혁파(革罷)의 대상은 환경부와 환경부 장관이다

오늘(8월 24일) 환경부는 ‘제4차 규제혁신전략회의’ 결과를 발표했다. 한화진 환경부 장관의 보고 내용은 참담하다. 환경부의 의지가 맞는지 의심될 정도로 자신들이 만든 제도를 ‘덩어리 규제’로 취급하며, 이를 갈기갈기 찢어 국민이 아닌 기업에 혜택이 돌아가도록 법과 제도를 개정하겠다고 밝혔기 때문이다. 환경부가 발표한 내용은 환경 당국으로서 더 이상 국토환경 훼손이나 화학물질 원인 안전사고 발생, 탄소중립실천에 대해서 책임지지 않겠다는 선언과 다름없다. 환경부는 지속하여 “규제완화”라는 대통령의 말을 복화술 인형처럼 따라 하며, 수십 년의 경험과 쓰디쓴 참사의 역사 속에서 만들어 온 안전·건강·환경보전을 위한 최소한의 제도를 제 손으로 부수고 있다. 『화학물질의 등록 및 평가 등에 관한 법률』(이하 화평법)과 『화학물질관리법』(이하 화관법)에 따라 관리되는 화학물질 및 취급시설 기준을 완화하는 것은 경제적 효과를 이유로 국민의 안전과 건강을 내팽개치겠다는 선언이다. 우리는 구미 불산 사고와 가습기 살균제 참사로부터 화학 사고의 위험성을 뼈아프게 배워야 했다. 화평법과 화관법은 이러한 위험으로부터 국민 건강 및 환경을 보호하기 위한 목적으로 만들어졌다. 해당 법 시행 후 감소세를 보였던 국내 화학물질 사고가 규제 완화 이후 증가세로 돌아섰다는 결과도 확인됐다. 국민 안전을 최우선한 제도 강화에 나서도 모자란 환경부가 기업의 편의와 비용 절감을 위해 규제를 완화하겠다고 나섰다는 점에서 ‘산업부2중대’ 꼬리표의 걸맞은 행보가 아닐 수 없다. 환경부는 작년부터 지속적으로 환경영향평가를 ‘킬러규제’로 꼽으며 개선을 공표해 왔다. 환경영향평가 제도의 이해당사자 중 하나인 기업의 환경영향평가 불만을 이유로 제도를 점차 간소화하고 있다. 환경부는 환경영향평가의 효율성 제고를 명목으로 제도의 목적을 부정하고, 스스로의 권한을 축소하고, 의무를 방기하고 있다. 계속되는 환경영향평가 거짓·부실 평가 논란에도 제도의 신뢰성과 투명성 강화가 아닌 제도의 축소와 후퇴를 ‘혁신’이라고 발표하는 환경부의 행태가 더 이상 놀랍지도 않다. 검증되지도 않은 간이평가를 도입해 환경영향평가를 면제를 확대하고, 난개발을 막을 장치도 없이 소규모환경영향평가 권한을 지방에 이양하고, 투자 촉진을 이유로 민간투자 사업에 면제 특혜를 주고, 환경영향평가를 신속히 처리해(패스트트랙) 첨단 산업단지 조성을 지원하겠다는 부처가 과연 ‘환경’이라는 이름을 달 자격이 있는가? 또한 환경부는 온실가스 배출권 이월 제한 규정을 완화해 탄소중립의 시급성은 감소시키고, 기업의 책임과 의무를 대폭 면제한다. 기후위기 대응을 위한 탄소중립은 전 지구적 과제다. 전 세계가 나서 지금 당장 온실가스 감축을 위한 적극적인 실천과 기업의 책임을 묻고 있다. 하지만 오늘 환경부의 발표는 이미 후퇴한 기후정책을 더욱 뒤로 물리며, 윤석열 정부의 기후위기 책임 의식과 탄소중립 의지의 실종을 그대로 반영하고 있다. 정부가 말하는 ‘킬러규제’는 국민 안전을 위한 ‘필수 규제’다. 고로 ‘킬러규제 완화‘는 국민 안전을 위한 ’필수 규제’ 포기를 의미하는 것이고, 이것을 ’혁파(革罷)’라 말하는 것은 환경부 스스로 혁파의 대상임을 애둘러 자임하는 격이다. 지난 1년간 대통령과 기업에 부화뇌동해온 한화진 환경부 장관의 즉각적인 사퇴를 촉구한다. 또한 환경부는 오늘 발표한 환경 킬러규제 혁파 방안을 즉시 철회해야 한다. 한국환경회의는 환경부가 불러일으킨 환경비상시국에 엄중하게 대응할 것이다.

We stand with the People of Palestine!

We stand for Justice, Human Rights and Freedom!

환경운동연합은 지구의벗(Friends of the earth) 한국으로 지구의벗 아시아태평양(Friends of the earth Asia-Pacific)과 함께 무고한 팔레스타인 시민의 인권과 자유를 위해 함께 팔레스타인 전쟁 중단과 인도적 지원을 촉구합니다. 환경운동연합은 11월 3일 지구의벗 아시아태평양과 세계 시민단체가 연대해 배포한 공동 성명 원본을 공유 드립니다.

As movements fighting against systems of injustice that view black, brown and indigenous peoples as disposable, to be sacrificed by racist and colonial systems of exploitation and domination, we see the struggle of the Palestinian people against occupation and apartheid as part and parcel of our collective struggle for climate, racial, economic and political justice and for a world where everyone has the right to live with dignity, free from oppression.

We are enraged and grieve equally the loss of lives of all civilians – Palestinian and Israeli – that have taken place since 7 October and call for those responsible to be held accountable for their actions.

We decry the fact that for many Northern Governments,  Palestinian lives are deemed as being of less value and worth as those of Israeli citizens. This has allowed tens of thousands of Palestinians being killed with impunity over the decades as a result of Israel’s illegal occupation of Palestine. People whose names and dreams, like those of our peoples in the global South, sacrificed to colonialism.

In the latest indiscriminate bombing of Gaza, Israel has already killed more than 5000 Palestinians including at least 2360 children, displacing over 1 million people, as it collectively punishes the Palestinian people. In just one week, between 7-12 October, Israel dropped over 6,000 bombs on the Palestinian people living under its illegal occupation, more than the US dropped in a whole year during its war on Afghanistan. Whilst Human Rights Watch has confirmed that Israel has used a banned chemical weapon – white phosphorous – in civilian areas in the Gaza Strip, causing severe burns and uncontrollable fires.

We are devastated by the  bombing of the Al-Ahli Arab Hospital in Gaza which killed 471 injured and sick Palestinians, including women, children, doctors, nurses, and those seeking refuge from the retaliatory bombardment by Israel. To date, the World Health Organisation has documented 76 attacks on healthcare workers, 26 healthcare facilities including 17 hospitals have been attacked, as well as attacks on UN schools where Palestinians are sheltering for safety.

The Occupied Palestinian Territory of Gaza is facing a “complete siege” with the purposeful targeting of civilian infrastructure such as hospitals and schools which constitute war crimes under international law. Israel is also blocking food, water, fuel and medicine to a captive population of 2.3 million Palestinians, half of whom are children, as a weapon of war.

While in the Occupied Palestinian Territory of the West Bank, Israel has imposed a total blockade. The Israeli military is attacking Palestinians protesting the genocide in the Gaza Strip with lethal military force, and is providing thousands of weapons to Israeli settlers inside the West Bank, who are attacking and killing Palestinians.

Israel has openly made genocidal statements that ‘Gaza will be reduced to rubble’ and called the Palestinians ‘human animals’. As climate justice movements we recognise the language of racism and colonialism that has been used to justify the sacrificing and killing of so many of our people across the global South.

The current war in Gaza is not an isolated event but is deeply rooted in ongoing colonization, illegal occupation, systemic injustices, and historical oppression of Palestine by an apartheid state. Israel has repeatedly disregarded the international humanitarian law and human rights principles that demand the protection of civilians, especially in conflict zones, as it escalated its genocidal attacks in Gaza.

Israel is planning a ground offensive with intent to indiscriminately kill Palestinians in north Gaza; and aims to ethnically cleanse more Palestinians in a single day than during the Nakba (Arabic for ‘catastrophe’) in 1948, when over 750,000 Palestinians were expelled from their homes – or any day since in their ongoing settler-colonial occupation of Palestine. The vast majority of Palestinians in Gaza are refugees from the Nakba.

The situation has never been more urgent. In the words of the Director of the United Nations Relief and Works Agency for Palestinian refugees (UNRWA), “Gaza is running out of life”. As vital resources run out and Gaza’s health infrastructure – already battered by Israel’s 16 year-long blockade and periodic bombardment – ‘collapse before our eyes’, Gaza’s remaining hospitals are turning into morgues.

We call for an immediate ceasefire, and for the international community to break the blockade and end the collective punishment of the Palestinian people. We must bring an end to apartheid and occupation.

We are appalled at the US and UK refusing to support the resolutions at the United Nations Security Council calling for a ceasefire to allow humanitarian aid access to the Gaza Strip. The complicity of powerful Western nations in enabling Israel to carry out these actions with impunity is a matter of grave concern. Despite the growing evidence of human rights violations, the provision of military and financial support to Israel from these nations continues unabated. The disregard for the lives of Palestinian people is inexcusable, and it is incumbent upon these nations to end their arming of Israel and prioritise human rights.

We also call out the role and bias of politicians and international media, led by northern media, fueling the islamophobic rhetoric and dehumanization of the Palestinian people as well as the role of international tech companies and platforms in allowing the rise of islamophobic and anti-semitic hate speech and fake news.

We condemn the attempt by Northern Governments – from Germany, France, to the UK, to attempt to criminalize and ban our movements from marching and calling for Justice for Palestine. The attacks on our right to protest mirror the attacks on climate protests that are taking place in countries that bear the greatest responsibility for these injustices.

We stand in immutable solidarity with the people of Gaza and all victims of brutality and demand upholding of international law and human rights principles to protect innocent civilians.

We also stand in solidarity with Palestinians and Jews who are protesting Israel’s bombardment of Gaza and advocating for peace and justice in the region. We condemn actions taken by several governments around the world to stop these protests and the arrest of peaceful demonstrators.

There can be no peace without justice and it is a moral imperative for the global community to stand in unity with the oppressed. We call on all our governments and international bodies to work together to end the war, and to bring all those responsible for war crimes to justice. We demand an end to the occupation and genocide of the Palestinian people and urge for resolution that can ensure that both Palestinians and Israelis can live with security and dignity.

 

Our Demands
In light of the ongoing violence and the appalling human rights violations in Gaza by the apartheid state of Israel, we call for the following urgent measures:

Immediate Ceasefire: We echo the calls of the United Nations Secretary General and  humanitarian and human rights organisations for an immediate ceasefire in Gaza.

End the illegal blockade: Urgent humanitarian and emergency aid must be provided to civilians in Gaza. The people of Gaza are in dire need of medical supplies, food, water, and other essential resources, which need to be restored urgently.

Stop War Crimes: Israel must be held accountable for its actions that breach international law, including attacks on hospitals, forced evacuations, and the illegal blockade on Gaza for decades.

End Impunity: All those responsible for war crimes including the State of Israel must be held to account for their actions. All civilian hostages, including the thousands of Palestinian political prisoners held without charge or trial must be released. Western powers must stop their support for Israel, including ending arms sales to Israel particularly in the context of human rights violations and stop all support and funding to Israel immediately. Political alliances should not take precedence over human lives.

End Apartheid and Occupation: We support the self-determination of the Palestinian people. We call on Israel to end its system of apartheid and for the right of return and compensation to Palestinian refugees. We call on the international community to finally uphold the UN resolutions for a safe, secure and viable State of Palestine alongside a State of Israel.

Stop Racism, Islamophobia and Anti-Semitism: We stand in solidarity with our comrades in the Jewish and Muslim communities facing an increase in racist attacks. The struggle for climate justice is a struggle for racial justice.

    설악산케이블카 무조건 추진한다! 윤석열 대통령의 공약이었습니다. 삭도가 설치되는 설악산국립공원은 유네스코 생물권보전지역과 백두대간 핵심보호지역 등 4개의 보호지역으로 중첩지정되어 보호 필요성이 매우 요구되는 지역입니다. 한국환경연구원, 국립환경과학원, 국립기상과학원 등 전문기관들이 설악산오색삭도 설치계획에 대해 부적정 의견을 피력하였음에도 환경부와 국립공원공단은 대통령 하명을 받들어 일사천리로 사업을 허가했습니다. 사업자 양양군은 오는 11월 20일(월)에 착공식을 개최한다고 발표했습니다. 설악산이 파괴되는 현실이 우리 눈앞에 다가왔습니다. 비단 설악산만의 문제가 아닙니다. 오색삭도 환경영향평가 조건부 동의와 이번 공원사업시행허가 이후 전국의 명산이 위치한 지자체장들은 환경부를 향해 공원관리계획 변경을 요구하기 시작하였습니다.  지리산, 북한산, 속리산, 무등산, 팔공산, 신불산, 황령산....  이름만 들어도 알 수 있는 산에 삭도를 막을 수 있는 유일한 방법은 오색삭도에 있습니다.   꺾이지 않고, 끝까지 저항합니다!  민주사회를 위한 변호사모임 환경보건위와 녹색법률센터 변호사들은 '설악을 지키는 변호사들 모임'을 다시 시작하였습니다. 양양군민들과 시민들과 함께 설악산케이블카 공사를 막기 위해 행정소송을 진행합니다. 국립공원 사업시행허가 취소소송을 통해 다투겠습니다. 설악산을 지키고자 하는 시민들의 모든 의지와 소망과 설악산에 대한 사랑을 담아내겠습니다. 소송인단 참여에 많은 관심과 참여를 부탁드립니다. ✅ 소송인단 모집기간: 2023년 11월 8일(수) ~ 11월 14일(화)까지 ✅ 문 의: 02-961-6547(설악산국립공원지키기국민행동, 팀장 이이자희), [email protected]                02-583-5700(법무법인 자연, 설악을 지키는 변호사들, 변호사 최재홍) ✅ 소송인단 모집 공유 주소: https://bit.ly/saveseorak2023  

11월 20일로 다가온 설악산 케이블카 착공식

윤석열 정부 이후 여당과 야당을 가리지 않고 생태 파괴에 대한 정책이 쏟아져 나오고 있습니다. 그중 우리나라 최상위 보호구역인 국립공원에 대한 생태 학살 개발인 케이블카 건설과 산악 열차에 대한 목소리가 높아지면서, 설악산 케이블카에 대한 환경영향평가에 대한 협의가 진행됐습니다. 현재 발생하고 있는 환경 현안에 대한 공통점은 상징성 있는 지역을 선제적으로 무너뜨리고 있다고 보입니다. 국립공원의 상징성을 갖고 있는 설악산에 대한 케이블카 건설을 환경부가 협의하면서 지리산(산청, 구례, 함양), 소백산, 속리산, 가야산, 무등산, 치악산, 북한산 등 국립공원이 속한 국내 지자체에서 산악 개발에 대한 요구가 빗발치고 있는 상황입니다. 시민과 함께 운동하는 환경운동연합은 오는 11월 20일 우려했던 설악산 케이블카 착공식이 진행된다는 비통한 소식을 시민께 알려드립니다. 2022년 기준으로 전국에 설치된 관광용 케이블카는 총 41대지만 대부분 적자를 기록하고 있습니다. 그런 상황 속에서도 환경부는 올해 2월 설악산 케이블카 건설을 협의했습니다. 면피용으로 사용한 환경부의 조건부 협의는 실상을 들여다보면 “협의”와 다름이 없습니다. 이제 국립공원의 상징인 설악산에 케이블카 건설이 시작되면, 경제적 가치 창출이라는 실현하기 어려운 명분으로 국립공원을 포함한 많은 산지에 케이블카, 산악 열차 등의 사업이 진행될 것이 불 보듯 뻔합니다. 산지에 대한 생태 학살, 개발은 어려운 사회적 상황에서 발생한 시민의 귀중한 혈세를 일부 개발업자의 재정을 채우게 한다는 예산의 문제도 있지만, 더 중요한 문제는 파괴되면 복원되기까지 너무나 긴 시간이 걸리는 산지 생태와 생물다양성의 파괴라는 문제입니다. 최상위 보호구역, 국립공원의 생태적 가치는 돈으로 환산할 수 없습니다. 11월 20일 정부는 설악산 오색 삭도 착공식으로 생태 학살의 첫 삽질을 시작합니다. 환경운동연합은 회원 여러분과 시민 여러분, 환경운동연합을 포함한 설악산국립공원지키기국민행동은 생태 학살의 시작을 막기 위해 여러분의 참여를 요청합니다.

조명래 환경부장관님!

제주 제2공항과 비자림로에 대한 엉터리 환경영향평가 때문에 사람들이 농성을 하고 있다는 소식을 들으셨는지요? 제주 제2공항 전략환경영향평가서를 장관님이 반려하기를 요구하며 노민규 씨는 2019년 10월 18일부터 세종시에 있는 환경부 청사 앞에서 단식 농성을 하고 있습니다. 제주 비자림로 소규모환경영향평가가 잘못되었다면서 영산강유역환경청에 ‘공정한 사계절 정밀조사’와 ‘환경영향갈등조정협의회 구성’을 촉구하면서 김키미 씨가 10월 16일부터 광주에 있는 영산강유역환경청 앞에서 농성을 하고 있습니다.

사람들이 이렇게 농성을 하는 이유는 장관님도 잘 아시는 것처럼 환경영향평가라는 제도가 한참 잘못되었기 때문입니다. '개발사업이 환경에 미치는 영향을 최소화하기 위해, 환경보전방안을 마련함으로써, 지속가능한 발전을 도모하고 국민의 환경권을 지키는 것'이 환경영향평가제도의 목적입니다.

그런데 현행 법률은 개발업자가 대행업자에게 돈을 주고 환경영향평가를 시키도록 규정하고 있습니다. 환경영향평가 결과 개발사업이 환경에 미치는 영향이 크면 그 개발 사업 자체를 못할 수도 있는데 어떻게 자기 자신의 개발사업을 막아 달라고 돈을 주고 시키겠습니까? 그렇기 때문에 환경영향평가는 1993년에 법률이 제정될 때부터 엉터리였습니다. 처음부터 환경영향평가는 엉터리로 될 수밖에 없고 그 때문에 국민의 환경권은 개발업자들에게 강탈당할 수밖에 없었습니다. 이런 엉터리 환경영향평가 제도가 우리나라 사회적 갈등의 주요 원인이라는 점을 이미 환경부 산하 연구기관도 지적하고 있습니다.

환경영향평가 개선은 대통령 공약

문재인 대통령도 이미 이런 문제점을 알고 환경영향평가 제도의 개선을 공약했습니다. 개발업자가 환경영향평가 대행업체를 스스로 선택하면 환경영향평가가 엉터리로 될 수밖에 없기 때문에 환경영향평가 비용을 먼저 납부하면 공인기관이 평가 대행업체를 선정하는 방식입니다. 이 좋은 제도를 2018년부터 도입하겠다고 약속했지만 2019년 10월 지금까지 이 공약은 지켜지지 못하고 있습니다.

물론 이 공약을 지키려면 국회가 환경영향평가법을 개정해야 하기 때문에 환경부장관도 대통령도 마음대로 할 수 없다는 것 저도 이해합니다. 하지만 설령 그것이 국회의 권한이라 하더라도 국회를 설득하기 위해 장관님이 할 수 있는 일이 있지 않겠습니까?

예를 들어 개발업자들은 환경영향평가법을 위와 같이 개정하는 것에 반대할 수도 있습니다. 하지만 법이라는 것은 국민 전체의 이익을 위해서 만들어지는 것이기 때문에 환경영향평가 공탁제를 도입하는 것이 사회 갈등 비용을 줄임으로써 국민 전체의 이익을 극대화하는 방법이라는 사실을 연구를 통해 밝혀낼 수도 있습니다. 환경부가 그런 연구를 하면 됩니다. 그렇게 합리적인 근거로 설득해도 국회가 움직이지 않는다면, 제가 만일 환경부장관이었다면, 저는 국회 앞에서 농성이라도 하겠습니다. 국민을 위한 길이라면 왜 못하겠습니까? 문재인 대통령이 조명래 장관님을 환경부장관으로 임명한 것은 바로 그런 일을 부탁하기 위해서 아니었을까요? 대통령이 모든 부처의 일을 일일이 챙기기 어려우니, 대통령의 공약을 지키기 위해서 장관님이 대신 일을 좀 해달라고 부탁한 게 아니었을까요? 그런데 장관님은 2018년 11월 장관에 취임한 이후 대통령의 이 공약을 이행하기 위해 구체적으로 무슨 일을 하셨나요?

조명래 장관님이 전에 했던 말씀들

"오늘날 한국의 환경문제는 환경부의 환경정책이 잘못되었기 때문에 발생하는 것이 아니라 개발 부서의 경제중심 개발과 성장 정책의 남용에서 비롯되고 있다. 따라서 비환경부서의 정책과제들을 얼마만큼 환경친화적인 것으로 만들어내느냐에 한국환경의 미래가 달려 있다 할 수 있다. 환경문제는 환경부문으로 좁히는 현재의 칸막이식 행정으로 해결할 수 없고, 도시개발, 자원관리, 문화복지 전반에 녹색성이 반영되면서 이를 중심으로 상호 조정하는, 즉 환경중심의 통합행정 체제가 강구될 때 해결될 수 있다." 

"한국사회에 만연한 개발주의는 어떠한 희생과 대가를 치러서라도 극복되어야 한다. 개발주의에 포로가 된 정치경제 시스템을 바꾸어야 하고, 외형적 성장 중심의 발전의 문법을 바꾸어야 하며, 국가 영역을 넘어 시장 영역으로 넘어간 권력의 작용 방식을 바꾸어야 한다."

위의 두 글은 조명래 장관님이 학자로서, 연구자로서 과거에 쓰신 논문에 있는 내용입니다. 각각 2011년과 2015년에 써서 발표하신 내용이니 그리 오래된 것도 아닙니다. 아마 문재인 대통령은 위와 같은 글들을 보고 환경 보호에 대한 장관님의 의지를 믿고 장관에 임명하신 게 아닐까요?

장관님이 하신 말씀을 실천할 기회: 바로 지금

저런 말씀들을 지금 2019년에 누가 언제, 어떻게 실행해야 할까요? 바로 장관님 자신입니다. 장관으로 재직하고 계신 지금이 바로 저 말씀들을 실행할 가장 좋은 기회입니다. 장관을 해보니 한계가 너무 많다고요? 이해합니다. 하지만 그런 한계에도 불구하고 자신이 할 수 있는 모든 일을 하는 사람 언행일치를 실천하는 사람이야말로 존경받는 학자요 장관이라고 할 수 있지 않겠습니까?

저 글의 내용을 실천하는 가장 쉬운 방법이 바로 환경영향평가입니다. 환경영향평가 결과에 따라 환경부 장관이 개발사업을 취소할 권한이 생긴다면 바로 위에서 말씀하신 것처럼 환경중심의 통합행정 체제가 될 수 있습니다. 거기까지 가기가 힘들다면 대통령 공약인 환경영향평가 공탁제만 이행하더라도 개발주의를 넘어서는 데 큰 도움이 됩니다.

장관님이 말씀하신 대로 ‘어떤 희생과 대가를 치러서라도 극복되어야 할 것’이 바로 우리 사회에 만연한 개발주의입니다. 그 희생과 대가를 장관님 스스로 치를 절호의 기회가 바로 지금입니다. 그러니, 대답해 주십시오. 장관님은 개발주의를 극복하고 환경중심의 통합행정을 이루기 위해 어떤 희생과 대가를 치르시겠습니까? 환경부 앞에서 단식 투쟁을 하고 있는 노민규 씨처럼 국회 앞에서 환경영향평가법 개정을 위해 단식 투쟁을 하시겠습니까? 아니면 영산강유역환경청 앞에서 농성을 하고 있는 김키미 씨처럼, 국회 앞에서 농성이라도 하시겠습니까? 그것도 힘들다면 노민규 씨와 김키미 씨가 요청하는 사항들이라도 들어줄 순 없습니까?
