투르크메니스탄: 아시안게임 앞두고 강제퇴거 실태 밝히는 위성사진 공개

투르크메니스탄에서 2017년 개최되는 실내 무술 아시안게임을 앞두고 수도 아슈하바트의 미관 개선 사업의 일환으로 약 5만 명 이상이 강제 퇴거됐다고 국제앰네스티가 28일 밝혔다. 국제앰네스티는 강제퇴거로 인한 파괴 규모를 나타내는 위성사진을 함께 공개했다.

국제앰네스티의 위성사진 분석 결과, 2015년 3월부터 4월 사이 아슈하바트 인근 초건리 마을에서 1가구당 평균 5인이 거주하던 주택 5,000가구가 파괴되었다. 이후 9월이 되자 1만 채 이상의 주택이 있었던 이 마을은 완전히 폐허가 되었고, 지금까지도 수도 곳곳에서 철거가 계속되며 수많은 주민들이 집을 잃게 된 것으로 밝혀졌다.

데니스 크리보셰프(Denis Krivosheev) 국제앰네스티 유럽중앙아시아 부국장은 “아시안게임 개최를 계기로 투르크메니스탄의 인권상황을 개선할 수 있는 기회를 얻었음에도, 정부는 교외에서 일자리를 찾아왔거나 이미 다른 곳에서 강제 퇴거된 사람들이 대부분인 이 지역 주민들의 생활 환경을 더욱 악화시키고 있을 뿐”이라며 “정부의 무자비한 퇴거 방식은 명백한 국제인권기준 위반이다. 투르크메니스탄 정부는 즉시 강제퇴거와 불법 철거를 중단하고, 피해 주민들에게 적절한 보상과 대체 주거지를 시급히 제공해야 한다. 특히 겨울이 다가오고 있는 지금이 가장 취약한 때”라고 말했다.

국제앰네스티가 분석한 위성사진은 세계에서 가장 어둠 속에 감춰져 있는 사회의 단면을 엿볼 수 있는 희귀한 자료다. 구르반굴리 베르디무하메도프 투르크메니스탄 대통령은 독재자였던 전임 대통령과 마찬가지로 공포 정치를 통해 국민의 숨통을 조이며 실권을 유지하고 있다. 감시가 만연하고 정부에 반대하는 의견을 거의 찾아볼 수 없는 투르크메니스탄에서는 자신과 주변인들의 안위를 위협하면서까지 감히 목소리를 내려는 사람은 거의 없다.

국제앰네스티를 비롯한 인권감시단체는 투르크메니스탄으로의 입국이 금지된 상태다. 그러나 조사관들의 노력으로 전화 인터뷰 및 신뢰성 있는 소식통을 통한 증언과 철거 현장이 담긴 위성 사진 등을 수집할 수 있었다. 퇴거당한 초건리 주민들은 당시 정부와 경찰이 “탱크처럼 들이닥쳐” 마을 사람들을 강제로 퇴거시켰다고 말했다.

한 마을 주민은 “이제 사람들은 그곳에 가서 오열만 할 뿐”이라며, 마을 사람들의 주택 허가는 무참히 무시당했고, 불도저로 밀린 옛 집 터로 돌아가 슬퍼하는 사람들도 있었다고 전했다. 이 주민은 철거 당시 정부 관계자들이 집에 들이닥쳐 가족들과 함께 당황한 아이들까지 모두 쫓아내던 모습이 아수라장과 다름 없었다고도 증언했다.

베르디무하네도프 대통령은 아시아 올림픽위원회에서 주관하는 이번 실내무술 아시안게임 개최를 앞두고 수도 아슈가바트를 현대화하기 위한 개발 계획 진행을 직접 감독하고 있다. 초건리와 쇼르 구역에 이어서 9월 아슈가바트의 다른 지역에서도 주택 철거가 이루어지는 등 강제퇴거는 조금도 변함없이 계속되고 있다.

베르디무하네도프 정권은 투르크메니스탄에 매장된 다량의 석유와 가스로 힘을 얻고 있으며, 이번 아시안게임 개최는 투르크메니스탄의 국제적인 입지를 더욱 개선시킬 기회로 여겨지고 있다. 국제앰네스티는 해외 각국 정부와 기업에 대해, 투르크메니스탄과의 모든 정치적 또는 경제적 협력사업이 전반적인 인권침해행위에 일조하지 않도록 할 것을 촉구한다.

데니스 크리보셰프 부국장은 “안타깝게도 투르크메니스탄에서 박해와 억압은 일상과도 같은 것이다. 국제사회와 기업체는 베르디무하메도프 대통령이 자국에서 자행하는 인권침해행위를 중단하라고 압박하기 위해 가능한 모든 조치를 취해야 할 것”이라며 “강제퇴거는 어떤 경우에도 정당화될 수 없다. 모든 퇴거는 언제나 최후의 수단으로, 국제인권기준에 따라서만 이루어져야 한다. 이러한 인권기준에는 주거권을 보호할 것과 적절한 법적 및 절차적 안전 조치에 따를 것, 이러한 퇴거 명령에 공포와 박해 없이 반대할 수 있는 권리를 보장할 것 등이 포함된다”고 말했다.

Turkmenistan: Satellite images reveal how mass forced evictions blight upcoming Asian Games

An estimated 50,000 or more people have been forcibly evicted from their homes as part of a push to “beautify” the capital of Turkmenistan ahead of the 2017 Asian Indoor and Martial Arts Games, Amnesty International revealed today as it published satellite images showing the extent of the devastation.

Amnesty International’s analysis of satellite images shows that 5,000 houses, each home to an average of five people, were destroyed in the Choganly neighbourhood near Ashgabat between March 2014 and April 2015. The organization has since learned that the entire neighbourhood – comprising more than 10,000 houses – was entirely razed to the ground by September and that fresh demolitions are continuing in other areas of the capital rendering many families homeless.

“Instead of using the Games as an opportunity to clean up Turkmenistan’s human rights record, local authorities there have only succeeded in worsening living conditions for residents, many of whom had moved to Ashgabat from the countryside in search of work or had already been evicted elsewhere,” said Denis Krivosheev, Amnesty International’s Deputy Programme Director for Europe and Central Asia.

“The ruthless way in which they have been evicted is in clear violation of international human rights standards. Turkmenistan’s government must immediately put an end to forced evictions and illegal demolitions, compensate the victims and give them access to adequate alternative housing urgently. They are especially vulnerable as winter approaches.”

Amnesty International analyzed satellite images that provide a rare glimpse into one of the world’s most darkly shrouded societies. President Gurbanguly Berdymukhamedov, like his autocratic predecessor, is at the helm of a government that maintains a stranglehold of fear on the population. Surveillance is rife and dissent is rare in Turkmenistan, where the few voices that do dare to speak up risk their own safety and that of their relatives.

Amnesty International and other human rights monitors are barred from the country. However, researchers corroborated details of the evictions depicted in the satellite imagery with testimony from phone interviews and other confidential sources. Former Choganly residents described how authorities, including the police, “burst in like tanks” and forcibly evicted dwellers.

“Now people go there to cry,” said one former Choganly resident, who described how their housing permits were brutally disregarded and some return to grieve on bulldozed plots where their homes once stood. She described to Amnesty International the scene of chaos her family faced when authorities charged into their house forcibly evicting the family, including distraught children.

President Berdymukhamedov has personally overseen the development projects in a bid to modernize Ashgabat ahead of the Games, organized by the Olympic Council of Asia. Following the demolitions in Choganly and the district of Shor, the forced evictions have continued unabated, with the authorities moving on in September to destroy homes in other areas of Ashgabat.

President Berdymukhamedov’s regime is bolstered by the country’s large oil and gas reserves, and the Games are regarded as an opportunity to improve its international standing. Amnesty International is calling on foreign governments and businesses to ensure that neither political nor economic cooperation with Turkmenistan contribute to human rights violations in general.

“Sadly, intimidation and repression is a daily fact of life in Turkmenistan. The international community and businesses must do everything within their power to press President Berdymukhamedov to put an end to the human rights violations perpetrated in the country,” said Denis Krivosheev.

“Forced evictions can never be justified. Any eviction must always be a last resort and in compliance with international human rights standards. This includes protecting the right to housing, ensuring compliance with appropriate legal and procedural safeguards and guaranteeing the right to oppose such evictions without fear and harassment.”

이란 정부가 16세일 때 저지른 범죄로 체포된 남성에게 사형을 집행했다. 이는 명백한 국제인권법 위반일 뿐만 아니라, 아동 권리를 완전히 무시하는 것이다.

‘아스카르(Asqar)’라는 이름으로만 언론에 공개된 이 남성은 약 30년 전 공개 교수형을 선고받았고, 2017년 5월 23일 테헤란 인근의 카라지 중앙 교도소에서 사형이 집행됐다.

이번 사형집행을 통해, 이란 정부가 유엔과 EU에 청소년 범죄자에 대한 사형 적용을 점진적으로 중단하겠다고 반복한 것이 참담한 거짓이었음이 드러났다.

루서 국장은 “이란에서 체포될 당시 어린이였던 사람을 처형한 것은 올해 들어 세 번째로, 이는 국제인권법을 개의치 않는 정부의 분명한 의지를 드러내는 것이다. 이란 정부는 향후 예정된 모든 사형집행 계획을 중단하고, 청소년 범죄자에 대한 사형 적용을 완전히 폐지하도록 이란의 이슬람형법을 개정해야 한다”고 밝혔다.

이란은 여전히 청소년 범죄자에게 사형을 집행하는 세계에서 몇 안 되는 국가 중 하나다. 국제인권법상 범죄 당시 18세 이하였던 사람에게 사형을 적용하는 것은 엄격히 금지되어 있다.

국제앰네스티는 피고의 신원과 범죄, 유죄 여부 또는 사형집행 방식에 관계없이 모든 경우에 대해 사형을 반대한다. 국제앰네스티는 모든 사형존치국에 대해 사형폐지를 목적으로 한 공식적인 사형집행 유예를 선포할 것을 지속적으로 촉구하고 있다.

언론 보도에 따르면 ‘아스카르’는 이웃에 살던 12세 어린이를 흉기로 찔러 1988년 사형을 선고받았고, 이후 대법원에서 형이 확정됐다. 아스카르는 18세에 사형이 집행될 예정이었으나 예정된 사형집행일 직전 탈옥해, 2015년 4월 다시 체포될 때까지 도피생활을 했다.

12월 5월 국회에서 열린 박근혜 최순실 게이트 진상규명을 위한 국회 국정조사 특위 2차 기관보고에서는 박흥렬 청와대 경호실장과 최재경 민정수석 등 3명이 출석을 거부했다. 지난 1차 보고에서 김수남 검찰총장이 출석하지 않은 데 이어 이번에도 국정조사 핵심 증인들이 출석을 거부한 것이다. 특히 박흥렬 청와대 경호실장은 세월호 참사 초기 대통령의 7시간 행적을 추궁할 핵심증인이다.

이에 대해 황영철 새누리당 의원은 “경호실장이 지금까지 지금까지 국회에 출석해 증언한 바가 없다면 우리 특위가 직접 청와대를 방문하여 증언을 청취하는 일정을 반드시 잡아야 한다.”고 말했다.

이번 주 6일과 7일로 예정된 1,2차 청문회의 핵심증인들도 출석여부가 명확하지 않은 상황이다. 특히, 우병우 청와대 전 민정수석과 그의 장모 김장자 씨, 홍기택 전 KDB 산업은행 회장 등 5인은 증인출석요구서가 송달되지 않아 증인으로 출석하지 않을 예정이다. 이에 대해 박범계 더불어민주당 의원은 “우병우 전 민정수석과 김장자 씨의 경우 청문회 4차에 반드시 증인으로 출석시켜야 한다”며 “동행명령장도 발부해야 한다”고 말했다.

여당 의원들도 정부 측 주요 증인들의 이러한 행태에 비판했다. 새누리당 장제원 의원은 “최순실 등이 청와대에 함부로 들어오고 나가고 하지 않았다는 것을 밝히기 위해서라도 청와대 출입에 관한 모든 기록은 필요하다”며 적극적으로 자료를 제출하는 것이 국민들을 납득시킬 수 있는 길이라고 주장했다.

향정신성 의약품에 대한 사용내역 등에 대한 청와대 측의 자료제출이 제대로 이뤄지지 않아 의원들이 현장에서 재차 자료제출을 요구하기도 했다. 특히 청와대의 탈모제 사용에 대해 의문을 제기한 박영선 더불어민주당 의원은 “발모제로 발급을 하면 의료보험의 혜택이 안되기 때문에 이게 굉장히 비싸다”며 “전립선 비대증인 것처럼 속여서 지금 청와대에서 발모제를 지금 누군가에게 지속적으로 줬다”고 의문을 제기했다.  

또 이번 청문회에서는 대통령의 세월호 7시간 동안 대통령의 행적에 대해 집중적인 추궁했다. 그러나 청와대는 “큰 오보가 났던 오후 2시 370명이 구조가 됐다는 중대본의 언론브리핑이 50분 후에 안보실에서 190명 추가 인원은 잘못된 것이라고 VIP께 유선으로 정정 보고를 했다”며 “그 직후 대통령께서 혼선에 대해 질책했고 정확히 통계를 재확인 하라는 지시가 있었다”고 보고 받았다고 주장했다.  

이런 가운데 새누리당의 이완영 간사를 비롯한 이만희 의원과 정유섭 의원은 1차 기관보고에 이어 2차 기관보고에서도 청와대 옹호에 급급한 모습을 보였다. 특히 정유섭 의원은 “세월호 사건에 대통령은 총체적인 책임은 있지만 직접적인 책임은 없다”며 “대통령은 7시간 동안 놀아도 될만큼 적절한 인사를 실시하는 게 중요하다”고 말해 여야의원간 고성이 오가기도 했다.

특히 이번 국정조사의 핵심인물인 최순실, 최순득, 장시호씨를 비롯해 정호성 전 비서관과 안종범 전 수석, 차은택 감독 등 핵심 인물들이 오는 7일 청문회 출석을 거부한 것으로 알졌다. 최순실 씨 등 민간인에 의한 국정농단을 파헤치겠다던 국회의 국정조사가 핵심 중의 핵심인 최순실 씨도 증인으로 세우지 못하는 청문회를 열 상황에 놓였다.

세계가 당면한 불평등 위기는 통제 불능인 악순환으로 빠지고 있다. 극심한 빈부격차 역시 한 국가만의 문제가 아닌, 전세계적으로 나타나는 현상이 되었다.

이러한 위기 속에, 더 나은 세상을 만들고자 하는 노력도 위협받고 있다. 불평등이 심화되면서 노동자의 임금수준과 근로환경은 악화되었고, 경제적인 격차가 커질수록 여성인권 수준은 제도적으로 더욱 추락했다. 세계 부유층의 압도적 대다수가 남성인 반면, 가장 불안정한 직장에서 낮은 임금을 받는 것은 여성이다. 청년들은 극심한 실업난에 빠져 있고, 이주민, 소수민족, LGBTQI, 장애인, 선주민들은 여전히 제도적인 차별에 시달리며 사회에서 소외되고 있다. 다수의 인권을 실현하고자 하는 노력은 이러한 부와 권력의 차이에 가로막혀 계속해서 힘을 잃어가고 있다.

정·재계 고위층이 자신들의 이익을 위해 야합하고 시민들의 공간과 민주적 권리를 더욱 심하게 탄압하면서 극심한 불평등으로 이어지는 경우도 빈번하다. 거의 세계 모든 지역에서 평화적 시위를 할 권리와 지배적인 경제 담론에 이의를 제기할 시민들의 목소리가 크게 제한되고 있다. 지배층은 극심한 불평등과 참여민주주의가 오랫동안 공존할 수 없음을 알고 있기 때문이다.

상위 1% 국가들의 탄소소비량이 하위 1% 국가들의 175배에 달하면서, 지구의 미래조차도 이러한 격차를 해소하는 것에 달려 있다.

현재의 경제체제는 제 역할을 다하지 못하고 있다. 시장이익에 대한 지나친 자만심에 사로잡혀 소수의 지배층에만 이용될 뿐, 대다수의 사람과 지구를 외면하고 있다. 현재 인류는 불평등의 위기 속에서 살아가고 있다는 것에 많은 사람이 동의한다. 국제통화기금(IMF)과 교황을 비롯한 영향력 있는 인사와 단체 역시 이에 동의한 바 있다. 이제는 행동에 나서야 할 때다. 현행 체제는 우연히 만들어진 것이 아니라, 의도적인 정책 결정의 산물이다. 지도자들이 대다수가 아닌 1%의 목소리에만 귀 기울였다는 결과다. 이제는 바뀌어야 한다.

국제사회가 지속 가능한 개발목표(Sustainable Development Goals, 아젠다 2030)를 채택하고, 경제 발전에 대한 논의와 함께 파리 기후변화협정(Climate Change Accord in Paris)을 통해 모든 국가가 기후변화에 맞서 함께 노력하는 데 동의하면서 이 모든 것이 실현될 수 있게 되었다.

우리는 투쟁 없이는 이미 했던 약속은 물론, 산적한 과제도 실현될 수 없다는 것을 알고있다. 따라서 우리는 불평등과 맞서기 위한 국제적 연대를 출범하기 위해 오늘 이 자리에 모였다.

우리는 경제, 정치, 사회, 문화계를 막론하고 불평등의 근본적인 원인을 해결하기 위해 함께 노력할 것이다. 정부를 압박해 탈세를 막고 진보적인 조세 및 지출 정책을 마련함으로써 국민이 건강권과 교육권 등 필수적인 공공서비스를 누릴 수 있도록 정부의 의무를 다하게 할 것이다. 노동자의 결사권과 단체교섭권을 지지하고, 빈부 격차를 줄이도록 노력할 것이다. 여성의 불평등한 가사노동 분담량을 재분배하고, 정부의 탄압과 근본주의 대두로 인한 여성폭력 문제를 해결하고자 노력할 것이다. 보편적인 사회보장제도를 지지할 것이다. 토지개혁 실현을 위해 투쟁할 것이다. 전 세계적으로 투쟁을 무산시키고, 인권침해를 저지르고, 불평등을 심화한 기업들의 부당한 권력과 관행에 맞서 함께 노력할 것이다. 기후정의 실현을 위해 함께 노력할 것이다. 인류와 지구를 보호하려는 노력을 저해하는 화석연료기업 등의 기업권력에 맞설 것이다. 모든 국가가 역할을 다하고 바닥으로의 경쟁(race to the bottom)을 피하도록 국제적 협력을 함께 지지할 것이다.

세계화 실패로 불평등과 갈등, 부패와 탄압만 남았다. 세계는 공익을 우선하는 새로운 경제모델 수립을 통해 근본적으로 변화해야 할 때다. 전례 없는 규모의 변화가 필요하다. 세계인들은 이러한 변화를 요구하고 만들어가는 핵심이 되어야 한다. 대중의 힘을 원동력으로 한 활동만이 정부와 노동조합, 시민사회, 기업을 하나로 모아 공익을 위해 협력할 수 있도록 돌파구를 마련할 수 있다.

우리는 모든 사람의 인권이 존중되고, 보호받고, 실현되는, 지금보다 더 나은 세상을 꿈꾸기를 선택했다. 다수의 이익을 우선하는 더 나은 세상을 만들만한 재능과 기술, 총명함이 인류에게는 있다고 믿는다. 또한, 언젠가 이를 위해 함께 맞서 싸울 때가 오리라 믿는다.

Civil society leaders issue statement to step up the fight on inequality

The world faces an inequality crisis that is spiralling out of control. Across the world we are seeing the gap between the richest and the rest reach extremes not seen in a century.

Struggles for a better world are all threatened by the inequality crisis. Workers across the world are seeing their wages and conditions eroded as inequality increases. The rights of women are systematically worse in situations of greater economic inequality. The vast majority of the world’s richest people are men; those in the most precarious and poorly paid work are women. Young people are facing a crisis of unemployment. Other groups such as migrants, ethnic minorities, LGBTQI people, people with disability and indigenous people continue to be pushed to the margins, suffering systematic discrimination. The struggle to realise the human rights of the majority are continually undercut in the face of such disparities of wealth and power.

Extreme inequality is also frequently linked to rising restrictions on civic space and democratic rights as political and economic elites collude to protect their interests. The right to peaceful protest and the ability of citizens to challenge the prevailing economic discourse is being curtailed almost everywhere, for elites know that extreme inequality and participatory democracy cannot co-exist for long.

Even the future of our planet is dependent on ending this great divide, with the carbon consumption of the 1% as much as 175 times that of the poorest.

Our current economic system is not working at many levels. Dominated by an over-confidence in the benefits of the market, it helps only a small elite, and is failing the majority, and failing the planet. There is widespread agreement that we are living through an inequality crisis. On this the IMF, the Pope and many other influential voices are agreed. The time has come to do something about it. The current system did not come about by accident. It is the result of deliberate policy choices. It is the result of our leaders listening to the 1% instead of to the majority. This has to change.

This is all happening at the time when the international community has agreed a new set of Sustainable Development Goals (Agenda 2030), and has come together to discuss financing development and crucially the Climate Change Accord in Paris where every country agreed to work together to combat climate change.

We know that existing commitments, and much more beyond that must be done, will not be realised without a fight. That is why today we are coming together as the beginnings of a global alliance to fight inequality.

We will work together with others to tackle the root causes of inequality, whether they be economic, political, social or cultural. We will press governments to meet their obligations to ensure people can enjoy their rights to health, education and other essential public services through tackling tax dodging and ensuring progressive tax and spend policies. We will support workers’ rights to freedom of association and collective bargaining, and narrow the gap between rich and poor. We will fight for the redistribution of women’s unequal share of unpaid care work, and the tackling of violence against women brought on by state repression and rising fundamentalism. We will advocate for universal social protection floors. We will fight for land reform. We will work together to challenge the disproportionate power and practices of the corporate sector that is undermining so many struggles, contributing to human rights violations and increasing inequality across the globe. We will work together with others to secure climate justice. We will take on the power of corporations, including fossil fuel companies who are undermining efforts which respond to science and protect people and planet. We will together champion international cooperation so every country plays its part and we avoid a race to the bottom.

The current face of failed globalisation is rising inequality, conflict, corruption and oppression. The world needs fundamental change through a new economic model that puts the interests of people first. We need change on a scale never seen before. People across the world must be at the heart of demanding and driving this change. Only such a people powered movement can build a breakthrough that unites governments, trade unions, civil society and companies who share a commitment to the common good.

We choose to imagine a better world than this, where everyone’s human rights are respected, protected and fulfilled. We believe humanity has the talent, technology, and brilliance to build that better world, where the interests of the majority are put first. And we believe the time has come to fight for it together.

보고서 <즐거운 나의 집? 심화되는 난민 위기 속 온두라스, 과테말라, 엘살바도르의 역할>에서는 해당 3국이 폭력으로부터 국민을 보호하지 못하고 있음은 물론, 멕시코와 미국 등의 국가에서 추방되어 목숨을 위협받는 상황으로 되돌아와야 하는 사람들에 대한 포괄적인 보호 대책도 마련하지 않고 있다고 분석했다.

기록을 깨는 폭력과 사건

과테말라와 온두라스의 살인율은 세계에서 가장 높은 수준이다.

유엔은 전쟁지역을 제외하고 세계에서 가장 사망자가 많은 국가로 엘살바도르를 꼽았다. 엘살바도르에서는 2015년 인구 10만명당 108건이 넘는 살인 사건이 발생했다.

인구 10만명당 살인률은 온두라스가 63.75, 과테말라는 34.9였다.

젊은이들이 가장 주된 피해자로, 2015년 3국에서 사망한 살인 피해자 중 절반 이상이 30세 이하였다.

어린 남자아이들은 협박에 못 이겨 범죄조직에 가담해야 하고, 여자아이들은 강제로 조직원들의 “여자친구”가 되어 성적 학대를 당하는 경우가 많다.

상점 주인과 버스 운전기사는 해당 지역을 통제하는 조직에게 주기적으로 갈취를 당하고 강제로 “세금”을 내야 한다. 엄격한 불문율을 따르지 않는 사람은 폭행을 당하거나 목숨을 잃기까지도 한다.

3국을 통틀어 많은 어린이들이 국제앰네스티와의 인터뷰를 통해, 범죄조직원들이 두려워서 학교를 그만둔 뒤 지금은 온종일 집에서만 시간을 보내야 한다고 말했다.

엘살바도르 교육부는 2015년 범죄조직의 괴롭힘이나 위협 때문에 학교를 그만둔 학생이 39,000명으로, 2014년 13,000명이었던 통계에 비해 3배 증가한 수치로 나타났다고 보고했다. 이에 대해 교원조합은 실제 수는 10만 명 이상일 것으로 본다고 밝혔다.

일부의 경우, 10대 청소년들이 정부 보안군에게 범죄조직 가담자로 몰려 괴롭힘과 공격을 당하기도 했다.

16세의 안드레스(가명)는 지난 5월 보안군에 체포된 이후 엘살바도르에 몸을 숨긴 채 살아가고 있다. 안드레스는 국제앰네스티와의 인터뷰에서, 총격전에 가담했고 범죄조직의 파수꾼임을 자백하라며 보안군에게 고문을 당했다고 말했다. 국내에서 충격적이리만치 만연한 수준인 폭력범죄에 대응하고자 노력하는 모습을 보여주고자하는 정부 관계자들의 필사적인 시도로 보인다.

안드레스는 군인들이 그의 입과 코에 물을 쏟고, 머리를 웅덩이에 집어넣고, 입 속에 모래를 넣거나, 배 위로 뛰어올라 발길질, 주먹질을 하고, 자백하지 않으면 죽이겠다며 위협했다고 진술했다.

안드레스의 어머니는 아들의 처우에 대해 정부에 항의했고, 이에 대한 조사가 진행 중이다.

보호받지 못 하는 사람들

현재 안드레스는 그를 고문한 사람들이 찾아올까 두려워하며 계속해서 이사를 다니고 있다. 또한 엘살바도르를 떠나기만 간절히 바라고 있다.

걷잡을 수 없이 계속되는 폭력으로 멕시코, 미국 등 국가에서 중앙아메리카인의 비호 신청이 급격히 증가해, 수십 년 전 중앙아메리카 내전 이후 사상 최고치를 기록했다.

유엔난민기구(UNHCR) 발표에 따르면 엘살바도르, 온두라스, 과테말라 3개국 출신인 비호 신청자 수는 5년 전보다 6배 이상 증가했고, 특히 주변국과 미국에서 더욱 두드러지게 나타났다.

그러나 많은 비호 신청자들이 망명이 허가되지 않을 경우 극심한 폭력과 사망에까지 직면할 수 있다는 강력한 증거가 있음에도, 멕시코와 미국 등에서 이루어지는 강제추방 건수는 증가하고 있다. 2015년 멕시코에서 추방된 과테말라, 온두라스, 엘살바도르인의 수는 2010년에 비해 약 180% 증가했다.

살해당할 수도 있는 모국으로 추방되다

사울의 경우는 이미 너무 늦었다. 다섯 아이를 둔 35세 아버지인 사울은 2016년 7월 멕시코에서 비호 신청이 거절되면서 모국인 온두라스로 되돌아온 후 3주도 지나지 않아 살해당했다.

범죄조직이 시장을 장악하면서 온두라스에서 가장 위험한 직업이 된 버스기사 일을 하던 사울은 총격전에서 두 아들과 가까스로 살아남은 후 2015년 11월 국경을 넘었다. 두 아들은 이로 인해 심각한 부상을 입었지만 경찰은 사울의 신고에 후속 조치를 취하지도 않았고, 그를 보호하지도 않았다.

국제앰네스티가 지난 7월 연락을 취했을 때, 사울은 “아마도 나한테 무슨 일이 다시 벌어질 것만 같다”는 말을 남겼다.

현재 사울의 아내와 아이들은 무슨 일이 벌어질지 두려움에 떨며 살고 있다.

엘살바도르, 온두라스, 과테말라의 정부 관계자들은 미국이 지원하는 ‘번영 계획’의 일환으로 배당된 미화 750달러를 생명의 위험에 처한 강제 추방자들을 돕기 위해 어떻게 사용할 것인지에 대해서는 확답을 하지 못했다. 이 계획은 이민자 유입을 막고 강제 추방자들을 보호하기 위해 이민의 근본적인 원인을 해결하는 것을 목표로 하고 있다.

엘살바도르, 온두라스, 과테말라는 강제추방자를 위한 공식 수용소를 마련했다. 이곳에서 추방자들은 짧은 면접을 거쳐야 하는데, 이민 담당자가 국경을 오가는 도중 겪은 인권침해가 있었는지를 묻는 식이다. 그러나 이들이 떠나게 된 이유인 모국에서의 폭력에 대해, 또는 보호 조치가 필요한지에 대해 묻는 경우는 거의 없었다.

살릴 셰티 사무총장은 “강제추방자를 위한 수용소 운영은 실 없는 농담 같다. 말끔한 건물에 따뜻한 식사와 환영 문구만으로는 그들을 기다리는 끔찍한 공포로부터 안전하게 지켜줄 수 없다”라며,

“그보다 필요한 것은 지원받은 국제 원조금을 투입해 이처럼 많은 사람들이 절박하게 모국을 떠나게 만드는 근본 원인을 해결할 수 있는 효과적인 지역규모 계획을 마련하는 것”이라고 말했다.

또한 “중앙아메리카 국가들이 자국의 충격적인 폭력 수준을 해결하지 않는 한, 중앙아메리카 지역은 최악의 암흑기로 퇴보할 위험에 놓여 있다. 국민들이 폭력을 피해 달아나고 있음을 완고히 부인하기보다, 위정자들은 그 해결책을 찾는 데 더욱 노력을 기울여야 할 것”이라고 밝혔다.

Central America turns its back on hundreds of thousands fleeing ‘war-like’ violence

Governments in Central America are fuelling a deepening refugee crisis by failing to tackle rampant violence and sky-high homicide rates in El Salvador, Guatemala and Honduras which are forcing hundreds of thousands to flee, Amnesty International said in a new report today.

Home Sweet Home? Honduras, Guatemala and El Salvador’s role in a deepening refugee crisis explores how the three countries are failing to protect people from violence, and also failing to set up a comprehensive protection plan for deportees forced by countries such as Mexico and the USA to return to life-threatening situations.

“El Salvador, Guatemala and Honduras have become virtual war zones where lives seem to be expendable and millions live in constant terror at what gang members or public security forces can do to them or their loved ones. These millions are now the protagonists in one of the world’s least visible refugee crises,” said Salil Shetty, Secretary General at Amnesty International.

“Although countries like Mexico and the USA are utterly failing to protect Central American asylum seekers and refugees, it is high time for authorities in El Salvador, Guatemala and Honduras to own up to their role in this crisis and take steps to tackle the problems that force these people to leave home in the first place.”

“Millions of Central Americans are falling through the cracks, victims of countries that do not fulfil their responsibility to provide the international protection they need, and of their own governments’ utter inability and unwillingness to keep them safe from the most tragic end.”

Record-breaking violence
Murder rates in Guatemala and Honduras are also among the highest on earth.

The United Nations has ranked El Salvador as one of the deadliest countries on earth outside of a war zone, with more than 108 homicides per 100,000 inhabitants in 2015.

In Honduras the rate was 63.75 and in Guatemala it was 34.99 per 100,000 inhabitants.

Young people are the hardest hit by violence, with more than half of those killed in the three countries in 2015 under 30 years of age.

Young boys often join the gangs under duress, while girls are forced to become gangsters’ “girlfriends” and are often sexually abused.

Shop owners and bus drivers are routinely extorted and forced to pay “taxes” to the gangs controlling their area. Those who fail to follow the strict unwritten rules of conduct are often abused or killed.

Many young children across the three countries told Amnesty International they had quit school for fear of gang members and now have to spend all day at home.

The Salvadoran Ministry of Education has been reported as saying that 39,000 students left school due to harassment or threats by gangs in 2015 – three times the figure in 2014 (13,000). The teachers’ union said they believed the real number could be more than 100,000.

In some cases, teenagers are harassed and attacked by the security forces, accused of being part of a gang.

Sixteen-year-old Andrés (not his real name) is living in hiding in El Salvador after being arrested in May by security forces. He told Amnesty International they tortured him to confess to participating in a shootout and being a lookout for gangs in what seems a desperate attempt to show officials are trying to tackle the shocking levels of violent crime in the country.

He said the soldiers poured bottles of water into his mouth and nose, put his head in a puddle, stuffed sand into his mouth, jumped on his stomach, then kicked, punched and threatened to kill him unless he confessed.

His mother complained to the authorities about her son’s treatment and an investigation has been opened.

Andrés is now constantly moving from house to house, afraid the men who abused him will find him, and is desperate to leave the country.

No protection

The relentless violence has led to a surge in asylum applications from Central American citizens in Mexico, the United States and other countries, reaching levels not seen since the region’s armed conflicts ended decades ago.

According to the United Nations Refugee Agency (UNHCR), the number of asylum applications from people coming from the three countries has increased more than six times in the past five years, particularly in neighbouring countries and in the United States.

But despite overwhelming evidence that many asylum-seekers face extreme violence and potentially death if they are not granted asylum, deportations from Mexico, the USA and elsewhere have increased. The number of Guatemalans, Hondurans and Salvadorans deported from Mexico increased by nearly 180% between 2010 and 2015.

Sent back home to be killed

For Saúl, it is too late. The 35-year-old father of five was murdered in his native Honduras less than three weeks after he was sent back home from Mexico in July 2016 when his asylum application was rejected.

A bus driver – one of the most dangerous professions in Honduras due to the control gangs assert over the industry – Saúl fled the country in November 2015 after he survived a shooting along with his two sons, who were severely injured. The police failed to follow up on his report or offer him protection.

When Amnesty International spoke to Saúl in July, his final words were, “I feel like something is going to happen again, maybe to me.”

His wife and sons are now living in terror of what might happen to them.

Government officials in El Salvador, Honduras and Guatemala were unable to confirm to Amnesty International how the US$750 million earmarked for the region as part of the US-backed Plan for Prosperity would be used to help deportees whose lives are at risk. The plan is aimed at tackling the root causes of migration as a way to stem the migrant flow and protect those who are deported back.

El Salvador, Honduras and Guatemala have set up official reception centres for deportees. Deportees have to go through a short interview where a migration official asks them about any abuse they might have suffered during the journey. They are rarely asked about the violence they were fleeing in their own countries and any needs for protection they might have.

“Reception programmes for deportees are a bad joke. A shiny building, a warm meal and a welcome banner will not keep these people safe from the horrors that await them back home,” said Salil Shetty.

“Instead, what we need to see is an effective region-wide initiative to invest the international aid they are receiving into tackling what causes so many people to desperately flee their homes.”

“Unless Central American leaders address the shocking current levels of violence in their countries, the region risks plunging back into its darkest times. Instead of stubbornly denying people are running away from violence, those in power should focus their efforts on trying to find solutions to it.”
