2011년 3월 15일 시리아 반정부시위가 시작된 이후, 지난 5년간 전쟁범죄와 반인도적 범죄 등 끔찍한 인권침해가 시리아를 휩쓸며 수많은 사람이 고통 속에 신음하게 되었다고 국제앰네스티가 밝혔다.

살릴 셰티(Salil Shetty) 국제앰네스티 사무총장은 “시리아 시위가 처음 시작된 이후로 지난 5년간의 세월은 엄청난 규모의 공포와 유혈사태로 얼룩져 왔다. 시리아 정부군이 평화적인 시위대를 향해 처음 발포했던 순간부터 민간인의 고통과 잔혹함은 시리아 사태를 비극적으로 상징하게 되었다”고 말했다.

또한 “시리아군을 비롯해 자칭 ‘이슬람국가(IS)’와 같은 비정부 무장단체는 인권과 전쟁법은 물론, 자신들로 인해 목숨을 잃고 상처 입거나, 피난을 떠나고, 포위당한 지역에서 굶주리는 민간인들에 대해 싸늘한 무관심으로 일관하고 있다. 시리아군은 민간 지역에 무자비한 ‘드럼통 폭탄(barrel bomb)’ 공격을 가하고, 대규모의 납치 활동과 산업 규모의 조직적 고문을 자행하는 등 끔찍한 전략을 사용하며 반인도적 범죄를 버젓이 저질렀다. 특히 IS와 같은 일부 무장단체는 세계 언론에 주목받는 점을 이용해 시리아인과 외국인을 막론한 민간인을 납치하고 약식 처형하는 등 자신들이 저지른 전쟁범죄를 아랑곳 하지 않고 홍보하고 있다”고 말했다.

다음은 지난 5년간 시리아 사태가 최악으로 치닫게 된 다섯 가지 결정적 순간을 정리한 것이다.

  • 반정부 시위가 시작된 지 3일이 지난 2011년 3월 18일, 남부 데라아(Dera’a)에서 반정부 성향의 그래피티를 그렸다는 이유로 체포, 고문당한 소년들의 석방을 요구하던 평화적 시위대를 향해 시리아군이 실탄을 발사했다. 이날 이후 시위는 유혈 사태로 번졌고, 이날의 발포는 정부군이 평화적인 시위를 탄압하는 데 치명적 무력을 광범위하게 사용하며 결국 전면적인 무장 분쟁으로까지 이어지게 되는 전조였다.
  • 2013년 8월 다마스쿠스 동부 고타(Ghouta)에서 화학무기 공격으로 고통스러워하는 주민의 모습을 담은 영상이 공개되면서 세계는 충격에 휩싸였고, 시리아에서 자행되고 있는 끔찍하고 잔혹한 인권침해에 대해 경종을 울렸다. 그러나 안타깝게도 이는 빙산의 일각에 불과했다. 화학무기 외에도 확산탄과 같은 금지 무기를 사용해 공격하거나 정기적인 미사일, 박격포 폭격을 가하면서 시리아 전역에서는 매일같이 점점 더 많은 사람들 목숨을 잃고 있다. 그런데도 유엔 안전보장이사회는 시리아 상황을 국제형사재판소(ICC) 검찰부에 회부하는 데 합의하지 못했고, 특히 러시아와 중국은 거부권을 행사해 민간인 보호 결의안 통과를 여러 차례 저지하는 등 수년째 제대로 대처하지 못하고 있다.
  • 2014년 1월 다마스쿠스 외곽 야르무크(Yarmouk)에서 봉쇄된 지역에 갇힌 주민들이 구호물품을 받기 위해 길게 늘어선 충격적인 모습은 시리아 전역의 봉쇄된 지역에서 식량과 의료 지원이 부족해 죽어가는 수천 명의 안타까운 현실을 알리는 계기가 되었다. 야르무크 외에도 모아다미야(Moadamiya), 동부 고타, 마다야(Madaya), 알포아(al-Fouaa) 등지를 봉쇄하며 정부군과 무장단체는 주민들의 굶주림을 전쟁 무기로 사용했다. 현재 시리아 15개 지역에서 40만 명 이상이 봉쇄지역에 갇혀 있다. 최근 합의된 휴전 협정의 일환으로 봉쇄지역에 한정된 수준의 구호물품이 전달되고 있지만, 여전히 이곳 주민들은 아사할 위험에 처해 있으며 제한 없는 인도적 지원이 절실히 필요한 상황이다.
  • 2014년 1월, 시리아군 출신 제보자가 비밀리에 촬영한 고문당하고, 굶주리고 불탄 시신들의 섬뜩한 사진이 공개됐다. ‘카이사르 고문 사진’으로 알려진 이 사진들은 시리아의 수용소 내에서 제도적인 고문과 비사법적 처형이 이루어지고 있다는 또 하나의 강력한 증거로, 바사르 알 아사드(Bashar al-Assad) 대통령 정권이 반대자를 무자비한 수법으로 처벌하고 있음을 전 세계에 알렸다. 아직도 수만 명이 시리아 보안정보당국에 체포된 이후 행방이 묘연한 상태다.
  • 2015년 9월 시리아 정부를 지원하는 러시아의 첫 공습이 시작됐다. 표면상으로는 IS를 노린 공격이었지만 대부분 반군 점령 지역이 폭격을 당했다. 러시아의 참전으로 공습이 더욱 격화되었고, 특히 시리아 북부 지역에서는 전쟁범죄로 추정되는 공격까지 가해지며 민간인 수백 명이 목숨을 잃었다. 최근에는 알레포 인근에서 러시아와 시리아 전투기가 전략적으로 병원을 폭격하며 명백한 국제법 위반행위를 저질렀다.

From hope to horror: Five years of crisis in Syria

A horrifying catalogue of human rights abuses including war crimes and crimes against humanity have overwhelmed Syria over the past five years causing human suffering on a vast scale, said Amnesty International, marking the five-year anniversary of the start of anti-government protests in the country on 15 March 2011.

“The five years since the uprising in Syria first began have been marred by horror and bloodshed on a colossal scale. From the moment that Syrian government forces first opened fire on peaceful protesters, brutality and civilian suffering have been the tragic hallmarks of this crisis,” said Salil Shetty, Secretary General of Amnesty International.

“Government forces and non-state armed groups, including the one calling itself the Islamic State (IS), have displayed a callous indifference to human rights and the laws of war as well as the civilians they have killed, maimed, displaced and, in some areas under siege, starved.

“Government forces have brazenly committed crimes against humanity through the use of appalling strategies such as relentless barrel bomb attacks on civilian areas, a campaign of mass disappearances and systematic, industrial-scale torture. Some armed groups, particularly IS, have exploited the international media spotlight to cynically broadcast their own war crimes, such as the abduction and summary killing of Syrian and foreign civilians.”

Here is a reminder of five key moments that saw the crisis in Syria go from bad to worse over the past five years:

On 18 March 2011, three days after the start of the uprising Syrian government forces opened fire on peaceful protesters in the southern city of Dera’a, using live ammunition against demonstrators demanding the release of boys arrested and tortured for anti-government graffiti. This marked a bloody turning point, and was a precursor to the widespread use of lethal force by government forces to suppress peaceful protests, which eventually evolved into a full-blown armed conflict.

Video footage showing civilians suffering from the effects of a chemical weapons attack in Eastern Ghouta, east of Damascus in August 2013 shocked the world, acting as a wake-up call to the horrific and cruel nature of the abuses being committed in Syria. Sadly, this was just the tip of the iceberg. Across Syria, civilians continued to be killed on a daily basis often in far greater numbers in attacks using both other banned weapons such as cluster munitions and regular bombs, missiles and mortars. However, for years the UN Security Council dragged its feet, with member states failing to unite to refer the situation in Syria to the Prosecutor of the International Criminal Court and Russia and China in particular blocking several resolutions on the protection of civilians using veto powers.

The surreal images of crowds of besieged civilians queuing for aid parcels in Yarmouk on the outskirts of Damascus in January 2014 brought to life the tragic reality that thousands of people trapped under siege across Syria were dying from lack of food and medical care. Beyond Yarmouk starvation has been used as a weapon of war by both government forces and armed groups in areas such as Moadamiya, Eastern Ghouta, Madaya and al-Fouaa. Today more than 400,000 people are under siege in 15 locations across Syria. Despite limited deliveries of aid to besieged areas as part of the ceasefire agreed in recent weeks, civilians are still at risk of starving to death and in desperate need of unfettered humanitarian aid.

Harrowing photographs showing tortured, starved and burnt bodies, known as the “Caesar” torture photos, were smuggled out of Syria by a military defector and published in January 2014. These provided the strongest evidence yet of systematic torture and extrajudicial executions taking place inside government detention centres, opening the world’s eyes to the ruthless tactics used to punish those who dare to oppose the government of President Bashar al-Assad. Tens of thousands remain missing after being arrested by one of Syria’s various security and intelligence forces.

Russia began its first air strikes in support of the Syrian government in September 2015, ostensibly targeting IS but mostly hitting areas under the control of armed opposition groups. Russia’s entry into the fray has led to intensive aerial bombardments, particularly in northern Syria, that have killed hundreds of civilians, including in attacks that appear to be war crimes. Most recently an offensive in the vicinity of Aleppo has seen Russian and Syrian warplanes bomb hospitals as part of its military strategy in flagrant violation of international law.

시리아 북부 지역에서 쿠르드계 정치세력인 민주동맹당(Partiya Yekîtiya Demokrat, PYD, 이하 PYD)이 주도하는 자치정부에 의해 전쟁범죄에 이르는 수준의 강제이주와 건물 파괴가 이루어졌다는 사실이 현장 조사 결과 드러났다고 국제앰네스티가 13일 발표한 보고서를 통해 밝혔다. 이곳 자치정부는 무장단체 자칭 이슬람국가(IS, 이하 IS)를 격퇴하기 위해 미국이 주도하는 연합세력의 중요한 구성원이다.

일부 주민들은 마을을 떠나지 않을 경우 미국이 주도하는 연합군의 공습이 있을 것이라며 위협을 받았다고 전했다.

국제앰네스티 조사단은 2015년 7월과 8월 알 하사케흐와 알 라카의 14개 마을을 방문해, 자치정부 점령지였던 이곳에서 벌어진 강제이주와 주택 파괴에 대해 조사했다.

국제앰네스티가 입수한 위성사진을 보면 농촌 지역인 텔 하메스(Tel Hamees)의 후세이니야(Husseiniya) 마을에서 벌어진 주택 파괴의 규모가 상세히 드러나 있다. 2014년 6월 촬영된 사진에는 225채의 건물이 들어서 있으나 2015년 6월에는 14채밖에 남아있지 않다. 건물의 93.8%가 사라진 충격적인 결과다.

2015년 2월, 자치정부의 군사조직인 인민수비대(YPG, 이하 YPG)는 이전 IS 점령지였던 후세이니야 마을을 재점령한 후 건물 파괴와 주민 강제 이주를 자행하기 시작했다. 이곳을 방문한 조사단은 파괴된 건물의 잔해를 볼 수 있었고, 당시 목격자들과 인터뷰를 나눴다.

한 목격자는 “군인들이 집에서 우리를 끌어내더니 집을 불태우기 시작했습니다… 마을에 불도저를 끌고 와서는 마을 전체가 없어질 때까지 집을 하나하나 철거했습니다”라고 했다.

술룩(Suluk) 남부 지역 마을에는 YPG 군인들에게 IS 지지자로 몰려, 마을을 떠나지 않으면 사살하겠다고 위협을 당했다는 주민들도 있었다. 일부의 경우 마을에 IS 지지자가 소수 있었던 것은 사실이었다고 주민들도 인정한 경우도 있었지만, 대다수는 IS를 지지하지 않는 사람들이었다.

또한 YPG 군인들은 주민들이 명령에 따르지 않을 경우 미국 연합군의 공습을 받을 것이라고 위협하기도 했다.

마을 주민 사프완은 “군인들은 우리가 마을을 떠나지 않으면 미국 연합군에 테러리스트라고 보고할 것이며, 전투기가 우리 가족을 공격할 것이라고 했습니다”라고 했다.

YPG는 주민들의 안전을 위해서라며, 또는 군사적 필요를 주장하며 강제이주를 정당화했다.

라마 파키흐 상임고문은 “중대한 문제입니다. 시리아에서 IS와 맞서고 있는 미국이 주도하는 연합군을 비롯해, PYD 자치정부를 지지하거나 군사적으로 협력하는 모든 국가는 이러한 인권침해에 대해 모른 척하지 않아야 합니다. 공개적으로 강제이주와 불법 파괴를 규탄하는 입장을 취하고, 자국의 군사적 협력이 국제인도법 위반행위에 기여하지 않도록 해야 할 것”이라고 말했다.

잔혹성을 보여준 특정 사례에서는 YPG 군인들은 사람들이 아직 집을 떠나지 않은 상태에서도 기름을 퍼부은 뒤 불을 붙이겠다고 위협하기도 했다.

당시 피해자였던 바사마는 “군인들이 처가에 기름을 붓기 시작했습니다. 장모가 집을 떠나기를 거부하며 아직 안에 있었지만 아랑곳 않고 그 주변으로 기름을 부어댔고… 장인을 보고는 마구 때리기 시작했습니다. 나는 군인들에게 ‘우리 집을 불태워도 텐트를 치고 살 것이다. 여기는 우리 집이다. 우리 집에 남겠다’고 했습니다”라고 전했다.

이처럼 부당하게 피해를 입은 주민들의 대부분이 아랍족과 투르크만족이었지만, 술룩과 같이 다양한 인종이 모인 지역의 경우 쿠르드족 주민들 역시 자치정부의 자경단인 아사이시(Asayish)와 YPG에 가로막혀 집으로 돌아가지 못하고 있다. 이외에 압디 코이(Abdi Koy) 마을에서도 소수의 쿠르드족 주민들이 YPG에 의해 강제로 이주해야 했다.

아사이시 마을의 대표는 국제앰네스티와의 인터뷰를 통해, 주민들이 이렇게 강제로 이주당한 것이 다른 마을과 ‘별개의 일’이 아님을 인정했다. YPG 대변인은 주민들의 안전을 위해 대피시킨 것이라는 주장을 반복했다.

그러나 주민들 중 대부분은 전투 발발 지역이 아니고, 전선에서도 멀리 떨어져 있어 IS가 설치한 급조폭발물(IED)의 피해를 입을 위험이 전혀 없음에도 강제로 마을을 떠나야 했다고 말했다. 중대한 군사적 필요 없이 민간인을 강제로 이주시키는 것은 국제인도법 위반이다.

라마 파키흐 상임고문은 “PYD 자치정부는 불법적인 민가 파괴를 즉시 중단하고, 부당하게 집을 잃은 모든 민간인들에게 보상을 지급해야 한다. 또한 불법 강제이주를 중단하고, 주민들이 마을로 돌아와 재건할 수 있도록 허가해야 한다”고 말했다.

Syria: US ally’s razing of villages amounts to war crimes

A fact-finding mission to northern Syria has uncovered a wave of forced displacement and home demolitions amounting to war crimes carried out by the Autonomous Administration led by the Syrian Kurdish political party Partiya Yekitiya Demokrat (PYD) controlling the area, said Amnesty International in a report published today. The Autonomous Administration is a key ally, on the ground, of the US-led coalition fighting against the armed group calling itself the Islamic State (IS) in Syria.

‘We had nowhere else to go’: Forced displacement and demolitions in northern Syriahttps://www.amnesty.org/en/documents/mde24/2503/2015/en/ reveals evidence of alarming abuses, including eyewitness accounts and satellite images, detailing the deliberate displacement of thousands of civilians and the razing of entire villages in areas under the control of the Autonomous Administration, often in retaliation for residents’ perceived sympathies with, or ties to, members of IS or other armed groups.

“By deliberately demolishing civilian homes, in some cases razing and burning entire villages, displacing their inhabitants with no justifiable military grounds, the Autonomous Administration is abusing its authority and brazenly flouting international humanitarian law, in attacks that amount to war crimes,” said Lama Fakih, Senior Crisis Advisor at Amnesty International.

“In its fight against IS, the Autonomous Administration appears to be trampling all over the rights of civilians who are caught in the middle. We saw extensive displacement and destruction that did not occur as a result of fighting. This report uncovers clear evidence of a deliberate, co-ordinated campaign of collective punishment of civilians in villages previously captured by IS, or where a small minority were suspected of supporting the group.”

Some civilians said they were threatened with US-led coalition airstrikes if they failed to leave.

Amnesty International researchers visited 14 towns and villages in al- Hasakeh and al-Raqqa governorates in July and August 2015, to investigate the forced displacement of residents and demolition of homes in areas under the control of the Autonomous Administration.

Satellite images obtained by Amnesty International illustrate the scale of the demolitions in Husseiniya village, in Tel Hamees countryside. The images show 225 buildings standing in June 2014 but only 14 remaining in June 2015 – a shocking reduction of 93.8%.

In February 2015, the Autonomous Administration’s military wing, the YPG (the People’s Protection Units), took control of the area, which had been under IS control, and began demolitions, displacing villagers. Researchers visiting Husseiniya saw ruins of destroyed homes and interviewed eyewitnesses.

“They pulled us out of our homes and began burning the home… they brought the bulldozers… They demolished home after home until the entire village was destroyed,” said one witness.

In villages south of the town of Suluk, some residents said YPG fighters had accused them of supporting IS and threatened to shoot them if they did not leave. While in some cases residents acknowledged that there had been a handful of IS supporters in their villages the majority were not supporters of the group.

In other cases, villagers said YPG fighters had ordered them to leave threatening them with US coalition airstrikes if they failed to comply.

“They told us we had to leave or they would tell the US coalition that we were terrorists and their planes would hit us and our families,” said one resident, Safwan.

The YPG has justified the forced displacement of civilians by saying it was necessary for the civilians’ own protection or militarily necessary.

“It is critical that the US-led coalition fighting IS in Syria and all other states supporting the Autonomous Administration, or co-ordinating with it militarily, do not turn a blind eye to such abuses. They must take a public stand condemning forced displacement and unlawful demolitions and ensure their military assistance is not contributing to violations of international humanitarian law,” said Lama Fakih.

In one particularly vicious attack, YPG fighters poured petrol on a house, threatening to set it alight while the inhabitants were still inside.

“They started pouring fuel in my in-laws’ house. My mother-in-law was there refusing to leave and they just poured it around her…They found my father-in-law and began hitting him on his hands… I said, ‘Even if you burn my house I will get a tent and pitch it.This is in my place. I will stay in my place,” said Bassma.

Although the majority of residents affected by these unlawful practices are Arabs and Turkmen, in some cases, for example in the mixed town of Suluk, Kurdish residents have also been barred by the YPG and Asayish, the Autonomous Administration’s police force, from returning to their homes. Elsewhere, for example in Abdi Koy village, a small number of Kurdish residents have also been forcibly displaced by the YPG.

In an interview with Amnesty International, the head of the Asayish admitted civilians had been forcibly displaced but dismissed these as “isolated incidents”. The spokesperson for the YPG repeated claims that civilians were being moved for their own security.

However, many residents said they were forced to leave even though their villages had not been the site of clashes, or were at a distance from the frontline and there was no danger from improvised explosive devices (IEDs) laid by IS. Forcibly displacing civilians without imperative military necessity is a violation of international humanitarian law.

“The Autonomous Administration must immediately stop the unlawful demolition of civilian homes, compensate all civilians whose homes were unlawfully destroyed, cease unlawful forced displacements, and allow civilians to return and rebuild,” said Lama Fakih.

국제앰네스티는 이날 부르키나파소에서 <My Body My Rights> 캠페인을 시작하고, 오는 2015년 10월 11일 치러질 국회의원 총선거 및 대통령 선거 출마자를 대상으로 강제결혼과 조혼에 대해 더욱 강경한 입장을 취할 것과, 여성들이 피임 및 성과 재생산건강 관련 정보, 서비스를 더욱 쉽게 접할 수 있도록 할 것을 촉구하는 내용의 인권선언을 발표했다.

알리오네 티네(Alioune Tine) 국제앰네스티 서-중앙아프리카 지역국장은 “오늘날 부르키나파소에서 자라나는 소녀들은 살아가면서 꿈과 희망을 마음껏 펼치지 못하게 가로막는 수많은 장벽과 마주하고 있다. 가족에 의해 강제로 결혼해야 하거나, 피임을 할 수 있어도 배우자가 거부하거나 허락하지 않을 수도 있다”며 “부르키나파소 정부는 너무나 오랫동안 여성인권 문제를 등한시해 왔다. 이러한 문제점을 해결하고 여성들의 장벽을 허무는 것이 후보자들의 중심 공약이 되어야 할 것”이라고 말했다.

양성평등은 부르키나파소의 헌법과 국내법에도 명시되어 있지만, 실제로는 여성들의 음부 절제, 강제결혼, 조혼, 가정폭력이 만연히 이루어지고 있다. 국제앰네스티와 인터뷰를 나눈 여성들은 임신과 결혼에 대한 의사결정이 주로 남성 가족 구성원의 몫이라고 전했다. 그 결과, 부르키나파소 여성 중 불과 17%만이 피임법을 사용하며 매년 2,000명 이상의 산모가 출산 중 사망하고 있다.

성-재생산건강과 피임법 접근을 가로막는 장벽

남성들이 아내에게 폭력으로 위협하며 피임을 하지 못하게 하는 경우가 매우 흔하게 나타나고 있다. 23세의 과일 상인이자 세 아이의 어머니인 테레즈는 국제앰네스티에 이렇게 전했다.

“둘째 아이를 낳은 뒤로 몰래 피임약을 먹고 있어요. 다른 피임법에 비해 싸게 구할 수 있거든요. 남편은 피임에 대해서 전혀 몰라요. 피임을 하면 병에 걸린다고 생각해서, 피임 때문에 병이 나면 저를 가둬버리겠다고 위협하고 있어요.”

여성들이 피임을 하지 못하는 이유로는 높은 가격과 보편적인 성교육을 받지 못한다는 점도 있다. 세 아이의 엄마인 24세의 마리아마는 성교육을 받지 못한 것이 원치 않는 임신으로 이어지게 되었다고 말했다.

“성관계를 갖고 처음 임신을 했을 때, 저는 성관계를 하면 임신이 될 수도 있다는 사실을 몰랐어요. 피임에 대해서도 전혀 몰랐고요. 그래서 첫 아이를 낳은 뒤 다시 임신하게 됐죠. 아무런 피임법도 사용하지 않았어요. 아직도 어떻게 하는 건지 모르겠어요.”

충격적인 강제 조혼 비율

향후 부르키나파소에 새롭게 수립될 정부는 딸을 본인의 동의 없이 결혼시키는 가족에게는 제재를 부과하는 등의 방법을 통해 법적으로 강제 조혼을 금지할 수 있도록 현행법을 검토해, 충격적인 수준의 조혼률에 대처해야 할 것이라고 국제앰네스티가 밝혔다.

부르키나파소의 조혼률은 아프리카 국가 중 6번째로 높은 수준으로, 18세 소녀 중 52%가 기혼이며, 그 중 반 이상이 이미 자녀가 있다.

말라이카는 부모가 강요하는 결혼을 하지 않으려 집에서 도망쳐 나왔다. 그녀를 데려간 경찰은 부모님께 다시 돌려 보냈다고 한다.

“제가 열다섯 살 때 부모님은 75세 노인과 절 결혼시키려 했어요. 아버지보다도 나이가 많은 데다 이미 부인이 셋이나 있었고 제 나이 또래의 딸들도 있는 사람이었죠. 그 할아버지를 소개받기로 한 날, 저는 부모님께 이 결혼을 원하지 않고 마저 공부를 하고 싶다고 했지만 부모님은 제가 이 사람과 결혼해야 하고, 저는 아무 선택권이 없다고 했어요.”

알리오네 티네 국장은 “국제앰네스티는 모든 국회의원 및 대통령 후보자들에게 국제앰네스티의 인권선언문에 서명할 것과, 여성들이 자신의 신체와 성재생산권에 대한 기본적인 선택을 스스로 할 수 있도록 의미 있는 변화를 만들겠다고 약속할 것을 촉구한다”며 “앞으로 부르키나파소를 이끌고자 하는 사람은 누구든 이와 같은 어린 소녀들에 대한 차별을 철폐해야 한다. 유년기는 단절되고, 여성들은 자신의 삶과 신체에 관한 결정권조차 빼앗겼다. 오늘날의 부르키나파소 여성들은 자신의 결혼 상대와 시기, 임신 시기와 횟수도 항상 자유롭게 결정하지 못한다. 이는 바뀌어야 한다”고 말했다.

Burkina Faso: Elections cannot ignore women’s crisis

Burkina Faso must urgently tackle the nationwide crisis where forced and early marriage, unwanted pregnancy and lacking sex education reduce hundreds of thousands of girls and women to second class citizens, said Amnesty International today.

Amnesty International is today launching the My Body My Rights campaign in Burkina Faso, with a human rights manifesto calling on presidential and legislative candidates in the 11 October 2015 elections to commit to a tougher stance on forced and early marriage, and to making it easier for women and girls to access contraception and sexual and reproductive health information and services.

“A young girl growing up in Burkina Faso today faces many barriers preventing her from fulfilling her own hopes and dreams for her life. She could be married off by her family and even if she can afford contraception, her partner may refuse to use it or not allow her to use it,” said Alioune Tine, Amnesty International regional director for West and Central Africa.

“For too long, the Burkinabé authorities have neglected the rights of women and girls. Redressing this wrong and lifting the barriers faced by women and girls must be a central aim of any election candidate’s campaign.”

While gender equality is protected under Burkina Faso’s constitution and law, in practice, female genital mutilation, forced and early marriage and domestic violence are widespread. Women and girls told Amnesty International that decisions about pregnancy and marriage are often taken by male family members. As a result, only 17% of women in Burkina Faso use contraception and more than 2,000 women die in childbirth every year.

Several barriers to sexual and reproductive health and access to contraception

It is very common for men to prevent their wives from using contraception with threats of violence. Therese, a 23 year-old fruit seller and mother of three told Amnesty International:

“Since I gave birth to a second child, I hide to take my contraceptive pills, which are also cheaper for me than other methods. My husband does not know about contraception. He thinks that it brings diseases and he threatens to lock me up if I fall ill because of it.”

Other barriers women face in accessing contraception include high costs and a lack of access to comprehensive sex education. Mariama, a 24 year-old mother of three, told Amnesty International how lack of education can lead to unwanted pregnancy:

“When I had sex and got pregnant for the first time, I didn’t know that I could get pregnant after having sex. I didn’t know anything about contraception. After my first child was born, I got pregnant again. I did not use any method of contraception because I still didn’t know what to do.”

Alarming rates of forced and early marriage

Burkina Faso’s next government will have to respond to alarming rates of early marriage by reviewing national legislation to ensure that laws prohibiting early marriage are enforced, including through sanctioning families who marry girls without their consent, Amnesty International said.

Burkina Faso has the sixth highest rate of early marriage in Africa, with 52% of girls married by the age of 18 and nearly half already mothers at that age.

Malaika ran away from home to avoid being married off by her parents. When she was picked up by the police they told her to go back to her mum and dad, she told Amnesty International:

“I was 15 when my parents wanted me to marry an old man of 75. He is older than my father and already has three wives and daughters of my age. The day that I had to be introduced to the old man I told my parents that I did not agree with their choice and that I wanted to finish my education. They told me that I had to marry the man they had chosen and that I had no choice but to accept.”

“Amnesty International is calling on all legislative and presidential candidates to sign its human rights manifesto and commit to making the meaningful changes that will enable women and girls to make fundamental decisions about their bodies and their sexual and reproductive rights,” said Alioune Tine.

“Whoever wants to lead the country in future must end this discrimination against young people. Childhood is cut short, and women and girls are robbed of their right to make decisions about their lives and their bodies. Today in Burkina Faso women and girls are not always free to choose when they marry, and who; when they have children and how many – this has to change.”

My Body My Rights is Amnesty International’s global campaign against government efforts to control women and girls. The campaign is already running in El Salvador and Ireland.

The campaign in Burkina Faso will seek to raise awareness about barriers facing women and girls through advertisements, concerts and other activities, with Amnesty International supporters handing out free condoms to highlight the need for greater access to contraception.

이란 정부는 이란계 미국인 기자 제이슨 리자이언(Jason Rezaian)에 대한 터무니없는 판결 연기를 중단하고, 양심수이므로 즉시 무조건적으로 석방해야 한다고 국제앰네스티가 18일 밝혔다.

이란 법무부 대변인은 워싱턴포스트(Washington Post)지 기자인 리자이언을 간첩 활동과 ‘반체제 사상 전파’ 등의 혐의로 기소한 것이 기자인 것과는 관계없이 이루어진 것이라고 밝혔다. 유엔을 비롯한 전세계 전문가들은 이란 정부에 리자이언의 석방을 촉구하고 있다.

사이드 부메두하(Said Boumedouha) 국제앰네스티 중동-북아프리카 국장대행은 “이미 제이슨 리자이언을 1년 이상 재판 없이 구금하고, 그 중 6개월 이상을 변호사 접견도 허용하지 않은 채 독방에 구금했던 상황에서 구금일수를 하루라도 더 늘리는 것은 정의에 대한 모욕이다. 리자이언은 이란에서 기자로서 합법적, 공개적으로 활동했으며, 그를 기소하는 것은 이란 내에서의 독립적인 언론 보도를 탄압하려는 시도임이 명백하다”고 말했다.

또한 “안타깝게도 이란은 기자들을 수감시켜 온 충격적인 전적이 있다. 리자이언이 체포되고 구금된 것은 그간 이란 정부가 평화적으로 정당하게 자신의 역할을 수행한 기자들을 탄압해 왔던 긴 역사의 연장선상에 있다”고 말했다.

국제앰네스티는 지난 5월 26일부터 테헤란 혁명재판소에서 비공개로 진행된 리자이언의 재판에 심각한 결함이 있었다고 보고 있다.

8월 10일 열린 마지막 심리가 끝난 후, 제이슨의 변호사 레일라 아산은 검사 측에서 주장하는 혐의를 입증할 증거가 전혀 제출되지 않았다고 취재진에게 밝혔다. 또한 검사 측 진술이 끝난 뒤 시간 제한으로 충분한 변호를 할 수 없었으며, 대신 변론 내용을 서면으로 제출할 수밖에 없었다고 했다.

워싱턴포스트지는 검찰이 주장하는 죄목에 대한 “증거” 중 하나는 지난 2008년 리자이언이 미국 오바마 행정부의 채용공고에 온라인상으로 지원서를 제출한 것이었다고 밝혔다. 이란의 반관반민 통신사 메흐르 뉴스(Mehr News Agency)는 또 다른 “증거”로 리자이언이 두바이와 아랍에미리트연합(UAE)의 미국 영사관에 방문한 점을 들었는데, 이에 대해 리자이언은 이란 국적인 아내의 비자 신청과 관련된 일 때문이었다고 해명했다.

첫 재판에서 판사가 UAE 주재 미국 영사관과의 관계에 대해 묻자, 리자이언은 “나는 그저 한 명의 기자일 뿐으로, 나의 활동은 모두 기자로서 행한 것이며 합법적인 행동이었다”고 답했다.

제이슨 리자이언이 체포된 것은 2014년 7월 22일로, 이란 문화이슬람지도부가 리자이언의 기자 출입증을 갱신한 지 불과 하루 뒤였다.

사이드 부메두하 국장대행은 “로우하니 대통령이 집권한 지 2년이 되었지만 이란의 인권상황은 암울하고, 기자에 대한 괴롭힘과 협박, 구금은 여전히 끊임없이 계속되고 있다”고 말했다.

제이슨 리자이언은 수감된 후 9개월 동안 가족의 면회 외에는 변호사 접견도 허용되지 않았다. 레자이언의 아내이자 UAE의 국영신문 더 내셔널(The National)에 기고하고 있는 예가네흐 살레히 역시 남편과 함께 체포되어 두 사람 모두 여권을 압수당했다. 가족들은 한동안 부부의 행방조차 알 수 없었다. 살레히는 2014년 10월 보석 석방되었다. 리자이언 부부와 함께 체포됐던 사진기자와 그 남편 역시 같은 해 11월 풀려났다.

미국 정부는 이란 정부에 지난 달 타결된 핵 관련 협상과는 별도로, 계속해서 제이슨 리자이언의 석방을 촉구하고 있다.

이란의 기자들은 여전히 정당한 취재 활동을 이유로 괴롭힘과 협박, 체포, 구금의 위험에 처해 있다. 영화 제작자와 같은 다른 매체 종사자들 역시 모호한 표현의 국가보안법을 위반했다며 기소를 당하거나, 활동을 하지 못하도록 법적 금지 조치를 당하고 있다.

이란은 비정부단체 ‘국경없는 기자회’가 발표한 2015년 세계 언론자유지수에서 총 180개국 중 173위를 차지했다. 아직 수많은 기자들이 이란에서 구금되어 있으며, 쿠르드족 기자이자 양심수인 무하마드 사딕 카부드반드 역시 평화적인 취재 활동으로 징역 11년형을 선고받고 현재 복역 중이다.

Iran: Washington Post journalist on trial on ludicrous charges must be freed now

The Iranian authorities must end the farcical waiting game for the verdict in the case of Iranian-American journalist Jason Rezaian, and release him immediately and unconditionally, as he is a prisoner of conscience, Amnesty International said today.

The call comes after a spokesperson for Iran’s Judiciary said the charges against the Washington Post journalist – including espionage and “spreading propaganda against the system” – are not related to journalism. United Nations experts are among others around the world who have called on the Iranian authorities to release him.

“After subjecting Jason Rezaian to over one year in pre-trial detention – over six of them in solitary confinement with no access to a lawyer – it is a further affront to justice to keep him behind bars for even one more day. He had been working legally and openly as a journalist in Iran and his prosecution is clearly motivated by an attempt to crush independent reporting in the country,” said

“Unfortunately, Iran has an appalling track record of jailing reporters. Jason Rezaian’s arrest and detention is the latest in a long line of attacks by the Iranian authorities against journalists who are peacefully and legitimately carrying out their work.”

Amnesty International believes the trial, which began on 26 May and was held in four closed-door sessions at Branch 15 of the Revolutionary Court of Tehran, was seriously flawed.

Speaking to reporters after the final trial session on 10 August, Jason Rezaian’s lawyer Leila Ahsan said that no evidence had been presented to the court to substantiate any of the charges put forward by the prosecution. She said she had not been able to present her defence fully after the prosecution’s statement due to time constraints, and was forced to submit a written response instead.

According to the Washington Post, one piece of “evidence” put forward by the prosecution was an online job application for a position in President Obama’s administration in the USA that Jason Rezaian unsuccessfully submitted in 2008. Other “evidence” against him, according to Iran’s semi-official Mehr News Agency, included him visiting the US Consulate in Dubai, United Arab Emirates (UAE), which Jason Rezaian said was in relation to a visa application for his Iranian wife.

At the first trial session, when the judge asked him about his relationship with the US Consulate in the UAE, Rezaian replied “I am just a journalist, and all of my activities have been conducted as a journalist, and all have been legal.”

Jason Rezaian was arrested on 22 July 2014, a day after Iran’s Ministry of Culture and Islamic Guidance renewed his press credentials.

“Two years into President Rouhani’s rule, the human rights situation in Iran is grim and the harassment, intimidation, and imprisonment of journalists remains unrelenting,” Said Boumedouha said.

Background on Jason Rezaian’s case

Jason Rezaian only gained access to a lawyer after nine months in jail but was able to receive visits from his family. His wife, Yeganeh Salehi, who writes for the UAE state-owned newspaper The National was arrested at the same time and both have had their passports confiscated. Their family did not learn of their whereabouts for some time after their arrest. Yeganeh Salehi was released on bail in October 2014. A photographer and her husband were also arrested with the Rezaians and were released the next month.

The United States government has repeatedly called on the Iranian authorities to release Jason Rezaian, most recently on the sidelines of the recent nuclear negotiations, which ended in a deal with the US last month.

Journalists in Iran continue to face harassment, intimidation, arrest and imprisonment for their legitimate journalistic activities. Other media workers, such as film producers, have also faced trial on vaguely worded national security charges or judicial bans preventing them from carrying out their work.

Iran came 173rd out of 180 countries in the 2015 World Press Freedom Index produced by the NGO, Reporters Without Borders. A number of journalists remain in prison in Iran, including Mohammad Sadiq Kabudvand (Kaboudvand), a Kurdish journalist and prisoner of conscience who is currently serving an 11-year prison term for his peaceful journalistic activities.

더불어민주당 대선경선 후보인 이재명 성남시장은 오늘(8일) 오후 국회 정론관에서 기자회견을 열여 국회에 계류 중인 ‘최순실 게이트’ 특검법 개정안을 통과시켜야 한다고 주장했다. 황교안 대통령 권한대행이 국민의 뜻을 외면하고 있는 상황에서 국회가 나서서 국민의 뜻을 관철해야 한다는 것이다.

이재명 시장은 기자회견을 통해 “박근혜 대통령과 재벌을 수사 중인 박영수 특검의 조사가 이달 28일로 종료된다”며 “국민의 응원과 특검의 노력으로 사상초유의 정경유착이 추악한 모습을 드러낸 만큼 특검 수사는 연장돼야 한다”고 주장했다.

이 시장은 “박 대통령이 국정농단 혐의를 전면 부정하며, 특검 조사를 회피했다. 청와대 압수수색을 거부했고, 헌재의 탄핵심판도 지연시키고 있다”며 “사상 초유의 정경유착의 추악한 모습이 일부나마 드러났지만 특검이 갈 길은 아직 멀다”고 지적했다.

그는 “국민들이 광장에서 100일 넘게 촛불을 들며 ‘박근혜 탄핵’과 ‘이재용 구속’을 외쳤지만 성과는 미미하다”며 “국민의 노후까지 훔친 재벌과 권력의 부적절한 공생관계를 철저히 파헤쳐 지위고하를 막론하고 처벌하기 위해서는 특검 연장이 반드시 필요하다”며 황교안 권한대행을 압박했다.

이 시장은 황교안 권한대행을 국정농단의 종범으로 지목하며 “황 대행은 법무부 장관 시절, 법과 원칙대로 수사한 국정원 댓글 수사팀에 좌천성 인사를 단행한 전력이 있다”면서 “특검이 박근혜 대통령과 황교안 대행, 재벌 앞에서 좌초하는 걸 지켜볼 수 없다”고 말했다. 또 “황 권한대행이 국민의 뜻을 외면한다면 국회가 나서서 국민의 뜻을 관철해야 한다”고 주장했다.  

어제(7일)도 이재명 시장은 헌법재판소 앞에서 긴급 기자회견을 열고 헌법재판소의 2월 중 탄핵 심판을 촉구하기도 했다. 그는 기자회견을 통해 “광장의 국민들이 마음을 졸이며 헌법재판소가 탄핵심판을 기각하지 않을까 노심초사 하고 있다”며 “헌법재판소는 국민을 믿고 2월 중 탄핵을 결정해주길 바란다”고 호소했다.

이재명 시장이 이틀 연속 긴급 기자회견을 연 이유에 대해 이 시장의 대변인을 맡고 있는 더불어민주당 제윤경 의원은 “시민들이 방심하는 사이 박 대통령과 박사모, 새누리당의 반격이 시작됐다”며 “1000만 시민이 촛불을 든 이유가 어느 누구 대통령 만드는 것이 아니라 박근혜 대통령 탄핵과 적폐청산이라는 것을 강조하기 위해 긴급 기자회견을 열게 됐다”고 밝혔다.

한편 오늘 오후 야3당 대표는 국회에서 회동을 갖고 박 대통령과 새누리당의 행태에 대해 규탄했다. 야3당 대표는 회동 직후 발표한 합의문을 통해 ‘이정미 재판관 임기 이전에 탄핵심판 인용’이 이뤄져야 한다고 강조했다. 또 ‘황교안 권한대행의 특검 연장 승인과 청와대 압수수색 승인’을 촉구하며 이것이 이뤄지지 않을 경우 황 대행에게 헌법이 보장하는 내에서 모든 책임을 물을 것이라고 밝혔다.

돼지의 등에 “라울”과 “피델”의 이름을 그렸다는 죄로 1년 가까이 수감됐던 쿠바의 그래피티 아티스트 다닐로 말도나도 마차도(Danilo Maldonado Machado)가 하바나 외곽에 위치한 발레 그란데 교소도에서 20일 풀려났다. “El Sexto(엘 섹스토, 여섯번째)”로 더 잘 알려진 그는 아바나의 정치범 치안대원에 의해 지난 2014년 12월 25일 택시로 이동 중 체포됐으며, ‘혁명 지도자에 대한 결례’ 혐의로 기소됐다. 하지만 석방될 때까지 단 한 차례의 재판도 열리지 않았다. 다닐로는 성탄절 예술축제에서 선보이기 위한 목적으로 이 같은 행동을 한 것으로 알려졌다.

지난 9월 19일 쿠바를 방문한 성 프란치스코 교황은 “쿠바를 세계에 공개할 기회가 왔다”며, 쿠바의 젊은이들에게 열린 생각과 마음을 지니고 ‘생각이 다른’ 사람들과 기꺼이 대화를 나눌 것을 요청했다.

하지만 쿠바 국민들과는 달리, 정부는 이를 귀담아 듣지 않았다. 오히려 교황이 쿠바를 떠난 이후 표현의 자유에 대한 탄압은 더욱 심해지고 있는 듯하다. 독립적 단체인 쿠바 국가화해 인권위원회는 2014년 평균적으로 매달 741건의 자의적 구금이 이뤄졌다고 발표했다. 교황이 쿠바를 방문했던 지난 9월에는 심지어 더 늘어난 882건의 자의적 구금이 이뤄진 것으로 알려졌다.

반정부단체 쿠바애국연합(UNPACU) 소속 활동가 자케오 바에스 게레로(Zaqueo Baez Guerrero), 이스마엘 보네트 레네(Ismael Bonet Rene), 마리아 호세파 아콘 사르디나스(María Josefa Acón Sardinas)는 지난 9월 20일 아바나에서 교황에게 대화를 시도하려다 안전선을 넘었다는 이유로 체포돼 지금까지 교도소에 수감돼있다.

이들 3명에게 적용된 혐의는 ▲불경 ▲저항 ▲공무원에 대한 폭행 또는 위협 ▲공공 무질서 등이다. 유죄가 선고될 경우 최소 3년에서 최대 8년까지 징역형에 처해질 수 있다.

지난 10월 11일, ‘흰옷 입은 여성(Damas de Blanco)’과 쿠바애국연합 소속 회원들을 비롯한 인권활동가와 반정부 시위대 수백 명이 전국 각지에서 구금된 활동가들과 양심수의 석방을 요구하는 평화적인 시위를 준비하던 도중 임의 체포 및 구금됐다. 사람들은 이들이 평화적인 행진을 시작한 지 채 10분도 되기 전에 구타를 당했고, 회원 60명은 수 시간 동안 구금됐다고 전했다. ‘흰옷 입은 여성’의 대표 베르타 솔라르(Berta Solar)는 “오후 1시 30분에 시작된 행진이 1시 40분에 저지당했다”고 말했다.

그래피티 아티스트 다닐로 말도나도 마차도의 어머니와 할머니 역시 ‘흰옷 입은 여성’의 행진에 함께 참여했다. 다닐로의 어머니는 “수많은 경찰들이 ‘흰옷 입은 여성’ 회원들을 버스에 태워서 아무도 이들이 시위하는 모습을 보지 못하도록 했으며 경찰이 여성들을 끌고 가는 모습은 너무나도 충격적이었다”고 말했다.

호세 다니엘 페레르(José Daniel Ferrer) 쿠바애국연합 총서기는 최근 사회적 지도자 4명의 자택이 강도를 당하거나 훼손당했다고 밝혔다.

최근 한 활동가는 자신을 비롯해 30명의 승객을 태우고 산티아고 데 쿠바로 향하던 버스가 경찰관 40명에게 불시에 검문을 당했다고 증언했다. 이 활동가는 “경찰관들이 버스에서 한 사람씩 내리게 하더니, 사람들을 구타하고 교도소에 보내겠다고 위협했다”며 “지프에 태워 어느 외딴 곳에 버려두고 떠나는 바람에 집으로 돌아가기 위해 수 마일을 걸어가야 했다”고 전했다.

또 다른 활동가는 체포된 이후 폭행을 당했다며, “어떤 경찰관은 우리에게 모두 조용히 하지 않으면 이를 모두 뽑아 버리겠다며 협박하기도 했다”고 전했다. 경찰들은 출혈이 심한 것을 보고서야 구타를 멈췄다고 한다.

많은 사람들이 프란치스코 교황의 쿠바 방문으로 표현의 자유를 되찾기를 기대했지만 쿠바정부는 반대파의 목소리를 막기 위해 여전히 구시대와 똑같은 방식을 동원하고 있음을 보여줬다. 에리카 게바라 로사스(Erika Guevara-Rosas) 국제앰네스티 미주국장은 “다닐로의 석방은 주목할 일이지만 애초에 체포돼서는 안됐다”며 “평화적인 방법으로 자신의 견해를 표현하는 것이 범죄가 될 수 없다”고 말했다.

쿠바는 중요한 갈림길에 서 있다. 쿠바 정부는 오래 전부터 교육과 의료 서비스를 받을 권리를 증진하겠다고 밝혀 왔고, 레즈비언, 게이, 양성애자, 성전환자, 인터섹스(LGBTI)의 권리 보장에 대해서는 일부 진전을 보이기도 했다. 그러나 정부가 평화적으로 의견을 표현할 권리를 엄격히 통제하고 독립적인 감시단의 입국을 막는 한, 쿠바의 전반적인 인권 상황을 제대로 평가하기란 불가능한 일이다.

쿠바 국민들이 정부에 통제된 공간에서만 반대 의견을 표현할 수 있고, 집회와 시위의 자유가 엄격히 제한되어 있다면, 쿠바에서 인권에 대해 폭넓은 논의가 이뤄지기란 실현되기 힘든 꿈으로만 남게 될 것이다.
