원이 반드시 필요

레바논 난민에 대한 국제적인 재정 지원 부족은 난민 여성들을 가난과 불안정한 위치에 놓이게 하고, 이 때문에 더욱 큰 위험에 노출되게 만드는 직접적인 요인이다.

유엔난민기구는 각국에 수용된 시리아 난민 중 45만 명에 해당하는 최소 10%가 취약한 상태로, 다른 지역의 국가로 재정착해야 할 필요성이 시급하다고 파악했으며, 특히 여성들은 ‘가장 취약한’ 난민의 기준에 포함될 위험이 있다고 보고 있다.

국제앰네스티는 국제사회에 재정착지를 확충하고, 시리아 난민들에게 안전한 출국 경로를 제공할 것을 촉구한다.

더불어 재정 지원을 확대하고, 이번 주 개막하는 공여국 회의를 통해 유엔이 2016-2017년 시리아 위기를 지원하기 위해 요청한 기금을 채울 것을 약속해야 할 것이다.

캐트린 램지 조사관은 “유럽연합과 영국, 걸프 지역 국가와 미국 등 세계적인 부유국으로 꼽히는 국가들은 특히 다른 어느 국가보다도 난민 위기 해소를 위해 더 많은 역할을 해야 한다. 시리아와 난민들에 대한 인도적 지원을 확대함은 물론, 더욱 많은 난민을 재정착시킴으로써 난민 위기의 책임을 공유해야 할 것”이라며 “또한 레바논과 같은 난민 수용국과 공조해 난민이 합법적으로 체류 허가를 받고 필수 서비스를 받을 수 있도록 장벽을 제거해야 하며, 위험에 처한 여성을 포함해 모든 난민이 인권침해 대상이 되지 않도록 도와야 한다”고 말했다.

Syrian refugee women in Lebanon face heightened risk of exploitation and sexual harassment

Shortfalls in international assistance and discriminatory policies imposed by the Lebanese authorities are creating conditions that facilitate the exploitation and abuse of women refugees in Lebanon, said Amnesty International in a new report published ahead of the Syria Donors Conference in London on February 4.

The report, ‘I Want a Safe Place’: Refugee Women from Syria Uprooted and Unprotected in Lebanon, highlights how the Lebanese government’s refusal to renew residency permits for refugees and a shortage of international funding, leaves refugee women in a precarious position, and puts them at risk of exploitation by people in positions of power including landlords, employers and even the police.

“The combination of a significant shortage in international funding for the refugee crisis and strict restrictions imposed on refugees by the Lebanese authorities, is fuelling a climate in which refugee women from Syria are at risk of harassment and exploitation and are unable to seek protection from the authorities,” said Kathryn Ramsay, Gender Researcher at Amnesty International.

In 2015, Lebanon stopped the UN Refugee Agency (UNHCR) from registering any more Syrian refugees and introduced new regulations making it difficult for refugees to renew their residency status. Without proper legal status they face arbitrary arrest, detention and even deportation leaving many afraid to report abuse to police.

Twenty percent of Syrian refugee households in Lebanon are headed by women. In some cases women became the main income providers supporting the family after their husbands were killed, detained, forcibly disappeared or abducted in Syria.

“The majority of refugees from Syria in Lebanon – are struggling to survive in often desperate conditions. They face widespread discrimination and major obstacles in obtaining food, housing or a job. For women refugees surviving in such circumstances can often be even more difficult, with many – particularly women who are the heads of their households – at increased risk of harassment, exploitation and abuse at work and in the streets,” said Kathryn Ramsay.

Poverty, exploitation by employers and landlords

Around 70 percent of Syrian refugee families are living significantly below the Lebanese poverty line. The UN humanitarian response to the Syria refugee crisis has consistently been underfunded. Last year the UN only received 57 percent of the funds it requested for its work in Lebanon. The severe shortage of funds forced the World Food Program to reduce the monthly food allowance provided to the most vulnerable refugees from $30 to $13.50 in mid-2015. After an injection of funding in late 2015, it was increased to $21.60- just $0.72 a day. A quarter of the women Amnesty International spoke to had stopped receiving payments for food over the last year.

Many refugee women said they struggle to meet the high cost of living in Lebanon and to afford food or rent which has exposed them to greater risk of exploitation. Some said that they received inappropriate sexual advances from men or offers of financial or other assistance in exchange for sex.

In a climate of widespread discrimination against refugees in Lebanon, refugee women who managed to find jobs to support themselves reported being exploited by employers who paid excessively low wages.

“They know we will agree to whatever low wage they offer because we are in need,” said “Hanan” a Palestinian refugee from Syria whose name has been changed to protect her identity.

“Asmaa,” a 56-year-old Palestinian refugee from Syria living in Shatila, a refugee camp in Beirut southern suburbs said she did not permit her daughters to work for fear they would face harassment: “My daughter worked in a store. The manager harassed her and touched her. That is why I don’t let my daughters work now.”

Several women also said they had left a job or not taken a job because they felt the employers’ behavior had been inappropriate.

Finding enough money to pay for accommodation is another significant challenge. At least 58 percent of Syrian refugees live in rented apartments or houses, others live in dilapidated buildings and informal settlements. Yet many women said they were unable to afford the exorbitant rents and found themselves in squalid accommodation.

“Whether they are underpaid at work or living in dirty, rat-infested, leaking homes, the lack of financial stability causes immense difficulties for women refugees and encourages people in positions of power to take advantage of them,” said Ramsay.

Lack of legal status increases risks

Burdensome bureaucratic procedures and high costs for refugees to renew their residence permits, introduced by the Lebanese government in January 2015, have prevented many refugees from being able to renew their residency permits. Without a valid residence permit, refugees from Syria often fear arrest and fail to report abuse to the police.

The majority of refugee women who spoke to Amnesty International said the lack of a residence permit stopped them from reporting a crime to the Lebanese authorities. “Hanan,” a Palestinian refugee from Syria who lives in a refugee camp near Beirut with her three daughters, said she went to the police to complain when a bus driver harassed her and was turned away. They told her she was not eligible to present a complaint because she lacked “legal status.”

“It was very clear to the women we spoke to that the harassment and exploitation they face is made even worse by the fact they have nowhere to turn to for help and protection because they lack valid residence permits,” said Ramsay.

Another Syrian woman told Amnesty International said she became a target for harassment after going to the police: “After a while the police would pass by our house or would call us and ask us to go out with them. It was the same three police officers who took our report. Because we don’t have legal [residence] permits, the officers threatened us. They said that they would imprison us, if we didn’t go out with them.”

Lebanon has more refugees per capita than any other country in the world and the international community has failed to support the country, however this is no justification for not offering protection to refugees from exploitation and abuse.

“The influx of refugees has placed a considerable strain on Lebanon, but this is no excuse for the stringent restrictions the authorities have imposed on refugees which are putting them in danger,” said Ramsay. “Instead of contributing to the climate of fear and intimidation the Lebanese authorities must urgently amend their policies to ensure women refugees are protected, and that all refugees in Lebanon are able to easily renew their residence permits without restrictions.”

International support crucial

The lack of international funding and support for refugees in Lebanon is a direct factor contributing to the poverty and precarious circumstances of refugee women which has exposed them to greater risks.

UNHCR has identified at least 10 percent of the Syria refugee population in host countries, the equivalent of 450,000, as vulnerable and in urgent need of resettlement in another country outside the region. UNHCR considers women and girls at risk as among those who meet the criteria of “most vulnerable” refugees.

Amnesty International is calling on the international community to increase the number of resettlement places and other safe routes out of the region offered to refugees from Syria.

In addition, they must boost financial assistance and use this week’s donor conference to pledge to fulfil the UN’s funding requirements for assistance for the Syria crisis for 2016-2017.

“The world’s wealthiest countries, from the EU including the UK, Gulf states and the USA, among others all need to do much more to alleviate this crisis. As well as boosting humanitarian support to those in Syria and refugees in the region they must also offer to share responsibility for the crisis by resettling more refugees,” said Ramsay.

“They must also work with host countries such as Lebanon to remove barriers to legal registration for refugees and access to vital services and help ensure all refugees, including women at risk do not face abuse.”
