2018년 세법개정안 건의서 기획재정부 제출

심각한 자산불평등 문제 해결하기 위해 종합부동산세 정상화해야

참여연대 조세재정개혁센터는 2018년 세법개정안 건의서를 기획재정부에 제출했습니다. 현재 우리나라의 양극화 현상은 심각한 상황입니다. 소득불평등뿐만 아니라 자산불평등 문제 역시 묵과할 수 없는 상황입니다. 현재 상위 5%가 전체 자산의 절반 정도를, 상위 1%가 25% 정도를 소유하고 있습니다. 이러한 불평등 문제를 해소하기 위해서 가능한 수단 중 하나는 부동산 보유세입니다. 우리나라의 부동산 보유세 중 고가의 부동산에 대해 부과하는 종합부동산세는 부동산 투기를 통한 불로소득 추구를 억제하는 효과가 있습니다. 특히 공급량이 제한적인 부동산에 대한 세금은 개별 경제주체들의 경제활동에 영향을 미칠 가능성이 적어 경제학자들에게도 경제 효율성에 악영향을 미치지 않는 세금으로 여겨지고 있습니다. 그러나 이러한 취지로 도입된 종합부동산세는 현재 세율이 도입 당시와 비교해 절반으로 인하되는 등 본래의 기능을 다하지 못하고 있습니다. 본래의 취지를 살리기 위해 종합부동산세의 세율을 제도가 도입된 시점의 수준으로 정상화시키는 것이 필요합니다.

 

상속은 증여와 함께 대표적으로 경제적 가치가 있는 부를 무상이전하는 원인이며 이러한 부의 무상이전은 금수저, 흙수저와 같은 출발선의 차이를 발생시키며 부의 불평등을 더욱 심화시킵니다. 그러나 일괄공제 금액 기준이 높아 2015년 기준 상속세 과세자는 대상자 전체의 2.4%밖에 되지 않습니다. 또한 중소기업의 가업 승계를 지원하기 위한 제도인 가업상속공제의 경우 가업의 요건과 공제대상 기업의 기준이 넓고 공제한도가 너무 높아 일부 고액 자산을 보유한 상위계층에게 특혜를 주는 결과를 초래하고 있습니다. 이러한 문제들을 해결하기 위해 상속세의 경우 일괄공제 금액을 5억 원에서 3억 원으로 인하하고 가업상속공제의 경우 가업의 범위를 자산 규모까지 고려하며 최대 500억 원까지 되어 있는 공제한도를 축소할 필요가 있습니다.

현재 2천만원인 금융소득종합과세의 기준 금액을 하향 또는 폐지하는 것이 필요합니다. 근로소득이 종합과세되는 것과 비교해 금융소득은 각종 비과세, 분리과세를 통해 낮은 세율을 적용받고 있으므로 금융소득에 대한 과세를 강화해 조세형평을 제고할 필요가 있습니다. 또한 저소득자의 경우 낮은 소득세율로 세금을 부담하기 때문에 금융소득종합과세 기준금액을 낮춰도 영향이 거의 없는 반면 높은 한계세율을 적용받는 고소득자일수록 금융소득에 대한 분리과세로 혜택이 커지므로 금융소득종합과세를 강화해 조세의 수직적 형평을 제고할 필요가 있습니다.

올해부터 시작된 종교인소득 과세는 크게 세 가지 문제점을 가지고 있습니다. 첫째, 종교인소득은 원천징수의무자인 종교단체의 원천징수방법에 따라 기타소득 또는 근로소득 두 세목으로 신고납부할 수 있는데 이는 일반 납세자가 조세법률주의에 따라 정해진 세목으로 신고납부해야 하는 것과 비교해 과세형평성을 크게 저해하고 있는 것입니다. 둘째, 종교인소득을 기타소득(2천만원까지 80%)으로 과세하는 경우 필요경비공제가 근로소득공제(5백만원까지 70%)에 비해 지나치게 과다해 과세형평성의 문제를 초래하고 있습니다. 셋째, 종교단체가 종교단체회계와 종교인회계를 정당하게 구분하여 기록관리하는 경우, 종교단체회계에 대한 세무공무원의 질문조사권이 제한되는 문제입니다. 예를 들어 종교인소득을 해당 종교인이 소속된 종교단체로부터 받는 소득으로 규정하고 있어 종교단체가 해당 단체에 속하지 않은 외부 종교인에게 지급한 강연료 등은 종교인소득이 아니므로 일반적인 기타소득으로 보아야 할 것인데 이를 종교단체회계인 종교활동비용으로 잘못 구분 기록하고 원천징수도 하지 않은 경우에 과세할 방법이 사실상 없게 됩니다. 이를 해결하기 위해 종교인소득을 기타소득이 아닌 근로소득 세목으로 규정해야 하며, 종교단체회계와 종교인회계를 구분 기록하는 것이 아니라 하나의 고유목적사업회계로 기록하는 것이 필요합니다.

소득이 있는 곳에 과세하는 것이 조세정의의 원칙이나 주택임대소득의 경우 제대로 과세가 이루어지고 있지 않습니다. 현재 2천만원 이하의 주택임대소득에 대한 과세는 2019년까지 유예되어 있으며 그마저도 낮은 세율로 분리과세를 적용하도록 되어 있습니다. 이러한 분리과세는 소규모 임대소득만을 얻고 있는 임대인보다 주택 임대 외의 다른 소득을 가진 고소득자에게 유리한 방향으로 악용될 소지가 높습니다. 현재 분리과세 적용 구간인 2천만원 기준을 1천만원으로 낮추는 등 단계적으로 분리과세 범위를 축소해야 합니다. 또한 현행 60%인 필요경비액 인정비율도 30% 수준으로 축소하고, 400만원의 기본공제 금액 역시 폐지하는 것이 필요합니다.

공공의료 강화를 위한 새로운 모델, 민간병원의 공공병원화

 

부산은 대표적으로 건강이 나쁜 도시이다. 서울과 비교했을 때 기대수명이 많게는 9.7세까지 차이가 났으며(2014년 기준, 서울 서초구와 부산 동구의 격차), 피할 수 있는 죽음도 16개 구군 중 강서구를 제외한 15개 구군이 서울의 모든 자치구보다 높게 나타났다(2013년 기준).

하지만 아이러니하게도 의료공급은 과잉된 대표적인 도시가 부산이기도하다. 병상수가 전국에서 1~2위를 다툴 정도로 많으며 요양병원 병상의 수는 전국에서 단연 1위를 차지하고 있다. 병원은 많은데 왜 건강이 나쁠까? 그 해답을 공공의료에서 찾기로 했다.

지난 9월 8일 건강정책학회와 부산대학교 공공보건의료정책센터 공동주최로 “의료의 공공성 확대·강화 어떻게 할 것인가? - 부산 침례병원 사태를 중심으로” 토론회가 부산일보사 소강당에서 개최되었다. 건강불평등 해소 운동을 진행하고 있는 사회복지연대는 지난 7월에 파산한 침례병원 사태를 공공의료강화의 기회로 삼기위해 ‘민간병원의 공공병원화’라는 공공병원 확대의 새로운 모델을 고민해 왔고 침례병원 파산에 따른 새로운 공공병원 설립을 위한 부산시민대책위와 함께 토론회에 참여하였다.

토론회에 참석한 부산의대 윤태호 교수의 발제에 따르면 부산은 7대 특·광역시 중 공공의료 수준이 취약하며(2015년 기준: 의료기관 수 6등, 병상 수 5등) 시민의 건강수준을 개선하기 위한 정책을 수행하는 것이 어려운 실정에 놓여있다.

 

 

때문에 공공병원의 확대가 필요한데, 의료공급과잉인 상태에서 새로운 병원을 짓는 것 방법보다는 민간병원을 공공이 인수(투자)하여 공공병원을 확충하는 방안이 효율적이며 600병상규모의 대형병원인 침례병원이 그 첫 사례로 적합하다는 발제가 이어졌다.

이후 토론에서는 성남의료원의 사례를 들어 주민들이 간절하게 원하고 자랑할 수 있는 공공병원, 민간병원이라 할지라도 민주적으로 운영될 수 있도록 주민이 이사회에 참여하는 병원 등 공공성 확대를 위한 병원의 미래상에 대한 토론과 침례병원을 공공이 인수하기 위한 현실적인 방안과 한계 등의 토론들이 이어졌다.

토론회의 좌장을 맡았던 김용익 전 의원은 민간병원의 공공병원화는 향후 공공의료를 강화하는데 필수적인 방법이며, 민간병원을 공공병원화 하는 침례병원의 사례와 주민들이 참여하고 자랑스러워할 수 있도록 올바른 공공병원 운영을 추진하는 진주의료원의 재개원의 사례를 함께 고민하며 부울경 지역의 공공의료를 강화시키기 위해 노력해야 한다고 이야기했다.

사회복지연대는 지난 2013년, 부산일보사와 공동기획한 ‘건강최악도시부산’시리즈 이후로 부산의 건강불평등 해소와 공공의료 강화를 위해 노력해왔다. 토론회를 통해 이번 침례병원사태가 오히려 기회가 될 수 도 있다는 생각이 들기도 한다. 물론 민간병원을 공공이 인수하는 것이 쉬운 길은 아니겠지만 건강최악도시부산이 건강최고도시 부산으로 거듭날 수 있도록 사회복지연대는 계속해서 활동할 것이다.

'2017 권리로 요구하는 천안시 사회복지 정책제안 토론회'

시민 정책참여과정을 통해 모은 시미느이 목소리를 천안시 정책으로 제안

 

참여예산복지네트워크(사무국 : 복지세상을 열어가는 시민모임)는 9월 19일(화) 권리에 기반한 시민 정책참여과정으로 시민이 직접 천안시에 필요한 정책 7건을 발표하는 ‘2017 권리로 요구하는 천안시 사회복지 정책제안 토론회’를 천안축구센터에서 진행하였다.

정책제안 토론회는 아동, 청소년, 노인, 장애인, 이주민, 자활참여주민, 대학생 등 7개 영역에서 158명의 복지 당사자와 사회복지기관․단체 현장 실무자가 직접 권리워크숍과 원탁회의, 정책모니터링에 참여하며 문제점과 개선방안을 도출한 결과, 최종 7건의 정책을 천안시에 요구하는 자리이다.

 

2017년 시민 정책참여과정은 아동부터 노인, 장애인 등 총 158명이 4월 인권교육을 시작으로 각각 8번의 권리워크숍을 통해 320여가지 결핍점을 생생하게 이야기한 후, 75명이 한 자리에 모여 ‘권리원탁회의’를 통해 16가지 주제 중 ‘내 삶에서 가장 결핍된 점’에 대해 세부토의를 진행하고 우선순위 투표를 거쳤다. 이후 네트워크 기관․단체와 당사자가 함께 정책모니터링을 통해 실태와 문제점, 개선방안을 도출한 후 최종적으로 ‘저소득층 중․장년층 1인가구 고독사 예방 및 보호대책 마련’ 등 총 7건의 정책제안서를 작성하였다. 제안된 제안서는 9월 초 천안시 각 해당 부처에 정책을 전달하고 부서별로 의견서를 수렴하였다.

 

정책별 천안시 해당부서 사전 검토의견 수렴은 올해로 4년째 시행하고 있는 과정으로 사전 검토의견을 요청하기 이전보다 시민들의 삶을 더욱 살피며 책임 있게 정책을 수행하는 등 긍정적인 효과를 나타내고 있다. 그러나 부서검토 결과 7건 중 4건이 미반영과 보류 결과를 보이며, 절반이 넘게 시민의 의견이 반영되지 못하였다.

특히 저소득층 특수촬영 의료비 지원의 경우 참여예산복지네트워크에서 3년동안 제안하여 2015년 천안시장 공약사업에 포함되어 조례제정 후 시행하고 있으나, 지원되는 질환의 폭이 좁아 2016년 말 기준 18.%의 예산집행률을 보이며 실질적으로 지원이 필요한 저소득층에게 제대로 이루어지지 않고 있다. 또한 저소득층 중․장년층 1인가구 고독사의 경우 기록적인 고령화와 가파른 1인가구 증가세와 맞물리면서 전국적으로 급증하며 사회문제로 떠올랐다. 현재 고독사 관련 공식적인 정부차원의 통계는 없는 상태이며, 이와 관련있는 무연고 사망자 통계의 경우 전국 222개 지자체 중 천안시가 6위로 지난해 27명이 무연고 사망자가 발생하였다. 이에 지자체별로 중․장년층 1인가구에 대한 전수조사를 실시하고 대책을 마련하는 반면 천안시는 아직 고독사 예방을 위한 조사나 대책을 마련하지 않고 있다.

 

참여예산복지네트워크는 토론회 이후 조례개정 등을 통해 제안한 정책이 실행될 수 있도록 간담회 등을 진행할 예정이며, 사회복지예산의 양적인 확대 뿐 아니라 실질적으로 시민들이 필요로 하는 정책이 될 수 있도록 활동하고자 한다.

국제 평화단체, 한반도⋅동북아 위기에 대한 외교적 해결 촉구

퍼그워시 회의 등 전세계 110개 평화단체, 무력사용 반대 입장 담은 서한을

미국과 북한 등 주요국가들에 전달

전 세계의 110개 평화단체들과 146인의 평화운동가들은 당면한 동북아와 한반도 위기에 대해 무력 사용을 반대하고 외교적 해결을 촉구하였습니다. 전 세계 평화와 군축을 위해 활동하는 이들은 이번 서한을 통해 지금의 위기가 오판과 우연에 의해 핵전쟁으로까지 비화된다면 전 세계는 핵참화를 피하기 어려울 것이라고 우려하며 △선제적 무력 사용 반대, △도발적인 군사연습 중단, △동북아비핵지대안 검토, △한국전쟁 종전, △6자회담 재개, △유럽연합의 외교적 협상 지원 환영, △외교적 해결 우선 등 7개 요구사항을 제시하였습니다.

 

이들은 이러한 입장을 담은 서한을 지난 9월 7일 남⋅북⋅미⋅중⋅러⋅일 등 6개국 대통령(또는 수상)과 유엔주재 대표, 유엔안보리 회원국, 안토니오 구테레스 유엔 사무총장 그리고 페데리카 모게리니 유럽연합 외교안보 고위대표에게 보냈다고 밝혔습니다. 

 

이번 공동서한에는 퍼그워시 회의(Pugwash Conference), Campaign for Nuclear Disarmament(영국), Coalition for Peace Action(미국), 원수폭금지협의회(일본), 참여연대(한국) 등 전세계 24개국에서 활동하는 평화단체들과 1976년 노벨평화상 수상자인 메어리드 코리건 매과이어(Mairead Corrigan Maguire)를 비롯한 대표적 평화운동가들이 함께 하였습니다.

▣ 공동서한 국문

 

동북아 상황의 외교적 해결을 호소합니다

 

전 세계에서 평화와 군축을 위해 활동하는 ‘어볼리션(Abolition) 2000’의 회원단체들을 대신하여 미국과 북한에 동북아가 직면하고 있는 전쟁 직전의 상황에서 한 걸음 물러나, 대신 전쟁을 막기 위한 외교적 접근법을 택하라고 촉구합니다. 

 

우리는 군사 갈등이 발발하는 것을 막고 나아가 근본적인 갈등을 해결하기 위해 즉시 협상에 나설 것을 요구합니다. 그러한 협상은 양자 간은 물론 중국, 일본, 북한, 러시아, 한국, 미국을 포함하는 새로운 6자회담 틀을 통해 이뤄져야 합니다. 

 

북한의 핵‧미사일 능력을 두고 고조되는 긴장과 군사 갈등 위협은 외교적 해법이야말로 필수적이며 최우선임을 다시금 일깨워줍니다. 전쟁 위기가 높아지고 오판과 우연, 또는 의도에 의해 핵무기가 사용될 수도 있다는 사실은 매우 끔찍한 일입니다. 

 

1950년에서 1953년까지 이어진 한국전쟁에서 목숨을 잃은 사람들의 수는 남북, 중국, 미국 등 다 합해 총 300만 명을 넘습니다. 만일 전쟁이 다시 발발한다면, 특히 핵무기가 사용된다면 사망자 수는 훨씬 더 많을 것입니다. 한반도에서 발발하는 핵전쟁은 핵 참사로 전 세계를 집어 삼킬 것이며 이는 우리 모두가 알듯이 문명의 종말을 가져올 것입니다. 

 

전쟁보다 외교적 해법을 지지하며, 우리는 다음과 같이 요구합니다.

  1. 우리는 그 어느 측의 선제적 무력 사용에도 반대합니다. 이는 역효과를 낳을 것이며 상황을 핵전쟁으로 이끌 것입니다. 
  2. 우리는 모든 측에 군국주의적 수사와 도발적인 군사 연습을 그만두기를 촉구합니다. 
  3. 우리는 중국, 일본, 북한, 러시아, 한국, 미국이 3+3 방식의 동북아 비핵지대 수립을 위한 단계적이고 포괄적인 접근법을 검토하기를 권합니다. 이는 일본과 한국에서 두 개 이상의 정당의 지지를 받고 있으며 북한 정부도 관심을 가지고 있습니다. 
  4. 우리는 중국, 일본, 북한, 러시아, 한국 그리고 미국이 또한 한국전쟁(1950-1953)을 공식적으로 끝내도록 1953년 정전협정을 전환하기 위한 가능한 옵션과 양식을 고려할 것을 권합니다. 
  5. 우리는 6자회담을 재개하라는 유엔 사무총장의 요구와, 협상을 지원하겠다는 그의 제안을 환영합니다. 
  6. 우리는 이란 핵 프로그램 협상을 성공적으로 이끌었던 것처럼 외교적 협상을 지원하겠다는 유럽연합(EU)의 제안 역시 환영합니다. 
  7. 우리는 유엔 안전보장이사회에 갈등에 대한 외교적 해결을 우선시할 것을 요구합니다. 

 

* 3+3 틀은 일본, 한국, 북한이 핵무기를 보유하거나 반입하지 않고, 중국과 러시아, 미국이 일본, 한국, 북한에 핵무기를 배치하지도, 이들을 핵무기로 공격하겠다고 위협하지도 않을 것을 요구합니다.

Appeal for a diplomatic solution in North East Asia

 

The Abolition 2000 members and affiliated networks listed below, representing peace and disarmament organisations from around the world, call on the United States and North Korea to step back from the brink of war in North East Asia, and instead adopt a diplomatic approach to prevent war. 
 
We call for the immediate commencement of negotiations to prevent a military conflict from erupting, and to resolve the underlying conflicts. Such negotiations should take place both bilaterally and through a renewed Six-Party framework involving China, Japan, North Korea, Russia, South Korea and the United States.
 
The escalating tensions and threat of military conflict over North Korea's nuclear and missile capabilities makes a diplomatic solution of vital importance and the highest priority. The increasing risk of war - and possibly even the use of nuclear weapons by miscalculation, accident, or intent - is frightening. 
 
More than three million citizens of Korea, China, USA and other countries lost their lives in the Korean War from 1950-1953. Should a war erupt again, the loss of lives could be considerably worse, especially if nuclear weapons are used. Indeed, a nuclear conflict erupting in Korea could engulf the entire world in a nuclear catastrophe that would end civilization as we know it.
 
In supporting diplomacy rather than war, we:
 

  1. Oppose any pre-emptive use of force by any of the parties, which would be counter-productive and likely lead to nuclear war;
  2. Call on all parties to refrain from militaristic rhetoric and provocative military exercises; 
  3. Encourage China, Japan, North Korea, Russia, South Korea and the United States to consider the phased and comprehensive approach for a North-East Asian Nuclear-Weapon-Free Zone with a 3+3 arrangement*, which already has cross-party support in Japan and South Korea and interest from the North Korean government;
  4. Encourage China, Japan, North Korea, Russia, South Korea and the United States to also consider options and modalities for turning the 1953 Armistice Agreement into a formal end to the 1950-1953 Korean War;
  5. Welcome the call of the UN Secretary-General for a resumption of Six-Party talks and his offer to assist in negotiations;
  6. Welcome also the offer of the European Union to assist in diplomatic negotiations, as they did successfully in the negotiations on Iran’s nuclear program;
  7. Call on the United Nations Security Council to prioritise a diplomatic solution to the conflict

 
* The 3+3 arrangement would include Japan, South Korea and North Korea agreeing not to possess or host nuclear weapons, and would require China, Russia and the USA agreeing not to deploy nuclear weapons in Japan, South Korea or North Korea, nor to attack or threaten to attack them with nuclear weapons.

정부가 지난해 세법 개정을 통해 도입한 ‘배당소득 증대세제’가 올해부터 적용된다. 이제 기업이 배당성향, 배당수익률 등의 조건을 갖출 경우에, 주주들이 기업으로부터 받는 배당금에 대한 세금이 대폭 줄어든다. 기업의 이익 잉여금을 가계소득으로 돌림으로써 경기를 활성화하겠다는 것이 박근혜 정부의 정책 요지였다. 그러나 배당소득 대부분이 고소득자들 몫이기 때문에 정책 효과가 크지 않을 것이라는 전망이 나오고 있다.

뉴스타파는 삼성 그룹과 현대자동차 그룹의 총수 부자가 박근혜 정부의 새로운 세제를 통해 얼마나 많은 혜택을 받게 되는지를 계산해봤다.

1. 배당 소득 3,575억

삼성그룹의 이건희 회장과 아들 이재용 부회장, 현대자동차그룹의 정몽구 회장과 아들 정의선 부회장의 배당 소득은 얼마일까? 이들이 현재 갖고 있는 주식 수(2015년 12월 20일 기준)에 2014년도 기준 배당금을 곱해서 이들이 받게 될 배당액수를 계산해봤더니 합계가 3,575억에 이르는 것으로 나타났다.

2. 세수 손실

종전까지 배당소득은 금융소득종합과세를 통해 6%에서 38%까지의 세율이 적용됐다. 총수일가 4명의 배당소득 3,575억 원에 최고 세율인 38%가 적용될 경우 내야 하는 세금은 1358억 5천만원이다. 그러나 배당소득증대세제가 적용될 경우, 이들이 내야 하는 세금은 25% 수준으로 크게 줄어든다.이로 인한 세수 손실은 464억 원에 이를 전망이다.

공정거래위원회가 삼성계열 공익법인으로 분류한 곳은 세 곳.삼성생명공익재단,삼성문화재단,삼성복지재단이다.뉴스타파가 기획재정부에 정보공개를 통해 받은 자료에 따르면 2016년 상반기 현재 이들 3개 공익재단은 모두 ’성실공익법인’으로 지정되어 있다.공익재단이 정부로부터 ’성실공익법인’으로 지정되면 각종 혜택이 주어진다.특히 계열사 주식을 상속이나 증여받을 수 있는 한도가 일반 공익법인에 비해 2배나 된다.일반공익법인은 발행주식 총수의 5%한도 내에서만 계열사 주식을 상속,증여받아야 면세조치를 받을 수 있지만,성실공익법인은 10%한도까지 계열사 주식을 상속,증여 받아도 세금이 0원이 된다는 말이다.

이것이 삼성 이건희 회장 일가에게 의미하는 것은 무엇일까? 여기에 삼성그룹이 공익재단을 유지하는 진짜 이유가 숨어있다고 전문가들은 말한다.

1. 33 대 31

삼성의 대표적인 공익재단으로 꼽히는 삼성생명공익재단이 하는 일은 세가지로 분류된다. 삼성생명공익재단은 수익용 사업으로 삼성서울병원을 운영하고 있고 고유목적사업인 공익사업으로는 노인복지시설과 어린이집을 운영하고 있다.그런데 홈페이지를 자세히 살펴보면 이상한 점이 발견된다. 삼성그룹 계열사 임직원들의 자녀들만 등록 가능한 어린이집이 전국에 33곳,일반 시민들에게도 개방된 어린이집은 31곳이다. 33대 31.

삼성직원 전용 어린이집이 더 많지만 공익사업으로 분류되고 있는 것이다.실제 취재진이 찾아간 한남동의 어린이집은 고급대형주택을 어린이집으로 개조한 곳으로 인근에 본사를 둔 제일기획 임직원들을 위한 시설이다.인근 지역 주민들의 자녀는 들어가는 게 불가능했다.서초동이나 태평로 삼성 사옥 내에 입주해 있는 어린이집의 경우도 아예 일반인들의 출입 자체가 통제되는 곳들에 위치해 있었다.이렇게 전국 곳곳에 있는 삼성 사옥이나 공장 인근에 자사 직원용 어린이집을 운영하면서도 삼성은 이를 자신들의 주요한 ’공익사업’으로 부르고 있다.

2. “생활비가 높다보니까 중상류층들이 입주하죠”

삼성생명공익재단이 운영하는 노인복지시설도 이상하기는 마찬가지다.삼성생명공익재단이 운영하는 노인복지시설의 이름은 ’노블카운티’.경기도 용인에 위치한 노블카운티의 안내 직원 설명에 따르면 이 곳은  “30평부터 72평까지 10가지 평형대가 구비되어 있고,최소 입주 보증금이 3억 원에 매달 생활비 역시 최소 200만 원 정도를 납부해야 하며,몸이 아파 간호사등의 조력이 필요한 노인이라면 매달 600만 원정도를 내야 하지만,높은 서비스 수준을 추구하기 때문에 이렇게 운용해도 수익이 많이 남지 않는” 그런 곳이었다.

현실적으로 중상류층 은퇴자들만 입주가 가능한 곳이라는 말이다.입주자 모집을 위한 안내 자료에도 ’시니어 명품 주거타운’이라고 적혀 있었다.

3. 삼성의 거짓말

이런 ‘공익사업’들을 보면 삼성이 공익재단을 통해 정말 우리 사회의 공익에 진정으로 기여하겠다는 의지가 있는 것인지 의심스럽다.그러나 이런 식으로 공익재단을 유지하기만 해도 삼성은,아니 정확히 말하자면 이건희 회장 일가는 국가로부터 혜택을 받게 된다.가장 큰 게 세금혜택이다.공익법인에 출연된 자산에는 상속세나 증여세가 붙지 않는다.이미 삼성은 삼성생명공익재단을 비롯해 삼성문화재단,삼성복지재단등에 계열사의 주식을 증여했다.올 상반기 현재 이들 3곳의 재단들이 보유한 삼성 계열사 주식의 가치는 3조 원에 이른다.

이게 의미하는 것은 2가지다. 먼저 공익재단들은 삼성계열사의 지분을 넘겨받을 때 공익적 목적에 사용한다는 명분으로 세금을 한푼도 내지 않는다는 점,둘째는 그로 인해 이재용 삼성전자 부회장이 공익재단의 이사회만 장악하고 있다면 이들 계열사가 넘긴 주식을 통해 세금 한 푼 내지 않고 삼성그룹의 지배권을 더욱 강화할 수 있게 된다는 말이다.이는 세금을 피해가기 위한 사실상의 편법 증여로 사회적 비판을 받아왔고 삼성도 이런 비판여론을 의식해서인지 앞으로는 세금을 제대로 내겠다고 언론에 밝힌 적도 있다.

그러나 삼성은 이런 사회적 약속을 한 지 채 1년도 지나지 않아 올 2월에 또 다시 삼성생명공익재단을 통해 삼성그룹의 지주사라고 할 수 있는 삼성물산 주식 3천억 원 가량을 취득했다.이 당시 삼성생명의 공익재단 이사장은 이재용씨였다.

당시 이사회 진행과정에서도 9명의 이사진은 사실상 거수기 역할에 머물렀던 것으로 뉴스타파 취재 결과 드러났다.이에 대해 참여연대 김남근 변호사는 공익적 목적에 써야 할 재단의 자산으로 계열사 주식을 취득해서 사실상 자신의 그룹에 대한 지배력을 강화한 것이 확실한 만큼 국세청은 이에 대해 당연히 증여세를 부과해야 한다고 말했지만,국세청이 과연 삼성에 세금을 부과할 수 있을지는 미지수다.

4. “이재용뿐만 아니라 그 아들의 아들까지…”

더 큰 문제는 앞으로다.이건희 회장은 삼성전자 지분 3.49%(보통주 498만여주)와 삼성생명 지분 20.76%(보통주 4천1백여만주)를 포함,14조 원 가량의 삼성그룹 계열사 주식을 보유하고 있다.만약 삼성이 여론의 거센 비판에도 불구하고 그동안 해왔던 편법 그대로 이건희 회장의 주식을 앞에서 열거한 3곳의 삼성 계열 공익재단들에게 넘긴다면 이재용 씨를 비롯한 이건희 일가는 최소 6조 원에 이르는 관련 세금을 한푼도 내지 않고 그룹의 지배권을 공고히 할 수 있다.삼성의 승계와 편법 탈세문제를 오랫동안 연구해온 김유찬(홍익대 세무대학원)교수는 ”만약 이런 식의 편법 증여나 상속이 계속된다면 이재용씨뿐만 아니라 이재용씨의 아들,그 아들까지도 이른바 공익재단이 유지되는 한 영원히 상속이나 증여세를 내지 않아도 될 것”이라고 강조했다.현재로서는 이들의 이런 행위를 법적으로 차단할 방법이 없다는 말이다.

이번엔 청계광장에서 함께 만나요.

이번 주 금요일(25일) 저녁 7시, 청계광장에서 여섯 번째 #돌마고 #불금파티 가 열립니다.

그동안 불금파티는 MBC와 KBS 앞에서 열었는데요, 더 많은 시민들과 함께 하기 위해 청계광장에서 불금파티를 엽니다. 제작중단 중인 마봉춘 아나운서 #허일후 님이 사회를 보고, #전인권 님과 #한영애 님이 초대손님으로 옵니다. 그리고, KBS와 MBC의 보도로 가슴이 무너져내렸던 #416가족합창단도 함께 합니다.

 

6번 째 불금파티는 공영방송 언론인들이 시민들과 함께 만나는 자리로 준비하고 있습니다.
그동안 KBS와 MBC에서 어떤 말도 안 되는 일들이 벌어졌는지 확인할 수 있습니다.

 

무엇보다 국민 모두가 성원했던  #마봉춘 과 #고봉순 을 하루라도 빨리 만나려면, 시민들의 응원이 절실합니다.
