5년 전 발사르 알 아사드(Bashar al-Assad) 정부는 2011년 3월 15일에 시작한 대규모 시위를 난폭하게 진압했다. 그러한 폭력적인 대응은 최악의 무력 충돌을 일으켰다.

Syria after the ‘Arab Spring’: Eight key facts

Five years ago, Bashar al-Assad’s government brutally suppressed mass protests which began on 15 March 2011. The violent response sparked the region’s most severe armed conflict.

1. More than 250,000 people have been killed, according to the UN. War crimes and crimes against humanity are rife.

2. Since then, more than 11 million people have been forced from their homes, including around 7 million people within Syria and more than 4 million who are now refugees abroad, mostly in Turkey, Lebanon and Jordan. Tens of thousands of refugees from Syria have also fled to Europe, often risking their lives in the process.

3. Government forces have repeatedly shelled and bombed civilian areas using indiscriminate weapons, including barrel bombs. They’ve also bombed hospitals, targeted medical workers and mounted long-running sieges of opposition-held areas, depriving people of food, medicines and other necessities. According to Physicians for Human Rights, 112 medical facilities were attacked in 2015 alone, the majority by government forces.

4. According to the Syrian Network for Human Rights, approximately 65,000 people have been arrested by government security forces and are now missing in a network of unofficial detention centres. Others have been jailed for helping people forced from their homes by the fighting, or for speaking out about the situation in Syria. Lawyers, doctors and journalists have been locked up just for doing their jobs.

5. Intelligence agencies and other government forces continue to use torture on a massive scale. Thousands have died in custody since 2011 due to torture and other factors, including lack of food and medical access.

6. The armed group calling itself the Islamic State (IS) has shelled civilian areas and killed scores of civilians and prisoners. The group has abducted, tortured and executed journalists, peaceful activists and other perceived opponents. IS also besieges civilian areas, which means people struggle to get food, medical supplies and other necessities.

7. Other armed groups including Jabhat al-Nusra have also attacked civilian areas, abducted suspected opponents and killed captives.

8. Russian air strikes in support of the al-Assad government have killed hundreds of civilians and struck medical facilities.

미국 등의 국가로부터 무기를 공급받는 사우디아라비아 주도 연합군이 전쟁범죄를 자행했다는 충격적인 증거가 밝혀지면서, 인권침해행위에 대한 독립적이고 실질적인 조사를 실시하고 특정 무기의 이전을 보류해야 할 필요성이 시급하다고 국제앰네스티가 7일 발표한 신규 보고서를 통해 밝혔다.

<’밤낮없는 폭격’: 예멘 북부의 민간인 피해>에서는 예멘 북동부 사다(Sa’da) 지역에서 사우디 연합군의 치명적인 공습으로 어린이 59명을 포함해 민간인 100여명을 숨지게 한 13개 사례를 조사했다. 또한 국제적으로 금지된 확산탄이 사용된 정황도 기록했다.

사실확인을 위해 예멘을 방문했던 도나텔라 로베라(Donatella Rovera) 국제앰네스티 위기대응 상임고문은 “이번 보고서를 통해 사우디아라비아 주도 연합군이 일부는 전쟁범죄까지 해당할 수 있는 불법 공습을 감행했다는 더 많은 증거가 공개됐다. 또한 이전된 무기가 이런 류의 중대한 인권침해행위를 저지르는 데 사용되지 않도록 막는 것이 얼마나 중요한지를 참혹한 현실을 통해 보여주고 있다”며 “예멘 분쟁 당사자들에게 무기를 수출하고 있는 미국 등의 국가들은 자국이 승인한 무기이전으로 중대한 국제인도법 침해행위가 용이해지는 것은 아닌지 확인해야 할 의무가 있다”고 말했다.

국제앰네스티는 군사작전에 참여한 사우디아라비아 주도 연합군 소속 국가에 대해, 예멘에서 전쟁범죄를 포함한 국제인도법 침해행위를 자행하는 데 사용되고 있는 무기와 탄약의 이전을 중단할 것을 촉구한다. 그 중에서도 특히 MK(MARK) 80 시리즈와 범용포, 전투기, 전투헬기 및 관련 부품과 파츠가 그 대상이다.

예멘 분쟁 중 가장 많은 민간인 사망자가 발생한 원인은 연합군의 공습이었다. 또한 사다 지역은 연합군의 공습으로 예멘의 다른 지역에 비해 가장 큰 피해를 입은 곳이다.

이번 보고서는 사우디 주도 연합군이 인구 수만여 명에 이르는 사다와 근방의 마란(Marran) 지역 전체를 군사적 목표로 설정해 국제법을 위반하는 등 민간인의 생명을 충격적이리만치 경시하는 경향을 보였다고 폭로했다. 국제앰네스티의 조사에 따르면 공습으로 인해 민간 주택이 1번 이상의 공격을 당한 경우가 최소 4차례 이상이었으며, 이는 이러한 민가가 군사적 목적으로 이용된다는 증거가 전혀 없음에도 의도적으로 표적이 되었음을 시사하는 것이다.

도나텔라 로베라 상임고문은 “인구 밀도가 높은 대도시 지역을 군사적 목표로 설정하고 민가를 반복적으로 공격한 것은, 국제법에서 규정하는 대로 민간인 희생을 피하기 위해 충분한 사전 조치를 취하지 않은 연합군의 명백한 실책을 증명하는 예”라고 말했다.

국제앰네스티가 기록한 바에 따르면 2015년 5월과 7월 사이 이루어진 13차례의 공습으로 최소 59명 이상의 아동이 목숨을 잃었으며, 이들 대부분은 집 근처에서 놀고 있거나 잠을 자던 도중에 변을 당했다.

2015년 6월 13일 알사프라(al-Safra) 지역 다마즈(Dammaj) 협곡의 한 민가에서는 연합군의 공습으로 일가족인 어린이 8명과 여성 2명이 숨졌고, 친척 7명이 부상을 입었다.

이날 공습으로 1살 난 아들을 잃은 압둘라 아흐메드 야흐야 알 사일라미(Abdullah Ahmed Yahya al-Sailami)는 “폭격을 당할 당시 집에는 19명이 있었고, 한 명을 제외하면 모두 여성과 어린이들이었다. 아이들은 보통 낮에는 밖에서 놀고 있을 시간이었지만 점심을 먹으러 모두 집에 들어와 있었다. 모두 죽거나 다쳤다. 죽은 아이들 중에는 12개월 된 아기도 있었다”고 말했다.

당시 구조활동을 돕던 친척은 잔해 속에서 입에 젖꼭지를 물고 있는 상태의 1살 난 아기 시신을 발견했다고 전했다. 국제앰네스티 조사관들은 현장에서 어린이 장난감, 책, 요리도구 등의 가제도구만 발견했을 뿐 무기나 군사용품은 전혀 찾아볼 수 없었으며, 이 주택을 정당한 군사적 목표로 삼을만한 증거도 없었다.

또다른 사례의 경우 분쟁을 피해 식량과 인도적 지원물품, 가축 등을 싣고 달아나던 민간 차량들이 포격을 당했다. 이외에도 상점, 시장 등의 상업 건물에도 여러 차례 공습이 가해진 사례가 보고서에 수록되어 있다.

계속되는 공습의 공포 속에 살아가고 있는 사다 주민들은 도시 전체에 전력이 차단되고, 교외 지역의 의료제도가 전혀 기능하지 못하고, 의사가 심각하게 부족한 상황이라는 중대한 인도적 위기에 처해 있다.

국제앰네스티 조사관들은 또한 BLU-97과 이를 수용한 CBU-97, 이보다 더욱 정밀한 유도탄인 CBU-105 등 2개 종류 확산탄의 파편을 발견했다. 국제법상 사용이 금지된 확산탄은 넓은 범위에 수백 개의 자탄을 흩뿌리는 탄으로, 이렇게 투하된 소형 폭탄은 불발되는 경우가 많아 이에 접근할 경우 치명적인 위협이 된다.

13세 소년 모하메드 하무드 알 와바시(Mohammed Hamood al-Wabash)는 불발된 확산탄의 자탄을 밟았다가 왼발에 수십 개의 파편이 박힌 채 살아가고 있다. 국제앰네스티는 연합군 소속 국가에 즉시 확산탄의 사용을 중지할 것과, 모든 국가에 해당 무기의 이전을 중단할 것을 촉구한다.

책임성 요구

지난 주 제네바에서 열린 유엔 인권위원회 총회에서는 예멘 분쟁에 대해 독립적이고 국제적인 조사에 착수하려는 시도가 실패로 돌아가고, 대신 각국 주도의 조사위원회 설립을 지지하는 내용의 결의안이 채택되었다.

도나텔라 로베라 상임고문은 “예멘 분쟁으로 인한 민간인들의 고통에 대한 국제사회의 무관심은 충격적인 수준이다. 지난주 유엔 인권위원회 총회에서 모든 분쟁 당사자들의 인권침해행위를 국제적으로 조사하려는 시도가 실패하면서, 예멘의 인권침해 가해자들이 전혀 처벌받지 않는 문제를 해결하지 못한 국제사회의 실책이 또 하나 늘었다”며 “책임성 부재로 예멘 위기는 더욱 악화되고 있으며, 가해자들이 범죄를 저질러도 처벌받지 않는다고 생각하는 한 민간인들은 그로 인해 계속해서 고통받게 될 것”이라고 말했다.

국제적 조사위원회 설립은 유엔 총회 혹은 안전보장이사회의 결의안 채택, 또는 유엔 사무총장 혹은 고등법무관의 결정이 있을 경우 가능하다.

Yemen: Call for suspension of arms transfers to coalition and accountability for war crimes

Damning evidence of war crimes by the Saudi Arabia-led coalition, which is armed by states including the USA, highlights the urgent need for independent, effective investigation of violations and for the suspension of transfers of certain arms, said Amnesty International in a new report published today.

‘Bombs fall from the sky day and night’: Civilians under fire in northern Yemen examines 13 deadly airstrikes by the coalition in Sa’da, north-eastern Yemen, which killed some 100 civilians, including 59 children. It also documents the use of internationally banned cluster bombs.

“This report uncovers yet more evidence of unlawful airstrikes carried out by the Saudi Arabia-led coalition, some of which amount to war crimes. It demonstrates in harrowing detail how crucial it is to stop arms being used to commit serious violations of this kind,” said Donatella Rovera, Amnesty International’s Senior Crisis Response Adviser who headed the organization’s fact-finding mission to Yemen.

“The USA and other states exporting weapons to any of the parties to the Yemen conflict have a responsibility to ensure that the arms transfers they authorize are not facilitating serious violations of international humanitarian law.”

Amnesty International is calling for a suspension in transfers to members of the Saudi Arabia-led coalition, that are participating in the military campaign, of weapons and munitions which have been used to commit violations of international humanitarian law, including war crimes in Yemen: in particular, bombs from the MK (MARK) 80 series and other general purpose bombs, fighter jets, combat helicopters and their associated parts and components.

More civilians have died as a result of coalition airstrikes than from any other cause during the conflict in Yemen. The city of Sa’da has suffered more destruction from coalition airstrikes than any other city in the country.

The report reveals a pattern of appalling disregard for civilian lives displayed by the Saudi Arabia-led military coalition which declared the entire cities of Sa’da and nearby Marran – where tens of thousands of civilians live – military targets in violation of international law. In at least four of the airstrikes investigated by Amnesty International, homes attacked were struck more than once, suggesting that they had been the intended targets despite no evidence they were being used for military purposes.

“The designation of large, heavily populated areas as military targets and the repeated targeting of civilian homes are telling examples revealing the coalition forces’ flagrant failure to take sufficient precautions to avoid civilian loss of life as required by international humanitarian law,” said Donatella Rovera.

Overall at least 59 children were killed in the 13 airstrikes documented by Amnesty International in the Sa’da region between May and July 2015, many of them while they were playing outside their homes, others while sleeping.

In one airstrike on 13 June 2015 at a home in Dammaj valley in al-Safra, coalition forces killed eight children and two women from the same family and injured seven other relatives.

“There were 19 people in the house when it was bombed. All but one were women and children. The children who would usually be outside during the day were in the house because it was lunchtime. They were all killed or injured. One of the dead was a 12-day-old baby,” said Abdullah Ahmed Yahya al-Sailami, whose one-year-old son was among those killed.

Another relative who helped with the rescue efforts said the body of a one-year-old baby was found in the wreckage with his dummy [pacifier] still in his mouth. Amnesty International researchers found only household items – children’s toys, books and cooking utensils – among the rubble. No sign of weapons or military-ware could be found, nor any other evidence to suggest the house was a legitimate military target.

Other attacks struck vehicles carrying civilians fleeing the conflict, foodstuff, humanitarian supplies and animals. The report also details several attacks on shops, markets and other commercial properties.

Civilians in Sa’da living under the terror of constant airstrikes are also contending with a major humanitarian crisis, which has seen electricity cut off to the whole of the city, the healthcare system collapsed in remote areas and a severe shortage of doctors.

Amnesty International researchers also found remnants of two types of cluster bombs, BLU-97 sub-munitions and their carrier (CBU-97) and the more sophisticated CBU-105 Sensor Fuzed Weapon. Cluster bombs, which are banned under international law, scatter scores of bomblets over a wide area. Many of the bomblets fail to explode upon impact, posing an ongoing deadly threat to anyone who comes into contact with them.

Mohammed Hamood al-Wabash, 13, sustained multiple fractures in his left foot after stepping on an unexploded bomblet from a cluster bomb. Amnesty International is urging coalition members to cease the use of cluster munitions immediately, and for all states to stop transferring such weapons.

Calls for accountability

Last week, attempts to set up an independent, international investigation into the conflict at the UN Human Rights Council in Geneva collapsed and instead a resolution was adopted supporting a national-led investigative committee.

“The world’s indifference to the suffering of Yemeni civilians in this conflict is shocking. The failure of the UN Human Rights Council last week to establish an international investigation into violations committed by all sides is the latest in a series of failures by the international community to address total impunity for perpetrators of serious violations in Yemen,” said Donatella Rovera.

“Lack of accountability has contributed to the worsening crisis and unless perpetrators believe they will be brought to justice for their crimes, civilians will continue to suffer the consequences.”

An international investigation or inquiry could be established through a resolution adopted by the UN General Assembly or the UN Security Council – or by the UN Secretary-General or the UN High Commissioner for Human Rights acting on their own initiative.

인도네시아 아체 주 정부는 일부의 경우 합의 하에 가진 성관계에 대해 채찍질형을 선고할 수 있고, 강간 가해자가 더욱 쉽게 처벌을 피할 수 있게 되는 신규 조례를 즉시 폐지해야 한다고 국제앰네스티가 23일 밝혔다.

23일부터 시행되는 아체의 신규 이슬람 형법(Qanun Jinayat)은 결혼하지 않은 남녀 또는 동성간의 합의 성관계에 대해 각각 최대 채찍질 30회와 100회의 체벌을 부과하고 있다. 또한 강간 피해를 신고하기까지 매우 번거로운 절차를 추가하고, 허위로 신고했다고 간주된 사람은 누구나 처벌할 수 있도록 명시했다.

요세프 베네딕트(Josef Benedict) 국제앰네스티 동남아시아 캠페인국장은 “합의 하에 성관계를 가졌다는 이유만으로 채찍질형 100회에 처하는 것은 비열한 일”이라며 “범죄에 대한 처벌로 체벌을 부과하는 것은 잔인하고 비인도적이며 굴욕적인 대우이자 고문까지 해당할 수 있다. 이처럼 말도 안 되는 신체적 학대로 입은 상처는 영구적인 부상으로 이어질 수 있으며, 조직적으로 폭행을 당한 데 따른 심리적인 영향은 말할 것도 없을 것이다. 이는 명백한 인권침해로, 즉시 폐지되어야 한다”고 말했다.

아체의 이번 신규 조례는 이슬람 형법으로 입안된 것임에도 불구하고 이슬람 신도뿐만 아니라 신도가 아닌 사람들에게도 적용되며, 현 인도네시아 형법상으로는 범죄가 아닌 행위까지도 범죄로 간주하고 있다.

이번 조례에서는 체벌이 가해질 수 있는 범죄의 범위가 더욱 넓어졌을 뿐만 아니라, 여성들이 강간 피해를 신고하기 위해 필요한 조건이 더욱 추가됐다.

강간 피해자는 피해 사실을 신고할 때 자신이 강간을 당했다는 증거를 제시해야 한다. 제시된 증거가 충분하지 않다고 간주될 경우, 용의자는 자신의 결백을 주장하며 선서를 하는 것만으로 처벌을 피해갈 수 있다. 또한 신규 조례에서 “허위” 신고를 할 경우 채찍질형과 벌금형, 최대 징역 30월형까지 처할 수 있도록 명시하고 있어, 강간 피해를 신고하려는 여성은 더욱 줄어들 것으로 보인다.

베네딕트 국장은 “이러한 점은 강간과 같은 성폭행 사건을 조사하고 기소하지 못하도록 가로막는 장애물이 되어, 피해자들이 사법절차를 밟지 못함은 물론 처음부터 강간 피해 사실을 신고하지 못하게 할 가능성도 있다. 이들을 성폭행 위협에 더욱 취약한 상태로 내몰게 될 뿐”이라고 말했다.

또한 우려되는 점은 이번 조례에 “아동과의 간통”죄가 신설되어, 사실상 아동 성폭행을 불륜 또는 “간통”과 마찬가지로 취급하면서 어린이에게 심각한 영향을 미칠 가능성이 있다는 것이다. 성폭행과 성관계 강요로부터 특히 어린이를 보호해야 할 인도네시아의 의무에 반하는 내용이다.

베네딕트 국장은 “인도네시아의 인권적 의무는 국가적, 지역적 수준의 모든 법과 관행에 적용되며, 중앙정부는 국내의 어디서든 인권이 존중될 수 있도록 해야 한다. 분권화 과정과 지방 자치로 인권이 희생되어서는 안 될 것”이라고 말했다.

배경정보

인도네시아의 다른 지역에서는 체벌이 불법인 반면, 특별자치지역인 아체 주는 2002년부터 체벌을 다양한 범죄에 대한 처벌 형태로 부과해 왔다.

2008년 유엔 고문방지위원회는 인도네시아에 체벌 부과를 허용하는 모든 국가적, 지역적 법률에 대해 폐지를 목적으로 검토할 것을 촉구했다.

세계 각국의 시민적, 정치적 권리에 관한 국제규약(ICCPR) 준수 여부를 감독하는 유엔 인권위원회는 2013년 인도네시아에 체벌을 폐지하기 위한 실질적인 행동에 나설 것과, 형벌로서의 체벌 사용을 허용하고 있는 아체 주 조례의 관련 조항을 폐지할 것을 요청했다.

Indonesia: Repeal abhorrent bylaw that imposes flogging for consensual sex

Authorities in the Indonesian region of Aceh must immediately repeal a controversial new bylaw which imposes harsh flogging sentences for consensual sex in some instances and could make it easier for rapists to escape justice, said Amnesty International today.

Aceh’s new Islamic Criminal Code (Qanun Jinayat) came into effect today, imposing caning sentences for consensual sexual relationships outside marriage and same-sex relations, punishable by up to 30 lashes and up to 100 lashes, respectively. It also introduces unacceptable hurdles for those reporting rape along with punishments for anyone deemed to have made false allegations.

“To punish anyone who has had consensual sex with up to 100 lashes is despicable,” said Josef Benedict, Amnesty International’s South East Asia Campaigns Director.

“The use of caning as a punishment constitutes cruel, inhuman and degrading treatment and may amount to torture. Injuries sustained from such monstrous physical abuse may well lead to permanent physical injuries, to say nothing of the psychological consequences of being systematically beaten. This is a flagrant violation of human rights and must be repealed immediately.”

Despite being billed as an Islamic Code, the new Aceh bylaw applies to Muslims and non-Muslims alike for offences which are not considered crimes under the current Indonesia criminal code (KUHP).

The new code not only expands the range of offences for which caning can be imposed, but also includes new requirements for women reporting rape.

Rape victims must produce evidence of having been raped when filing a complaint. If the authorities deem the evidence is insufficient, the alleged perpetrator can evade punishment merely by taking an oath to assert their innocence. Women will also be less likely to report rapes, as the new bylaw introduces punishments, including flogging, a fine and the possibility of up to 30 months in prison for making “false” accusations.

“This creates unacceptable hurdles for investigating and prosecuting rape and other sexual violence, hindering victims from accessing justice and potentially deterring them from reporting rapes in the first place. This will only further endanger those at threat of sexual violence,” said Josef Benedict.

Equally worrying is the fact that new code may also have serious implications for children as it introduces the offence of “adultery with a child”, potentially treating sexual violence against children as sex outside marriage or “adultery”. This flies in the face of Indonesia’s obligation to provide special protection for children from sexual coercion and violence.

“Indonesia’s human rights obligations apply to laws and practices at whatever level – national, regional or local – and the central government must ensure that human rights are respected everywhere in the country. The decentralization process and regional autonomy must not come at the expense of human rights,” said Josef Benedict.

Background

Although corporal punishment is illegal in the rest of Indonesia, the Acehnese provincial government has imposed caning as a form of punishment for various offences since 2002, under its special autonomy status.

In 2008 the UN Committee against Torture called on Indonesia to review all national and local legislation that allows the use of corporal punishment with a view to abolishing it.

In 2013 the UN Human Rights Committee, which monitors states’ compliance with the International Covenant on Civil and Political Rights (ICCPR), asked Indonesia to take practical steps to put an end to corporal punishment and to repeal the provisions of the Acehnese law permitting its use in the penal system.

Laws concerning “adultery” have a disproportionate impact on women in a society where discriminatory attitudes attempt to control their sexuality. Social expectations regarding what constitutes “appropriate” behaviour for women mean they are more likely to face arrest and prosecution for such “crimes”. Women from poorer backgrounds, who often face arbitrary detention, will be more severely affected as they won’t be able to afford legal representation.

지난 1월 국제앰네스티는 시나이 북부 지역에서 보안군 병사들에게 초법적 처형을 당한 남성 6인의 사례를 집중 조명했다. 피해자들은 살해될 당시 1~3개월 동안 구속된 상태였다.

이슬람계 TV 방송국 메카밀린(mekameleen)이 공개한 이 유출 영상에는 이집트군 병사들이 미국산 험비 장갑차량에서 비무장 상태의 남성 2명 이상을 억류하고 있다가 곧장 총살시키는 모습도 나타났다. 미국은 이집트 군수품의 주요 공급국이다. 스톡홀름 국제평화조사기구(SIPRI)에 따르면 미국은 2003년부터 험비(고기동다목적차량) 100대를 포함해 1,000대가 넘는 병력수송장갑차량을 이집트에 공급했다.

나지아 보나임 국장은 “미국을 비롯한 여러 국가들은 이전한 무기가 중대한 인권침해를 저지르거나 용이하게 하는 데 사용될 가능성에 대해 아무런 관리감독 또는 감시도 없이 시나이 북부의 이집트군에 무기를 이전하고 있다. 이러한 무기 이전은 모두 중단되어야 한다”고 말했다.

유출된 비디오의 초법적 처형 장면

시나이 지역 소식통에 따르면 이 영상은 시나이 반도 북부의 셰이크 조와이드와 라파 사이에 위치한 사막 지역에서 촬영된 것이다. 인터넷 지역뉴스매체인 ‘시나이 24’는 피해자 두 명이 형제지간으로, 16세의 압드 엘 하디 사브리(Abd el-Hady Sabry)와 19세의 다우드 사브리(Dawood Sabry)라고 보도했다. 두 사람은 이집트와 이스라엘 국경지대에 위치한 라파의 알 아와브다 부족 출신이다. 동영상 속에서 십대 청소년이 총살되기 전 자신은 알 아와브다 부족 출신이며 라파에서 왔다고 말하는 장면과 일치한다.

유부녀와 달아난 오빠에 대한 처벌로 강간과 나체 행진 위기에 놓였던 미나크시 자매와 그 가족이 경찰의 보호를 받을 수 있게 됐다. 국제앰네스티 인도사무소는 우타르 프라데시 주 바팟 마을의 달리트 계급 가족이 처한 위기상황을 인정한 인도 대법원 판단을 환영한다고 밝혔다.

지난 16일 대법원은 미나크시 쿠마르(Meenakshi Kumari, 23세)가 카스트제도에 기반한 차별과 폭력으로부터 보호를 요청하는 탄원서 내용을 받아들여 델리 경찰에 그녀와 가족을 보호할 것을 명령했다. 하루 전인 15일 법원은 비공개로 마나크시 가족에게 완벽한 보호를 보장했다.

미나크시 쿠마르가 제출한 탄원서에는 그녀의 가족이 카스트 지배계급으로부터 심각한 인권유린을 당할 위기에 처해있다는 내용이 담겨있다. 마을 회의인 캅 판차야트(Khap Panchayats)에서 결정한 바에 따르면, 카스트 제도상 상위계급 유부녀와 달아난 라비 쿠마르(Ravi Kumar)와 남매 지간이라는 이유로 미나크시와 15세 여동생은 강간을 당하고, 나체로 행진하는 ‘처벌’을 받아야 했다.

India : Supreme Court recognizes risks to Baghpat Dalit family

Amnesty International India welcomes orders by the Supreme Court of India that recognize the vulnerability of a Dalit family from Baghpat, Uttar Pradesh, who fled their village fearing caste-based discrimination and violence.

On 16 September, the Supreme Court, responding to a petition filed by 23-year old Meenakshi Kumari, directed the Delhi Police to provide the family with protection. The previous day, the Court had assured the family in an in-camera hearing that they would receive full protection.

Meenakshi Kumari’s petition stated that the family had faced several human rights abuses by dominant caste members, including an order by a khap panchayat- an unelected all-male village body- that she and her 15-year old sister be raped and paraded naked as ‘punishment’ for their brother Ravi Kumar having eloped with a married woman from a dominant caste.

“The last few months have been a harrowing time for this family,” said Gopika Bashi, Women’s Rights Researcher, Amnesty International India. “The Supreme Court orders offer hope that they will finally get justice.”

The Supreme Court also ordered that Meenakshi’s brother Ravi Kumar, who is being detained in a case of alleged drug possession, be released on a personal bond. Ravi Kumar was arrested in May a day after he and the dominant caste woman were handed over to the police.

A local court had ordered his release on bail, but the family was unable to find anyone to serve as a guarantor.

In a recorded telephone conversation in May allegedly between Ravi Kumar’s brother and a local police official, the official had admitted that he had been falsely implicated. Another case of alleged rape has also been filed against members of the family, who say that it is fabricated.

The Supreme Court ordered that no investigation report in the two cases be filed without its permission. A local police official involved in Ravi Kumar’s arrest has already been suspended.

Rahul Tyagi, a lawyer for the family, told Amnesty International India, “The Supreme Court has directed the Uttar Pradesh Police not to file any charges in the cases without its permission.”

Gaurav Bhatia, the Additional Advocate General of Uttar Pradesh, said, “We are very concerned. The state government has offered to provide protection to the family. Their security is of utmost importance.”

“The Uttar Pradesh Government must ensure that the family receives adequate remedy, including justice and reparation,” said Gopika Bashi.

“If the family is unable to return to their village, they must receive the support they need to live elsewhere in safety and with dignity.”

이보다 앞선 13일 오전에는 말레이시아 북부 페낭 섬 연안에서 500여명을 실은 배 한 척이 발견됐다. 말레이시아 정부는 배를 돌려보내고 난민들을 강제 추방하는 등의 강경책을 사용해 불법 입국자들에게 “올바른 메시지”를 전할 것이라고 밝힌 바 있다.

슛체 조사관은 “말레이시아 정부는 13일 해안에 도착한 수백 명을 처벌할 것이 아니라 지켜야 할 의무가 있다. 가장 절실히 필요한 의료적 지원을 제공하고, 어떠한 경우에도 이들을 바다로 돌려보내거나, 인권 또는 생명을 위협받는 장소로 보내는 일은 없어야 한다”며 “배에 타고 있던 사람들을 돌려보내겠다는 정부의 발언은 인간의 존엄성에 대한 모욕이다. 또한 만약 정부가 경고한 대로 조치할 경우, 말레이시아의 국제법적 의무를 위반하게 될 것”이라고 말했다.

지난 수 일간 미얀마와 방글라데시에서 배를 타고 말레이시아, 인도네시아로 도착한 난민의 수가 부쩍 증가했다. 11일에는 미얀마의 로힝야족으로 추정되는 400여명을 태운 보트 최소 한 척 이상이 인도네시아 아체 연안에서 발견되어, 식량과 연료를 전달받은 후 인도네시아 해군에게 예인되었다.

태국이 불법 입국을 단속하면서 밀수업자와 밀입국 브로커들이 새로운 경로를 물색할 수밖에 없었던 것으로 보인다. 국제이주기구(IOM)는 태국 근해에 여전히 8,000명 가량이 배를 타고 표류 중일 것으로 추정하고 있다.

방글라데시와 미얀마를 떠난 수천 명은 주로 미얀마에서 차별과 폭력을 피해 온 이슬람계의 로힝야족과 같은 취약한 이주민, 난민들과 인신매매의 피해자들로 구성되어 있다. 대부분 고향에서의 견딜 수 없는 상황을 벗어나고자 목숨을 걸고 위험한 바다로 나올 만큼 절박한 사람들이다.

슛체 조사관은 “위험에 처한 수천 명의 생명이 가장 우선되어야 하지만, 이러한 위기상황의 근본적인 원인 역시 해결되어야 할 것이다. 수천여 명에 이르는 로힝야족 사람들이 미얀마에 남아있기보다 위험한 밀항을 택했다는 사실은 현지의 상황에 대해 많은 것을 시사하고 있다”고 말했다.

South East Asia: Immediately step up efforts to rescue thousands at grave risk at sea

South East Asian governments must step up urgent search and rescue efforts to ensure that thousands of people stranded in boats are not left in dire circumstances and at risk of death, Amnesty International said, as another boat carrying hundreds of people thought to be migrants and asylum seekers in desperate conditions is currently awaiting rescue off the Thai coast.

Amnesty International has confirmed that a boat crammed with some 350 people, including children, is currently drifting off the coast of Thailand and Malaysia. The hundreds of people, believed to be from Myanmar or Bangladesh, have been at sea for “many days”, possibly more than two months. Their crew abandoned them several days ago. The passengers are without food and water and are in urgent need of medical care. Thai Navy vessels are currently searching for the boat.

“Governments in South East Asia must act immediately to stop this unfolding humanitarian crisis. It is crucial that countries in the region launch coordinated search and rescue operations to save those at sea – anything less could be a death sentence for thousands of people,” said Kate Schuetze, Amnesty International Asia Pacific Researcher.

“It’s harrowing to think that hundreds of people are right now drifting in a boat perilously close to dying, without food or water, and without even knowing where they are.”

Earlier today, a boat carrying some 500 people was found off the coast of Penang island in northern Malaysia. Malaysian authorities this week said they would use punitive measures, including pushing back boats and deporting migrants and refugees, to send the “right message” to irregular arrivals.

“The Malaysian authorities have a duty to protect and not punish the hundreds of people who reached the country’s shores today. They must be given the medical care they desperately need, and in no circumstances be sent back to sea or transferred to a place where their rights or lives are put at risk,” said Kate Schuetze.

“Comments by the authorities that they will turn back those arriving on boats are an affront to human dignity. What’s more, if authorities follow through with these threats, they will be violating Malaysia’s international legal obligations.”

In the last few days, increasing numbers of people from Myanmar and Bangladesh have arrived by boat in Malaysia and Indonesia. At least one boat with some 400 people believed to be Rohingya was on Monday towed out to sea by the Indonesian Navy, off the coast of Aceh, after it was provided with food and fuel.

A crackdown on irregular arrivals in Thailand seems to have forced smugglers and traffickers to look for new routes. The International Organization for Migration believes that 8,000 people may still be on boats close to Thailand.

The thousands of people who have fled Bangladesh and Myanmar include vulnerable migrants, refugees such as Muslim Rohingya fleeing discrimination and violence in Myanmar, and victims of human trafficking. Many are desperate enough to put their own lives at risk by braving dangerous journeys at sea in order to escape unbearable conditions at home.

“The thousands of lives at risk should be the immediate priority, but the root causes of this crisis must also be addressed. The fact that thousands of Rohingya prefer a dangerous boat journey they may not survive to staying in Myanmar speaks volumes about the conditions they face there,” said Kate Schuetze.
