엘살바도르의 극단적인 낙태금지법에 따라 유산이나 응급상황을 겪은 여성들이 불법 낙태 시술을 받은 혐의로 갇히면서, 수백 명 자녀의 삶에 참담한 영향을 끼치고 있다고 국제앰네스티가 11월 30일 발표한 보고서를 통해 밝혔다.

보고서 <헤어진 가족, 끊어진 인연>에서는 터무니없는 낙태금지법으로 갇힌 여성의 아이들이 대부분 금전적으로 힘든 상황에 부닥치거나 어머니와 연락을 주고받지도 못하는 현실이 담겨있다.

아스트리드 발렌시아(Astrid Valencia) 국제앰네스티 중앙아메리카 조사관은 “엘살바도르 정부는 유산이나 임신 합병증을 겪은 여성을 부당하게 가둘 때마다 그 자녀들 역시 가난과 정신적 고통 속에 살아가도록 내몰고 있다”며 “임신 합병증을 겪은 여성들에게만 적용되는 엘살바도르의 ‘유죄 추정의 원칙’으로 수백 명이 희생되었고, 여성들은 최대 40년까지의 징역형에 처했으며, 의사와 환자 사이에 절대적인 공포 분위기가 조성되었다. 지금이야말로 엘살바도르의 이러한 시대착오적인 낙태금지법을 철폐해야 할 때”라고 말했다.

모든 경우에 대한 낙태 시술이 범죄화됨에 따라 최소 19명 이상의 여성들이 근거가 미약하거나 결정적이지 못한 증거로도 살인과 같은 중대한 범죄로 유죄 선고를 받고, 장기간의 징역형에 처해 현재 교도소에 갇혀 있다. 이들 중 대부분은 가정의 생계를 책임지고 있었다. 이런 여성들이 투옥되면 가족들이 벌이하고 아이들을 돌봐야 하는데, 주로 극심하게 어려운 상황에 처한 경우가 많았다.

경제적 수입이 전혀 없고, 교도소가 집에서 멀리 떨어진 탓에 대부분의 가족은 사랑하는 가족을 면회하기도 어렵다. 일부의 경우 수개월 넘게 자녀를 만나지 못하는 여성들도 있었다.

유산을 겪은 이후 ‘고의 살인’ 죄로 징역 40년형을 선고받고 현재 수감 중인 32세 여성 마리아 테레사 리베라는 2011년 갇힌 이후 지금까지 열 살 난 아들을 만난 것이 겨우 4번에 불과했다.

마리아 테레사의 아들은 그녀가 수감된 교도소로부터 수 시간 떨어진 곳에 할머니와 함께 살고 있는데, 교도소를 한번 방문하려면 엄두도 못 낼 정도로 비싼 비용이 든다. 마리아 테레사가 벌어오던 수입이 끊기고, 정부의 지원도 없어 마리아 테레사의 시어머니 역시 손자를 키우는 데 큰 어려움을 겪고 있다.

마리아 테레사는 욕실에서 거의 실신한 상태로 피를 심하게 흘리고 있는 것을 시어머니가 발견해 병원에 옮겨졌으나 그 자리에서 체포되었다. 병원 직원이 낙태한 것으로 의심하고 경찰에 신고했던 것이다.

재판 과정에서 마리아 테레사의 직장 상사 중 한 명이 그녀가 임신한 사실을 2011년 1월에 이미 알고 있었다며 불리한 증언을 했다. 이 증언이 사실이라면 유산 당시 임신 11개월째였다는 말이 된다. 이처럼 터무니없는 증언조차도 유죄를 선고하는 근거로 이용됐다.

마리아 테레사의 어린 아들은 어머니의 부당한 구금으로 유난히 힘든 시간을 보내고 있다.

마리아 테레사의 시어머니인 “이사벨”은 교도소를 방문할 때마다 겪는 고통에 대해, “손자를 데리고 처음 면회를 갔을 때는 정말 힘들었다. 손자는 심하게 울음을 터뜨렸고 나도 마찬가지였다. 아이는 교도소를 떠나지 않으려고 했다. 너무나 고통스러워서 아이를 데리고 나가는 것도 잠시 포기해야 했다. 아이에게도, 엄마에게도 너무나 힘든 일이기 때문이었다”고 전했다.

테오도라 델 카르멘 바스케스는 2008년 직장에서 사산한 후 “고의 살인” 죄로 징역 30년이 선고됐다. 그녀의 11살 난 아들은 면회를 거의 오지 못한다.

테오도라는 2008년 30년 형을 선고받았다. 11살 난 아들은 엄마를 거의 만날 수 없다.

베르타(가명) 역시 이와 비슷하게 임신 합병증을 겪고 기소되어 거의 1년간을 감옥에서 보냈다. 수감되어 있던 기간의 절반 동안은 열 살 난 아들을 만날 수 없었다.

“베르타”는 2010년 7월 출혈이 심한 상태로 지역 병원을 찾았다가 체포되었다. ‘고의 살인’ 죄로 기소되었지만 정작 본인은 임신한 사실조차 몰랐다. 재판이 시작할 때까지 변호사를 만나지도 못했다. 베르타가 기소된 죄목으로 유죄가 선고되면 최대 징역 50년형까지 처할 수 있었다. 사법절차가 시작된 지 거의 1년 만에 베르타는 무죄가 선고됐다. ‘치료 목적, 윤리적, 우생적 낙태 비범죄화를 위한 시민단체’라는 지역 인권단체의 소속 변호사들이 새로운 증거를 제출한 덕분이었다.

그러나 재판 과정과 교도소에 갇혔던 당시의 경험은 베르타와 가족들의 삶에 엄청난 상처를 남겼다.

베르타는 당시의 경험 때문에 여전히 정신적으로 힘든 상태이며, 이후 어떤 형태의 보상이나 배상도 받지 못했다고 국제앰네스티에 전했다.

베르타는 “몇 년이 지나더라도 그 때로 인한 고통은 여전히 마음속 깊은 곳에 남아 있다”고 말했다.

베르타의 어머니는 당시 베르타가 부당하게 교도소에 갇히면서 끼친 영향에 대해, “딸이 감방에서 지내는 동안 추위로 고생하고 있을 것을 생각하니 잘 때도 이불을 덮지 못했다. 이불을 덮지 않으면 함께 고통을 나눌 수 있겠다고 생각했기 때문이었다. 지금도 아무리 추워도 이불을 덮지 못하는 걸 보니 여전히 상처가 아물지 않은 것 같다. 지금은 베개도 딱딱한 바위처럼 느껴진다. 예전과는 전혀 달라졌다”고 국제앰네스티에 전했다.

아스트리드 발렌시아 조사관은 “엘살바도르 정부는 어린아이들에게 이처럼 감당할 수 없는 고통을 선고하기보다는, 여성을 그저 ‘출산 기계’로 취급하는 것만이 목적인 현행법을 재검토하는 데 여력을 집중해야 할 것”이라고 말했다.

1998년 개정형법에 따라, 엘살바도르는 강간, 근친상간에 의한 임신이거나 산모의 생명이 위험에 처한 경우에도 상관없이 모든 경우에 대한 낙태 시술을 금지했다. 이로 인해 여성들이 즉시 유죄로 몰리며 부당한 기소와 형법의 오적용이 계속되고 있다. 경제적으로 넉넉하지 못한 여성들은 특히 낙태금지법으로 더욱 큰 영향을 받았다.

EL SALVADOR’S TOTAL ABORTION BAN SENTENCES CHILDREN AND FAMILIES TO TRAUMA AND POVERTY

El Salvador’s extreme anti-abortion law is having a devastating effect on the lives of scores of children whose mothers, having suffered miscarriages or other obstetric emergencies, are being held behind bars accused of having illegal abortions, said Amnesty International in a new report today.

Separated families, broken ties, reveals how children of women jailed under the absurd anti-abortion law are often left facing difficult financial circumstances and prevented from staying in touch with their mothers.

“Each time authorities in El Salvador unfairly lock up a woman for having a miscarriage or suffering pregnancy related complications, they are also condemning her children to a life of poverty and trauma,” said Astrid Valencia, Central America Researcher at Amnesty International.

“El Salvador´s ‘guilty until proven innocent’ approach when it comes to women who suffer pregnancy-related complications has cost scores of lives, landed women in prison for up to 40 years and created an environment of absolute fear amongst doctors and patients. It is high time for El Salvador to abolish this outdated ban.”

At least 19 women are currently in jail, in the context of a total criminalization of abortion, convicted of serious offences such as homicide and sentenced to long prison terms on weak or inconclusive evidence. Most of them were their household’s main breadwinners. Since their incarceration, their extended families are responsible for providing and looking after their children, often in extremely difficult circumstances.

The lack of financial resources and the long distances between their homes and the prisons prevents many of the families from visiting their loved ones in prison. In some cases, women were not able to see their children for months.

Maria Teresa Rivera, a 32-year-old woman currently serving a 40 year prison sentence for “aggravated homicide” after having a miscarriage has only seen her ten-year-old son four times since she was jailed in 2011.

The boy lives with his grandmother several hours away from the prison and the journey is prohibitively expensive. Without Maria Teresa’s income and with no official support, her mother- in- law is also struggling to provide for her grandson.

Maria Teresa was arrested in a hospital after her mother-in-law found her in her bathroom almost unconscious and bleeding heavily. Staff at the hospital reported her to the police and accused her of having an abortion.

During the trial, one of Maria Teresa’s bosses testified against her saying she knew she was pregnant in January 2011. This would have made her 11 months pregnant by the time the miscarriage took place. The outrageous testimony was used as one of the pieces of evidence to convict her.

María Teresa´s young son is having a particularly difficult time dealing with his mother’s unfair detention.

“Isabel”, María Teresa´s mother in law, told Amnesty International of the traumatic visits to the prison: “The first time I took the child it was very hard. He cried a lot and I did too. He didn’t want to leave the prison. It was so hard that I stopped taking him for a while because it was tough for both of them.”

Similarly, Bertha (not her real name), spent nearly a year in jail also prosecuted for homicide after suffering a pregnancy-related complication. She was not able to see her 10- year-old son during half the time she was in prison.

“Bertha” was arrested in July 2010 in a local hospital, where she had arrived heavily bleeding. She was charged with “aggravated homicide” although she did not know she was pregnant. “Bertha” did not meet her lawyer until the trial started. The penalty for the crime she was accused of could be as high as 50 years in jail. Bertha was found innocent almost a year after the process against her began, when lawyers from the local human rights group Citizen Group for the Decriminalization of Therapeutic, Ethical and Eugenic Abortion provided new evidence on the case.

The trial and the time she was forced to spend in jail, however, left a profound mark on Berta’s life and her relatives.

She told Amnesty International that she is still traumatized by the experience and said she has not receive any kind of compensation or reparation measures.

“Even though several years have passed, the pain stays deep inside,” she said.

Talking about the impact of Bertha’s unfair incarceration on her family, her mother said: “To sleep, I couldn’t use the covers because during those days, when she was in the cells, I would start to think that she was suffering from the cold and so I wouldn’t cover myself so that I could experience her suffering. And now, I can’t use the covers even if I’m cold, so I know I’m still affected by it. Now, the pillow feels like a stone…I’m not the person I used to be.”

“Instead of sentencing children to this unbearable suffering, authorities in El Salvador should focus their energies in reviewing legislation that serves no purpose but to treat women as little more than ‘human vessels’,” said Astrid Valencia.

Following a change in the Penal Code in 1998, abortion in El Salvador has been banned in all circumstances – even when the pregnancy is the result of rape, incest or when the life of the woman is at risk. The change in the law has led to wrongful prosecutions and misapplication of criminal law where women are immediately assumed guilty. Women with few economic resources are particularly affected by the ban.

도널드 트럼프 신임 미국 대통령의 취임식이 20일, 전세계의 관심 속에 워싱턴 D.C에서 진행됐다. 이로써 도널드 트럼프와 신임 행정부는 미국의 법을 수호할 책임을 부여받게 되었다. 여기에는 미국 안팎의 인권을 보호하는 의무도 포함된다.

미국의 막대한 권력은 사람들의 인권에 파괴적 영향을 끼친다. 그래서 만약 트럼프가 자신의 선거운동에 활용했던 공포와 혐오의 구호를 정책으로 구현한다면 이는 매우 실제적인 위협이 될 수 있다.

무슬림 등록제, 특정 종교를 가진 사람들에 대한 입국 금지 등 트럼프의 대선 공약은 2차 세계대전 당시 일본계 미국인 감금과 같은 미국 역사의 수치스러운 장면을 환기시킨다. 트럼프는 자신의 연설에서 여성, 유색인종, 장애인을 비하하는 발언을 했고 비평가들과 기자들에 대한 협박성 발언도 서슴지 않았다.

트럼프 캠프의 책임 전가와 공포감 조성 전략은 미국은 물론 세계적으로 유래를 찾아볼 수 없는 것들이다.

트럼프가 당선된 후 임명한 내각 내정 인사들의 과거 발언과 증언도 향후 트럼프 행정부의 정책에 대한 우려를 낳는 부분이다. 렉스 틸러슨(Rex Tillerson) 국무장관 내정자는 엑손 모빌 최고경영자 시절 긴밀한 사업적 관계로 맺어진 이들과 여러 국가에서 자행되는 인권침해에 대해 소극적인 자세로 일관한 전력이 있다. 법무장관으로 내정된 제프 세션스(Jeff Sessions) 상원의원도 여성, 유색 인종, LGBTI(성소수자)의 권리를 보호하는 정책에 거듭 반대 입장을 표명해 왔다.

국제앰네스티는 지난 55년 동안 역대 미국 대통령을 포함한 세계 각국의 지도자들에게 인권수호의 책임을 물어왔으며, 도널드 트럼프도 예외가 될 수 없다.

혐오발언, 인종차별주의, 소수자 차별 발언을 중단하라


트럼프는 대통령으로서 혐오발언을 단호하게 중단하고, 인종차별주의와 차별을 공식적으로 거부해야 한다. 그렇게 하지 않는다면 그 폐해는 미국인뿐 아니라 전세계 사람들에게 전가될 것이다.

난민 지원 원칙을 준수하라


트럼프의 취임은 사상 초유의 난민위기와 그 시기가 맞물려 있다. 제2차 세계대전 이래 그 어느 때보다 많은 수의 난민이 폭력적 분쟁을 피해 달아나고 있다. 돌아가면 죽을지도 모른다는 공포로 수백만명이 강제로 집을 떠나야했다. 미국은 반드시 난민 보호의 책임을 공유해야 한다.

그간 트럼프는 난민신청자들에 대해서 추하고 명백히 잘못된 고정관념에 기초한 거짓 주장을 여러 차례 펼쳐왔다. 트럼프는 이런 발언을 중단하고 미국이 지켜온 난민 지원 원칙을 준수해야 한다.

미국이 난민 위기를 외면한다면 다른 국가들도 이런 구실로 국제법상의 의무를 회피할 것이다. 이는 교육, 일자리, 적절한 식량과 의료 지원 없이 난민 수용소에 머물고 있는 여성, 남성, 아이들의 고통을 장기화할 뿐만 아니라 약 2100만명의 오갈 데 없는 난민들을 양산하며 국제 사회의 비극을 되풀이하는 결과로 이어질 것이다.

반대에 대한 의견 존중, 표현의 자유를 보장하라


트럼프의 취임 시기는 인권옹호자에 대한 공격이 증가하는 추세에 접어든 때와 맞물려 있기도 하다. 모스크바에서 카이로, 스탠딩 록에서 홍콩에 이르기까지 자신의 권리를 지키기 위한 사람들이 박해당하고 체포되며 공격받고 있다. 트럼프가 자신과 다른 목소리를 내는 사람들을 잔인하게 거부하는 모습도 불길한 징조다. 대통령으로서 트럼프는 이런 위협 전략을 버리고, 표현의 자유를 지키기 위해 비폭력성향의 반정부인사, 인권옹호자, 더 나아가 자신을 비판하는 사람들의 권리까지도 존중하고 보호하는 데 앞장서야 한다.

국제 인권 의무는 대통령이 지켜야 하는 엄중하고 무시할 수 없는 의무이다. 미국 정부가 어떠한 차별 없이 모든 사람의 인권을 존중하고 보호하며 이행해야 하는 것은 매우 중요하다.

지금까지 우리는 세계 지도자들이 이러한 의무를 도외시하고 양심 없이 행동했을 때 어떤 결과가 나오는지 지켜봐왔다. 미국에서 이런 일이 되풀이된다면, 다른 국가 지도자들이 대담하게 인권침해를 제멋대로 계속할 것이다.

이제는 우리 모두가 연대하여 트럼프 대통령과 신임 행정부가 모든 이의 인권을 존중하도록 요구할 때다.

만평 작가 아테나 파르가다니와 그 변호사가 서로 악수를 나눈 것만으로 “간통에는 해당하지 않는 부적절한 성적 관계” 혐의로 재판을 받게 된 것은 터무니없고 지나칠 뿐만 아니라 명백히 정치적인 이유로 이루어진 것이라고 국제앰네스티가 밝혔다. 이들에 대한 재판은 3일 테헤란 일반형사법원에서 시작되었다.

국제앰네스티가 양심수로 간주하는 아테나 파르가다니와 그의 변호사 모하마드 모기미는 두 사람 모두 유죄가 선고될 경우 채찍질형 99번까지 처해질 수 있다. 국제앰네스티는 파르가다니가 표현의 자유를 행사했다는 이유만으로 두 사람이 구금되었다고 보고 있다.

라하 바레이니(Raha Bahreini) 국제앰네스티 조사관은 “이번 사건은 터무니없을 뿐만 아니라, 남녀가 악수를 나누는 것을 형사범죄로 간주하며 사생활의 권리를 명백히 침해하는 것”이라며 “이는 정치적인 이유로 이루어진 것으로, 이란 정부가 아테나를 괴롭히고 변호사가 제대로 변호하지 못하도록 막으려는 명백한 시도다. 이란 정부는 이처럼 젊은 양심수를 괴롭히고 위협하지 말고, 즉시 무조건적으로 기소를 취소하고 석방해야 할 것”이라고 말했다.

국제앰네스티가 파악한 바에 따르면 아테나 파르가다니는 4일 열린 재판에 직접 변호사를 선임하지 못했으며, 공정한 재판을 받지 못했을 우려가 있다.

아테나 파르가다니와 모함마드 모기미는 아테나의 재판이 열렸던 6월 13일, 교도소에서 악수를 나눴다가 “간통에는 해당하지 않는 부적절한 성적 관계” 혐의로 기소되었다. 당시 체포된 모함마드는 3일 후 약 6만 달러에 이르는 보석금을 내고 석방되었다.

지난 6월 아테나 파르가다니는 이란 국회의원들과 아야톨라 알리 카메네이 국회의장을 원숭이, 소 등의 동물로 묘사한 풍자 만평을 발표해 이들을 모욕한 혐의 등 다수의 죄목으로 징역 12년 9월에 처해졌다.

아테나가 2009년 이란 대통령 선거 이후 정부가 시위를 진압하는 과정에서 희생된 피해자 유족들의 권리를 공개적으로 옹호했던 것 역시 유죄 선고의 원인이 됐다.

교도소 수감 중에도 아테나는 교도관들로부터 성적 모욕과 욕설 등의 폭언을 들어야 했다. 아테나는 이에 항의하며 지난 9월 3일간 단식 투쟁을 벌였지만 괴롭힘은 계속되고 있다.

Iran: Indecency trial of jailed cartoonist and her lawyer for shaking hands absurd

The trial of satirical cartoonist Atena Farghadani and her lawyer on a charge of “illegitimate sexual relations falling short of adultery” after they shook hands is not only absurd and extreme but clearly politically motivated, said Amnesty International ahead of the General Criminal Court session starting tomorrow in Tehran.

Both Atena Farghadani, whom Amnesty International regards as a prisoner of conscience, and her lawyer Mohammad Moghimi may face up to 99 lashes if found guilty. The organization believes the cartoonist and activist has been detained solely for exercising her right to freedom of expression.

“It is clearly both absurd and a violation of the right to privacy to consider a man and a woman shaking hands as a criminal offence,” said Raha Bahreini, an Amnesty International researcher.

“These charges are politically motivated and they are a blatant attempt by the Iranian authorities to harass Atena and hinder her lawyer’s work representing her. Instead of subjecting this young prisoner of conscience to further harassment and intimidation, the Iranian authorities must immediately drop these charges and free her immediately and unconditionally.”

Amnesty International has learnt that Atena Farghadani is going to tomorrow’s hearing without having secured a lawyer of her own choice and fears that she won’t receive a fair trial.

Atena Farghadani and Mohammad Moghimi were charged with “illegitimate sexual relations short of adultery” after they shook hands in prison after her trial on 13 June. Mohammad was arrested, and released three days later after he had paid a bail amounting to around $60,000.

In June, Atena Farghdani was sentenced to 12 years and nine months in prison for multiple offences including insulting Iran’s MPs and its Supreme Leader Ayatollah Ali Khamenei after publishing a series of satirical cartoons depicting legislators as monkeys, cows and other animals.

Her conviction also stemmed from her speaking out publicly on the rights of the families of victims of the government’s crackdown following Iran’s 2009 presidential elections.

Whilst in prison, Atena Farghadani has been verbally abused with sexual slurs and other insults by both prison officials and guards. Despite a three-day hunger strike by Atena Farghadani in September, the harassment continues.

헌재의 대통령 탄핵심판 정국으로 조기 대선이 전망되는 가운데, 이재명 성남시장이 오늘(1월 23일) 19대 대선 공식 출마를 선언했다. 하루 전(22일)에는 안희정 충남지사가 대선 출마를 공식선언했다.

“적폐청산, 공정국가. 이재명이 합니다.”

이재명 성남시장은 1월 23일 월요일 오전 11시, 19대 대통령 선거 출마를 공식 선언했다. 장소는 자신이 소년시절 노동자로 일했던 공장이었다.  이재명 시장은 “‘노동자 출신 대통령’으로서 과거의 어둠과 절망을 걷어내고, 공정한 나라를 만들겠다”고 말했다.

이날 이재명 시장이 강조한 화두는 ‘적폐청산’과 ‘공정사회’였다. 이 시장은 공정사회를 방해하는 적폐로 재벌과 기득권 정치 세력이 있다면서 이를 최우선적으로 해결하겠다고 여러차례 밝혔다.

우리 경제구조의 가장 큰 문제로 ‘10%의 국민이 대한민국 전체 연소득의 48%, 자산 66%를 가지고, 국민 50%가 연소득의 5%, 자산 2%를 나눠가지는 극심한 불평등 구조’를 꼽으며 이를 타파할 것을 강조했다. 이를 위해 “기업과 개인에 합당한 증세를 실시해 국민복지를 확대해야 한다”고 밝혔다. 또 “언론과 검찰, 공직사회의 대대적 개혁을 통해 부정부패를 뿌리뽑아 정경유착의 고리를 끊겠다”며 ‘공정사회’를 만들기 위한 선결과제로 정치를 바꿔야 한다고 주장했다.

이재명 시장은 지난해 10월부터 계속된 촛불민심이 원하는 것이 ‘공정사회’라며, “국민발안, 국민소환, 국민투표제 등 직접민주주의를 도입 확대하고, 대의민주주의가 제대로 작동하도록 비례대표제를 수정해야 한다”고 말했다.

이 시장은 또 성남시의 공약 이행률이 96%라는 것을 강조하며 기득권과 싸워 이겨 적폐청산, 공정사회를 건설하겠다”고 말해 자신이 “우리사회의 뿌리깊은 기득권과 싸워 이기겠다”고 주장했다.

출마선언 후 기자와의 질의응답에서도 이재명 성남시장은 “여론조사와 경선은 다르다”며, “소극적인 여론조사와 달리 경선에서는 적극적 지지자가 승리를 결정하기 때문에 부패기득권 세력과 싸울 적임자로 자신이 선택될 것”이라고 말했다.

“안희정과 함께, 바꿉시다.”

이에 앞서 안희정 충남지사는 1월 22일 대학로의 한 소극장에서 대선 출마를 선언했다. 더불어민주당 소속으로는 첫 공식 선언이다.  

안희정 지사는 이날 지금의 국정혼란 상황이 벌어진 것이 “부끄럽고 참담하다”며 “우리 정치가 30년을 후퇴한 것 같아 안타깝지만, 국민들의 역량을 바라보며 30년의 시간이 헛되지 않았다”고  느꼈다고 밝혔다.

안 지사는 또 적폐 청산을 요구하는 국민들의 요구에 대해서도 “87년 6월 항쟁의 시대를 끝내고 이제 새로운 30년을 시작해야 한다”며 세상을 바꿀 젊은 리더십은 자신에게 있다며 지지를 호소했다. 또 자신이야 말로 민주당의 적자로 김대중, 노무현 정신을 계승할 수 있다고 주장했다. 그러면서 자신은 ‘차차기 후보’가 아닌 ‘차기 후보’임을 강조했다.

안 지사는 ‘법과 제도와 규칙이 지배하는 사회’, ‘대화를 통해 타협하는 민주주의’를 이뤄내야 한다며 정치권을 비롯한 각계각층에 대화와 협력을 강조했다. 대화 만이 지금 우리 사회의 문제를 해결할 수 있는 가장 적합한 방법이라고 주장했다.

안희정 지사는 자신의 복지정책에 대해 “누구에게나 나눠주는 정치는 답이 아니다”라고 말하며 ‘공정한 출발선을 보장해주는 것을 통해 일체의 차별이 없는 나라가 되도록 하는 것’이 자신이 생각하는 복지임을 분명히 밝혔다. 이는 이재명 시장과 박원순 시장이 주장하는 무상 복지정책과 차별화를 두는 전략으로 해석된다.  

실제 이날 안 지사는 “국민은 공짜밥을 원하지 않는다, 포퓰리즘은 청산되어야 한다”고 말했다. 이같은 발언에 대해 이재명 시장은 실망스럽다며 “포퓰리즘은 구태 기득권 세력이 쓰는 말이며, 국민이 내는 세금을 다시 국민에게 주는 것은 공짜가 아니”라고 반박했다.

더불어민주당 소속 두 후보가 잇따라 출마선언을 하자 문재인 전 대표는 페이스북에 글을 올려 ‘안 지사님의 출마선언을 환영한다’, ‘이재명 성남시장님의 대선 출마 선언을 환영한다’고  밝혔다. 박원순 서울시장도 페이스북을 통해 ‘우리는 드림팀이다’고 말하며 안 지사와 이 시장의 출마를 응원했다.

안희정 지사와 이재명 시장이 잇따라 대선 후보 출마를 공식 선언한 가운데, 문재인 전 대표, 박원순 서울시장, 안철수 국민의당 의원 등도 조만간 대선 출마 선언을 공식 발표할 것으로 보인다. 또 오는 1월 26일에는 바른정당 유승민 의원이 19대 대선 출마를 공식 선언할 예정이다.

에드워드 스노든(Edward Snowden)이 미국과 영국 정보부의 국제적 감시 프로그램을 폭로한 지 2년째를 맞이한 가운데, 국제앰네스티와 프라이버시 인터내셔널(Privacy International)은 5일 공동 브리핑을 발표하고, 각국 정부는 무차별 감시 프로그램의 정당성에 관한 논쟁에서 패배했음을 인정하고 정보 수집 방식에 있어 자신들의 과오를 바로잡아야 할 것이라고 밝혔다.

에드워드 스노든은 5일 전세계 신문에 실린 기사를 통해, “힘의 균형이 옮겨가고 있다”며 “법정에서의 승소와 법률 개정을 통해, 우리는 공포보다 사실이 더욱 확실하다는 것을 입증하고 있다”고 말했다.

브리핑 <’스노든 폭로’ 후 2년: 무차별 감시 시대에서의 인권 보호>는 법원과 의회, 많은 인권단체가 집단 감시 프로그램을 인권침해라고 비판하고 있음에도 이를 강행하고 확대하려는 국가정부에 대해 경고하고 있다. 이는 이번 주 미 의회가 미국 자유법(USA Freedom Act)을 채택한 데 뒤이어 발표된 것으로, 스노든의 폭로 이후 감시 권력의 법적 후퇴를 보여주는 유일무이한 사례였다.

칼리 니스트(Carly Nyst) 프라이버시 인터내셔널 법무국장은 “스노든의 폭로 덕분에 수백만 명의 일반 시민들은 자신의 가장 은밀한 비밀조차도 정부의 감시로부터 안전하지 못하다는 것을 알게 되었다. 다양한 국립 및 국제 전문가 집단이 이미 분명히 밝혔듯이, 무차별적인 집단 통신기록 감시는 인권 침해다. 이미 승부는 났고, 국가정부가 무차별적 집단 감시 프로그램을 개혁해야 할 때가 왔다”고 말했다.

셰리프 엘세이드 알리(Sherif Elsayed-Ali) 국제앰네스티 글로벌이슈 부국장은 “정부가 아직 집단 감시 프로그램이 인권침해라는 사실을 받아들이지 못하고 있는 점은 실망스럽다. 미국 자유법의 통과로 감시활동의 제한 가능성이 제시되긴 했지만, 프랑스와 영국의 감시활동이 더욱 치밀해졌다는 점은 국민의 사생활에 대해 더 많은 정보를 얻고자 하는 국가정부의 욕구가 충족되지 않았음을 보여주는 것”이라고 말했다.

여론 반대 무릅쓰고 감시 확대하는 정부

지난 2년 간, 법원과 의회 청문회 및 정부가 선임한 법적, 기술적 전문가 집단, 유럽위원회 및 유엔 등의 국제기구 등으로부터 집단 감시 프로그램은 불필요한 인권침해라는 비판이 계속됐다.

이번 브리핑은 이러한 국제적 비판에도 불구하고 미국과 영국의 감시 프로그램은 여전히 비밀에 싸여 있으며, 다른 국가들은 독자적으로 새로운 감시활동을 모색하고 있다고 경고했다.

덴마크, 핀란드, 프랑스, 네덜란드, 파키스탄, 스위스 등은 자국 및 그 외 국가까지 아울러 통신 감시 역량을 높인다는 내용의 신규 정보법안을 논의 중이거나 상정할 예정에 있다. 이번 주만 해도 프랑스 상원에서는 정부의 감시 역량을 대폭 강화하는 내용의 신규 법안이 가결되었다.

이번 브리핑은 또한 기술 발전으로 감시 기술이 더욱 저렴하고, 강력하고, 광범위해질 것이라고 경고했다. 현재 대부분 미국과 영국 정보부만이 보유하고 있는 감시 기술은 향후 더 많은 국가에 보급될 가능성이 높다.

디지털 시대의 인권 보호를 위한 7대 계획

국제앰네스티와 프라이버시 인터내셔널은 국가정부에 감시 프로그램의 사용에 있어 적절한 법적 통제 및 의회의 관리감독 등 견제와 균형 원칙을 적용할 것을 촉구하는 내용의 7대 계획을 발표했다. 국제앰네스티와 프라이버시 인터내셔널은 국가정부의 통신 감시 활동이 국제인권법이 허용하는 한도 안에서 이루어지기를 바라며, 즉 다음과 같은 상황에만 허용할 것을 촉구한다.

  • 범법행위가 있었다는 충분한 증거에 기반하여, 대상이 명확하고, 판사와 같이 독립적이고 엄격한 감독자에게 허가를 받았을 경우
  • 투명하고 독립적인 의회 및 사법 절차를 통해 관리 감독되는 경우
  • 공개적으로 열람이 가능하고 충분히 구체적으로 서술된 규칙과 정책에 따라 관리될 경우

국제앰네스티와 프라이버시 인터내셔널은 또한 공격적인 감시활동과 범죄 공격으로부터 수억 명의 인터넷과 통화 내용을 보호하기 위해 유력 인터넷 및 통신 업체가 더욱 큰 역할을 해야 한다고 촉구했다. 이러한 업체들은 정보의 보호와 익명화를 위해 암호화 및 그 외 사생활 보호 기술의 신규 개발과 강화에 더욱 투자하고, 법에 따라 보유한 정보를 정부에 제공해야 할 경우에는 사용자에게 고지해야 한다.

셰리프 엘세이드 알리 부국장은 “기술업체들은 온라인상에서의 사용자의 사생활과 표현의 자유를 보호하기 위해 더욱 적극적으로 나서야 한다. 애플(Apple)과 구글(Google) 등의 대형 업체들은 더욱 강력한 암호화 기준을 채택하기 시작하는 등의 움직임을 보이고 있는 반면 여타 업체들은 뒤처지고 있다. 기술업체들은 언제든 가능할 때 자사의 서비스에 종단간 암호화 기술을 기본적으로 도입해야 한다”고 말했다.

칼리 니스트 국장은 “대규모로 통신 기록을 수집하는 활동의 정당성 여부는 더 이상 논의의 대상이 아니다. 이는 명백한 인권침해이자 국제법 위반이다. 집단 감시 프로그램을 폐기하고, 명확한 대상을 설정해, 인권을 존중하는 책임 있는 방법으로 대체해야 한다”고 말했다.

Two years after Snowden, governments resist calls to end mass surveillance

Governments must accept they have lost the debate over the legitimacy of mass surveillance and reform their oversight of intelligence gathering, Amnesty International and Privacy International said today in a briefing published two years after Edward Snowden blew the lid on US and UK intelligence agencies’ international spying network.

“The balance of power is beginning to shift,” said Edward Snowden in an article published today in newspapers around the world. “With each court victory, with every change in law, we demonstrate facts are more convincing than fear.”

The briefing, Two years after Snowden: Protecting human rights in an age of mass surveillance, warns that governments are looking to maintain and expand mass surveillance, despite the practice being condemned as a human rights violation by courts, parliaments and human rights bodies. It comes on the heels of the adoption of the USA Freedom Act by the US Congress this week, a solitary and limited example of legislative rollback of surveillance powers since Snowden’s revelations began.

“Thanks to Edward Snowden, millions of ordinary people are now aware that not even their most intimate secrets are safe from government snooping. National and international expert bodies could not have spoken more clearly: the indiscriminate mass surveillance of communications is a violation of human rights. The game is up and the time has come for governments to reform their indiscriminate mass surveillance programmes,” said Carly Nyst, Legal Director at Privacy International.

“It is disappointing that governments have not accepted that mass surveillance violates human rights. While the passage of the USA Freedom Act shows that it is possible to roll back surveillance, the prospect of more intrusive spying powers in France and the UK shows that governments’ appetite for ever more information on our private lives is unsated,” said Sherif Elsayed-Ali, Deputy Director of Global Issues at Amnesty International.

Governments defy public opinion by expanding surveillance

During the past two years, mass surveillance has been condemned as excessive and a violation of human rights by courts, parliamentary enquiries and legal and technology experts appointed by governments and international institutions such as the Council of Europe and the United Nations.

The briefing warns that, in defiance of global condemnation, UK and US spying programmes remain shrouded in secrecy, while several other governments are seeking new surveillance powers of their own.

Denmark, Finland, France, the Netherlands, Pakistan and Switzerland are discussing or set to present new intelligence bills that will increase their ability to spy on communications in these countries and beyond. Just this week, the French Senate voted on a new bill that would grant the authorities vastly increased surveillance powers.

The briefing also warns that technological advances will make surveillance technology cheaper, more powerful and more widespread. Much of the capability currently available only to US and UK intelligence agencies will likely be available to many more countries in future.

Seven-point plan for protecting human rights in the digital age

Amnesty International and Privacy International today presented a seven-point plan calling on governments to introduce checks and balances on the use of surveillance, including proper judicial control and parliamentary oversight.

The rights groups want communications surveillance to be reeled in within the bounds of international human rights law, which means it only happens when it is:

  • Targeted, based on sufficient evidence of wrongdoing, and is authorized by a strictly independent authority, such as a judge,
  • Overseen by transparent and independent parliamentary and judicial processes,
  • Governed by publicly available and sufficiently detailed rules and policies.

The rights groups are also calling on powerful internet and telecoms companies to do more to protect the internet and phone communications of billions of people from invasive surveillance and criminal attacks. Companies should invest in new and better encryption and other privacy technologies for securing and anonymizing data, and inform users when the law may oblige them to hand their data over to governments.

“Tech companies must do much more to protect their users’ privacy and freedom of expression online. While some big firms like Apple and Google have started adopting stronger encryption standards, others are lagging behind. Tech companies need to introduce end-to-end encryption in their services by default, whenever possible,” said Sherif Elsayed-Ali.

“The legitimacy of collecting communications in bulk is no longer up for debate – it is a violation of human rights and international law. Mass surveillance must be dismantled and replaced by targeted, accountable measures that respect human rights,” said Carly Nyst.

사우디아라비아에서 반정부시위에 참여했다가 미성년자임에도 체포된 시아파 활동가 알리 모하메드 바키르 알 니므르(Ali Mohammed Baqir al-Nimr) 및 동료 활동가 2명이 곧 처형될 것이라는 우려가 증폭되고 있다고 국제앰네스티가 16일 밝혔다. 이들은 최근 독방으로 이감된 것으로 알려졌다.

국제앰네스티는 알리 알 니므르와 다우드 후세인 알 마르훈(Dawood Hussein al-Marhoon), 압둘라 하산 알 자헤르(Abdullah Hasan al-Zaher) 등 3명이 지난 10월 5일 수도 리야드의 알 하이르 교도소에서 독방으로 이감되었다는 사실을 확인할 수 있었다. 2012년 당시 모두 18세 이하의 미성년자였던 3명은 각기 다른 시기에 체포되어, 2014년 사형을 선고받았으며 사우디아라비아 항소법원과 대법원은 올해 초 이들에 대한 사형 판결을 모두 확정했다.

알리 알 니므르가 참수된 뒤 십자가형에 처해질 수 있다는 사우디 국영매체의 보도에 국제적인 규탄의 목소리가 잇따랐다. 10월 14일에는 알리 알 니므르의 어머니가 아들을 구하기 위해 개입해 줄 것을 버락 오바마 미국 대통령에게 호소하기도 했다.

제임스 린치(James Lynch) 국제앰네스티 중동-북아프리카 부국장은 “사형은 잔인하고 비인도적이며 굴욕적인 형벌로, 특별히 범죄에 대한 억지력이 있다는 설득력 있는 증거도 없다. 이러한 사형을 18세 이하 미성년자의 혐의를 처벌하는 데 사용하는 것은 명백한 국제법 위반”이라며 “3명 모두 심문 과정에서 고문을 당하고 변호사 접견을 거부당했다고 진술함에 따라 이들 사건의 법적 절차에 대해 더욱 심각한 우려가 제기되고 있다. 그 과정이 공정한 재판이 전혀 아니었다는 것은 무엇보다도 명백하다”고 말했다.

2012년 2월 체포될 당시 17세였던 알리 알 니므르는 소년원에 수감되어 있다가 이후 성인 교도소로 이감됐으며, 안보 및 테러 사건을 전담하는 법원인 제다 특수형사법원(SCC)은 2014년 5월 알리 알 니므르에게 반정부시위에 참여한 것, 보안군을 공격한 것, 기관총을 소지하고 무장강도 행위를 한 것 등의 12개 혐의에 대해 사형을 선고했다. 알리 알 니므르는 자신의 “자백”이 고문에 의한 것이라고 주장했지만 법원은 해당 의혹에 대한 조사를 명령하지 않았다.

다우드 후세인 알 마르훈과 압둘라 하산 알 자헤르는 2012년 5월 22일과 3월 2일, 각각 17세, 16세의 나이로 체포되었다. 두 사람은 2014년 10월 리야드 특수형사법원에서 반정부 시위에 참여한 것과 무장강도 행위를 한 것, 또한 “화염병을 제작하고 이를 사용해 경찰관 살해에 공조한 것” 등 알리 알 니므르와 유사한 혐의로 사형을 선고 받았다. 두 사람 역시 고문을 당하고 “자백”을 강요받았다고 주장했다.

제임스 린치 부국장은 “사우디아라비아가 심각한 결함이 있는 법적 절차를 통해 사형을 선고한 전력이 있는 것은 매우 수치스러운 일이다. 명백히 불공정한 재판을 통해 임의로 사형이 부과되는 경우도 많다”며 “이번 사건은 소년범에게 사형을 부과한 것까지 겹쳐, 엄청난 국제법 위반에 해당한다. 법원이 ‘자백’하기를 강요받으며 고문을 당했다는 세 사람의 주장을 모두 무시하고 사형을 선고해 버린 것은 그야말로 충격적인 일”이라고 말했다.

사우디아라비아에 법적 구속력이 있는 유엔 아동권리협약에서는 18세 이하 미성년자가 저지른 범죄에 대해 사형을 부과해서는 안 된다고 명시하고 있다.

사우디아라비아는 세계에서 사형을 가장 많이 집행하는 국가 중 하나로, 2014년 한 해를 통틀어 90건의 사형을 집행한 것에 비해 올해 들어서는 지금까지 137명을 처형했다. 주로 불공정재판을 통해 사형이 선고되며 그 대상은 소년범과 정신장애인도 예외가 아니었다. 국제앰네스티는 최근 발표한 보고서를 통해 이러한 내용을 상세히 다루기도 했다.

알리 알 니므르는 사우디아라비아 동부 출신의 유명 시아파 성직자이자 지난 2014년 10월 사형이 선고된 세이크 니므르 바키르 알 니므르(Sheikh Nimr Baqir al-Nimr)의 조카이기도 하다. 사우디 정부와 소수 이슬람 시아파 신도들간의 갈등은 지난 2011년 중동과 북아프리카 지역의 민주화 시위 열풍에 영향을 받은 동부의 시아파 우세 지역 시민들이 개혁을 요구하는 시위를 벌인 이후로 지금까지 긴장이 지속되고 있다.

배경정보

2012년 이후로 사우디아라비아 정부는 법적 수단과 임의로 여행을 금지하는 등의 비사법적 수단을 모두 동원하며 인권활동가와 반정부세력을 박해하고 있다.

2014년 2월, 정부는 신규 반테러법을 시행하며 인권활동가들을 대상으로 장기간의 징역형 또는 사형까지 처하는 데 사용하고 있다.

이러한 활동가들의 재판은 대부분 특수형사법원(SCC)에서 이루어진다. 특수형사법원의 관할권은 모호하고, 재판 절차 역시 비밀에 부쳐진다.

특수형사법원은 상기한 시아파 활동가 3명 외에도 변호사이자 인권활동가인 왈리드 아부 알 카이르(Walled Abu al-Khair) 역시 신규 반테러법에 따라 유죄를 선고했으며, 최근 10월 13일에는 독립적 인권단체인 사우디 시민정치적권리협회(ACPRA)의 창립자 중 한 명인 압둘라만 알 하메드(Abdulrahman al-Hamed)에게 징역 9년형을 선고한 바 있다.

Saudi Arabia: Fears grow that three young activists could soon be executed

There are rising fears about the impending executions of Ali Mohammed Baqir al-Nimr and two other young Shi’a activists in Saudi Arabia who were arrested as juveniles after participating in anti-government rallies, Amnesty International said today after learning that they had been moved to solitary confinement.

The organization has been able to confirm that Ali al-Nimr, Dawood Hussein al-Marhoon and Abdullah Hasan al-Zaher were moved to solitary confinement in al-Ha’ir prison in Riyadh on 5 October. They were arrested at different times in 2012, when they were all under the age of 18, and sentenced to death in 2014. All three death sentences were upheld by Saudi Arabia’s appeal court and the Supreme Court earlier this year.

Pro-government media reports that Ali al-Nimr could face crucifixion after his beheading have sparked a global outcry. On 14 October, his mother appealed to US President Barack Obama to step in to save her son.

“The death penalty is a cruel, inhuman and degrading punishment and there is no convincing evidence that it is a particular deterrent against crime. Its use to punish someone for a crime they allegedly committed when they were under 18 years old is a flagrant violation of international law,” said James Lynch, Deputy Director of the Middle East and North Africa Programme at Amnesty International.

“The fact that all three state that they were tortured and denied access to a lawyer during their interrogations raises further grave concerns about the legal proceedings in their cases. It is abundantly clear that they have had nothing that resembles a fair trial.”

Ali al-Nimr was arrested in February 2012, when he was 17 years old, and held in a juvenile rehabilitation centre and then an adult prison. He was sentenced to death in May 2014 by the Specialized Criminal Court (SCC) in Jeddah, a security and counter-terrorism court, for 12 offences that included taking part in anti-government protests, attacking security forces, possessing a machine-gun and carrying out an armed robbery. Ali al-Nimr has said that his “confessions” were extracted under torture but the court has refused to order an investigation into his allegations.

Dawood Hussein al-Marhoon and Abdullah Hasan al-Zaher were arrested on 22 May and 3 March 2012, when they were aged 17 and 16 respectively. They were sentenced to death by the SCC in Riyadh in October 2014 on similar charges, which included taking part in anti-government protests, carrying out an armed robbery, and “participating in killing of police officers by making and using Molotov cocktails to attack them.” They too claimed to have been tortured and forced to “confess”.

“Saudi Arabia’s record when it comes to sentencing people to death after deeply flawed legal proceedings is utterly shameful. The death penalty is often arbitrarily applied after blatantly unfair trials,” said James Lynch.

“This is compounded in this case by imposing death sentences on juvenile offenders, which is an egregious violation of international law. It is absolutely outrageous that the court dismissed all three activists’ allegations of torture to make them ‘confess’ and simply sentenced them to death.”

The UN Convention on the Rights of the Child, which is legally binding on Saudi Arabia, makes clear that no death sentences may be imposed for offences committed by individuals under the age of 18.

Saudi Arabia is one of the most prolific executioners in the world. The kingdom has executed 137 people so far this year, compared to 90 in the whole of 2014. Death sentences are often imposed after unfair trials, with juvenile offenders and people with mental disabilities not spared, Amnesty International documented in a recent report.

Ali al-Nimr is the nephew of Sheikh Nimr Baqir al-Nimr, a prominent Shi’a cleric from eastern Saudi Arabia who was sentenced to death in October 2014. Tensions between the Saudi Arabian authorities and the country’s Shi’a Muslim minority have increased since 2011 when, inspired in part by popular protests across the Middle East and North Africa, some citizens in the predominantly Shi’a Eastern Province stepped up calls for reforms.

Background

Since 2012, the Saudi Arabian authorities have been persecuting human rights defenders and dissidents with complete impunity, using both the courts and extrajudicial means such as the imposition of arbitrary travel bans.

In February 2014, the authorities put into force a new counter-terror law that has since then been used against human rights defenders and activists to sentence them to long prison terms and even to death.

Most trials of these activists have taken place at the SCC, whose jurisdiction is vague and proceedings shrouded in secrecy.

In addition to the above Shi’a activists, the SCC had also sentenced human rights defender and lawyer Waleed Abu al-Khair under the new counter-terror law. It also recently sentenced Abdulrahman al-Hamed, one of the founding members of the independent human rights organizations, the Saudi Civil and Political Rights Association (ACPRA), to nine years in prison on 13 October.
