5일 대만에서 6명의 사형이 집행된 것은 정의실현과는 관계없는 퇴보적인 결정이라고 국제앰네스티가 밝혔다. 5일 저녁 대만의 4개 교도소에서 남성 6명이 총살형에 처해졌다. 모두 살인으로 사형을 선고받은 사람들이었다.

이들에 대한 사형집행은 지난주 타이페이에서 8세 소녀가 끔찍하게 살해된 사건으로 대중의 분노가 극에 달한 가운데 이루어진 것이었다.

윌리엄 니(William Nee) 국제앰네스티 조사관은 “죄 없는 여학생에게 벌어진 끔찍한 살인 사건에 분노하는 것은 매우 당연한 일이며 이처럼 극악무도한 범죄를 저지른 범인은 반드시 마땅한 처벌을 받아야 하지만, 사형이 그 답이 될 순 없다”며 “사형을 집행하기로 결정한 것은 분노한 대중을 달램으로써 좋은 점수를 얻으려는 정부의 정치적 계산이 엿보인다. 정부는 이날의 결정으로 정치적 리더십의 부재를 증명했다”고 말했다.

총살형에 처해진 6명의 남성은 타이페이 교도소의 청친언, 왕슈팡, 차오 티엔서우와 타이난 교도소의 왕춘친, 가오슝 교도소의 왕유렁, 타이중 교도소의 황추왕 등이다.

대만에서의 사형집행은 모두 비밀리에 진행되고 있으며, 사형수의 가족과 변호인들에게 사전에 고지하는 경우는 거의 없다.

지난 2014년, 대만은 5명에 대해 사형을 집행하고 1명에 대해 새로 사형을 선고했으며, 모두 살인으로 유죄가 선고된 사람들이었다.

대만은 2014년 사형을 집행한 단 22개국 중 하나로, 41개국이었던 20년 전 기록과 비교되는 수치다. 현재 총 140개국이 법적 또는 실질적 사형폐지국이다.

윌리엄 니 조사관은 “이번 사형집행 결정은 사형폐지를 장기적인 목표로 본다던 대만 정부의 발표와 완전히 상반되는 조치다. 정부는 정치적 도구로 사형집행을 이용하는 것을 중단하고, 사형폐지를 위한 첫걸음으로써 공식적으로 사형집행 유예를 선포해야 한다” 고 말했다.

사형이 다른 처벌에 비해 더욱 효과적이라는 설득력 있는 증거는 존재하지 않는다. 사형과 살인 발생률간의 상관관계에 대해 유엔이 포괄적인 연구를 진행한 결과, 사형이 종신형에 비해 범죄 억지력이 더욱 강하다는 과학적인 증거는 찾을 수 없었다.

국제앰네스티는 범죄의 성질 또는 정황, 개인의 유, 무죄 여부와 그 외 특성, 국가의 사형집행 방법에 관계없이 모든 경우에 대해 사형에 반대한다. 사형은 세계인권선언에 명시된 생명권을 침해하는 것이며, 극도로 잔인하고 비인도적이며 굴욕적인 처벌이다.

Taiwan: Six executed in politically motivated decision

The execution of six people in Taiwan today is a regressive decision that does not deliver justice, Amnesty International said.

The six men were executed by firing squad at four different prisons in Taiwan earlier this evening. All had been convicted of murder.

The executions were carried out amidst public outrage following the abhorrent murder of an eight year old girl in Taipei last week.

The decision to carry out the executions reeks of political calculations by a government attempting to gain points by quelling public anger.

“The public outrage at the horrific murder of an innocent schoolgirl is totally understandable and the perpetrators of such heinous crimes must face justice, but the death penalty is never the answer,” said William Nee, researcher at Amnesty International.

“The decision to carry out the executions reeks of political calculations by a government attempting to gain points by quelling public anger. The government has today demonstrated a failure of political leadership.”

The six men executed by firing squad were: Cheng Chin-wen, Wang Hsiu-fang, and Tsao Tien-shou at a prison in Taipei; Wang Chun-chin at a prison in Tainan; Wang Yu-lung at a prison in Kaohsiung; and Huang Chu-wang in Taichung.

Executions in Taiwan are shrouded in secrecy, with the families and lawyers of those executed rarely informed in advance.

In 2014, Taiwan carried out five executions and imposed one new death sentence, all involving people convicted of murder.

Taiwan was one of only 22 countries to carry out executions in 2014, compared to 41 countries 20 years ago. A total of 140 states have now abolished the death penalty in law or practice.

“The executions fly in the face of the government’s stated long term goal to abolish the death penalty. The government must cease using executions as a political tool and should establish an official moratorium on executions as a first step towards abolition.”

There is no convincing evidence that the death penalty prevents crime more effectively than other punishments. A comprehensive study carried out by the United Nations on the relationship between the death penalty and homicide rates concluded that research has failed to provide scientific proof that executions have a greater deterrent effect than life imprisonment.

Amnesty International opposes the death penalty in all cases without exception, regardless of the nature or circumstances of the crime; guilt, innocence or other characteristics of the individual; or the method used by the state to carry out the execution. The death penalty violates the right to life as proclaimed in the Universal Declaration of Human Rights. It is the ultimate cruel, inhuman and degrading punishment.

미얀마에서 구속되었던 학생 시위대 수십여 명이 석방된 것은 인권적 진전이며, 새 정부가 남은 양심수를 모두 석방하고, 임의 체포를 부추기는 법안을 모두 개정하거나 폐지하는 계기가 되어야 한다고 국제앰네스티가 밝혔다.

미얀마의 타라와디 법원은 2015년 3월 평화적 시위에 참여했다가 징역형이 선고될 위험에 처했던 학생 시위대 수백 명에 대해 공소를 철회했다. 미얀마 새 정부가 4월 7일 가능한 한 모든 양심수를 석방하도록 노력하겠다고 밝힌 데 따른 조치였다. 그 결과 표 표 아웅을 포함해 많은 양심수가 풀려나게 되었다.

로라 하이(Laura Haigh) 국제앰네스티 미얀마 조사관은 “이날 학생 시위대 대부분이 석방된 것은 미얀마 인권의 상당한 진전이며, 학생들이 무사히 풀려나게 되어 매우 기쁘다. 이번 석방은 미얀마의 정치적 체포와 구금의 악순환을 끝내겠다는 새 정부의 의지를 강력히 전달하는 조치다. 이제는 다른 법원에서 기소된 학생들을 포함해 모든 양심수를 석방하길 기대한다. 새 정부는 반드시 단 한 명의 양심수도 교도소에 남지 않도록 해야 할 것”이라고 말했다.

하이 조사관은 또 “물론 양심수 석방은 시작에 불과하다. 문민정부는 너무나 오랫동안 비판세력을 탄압하는 수단으로 이용됐던 억압적인 법률제도를 개혁해야 한다. 이것이 남아 있는 한 인권옹호자와 활동가들은 의견을 표현했다는 이유만으로 수감될 위험에 여전히 노출될 것이다. 다행히도 새 정부는 억압적인 법률을 폐지하고 수정할 필요성을 인정한 바 있다. 정부가 이를 행동에 옮길 날만을 기다린다”며 “새 정부는 또한 이날 사면으로 석방된 학생들을 비롯해 부당하게 수감되었던 수많은 양심수들을 지원하고 이들이 사회에 무사히 복귀할 수 있도록 해야 한다”고 말했다.

배경

2016년 3월 24일, 국제앰네스티는 미얀마의 정치적 구금에 관한 보고서를 발표하고 2014년부터 표현과 결사, 평화적 집회의 자유를 침해하는 경향이 나타나기 시작한 것에 대해 우려를 표했다. 이때부터 수백 명이 정치적인 이유로 체포, 기소되고 임의 구금되거나 수감되었다. 학생 시위대와 정치 활동가, 언론인, 인권옹호자, 특히 토지 및 노동활동가들이 주로 그 대상이었다.

이 보고서는 또한 정부가 기존 법과 새로 제정한 법을 이용해 비판적인 의견을 막고, 다양한 전략을 동원해 인권옹호자와 활동가를 장기간 구금하거나 수감시키며 미얀마 내 다른 활동가에게 공포 분위기를 조성한 점에 대해서도 지적했다.

Myanmar: Students’ release must pave way for an end to repression

The release of dozens of student protesters in Myanmar is a step forward for human rights that should pave the way for the new government to release all remaining prisoners of conscience and amend or repeal all laws that fuel arbitrary arrests, Amnesty International said.

The Tharawaddy Court in Myanmar today dropped charges against scores of students facing jail for largely peaceful protests in March 2015. The move came after the new government announced on 7 April that it would work to release all prisoners of conscience as soon as possible.

“Today’s release of most of the student protesters is a huge step forward for human rights in Myanmar, and we are delighted that these men and women will walk free. It sends a strong message about the new government’s intention to end the cycle of political arrest and detention in Myanmar. We are now looking forward to the release of all other prisoners of conscience – including those students who are facing charges in other courts. The new government must ensure that no prisoner of conscience is left in jail,” said Laura Haigh, Amnesty International’s Myanmar Researcher.

“Of course, a prisoner release is only a first step – the NLD must also reform the country’s repressive legal framework, which has for too long been used to clamp down on dissent. As long as these laws remain on the books, human rights defenders and activists will remain at risk of being jailed simply for expressing their opinions. Thankfully, the NLD has acknowledged the need to repeal and amend repressive laws, and we are looking forward to seeing the government following up on this.

“The new administration must also aim to ensure support and rehabilitation for those released in today’s amnesty, along with the many others before them who were unjustly imprisoned.”

Background

On 24 March 2016, Amnesty International published a report on political imprisonment in Myanmar which highlighted the worrying erosion of newly found freedoms of expression, association and peaceful assembly in the country since the start of 2014. Since then, hundreds of people have been arrested, charged, arbitrarily detained or imprisoned in politically motivated cases. They include student protesters, political activists, media workers, human rights defenders and, in particular, land and labour activists.

The report highlights how authorities have used both old and new laws to silence dissent, and how the use of these laws has been supported by a range of other tactics to keep human rights defenders and activists in detention or in prison for lengthy periods of time, creating a climate of fear among human rights defenders and other activists in the country.

쿠르디가 목숨을 잃은 지 1년이 되는 9월 2일을 기리며, 국제앰네스티는 난민 위기에 대처하지 못한 국제사회의 실책으로 쿠르디를 비롯한 수천여 명의 난민 어린이들이 여전히 비참한 상황에 방치되어 있다는 점을 재차 환기시켰다. 9월 19일 유엔 난민과 이주민 정상회의를 앞두고 지난 7월 진행된 협상에서는 반기문 유엔 사무총장이 제안한 “난민 책임분담에 관한 글로벌 컴팩트(Global Compact on Refugee Responsibility-Sharing)”의 출범을 2018년까지 보류하기로 결정했다.

에티오피아 아와사(Awassa)에서 온 13세 메리(Mary)를 만난 것은 2016년 8월 19일, 케냐 북부의 카쿠마(Kakuma) 난민캠프 안 모가디슈(Mogadishu) 학교에서였다.

“우리나라에서 전쟁이 벌어졌고, 제가 이곳에 온 건 일곱 살 때였어요. 케냐로 오는 길은 너무나 힘들었고, 정말 많이 고생했죠. 부모님과 언니오빠 3명과 함께 왔어요. 캠프에서 살기란 쉽지 않아요. 충분히 공부할 기회도 없고요. 더 발전하려면 더 많이 배워야 해요. 우리는 좋은 교육을 받고 싶어요. 여긴 날씨도 좋지 않아요. 너무 더워서 숨도 쉬기 힘들 때도 있고, 비가 엄청나게 쏟아지기도 해요. 이곳의 미술 수업 선생님들은 잘 가르쳐 주세요. 수업을 듣기 전까지만 해도 그림을 그리는 법조차 몰랐는데, 이젠 저도 그릴 수 있어요. 미국에서 하는 게임도 배웠는데, 아주 재미있어요. 미술 수업에서 제가 제일 좋아하는 건 인물화와 수채화 그리기에요. 크면 과학자가 되고 싶어요. 여러 나라를 다니면서 저처럼 힘든 처지에 있는 사람들을 만나 도와주고 싶어요. 여행자처럼 세계 곳곳을 여행하고 야생동물을 만나고 싶어요.”

Anniversary of Alan Kurdi drowning highlights continuing global shame

One year after the shocking image of Syrian boy Alan Kurdi’s drowned body caused international outcry, world leaders are still failing to respond to the refugee crisis, said Amnesty International today.

Marking the 2 September anniversary of Alan’s death, the organisation drew attention to the plight of thousands of other refugee children let down by the dismal failure of world leaders to tackle the refugee crisis. In July, negotiations ahead of the 19 September UN Refugee and Migrant Summit put the “Global Compact on Refugee Responsibility-Sharing” proposed by UN Secretary General Ban Ki-moon on ice until 2018.

“As if the image of Alan’s lifeless body that shamed the world were not enough, one year later world leaders are still refusing to act. Tragically, states have already passed up on a chance to address the crisis at a UN Summit on 19 September, which is set to fall far short of what is needed. We now face the prospect of another conclave of world leaders fiddling with hollow declarations while more children suffer,” said Salil Shetty, Amnesty International’s Secretary General.

“Until wealthy countries take more responsibility for the crisis unfolding before them, and take in a fairer share of the people fleeing war and persecution, they will be condemning thousands more children to risk their lives in desperate journeys or being trapped in refugee camps with no hope for the future.”

“The outpouring of sympathy for Alan Kurdi seen last year must be extended to the countless other refugee children who are in dire need of help. Governments have dealt with the refugee crisis with narrow self-interest, as if the people they represent are incapable of extending their empathy beyond their own communities. It’s time all of us started taking the refugee crisis personally and show our leaders that we welcome refugees.”

Three year old Ismail lives in a tent outside Elliniko old airport in Athens with his parents and two older brothers. The family fled from the war in Afghanistan. Children like Ismail spend most of their time outside this abandoned building, which is full of health and sanitary hazards.

Hadi is 3 and a half years old. His mother, Salwa Al Aji, is a 38 year old teacher from Damascus. They live in the Softex camp near Thessaloniki in Greece. Salwa travelled with three of her children and her husband, who cannot walk because of a slipped disc. She has tried to help set up a school in the camp but there are no books, and she is scared of the fights that happen every day. She told us, “I didn’t want to leave Syria, but our house was destroyed…I fled from war to find war in here”.

We have also learnt American games, which is good. My favourite thing in the art course is drawing a person and painting with watercolours. I would like to be a scientist. I want to visit other countries and see people like me who are struggling so that I can help them. I want to travel to different countries like a tourist and see wild animals.”

10월 말, 파키스탄 정부는 4인 이상 모이는 것을 금지하는 내용의 형법 144항을 이슬라마바드(Islamabad)와 라왈핀디(Rawalpindi) 등의 도시 전역에 부과했다.

야당 지도자 임란 칸이 속한 테흐리크 에 인사프 당 의원 및 당원들은 현 나와즈 샤리프(Nawaz Sharif) 총리 정권에 반대하는 시위를 벌이기 위해 이슬라마바드(Islamabad)로 향하던 도중 체포됐다.

또한 국제앰네스티는 기자들이 호의적인 보도를 요구하는 시위대로부터 위협을 당하거나 협박을 받고 있다는 정보에 대해서도 우려를 표한다.

참파 파텔 국장은 “기자와 인권옹호자는 시위 과정에서 중요한 역할을 수행한다. 시위를 보도하는 모든 언론인들은 자유롭게, 공격 또는 위협을 받을 우려 없이 자신의 역할을 할 수 있어야 한다”고 말했다.

국제앰네스티와 도미니카공화국 시민사회 대표단은 9월 21일 도미니카공화국 대통령궁에서 구스타보 몬탈보 대통령 비서실장과 만나, 도미니카 내 무국적인 문제에 신속히 대응할 것을 촉구하는 134개국의 5만 건이 넘는 탄원서명을 전달했다.

2013년 도미니카공화국은 1929년 이후 도미니카공화국에 살고 있는 미등록이주민의 자손은 국민으로 인정하지 않는다는 결정으로 수만 명이 기본적인 인권조차 누릴 수 없게 되었다.
신분증이 없는 사람들은 “유령”이 되었고, 교육이나 보건 서비스는 물론이고 일자리마저 빼앗겼다.

9월 마지막 주는 도미니카공화국 헌법재판소가 주로 아이티 출신인 수만여 명의 도미니카 국적을 말소하도록 결정한 지 3년이 되는 때이다. 헌재의 이 같은 결정으로 수만 명이 사실상의 “유령 시민”이 되어, 학교에 다니거나 직업을 구하는 것은 물론 국내에서 자유롭게 이동하는 것조차 심각하게 제한당하는 처지에 놓였다.

메디나 대통령의 연임으로 도미니카 정부는 3년 전 헌법재판소의 결정을 바로잡을 기회를 얻었다. 꾸준한 노력의 연장선에서, 당시 헌재 결정으로 영향을 받은 도미니카 국민 수만 명을 위한 새로운 해결책을 찾는 것이 다음 정부의 최우선과제가 되어야 한다.”

해외 출신인 도미니카 국민 수만 명은 헌재의 차별적인 결정으로 고통받고 있다.

한 달 전, 아이티계 태권도 챔피언 루이시토 피에는 2016 리우 올림픽에서 도미니카공화국의 유일한 메달을 획득한 선수이다. 그러나 그 외에 복싱의 아도니스 페게로를 비롯해 수많은 선수들은 2013년 헌재 결정으로 2014년 대책을 실시했음에도 불구하고 도미니카 국적을 되찾지 못해 국가대표팀에 합류할 수 없었다.

DOMINICAN REPUBLIC: 50,000 PEOPLE DEMAND SOLUTION TO CRISIS OF “GHOST CITIZENS”

An Amnesty International delegation and representatives of Dominican civil society will meet the Minister of Presidency, Gustavo Montalvo, at the Presidential Palace in the Dominican Republic on 21 September to deliver more than 50,000 petitions from 134 countries urging swift action to tackle the crisis of stateless people in the country.

The meeting will take place the week of the third anniversary of a judgement by the country’s Constitutional Court that stripped tens of thousands of people, mainly of Haitian descent, of their Dominican nationality. The ruling effectively made them “ghost citizens” severely limiting their chances of going to school, finding a job or even travelling freely in their country.

“President Medina’s new mandate provides a unique opportunity for the Dominican government to continue to undo some of the many wrongs created with the Constitutional Court’s judgment three years ago. Following the efforts made in 2014, finding new solutions for the tens of thousands of Dominicans affected by this measure must be a top priority for the new authorities,” said Robin Guittard, Campaigner on the Caribbean at Amnesty International.

Tens of thousands of Dominicans of foreign descent suffer the consequences of this discriminatory ruling.

A month ago, taekwondo champion Luisito Pie, a Dominican of Haitian descent, won the only medal for the Dominican Republic in the Rio 2016 Olympic Games.

But many other athletes, including boxing champion Adonis Peguero, are not even allowed to join the national team, as they were not able to get their Dominican nationality back despite the measures implemented in 2014 to address the human drama created by the 2013 judgement.

“While Adonis could give so much to his country, like Luisito does, the legal maze created by the Dominican authorities prevents him to fully participate in society and his life remains in a limbo. This injustice must end.”

On Friday 23 September at 10.30 am, Amnesty International will join Dominican activists and people affected by the ruling in a protest in front of the Constitutional Court in Santo Domingo.

표현의 자유를 행사했다는 이유로 블로거 라이프 바다위(Raif Badawi)에게 공개 채찍질형을 집행한 이후 1년 동안 사우디아라비아의 인권상황은 꾸준히 악화되어 왔다고 국제앰네스티가 밝혔다.

지난 한 해 동안 사우디아라비아의 인권상황은 더욱 최악으로 치달았다. 불과 얼마 전에는 이슬람 시아파 성직자인 셰이크 님르 알 님르를 포함해 하루 만에 47명을 집단 처형하면서 중동 지역을 충격에 휩싸이게 했다.

지난달 지방선거를 통해 마침내 여성의 투표권을 인정한 것은 매우 환영할만한 일이나, 사우디아라비아는 여전히 인권활동가에 대한 전면적인 탄압을 계속하고 있는 한편, 예멘에서 막대한 규모의 폭격을 주도하며 심각한 국제인도법 위반행위 및 전쟁범죄를 범하고 있다.

제임스 린치(James Lynch) 국제앰네스티 중동-북아프리카 부국장은 “라이프 바다위의 공개 채찍질형 집행에 대한 국제사회의 비난이 쏟아진 지 1년이 지났지만, 바다위를 포함한 양심수 수십 명은 지금도 평화적으로 활동에 참여했다는 이유만으로 감옥에 수감된 채 잔인한 처벌과 부당대우를 당할 위험에 처해 있다”며 “2014년 사우디아라비아의 테러방지법이 발효된 이후 더욱 많은 인권옹호자들이 징역형을 선고 받고 있음에도 동맹국들은 부끄럽게도 ‘테러와의 전쟁’이라는 명목으로 사우디 정부의 탄압을 지지하고 있다”고 말했다.

라이프 바다위의 변호사인 왈리드 아부 알 카이르는 2014년 2월 발효된 사우디아라비아의 테러방지법에 따라 불공정한 재판을 거쳐 처음으로 유죄가 선고된 인권옹호자다. 2015년에도 이 법을 근거로 수십여 명이 수감되었다. 그 중 압둘카림 알 코더 박사와 압둘라만 알 하미드 박사는 현재 폐쇄된 독립적 단체인 사우디 시민, 정치적 권리 연합 (ACPRA)의 창립 회원으로, 마찬가지로 불공정한 재판을 통해 형이 선고됐다.

사우디아라비아는 독립적인 인권단체 조직을 금지하고, “무허가 단체”를 결성했다는 혐의로 설립에 참여한 회원들을 장기간의 징역형에 처하고 있다. 평화적인 시위를 포함한 모든 공공 집회 역시 2011년 사우디 내무부의 명령이 내려진 이후 금지된 상태다.

한편 사우디아라비아 정부는 2014년 발효된 테러방지법과 악명 높은 “테러 전담 법원”인 특수형사법원(SCC)을 이용해 모든 형태의 캠페인 활동을 제도적으로 탄압하고 있다. 이슬람 시아파 활동가들에게 매우 불공정한 재판을 통해 사형을 선고하고 집행하는 방법도 그 중 하나로, 유명 시아파 성직자이자 정부에 비판적이었던 셰이크 님르 알 님르가 시아파 활동가 3명과 함께 1월 2일 처형된 것도 이를 이용한 것이었다.

셰이크 님르 알 님르의 조카인 알리 알 님르와, 시아파 활동가인 다우드 알 마르훈, 압둘라 알 자헤르는 체포될 당시 모두 18세 미만의 미성년자였다. 세 사람은 매우 불공정한 재판을 거쳐, 단순히 ‘자백’만을 근거로 사형을 선고 받았다. 이들은 고문에 의한 자백이었다고 주장했으나 법원은 이러한 의혹을 조사하기를 거부했다.

제임스 린치 부국장은 “사우디아라비아 정부가 미성년자 피고인 3명에게 사형 선고를 확정하는 터무니없는 국제법 위반 행위를 저질렀고, 그것도 이들 3명이 모두 고문에 의한 것이라고 주장한 ‘자백’만을 근거로 이루어졌다는 것은 정부에 비판적인 의견을 드러내는 모든 활동을 참혹하게 탄압하고 있음을 보여주는 것”이라며 “사우디아라비아는 2015년 1월부터 11월 사이 최소 151명을 연달아 처형하며 1995년 이후 가장 많은 사형을 집행하는 충격적인 행보를 보였다. 이제는 이로부터 벗어나 진전을 보여야 할 때다. 이들 사형수 중 절반 가량이 국제법상 사형을 부과할 수 없는 범죄로 처형됐다”고 말했다.

또한 사우디아라비아는 2015년 3월부터 연합군을 구성해 예멘의 후티 반군 점령 지역에 수천여 건의 공습을 가하고 있다. 이로 인해 의료시설과 학교, 공장, 발전소, 다리, 도로 등의 민간 시설 역시 피해를 입으면서 민간인 수백 명이 목숨을 잃었다. 국제앰네스티는 이러한 공습이 부적절하거나 무차별적으로 이루어지는 경우가 빈번하며, 민간인 또는 민간 표적을 정확히 겨냥한 것으로 추정되는 사례도 있다고 파악한 바 있다.

사우디아라비아 주도 연합군이 예멘의 민간 표적을 공격하는 데 사용한 무기 중에는 미국과 영국이 생산하고 개발한 무기도 있다. 미국과 영국 정부는 이외에도 사우디 연합군에 물류적 지원과 정보를 제공하고 있다.

제임스 린치 부국장은 “미국, 영국과 같은 동맹국들은 사우디아라비아 정부와의 긴밀한 관계를 이용해, 사우디아라비아의 인권상황을 개선하고 예멘에서 이루어지는 군사작전이 국제법을 따르도록 정부를 공개적, 비공개적으로 압박해야 할 것이다. 이러한 사안에 침묵하면서 사우디아라비아에 치명적인 무기를 계속해서 공급하는 것은 납득하기 어려운 일”이라고 말했다.

배경

2015년 1월 9일 제다 광장에서 라이프 바다위에게 채찍질 50번이 가해졌다. 이는 2014년 5월, 온라인상에 공개 토론 웹사이트를 만들고 “이슬람교를 모욕”했다는 혐의로 법원이 바다위에게 선고한 징역 10년형과 채찍질형 1,000번 중 일부를 집행한 것이었다.

남은 채찍질형은 건강상의 문제로 연기된 이후, 지금까지도 알 수 없는 이유로 집행되지 않고 있다.

국제앰네스티가 2014년 편지쓰기마라톤을 통해 라이프 바다위의 사례를 소개하면서 그를 지지하는 메시지 백만 건 이상이 보내졌다. 2015년에는 바다위의 변호사 왈리드 아부 알 카이르가 처한 곤경 역시 주목됐다.

Saudi Arabia: A year of bloody repression since flogging of Raif Badawi

The human rights situation in Saudi Arabia has steadily deteriorated over the year since blogger Raif Badawi was publicly flogged for exercising his right to free expression, said Amnesty International the day before the first anniversary of the flogging.

The past year has seen the Kingdom’s human rights record go from bad to worse. Most recently the mass execution of 47 people in a single day, including Shia Muslim cleric Sheikh Nimr al-Nimr, sent shockwaves across the region.

Despite the much hailed participation of women in municipal elections last month, Saudi Arabia continued its sweeping crackdown on human rights activists and led a devastating air bombardment campaign in Yemen that saw the commission of serious violations of international humanitarian law, including war crimes.

“A year after the international outcry over his public flogging, Raif Badawi and dozens of prisoners of conscience remain in prison and at risk of suffering cruel punishments and ill-treatment for their peaceful activism,” said James Lynch, Deputy Director of the Middle East and North Africa Programme at Amnesty International.

“More and more human rights defenders are being sentenced to years in prison under Saudi Arabia’s 2014 counter-terror law, while its allies shamelessly back the Kingdom’s repression in the name of the so-called ‘war on terror’.”

Among the many people imprisoned is Raif Badawi’s lawyer, Waleed Abu al-Khair, the first human rights defender to be sentenced under Saudi Arabia’s counter-terror law in force since February 2014, after an unfair trial. Dozens more were jailed under the law in 2015, including human rights defenders Dr Abdulkareem al-Khoder and Dr Abdulrahman al-Hamid, both founding members of the now disbanded independent Saudi Civil and Political Rights Association (ACPRA), also after unfair trials.

Saudi Arabia continues to ban independent human rights associations and imprison its founding members, with lengthy prison terms for forming “unlicensed organizations”. All public gatherings, including peaceful demonstrations, remain prohibited under an order issued by the Ministry of Interior in 2011.

Meanwhile, the authorities have used the 2014 counter-terror law and the Kingdom’s notorious “counter-terror” court, the Specialized Criminal Court (SCC), to systematically clamp down on all forms of activism, including by sentencing to death and executing Shi’a Muslim activists after grossly unfair trials, such as prominent Shi’a Muslim cleric and vocal critic of the Saudi Arabian government, Sheikh Nimr al-Nimr who was executed with three other Shia Muslim activists on 2 January.

Ali al-Nimr, the nephew of Sheikh Nimr al-Nimr, and other Shi’a activists Dawood al-Marhoon and Abdullah al-Zaher were all under the age of 18 when they were arrested. All three have had grossly unfair trials and were sentenced to death based solely on ‘confessions’ they claim were extracted under torture. The court has refused to investigate their allegations of torture.

“A bloody crackdown on all forms of dissent has seen the authorities uphold death sentences imposed on three alleged juvenile offenders, in egregious violation of international law and based on no evidence other than ‘confessions’ all three activists have said they were tortured to make,” said James Lynch.

“This is at a time when Saudi Arabia has stepped up its horrendous execution spree with at least 151 people executed between January and November 2015 – the highest toll since 1995. Close to half of those executed were for crimes that should not, according to international law, be punishable by death.”

Saudi Arabia has also led a military coalition which, since March 2015, has carried out thousands of air strikes in areas of Yemen controlled by the Huthi armed group. Hundreds of civilians have been killed in the air strikes, which have also struck civilian infrastructure including health facilities, schools, factories, power facilities, bridges and roads. Amnesty International has found that such strikes have been frequently disproportionate or indiscriminate and in some instances they appear to have directly targeted civilians or civilian objects.

Some of the weapons used by the Saudi Arabia-led coalition forces in Yemen which have hit civilian targets, were produced and/or designed in the US and UK. The UK and US governments are also providing logistical support and intelligence to the coalition.

“Saudi Arabia’s allies like the USA and UK should be using their close relationships to press the government, including publicly, to improve its human rights record and to comply with international law in its Yemen campaign. Their silence, as they continue to supply Saudi Arabia with deadly arms, is simply not tenable,” said James Lynch.

Background
A security officer administered 50 lashes with a cane on Raif Badawi in a public square in Jeddah on 9 January 2015. The 50 lashes were part of the sentence of 1,000 lashes and 10 years in prison handed down by a court in May 2014 for setting up an online forum for public debate and for “insulting Islam”.

Further floggings were delayed, initially due to medical concerns and since then for unknown reasons.

More than a million messages have been sent in support of jailed Saudi Arabian blogger Raif Badawi since Amnesty International’s Write for Rights campaign raised his case in 2014. In 2015 the campaign highlighted the plight of his lawyer, Waleed Abu al-Khair.
