5일 대만에서 6명의 사형이 집행된 것은 정의실현과는 관계없는 퇴보적인 결정이라고 국제앰네스티가 밝혔다. 5일 저녁 대만의 4개 교도소에서 남성 6명이 총살형에 처해졌다. 모두 살인으로 사형을 선고받은 사람들이었다.

이들에 대한 사형집행은 지난주 타이페이에서 8세 소녀가 끔찍하게 살해된 사건으로 대중의 분노가 극에 달한 가운데 이루어진 것이었다.

윌리엄 니(William Nee) 국제앰네스티 조사관은 “죄 없는 여학생에게 벌어진 끔찍한 살인 사건에 분노하는 것은 매우 당연한 일이며 이처럼 극악무도한 범죄를 저지른 범인은 반드시 마땅한 처벌을 받아야 하지만, 사형이 그 답이 될 순 없다”며 “사형을 집행하기로 결정한 것은 분노한 대중을 달램으로써 좋은 점수를 얻으려는 정부의 정치적 계산이 엿보인다. 정부는 이날의 결정으로 정치적 리더십의 부재를 증명했다”고 말했다.

총살형에 처해진 6명의 남성은 타이페이 교도소의 청친언, 왕슈팡, 차오 티엔서우와 타이난 교도소의 왕춘친, 가오슝 교도소의 왕유렁, 타이중 교도소의 황추왕 등이다.

대만에서의 사형집행은 모두 비밀리에 진행되고 있으며, 사형수의 가족과 변호인들에게 사전에 고지하는 경우는 거의 없다.

지난 2014년, 대만은 5명에 대해 사형을 집행하고 1명에 대해 새로 사형을 선고했으며, 모두 살인으로 유죄가 선고된 사람들이었다.

대만은 2014년 사형을 집행한 단 22개국 중 하나로, 41개국이었던 20년 전 기록과 비교되는 수치다. 현재 총 140개국이 법적 또는 실질적 사형폐지국이다.

윌리엄 니 조사관은 “이번 사형집행 결정은 사형폐지를 장기적인 목표로 본다던 대만 정부의 발표와 완전히 상반되는 조치다. 정부는 정치적 도구로 사형집행을 이용하는 것을 중단하고, 사형폐지를 위한 첫걸음으로써 공식적으로 사형집행 유예를 선포해야 한다” 고 말했다.

사형이 다른 처벌에 비해 더욱 효과적이라는 설득력 있는 증거는 존재하지 않는다. 사형과 살인 발생률간의 상관관계에 대해 유엔이 포괄적인 연구를 진행한 결과, 사형이 종신형에 비해 범죄 억지력이 더욱 강하다는 과학적인 증거는 찾을 수 없었다.

국제앰네스티는 범죄의 성질 또는 정황, 개인의 유, 무죄 여부와 그 외 특성, 국가의 사형집행 방법에 관계없이 모든 경우에 대해 사형에 반대한다. 사형은 세계인권선언에 명시된 생명권을 침해하는 것이며, 극도로 잔인하고 비인도적이며 굴욕적인 처벌이다.

Taiwan: Six executed in politically motivated decision

The execution of six people in Taiwan today is a regressive decision that does not deliver justice, Amnesty International said.

The six men were executed by firing squad at four different prisons in Taiwan earlier this evening. All had been convicted of murder.

The executions were carried out amidst public outrage following the abhorrent murder of an eight year old girl in Taipei last week.

“The public outrage at the horrific murder of an innocent schoolgirl is totally understandable and the perpetrators of such heinous crimes must face justice, but the death penalty is never the answer,” said William Nee, researcher at Amnesty International.

“The decision to carry out the executions reeks of political calculations by a government attempting to gain points by quelling public anger. The government has today demonstrated a failure of political leadership.”

The six men executed by firing squad were: Cheng Chin-wen, Wang Hsiu-fang, and Tsao Tien-shou at a prison in Taipei; Wang Chun-chin at a prison in Tainan; Wang Yu-lung at a prison in Kaohsiung; and Huang Chu-wang in Taichung.

Executions in Taiwan are shrouded in secrecy, with the families and lawyers of those executed rarely informed in advance.

In 2014, Taiwan carried out five executions and imposed one new death sentence, all involving people convicted of murder.

Taiwan was one of only 22 countries to carry out executions in 2014, compared to 41 countries 20 years ago. A total of 140 states have now abolished the death penalty in law or practice.

“The executions fly in the face of the government’s stated long term goal to abolish the death penalty. The government must cease using executions as a political tool and should establish an official moratorium on executions as a first step towards abolition.”

There is no convincing evidence that the death penalty prevents crime more effectively than other punishments. A comprehensive study carried out by the United Nations on the relationship between the death penalty and homicide rates concluded that research has failed to provide scientific proof that executions have a greater deterrent effect than life imprisonment.

Amnesty International opposes the death penalty in all cases without exception, regardless of the nature or circumstances of the crime; guilt, innocence or other characteristics of the individual; or the method used by the state to carry out the execution. The death penalty violates the right to life as proclaimed in the Universal Declaration of Human Rights. It is the ultimate cruel, inhuman and degrading punishment.

두 사람은 11일 오후 경찰로부터 문제가 된 기사에 대해 심문을 받고 인세인 교도소로 이송됐다. 이 기사는 지난 주 탄 흐투트 아웅의 페이스북 페이지에 게시된 후 아시아 각지의 다양한 뉴스매체를 통해 발표되었다.

두 사람은 미얀마 정보통신법에 따라 조사를 받고 있으며, 최대 징역 2년형까지 선고될 수 있다. 이들의 다음 재판일은 11월 25일로 예정되어 있다.

2015년 한 해 동안 세계적으로 사형집행 건수가 급격히 증가하며 25년만에 가장 많은 사형수가 처형되었다. 국제앰네스티가 세계 사형제도 현황 보고서를 통해 밝힌 바에 따르면, 급증의 원인은 주로 이란, 파키스탄, 사우디아라비아가 일조했다.

2015년 처형된 사형수는 최소 1,634명으로, 작년 대비 50% 이상 증가했으며 국제앰네스티가 1989년부터 기록한 이래 가장 많은 수이다. 이 통계는 중국의 사형집행이 포함되지 않은 것으로, 사형 관련 통계를 기밀로 취급하는 중국에서는 수천 명 이상이 처형됐을 것으로 추정된다.

살릴 셰티(Salil Shetty) 국제앰네스티 사무총장은 “지난해 사형집행 증가 추세는 매우 충격적이다. 세계적으로 지난 25년간 이렇게 많은 사형수가 처형된 것은 처음이다. 2015년에도 정부는 사형제도가 사람들을 안전하게 할 것이라는 잘못된 전제로 가차없이 생명을 앗아갔다”고 말했다.

“이란, 파키스탄, 사우디아라비아는 전례 없는 수준으로 사형을 집행했으며, 매우 불공정한 재판으로 처형된 경우도 많았다. 이러한 살육은 중단돼야만 한다”며 “다행히도 사형존치국은 작으며, 점차 고립된 소수집단이 되고있다. 다수의 국가들이 사형에 등을 돌렸고 2015년 한 해에만 4개국이 이처럼 야만적인 처벌을 법적으로 완전히 폐지하는 데 합류했다”고 덧붙였다.

이란, 파키스탄, 사우디아라비아의 일조로 사형집행 급증

세계적으로 사형집행이 증가하는 데 주로 일조한 3개 국가가 있는데, 이는 2015년 총 사형집행 건수(중국 제외)의 89%를 차지한다.

파키스탄은 2014년 12월 민간인에 대한 사형집행 유예를 해제한 이후 사형집행을 계속해서 남발하고 있다. 2015년에 320명 이상이 교수대로 보내졌는데, 이는 국제앰네스티가 파키스탄을 기록한 이래 가장 많은 숫자다.

이란은 지난해 최소 743명을 처형한 데 이어 2015년 최소 977명의 사형을 집행했으며, 압도적인 대부분의 경우는 마약 관련 범죄로 사형이 선고됐다. 이란은 세계에서 마지막 남은 청소년 범죄자 사형집행국 중 하나이기도 한데, 이는 명백한 국제법 위반이다. 이 나라는 2015년, 유죄를 선고받을 당시 18세 이하였던 4명에게도 사형을 집행했다.

사우디아라비아는 작년에 2014년 수치 대비 76% 증가한 최소 158명을 처형했다. 대부분 참수형을 당했지만, 사형수를 총살하거나 시신을 공공장소에 전시하기도 했다.

이집트소말리아 등의 국가에서도 사형집행이 눈에 띄게 증가했다.

사형을 집행한 국가의 수도 2014년 22개국에서 2015년 25개국으로 증가했다. 2014년 단 한 건의 사형집행도 하지 않았으나 2015년 재개한 국가는 최소 6개국으로, 이 중 차드의 경우는 10여년만에 처음으로 사형을 집행했다.

2015년에 사형을 가장 많이 집행한 5개 국가는 중국, 이란, 파키스탄, 사우디아라비아, 미국 순이었다.

중국, 이란, 사우디아라비아 등 다수의 국가에서는 여전히 마약 밀매, 부정부패, “간통”, “신성모독” 등 국제법상 사형을 제한하고 있는 기준인 “매우 중대한” 범죄에 부합하지도 않는 범죄로 사형집행을 계속했다.

극과 극이 공존한 2015년

이러한 걸림돌에도 불구하고 2015년 세계는 사형폐지의 길로 계속해서 나아갔다. 지난해 이룩한 성과를 통해 희망을 얻었고, 이제 사형을 고수하는 국가는 고립된 소수가 되었음을 보여줬다.

2015년 피지, 마다가스카르, 콩고, 수리남 4개국이 법적으로 사형을 완전히 폐지했다. 몽골에서도 사형을 폐지한 신규 형법안이 통과돼 2016년 말에 발효될 예정이다.

이로써 법적 사형폐지국은 102개국으로, 처음으로 세계의 과반을 차지하게 되었다. 현재 세계 140개국이 법적 또는 실질적 사형폐지국이다.

살릴 셰티 사무총장은 “2015년은 극과 극이 공존하는 한 해였다. 매우 우려되는 추세가 나타나기도 했던 반면 희망적인 진전을 이룩하기도 했다. 4개 국가가 추가로 완전히 사형을 폐지하며, 이처럼 참혹한 형벌을 철폐한 국가가 세계의 다수를 차지하게 되었다”며 “단기적인 퇴보가 나타나긴 했지만 장기적인 추세는 여전히 명백하다. 세계는 사형제도로부터 멀어지고 있다. 사형집행을 계속하는 국가들은 역사의 잘못된 쪽에 있음을 인정하고, 극도로 잔인하고 비인도적인 형벌인 사형을 폐지해야 한다”고 말했다.

지역별 현황

미주 지역

미주 지역에서는 사형 집행 중단을 향한 진전을 이어갔다. 7년 연속으로 미국이 사형을 집행한 유일한 국가이다. 미국은 28건을 집행했는데, 이는 1991년 이후 가장 낮은 수치이다. 52건의 사형 선고는 1977년 이후 가장 적은 수치이다. 펜실베니아주는 사형집행 유예를 선포했고, 총 18개주가 사형을 완전 폐지했다.

트리니다드토바고는 미국을 제외하고 미주 지역에서 유일하게 사형을 선고했다.

아시아태평양 지역

2015년 아시아태평양 지역의 사형집행 건수가 급격히 증가한 것은 파키스탄이 주된 원인인데, 국제앰네스티의 조사에 따르면 파키스탄은 이 지역의 총 사형집행 건수 중 약 90%를 차지했다.(중국 제외) 방글라데시, 인도, 인도네시아는 사형집행을 재개했다. 인도네시아에서는 한 해 동안 마약 관련 범죄로만 14명이 처형됐다.

중국은 여전히 세계에서 가장 많이 사형을 집행했다. 국제앰네스티는 중국에서 2015년 수천여 명이 처형되고, 수천여 명에게 사형이 선고됐을 것으로 추정하고 있다. 최근 수 년간 중국의 사형집행 건수가 감소한 조짐이 나타기는 했지만, 사형 관련 정보가 기밀로 유지되고 있어 이를 정확히 확인하는 것은 불가능했다.

유럽, 중앙아시아 지역

벨라루스는 이 지역에서 유일하게 사형을 적용한 국가였다. 2015년 사형을 집행하지는 않았지만, 최소 2건 이상의 사형을 선고했다.

중동, 북아프리카 지역

2015년 이 지역에서 사형제도 사용이 급증한 것은 이미 심각하게 우려할 만한 이유가 된다. 오만과 이스라엘을 제외한 이 지역의 모든 국가가 사형을 선고했고, 8개국이 사형을 집행했다. 2014년 기록보다 26% 증가한 1,196명 이상이 처형됐는데, 주로 이란과 사우디아라비아에서의 사형 집행 급증이 증가 원인이었다. 이 지역에서 기록된 총 사형집행 건수 중 82%가 이란에서 이루어졌다.

사하라 이남 아프리카 지역

사하라 이남 아프리카 지역에서는 긍정적, 부정적인 양상이 동시에 나타났다. 마다가스카르와 콩고가 사형을 완전히 폐지했고, 사형을 선고한 숫자는 주로 나이지리아에서 급감한 덕분에 2014년 909건에서 2015년 443건으로 크게 감소했다.

사형집행 건수 역시 2014년 46건에서 43건으로 소폭 감소했다. 그러나 차드의 경우 8월, 무장단체 보코하람 소속으로 추정되는 용의자 10명을 총살하면서 12년만에 처음으로 사형집행을 재개했다.

국제앰네스티는 범죄의 성질이나 정황, 개인의 유죄 여부 또는 기타 성격, 사형집행 방식에 관계없이 모든 경우에 대해 사형을 반대한다. 사형이 다른 형벌에 비해 더 효과적으로 범죄를 억지한다는 증거는 없다.

투르크메니스탄에서 2017년 개최되는 실내 무술 아시안게임을 앞두고 수도 아슈하바트의 미관 개선 사업의 일환으로 약 5만 명 이상이 강제 퇴거됐다고 국제앰네스티가 28일 밝혔다. 국제앰네스티는 강제퇴거로 인한 파괴 규모를 나타내는 위성사진을 함께 공개했다.

국제앰네스티의 위성사진 분석 결과, 2015년 3월부터 4월 사이 아슈하바트 인근 초건리 마을에서 1가구당 평균 5인이 거주하던 주택 5,000가구가 파괴되었다. 이후 9월이 되자 1만 채 이상의 주택이 있었던 이 마을은 완전히 폐허가 되었고, 지금까지도 수도 곳곳에서 철거가 계속되며 수많은 주민들이 집을 잃게 된 것으로 밝혀졌다.

데니스 크리보셰프(Denis Krivosheev) 국제앰네스티 유럽중앙아시아 부국장은 “아시안게임 개최를 계기로 투르크메니스탄의 인권상황을 개선할 수 있는 기회를 얻었음에도, 정부는 교외에서 일자리를 찾아왔거나 이미 다른 곳에서 강제 퇴거된 사람들이 대부분인 이 지역 주민들의 생활 환경을 더욱 악화시키고 있을 뿐”이라며 “정부의 무자비한 퇴거 방식은 명백한 국제인권기준 위반이다. 투르크메니스탄 정부는 즉시 강제퇴거와 불법 철거를 중단하고, 피해 주민들에게 적절한 보상과 대체 주거지를 시급히 제공해야 한다. 특히 겨울이 다가오고 있는 지금이 가장 취약한 때”라고 말했다.

국제앰네스티가 분석한 위성사진은 세계에서 가장 어둠 속에 감춰져 있는 사회의 단면을 엿볼 수 있는 희귀한 자료다. 구르반굴리 베르디무하메도프 투르크메니스탄 대통령은 독재자였던 전임 대통령과 마찬가지로 공포 정치를 통해 국민의 숨통을 조이며 실권을 유지하고 있다. 감시가 만연하고 정부에 반대하는 의견을 거의 찾아볼 수 없는 투르크메니스탄에서는 자신과 주변인들의 안위를 위협하면서까지 감히 목소리를 내려는 사람은 거의 없다.

국제앰네스티를 비롯한 인권감시단체는 투르크메니스탄으로의 입국이 금지된 상태다. 그러나 조사관들의 노력으로 전화 인터뷰 및 신뢰성 있는 소식통을 통한 증언과 철거 현장이 담긴 위성 사진 등을 수집할 수 있었다. 퇴거당한 초건리 주민들은 당시 정부와 경찰이 “탱크처럼 들이닥쳐” 마을 사람들을 강제로 퇴거시켰다고 말했다.

한 마을 주민은 “이제 사람들은 그곳에 가서 오열만 할 뿐”이라며, 마을 사람들의 주택 허가는 무참히 무시당했고, 불도저로 밀린 옛 집 터로 돌아가 슬퍼하는 사람들도 있었다고 전했다. 이 주민은 철거 당시 정부 관계자들이 집에 들이닥쳐 가족들과 함께 당황한 아이들까지 모두 쫓아내던 모습이 아수라장과 다름 없었다고도 증언했다.

베르디무하네도프 대통령은 아시아 올림픽위원회에서 주관하는 이번 실내무술 아시안게임 개최를 앞두고 수도 아슈가바트를 현대화하기 위한 개발 계획 진행을 직접 감독하고 있다. 초건리와 쇼르 구역에 이어서 9월 아슈가바트의 다른 지역에서도 주택 철거가 이루어지는 등 강제퇴거는 조금도 변함없이 계속되고 있다.

베르디무하네도프 정권은 투르크메니스탄에 매장된 다량의 석유와 가스로 힘을 얻고 있으며, 이번 아시안게임 개최는 투르크메니스탄의 국제적인 입지를 더욱 개선시킬 기회로 여겨지고 있다. 국제앰네스티는 해외 각국 정부와 기업에 대해, 투르크메니스탄과의 모든 정치적 또는 경제적 협력사업이 전반적인 인권침해행위에 일조하지 않도록 할 것을 촉구한다.

데니스 크리보셰프 부국장은 “안타깝게도 투르크메니스탄에서 박해와 억압은 일상과도 같은 것이다. 국제사회와 기업체는 베르디무하메도프 대통령이 자국에서 자행하는 인권침해행위를 중단하라고 압박하기 위해 가능한 모든 조치를 취해야 할 것”이라며 “강제퇴거는 어떤 경우에도 정당화될 수 없다. 모든 퇴거는 언제나 최후의 수단으로, 국제인권기준에 따라서만 이루어져야 한다. 이러한 인권기준에는 주거권을 보호할 것과 적절한 법적 및 절차적 안전 조치에 따를 것, 이러한 퇴거 명령에 공포와 박해 없이 반대할 수 있는 권리를 보장할 것 등이 포함된다”고 말했다.

Turkmenistan: Satellite images reveal how mass forced evictions blight upcoming Asian Games

An estimated 50,000 or more people have been forcibly evicted from their homes as part of a push to “beautify” the capital of Turkmenistan ahead of the 2017 Asian Indoor and Martial Arts Games, Amnesty International revealed today as it published satellite images showing the extent of the devastation.

Amnesty International’s analysis of satellite images shows that 5,000 houses, each home to an average of five people, were destroyed in the Choganly neighbourhood near Ashgabat between March 2014 and April 2015. The organization has since learned that the entire neighbourhood – comprising more than 10,000 houses – was entirely razed to the ground by September and that fresh demolitions are continuing in other areas of the capital rendering many families homeless.

“Instead of using the Games as an opportunity to clean up Turkmenistan’s human rights record, local authorities there have only succeeded in worsening living conditions for residents, many of whom had moved to Ashgabat from the countryside in search of work or had already been evicted elsewhere,” said Denis Krivosheev, Amnesty International’s Deputy Programme Director for Europe and Central Asia.

“The ruthless way in which they have been evicted is in clear violation of international human rights standards. Turkmenistan’s government must immediately put an end to forced evictions and illegal demolitions, compensate the victims and give them access to adequate alternative housing urgently. They are especially vulnerable as winter approaches.”

Amnesty International analyzed satellite images that provide a rare glimpse into one of the world’s most darkly shrouded societies. President Gurbanguly Berdymukhamedov, like his autocratic predecessor, is at the helm of a government that maintains a stranglehold of fear on the population. Surveillance is rife and dissent is rare in Turkmenistan, where the few voices that do dare to speak up risk their own safety and that of their relatives.

Amnesty International and other human rights monitors are barred from the country. However, researchers corroborated details of the evictions depicted in the satellite imagery with testimony from phone interviews and other confidential sources. Former Choganly residents described how authorities, including the police, “burst in like tanks” and forcibly evicted dwellers.

“Now people go there to cry,” said one former Choganly resident, who described how their housing permits were brutally disregarded and some return to grieve on bulldozed plots where their homes once stood. She described to Amnesty International the scene of chaos her family faced when authorities charged into their house forcibly evicting the family, including distraught children.

President Berdymukhamedov has personally overseen the development projects in a bid to modernize Ashgabat ahead of the Games, organized by the Olympic Council of Asia. Following the demolitions in Choganly and the district of Shor, the forced evictions have continued unabated, with the authorities moving on in September to destroy homes in other areas of Ashgabat.

President Berdymukhamedov’s regime is bolstered by the country’s large oil and gas reserves, and the Games are regarded as an opportunity to improve its international standing. Amnesty International is calling on foreign governments and businesses to ensure that neither political nor economic cooperation with Turkmenistan contribute to human rights violations in general.

“Sadly, intimidation and repression is a daily fact of life in Turkmenistan. The international community and businesses must do everything within their power to press President Berdymukhamedov to put an end to the human rights violations perpetrated in the country,” said Denis Krivosheev.

“Forced evictions can never be justified. Any eviction must always be a last resort and in compliance with international human rights standards. This includes protecting the right to housing, ensuring compliance with appropriate legal and procedural safeguards and guaranteeing the right to oppose such evictions without fear and harassment.”

터키 안탈리아에서 13일 G20 정상회의가 개막한 가운데, 선진국들은 나날이 심각해지는 세계적인 난민 위기에 대해 충격적이리만치 방관적인 태도를 중단하고, 세계 각지에서 가장 취약한 난민 115만 명의 재정착을 위해 구체적인 계획을 마련하거나 인도적 지원 수요를 충족할 만큼 충분한 기금을 마련하는 등의 공동 대책을 수립할 수 있도록 주도적으로 나서야 한다고 밝혔다.

현재 G20 국가들은 시리아 난민 약 14만 명을 수용하겠다고 약속한 바 있으나, 재정착이 필요한 난민의 수에 비하면 턱없이 부족한 수다. 지난해 G20 국가들이 제공한 재정착지는 수요의 10분의 1에 불과한 규모였다.

오드리 고프란(Audrey Gaughran) 국제앰네스티 글로벌이슈국장은 “세계적으로 참담하리만치 엄청난 규모의 난민 위기가 벌어지고 있는 가운데 선진국들은 지금까지도 구경만 하고 있다. 심지어는 안전을 찾아 온 난민들의 입국을 막으면서 이들의 절망에 적극적으로 기여한 국가도 있다”며 “터키 안탈리아에서 열린 G20 회의로 세계 주요 선진국들이 한자리에 모인 만큼, 이 기회를 놓치지 말고 수백만 난민의 고통을 끝낼 수 있는 구체적이고 의미 있는 해법을 모색하기 위해 힘을 모아야 할 것이다. 이번 G20 회의는 다른 정상회담이 관련 논의를 피하기만 했던 것과는 달리, 과감한 행동에 나서는 발판이 됨으로써 그 영향력을 증명할 수 있는 기회”라고 말했다.

국제앰네스티는 또한 G20 국가에 심각한 지원품 부족과 인도적 지원 중단으로 고통받고 있는 난민 수백만 명을 위해 인도적 재정 지원 규모를 과감하게 확대할 것을 촉구한다. 올 11월 현재까지 시리아 난민 사태에 대한 유엔의 인도적 지원 호소로 투자된 금액은 목표액의 50%에 불과하다.

시리아 난민을 주로 수용하고 있는 국가들과 G20의 영향력 있는 선진국의 대응은 충격적일 정도로 극명한 차이를 보인다. 연간 국민총소득 445억 달러인 레바논이 현재 국민 1인당 가장 많은 수의 난민을 수용하고 있는 반면, 국민총소득 1조 9천억 달러에 이르는 러시아는 시리아 난민을 단 한 명도 받아들이지 않았다.

오드리 고프란 국장은 “지금까지 주로 난민 위기에 대한 유럽 국가들의 잘못된 대처가 주목 받아왔으나, 이번 G20 회의는 다른 G20 국가 역시 국제사회에서 주도적인 역할을 맡은 데 따르는 책임을 받아들일 준비가 되어 있음을 보여줄 기회”라며 “세계적인 난민 위기에 대해 독일과 터키가 주도적으로 대처에 나서고 있고, 최근 캐나다가 향후 2개월간 시리아 난민 25,000명을 수용하겠다고 약속한 반면, 러시아와 사우디아라비아 등은 잔혹한 분쟁과 박해를 피해 온 난민들에 대해 충격적일 정도로 연민을 보이지 않고 있다. 지금이라도 방향을 바꾸고 도덕적 예의를 지키기에 아직 늦지 않았다”고 말했다.

또 “시리아 사태는 이러한 문제점을 전형적으로 보여주는 예다. 이번 회의에 참가하는 G20 국가들은 의장국인 터키가 현재 200만 명 이상으로 세계에서 가장 많은 난민을 수용하고 있는 국가임을 무시할 수 없을 것이다. 그 어떤 국가도 난민 원조에 나서지 않은 것은 세계 주요 부유국들이 자국의 책임을 완전히 유기하고 있다는 충격적인 예시”라며 “G20 정상회담이 철저한 보안 속에서 호화롭게 진행되는 동안, 불과 수백 킬로미터 떨어진 곳에서는 매일같이 수천 명의 남녀와 어린이들이 안전한 유럽 해안에 닿기 위해 목숨을 걸고 조각배를 타고 있다. 이러한 위기를 앞둔 상황에서 인도적 수요를 충족하는 기금을 마련할 구체적인 방안을 마련하고, 각국이 분명한 기간을 정해 난민을 수용하겠다고 약속하지 않는 한 무엇이든 비참한 실패로 끝나고 말 것”이라고 말했다.

시리아 난민 중 약 10%인 40만 명은 특히 취약해 재정착이 필요한 상태다. 지금까지 세계 각국이 난민들에게 제공하기로 약속한 재정착지는 수요량의 4분의 1에 불과하다. 실제로 약속이 이행된 경우는 훨씬 적다.

국제앰네스티는 최근 수 개월간 상당수의 G20 국가들이 세계적인 난민위기에 대응하는 데 처참하게 실패한 사례를 기록했다. 가장 최근에는 지난해 G20 의장국이었던 호주에서 출입국 관계자들이 업자에게 돈을 주고 난민선을 돌려보냈음을 시사하는 증거를 공개하기도 했다.

전세계적으로 난민 중 86%가 개발도상국에 머무르고 있다. 시리아를 탈출한 난민 400만 명 중 95%가 터키, 레바논, 요르단, 이라크, 이집트 등 단 5개국에만 수용되어 있다.

G20 Summit: Rich countries must pull a U-turn on shameful refugee response

The world’s wealthiest countries must end their shocking inaction and begin to lead a coordinated response to the spiralling global refugee crisis by proposing a concrete plan for resettling the 1.15 million most vulnerable refugees worldwide, and fully fund humanitarian needs, said Amnesty International today ahead of the G20 summit in Antalya, Turkey.

To date, G20 member states have committed to resettling approximately 140,000 refugees from Syria – far below what is required. Last year, G20 countries offered resettlement places to a tenth of the refugees who needed them.
“World leaders have sat on the sidelines as a global refugee crisis of devastating proportions has unfolded before their eyes. Even worse, in some cases they have actively contributed to the misery by blocking refugees from seeking safety,” said Audrey Gaughran, Director for Global Issues at Amnesty International.

“As some of the world’s richest countries gather in Antalya they must not squander this opportunity to join forces to find concrete and meaningful ways to end the suffering of millions of vulnerable refugees. The G20 has a chance to prove its worth by serving as a springboard for bold action where other summits have shied away.”
Amnesty International is also calling on G20 members to drastically scale up financial support for humanitarian assistance for millions of refugees who are suffering because of severe cuts and shortages in aid. As of November, the UN humanitarian appeal for Syria’s refugee crisis is only 50% funded.
The contrast between the major host countries for Syrian refugees and the response of the G20 powers is striking. Lebanon which has a GNI of $44.5 billion currently hosts the highest number of refugees per capita, while Russia, with a GNI of $1.9 trillion has not resettled any Syrian refugees at all.
“Until now most of the focus has been on Europe’s failing response to the crisis, but this summit is a chance for other G20 nations to show they are ready to accept the responsibility that comes with playing a leading role in international affairs.”

“While states like Germany and Turkey have been playing a crucial role in responding to the global refugee crisis, and Canada has recently committed to resettle 25,000 Syrian refugees in the next two months, others like Russia and Saudi Arabia have shown shockingly little compassion towards people fleeing brutal conflicts and persecution. It is not too late for countries to change course and salvage some moral decency,” said Audrey Gaughran.

“The Syrian crisis exemplifies this failure. G20 leaders at the summit cannot ignore that they are meeting in a country that is currently hosting more than two million refugees – a greater number than any other country in the world. The failure to come to their aid is a shocking example of the complete abdication of responsibility by some of the world’s wealthiest countries.”

“Only a few hundred kilometres from the luxury high security G20 summit meetings, thousands of women, men and children risk their lives each day on flimsy boats to reach safety on Europe’s shores. In the face of such a crisis, anything less than a concrete plan to fully fund humanitarian needs and clear, time-bound commitments to resettle refugees from each country will be an abject failure.”

Approximately 10% of Syria’s refugees – some 400,000 people – are particularly vulnerable and in need of resettlement. To date, countries around the world have pledged only a quarter of the resettlement places needed for refugees from Syria. The pledges that have actually been followed through on are much lower.
In recent months, Amnesty International has documented the abject failure of several G20 governments to respond to the global refugee crisis, most recently publishing damning evidence that officials from last year’s G20 host, Australia, may have paid bribes to smugglers to turn ships with refugees away from its shores.
Globally, 86% of refugees are hosted in developing countries. Of the four million refugees who have fled Syria, 95% of them are in just five main host countries: Turkey, Lebanon, Jordan, Iraq and Egypt.

필리핀 법원이 버스 기사 제림 코리를 고문한 혐의로 경찰관에게 유죄를 선고하는 역사적인 판결을 내리면서, 고문 가해자들이 처벌받지 않는 관행을 뒤집을 수 있는 희망이 생겼다고 국제앰네스티가 밝혔다.

이번 판결은 국제앰네스티가 3년간 진행한 고문중단 캠페인 결과로, 2009년 고문방지법이 발효된 이후 처음으로 나온 유죄 판결이다. 국제앰네스티는 제림 코리가 체포된 지 1년 반이 지난 2013년 12월, 국제 고문중단(Stop Torture) 캠페인의 주요 사례로 제림의 이야기를 선정했다.

참파 파텔(Champa Patel) 국제앰네스티 동남아시아 지역 국장은 “제림은 경찰에게 끔찍한 고문을 당하고도 날조된 혐의로 재판을 받으며 4년이 넘는 시간을 교도소에서 보내야 했다. 고문에 관여한 경찰에게 유죄를 선고한 것은 두 가지 분명한 메시지를 전달하는 것이다. 하나는 고문이 반드시 중단되어야 한다는 것과 다른 하나는 고문 가해자들은 반드시 처벌받는다는 것이다.”

참파 파텔 지역 국장은 이어 “피고인 경찰관은 항소할 수 있지만, 이러한 재판이 진행된 것 자체만으로 이미 올바른 방향으로 진전한 것이다. 이제 필리핀 정부는 경찰과 정부 관계자들이 저지른 고문과 부당대우 사례를 모두 신속하고 공정하게 조사해야 한다”고 말했다.

판결이 나온 것은 3월 29일로, 국제앰네스티는 4월 1일 해당 판결문을 입수해 확인할 수 있었다.

수도 마닐라 북부에 위치한 팜팡가 주의 한 법원은 3월 29일 경찰관 제릭 디 지메네스(Jerick Dee Jimenez)에게 고문 혐의로 최대 징역 2년 1월형을 선고했다. 또한, 피해자인 제림 코리에게 10만 페소(미화 2,173달러)의 보상금을 지급하라고도 명령했다. 같은 혐의로 기소된 또 다른 경찰관은 불구속 입건됐다.

제림 코리는 지난 2012년 1월 팜팡가 주의 친척 집을 방문했다가 무장한 사복 경찰 10명에게 체포돼 수용소로 끌려갔고, 이곳에서 전기충격과 구타 및 살해 협박을 당했다. 경찰은 제림이 마약 관련 범죄와 외국인에 대한 강도살해, 경찰관 살해 등에 연루되었다고 주장했지만, 제림은 모든 혐의를 강력히 부인했다.

경찰은 제림 코리를 고문하며 계속해서 “보옛”이라는 이름으로 불렀다. 제림의 신분증으로 이름이 다른 것을 확인할 수 있었고, 지역 관계자 역시 경찰에게 다른 사람을 잘못 체포했다고 알렸음에도 고문은 계속됐다. 제림은 내용조차 확인할 수 없는 “자백서”에 서명할 것을 강요당했고, 그 뒤로 지금까지 마약 관련 혐의로 교도소에 수감되어 있다.

이날 판결은 처음으로 필리핀 고문방지법에 따라 법원에서 고문 혐의로 유죄가 선고된 사례였다. 국제앰네스티는 고문 사건 수사가 매우 비효율적으로 이루어지는 점에 대해 지속해서 우려를 제기해왔다. 대부분 사건이 예비수사 단계조차 통과하지 못하고, 아주 드물게 재판이 이루어지더라도 극도로 느리게 진행된다.

국제앰네스티는 필리핀 정부에 상습적으로 이루어지는 고문과 부당대우 문제를 공개적으로 인정하고 고문 피해자들이 가해 경찰을 더 쉽게 고발할 수 있도록 현행 민원 제도를 재검토할 것을 촉구한다.

참파 파텔 국장은 “경찰의 고문 피해자들이 자신의 권리를 인식하고, 피해자 본인은 물론 그 가족과 변호인, 시민사회단체 역시 어떤 고문과 부당대우 사건이든 고발할 수 있는 것이 가장 중요하다. 필리핀 정부는 경찰의 인권침해 문제에 대한 독립적 처벌 제도를 더욱 강화하고, 경찰에 의한 고문 사건을 모두 효과적으로 조사하고 기소해야 한다”고 말했다.

2015년 3월 27일, 국제앰네스티 필리핀지부는 매년 진행하는 편지쓰기 캠페인 ‘Write for Rights’를 통해 전 세계에서 모은 7만 건 이상의 탄원서명을 필리핀 경찰에 전달했다.

이후 제림 코리와 가족들은 국제앰네스티의 탄원 내용에 따라, 경찰 내부 수사가 시작될 것이라는 연락을 받았다. 첫 심리가 진행될 당시 경찰은 “한 인권단체”에서 전달한 편지를 바탕으로 수사를 시작했다고 확인했다.

필리핀은 2014년 국제앰네스티의 고문중단 캠페인에서 가장 중점적으로 다뤄진 국가였다. 국제앰네스티 조사 결과 경찰관들이 주로 금품을 갈취하거나 자백을 받아내려는 목적으로 전기 충격, 모의 처형, 물고문을 가하고 비닐봉지로 질식시키거나 구타, 때로는 강간하는 등의 방법을 이용해 상습적으로 고문한 사실이 드러났다. 2009년 필리핀이 고문반대 관련 주요 국제조약 2개를 비준했음에도 불구하고 벌어진 일이었다.

2014년 발표한 보고서 <법 위에 있는 자: 필리핀 경찰의 고문 실태(영문)>는 경찰이 고문 및 잔혹하고 비인도적이거나 굴욕적인 대우 또는 형벌을 가해도 처벌받지 않는 관행을 폭로하고, 2009년 고문이 금지된 이후에도 피해를 당한 고문 생존자 55명의 증언을 수록했다. 고문을 당할 당시 어린이였던 피해자도 21명에 이르렀다.

조사 결과 많은 피해자가 자신의 피해 사실을 신고하기 두려워했고, 실제로 신고한 사람들은 목숨을 위협하는 협박을 당했다. 고문 사실을 신고하는 규칙과 절차가 불분명하고 일관적이지 못해, 절차상의 문제로 신고가 접수되지 않는 경우가 많아 상황은 더욱 악화됐다.

Philippines: Historic ruling on police torture following Amnesty International campaign

A historic ruling by a Philippines court this week in which a police officer was convicted of torturing bus driver Jerryme Corre plants a seed of hope that the tide may be turning against impunity for perpetrators of torture, Amnesty International said today.

It is first under the country’s 2009 Anti-Torture Act, and follows a three-year campaign by Amnesty International. The organization took up Jerryme Corre’s case in December 2013 – one year after his arrest – in its global Stop Torture campaign.

“Jerryme has spent more than four years in prison while under trial on trumped-up charges against him, after suffering horrific torture at the hands of the police. The conviction of the officer involved sends a clear message that the torture must stop and that the perpetrators will be brought to book,” said Champa Patel, Director at Amnesty International’s South East Asia Regional Office.

“Even if the police officer still has the right to appeal, this trial has in itself been a step in the right direction. Philippine authorities must now ensure prompt and impartial investigations into all reports of torture and other acts of ill-treatment committed by the police and other state agents.”

The ruling came down on 29 March, but Amnesty International only today obtained court documents confirming the sentence.

Police officer Jerick Dee Jimenez was sentenced on 29 March to a maximum of two years and one month imprisonment by a court in Pampanga, north of the capital Manila, having been convicted of torture. He must also pay Jerryme Corre damages amounting to 100,000 pesos (USD $2,173). Another police officer faces the same charges but remains at large.

Jerryme Corre was visiting a relative in Pampanga province in January 2012 when 10 armed plain-clothed officers arrested him and took him to a police camp where he was electrocuted, punched and threatened with death. The police accused him of being involved in drug-related crimes, of robbing and killing a foreigner and of killing a police officer, all of which he strongly denied.

While the police were torturing Jerryme Corre they repeatedly called him by the name “Boyet”, even though his ID proved that was not his name and an official from his community told the police they had arrested the wrong man. He was forced to sign a “confession”, which he was not allowed to read, and has been in prison on drugs charges ever since.

Tuesday’s verdict is the first time anyone has been convicted for torture in a Philippines court under the Anti-Torture Act. Amnesty International has consistently raised concerns about the ineffectiveness of criminal investigations into cases of torture. Many cases do not make it past the preliminary investigation stage and the few cases that do reach the courts progress extremely slowly.

Amnesty International is calling on the Philippine government to publicly acknowledge and condemn the persistence of torture and other ill-treatment in the country, and to review existing complaints mechanisms against police to make it easier for torture victims to access justice.

“It is vital that victims of police abuse know their rights, and that victims, as well as their families, lawyers and civil society organizations are able to access justice in all cases of torture and other ill-treatment. The Philippine government must now strengthen independent accountability mechanisms for police violations, and ensure that all cases of police torture are effectively investigated and prosecuted,” said Champa Patel.

On 27 March 2015, Amnesty International Philippines handed over a petition with 70,000 signatures collected during the annual Write for Rights campaign to the Philippine National Police.

Following this, Jerryme Corre and his family were informed that an investigation would be opened by the police’s Internal Affairs Service (IAS), in line with Amnesty International’s calls. During the first hearing it was confirmed that the IAS initiated the investigation based on letters received “by a human rights organization”.

In 2014 the Philippines was a focus country in Amnesty International’s Stop Torture campaign, and research by the organization revealed that methods such as electrocution, mock executions, waterboarding, asphyxiating with plastic bags, beatings and occasionally rape continue to be employed by police officers who torture mainly for extortion and to extract confessions. This is despite the fact that the Philippines ratified the two key international anti-torture treaties in 2009.

A 2014 report, Above the Law: Police Torture in the Philippines, documented a pervasive culture of impunity for torture and other cruel, inhuman or degrading treatment or punishment within the police force, and included the testimonies of 55 torture survivors, all of whom had been tortured after the 2009 prohibition. Twenty-one of these people were children when they were tortured.

The research found that many victims were too afraid to report their experiences, and death threats were made against some of those who did. The situation is made worse by the fact that rules and procedures for reporting torture are unclear and inconsistent, meaning complaints are often dismissed on a technicality.
