2011년 3월 15일 시리아 반정부시위가 시작된 이후, 지난 5년간 전쟁범죄와 반인도적 범죄 등 끔찍한 인권침해가 시리아를 휩쓸며 수많은 사람이 고통 속에 신음하게 되었다고 국제앰네스티가 밝혔다.

살릴 셰티(Salil Shetty) 국제앰네스티 사무총장은 “시리아 시위가 처음 시작된 이후로 지난 5년간의 세월은 엄청난 규모의 공포와 유혈사태로 얼룩져 왔다. 시리아 정부군이 평화적인 시위대를 향해 처음 발포했던 순간부터 민간인의 고통과 잔혹함은 시리아 사태를 비극적으로 상징하게 되었다”고 말했다.

또한 “시리아군을 비롯해 자칭 ‘이슬람국가(IS)’와 같은 비정부 무장단체는 인권과 전쟁법은 물론, 자신들로 인해 목숨을 잃고 상처 입거나, 피난을 떠나고, 포위당한 지역에서 굶주리는 민간인들에 대해 싸늘한 무관심으로 일관하고 있다. 시리아군은 민간 지역에 무자비한 ‘드럼통 폭탄(barrel bomb)’ 공격을 가하고, 대규모의 납치 활동과 산업 규모의 조직적 고문을 자행하는 등 끔찍한 전략을 사용하며 반인도적 범죄를 버젓이 저질렀다. 특히 IS와 같은 일부 무장단체는 세계 언론에 주목받는 점을 이용해 시리아인과 외국인을 막론한 민간인을 납치하고 약식 처형하는 등 자신들이 저지른 전쟁범죄를 아랑곳 하지 않고 홍보하고 있다”고 말했다.

다음은 지난 5년간 시리아 사태가 최악으로 치닫게 된 다섯 가지 결정적 순간을 정리한 것이다.

  • 반정부 시위가 시작된 지 3일이 지난 2011년 3월 18일, 남부 데라아(Dera’a)에서 반정부 성향의 그래피티를 그렸다는 이유로 체포, 고문당한 소년들의 석방을 요구하던 평화적 시위대를 향해 시리아군이 실탄을 발사했다. 이날 이후 시위는 유혈 사태로 번졌고, 이날의 발포는 정부군이 평화적인 시위를 탄압하는 데 치명적 무력을 광범위하게 사용하며 결국 전면적인 무장 분쟁으로까지 이어지게 되는 전조였다.
  • 2013년 8월 다마스쿠스 동부 고타(Ghouta)에서 화학무기 공격으로 고통스러워하는 주민의 모습을 담은 영상이 공개되면서 세계는 충격에 휩싸였고, 시리아에서 자행되고 있는 끔찍하고 잔혹한 인권침해에 대해 경종을 울렸다. 그러나 안타깝게도 이는 빙산의 일각에 불과했다. 화학무기 외에도 확산탄과 같은 금지 무기를 사용해 공격하거나 정기적인 미사일, 박격포 폭격을 가하면서 시리아 전역에서는 매일같이 점점 더 많은 사람들 목숨을 잃고 있다. 그런데도 유엔 안전보장이사회는 시리아 상황을 국제형사재판소(ICC) 검찰부에 회부하는 데 합의하지 못했고, 특히 러시아와 중국은 거부권을 행사해 민간인 보호 결의안 통과를 여러 차례 저지하는 등 수년째 제대로 대처하지 못하고 있다.
  • 2014년 1월 다마스쿠스 외곽 야르무크(Yarmouk)에서 봉쇄된 지역에 갇힌 주민들이 구호물품을 받기 위해 길게 늘어선 충격적인 모습은 시리아 전역의 봉쇄된 지역에서 식량과 의료 지원이 부족해 죽어가는 수천 명의 안타까운 현실을 알리는 계기가 되었다. 야르무크 외에도 모아다미야(Moadamiya), 동부 고타, 마다야(Madaya), 알포아(al-Fouaa) 등지를 봉쇄하며 정부군과 무장단체는 주민들의 굶주림을 전쟁 무기로 사용했다. 현재 시리아 15개 지역에서 40만 명 이상이 봉쇄지역에 갇혀 있다. 최근 합의된 휴전 협정의 일환으로 봉쇄지역에 한정된 수준의 구호물품이 전달되고 있지만, 여전히 이곳 주민들은 아사할 위험에 처해 있으며 제한 없는 인도적 지원이 절실히 필요한 상황이다.
  • 2014년 1월, 시리아군 출신 제보자가 비밀리에 촬영한 고문당하고, 굶주리고 불탄 시신들의 섬뜩한 사진이 공개됐다. ‘카이사르 고문 사진’으로 알려진 이 사진들은 시리아의 수용소 내에서 제도적인 고문과 비사법적 처형이 이루어지고 있다는 또 하나의 강력한 증거로, 바사르 알 아사드(Bashar al-Assad) 대통령 정권이 반대자를 무자비한 수법으로 처벌하고 있음을 전 세계에 알렸다. 아직도 수만 명이 시리아 보안정보당국에 체포된 이후 행방이 묘연한 상태다.
  • 2015년 9월 시리아 정부를 지원하는 러시아의 첫 공습이 시작됐다. 표면상으로는 IS를 노린 공격이었지만 대부분 반군 점령 지역이 폭격을 당했다. 러시아의 참전으로 공습이 더욱 격화되었고, 특히 시리아 북부 지역에서는 전쟁범죄로 추정되는 공격까지 가해지며 민간인 수백 명이 목숨을 잃었다. 최근에는 알레포 인근에서 러시아와 시리아 전투기가 전략적으로 병원을 폭격하며 명백한 국제법 위반행위를 저질렀다.

From hope to horror: Five years of crisis in Syria

A horrifying catalogue of human rights abuses including war crimes and crimes against humanity have overwhelmed Syria over the past five years causing human suffering on a vast scale, said Amnesty International, marking the five-year anniversary of the start of anti-government protests in the country on 15 March 2011.

“The five years since the uprising in Syria first began have been marred by horror and bloodshed on a colossal scale. From the moment that Syrian government forces first opened fire on peaceful protesters, brutality and civilian suffering have been the tragic hallmarks of this crisis,” said Salil Shetty, Secretary General of Amnesty International.

“Government forces and non-state armed groups, including the one calling itself the Islamic State (IS), have displayed a callous indifference to human rights and the laws of war as well as the civilians they have killed, maimed, displaced and, in some areas under siege, starved.

“Government forces have brazenly committed crimes against humanity through the use of appalling strategies such as relentless barrel bomb attacks on civilian areas, a campaign of mass disappearances and systematic, industrial-scale torture. Some armed groups, particularly IS, have exploited the international media spotlight to cynically broadcast their own war crimes, such as the abduction and summary killing of Syrian and foreign civilians.”

Here is a reminder of five key moments that saw the crisis in Syria go from bad to worse over the past five years:

On 18 March 2011, three days after the start of the uprising Syrian government forces opened fire on peaceful protesters in the southern city of Dera’a, using live ammunition against demonstrators demanding the release of boys arrested and tortured for anti-government graffiti. This marked a bloody turning point, and was a precursor to the widespread use of lethal force by government forces to suppress peaceful protests, which eventually evolved into a full-blown armed conflict.

Video footage showing civilians suffering from the effects of a chemical weapons attack in Eastern Ghouta, east of Damascus in August 2013 shocked the world, acting as a wake-up call to the horrific and cruel nature of the abuses being committed in Syria. Sadly, this was just the tip of the iceberg. Across Syria, civilians continued to be killed on a daily basis often in far greater numbers in attacks using both other banned weapons such as cluster munitions and regular bombs, missiles and mortars. However, for years the UN Security Council dragged its feet, with member states failing to unite to refer the situation in Syria to the Prosecutor of the International Criminal Court and Russia and China in particular blocking several resolutions on the protection of civilians using veto powers.

The surreal images of crowds of besieged civilians queuing for aid parcels in Yarmouk on the outskirts of Damascus in January 2014 brought to life the tragic reality that thousands of people trapped under siege across Syria were dying from lack of food and medical care. Beyond Yarmouk starvation has been used as a weapon of war by both government forces and armed groups in areas such as Moadamiya, Eastern Ghouta, Madaya and al-Fouaa. Today more than 400,000 people are under siege in 15 locations across Syria. Despite limited deliveries of aid to besieged areas as part of the ceasefire agreed in recent weeks, civilians are still at risk of starving to death and in desperate need of unfettered humanitarian aid.

Harrowing photographs showing tortured, starved and burnt bodies, known as the “Caesar” torture photos, were smuggled out of Syria by a military defector and published in January 2014. These provided the strongest evidence yet of systematic torture and extrajudicial executions taking place inside government detention centres, opening the world’s eyes to the ruthless tactics used to punish those who dare to oppose the government of President Bashar al-Assad. Tens of thousands remain missing after being arrested by one of Syria’s various security and intelligence forces.

Russia began its first air strikes in support of the Syrian government in September 2015, ostensibly targeting IS but mostly hitting areas under the control of armed opposition groups. Russia’s entry into the fray has led to intensive aerial bombardments, particularly in northern Syria, that have killed hundreds of civilians, including in attacks that appear to be war crimes. Most recently an offensive in the vicinity of Aleppo has seen Russian and Syrian warplanes bomb hospitals as part of its military strategy in flagrant violation of international law.

‘간성(인터섹스, intersex)’이란 무엇을 가리키는 말일까? 답하지 못한다 하더라도, 당신만 모르는 것은 아니다. 많은 사람이 간성이 무엇인지, 또 간성인 사람들이 어떤 문제를 겪는지 잘 모른다. 간성으로 태어난 아이들 중 많은 수가 낙인과 차별뿐만 아니라, 어린 나이에 불필요한 수술을 받는다. 자신의 의견을 제대로 표현하지 못할 때 돌이킬 수 없는 수술을 받는다.

10월 26일 간성의 날을 맞아, 지난 2년 6개월 동안 간성 인권을 위해 헌신한 간성인권활동가 키티 앤더슨(Kitty Anderson)에게 자세한 이야기를 들어 보았다.

간성이란 무엇인가?

간성은 남성 또는 여성이라는 전형적이고 이분법적인 “규범”에서 벗어난 성별적 특징을 지닌 사람들을 통틀어 이르는 포괄적 용어다. 내, 외부 생식기, 생식계, 호르몬 분비, 성 염색체와 같은 1차 성징, 또는 사춘기 때 명확히 드러나는 2차 성징 모두 포함될 수 있다.

간성은 생물학적 특징을 가리키는 것이지 성 정체성 자체를 가리키는 말은 아니다. 성 지향성 역시 해당되지 않으며, 간성들도 다양한 성 지향성을 지니고 있다.

자신이 간성이라는 것은 언제 알게 되었나?

13세 때 처음 알게 됐고, 당시에 너무 충격적이었다. 간성에 대한 침묵과 낙인 때문에 그 누구에게도 말할 수 없었다. 그러다 몇 년이 지나서 사촌동생 역시 간성으로 태어나자, 가족들은 더 이상 숨기지 않았고, 우리 가족은 그 과정을 통해 치유되었다.

사회생활에 영향을 미칠까 봐 간성이라는 것을 숨기고, 언급해서는 안 된다는 생각을 극복하는 데 오랜 시간이 걸렸다. 생리나 임신 같은 주제가 나오면 나는 그저 고개만 끄덕이며 대화를 따라가곤 했다. 그것이 모두가 기대하는 모습이기 때문이었다. 하지만 그렇게 하고 싶지 않았다.

교환학생으로 호주에 갔을 때 ‘외국이니까 여기서 그냥 해 보자’라는 생각으로 처음으로 간성임을 밝히기 시작했다. 새로운 사람을 만나고 내 소개를 할 때마다 간성이라는 것도 함께 말했고, 아무런 문제나 충돌도 일어나지 않았다. 부적절하고 기분을 상하게 하는 말을 하는 사람들도 있었지만 그런 일이 일상적이지는 않았다.

19세 때 모국인 아이슬란드로 돌아와서는 그에 대해 더 많은 이야기를 하기 시작했다. “난 간성이야!” 라고 떠들고 다니는 게 아니라 밝힐 수 있는 시점이 되면 말하기 시작했다. 이제는 자연스러운 습관이 되었고, 말을 고르지 않게 되어 대화 중에도 아무렇지 않게 언급하고 있다. 간성인 사람들은 그동안 스스로를 숨긴 채 살았기 때문에 다른 간성인 사람을 만나볼 기회나, 공동체를 공동체를 구성하는 것이 어려웠다.

간성이 겪는 인권 문제로는 어떤 것이 있는가?

간성으로 태어난 아이들은 전형적인 남성 또는 여성의 외모에 맞는 사람으로 ‘정상화’하기 위해, 아주 어린 나이에 수술을 받는다. 이러한 초기 수술은 미용 또는 사회적인 이유로 대부분 아이의 성기를 평범한 모습으로 만드는 것이다.

삶을 바꿀 수도 있는 외과 수술은 아이가 자신에게 벌어지는 일에 대한 의견을 표현할 능력조차 없는 어린 나이에 이루어지고 있다.

최근에는 부모의 동의 하에 수술을 진행하는 것이 일반적이지만, 부모가 수술과 그로 인한 결과가 어떠한 영향을 미칠지 충분한 정보를 받는지 의문이다. 부모는 아이에게 장기적인 건강 문제를 야기하고, 이 때문에 평생 호르몬 치료를 받을 수도 있는 수술에 동의해야 한다. 그러나 아이에게도 이처럼 자신의 신체에 관한 중요한 선택을 직접 할 권리가 있어야 한다.

남성과 여성이라는 이분법적 젠더가 간성들이 겪는 어려움을 더욱 악화시킨다고 보는가?

매우 그렇다! 젠더 이분법이 매우 공고하다는 것은 많은 사람이 젠더와 성별에 엄격한 선을 긋고 있다는 것이다. 우리는 세상에 두 개의 성별이 있고, 남성인지 여성인지에 따라 서로 다른 역할을 해야 한다고 배워 왔다. 이렇게 엄격한 기준으로 사람을 분류하고 판단하는 방식은, 그 틀에 맞지 않는 사람일 경우 문제가 된다. 우리는 여전히 이분법적 젠더를 요구하며 이러한 기준을 아이들의 신체에도 강요하는 세상에 살고 있다. 아주 어린 나이에도 신체적 외형 때문에 잔혹한 수술을 당해야 하는 간성인 어린이들 역시 마찬가지다.

내가 직접 경험한 것과 사촌동생이 겪은 일을 지켜본 경험은 이제 변화가 필요하다는 것을 여실히 보여준 것이었다.

문제는 간성 어린이에게 있는 것이 아니라, 아이들에게 자신들의 이상에 따를 것을 강요하는 사회에 있기 때문이다.

그렇다면 어떤 변화가 일어나길 바라나?

우리 목표는 미용 또는 사회적인 이유로 아이들에게 이루어지는 불필요한 의료 수술을 모두 중단시키는 것이다. 또한 교육과 인식 제고를 통해 낙인을 극복하고, 부모에게 더 많은 심리적 지원을 제공함으로써 간성 어린이가 고립되거나 외로움을 느끼지 않고 쉽게 지원을 받거나 또래 집단에 참여할 수 있도록 해야 한다.

이제는 간성을 포용하는 사회심리적 틀 마련으로 나아가야 한다. 문제는 간성 어린이에게 있는 것이 아니라, 아이들에게 자신들의 이상에 따를 것을 강요하는 사회에 있기 때문이다. 간성이든 아니든, 아이들은 누구나 자신의 인권을 존중받는 세상에서 자랄 권리가 있다.

이미 상당한 진전이 이루어지고 있다. 2015년 몰타에서는 간성인 어린이에게 사회적인 이유로 수술을 하는 것을 불법화했다. (실제로 이것이 발표된 날이 4월 1일이라, 처음에는 만우절 장난이 아닐까 내심 의심하기도 했다!)

콜롬비아 역시 이러한 수술은 사법제도를 거쳐야 하도록 제도를 마련했다. 유엔 고문방지위원회와 아동인권위원회는 다수의 국가에 간성 어린이들에게 불필요한 외과 수술을 하지 않도록 권고하기도 했다.

하지만 아직 해야 할 일은 많다. 대중의 인식을 높이지 않는다면 현재의 관행은 계속될 것이다. 그간 역사를 봐도 어린이의 인권과 신체 자율성 및 완전성을 보호하는 것보다는, 이런 수술에 더 효과적인 기술을 개발하는 데 주로 관심이 집중됐다.

사회가 이러한 기준을 만들었고, 어린이 인권을 존중하라 요구하지 않는 사회는 앞으로도 이런 문제를 언제든지 쉽게 감출 수 있다.

목소리를 내기 두려워하던 사람들이 사회적 인식에 변화가 일어나고 있음을 알고 지지하지 않는다면, 이들이 목소리를 높이고 더 큰 움직임에 동참하기란 더욱 어려워질 것이다.

Understanding the ‘i’ in LGBTI

Do you know what the term intersex means? If the answer is no, you’re not the only one. Many people couldn’t tell you; nor could they say what issues intersex people face.

As well as stigma and discrimination, many children who are born intersex face unnecessary medical surgeries in their early years, which irrevocably shape their lives before they are even able to express their opinion.

This Intersex Awareness Day we’ve been catching up with leading intersex activist Kitty Anderson, who has dedicated her time to fighting for the rights of intersex people for the past two and a half years.

What does it mean to be intersex?

Intersex is an umbrella term used to cover a broad group of people who have sex characteristics that fall outside typical, binary “norms” of male or female. These can include primary sex characteristics such as internal and external genitalia, reproductive systems, hormone levels and sex chromosomes, or secondary sex characteristics which become apparent at puberty.

Being intersex is about biological features and not your gender identity per se. It’s not about your sexual orientation either – intersex people have many sexual orientations.

How did you find out that you are intersex?

When I found out I was 13 and I completely freaked out. There can be a lot of secrecy and stigma related to being intersex and it was something that had been kept from me. But when my cousin – who is also intersex – was born a couple of years later, my family didn’t keep it a secret and it was a healing process for all of us.

It took a long time to get over feeling that this was something I should not mention, which affects your social life. When topics like menstruation or having kids came up, I would just nod and go along with the conversation because that was what was expected. But I didn’t want to.

I first started talking about being intersex when I went on exchange to Australia; I thought to myself, “I’m in another country, I’ll just try it out here”. So when I met new people I made being intersex a part of who I am and I didn’t have any trouble or problems with it – a couple of people made weird or inappropriate comments but it wasn’t the norm.

When I came back home to Iceland at 19 I started talking about it more. I wasn’t running around yelling “Hi, I am intersex!” but I came to a point where I could talk about it and it was fine. Now it’s just a part of me and it just comes up in conversations because I stopped moderating what I say. Being intersex has been so hidden and under the radar that a lot of people actually miss out on the chance to meet other intersex people, which has hampered community building.

What human rights issues do intersex people face?

In order to ‘normalise’ people who are born intersex so that they fit into a traditional male or female appearance, medical interventions are carried out on some very young children.

Most early interventions are surgeries on cosmetic or social grounds that serve to make the appearance of a child’s genitalia normative. These procedures include clitoral reductions, which is when tissue that is full of nerve endings is removed to make the appearance of the clitoris seem smaller, or surgeries to remove internal gonads (ovaries or testes), surgeries to create a new vagina or surgeries to normalise the appearance of the penis.

These invasive and life-changing interventions take place before the child can even voice their opinion on what is being done to them.

Generally surgical interventions today take place with the consent of parents. But what information is given to the parents about the surgeries – or the consequences – is usually questionable. Parents are expected to consent to treatments that may have long-term health consequences, which can include life-long needs for hormonal treatments. But really these children should have the right to make such major choices about their own bodies themselves.

Do you think male/female gender binaries perpetuate the challenges faced by intersex people?

Yes they do! Having a very strong gender binary means that a lot of people draw a straight line between gender and sex. We are told that there are two sexes with different expectations if you are a man or a woman. This whole way of strictly dividing or viewing someone is problematic if you don’t fit into that mould. We are still in a place where gender binaries are expected and forced onto children’s bodies, and this is applied to intersex children’s physical appearance at a very early age with brutal methods.

What I experienced personally, as well as what I watched my younger cousin go through, really demonstrated to me that things need to change.

So what changes do you want to see?

Our goal is to end all medically unnecessary interventions on children that are based on cosmetic or social grounds. We also need to educate people and raise awareness to overcome stigma, as well as provide more psychological support for parents, so that intersex children do not feel isolated or alone and can get easy access to support and peer networks.

We need to move towards a psycho-social framework which accepts intersex people, because the problem isn’t with intersex kids, it’s with society expecting them to conform to their ideals. It doesn’t really matter if it’s an intersex kid or not – all of our children deserve to grow up in a world where their human rights are respected.

Are we moving in the right direction?

There have already been a number of positive developments. In 2015 Malta outlawed surgeries based on social grounds on intersex children (this actually happened on April 1, which did initially lead to a sneaking suspicion that it was an April Fool’s joke!)

Colombia has also set up a system so that surgeries of this nature have to go through the court system. The United Nations Committee against Torture and Committee on Children’s Rights have issued recommendations to several countries to stop medically unnecessary surgical interventions on intersex children.

But there is still work to do. If we don’t raise awareness current practices will continue. What history has shown us is that the main focus of interest is in creating better techniques for surgeries of this nature, rather than protecting the rights of children and their bodily autonomy and integrity.

It was society that created this paradigm and without society now demanding that children’s rights be respected, it is always going to be easy to sweep these issues under the carpet.

Until people who are scared to speak out see that there is a shift in societal perception and support, it is going to be a lot harder for them to raise their voices and join the broader movement which so desperately needs them.

보고서 <불안 속 삶: 독일은 혐오범죄 피해자 대응에 어떻게 실패하고 있는가>에 따르면, 2015년 난민 거주지를 대상으로 발생한 범죄 횟수는 1,031건으로, 2013년 63건에 비해 16배나 증가한 했다. 인종, 민족, 종교 소수자 일반에 대한 인종차별주의자들의 폭력 범죄는 2013년 693건에 비해 2015년 1,295건으로 87%나 증가했다.

마르코 페롤리니(Marco Perolini) 국제앰네스티 EU 조사관은 “독일에서 혐오범죄가 급증함에 따라 오랫동안 입증돼 온 법집행기관의 인종차별 폭력에 대한 미흡한 대응 문제는 반드시 해결되어야 한다. 독일 연방정부와 주정부는 난민 거주지에 대한 공격을 막기 위해 포괄적인 위험 평가 전략을 시행할 필요가 있다. 공격받을 위험이 가장 높은 거주지에는 즉시 경찰 보호를 강화해야 한다”고 말했다.

독일은 유럽에서 난민에게 가장 여론이 우호적인 국가인 한편, 2015년 한 해 동안만 최대 6개의 난민 반대 시위가 매주 일어났다. 공격당한 많은 수의 망명신청자와 난민, 피해자의 친구나 지인들은 현재 겁에 질려 살아가며, 더 이상 안전하다고 느끼지 않는다고 국제앰네스티에 전했다.

시리아를 탈출한 쿠르드족 시완 B.는 지난 2015년 9월 드레스덴에서 습격을 당했다. 시완은 “내가 공격당한 후 친구들 모두 겁에 질렸다. 나는 시리아에서 탈출했고 이곳 독일에서는 더 이상 긴장할 필요가 없다. 나는 그저 직업을 갖고 싶고, 평범한 삶을 살고 싶다. 전쟁 전에 그랬던 것처럼..”이라고 국제앰네스티에 전했다.

제도적인 인종차별 타파해야

지난해 약 백만 명의 난민과 망명신청자를 받아들이기 전부터 독일 정부는 인종차별 범죄에 대해 효과적인 조사, 기소, 판결에 실패했다는 문제제기를 오랫동안 받았다.

이러한 문제점들은 2000년부터 2007년 사이 극우단체 국가사회주의지하당(NSU, the National Socialist Underground)이 저지른 연쇄 살인에 대한 허술한 조사로 드러났다.

터키계 남성 8명과 그리스계 남성 1명, 독일 경찰관 1명이 살해된 사건의 배후에 인종차별적 동기가 있음을 파악하고 도출하는 데에는 계속해서 실패한 한편, 피해자 가족들은 경찰에게 괴롭힘을 당하는 느낌이었다고 전했다.

자물쇠 수리공인 테오도루스 불가리즈는 지난 2005년 6월 15일, 뮌헨에 있는 자신의 상점에서 NSU 소속원들에게 공격을 당해 목숨을 잃었다. 테오도루스의 아내 이본느 불가리즈는 “몇 년이 흘렀지만 한 번도 피해자로 대우받은 적이 없다”고 국제앰네스티에 전했다. “경찰이나 정치인들은 마치 우리가 숨기는 것이 있다는듯 언제나 용의자처럼 대했다. 우리의 의견을 물어보거나 이야기를 들어주는 사람은 아무도 없었다.”

NSU 사건의 허술한 수사를 조사하며 독일 법집행기관은 수많은 권고를 제기하고 시행했다. 그러나 법집행기관은 인종차별 범죄 가능성을 성의있게 파악하고, 기록하고 조사하는데 계속해서 실패하는 것이 제도적인 인종차별에서 기인하는 것은 아닌가 라는 무시하기 힘든 의문에 대해서는 다루지 않았다.

터키에서 온 압둘라만은 2013년 9월 베른부르크 기차역에서 운영하던 자신의 케밥 식당에서 9명의 남성 집단에게 습격을 받고 중상을 입었다.

압둘라만과 당시 상황을 목격한 그의 동업자, 친구에 따르면 경찰이 현장에서 흉기로 사용된 공기펌프라는 중요한 증거를 가해자들에게 돌려줬다고 한다. 재판 과정에서 인종차별주의적 동기는 충분히 고려되지 않았고, 증거가 부족해 일부는 정당방위였다는 가해자들의 주장이 더욱 힘을 얻었다.

이러한 실책은 독일이 혐오범죄 등 정치적 동기의 범죄에 대한 자료를 수집하고 분류하는데 복잡한 체계를 갖고 있기 때문이기도 하다. 복잡한 체계로 인해 의도적이든 아니든 인종차별 범죄로 분류하고 처리되려면 까다로운 기준을 통과해야 한다. 경찰은 범죄 피해자나 관련된 누구든 인종차별적인 동기가 있다고 간주되는 범죄는 반드시 혐오범죄로 분류해야 한다.

Germany failing to tackle rise in hate crime

Failed responses to the sharp increase in hate crimes across Germany – including attacks on shelters for asylum-seekers – expose the need to urgently step up protection and launch an independent inquiry into possible bias within the country’s law enforcement agencies, said Amnesty International in a report released today.

The report, Living in insecurity: How Germany is failing victims of hate crimes, details how 16 times as many crimes were reported against asylum shelters in 2015 (1,031) as in 2013 (63). More generally, racist violent crimes against racial, ethnic and religious minorities increased by 87% from 693 crimes in 2013 to 1,295 crimes in 2015.

“With hate crimes on the rise Germany, long-standing and well-documented shortcomings in the response of law enforcement agencies to racist violence must be addressed,” said Marco Perolini, Amnesty International’s EU Researcher.

“German federal and state authorities need to put in place comprehensive risk assessment strategies to prevent attacks against asylum shelters. Further police protection is urgently needed for shelters identified at highest risk of attack.”

While the German public has been among Europe’s most welcoming to refugees, as many as six anti-refugee protests were staged weekly throughout 2015. Many asylum-seekers and refugees who were attacked, or whose friends or acquaintances were attacked, told Amnesty International that they now live in fear and no longer feel safe.

“All my friends were afraid after the attack against me. I escaped a war in Syria and I don’t need to face tensions here in Germany. I just would like to work … and to have a good life, as I had before the war,” Ciwan B., an ethnic Kurd who fled Syria and was attacked in Dresden in September 2015, told Amnesty International.

Thwarting Institutional racism

The failure of the German authorities to investigate, prosecute and sentence racist crimes effectively is a longstanding concern that predates the arrival of around one million refugees and asylum-seekers last year.
Many of these shortcomings were highlighted by the botched investigations into a spate of killings between 2000 and 2007, by the far-right group, the National Socialist Underground (NSU).

Investigations into the murders of eight men of Turkish descent, one man of Greek descent and a German police officer repeatedly failed to identify and follow up leads pointing to the racist motivation behind the attacks, while relatives of the victims reported feeling victimized by the police.

“In all these years, they never treated us as victims,” Yvonne Boulgarides – wife of locksmith Theodorus Boulgarides, killed in his Munich shop by NSU attackers on 15 June 2005 – told Amnesty International. “We were always treated as suspects by the police or politicians, as if we were hiding something. Nobody asked us about our opinions or listened to us.”

Inquiries into the NSU failures have resulted in a number of recommendations being made, and implemented by German law enforcement agencies. However, they have not tackled the pressing question of whether institutional racism is contributing to the ongoing failure to diligently identify, record and investigate possible racist crimes.

Turkish national Abdurrahman suffered life-threatening injuries after he was assaulted by a group of nine men as he closed his kebab shop at the Bernburg train station in September 2013.

According to him, his partner and a friend who witnessed the attack, police at the scene returned a key piece of evidence used in the assault – an air pump – to the attackers. Once in court, the racist motive was not fully taken into account and the lack of evidence helped to strengthen the group’s argument that they had acted partly in self-defence.

Some of these failures are the result of Germany’s complex system for classifying and collecting data on politically motivated crimes, which include hate crimes.

This system, consciously or otherwise, sets a high threshold for an offence to be classified and treated as a racist crime. Any criminal offences that are perceived to be racially motivated – by the victim or any other person – should be classified as hate crimes by the police.

“There are many factors that point to the existence of institutional racism with German law enforcement agencies. This question needs to asked, and it needs to be answered: real improvement in how law enforcement agencies tackle racist crime cannot happen unless those very agencies are prepared to examine their own attitudes and assumptions.”

“This is not a time for complacency, but for law enforcement agencies to take a long, hard look in the mirror. A fully independent public inquiry is urgently needed to review the NSU murder investigations and to establish the extent to which institutional racism may be contributing to the broader failure of law enforcement agencies to tackle racist crime effectively,” said Marco Perolini.

모로코에서 시민기자를 육성했다는 이유로 기자와 활동가 7명이 29일 재판에 서게 된 것은 표현의 자유를 제한하는 위험한 전례가 될 수 있다고 국제앰네스티가 밝혔다.

이들 7명은 스마트폰을 이용한 시민기자 교육 프로그램을 운영하다 기소되어 라바트(Rabat)에서 재판을 받게 됐다.

막달레나 무그라비(Magdalena Mughrabi) 국제앰네스티 중동북아프리카국 부국장대행은 “이들이 재판을 받게 된 것은 모로코의 자유를 억압하는 시험적 사례로 우려된다. 기자와 시민이 국내에서 자유롭게 소식을 알리는 것이 국가 안보를 저해한다는 혐의가 된 것과, 이들이 수감될 위험에 처한 것은 매우 불안한 징조”라고 말했다.

법원 공식 기록에 따르면 역사학자 마아티 몬지브(Maati Monjib)를 포함한 피고인 5명은 형법 206조에 따라 “국가와 국가기관에 충성해야 할 시민의 의무”를 위협할 수 있는 “선전 활동”을 통해 “국가 인터넷 안보를 위협”했다는 혐의로 기소되었다. 이들은 유죄가 선고될 경우 최대 징역 5년까지 처해질 수 있다.

마아티 몬지브는 “사기” 혐의로도 재판을 앞두고 있다. 나머지 피고인 두 명은 기자인 마리아 무크림과 라치드 타리크로, “정부에 신고하지 않고 외국 기부금을 받은 것”을 이유로 재판을 받게 되었다.

국제앰네스티는 이들 7명에 대한 기소를 모두 취소할 것을 모로코 정부에 촉구한다.

최근 수개월 동안 모로코 정부는 형법 개정 등의 사법 개혁을 단행한 것에 대해 대대적으로 홍보해 왔다. 6월 9일 정부의 승인을 받은 형법 개정 초안은 인권적으로 일부 긍정적인 제안이 포함되어 있었지만, 표현의 자유를 침해하는 데 이용되는 206조의 내용은 수정되지 않아, 큰 결함은 여전히 남아 있다는 점을 드러냈다.

스토리메이커(StoryMaker)는 제한없는 자유언론(FPU)과 가디언 프로젝트(Guardian Project), 스몰월드뉴스(Small World News)가 개발한 보안 스토리텔링 앱으로, 이 앱을 이용하면 시민기자들이 원할 경우 익명으로 글을 게시할 수 있다. FPU는 최근 자신들의 활동과 스토리메이커 앱에 대해 설명하고자 모로코 정부에 면담을 요청했지만 아무런 답도 받지 못했다고 밝혔다. FPU는 모로코 정부에 피고인 7명에 대한 혐의를 취소하고, 표현의 자유를 재판에 세우지 말 것을 촉구했다.

Morocco: Journalists risk imprisonment for running smartphone app training

Tomorrow’s trial of seven journalists and activists in Morocco for training citizen journalists could set a dangerous precedent for restricting freedom of expression, Amnesty International said.

“The trial of these journalists is a worrying test case for press freedom in Morocco. The accusations that journalists and citizens reporting freely in their country are compromising state security, and the risk that they may be imprisoned, are deeply alarming,” said Magdalena Mughrabi, Interim Deputy Director of the Middle East and North Africa Programme at Amnesty International.

Five of the defendants, including historian Maati Monjib, are accused of “threatening the internal security of the state” through “propaganda” that may threaten “the loyalty that citizens owe to the State and institutions of the Moroccan people” under Article 206 of the Penal Code, according to official court papers. They could be imprisoned for up to five years if found guilty.

Maati Monjib also faces a second charge of “fraud”. The remaining two defendants, journalists Maria Moukrim and Rachid Tarik are being tried for “receiving foreign funding without notifying the General Secretariat of the government.”

Amnesty International is calling on the authorities to drop the charges against the seven defendants.

In recent months the Moroccan government has trumpeted high-profile judicial reforms including an overhaul of the Penal Code. The draft law to amend the Penal Code, approved by the government on 9 June, includes some positive proposals for human rights but leaves unchanged Article 206, which is used to violate freedom of expression, highlighting that deep flaws in the code persist.

“Morocco’s authorities should drop these shocking charges against these seven journalists and activists immediately. They should repeal or amend Article 206, so that it can no longer be used to arbitrarily restrict freedom of expression,” said Magdalena Mughrabi.

StoryMaker is a secure storytelling app developed by Free Press Unlimited (FPU), the Guardian Project and Small World News, which enables citizen journalists to publish content anonymously if they wish to. FPU recently reported that its request to meet the Moroccan authorities to explain its work and the StoryMaker app was left unanswered. FPU is calling on Moroccan authorities to drop charges against the seven defendants and not put freedom of expression on trial.

Background

The defendants in the trial are:

Maati Monjib, 54 historian and founder of the Ibn Rochd Center for Studies and Communication, president of the NGO Freedom Now (which he set up jointly with Ali Anouzla) and a member of the Moroccan Association for Investigative Journalism (AMJI). A regular commentator on Moroccan politics in international media, think tanks and academic forums, he is thought to be a key figure targeted in this prosecution.

Abdessamad Ait Aicha (known as Samad Iach), 31, journalist and former employee at the Ibn Rochd Center for Studies and Communication, and AMJI member.

Hicham Mansouri, 35, journalist and former AMJI employee, recently released from prison after serving a 10-month sentence in what Amnesty International fears was a politically-motivated conviction.

Hicham Khreibchi (known as Hicham Al-Miraat), 39, medical doctor, founder and former president of the Digital Rights Association (ADN), as well as former advocacy director for Global Voices.

Mohamed Sber, 44, president of the Moroccan Association for the Education of Youth (AMEJ).

Maria Moukrim, 39, journalist, former AMJI president.

Rachid Tarik, 62, journalist (retired), AMJI president.

Several defendants are also former supporters or members of the 20 February Movement, Morocco’s peaceful pro-democracy and anti-corruption protest movement that emerged in 2011 in the context of popular uprisings in the region.

펜실베니아주 버크스 카운티 거주시설에 구금되어 있던 3세 어린이 호수에(본명 Diego)와 엄마 테레사(본명 Wendy, 28세)가 8월 7일 이례적으로 석방된 데 이어, 8월 14일 8세 안토니오(Antonio 가명)와 엄마 마를렌(Marlene 가명, 24세)도 석방되었다.

호수에는 엄마와 함께 납치 협박과 신체적, 성적 폭행이 만연한 온두라스를 탈출하고 미국에 비호를 신청했다. 그러나 두 사람은 16개월이 넘도록 시설에 구금되어 있었고 호수에는 삶의 절반을 구금시설에서 보내며 말과 걸음마도 시설 안에서 배워야 했다. 안토니오와 마를렌 또한 납치 위협과 신체적, 성적 폭행으로부터 도망쳐 미국에 비호를 신청했지만, 23개월이 넘도록 구금시설에 갇혀있어야 했다. 

국제앰네스티 미국지부는 지난 6월부터 버크스 자치 거주소 등의 가족구금시설에 갇혀 있는 부모와 어린이들의 석방을 촉구했다.

현재 버크스에는 수십 명의 어린이와 부모들이 구금되어 있다.
이러한 가족구금시설은 버크스를 포함해 총 3곳으로,
이곳의 환경은 감옥과 다를 바가 없다.

버크스 거주시설에는 최소 세 가족 이상이 600일이 넘도록 구금되어 있다.

 

끔찍한 폭력으로부터 도망쳐 안전을 찾아 미국으로 온 가족들이다. 미국 정부는 이들에게 진정한 리더십과 난민보호가 아니라 엄마와 아이들을 더 취약한 상황으로 몰아넣었다.

또한 “버크스 시설에 구금되어 있는 가족들은 고향에서의 끔찍한 폭력을 피해 미국을 찾아왔지만, 이 곳에서도 감옥에 갇히게 됐다. 이처럼 무의미한 구금은 평등과 존엄이라는 미국의 공유가치에 어긋나는 것이다. 이민관세국은 여전히 구금되어 있는 비호 신청자 가족들을 석방해야 하고, 국토부는 이번에야말로 버크스와 같은 가족구금시설을 모두 폐쇄해야 한다”고 말했다.

버크스에 구금되어 있는 가족들 대부분은 중앙아메리카 북부삼각지대로 불리는 엘살바도르, 과테말라, 온두라스 등지에서 온 사람들이다. 북부삼각지대는 폭력과 불안정한 치안이 극심한 수준에 이른 지역으로 널리 알려져 있다.

이집트 법원이 16일 극도로 불공정한 재판을 통해 무하마드 무르시 전 대통령을 비롯한 100여명 이상의 피고인들에 대해 사형을 선고한 것은 이집트의 형사사법제도가 개탄스러울 수준임을 보여주는 것이라고 국제앰네스티가 밝혔다.

사이드 부메두하(Said Boumedouha) 국제앰네스티 중동-북아프리카 부국장은 “무르시에게 더욱 불공정한 재판을 거쳐 사형을 선고하는 것은 인권을 완전히 무시한 처사다. 무르시의 재판은 피고인이 법정에 발을 들이기도 전부터 이미 권위를 잃은 상태였다. 무르시가 법적 검토 없이 수 개월 동안 독방에 수감되어 있었던 점, 변호사 없이 조사를 받았다는 점으로 인해 이번 재판은 아무런 효력 없는 절차에 기반한 허울뿐인 재판에 불과하다”고 말했다.

또한 “이집트 정부는 무르시 또는 다른 구금자들이 강제 실종되었던 기간 동안 수집한 모든 증거를 폐기해야 하며, 즉시 무르시를 석방하거나, 전면적으로 공정한 재판이 보장된 민간 법원에서 재심을 받도록 해야 한다. 향후의 형사적 절차는 반드시 이집트 법과 국제기준에 따라 이루어져야 한다”며 “또한 지난 2011년 1월 교도소를 탈출했던 혐의에 대해, 당시 무르시는 비상 지휘권에 따른 행정 구금 중으로, 사법적 절차에 따라 구금된 것이 아니었던 만큼 해당 혐의에 대한 기소를 취소해야 한다”고 말했다.

무하마드 엘메시리(Mohamed Elmessiry) 국제앰네스티 이집트 조사관은 “사형은 이집트 정부가 정치적 반대세력을 숙청하는 데 가장 애용하는 도구가 되었다. 2013년 7월부터 법원에서 사형이 선고된 사람들은 대부분 무르시의 추종자들이었다. 마치 무르시를 지지하면 무조건 사형 또는 수 년간의 징역형에 처하겠다는 방침인 듯하다. 정부는 그 대신 사법제도의 독립성과 공평성을 보장하고, 끔찍한 인권침해의 책임자 모두에게 정당한 처벌을 내려야 할 것”이라고 말했다.

법원은 무하마드 무르시 외 무슬림형제단의 고위 간부를 포함한 105명에 대해, 무장단체 하마스와 헤즈볼라의 지원을 받아 “1.25 혁명” 당시 대규모 탈옥을 계획한 혐의로 유죄를 선고하고 사형에 처할 것을 권고했다.

무르시는 이외에도 외국기관을 위해 간첩행위를 한 혐의, 하마스, 헤즈볼라, 이란혁명수비대 등에 기밀정보 보고서를 유출한 혐의, 테러 활동에 참여한 혐의에 관해서도 재판을 받았다. 법원은 이 사건에 대해 여성 1명을 포함해 16명에게 사형을 선고했으나, 무르시는 포함되지 않았다.

법원은 사건에 대한 판결을 ‘무프티’에게 보낸 상태다. 이집트법상 형사재판에서 사형 선고를 확정하려면 무프티의 승인이 필요하다. 2015년 6월 2일, 법원이 사형 선고를 최종 확정할 경우 무르시와 피고인들은 이집트의 최고법원인 파기원에 항고할 수 있다.

배경정보

무하마드 무르시 전 대통령은 2013년 6월 3일 군사정부에 축출된 후 일부 측근들과 함께 수 개월 동안 독방에 구금되어 있었으며, 이는 강제실종에 해당할 수 있는 상황이다.

무르시 전 대통령은 2012년 12월 대통령궁 주변에서 시위대를 유혈 진압한 데 관여한 혐의로 기소되어, 2015년 4월 불공정재판을 통해 선고받은 징역 20년형을 이미 치르고 있는 중이다.

무르시 전 대통령은 카타르에 기밀정보를 유출한 혐의로도 재판을 앞두고 있다. 또한 법정모독 혐의로 24명과 함께 기소되어 또다른 재판을 받아야 한다. 첫 심리는 2015년 5월 23일 열릴 예정이다.

국제앰네스티는 범죄의 성질 또는 정황, 피고인의 유, 무죄 여부와 그 외 특성, 사형집행 방법에 관계없이 모든 경우에 대해 사형에 반대한다. 사형은 세계인권선언에 명시된 생명권을 침해하는 것이며, 극도로 잔인하고 비인도적이며 굴욕적인 처벌이다.

An Egyptian court’s recommendation today to sentence ousted president Mohamed Morsi and more than 100 other defendants to death after grossly unfair trials shows the deplorable state of the country’s criminal justice system, said Amnesty International.

“Condemning Mohamed Morsi to death after more grossly unfair trials shows a complete disregard for human rights. His trials were undermined even before he set foot in the courtroom. The fact that he was held for months incommunicado without judicial oversight and that he didn’t have a lawyer to represent him during the investigations makes these trials nothing but a charade based on null and void procedures,” said Said Boumedouha, Deputy Director of Amnesty International’s Middle East and North Africa Programme.

“Egypt’s authorities should disregard all the evidence that was obtained from Mohamed Morsi or any other detainee during the period in which they were subjected to enforced disappearance, and must either release him immediately or retry him in a civilian court with full fair-trial guarantees. Any further criminal proceedings must be in line with Egyptian law and international standards.

The authorities should also drop the charges of escaping from prison in January 2011, as at the time Morsi was held in administrative detention, under emergency powers and without a judicial detention order.”

“The death penalty has become the favourite tool for the Egyptian authorities to purge the political opposition. Most of those sentenced to death by courts since July 2013 have been Morsi supporters. The deal seems to be: Support Morsi and get sentenced to death or to years behind bars. Instead, Egypt must ensure the independence and impartiality of the justice system and bring to justice all those responsible for gross human rights violations.”

The court recommended a death sentence against Mohamed Morsi and 105 others, including senior Muslim Brotherhood members, found guilty of orchestrating mass prison-breaks during the “25 January Revolution”, aided by Hamas and Hizbullah.
Morsi had also faced trial on separate charges of spying for foreign states and organizations, leaking classified intelligence reports to groups including Hamas, Hizbullah and the Iranian Revolutionary Guards, and taking part in terrorism-related activities. The court recommended death sentences for 16 in the case, including one woman, but not Mohamed Morsi.

The court sent the casefile to the Grand Mufti for his advice, a mandatory procedure under Egyptian law before a criminal court can hand down the death sentence. If Mohamed Morsi and the other defendants were sentenced to death when the court hands down its final verdict on 2 June 2015, they will be able to appeal their death sentences before Egypt’s highest court, the Court of Cassation.

Background Information

Mohamed Morsi was ousted from power by a military-backed government on 3 July 2013 and held in incommunicado detention along with several of his close aides for months in conditions amounting to enforced disappearance.

The ousted president is already serving a 20-year prison sentence, handed down in April 2015 following an unfair trial, on charges of involvement in deadly clashes around the Presidential Palace in December 2012.

Mohamed Morsi faces a separate trial on charges of leaking confidential information to Qatar. He is also facing another trial with 24 others for insulting the judiciary. The first hearing is scheduled for 23 May 2015.

Amnesty International opposes the death penalty in all cases without exception, regardless of the nature or circumstances of the crime, the guilt, innocence or other characteristics of the offender or the method used by the state to carry out the execution. The death penalty violates the right to life as proclaimed in the Universal Declaration of Human Rights. It is the ultimate cruel, inhuman and degrading punishment.
