2022 카타르 월드컵 건설현장에서 자행되는 이주노동자 착취 증거 최초 입수

2022년 월드컵을 앞두고 도하에 건설 중인 칼리파 인터내셔널 스타디움 현장에서 이주민 건설노동자들이 제도적인 인권침해에 시달리고 있으며, 일부는 강제노동에 내몰리는 경우도 있다고 국제앰네스티가 31일 발표한 신규 보고서를 통해 밝혔다.

보고서 <아름다운 경기의 추한 단면: 2022년 월드컵 개최지 카타르에서 벌어지는 노동 착취>는 끔찍한 처우를 받는 이주노동자들에게 충격적인 무관심으로 일관하는 국제축구연맹(FIFA)을 강력히 비판하고 있다. 월드컵 건설현장 노동자 수는 향후 2년 내에 거의 열 배가 급증한 36,000명에 이를 것으로 추정된다.

살릴 셰티(Salil Shetty) 국제앰네스티 사무총장은 “이주노동자 인권 침해 문제는 세계 축구계의 양심에 오점으로 남아 있다. 선수와 팬들에게 월드컵 경기장이란 꿈의 장소다. 그러나 인터뷰를 나눈 노동자들에게는 산 지옥과도 같은 곳이 될 수 있다”며 “FIFA는 5년 동안 공허한 약속만 되풀이했을 뿐 월드컵 준비 과정에서 벌어지는 인권침해를 전혀 막지 못했다”고 말했다.

강제노동을 비롯한 심각한 인권 침해

이번 보고서는 칼리파 스타디움 재공사 현장의 이주건설노동자 132명과 인터뷰한 내용을 바탕으로 작성되었다. 칼리파 스타디움은 2022년 월드컵 조별예선전에 앞서 가장 먼저 완공되는 경기장으로, 이곳에서 월드컵 준결승전이 치러질 예정이다. 또한 지난 겨울 바이에른 뮌헨, 에버튼, 파리 생제르맹 등의 유명 축구팀이 전지훈련을 치른 아스파이어존 주변의 녹지 조성 사업에 참여했던 이주노동자 99명의 인터뷰도 포함되었다.

국제앰네스티가 인터뷰한 정원사와 건설노동자는 모두 다음과 같은 인권침해를 겪었다고 증언했다.

  • 불결하고 비좁은 숙소
  • 카타르 취업을 위해 본국의 취업알선업자에게 500달러에서 4,300달러에 이르는 높은 수수료를 지불함
  • 일자리 유형이나 급료를 속임(남성 6명을 제외하고 사례자 전원이 현지에서 약속보다 적은 급료를 받았으며, 절반 이하의 급료를 받은 경우도 있음)
  • 수 개월에 걸친 임금 체불로 이미 큰 빚을 지고 있는 노동자들은 재정적, 감정적 압박을 느낌
  • 고용주가 체류 허가를 승인하거나 연장하지 않아 노동자들이 “무단 이탈”로 구금되거나 추방될 위험에 처하게 함
  • 고용주가 노동자의 여권을 압수하고 출국 허가를 주지 않아 해외로 떠날 수 없게 함
  • 근무환경에 대해 항의하면 위협을 당함

국제앰네스티는 한 인력업체 관계자가 급료 지급을 미루거나, 경찰에 신고하거나, 카타르를 떠나지 못하게 막는 등의 방법을 이용해 이주노동자들을 위협한 증거를 적발했다.

대부분이 방글라데시, 인도, 네팔 출신인 이주노동자들은 2015년 2월부터 5월 사이 카타르에서 국제앰네스티에 피해 사실을 증언했다. 2016년 2월 조사팀이 카타르를 다시 찾았을 때, 국제앰네스티 발표에 따라 일부 업체가 처우를 개선하면서 더 좋은 숙소로 옮기거나 여권을 돌려받은 노동자들도 있었지만 그 외의 인권침해 문제는 전혀 해결되지 않았다.

살릴 셰티 사무총장은 “빚을 지고 사막의 불결한 캠프에서 생활하며 쥐꼬리만한 급료를 받는 이주노동자의 현실은 이곳에서 경기에 참가하게 될 일류 축구선수들의 모습과 극명히 대조된다. 노동자들이 바라는 것은 제 때 급료를 받고, 필요할 때 출국할 수 있고, 사람답게 존중 받을 수 있는 권리가 전부”라고 말했다.

 

노동자들 위협하고 공포에 떨게 하는 카타르의 후원 제도

카타르의 카팔라(kafala) 후원 제도는 이주노동자가 고용주(또는 ‘후원자’)의 허가 없이는 직장을 옮기거나 출국할 수 없도록 제한하는 제도로, 노동자들을 일하게 만들도록 위협하는 데 핵심적인 위치를 차지한다. 카타르 정부는 2015년 말 그간 수없이 거론되었던 후원제도 개혁안을 마침내 발표했지만 이주노동자와 고용주간의 역학 관계를 바꾸려면 턱없이 부족한 수준이다.

네팔 출신 노동자 중에는 2015년 4월 수천 명이 죽고 수백만 명이 집을 잃은 네팔 대지진 당시에도 고국의 사랑하는 사람들을 만나러 갈 기회조차 허가받지 못했다고 전했다.

칼리파 스타디움 재공사 현장에서 일한 인도 출신의 금속노동자 나빌(가명)은 수 개월째 급료를 받지 못하고 오히려 고용주로부터 협박만을 당했다고 말했다.

“사장은 내게 욕설을 하며 한 번만 더 불만을 말하면 영원히 카타르를 나가지 못할 거라고 소리를 질렀다. 그 후로는 급료 등의 문제에 대해 항의하지 않으려 조심하고 있다. 물론 할 수만 있다면 직장을 옮기거나 카타르를 떠나고 싶다.”

네팔 출신의 금속노동자 디팍(가명) 역시 비슷한 심정을 전했다.

“이곳에서의 생활은 감옥 같다. 일은 힘들고 뜨거운 햇빛 아래서 몇 시간이고 작업해야 한다. 처음 카타르에 온 지 얼마 되지 않았을 때 이곳 상황에 대해 불평했더니 관리자가 ‘불평은 얼마든지 해도 되지만 좋게 넘어가진 않을 거다. 카타르에 계속 있고 싶으면 조용히 일이나 하라’고 했다.”

 

월드컵 복지 기준 적용

2022년 월드컵 주최와 경기장 건설 관련 업무를 최종적으로 담당하는 카타르 월드컵 조직위원회는 2014년 노동자 복지 기준을 발표했다. 이에 따르면 월드컵 대비 건설 프로젝트에 참여하는 사업장은 카타르법에 명시된 것보다 노동자들에게 더 유리한 기준을 적용해야 한다.

살릴 셰티 사무총장은 “조직위원회는 확고한 노동자 인권 개선 의지를 보여줬고, 위원회가 발표한 복지기준은 현 상황에 큰 도움이 될 수 있다. 그러나 이러한 기준을 적용하기가 쉽지 않다. 카타르 정부의 미온적인 태도와 FIFA의 무관심 속에서 월드컵이 인권침해 없이 무사히 개최되기란 거의 불가능한 일”이라고 말했다.

 

FIFA 후원업체가 압박해야

국제앰네스티는 아디다스(Adidas), 코카-콜라(Coca-Cola), 맥도날드(McDonald’s) 등의 주요 월드컵 후원업체에 칼리파 스타디움 건설현장의 노동자 착취 문제를 해결하고, 향후 월드컵 준비 과정에서의 인권침해 예방 계획을 공개하라고 FIFA를 압박할 것을 촉구한다.

FIFA는 카타르 정부에 월드컵 건설 프로젝트가 절정에 이르는 2017년 중반까지 종합적인 개혁안을 발표하도록 압박해야 한다.

외국인 노동자가 직장을 옮기거나 카타르를 떠나지 못하게 하는 고용주의 권한을 제한하고, 노동 환경을 적절히 조사하고 인권침해적 사업장에 엄격한 제재를 가하는 등의 조치가 반드시 이루어져야 한다. FIFA 역시 카타르의 노동 환경에 대해 정기적으로 독립적인 자체 조사를 실시하고 그 결과를 공개해야 한다.

살릴 셰티 사무총장은 “월드컵 개최를 통해 카타르는 세계 유명 축구팀들에게 훌륭한 전지훈련 장소로 자국을 홍보할 수 있었지만, 세계 축구계는 경기가 벌어지는 시설과 경기장에서의 인권침해를 모른 척해서는 안 된다”고 말했다.

또한 “FIFA의 신임 위원장이 역사의 새로운 페이지를 넘기는 데 진지하게 임하고자 한다면, 이주노동자의 인권침해로 지어진 경기장에서 세계적인 행사가 열리는 모습이 전세계에 공개되도록 내버려둬서는 안 될 것”이라고 밝혔다.

 

세계 축구의 핵심 시설

칼리파 스타디움은 아스파이어존 스포츠 복합단지를 이루는 시설 중 하나로, 여기에 포함되는 아스파이어 아카데미 훈련센터와 아스페타르 의료시설은 세계 굴지의 축구팀들이 훈련 장소로 이용하기도 했던 곳이다.

살릴 셰티 사무총장은 “세계 유명 축구 스타 중에는 이주노동자의 노동착취로 조성되고 유지되는 시설에서 이미 훈련을 시작한 선수도 있을지 모른다. 마찬가지로 머잖아 이주노동자의 피땀으로 건설된 경기장에서 경기를 치르게 될 수도 있다”며 “이제는 바이에른 뮌헨, 파리 생제르맹 등 세계적인 축구팀과 아디다스, 코카콜라 등의 후원업체와 같이 대표적인 축구 관련 단체들이 이 문제에 목소리를 내지 않는다면 그들도 책임을 피하기 어려운 때”라고 말했다.

First evidence of migrant exploitation on 2022 World Cup site

Migrant workers building Khalifa International Stadium in Doha for the 2022 World Cup have suffered systematic abuses, in some cases forced labour, Amnesty International reveals in a new report published today.

The report, “The ugly side of the beautiful game: Labour exploitation on a Qatar 2022 World Cup venue”, blasts FIFA’s shocking indifference to appalling treatment of migrant workers. The number of people working on World Cup sites is set to surge almost ten-fold to around 36,000 in the next two years.

“The abuse of migrant workers is a stain on the conscience of world football. For players and fans, a World Cup stadium is a place of dreams. For some of the workers who spoke to us, it can feel like a living nightmare,” said Amnesty International Secretary General Salil Shetty.

“Despite five years of promises, FIFA has failed almost completely to stop the World Cup being built on human rights abuses.”

Severe abuses including forced labour

The report is based on interviews with 132 migrant construction workers rebuilding Khalifa stadium, set to be the first stadium completed for the tournament and slated to host a World Cup semi-final in 2022. A further 99 migrants also interviewed were landscaping the green spaces in the surrounding Aspire Zone sports complex, where Bayern Munich, Everton and Paris Saint-Germain trained this winter.

Every single gardener and construction worker who spoke to Amnesty International reported abuse of one kind or another, including:

  • squalid and cramped accommodation,
  • paying large fees ($500 to $4,300) to recruiters in their home country to get a job in Qatar,
  • being deceived as to the pay or type of work on offer (all but six of the  men had salaries lower than promised when they arrived, sometimes by half),
  • not being paid for several months, creating significant financial and emotional pressures on workers already burdened with heavy debts,
  • employers not giving or renewing residence permits, leaving them at risk of detention and deportation as “absconded” workers,
  • employers confiscating workers passports and not issuing exit permits so they could not leave the country,
  • being threatened for complaining about their conditions.

Amnesty International uncovered evidence that the staff of one labour supply company used the threat of penalties to exact work from some migrants such as withholding pay, handing workers over to the police or stopping them from leaving Qatar. This amounts to forced labour under international law.

The workers, mostly from Bangladesh, India and Nepal, spoke to Amnesty International in Qatar between February and May 2015. When Amnesty International researchers returned to Qatar in February 2016, some of the workers had been moved to better accommodation and their passports returned by companies responding to Amnesty International findings, but other abuses had not been addressed.

“Indebted, living in squalid camps in the desert, paid a pittance, the lot of migrant workers contrasts sharply to that of the top-flight footballers who will play in the stadium. All workers want are their rights: to be paid on time, leave the country if need be and be treated with dignity and respect,” said Salil Shetty.

 

Qatar’s sponsorship system leaves workers threatened, living in fear

Qatar’s kafala sponsorship system, under which migrant workers cannot change jobs or leave the country without their employer’s (or “sponsor’s”) permission, is at the heart of the threats to make people work. A much-touted reform of the sponsorship system, announced in late 2015 will do little to alter the power dynamics between migrant workers and their employers.

Some of the Nepali workers told Amnesty International they were not even allowed to visit their loved ones after the 2015 April earthquake that devastated their country leaving thousands dead and millions displaced.

Nabeel (name changed to protect identity), a metal worker from India who worked on the Khalifa stadium refurbishment, complained when he was not paid for several months but only received threats from his employer:

“He just shouted abuse at me and said that if I complained again I’d never leave the country. Ever since I have been careful not to complain about my salary or anything else. Of course, if I could I would change jobs or leave Qatar.”

Deepak (name changed to protect identity), a metal worker from Nepal, said:

“My life here is like a prison. The work is difficult, we worked for many hours in the hot sun. When I first complained about my situation, soon after arriving in Qatar, the manager said ‘if you [want to] complain you can but there will be consequences. If you want to stay in Qatar be quiet and keep working’.”

 

World Cup Welfare Standards not enforced

Qatar’s Supreme Committee for Delivery and Legacy, the organization responsible for World Cup 2022 and ultimately for stadium construction published Workers’ Welfare Standards in 2014. They require companies working on World Cup projects to deliver better standards for workers than are provided for under Qatari law.

“The Supreme Committee has shown commitment to workers’ rights and its welfare standards have the potential to help. But it is struggling to enforce those standards. In a context where the Qatari government is apathetic and FIFA is indifferent, it will be almost impossible for the World Cup to be staged without abuse,” said Salil Shetty.

 

Time for FIFA and sponsors to up the pressure

Amnesty International is calling on major World Cup sponsors like Adidas, Coca-Cola and McDonald’s to pressure FIFA to address the exploitation of workers on Khalifa stadium, and disclose its plan for preventing further abuses in World Cup projects.

FIFA should push Qatar to publish a comprehensive reform plan before World Cup construction peaks in mid-2017.

Essential steps include removing employers’ power to stop foreign employees from changing jobs or leaving the country, proper investigations into the conditions of workers and stricter penalties for abusive companies. FIFA itself should carry out, and publish, its own regular independent inspections of labour conditions in Qatar.

“Hosting the World Cup has helped Qatar promote itself as an elite destination to some of the world’s biggest clubs. But world football cannot turn a blind eye to abuse in the facilities and stadiums where the game is played,” said Salil Shetty.

“If FIFA’s new leadership is serious about turning a page, it cannot allow its showcase global event to take place in stadiums built on the abuse of migrant workers.”

 

Facilities at the heart of world football

Khalifa stadium is part of the Aspire Zone sports complex, whose Aspire Academy training and Aspetar medical facilities have been used by some of the world’s biggest football clubs (see backgrounder).

“Some of world football’s biggest stars may already be training on pitches grown and maintained by exploited migrant workers. They could soon be playing in stadiums built by them too,” said Salil Shetty.

“It is time for football’s leaders to speak out or be tainted by association, be they global football brands like Bayern Munich and PSG or major sponsors like Adidas and Coca-Cola.”

태국 정부는 위구르인 50명을 고문, 강제실종, 처형될 위험이 있는 중국으로 강제 송환해서는 안 되며, 중국은 이미 송환된 위구르인 100여명의 행방을 공개해야 할 것이라고 국제앰네스티가 밝혔다.

9일 오전 태국 정부는 동아시아와 중앙아시아 지역의 투르크계 소수민족인 위구르인 약 109명을 중국으로 강제 송환했다고 밝혔다. 이들은 지난 2014년 3월 태국에 불법 입국한 혐의로 구금되어 있었다.

1980년대 이후 위구르족은 중국 정부로부터 제도적이고 광범위한 인권침해의 표적이 되어 왔다.

니콜라 베클란(Nicholas Bequelin) 국제앰네스티 동아시아 지역국장은 “태국은 위구르인 109명을 중국에 강제로 돌려보냄으로써 국제법을 위반했다. 이는 그들에게 가장 무거운 형벌을 선고한 것이나 다름없는 일이다. 중국으로 송환된 위구르인들이 구금되고, 고문을 당하고, 일부는 사형에 처해지는 등 갑자기 행방이 묘연해진 경우를 이미 여러 차례 지켜본 바 있다”며 “이들을 중국에 강제로 송환하는 것은 비열한 행위이자 국제법을 위반하는 것이다. 태국 정부가 중국으로의 강제송환을 계속한다면, 많은 사람들의 생명을 위태롭게 만들 것”이라고 밝혔다.

태국은 중대한 인권침해를 당할 실질적 위험이 있는 국가 또는 관할 구역으로의 강제송환을 금지하는 농르풀망(Non-refoulement)원칙의 당사국이다. 농르풀망 원칙은 수많은 국제기준에 명시되어 있으며, 국제관습법으로 인정받아 관련 조약의 비준 여부와 상관없이 모든 국가에 구속력을 지닌다.

또한 망명자를 고문 및 그 외 부당대우를 당할 위험이 있는 나라로 강제 송환하는 것은 태국이 당사국인 고문방지협약 역시 위반하는 것이다.

Thailand must not send Uighurs to Chinese torture

The Thai authorities must not return 50 ethnic Uighurs to China, where they are at risk of being tortured, forcibly disappeared and executed, and China must reveal the whereabouts of more than 100 already deported, said Amnesty International.

This morning, the Thai authorities confirmed that they have deported to China some 109 Uighurs – the Turkic ethnic group living in Eastern and Central Asia. They were part of a group detained for irregular entry into Thailand in March 2014.

Since the 1980s, the Uighurs have been the target of systematic and extensive human rights violations by the Chinese authorities.

“Thailand has violated international law by forcibly returning some 109 Uighurs to China. This is akin to sentencing them to the worst punishment imaginable. Time and time again we have seen Uighurs returned to China disappearing into a black hole, with some detained, tortured and in some cases, sentenced to death and executed,” said Nicholas Bequelin, Regional Director for East Asia at Amnesty International.

“Deporting these people is a despicable act, and illegal under international law. If the Thai authorities go ahead with any further deportations, they will be putting the lives of many at risk.”

Thailand is bound by the principle of non-refoulement, which prohibits the transfer of people to any country or jurisdiction where they would be at real risk of serious human rights violations or abuses. This principle is enshrined in numerous international instruments, and has achieved the status of customary international law, binding on all states, regardless of whether they have ratified the relevant treaties.

The forcible return of people to a country where they could face torture and other ill-treatment would also violate the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, to which Thailand is a state party.

28년 만에 재벌 총수들이 국회 청문회에 총출동했다.

재계서열 1,2,3 위인 삼성 이재용 부회장과 현대차 정몽구 회장, SK 최태원 회장을 필두로 롯데 신동빈, 한화 김승연, LG 구본무 , GS 허창수, 한진 조양호, CJ 손경식 회장 등 9명이 나란히 증인석에 앉았다.  

6일 국회에서 열린 ‘박근혜 정부의 최순실 등 민간인에 의한 국정농단 의혹 사건 진상규명을 위한 국정조사특별위원회(이하 국조특위)’ 1차 청문회는 박근혜 최순실 게이트의 공범으로 지목받은 재벌들의 잘못을 따지기 위한 자리였지만 이들 재벌 총수들은 청문회 내내 모르쇠와 책임회피로 일관했다.

심지어 검찰 공소장을 통해 확인된 내용마저 잘 모르겠다고 부인하는 대범함을 보였고, 모든 일들이 실무자들 선에서 이루어져 자신들은 문제가 생긴 뒤에야 뒤늦게 보고받았다고 주장하는 뻔뻔함을 보였다.

이재용의 ‘면종복배’

국조특위 위원들의 질의는 대부분 이재용 삼성전자 부회장에게 집중됐다. 이재용 부회장은 “국민들에게 많은 우려와 심려와 끼쳐드린 것을 잘 알고 있으며, 앞으로 이런 불미스러운 일에 연루되지 않도록 노력하겠다”는 원론적인 수준의 사과말을 10여 차례나 반복하며 몸을 낮추는 듯한 인상을 주려고 노력했다. 그러나 구체적인 잘못에 대한 질문에 대해서는 모르쇠와 책임회피로 일관해 국조특위 위원들로부터 질타를 받았다.  

이 부회장은 미르와 K스포츠에 80억 원을 보낸 사실에 대해 “송금 당시에 전혀 몰랐으며, 누가 그 일을 지시했는지에 대해서도 모른다”고 답했다. 또 여러 국조특위 위원들이 “최순실 씨의 존재에 대해 언제부터 알고 있었느냐”는 질문을 6차례나 반복했지만, 이 부회장은 “잘 기억이 나지 않는다”고 발뺌했다. 자신의 경영권 세습과 직결된 삼성물산과 제일모직 합병에 대해서도 그 과정을 잘 몰랐다고 말했다. 특히 “그룹에 대한 지배력 강화는 지분이 올라가서 강화되는 것이 아니라 제가 사회에서 인정을 받고 저희 임직원과 고객사에게 인정을 받아야 된다고 생각한다”는 황당한 답변을 내놓기도 했다.

이재용, 전경련 탈퇴 및 미래전략실 해체 약속

이 부회장이 인정한 단 한 가지의 잘못은 최순실 씨의 딸 정유라에 대한 지원 방식이 부적절했다는 점이었다. 그러나 이마저도 자신은 당시 그러한 사실을 몰랐고 실무자들이 저지른 잘못을 미리 막지 못한 게 자신의 불찰이었다는 식으로 책임을 회피했다.

대신 이 부회장은 박근혜 대통령과 독대한 자리에서 대통령이 문화 융성과 체육 사업에 대한 지원을 언급했다는 사실을 인정함으로써 자신이 피해자라는 입장을 은연중에 내비치기도 했다.  

이 부회장은 “전경련을 탈퇴하고 삼성 그룹의 미래전략실을 해체하라”는 의원들의 요구에 “그렇게 하겠다”고 답했고, “자신보다 훌륭한 경영인이 있으면 경영권을 언제든지 넘기겠다”고도 말했다.

국조특위 용두사미로 끝날까

이날 청문회에서는 기대와 달리 정경유착 의혹이 새로 밝혀지지는 않았다. 그나마 새로운 것을 꼽자면 일성신약 윤석근 대표의 증언. 윤 대표는 삼성 바이오로직스의 김태환 사장과 만난 자리에서 “국민연금은 이미 찬성으로 가기로 되어 있다”라는 말을 들었다고 증언했다. 새누리당 장제원 의원은 삼성 뿐 아니라 한화도 정유라에게 연습용 말을 수입해 제공하지 않았냐는 의혹을 제기했다. 이에 대해 김승연 회장은 모르는 일이라고 답했다.

청문회가 저녁까지 이어지면서 현대차 정몽구 회장은 건강을 이유로 병원으로 이동했다.  고령인 CJ 손경식 회장과 LG 구본무 회장 역시 각각 저녁 8시 40분과 9시에 조기 귀가했다.

한편 오늘 청문회장에 삼성전자 이재용 부회장, 현대차 정몽구 회장이 출석할 때는 취재진 사이에 섞여 있던 시민단체 회원들이 기습적인 시위를 벌이며 피켓을 펼치고 구호를 외쳤다. 청문회가 열린 국회 본관 뒤편에서는 ‘박근혜 퇴진 비상국민행동 재벌구속 특별위원회’가 기자회견을 열고 재벌도 박근혜 최순실 게이트의 공범이라고 주장했다. 이 자리에는 삼성 백혈병 피해자 단체와 삼성전자서비스 노동자들, 현대차 부품업체 유성기업과 갑을 오토텍 노조들이 참석했다.  그러나 국회 의경들이 이를 저지했고, 이 과정에서 몸싸움이 벌어지기도 했다.

엘살바도르의 극단적인 낙태금지법에 따라 유산이나 응급상황을 겪은 여성들이 불법 낙태 시술을 받은 혐의로 갇히면서, 수백 명 자녀의 삶에 참담한 영향을 끼치고 있다고 국제앰네스티가 11월 30일 발표한 보고서를 통해 밝혔다.

보고서 <헤어진 가족, 끊어진 인연>에서는 터무니없는 낙태금지법으로 갇힌 여성의 아이들이 대부분 금전적으로 힘든 상황에 부닥치거나 어머니와 연락을 주고받지도 못하는 현실이 담겨있다.

아스트리드 발렌시아(Astrid Valencia) 국제앰네스티 중앙아메리카 조사관은 “엘살바도르 정부는 유산이나 임신 합병증을 겪은 여성을 부당하게 가둘 때마다 그 자녀들 역시 가난과 정신적 고통 속에 살아가도록 내몰고 있다”며 “임신 합병증을 겪은 여성들에게만 적용되는 엘살바도르의 ‘유죄 추정의 원칙’으로 수백 명이 희생되었고, 여성들은 최대 40년까지의 징역형에 처했으며, 의사와 환자 사이에 절대적인 공포 분위기가 조성되었다. 지금이야말로 엘살바도르의 이러한 시대착오적인 낙태금지법을 철폐해야 할 때”라고 말했다.

모든 경우에 대한 낙태 시술이 범죄화됨에 따라 최소 19명 이상의 여성들이 근거가 미약하거나 결정적이지 못한 증거로도 살인과 같은 중대한 범죄로 유죄 선고를 받고, 장기간의 징역형에 처해 현재 교도소에 갇혀 있다. 이들 중 대부분은 가정의 생계를 책임지고 있었다. 이런 여성들이 투옥되면 가족들이 벌이하고 아이들을 돌봐야 하는데, 주로 극심하게 어려운 상황에 처한 경우가 많았다.

경제적 수입이 전혀 없고, 교도소가 집에서 멀리 떨어진 탓에 대부분의 가족은 사랑하는 가족을 면회하기도 어렵다. 일부의 경우 수개월 넘게 자녀를 만나지 못하는 여성들도 있었다.

유산을 겪은 이후 ‘고의 살인’ 죄로 징역 40년형을 선고받고 현재 수감 중인 32세 여성 마리아 테레사 리베라는 2011년 갇힌 이후 지금까지 열 살 난 아들을 만난 것이 겨우 4번에 불과했다.

마리아 테레사의 아들은 그녀가 수감된 교도소로부터 수 시간 떨어진 곳에 할머니와 함께 살고 있는데, 교도소를 한번 방문하려면 엄두도 못 낼 정도로 비싼 비용이 든다. 마리아 테레사가 벌어오던 수입이 끊기고, 정부의 지원도 없어 마리아 테레사의 시어머니 역시 손자를 키우는 데 큰 어려움을 겪고 있다.

마리아 테레사는 욕실에서 거의 실신한 상태로 피를 심하게 흘리고 있는 것을 시어머니가 발견해 병원에 옮겨졌으나 그 자리에서 체포되었다. 병원 직원이 낙태한 것으로 의심하고 경찰에 신고했던 것이다.

재판 과정에서 마리아 테레사의 직장 상사 중 한 명이 그녀가 임신한 사실을 2011년 1월에 이미 알고 있었다며 불리한 증언을 했다. 이 증언이 사실이라면 유산 당시 임신 11개월째였다는 말이 된다. 이처럼 터무니없는 증언조차도 유죄를 선고하는 근거로 이용됐다.

마리아 테레사의 어린 아들은 어머니의 부당한 구금으로 유난히 힘든 시간을 보내고 있다.

마리아 테레사의 시어머니인 “이사벨”은 교도소를 방문할 때마다 겪는 고통에 대해, “손자를 데리고 처음 면회를 갔을 때는 정말 힘들었다. 손자는 심하게 울음을 터뜨렸고 나도 마찬가지였다. 아이는 교도소를 떠나지 않으려고 했다. 너무나 고통스러워서 아이를 데리고 나가는 것도 잠시 포기해야 했다. 아이에게도, 엄마에게도 너무나 힘든 일이기 때문이었다”고 전했다.

테오도라 델 카르멘 바스케스는 2008년 직장에서 사산한 후 “고의 살인” 죄로 징역 30년이 선고됐다. 그녀의 11살 난 아들은 면회를 거의 오지 못한다.

테오도라는 2008년 30년 형을 선고받았다. 11살 난 아들은 엄마를 거의 만날 수 없다.

베르타(가명) 역시 이와 비슷하게 임신 합병증을 겪고 기소되어 거의 1년간을 감옥에서 보냈다. 수감되어 있던 기간의 절반 동안은 열 살 난 아들을 만날 수 없었다.

“베르타”는 2010년 7월 출혈이 심한 상태로 지역 병원을 찾았다가 체포되었다. ‘고의 살인’ 죄로 기소되었지만 정작 본인은 임신한 사실조차 몰랐다. 재판이 시작할 때까지 변호사를 만나지도 못했다. 베르타가 기소된 죄목으로 유죄가 선고되면 최대 징역 50년형까지 처할 수 있었다. 사법절차가 시작된 지 거의 1년 만에 베르타는 무죄가 선고됐다. ‘치료 목적, 윤리적, 우생적 낙태 비범죄화를 위한 시민단체’라는 지역 인권단체의 소속 변호사들이 새로운 증거를 제출한 덕분이었다.

그러나 재판 과정과 교도소에 갇혔던 당시의 경험은 베르타와 가족들의 삶에 엄청난 상처를 남겼다.

베르타는 당시의 경험 때문에 여전히 정신적으로 힘든 상태이며, 이후 어떤 형태의 보상이나 배상도 받지 못했다고 국제앰네스티에 전했다.

베르타는 “몇 년이 지나더라도 그 때로 인한 고통은 여전히 마음속 깊은 곳에 남아 있다”고 말했다.

베르타의 어머니는 당시 베르타가 부당하게 교도소에 갇히면서 끼친 영향에 대해, “딸이 감방에서 지내는 동안 추위로 고생하고 있을 것을 생각하니 잘 때도 이불을 덮지 못했다. 이불을 덮지 않으면 함께 고통을 나눌 수 있겠다고 생각했기 때문이었다. 지금도 아무리 추워도 이불을 덮지 못하는 걸 보니 여전히 상처가 아물지 않은 것 같다. 지금은 베개도 딱딱한 바위처럼 느껴진다. 예전과는 전혀 달라졌다”고 국제앰네스티에 전했다.

아스트리드 발렌시아 조사관은 “엘살바도르 정부는 어린아이들에게 이처럼 감당할 수 없는 고통을 선고하기보다는, 여성을 그저 ‘출산 기계’로 취급하는 것만이 목적인 현행법을 재검토하는 데 여력을 집중해야 할 것”이라고 말했다.

1998년 개정형법에 따라, 엘살바도르는 강간, 근친상간에 의한 임신이거나 산모의 생명이 위험에 처한 경우에도 상관없이 모든 경우에 대한 낙태 시술을 금지했다. 이로 인해 여성들이 즉시 유죄로 몰리며 부당한 기소와 형법의 오적용이 계속되고 있다. 경제적으로 넉넉하지 못한 여성들은 특히 낙태금지법으로 더욱 큰 영향을 받았다.

EL SALVADOR’S TOTAL ABORTION BAN SENTENCES CHILDREN AND FAMILIES TO TRAUMA AND POVERTY

El Salvador’s extreme anti-abortion law is having a devastating effect on the lives of scores of children whose mothers, having suffered miscarriages or other obstetric emergencies, are being held behind bars accused of having illegal abortions, said Amnesty International in a new report today.

Separated families, broken ties, reveals how children of women jailed under the absurd anti-abortion law are often left facing difficult financial circumstances and prevented from staying in touch with their mothers.

“Each time authorities in El Salvador unfairly lock up a woman for having a miscarriage or suffering pregnancy related complications, they are also condemning her children to a life of poverty and trauma,” said Astrid Valencia, Central America Researcher at Amnesty International.

“El Salvador´s ‘guilty until proven innocent’ approach when it comes to women who suffer pregnancy-related complications has cost scores of lives, landed women in prison for up to 40 years and created an environment of absolute fear amongst doctors and patients. It is high time for El Salvador to abolish this outdated ban.”

At least 19 women are currently in jail, in the context of a total criminalization of abortion, convicted of serious offences such as homicide and sentenced to long prison terms on weak or inconclusive evidence. Most of them were their household’s main breadwinners. Since their incarceration, their extended families are responsible for providing and looking after their children, often in extremely difficult circumstances.

The lack of financial resources and the long distances between their homes and the prisons prevents many of the families from visiting their loved ones in prison. In some cases, women were not able to see their children for months.

Maria Teresa Rivera, a 32-year-old woman currently serving a 40 year prison sentence for “aggravated homicide” after having a miscarriage has only seen her ten-year-old son four times since she was jailed in 2011.

The boy lives with his grandmother several hours away from the prison and the journey is prohibitively expensive. Without Maria Teresa’s income and with no official support, her mother- in- law is also struggling to provide for her grandson.

Maria Teresa was arrested in a hospital after her mother-in-law found her in her bathroom almost unconscious and bleeding heavily. Staff at the hospital reported her to the police and accused her of having an abortion.

During the trial, one of Maria Teresa’s bosses testified against her saying she knew she was pregnant in January 2011. This would have made her 11 months pregnant by the time the miscarriage took place. The outrageous testimony was used as one of the pieces of evidence to convict her.

María Teresa´s young son is having a particularly difficult time dealing with his mother’s unfair detention.

“Isabel”, María Teresa´s mother in law, told Amnesty International of the traumatic visits to the prison: “The first time I took the child it was very hard. He cried a lot and I did too. He didn’t want to leave the prison. It was so hard that I stopped taking him for a while because it was tough for both of them.”

Similarly, Bertha (not her real name), spent nearly a year in jail also prosecuted for homicide after suffering a pregnancy-related complication. She was not able to see her 10- year-old son during half the time she was in prison.

“Bertha” was arrested in July 2010 in a local hospital, where she had arrived heavily bleeding. She was charged with “aggravated homicide” although she did not know she was pregnant. “Bertha” did not meet her lawyer until the trial started. The penalty for the crime she was accused of could be as high as 50 years in jail. Bertha was found innocent almost a year after the process against her began, when lawyers from the local human rights group Citizen Group for the Decriminalization of Therapeutic, Ethical and Eugenic Abortion provided new evidence on the case.

The trial and the time she was forced to spend in jail, however, left a profound mark on Berta’s life and her relatives.

She told Amnesty International that she is still traumatized by the experience and said she has not receive any kind of compensation or reparation measures.

“Even though several years have passed, the pain stays deep inside,” she said.

Talking about the impact of Bertha’s unfair incarceration on her family, her mother said: “To sleep, I couldn’t use the covers because during those days, when she was in the cells, I would start to think that she was suffering from the cold and so I wouldn’t cover myself so that I could experience her suffering. And now, I can’t use the covers even if I’m cold, so I know I’m still affected by it. Now, the pillow feels like a stone…I’m not the person I used to be.”

“Instead of sentencing children to this unbearable suffering, authorities in El Salvador should focus their energies in reviewing legislation that serves no purpose but to treat women as little more than ‘human vessels’,” said Astrid Valencia.

Following a change in the Penal Code in 1998, abortion in El Salvador has been banned in all circumstances – even when the pregnancy is the result of rape, incest or when the life of the woman is at risk. The change in the law has led to wrongful prosecutions and misapplication of criminal law where women are immediately assumed guilty. Women with few economic resources are particularly affected by the ban.

레바논 정부가 8일 시리아 난민 100명 이상을 본국에 강제 송환한 것으로 파악했다고 국제앰네스티가 밝혔다. 송환되지 않은 난민 약 150명은 여전히 레바논 베이루트의 라픽 하리리 국제공항에서 발이 묶인 채로 수 시간 내에 강제 송환될 위기에 처해 있다. 레바논 정부는 뒤이어 도착하는 현지 시간 오후 9시 30분 항공편으로 이들을 돌려보낼 계획인 것으로 알려졌다.

이들은 터키로 향하기 위해 시리아에서 항공편을 이용해 베이루트에 도착한 난민들로, 1월 7일 베이루트를 떠날 예정이었다. 그러나 터키 정부의 난민 입국 제한 정책이 8일부터 시행되면서 시리아 난민에 대한 비자 규정도 변경되었고, 이에 앞서 터키항공 항공편 2대가 취소됨에 따라 난민들의 발이 묶이게 되었다.

Lebanon: Forcible return of more than 100 refugees to Syria a shocking setback

More than 100 Syrian refugees have been forcibly returned to Syria by the Lebanese authorities today, Amnesty International has learned. Around 150 others are still stranded at Beirut’s Rafic Hariri International Airport and are at risk of imminent deportation in the coming hours. The authorities are reportedly planning to force them to leave on the next flight at 9:30pm local time.

The refugees had arrived in Beirut on flights from Syria with the intention of travelling on to Turkey. They were due to depart on 7 January but were unable to leave as two Turkish Airlines flights were cancelled ahead of new visa regulations for Syrian refugees imposed by the Turkish authorities that came into force today restricting access to the country.

“By forcibly returning more than 100 refugees to Syria the Lebanese government has stooped to a shocking new low and is putting these people in mortal danger. This is an outrageous breach of Lebanon’s international obligations to protect all refugees fleeing bloodshed and persecution in Syria. The Lebanese government must halt all further deportations of Syrian refugees immediately,” said Sherif Elsayed-Ali, Head of Refugee and Migrants’ Rights at Amnesty International.

“The new visa regulations in Turkey present yet another hurdle for Syrians desperate to seek sanctuary from the conflict and show what devastating consequences such restrictions can have for refugees.”

이스라엘의 핵실험 실태를 폭로했던 모데르차이 바누누(Mordechai Vanunu)가 언론과 인터뷰를 가졌다는 이유로 11일 가택연금에 처해진 것은 가혹한 보복성 판결이라고 국제앰네스티가 밝혔다.

예루살렘 법원은 바누누가 9월 4일 이스라엘 방송사 채널2와 인터뷰를 나눈 것과 관련해 9월 10일 일주일간의 가택 연금에 처해진 것에 불복하고 제기한 항소를 11일 기각했다. 또한 바누누가 인터넷을 사용하거나 기자와 접촉하는 것 역시 금지할 것을 명령했다.

필립 루서(Philip Luther) 국제앰네스티 중동-북아프리카 국장은 “모르데차이 바누누에게 가해진 금지 처분은 가혹한 보복성 처벌”이라며 “최근 바누누의 자유를 탄압하고 있는 것은 바누누가 1986년 사건으로 18년이라는 시간을 감옥에서 보내며 이미 큰 대가를 치렀음에도 지금까지도 처벌을 고집하며 본보기로 삼겠다는 이스라엘 정부의 결정을 보여주는 또 하나의 사례에 불과하다. 바누누에게 더 이상의 처벌을 가한다고 해도 이스라엘의 국가 안보에는 아무런 도움이 되지 않는다. 바누누가 폭로했던 정보는 이제 거의 30년 전의 것으로, 이미 유효한 기간을 훨씬 넘긴 상태”라고 말했다.

국제앰네스티는 모르데차이 바누누를 표현의 자유를 평화적으로 행사했다는 이유만으로 자유를 빼앗긴 양심수로 간주한다.

바누누는 지난 1986년 영국 신문사 선데이타임즈(The Sunday Times)에 이스라엘의 핵실험 실태를 폭로했다가 독방 구금 11년을 포함, 18년간 교도소에 수감되어 있었다. 당시 이스라엘 비밀정보기관 모사드(Mossad)는 바누누가 해당 내용을 폭로하자 이탈리아에서 그를 납치해 장기간 비밀 구금하기도 했다.

바누누는 2004년 형기를 마치고 출소했지만 그의 시련은 지금까지도 계속되고 있다. 해외여행을 가거나 외국 대사관 주변에 접근하지 못하는 것은 물론, 인터넷 사용이나 외국인과의 대화도 금지되는 등 군이 부과하는 불필요한 보복성 제재의 대상이 되고 있다.

그러나 이번 주 체포되기 전까지만 해도 이스라엘 국내 언론사 기자와 대화하는 것은 금지사항이 아니었다. 바누누 측 변호인은 해당 인터뷰가 이스라엘 군 검열관에게 사전 승인을 받은 것으로, 바누누의 석방 조건을 위반하는 것이 아니라고 주장했다.

채널2 측은 정보 제공자 보호 원칙을 철저히 지키는 중으로, 바누누와 나눈 인터뷰 영상의 편집되지 않은 원본을 제출하라는 경찰의 요구를 거부하고 있다.

배경정보

모르데차이 바누누는 2004년 형기를 마친 이후 표현과 집회, 결사의 자유를 행사하고자 여러 차례 시도했지만 이스라엘 대법원은 이를 모두 묵살해 왔다.

일례로 지난해 대법원은 영국에서 공익제보자를 주제로 열린 국제앰네스티 행사에 참여하고, 의원 54명의 초청을 받은 영국 의회 행사에 참석할 수 있도록 바누누의 해외여행 금지 조치를 해제해 달라는 바누누 측 변호인의 청원서를 기각한 바 있다.

지난 2010년에는 외국인과 대화를 나누고 베들레헴의 크리스마스 미사에 참석하려고 했다는 이유로 제재를 위반했다며 유죄를 선고 받고 3개월간 수감되기도 했다.

Israel: ‘Vindictive’ ruling keeps whistle-blower Vanunu under house arrest

Today’s court decision to keep Israeli nuclear whistle-blower Mordechai Vanunu under house arrest for giving a media interview is vindictive and heavy-handed, Amnesty International said.

The Jerusalem district court turned down his appeal against a week of house arrest imposed yesterday in connection with an interview he gave to Israeli broadcaster Channel 2 on 4 September. The sentence also prohibits him from using the internet or speaking to any journalists.

“The restrictions on Mordechai Vanunu are punitive and vindictive,” said Philip Luther, Middle East and North Africa Director at Amnesty International.

“The latest attacks on Vanunu’s freedom are just one more example of the Israeli authorities’ determination to continue to exact retribution and make an example of him for what he did in 1986 and for which he paid the high price of 18 years in prison.

“Punishing him further now does nothing to protect Israel’s national security – any information he disclosed almost three decades ago is by now way past its sell-by date.”

Amnesty International considers Mordechai Vanunu to be a prisoner of conscience, deprived of his liberty solely for peacefully exercising his right to freedom of expression.

He previously spent 18 years in prison, including 11 years in solitary confinement, for revealing details of Israel’s nuclear arsenal to the British newspaper The Sunday Times in 1986. Following that disclosure, agents from Israel’s intelligence agency Mossad abducted him in Italy and held him in prolonged secret detention.

Though Mordechai Vanunu was released in 2004 after serving his sentence, his ordeal continues today. He remains subjected to military orders that impose punitive and unnecessary restrictions, including bans on foreign travel or going near foreign embassies, as well as restrictions on his internet use and communications with foreigners.

But, until his arrest this week, he had not been barred from speaking to Israeli journalists. Vanunu’s lawyers say that he did not breach his release conditions – the interview was given prior approval by an Israeli military censor.

Channel 2 is apparently standing fast to the principle of protecting their sources and has refused to give police the unedited footage of their recent interview with Mordechai Vanunu.

Background

Since Mordechai Vanunu’s release from prison in 2004, Israel’s Supreme Court has repeatedly quashed his attempts to be able to exercise his rights to freedom of expression, assembly and association.

Last year, for example, the Supreme Court denied a petition from his lawyers to lift his travel ban so he could participate in an Amnesty International event on whistle-blowers in the UK and attend an event at the UK parliament to which he was invited by 54 members of parliament.

In 2010 he was imprisoned for three months after being convicted of breaching his restrictions by speaking to foreigners and attempting to attend Christmas Mass in Bethlehem.
