국제앰네스티의 조사에 따르면 리비아의 밀입국 경로를 따라 충격적인 수준의 인권침해가 벌어지고 있다는 사실이 드러났다. 국제앰네스티는 이탈리아 풀리아(Puglia)와 시칠리아(Sicily)의 난민 수용소에서 최소 90명 이상의 난민과 이주민을 만났고, 성폭력과 살인, 고문, 종교적 박해의 끔찍한 증언을 들었다. 이들은 지난 수 개월간 리비아에서 지중해를 통해 이탈리아 남부에 도착한 사람들로, 인신매매업자, 밀수업자, 범죄조직, 무장단체로부터 인권침해에 시달렸다.

난민과 이주민들은 무장단체에 납치되거나 수개월 동안 지하에 감금되어 성폭행을 당하고, 인신매매업자, 밀수업자, 범죄조직에 구타와 착취, 총격을 당하는 등 리비아에서 끔찍한 공포를 견뎌야 했다.

막달레나 무그라비(Magdalena Mughrabi) 국제앰네스티 중동북아프리카 부국장대행은 “난민과 이주민들은 무장단체에 납치되거나 수개월 동안 지하에 감금되어 성폭행을 당하고, 인신매매업자, 밀수업자, 범죄조직에 구타와 착취, 총격을 당하는 등 리비아에서 끔찍한 공포를 견뎌야 했다”며 “유럽으로 건너 온 사람들 대부분이 탈출해야만 했던 처참하고 절박한 환경을 보여준다”고 말했다.

대부분이 사하라 이남 아프리카 출신인 난민과 이주민 수만 명은 유럽에 정착할 수 있으리란 희망을 품고, 전쟁과 박해, 극심한 빈곤을 피해 리비아로 향하고 있다. 국제이주기구(IOM)는 현재 리비아에 26,4000명 이상의 난민과 이주민이 있는 것으로 추정하고 있다. 유엔난민기구(UNHCR)에 따르면 등록된 난민과 비호신청자만 약 37,500명으로, 이 중 절반이 시리아 난민이다.

막달레나 무그라비 부국장대행은 “비호를 신청하려는 사람들이 납치, 고문, 강간을 당하는 일은 일어나서는 안 된다. 국제사회는 애초에 난민들이 리비아로 도망쳐 올 필요가 없도록 최선을 다해야 한다. 유럽연합(EU)과 세계 모든 국가는 처음 떠난 이웃 국가에서 극심한 역경과 암담한 미래를 마주하는 취약한 난민들에게 제공할 재정착지와 인도주의적 비자의 수를 대폭 증가시켜야 한다”고 말했다.

유엔의 지원으로 리비아 통합정부가 구성됐지만, 여전히 리비아에서는 벵가지(Benghazi), 데르나(Derna), 시르테(Sirte) 등지에서 전투가 계속되고 있다.

막달레나 부국장 대행은 “리비아 정부는 법치주의를 회복하고 난민과 이주민의 권리를 보호하기 위해 시급히 조치를 취해야 한다. 국제사회의 지지로 구성된 통합정부는 인권을 존중하고 보호하겠다고 약속했으며, 이처럼 혐오스러운 범죄의 책임자를 처벌해야 할 의무가 있다.” 라고 덧붙였다.

여전히 무법과 폭력이 리비아를 잠식해 가고 있는 가운데, 리비아 남부에서 유럽행 보트가 출발하는 북부 지중해 해안까지의 경로를 따라 밀입국업자들이 성업하고 있다. 국제앰네스티가 인터뷰한 사람 중 20명 이상이 리비아의 해상경비대에게 또는 이주민 수용소에서 인권침해에 시달렸다고 전했다.

국제앰네스티와 이야기를 나눈 난민과 이주민들은 리비아에 도착해서부터 북부 해안에 이르기까지 여정의 모든 단계에서 인권침해에 직면했다고 진술했다. 리비아에 수년간 거주한 사람들도 지역 범죄조직과 경찰, 또는 무장단체의 괴롭힘이나 인권침해로 인해 탈출하고 싶어 했다.

국제앰네스티는 2015년 발표한 보고서 <잔혹뿐인 리비아(Libya is full of Cruelty, 영문)>를 통해 인신매매업자, 밀수업자, 무장단체의 인권침해를 기록했다. 그로부터 1년이 지난 후에도 난민과 이주민은 여전히 끔찍한 인권침해의 대상이 되고 있음이 증언을 통해 드러난다.

여정 내내 계속되는 공포

국제앰네스티가 인터뷰한 사람 중 대다수가 인신매매를 당한 경험이 있다고 전했다. 이들은 리비아에 도착하자마자 인신매매업자에게 붙잡히거나 범죄조직에 팔렸고, 붙잡힌 사람에게 구타, 강간, 고문, 착취를 당했다고 증언한 사람도 다수였다. 밀수꾼들이 사람들을 총살하는 모습을 목격하거나, 질병 또는 부당한 대우로 죽어가는 모습을 본 사람들도 있었다.

“리비아에 도착하는 순간 고난이 시작돼요. 그때부터 폭행하기 시작하죠.” 소말리아에서 온 18세 소년 아흐메드는 2015년 11월, 수단에서 사막을 건너 리비아에 이르기까지의 고된 여정에 대해 전했다. 함께 가던 시리아 남성들이 갈증에 시달리다 못해 물을 구걸하자, 밀수업자들은 벌이라면서 일부러 물을 주지 않거나 심지어는 총을 쏘기까지 했다고 한다.

“그러다 21살 정도로 보이는 젊은 시리아 남성이 숨을 거뒀어요. 그러고 나니 물을 주긴 했는데, 다른 시리아 남성도 죽고 말았어요. 19세밖에 되지 않았죠.” 아흐메드는 밀수업자들이 죽은 사람들의 소지품을 모두 압수하고, 시신을 매장할 시간도 주지 않았다고 덧붙였다.

에리트리아에서 온 24세 남성 파올로스는 수단과 차드를 거쳐 2016년 4월 리비아에 도착했다. 파올로스는 리비아 국경을 넘어 남부 도시인 사브하(Sabha)로 향하던 중, 밀수업자들이 장애인 남성을 사막 한가운데 버리고 갔다고 증언했다.

“그들이 한 남자를 [트럭 밖으로] 사막으로 집어 던지는 모습을 봤어요. 아직 살아 있었는데도요. 그 사람은 장애인이었어요.”

밀입국 과정에서 벌어지는 성폭력

국제앰네스티가 인터뷰한 여성 15명 중 대부분은 리비아 해안으로 향하는 도중 끊임없는 성폭력의 공포 속에서 살아야 했다고 말했다. 강간이 너무나 비일비재하다 보니 임신을 피하기 위해 길을 떠나기 전 미리 피임약을 먹었다고 말한 사람도 많았다. 국제앰네스티가 방문한 이탈리아 바리의 난민, 이주민 수용소 의료진은 다른 여성들도 같은 일을 겪었다고 확인했다. 국제앰네스티는 성폭력 생존자와 목격자 총 16명의 증언을 수집했다.

증언에 따르면 여성들은 인신매매업자, 밀수업자 또는 무장단체 소속원에게 성폭행을 당했다. 이들은 주로 밀입국 경로를 따라, 또는 여성들이 유럽행 보트를 타기 전 해안 근처의 민가 또는 버려진 창고에 갇혀있을 때를 노려 공격했다.

22세 에리트레아 여성은 다른 여성들이 성폭행을 당하는 모습을 목격했으며, 그중 한 명은 밀수업자가 돈을 내지 않았다고 누명을 씌우면서 집단 강간을 당했다고 전했다.

“다음에도 그 여자의 가족들은 돈을 주지 못했고, 그 사람은 결국 끌려가서 리비아 남자 5명에게 강간을 당했어요. 그들이 밤늦게 끌고 나가도 아무도 막지 못했어요. 다들 너무 겁에 질려 있었죠.”

에리트레아에서 온 22세 람야는 2015년 3월 리비아에 들어온 이후, 리비아 북동부 아지다비야(Ajdabya) 부근의 한 수용소에 잡혀 있는 동안 인신매매업자들에게 한 번 이상 강간을 당했다고 말했다.

여자들은 거부하려고 했지만, 머리에 총이 겨눠진 상태에서는 살고 싶으면 어쩔 수가 없죠. 저는 남자 3명에게 두 번 강간을 당했어요. 죽고 싶지는 않았거든요.

“경비들은 술을 마시고 하시시[대마초]를 피우고 들어와서 원하는 여자를 골라 끌고 나갔어요. 여자들은 거부하려고 했지만, 머리에 총이 겨눠진 상태에서는 살고 싶으면 어쩔 수가 없죠. 저는 남자 3명에게 두 번 강간을 당했어요. 죽고 싶지는 않았거든요.”

28세 카메룬 여성 앙투아네트는 2016년 4월, 자신을 붙잡고 있던 인신매매업자들에 대해 이렇게 말했다. “그 사람들은 여자든 아이든 신경 쓰지 않아요. 몽둥이를 [구타하는 데] 쓰고, 공중에 총을 쐈어요. 나는 아이가 있었기 때문에 강간하지 않았던 건지도 모르지만, 그들은 임신부와 혼자 있는 여자들을 성폭행했어요. 직접 목격했죠.”

납치, 착취, 갈취

많은 사람이 밀수업자들이 자신을 인질로 잡고 가족에게 몸값을 요구했다고 말했다. 이들은 인질을 처참한 환경에 가둬 두고, 음식과 물도 주지 않은 채 폭행과 괴롭힘, 욕설을 일삼았다.

에리트레아에서 온 22세 셈레는 몸값을 이유로 잡혀 있는 동안 14세 소년과 22세 여성 등 4명이 질병과 굶주림으로 목숨을 잃는 것을 봤다고 말했다.

“아무도 병원으로 데려가는 사람이 없어서 우리가 직접 시신을 묻어 줘야 했어요.” 셈레의 아버지가 결국 몸값을 지급했음에도 인신매매업자들은 셈레를 풀어 주는 대신 다른 범죄조직에 팔아넘겼다.

다른 사람들도 붙잡혀 있는 동안 계속해서 폭행을 당하고, 돈을 내지 못하는 사람들은 몸값 대신 무임금으로 노동해야 했다고 진술했다.

에리트레아에서 온 23세 남성 압둘라는 인신매매업자가 돈을 요구하며 고문과 구타를 일삼았고, 특히 가족들에게 몸값을 내도록 압박할 때 폭력은 더욱 심했다고 말했다.

에리트레아 출신의 20세 살레는 2015년 10월 리비아에 들어오자마자 인신매매업자들이 관리하는 바니왈리드(Bani Walid)의 한 창고로 끌려갔다. 이곳에 열흘간 갇혀 있는 동안 살레는 돈을 내지 못한 한 남성이 물속에서 전기고문을 당하고 목숨을 잃는 모습을 목격했다. “그들은 돈을 못 내는 사람은 누구나 이렇게 될 거라고 말했어요.”

살레는 탈출에 성공했지만, 결국 사브라타(Sabratah)의 해안가에 위치한 또 다른 인신매매 수용소에 갇히게 됐다.

“무슨 일인지 영문을 몰랐어요. 그들은 우리 가족이 돈을 낼 때까지 우리를 가둬 둘 거라고 말했어요. 우리를 감시하는 사람들은 집안일이나 청소, 무슨 일이든 보수 없이 강제로 일을 시켰어요. 제대로 된 음식은 주지 않았고, 물조차도 짠맛이 났어요. 제대로 된 화장실도 없어서 피부병이 난 사람들이 많았어요. 업자들은 대마를 피우고 총이나 쇠막대기, 돌멩이 등 무엇이든 잡히는 대로 들고 우리를 구타했어요. 인정이라곤 없는 사람들이었죠.” 라고 살레가 덧붙였다.

무장단체에 의한 성폭력과 종교적 박해

최근 수년간 자칭 이슬람국가(IS)에 충성을 맹세하고 자의적으로 해석한 이슬람 율법을 적용하려 하는 강력한 무장단체들이 떠오르며 외국인, 특히 기독교도들은 인권침해와 잠재적 전쟁범죄에 휘말릴 위험이 더욱 증가했다. 국제앰네스티는 몇 달씩 IS에 납치되었다는 사람들과 만나볼 수 있었다.

21세 에리트레아 여성 아말은 2015년 7월 리비아의 수도 트리폴리(Tripoli)로 향하던 71명이 벵가지(Benghazi) 근방에서 IS로 추정되는 무장단체에 모두 납치되었다고 전했다.

“그들이 밀수업자에게 왜 기독교도들을 도와주고 있냐고 물었어요. 업자가 기독교도들인 줄 몰랐던 척을 하자 그 사람은 그냥 보내줬죠. 그들은 우리를 기독교도과 무슬림으로 나누고, 다시 남자와 여자로 나눴어요. [기독교도들은] 트리폴리로 끌려갔고, 에리트레아에서 온 여자 11명은 지하에 갇혀 9개월간 햇빛을 볼 수 없었어요.”

“3일 동안 아무것도 먹지 못할 때도 있었어요. 하루에 한 끼로 빵 반 조각을 줄 때도 있었고요. 총을 들이대거나, 칼로 베어 버리겠다고 위협할 때도 있었어요.”

아말은 무장단체 소속원이 자신들에게 이슬람으로 개종할 것을 강요하고, 거부할 경우 호스나 몽둥이로 구타했다고 말했다.

여성들은 결국 굴복하고 개종에 동의했지만, 그 이후부터는 성폭행에 시달렸다고 한다. 남성들은 이들을 “부인”이라며 성노예처럼 대우했다. 아말은 여러 남성에게 강간당한 뒤 한 남성에게 맡겨졌고, 이 남성 역시 강간했다고 말했다.

또 다른 사례로 28세의 에티오피아 남성 아담은 벵가지에서 아내와 함께 살고 있었으나 2015년 단지 기독교도이라는 이유만으로 IS에 납치되었다.

“그들은 나를 한 달 반 동안 감옥에 가뒀어요. 내가 가족이 있다고 말했더니 그중 한 명이 나를 불쌍하게 여기고, 그들이 풀어줄지도 모르니 코란을 외울 수 있게 도와줬어요. 많은 사람이 죽었어요.” 아담은 결국 붙잡힌 지 7개월 만에 탈출할 수 있었다.

IS는 2015년 2월과 3월 세 번에 걸쳐 콥트교도 49명을 처형한 것이 자신들의 소행이라고 주장했다.

통합정부는 자국군과 동맹 민병대에 의한 인권침해를 중단해야 한다. 또한, 무장단체를 포함해 누구도 면죄부를 가지고 전쟁범죄를 비롯한 중대한 인권침해를 계속해서 저지를 수 없도록 반드시 보장해야 한다

막달레나 무그라비 부국장대행은 “경쟁 관계에 있는 무장단체와 민병대가 증가하고 무법상태가 만연하면서 리비아의 난민과 이주민이 처한 위험은 더욱 증가하고 있다. 통합정부(The Government of National Accord)는 자국군과 동맹 민병대에 의한 인권침해를 중단해야 한다. 또한, 무장단체를 포함해 누구도 면죄부를 가지고 전쟁범죄를 비롯한 중대한 인권침해를 계속해서 저지를 수 없도록 반드시 보장해야 한다”며 “국제사회 역시 리비아의 전쟁범죄와 반인도적 범죄를 조사할 사법권이 있는 국제형사재판소(ICC)를 지원해야 한다. 또한, 분쟁의 모든 당사자는 국제형사재판소의 조사에 협조해야 한다”고 강조했다.

리비아의 외국인들은 무장단체의 계속되는 위협뿐만 아니라, 여전히 적대적인 여론으로 인해 만연한 인종차별과 외국인혐오에도 직면하고 있다. 인터뷰한 난민과 이주민 중 다수가 신체적 폭행을 당하고, 칼이나 총으로 위협을 받거나, 총구가 겨눠진 채로 소지품을 빼앗기고, 거리에서 범죄조직에 구타를 당한 적이 있다고 말했다.

바다 위 생명을 구하라

6월 28일 유럽위원회는 지중해 중부의 해군작전인 ‘소피아 작전(Operation Sophia)’을 향후 수년간 더 연장하고, 밀입국 업자를 단속하는 기본 기능을 유지한 상태로 리비아 해안경비대와의 훈련과 정보 공유 및 리비아의 무기금수조치 시행여부 감시 임무를 추가하기로 한 결정을 승인했다.

막달레나 부국장대행은 “EU는 이주민과 난민을 쫓아내기보다 리비아에 갇힌 이들이 안전한 장소로 갈 수 있도록 안전하고 합법적인 방법을 모색하는 데 더욱 집중해야 할 것이다. 생명을 구하는 것이 최우선이 되어야 하며, 이를 위해서는 향후의 비극을 막기 위해 알맞은 장소에 충분한 자원을 배치해야 한다”며 “EU는 밀입국 업자들의 인권침해 문제를 해결해야 하지만, 난민들을 생명과 인권이 명백히 위태로운 국가에 가두려 해서도 안 된다”고 말했다.

국제이주기구에 따르면, 리비아에서 머물고 있는 외국인은 대부분 니제르, 이집트, 차드, 가나, 수단 출신이다. 리비아를 거쳐 보트를 타고 이탈리아로 향하는 난민 중 대다수는 에리트레아, 나이지리아, 감비아, 소말리아, 코트디부아르 출신이다. 서아프리카 출신 난민들이 리비아로 들어오는 주요 거점은 리비아 남서부의 도시 사브하(Sabha)다. 소말리아, 에리트레아, 에티오피아에서 수단을 거쳐 온 사람들은 쿠프라(Kufra)를 통해 들어온 후 리비아 북동부의 아지다비야(Ajdabiya)로 향한다. 유럽으로 향하는 보트 대부분은 리비아 북서쪽에서 출항한다. 출항하기 전, 외국인들은 더 많은 사람이 모일 때까지 민가나 농장에 갇혀 있다.

국제앰네스티가 기록한 리비아의 난민과 이주민에 대한 인권침해 중 일부는 인신매매에 해당한다. 인신매매는 인권침해일 뿐만 아니라 대부분 국가에서 형법상 범죄로 규정되어 있으며, 납치, 사기, 속임수 등 위협과 무력행사 또는 강요를 통해 사람을 인도하는 것을 포함한다. 인신매매를 막고 책임자를 기소해 재판을 받게 하는 것은 국제인권법상 의무다. 반면 밀입국은 강제성이 포함되지 않으며, 서로 합의된 일이다. 밀입국에는 형사범죄가 동반될 수 있지만, 그 자체로 인권침해가 되지는 않는다.

Refugees and migrants fleeing sexual violence, abuse and exploitation in Libya

Horrifying accounts of sexual violence, killings, torture and religious persecution collected by Amnesty International reveal the shocking range of abuses along the smuggling routes to and through Libya. The organization spoke to at least 90 refugees and migrants at reception centres in Puglia and Sicily, who had made the journey across the Mediterranean from Libya to southern Italy in the past few months, and who were abused by people smugglers, traffickers, organized criminal gangs and armed groups.

“From being abducted, incarcerated underground for months and sexually abused by members of armed groups, to being beaten, exploited or shot at by people smugglers, traffickers or criminal gangs – refugees and migrants have described in harrowing detail the horrors they were forced to endure in Libya,” said Magdalena Mughrabi, Interim Deputy Director of the Middle East and North Africa Programme at Amnesty International.

“Their experiences paint a terrifying picture of the conditions many of those who come to Europe are so desperate to escape.”

Hundreds of thousands of refugees and migrants – mostly from Sub-Saharan Africa – travel to Libya fleeing war, persecution or extreme poverty, often in the hope of settling in Europe. The International Organization for Migration (IOM) estimates there are over 264,000 migrants and refugees currently in Libya. According to UNHCR, there are around 37,500 registered refugees and asylum-seekers, half of them Syrians.

“No one should have to face abduction, torture and rape in Libya to seek protection. The international community should be doing their utmost to ensure refugees do not need to flee to Libya in the first place. The EU, and indeed governments around the world, should dramatically increase the number of resettlement places and humanitarian visas to vulnerable refugees facing severe hardships and few prospects in the neighbouring countries they first fled to,” said Magdalena Mughrabi.

Despite the formation of a UN-backed Government of National Accord fighting continues in parts of Libya including in Benghazi, Derna and Sirte. “The Libyan authorities must take urgent steps to restore the rule of law and protect the rights of refugees and migrants. The internationally-backed Government of National Accord has made commitments to respect and uphold human rights – they have a duty to hold those responsible for these abhorrent crimes accountable.” Amidst the lawlessness and violence that continue to plague the country, a lucrative people-smuggling business has been established along routes running from southern Libya to the Mediterranean coast in the north where boats bound for Europe depart. At least 20 of the people Amnesty International spoke to also described abuses suffered at the hands of the Libyan coastguard and in immigration detention centres inside Libya.

Amnesty International spoke to refugees and migrants who described facing abuse at every stage of the journey, from their arrival in Libya until they reached the northern sea coast. Others had lived in Libya for years but wanted to escape because of harassment or abuse by local gangs, police or armed groups. Amnesty International documented abuses by smugglers, traffickers and armed groups in Libya in its 2015 report Libya is full of Cruelty. The latest testimonies show that one year on, refugees and migrants continue to be subjected to horrifying abuse.

Horrors along the journey

The majority of people Amnesty International spoke to reported being victims of human trafficking. They were held by smugglers as soon as they entered Libya or sold on to criminal gangs. Several described being beaten, raped, tortured, or exploited by those who held them captive. Some witnessed people being shot dead by smugglers, others saw people left to die as a result of illness or ill-treatment.

“When you [arrive in] Libya, that’s when the struggle starts. That’s when they start to beat you,” said Ahmed, an 18-year-old from Somalia describing his arduous journey through the desert from Sudan to Libya in November 2015. He said the smugglers refused to give them water as punishment and even shot at them when they begged for water for a group of Syrian men travelling with them who were gasping with thirst.

“The first Syrian died, he was young, maybe 21 years old. After this they gave us water, but the other Syrian man also died…he was only 19,” he said, adding that the smugglers seized the belongings of the dead men and did not allow them time to bury them.

Paolos, a 24-year-old Eritrean man who travelled through Sudan and Chad and arrived in Libya in April 2016, told how the smugglers abandoned a disabled man in the desert along the way, as they crossed the Libyan border heading to the southern town of Sabha.

“We saw them throw one man [out of the pick-up truck] into the desert. He was still alive. He was a disabled man,” he said.

Sexual violence along the smuggling route

Amnesty International spoke to 15 women most of whom said they lived in perpetual fear of sexual violence along the journey to the Libyan coast. Many said rape was so commonplace that they took contraceptive pills before travelling to avoid becoming pregnant as a result of it. Medical staff as well as psychologists and social workers in three reception centres visited by Amnesty International in Sicily and Puglia confirmed that women reported a high level of sexual violence during the journey. At the reception centre in Bari, staff also confirmed that many migrant and refugee women were taking contraception ahead of the journey out of fear of rape. In total, Amnesty International collected 16 accounts of sexual violence from survivors and eyewitnesses.

According to testimonies, women were sexually assaulted either by the smugglers themselves, traffickers or members of armed groups. Attacks took place along the smuggling route and while women were being held in private homes or abandoned warehouses near the coast waiting to board boats to Europe.

A 22-year-old Eritrean woman told Amnesty International that she witnessed other women being sexually abused, including one who was gang-raped because the smuggler wrongly accused her of failing to pay his fee. “Her family couldn’t pay the money again. They took her away and she was raped by five Libyan men. They took her out late at night, no one opposed it, everyone was too afraid,” she said.

Ramya, 22, from Eritrea said she was raped more than once by the traffickers who held her captive in a camp near Ajdabya, in northeastern Libya after she entered the country in March 2015. “The guards would drink and smoke hashish [cannabis] and then come in and choose which women they wanted and take them outside. The women tried to refuse but when you have a gun pointed at your head, you don’t really have a choice if you want to survive. I was raped twice by three men…I didn’t want to lose my life,” she said.

Antoinette, a 28-year-old woman from Cameroon said of the traffickers who held her captive in April 2016: “They don’t care if you’re a woman or a child…They used sticks [to beat us] and would shoot in the air. Maybe because I had a child they didn’t rape me but they raped pregnant women and single women. I saw this happen.”

Abducted, exploited and extorted

Many said the smugglers held them captive to extort a ransom from their families. They kept them in deplorable and often squalid conditions, deprived them of food and water and would beat, harass and insult them constantly.

Semre, 22, from Eritrea, said he saw four people including a 14-year-old boy and a 22-year-old woman die from illness and starvation while he was held captive for ransom. “No one took them to the hospital so we had to bury them ourselves,” he said. His father eventually paid the traffickers in exchange for Semre’s freedom but instead of releasing him they sold him on to another criminal group.

Others recounted how they were repeatedly beaten by those who held them captive and those who could not pay were forced to work for free to pay off the debt.

Abdulla, a 23-year-old Eritrean man, said the traffickers would torture and beat people to force them to pay, particularly while forcing them to speak to their families to pressure them into paying. Saleh, 20, from Eritrea, entered Libya in October 2015 and was immediately taken to a storage hangar in Bani Walid run by traffickers. During the 10 days he was held there, he witnessed how one man who couldn’t pay dying after being electrocuted in water. “They said that if anyone else couldn’t pay, their fate would be the same,” he said. Saleh escaped but eventually ended up at another camp run by traffickers in Sabratah, close to the sea. He said: “We didn’t know what was happening…They said they would keep us there until our family was able to pay…The people in control forced us to work for free, in houses, to clean, any jobs. They didn’t give us proper food. Even the water they gave us was salty. There were no proper bathrooms. Many of us got skin problems. The men would smoke hashish and would beat you with their guns and anything they could find. They used metal, rocks. They had no heart.”

Sexual abuse and religious persecution by armed groups

The rise of powerful armed groups in recent years, including some which have pledged allegiance to the armed group calling itself Islamic State (IS) and aim at imposing their own interpretation of Islamic Law, has put foreign nationals – particularly Christians – at an increased risk of abuse and potential war crimes. Amnesty International spoke to people who said they were abducted by IS for several months.

Amal, a 21-year-old Eritrean woman, described how the group of 71 people she was travelling with was abducted by an armed group they believed to be IS near Benghazi while they were on their way to Tripoli in July 2015. “They asked the smuggler why he was helping Christians. He pretended that he didn’t know we were Christians so they let him go. They separated us into Christians and Muslims and then they separated the men and women. They took [the Christians] to Tripoli and kept us underground – we didn’t see the sun for nine months. We were 11 women from Eritrea,” she said. “Sometimes we didn’t eat for three days. Other times they would give us one meal a day, half a piece of bread.”

She also described how they were pressured into converting to Islam and beaten with hoses or sticks when they refused. “Sometimes they would frighten us with their guns, or threaten to slaughter us with their knives,” she said. When the women finally succumbed and agreed to convert, she said they suffered sexual violence. The men considered them their “wives” and treated them as sexual slaves. She said she was raped by different men before being assigned to one man who also raped her.

In another case, in 2015 Adam, 28, a man from Ethiopia living in Benghazi with his wife, was abducted by IS simply because he was a Christian. “They kept me in a prison for one and half months. Then one of them felt sorry for me after I told him I have a family and he helped me memorize the Quran so they would let me go…They killed many people,” he said. He was eventually able to escape after seven months in captivity.

The IS claimed responsibility for the summary killings of 49 Copts in three separate incidents in February and March 2015. “The lawlessness and proliferation of rival armed groups and militias increases the risks faced by refugees and migrants in Libya. The Government of National Accord must put a halt to abuses by its own forces and allied militias. And it must ensure that no one, including members of armed groups, can continue to commit serious abuses, including possible war crimes, with impunity,” said Magdalena Mughrabi. “The international community must also support the International Criminal Court, which continues to have jurisdiction over Libya, to investigate war crimes and crimes against humanity. And all parties to the conflict should cooperate with the ICC investigation.” As well as the persistent threat from armed groups, foreign nationals in Libya also face widespread racism and xenophobia as public sentiment remains hostile. Many refugees and migrants interviewed reported being physically assaulted, threatened with knives and guns or robbed of their possessions at gunpoint or beaten on the streets by criminal gangs.

Saving lives at sea

On 28 June the European Council endorsed a decision to extend Operation Sophia, the naval operation in the central Mediterranean, for a further year, maintaining its primary function of tackling smugglers and adding to its tasks training of and information sharing with the Libyan coastguard as well as monitoring the implementation of the arms embargo on Libya. “The EU should focus less on keeping migrants and refugees out and more on finding safe and legal ways for those trapped in Libya to access a place of safety. The priority should be saving lives, this means deploying enough resources in the right places to prevent further tragedy,” said Magdalena Mughrabi. “The EU should be tackling abuses by smugglers but should not be seeking to trap people in a country where their lives and rights are so obviously at risk.”

According to IOM, most foreign nationals residing in Libya originate from Niger, Egypt, Chad, Ghana and Sudan. The majority of those transiting through the country and then crossing to Italy by boat are from Eritrea, Nigeria, Gambia, Somalia and Côte d’Ivoire. The main transit point for people from West Africa entering Libya is the south-western city of Sabha. Those entering via Sudan from Somalia, Eritrea and Ethiopia come through Kufra, and then travel onto Ajdabiya in the north eastern part of the country. Most boats heading to Europe depart from north-western Libya. Before departure, foreign nationals are held in houses and farms until more people are gathered for the journey.

Some of the abuses documented by Amnesty International against refugees and migrants in Libya amount to human trafficking. Trafficking people constitutes a human rights abuse as well as being a crime in most national criminal law systems. It includes the transfer of persons through threat, the use of force or coercion such as abduction, fraud or deception. Its disruption and prosecution with the end of bringing perpetrators to justice is an obligation under international human rights law. By contrast, smuggling does not involve coercion; it is consensual. While smuggling can involve the commission of criminal offences, it is not in itself a human rights abuse.

Turkey: G20 leaders must show statesmanship in the wake of Paris

World leaders must show true statesmanship and avoid resorting to a knee-jerk anti-refugee agenda in the wake of the despicable attacks in Paris, urged Amnesty International today.

We have to remember that many of those trying to gain sanctuary have fled violence, fear and conflict, and indeed often by the very same group known as the Islamic State in both Syria and Iraq.

“The tragic events in Paris have sickened and stunned the world and our hearts and thoughts go out to all those affected by this atrocious attack. The threat of terrorism must always be responded to resolutely, with the utmost regard for security and respect for human rights,” said John Dalhuisen, Amnesty International’s Director of Europe and Central Asia.

“Now is also the time for world leaders to show true statesmanship and refuse to bow to the conflated anti-refugee rhetoric which is already emanating from some quarters. ‘가자 플랫폼’은 각각의 공격이 벌어졌던 시간과 장소를 인터랙티브 지도에 기록하고, 공격의 유형, 폭격 지점, 사상자 수 등의 다양한 기준에 따라 분류해 패턴을 도출한다. 가능할 경우 사진, 영상, 목격자 증언, 위성사진 등의 자료 역시 포함된다. 데이터 시각화 및 디지털 매핑의 신기술을 이용해 사용자들은 이러한 정보를 열람하고 검색해 가자지구 분쟁 중 이스라엘군이 가한 공격의 패턴을 파악할 수 있다. 특정 공격 사례가 전쟁범죄 등 국제인도법 위반에 해당하는지 여부를 분석하는 데 도움이 될 수 있도록 공격 양상을 파악하고 공개하는 것이 이 프로그램의 목적이다.

가자지구 기반 인권단체인 알 메잔(Al Mezan)과 팔레스타인 인권센터(PCHR)와 함께 국제앰네스티가 현지에서 직접 수집한 ‘가자 플랫폼’의 데이터를 분석하고 입력하기 위해 런던과 가자의 조사팀이 수 개월 동안 최선을 다했다.

‘가자 플랫폼’의 발표는 이번 프로젝트의 시작에 불과하다. 가자지구 분쟁과 관련해 더욱 많은 증거를 확보하기 위한 노력은 계속될 것이며, 이에 따라 플랫폼 역시 새로운 정보로 업데이트될 예정이다.

이스라엘군의 인권침해 양상

증언, 사진, 영상, 위성사진 등 방대한 양의 멀티미디어 정보는 여전히 분석 중인 반면, 가자 플랫폼은 현재 2014년 분쟁 당시 이스라엘군이 포탄을 이용해 270건 이상의 공격을 가했고, 민간인 320명 이상이 숨졌음을 보여주고 있다. 표적 없는 폭발무기인 포탄을 인구가 밀집한 민간 지역에 반복적으로 이용한 것은 무차별 공격에 해당하며, 이는 전쟁범죄로 조사되어야 한다.

가자 플랫폼은 또한 이스라엘군이 1,200건 이상 민간 주택을 표적으로 공격해 민간인 1,100명 이상을 숨지게 하는 등 충격적인 공격 패턴을 나타냈음을 명백히 보여준다. 적군에 직접적으로 관여하지 않은 민간인과 민간 대상을 직접 공격하는 것은 국제인도법 또는 “전쟁법”상 금지하고 있다. 국제앰네스티와 유엔 조사위원회 및 그 외의 분쟁감시기구들은 이러한 민간 대상 공격이 2014년 분쟁 중 높은 빈도로 나타난 것에 대해 경고한 바 있다.

이얄 바이츠만(Eyal Weizman) 포렌식 아키텍처 국장은 “분쟁이 시작된 지 1년이 지난 후인 오늘 ‘가자 플랫폼’을 발표하게 된 것은, 지난해 가자지구 분쟁 중 이루어진 인권침해를 전면 기록하는 과정에 있어 중요한 진전이다. 또한 개인과 단체들이 분쟁 중 직접 경험하거나 기록한 공격 사례에 대해 사진, 증언 등 더 많은 증거를 보내줄 것을 촉구하는 것이기도 하다”고 말했다.

디지털 시대로 지난해 가자 분쟁과 같은 인권위기 상황에서 입수하는 정보의 속도와 입수 수단이 급격히 증가하게 되었다. 다양한 매체로 남은 증거들이 사후에 어떤 일이 벌어졌는지를 확인하는 데 중요한 역할을 수행하는 경우도 많다. 가자 플랫폼은 다양한 형태의 정보를 분석하고 상호 참조하는 데 효율적이고 새로운 방식을 제공하고 있다.

포렌식 아키텍처의 조사원이자 가자플랫품 프로젝트 담당자인 프란세스코 세브레곤디(Francesco Sebregondi)는 “가자 플랫폼은 최근의 가자지구 분쟁과 같이 복잡한 사건을 해결할 수 있는 새로운 디지털 도구의 힘을 보여준다. 사용자는 이를 통해 각각의 사건들 사이의 연관성을 밝혀냄으로써, 규모를 넘나들며 각 사례별 자세한 세부사항부터 분쟁의 전체적인 상황까지 파악할 수 있다”며 “이번 프로젝트는 현지 증인과 단체, 전세계 사람들 간의 정보 공유를 가능하게 하는 공동 플랫폼을 통해 더욱 효과적으로 분쟁 감시를 수행하기 위한 첫걸음을 내디딘 것”이라고 말했다.

포렌식 아키텍처는 런던대학교 골드스미스대학 기반의 연구프로젝트 및 자문단체다.

Launch of innovative digital tool to help expose patterns of Israeli violations in Gaza

An investigative online tool mapping Israeli attacks in Gaza during the conflict of July and August 2014 has been unveiled by Amnesty International and Forensic Architecture today. Its purpose is to help push for accountability for war crimes and other violations of international humanitarian law.

The Gaza Platform enables the user to explore and analyse data about Israel’s 2014 military operation in Gaza. The preliminary data currently plotted on the Platform, which will be updated over the coming months, already highlights a number of patterns in the attacks by Israeli forces that indicate that grave and systemic violations were committed.

“The Gaza Platform is the most comprehensive record of attacks during the 2014 conflict to date. It allows us to piece together more than 2,500 individual attacks, illustrating the vast scale of destruction caused by Israel’s military operations in Gaza during the 50-day war last summer,” said Philip Luther, Director of Amnesty International’s Middle East and North Africa Programme.

“By revealing patterns rather than just presenting a series of individual attacks, the Gaza Platform has the potential to expose the systematic nature of Israeli violations committed during the conflict. Our aim is for it to become an invaluable resource for human rights investigators pushing for accountability for violations committed during the conflict.”

How the Gaza Platform works

The Platform records the time and location of each attack on an interactive map and classifies it according to numerous criteria including type of attack, site struck and number of casualties to highlight patterns. Photos, videos, eyewitness testimony and satellite imagery for attacks are also included where available. With the help of new data visualization and digital mapping technology, users can view and search this information to detect patterns in the Israeli forces’ conduct during the conflict. The aim is to identify and publicize patterns which can help in the analysis of whether particular attacks constitute violations of international humanitarian law, including war crimes.

A team of researchers in London and Gaza has been working over several months to collate and input onto the Platform data collected on the ground by the Gaza-based human rights organizations Al Mezan and the Palestinian Center for Human Rights (PCHR), as well as information gathered by Amnesty International.

The launch of the Platform is just the start of the project – it will be updated with new information as work to gather further evidence relating to the conflict continues.

Patterns of Israeli violations

While a vast amount of multimedia information, including testimony, photos, videos and satellite imagery, is still being processed, the Gaza Platform currently shows that more than 270 Israeli attacks were carried out using artillery fire during the 2014 conflict, killing more than 320 civilians. The repeated use of artillery, an imprecise explosive weapon, in densely populated civilian areas constitutes indiscriminate attacks that should be investigated as war crimes.

The Platform also clearly illustrates an overwhelming pattern of targeting residential homes, with more than 1,200 Israeli attacks on houses resulting in more than 1,100 civilian deaths. Direct attacks on civilians not directly participating in hostilities and on civilian objects are prohibited under international humanitarian law, or “the laws of war”. Amnesty International, the UN Commission of Inquiry and other conflict monitoring organizations have raised the alarm about the high number of such attacks during the 2014 conflict.

Users can also note other disturbing patterns, such as Israeli attacks striking first responders, medical workers and facilities, as well as the extensive use of “knock on the roof” warning attacks, where a missile fired from a drone is followed shortly afterwards by a larger bomb. Amnesty International does not consider that such strikes constitute an effective warning, nor do they absolve Israel from the clear obligation not to direct attacks at civilians or civilian property.

Innovative tool for human rights research

“The launch of the Gaza Platform today, a year after the start of the conflict, is a significant step in the process of documenting the full scale of violations that took place in Gaza last year. It is also a call for individuals and other organizations to send more photographs, testimonies and other forms of evidence about attacks they have experienced or documented during the conflict,” said Eyal Weizman, Director of Forensic Architecture.

The digital age has rapidly increased the pace and means of information gathering during a human rights crisis such as last year’s conflict in Gaza. Multimedia evidence can often play an instrumental role in confirming what took place after the fact. The Platform offers an efficient new method of processing and cross-referencing different types of information.

“The Gaza Platform exploits the power of new digital tools to shed light on complex events such as the latest war in Gaza. It enables users to move across scales, from the granular details of each incident to the big picture of the overall conflict, by revealing connections between scattered events,” said Francesco Sebregondi, Research Fellow at Forensic Architecture and Coordinator of the Gaza Platform project.

“We see this project as a first step towards more effective conflict monitoring efforts, supported by collaborative platforms that facilitate the sharing of data between witnesses on the ground, organizations, and citizens worldwide.”

Background

Forensic Architecture is a research project and consultancy based at Goldsmiths, University of London.

The Gaza Platform is a pilot project of a new mapping and data visualization tool to support research around armed conflicts and human rights violations. Entitled PATTRN, the tool has been developed by Forensic Architecture and first put into practice by Amnesty International in partnership with Palestinian human rights organizations Al Mezan and PCHR. The long-term goal is to create a tool that can be used more widely by human rights researchers, investigators, journalists, and citizens to enable them to share information and to monitor conflicts and crises collaboratively.

시리아 사태가 발발한 이후 4년이 넘는 시간 동안 화학무기 공격으로 민간인 수백여 명이 목숨을 잃었다. 화학무기 사용은 국제인도법상 금지되어 있다.

이번 결의안은 이러한 화학무기 공격의 책임자를 가려낼 합동조사기구를 설립하기 위해 필요한 조치를 상술하고 있다. 또한 분쟁의 모든 당사자들은 공격 장소 및 관련자, 관련 정보에 대해 전면적인 접근 권한을 부여하는 등 합동조사기구의 활동에 전적으로 협조해야 할 의무가 있다고 명시했다.

러시아를 비롯해 시리아 분쟁의 책임성 강화를 촉구하는 이전 결의안에 거부권을 행사했던 회원국들도 의견을 함께했다는 사실은 국제사회가 시리아의 참상 속에서 고통받는 민간인들을 구하기 위해 힘을 합칠 수 있다는 것, 또한 그래야만 한다는 것을 보여주고 있다.

그러나 책임자 개개인에 대해 어떻게 처벌이 이루어질 것인지, 결의안 내용에 불응할 경우 어떻게 적용될 것인지에 대해서는 구체적인 사항을 명시하지 않고 있다. 국제앰네스티는 시리아 상황을 국제형사재판소에 회부하는 것으로 결의안을 보완할 것을 유엔 안보리에 촉구한다.

화학무기 공격으로 인한 사상자는 2011년 3월 이후 시리아 전역에서 발생한 사상자 수의 극히 일부분에 불과하다.

Syria: UN resolution on chemical weapons a vital step towards justice for war crimes

A UN Security Council resolution passed today, paving the way for establishing an independent team of experts to identify the perpetrators of chlorine and other chemical weapon attacks, offers hope for accountability for war crimes in Syria, said Amnesty International.

“Chlorine and other chemical weapon attacks have brought death, anguish and terror to the civilian population in Syria. This resolution offers a much needed ray of hope in the darkness that presides over this conflict. If properly implemented, it could offer an opportunity to break the cycle of impunity for the countless war crimes being committed on a daily basis there,” said Said Boumedouha, Acting Director of Amnesty International’s Middle East and North Africa Programme.

Hundreds of civilians have been killed in chemical weapons attacks since the crisis in Syria began more than four years ago. The use of chemical weapons is prohibited by international humanitarian law.

The resolution details steps needed to create a Joint Investigative Mechanism to identify perpetrators of such attacks. It stipulates that all parties to the conflict would have an obligation to cooperate with it fully, including by granting full access to locations, individuals and relevant materials.

The fact that UN Security Council member states, including Russia which has blocked previous resolutions pushing for accountability in Syria, came together demonstrates how they can and should unite to help end the suffering of civilians in the Syrian catastrophe.

However, the resolution stops short of specifying how individuals should be held to account or how the terms of the resolution would be enforced in the event of non-compliance. Amnesty International is calling on the UN Security Council to expand on this resolution by referring the situation in Syria to the Prosecutor of the International Criminal Court.

Those killed and injured in chemical weapons attacks in Syria represent just a fraction of the casualties across the country since March 2011.

“The narrow scope of this resolution focuses only on one category of horrific crimes being committed in Syria, when thousands more continue to suffer on a daily basis as a result of other abuses including war crimes and crimes against humanity,” said Said Boumedouha.

스마트폰, 차량용 배터리 속에 숨은 아동노동 실태

애플(Apple)과 삼성(Samsung), 소니(Sony) 등 대형 전자기업이 자사 제품에 사용되는 코발트가 아동노동 착취의 산물은 아닌지에 대한 기본적인 점검조차 하지 않고 있다고 국제앰네스티와 아프리워치(Afrewatch)가 19일 공동 발표한 보고서를 통해 밝혔다.

보고서 <목숨을 건 코발트 채굴: 콩고민주공화국의 코발트 교역 과정에서 발생하는 인권침해>(영문 보고서/국문 요약보고서)는 리튬이온배터리의 원재료로 이용되는 코발트가, 성인부터 7세의 어린 아이까지 위험한 환경에서 노동하고 있는 광산으로부터 유통되는 과정을 추적했다.

마크 더멧(Mark Dummett) 국제앰네스티 기업과 인권 조사관은 “매장을 화려하게 전시하고 최첨단 기술을 홍보하는 것과, 돌더미를 지고 다니는 어린이들, 직접 판 탄광에서 장기적인 폐질환을 감수하며 일하는 광부들의 모습은 극명한 대조를 이룬다”며 “수백만 명이 최신 기술의 혜택을 누리고 있지만 그 제조 과정을 궁금해하는 사람은 거의 없다. 지금이 바로 대기업들이 수익성 높은 제품들의 원자재 채굴 과정에 대해 책임을 져야 할 때”라고 말했다.

이 보고서는 아동노동이 만연한 지역에서 코발트를 구입한 유통업자들이 중국계 대형 광산기업 저장화유코발트주식회사(Chinese mineral giant Zhejiang Huayou Cobalt Ltd)의 완전자회사인 콩고동방광업(Congo Dongfang Mining, CDM)에 판매하는 과정을 기록했다.

국제앰네스티의 투자문서 조사 결과 화유코발트와 자회사 CDM은 코발트 원석을 가공해 중국과 한국의 배터리 부품업체 3곳에 납품하고 있었다. 이 업체들이 이후 배터리 제조사로 부품을 판매하고, 이렇게 생산된 배터리가 애플, 마이크로소프트(Microsoft), 삼성, 소니, 다임러(Daimler), 폭스바겐(Volkswagen) 등의 기술 및 자동차기업에 공급된다.

국제앰네스티는 화유코발트가 가공한 코발트를 사용하는 배터리 제조사로부터 부품을 구매하는 것으로 알려진 16개 다국적기업과 접촉했다. 이 중 한 곳은 관련성을 인정했지만, 4개 기업은 콩고민주공화국이나 화유코발트로부터 코발트를 공급받았는지에 대해 확실한 답변을 내놓지 못했다. 6개 기업은 이러한 주장에 대해 조사 중이라고 밝혔고, 5개 기업은 배터리 제조업체의 관련 문서에 납품처로 기록되어 있었음에도 화유코발트로부터 코발트를 공급받지 않고 있다고 부인했다. 2개 기업은 콩고민주공화국산 코발트를 사용하지 않는다고 밝혔다.

그러나 결정적으로, 어떤 기업도 자사 제품에 사용된 코발트의 생산지를 독립적으로 확인할만한 구체적인 내용은 제공하지 못했다.

엠마누엘 움풀라(Emmaunel Umpula) 아프리워치(Afrewatch, 아프리카 자원 감시단) 국장은 “세계에서 가장 부유하고 혁신적이라 꼽히는 기업들이 부품 자재의 원산지를 공개하지도 않고 최첨단 장치를 판매할 수 있다는 것은 디지털 시대의 커다란 모순”이라며 “광산에서의 인권침해가 무관심 속에 잊혀지고 있는 것은 오늘날의 세계 시장 소비자들이 광산과 공장, 생산 라인의 환경에 대해 전혀 알지 못하기 때문이다. 조사 결과 유통업자들도 원산지와 채굴 방법에 대해서는 전혀 묻지 않은 채 코발트를 매입하고 있었다”고 말했다.

위험한 광산과 아동노동

콩고민주공화국은 세계 코발트 생산량의 최소 50% 이상을 차지하고 있다. 이곳에서 주로 광물을 제련하는 업체는 화유코발트의 자회사 CDM으로, 화유코발트는 자사 코발트의 40% 이상을 콩고민주공화국에서 조달한다.

CDM이 코발트를 매입하는 지역의 광부들은 장기적인 건강피해와 치명적인 사고가 발생할 매우 높은 위험을 감수하고 있다. 2014년 9월부터 2015년 12월 사이에만 콩고민주공화국 남부 지역의 최소 80명이 넘는 영세 광부들이 지하 탄광에서 목숨을 잃었다. 대부분의 사고가 알려지지 않은 채 무마되고, 시신은 무너진 잔해 속에 방치되기 때문에 실제 사망자 수는 알 수 없다.

또한 국제앰네스티 조사관들은 대다수의 광부들이 폐질환 또는 피부염으로부터 보호할 장갑이나 작업복, 마스크와 같은 가장 기본적인 보호장비조차도 없이 매일 장시간 코발트와 접촉하고 있다는 점도 파악했다.

국제앰네스티와 인터뷰를 나눈 어린이들은 광산에서 하루에 12시간 이상 무거운 돌 더미를 옮기고 일당 1~2달러를 받으며 일하고 있다고 전했다. 유니세프(UNICEF, 유엔아동기금)는 2014년 콩고민주공화국 남부 전역의 어린이 약 4만 명이 광산에서 일을 했고, 그 중 많은 수가 코발트 광산이었다고 발표했다.

14세 폴(Paul)은 12세 때부터 광산에서 일을 시작했다. 폴은 지하에서 오랫동안 일을 한 탓에 계속해서 몸이 아프다고 했다.

“탄광에서 24시간을 보낼 때가 많아요. 아침에 들어와서 다음 날 아침에 나가는 거죠. … 갱도 안에서의 생활에 적응할 수밖에 없었어요. … 양어머니께선 학교에 보내주려고 하셨는데, 양아버지가 반대해 탄광에서 일을 하게 했어요.”

마크 더멧 조사관은 “탄광 노동은 건강과 안전을 위협하는 환경 때문에 최악의 아동노동 형태로 꼽힌다. 세계적으로 총 1,250억달러의 수익을 올리고 있는 기업들이 자사 제품에 쓰이는 주요 원자재가 어디서 나오는지도 점검하지 못한다고 주장하기엔 신뢰성이 없다”며 “전기자동차나 스마트폰의 배터리에 쓰이는 기본적인 광물을 채광하는 것은 광부들에게 부의 원천이 되어야 하지만, 현실에서 그들은 거의 한 푼도 없이 등골 휘는 절망적인 삶을 살아가고 있다. 대기업은 이러한 현실을 변화시킬 힘이 있다”고 말했다.

공급망 추적 – 부끄러운 기업

국제앰네스티와 아프리워치 조사관들은 2015년 4월과 5월 콩고민주공화국 남부 지역의 5개 광산에서 어린이 17명을 포함한 전, 현직 코발트 광부 87명과 인터뷰를 가졌다. 또한 코발트 유통업자 18명과도 이야기를 나누고, 광부와 업자들의 차량을 따라 광산에서 코발트 광석을 구입해 시장에서 대형 기업에 판매하는 과정을 추적했다. 이렇게 광석을 매입하는 기업 중 가장 규모가 큰 곳은 화유코발트의 콩고계 자회사인 CDM이다.

화유코발트는 중국의 닝보샨샨(Ningbo Shanshan)과 톈진바모(Tianjin Bamo), 한국의 엘엔에프신소재(L&F Materials) 등 3곳의 리튬이온배터리 부품업체에 코발트를 공급하고 있다. 3개 업체는 2013년 화유코발트로부터 최소 미화 9,000만달러 이상 규모의 코발트를 매입했다.

이어 국제앰네스티는 이들 3개 업체로부터 직, 간접적으로 부품을 구매하는 것으로 나타난 다국적 소비재기업 16개곳과 연락을 시도했다. 국제앰네스티의 연락을 받기 이전부터 화유코발트와 연락을 주고받거나 자사 제품에 쓰인 코발트의 원산지를 추적했다고 밝힌 곳은 한 곳도 없었다.

이번 보고서는 코발트 공급망을 이용하는 기업들이 공급망에서 대두되는 인권 위험요소에 대응하지 못하고 있음을 보여주고 있다.

현재 세계 코발트 시장에는 아무런 규제도 존재하지 않는다. 미국의 현행 ‘분쟁 광물’ 규정에 따르면 콩고민주공화국에서 생산되는 금, 탄탈룸, 주석, 텅스텐은 규제 대상이 되지만, 코발트는 포함되지 않는다.

국제앰네스티와 아프리워치는 자사 제품에 리튬이온배터리를 사용하는 다국적기업에게 인권 주의의무를 수행할 것과, 코발트가 위험한 환경에서 아동노동 착취로 채굴되고 있는지 조사할 것, 자사 공급망을 더욱 투명하게 관리할 것을 촉구한다.

또한 중국 정부에도 해외에서 사업을 진행하는 채광기업에 대해 공급망을 조사하고 기업활동 중 발생하는 인권침해 문제를 해결하도록 의무화할 것을 촉구한다. 화유코발트는 거래하는 코발트의 원산지와 채굴 및 유통 과정 관련자들을 확인하고, 아동노동 착취 또는 위험한 환경에서 채굴된 코발트를 매입해서는 안된다.

Exposed: Child labour behind smart phone and electric car batteries

Major electronics brands, including Apple, Samsung and Sony, are failing to do basic checks to ensure that cobalt mined by child labourers has not been used in their products, said Amnesty International and Afrewatch in a report published today.

The report, “This is what we die for: Human rights abuses in the Democratic Republic of the Congo power the global trade in cobalt”, traces the sale of cobalt, used in lithium-ion batteries, from mines where children as young as seven and adults work in perilous conditions.

“The glamourous shop displays and marketing of state of the art technologies are a stark contrast to the children carrying bags of rocks, and miners in narrow manmade tunnels risking permanent lung damage,” said Mark Dummett, Business & Human Rights Researcher at Amnesty International.

“Millions of people enjoy the benefits of new technologies but rarely ask how they are made. It is high time the big brands took some responsibility for the mining of the raw materials that make their lucrative products.”

The report documents how traders buy cobalt from areas where child labour is rife and sell it to Congo Dongfang Mining (CDM), a wholly-owned subsidiary of Chinese mineral giant Zhejiang Huayou Cobalt Ltd (Huayou Cobalt).

Amnesty International’s investigation uses investor documents to show how Huayou Cobalt and its subsidiary CDM process the cobalt before selling it to three battery component manufacturers in China and South Korea. In turn, they sell to battery makers who claim to supply technology and car companies, including Apple, Microsoft, Samsung, Sony, Daimler and Volkswagen.

Amnesty International contacted 16 multinationals who were listed as customers of the battery manufacturers listed as sourcing processed ore from Huayou Cobalt. One company admitted the connection, while four were unable to say for certain whether they were buying cobalt from the DRC or Huayou Cobalt. Six said they were investigating the claims. Five denied sourcing cobalt from via Huayou Cobalt, though they are listed as customers in the company documents of battery manufacturers. Two multinationals denied sourcing cobalt from DRC.

Crucially, none provided enough details to independently verify where the cobalt in their products came from.

“It is a major paradox of the digital era that some of the world’s richest, most innovative companies are able to market incredibly sophisticated devices without being required to show where they source raw materials for their components,” said Emmanuel Umpula, Afrewatch (Africa Resources Watch) Executive Director.

“The abuses in mines remain out of sight and out of mind because in today’s global marketplace consumers have no idea about the conditions at the mine, factory, and assembly line. We found that traders are buying cobalt without asking questions about how and where it was mined.”

Fatal mines and child labour

The DRC produces at least 50% of the world’s cobalt. One of the largest mineral processors in the country is Huayou Cobalt subsidiary CDM. Huayou Cobalt gets more than 40% of its cobalt from DRC.

Miners working in areas from which CDM buys cobalt face the risk of long-term health damage and a high risk of fatal accidents. At least 80 artisanal died underground miners in southern DRC between September 2014 and December 2015 alone. The true figure is unknown as many accidents go unrecorded and bodies are left buried in the rubble.

Amnesty International researchers also found that the vast majority of miners spend long hours every day working with cobalt without the most basic of protective equipment, such as gloves, work clothes or facemasks to protect them from lung or skin disease.

Children told Amnesty International they worked for up to 12 hours a day in the mines, carrying heavy loads to earn between one and two dollars a day. In 2014 approximately 40,000 children worked in mines across southern DRC, many of them mining cobalt, according to UNICEF.

Paul, a 14-year-old orphan, started mining at the age of 12. He told researchers that prolonged time underground made him constantly ill:

“I would spend 24 hours down in the tunnels. I arrived in the morning and would leave the following morning … I had to relieve myself down in the tunnels … My foster mother planned to send me to school, but my foster father was against it, he exploited me by making me work in the mine.”

“The dangers to health and safety make mining one of the worst forms of child labour. Companies whose global profits total $125 billion cannot credibly claim that they are unable to check where key minerals in their productions come from,” said Mark Dummett.

“Mining the basic materials that power an electric car or a smartphone should be a source of prosperity for miners in DRC. The reality is that it is a back-breaking life of misery for almost no money. Big brands have the power to change this.”

Following the supply chain – corporate shame

Amnesty International and Afrewatch researchers spoke to 87 current and former cobalt miners, 17 of them children, from five mine sites in southern DRC in April and May 2015. They also interviewed 18 cobalt traders and followed vehicles of miners and traders as they carried cobalt ore from mines to markets where larger companies buy the ore. The largest of them is Huayou Cobalt’s Congolese subsidiary CDM.

Huayou Cobalt supplies cobalt to three lithium-ion battery component manufacturers Ningbo Shanshan and Tianjin Bamo from China and L&F Materials from South Korea. These three battery component manufacturers bought more than US$90 million worth of cobalt from Huayou Cobalt in 2013.

Amnesty International then contacted 16 multinational consumer brands listed as direct or indirect customers of the three battery component manufacturers. None said they had been in touch with Huayou Cobalt or traced where the cobalt in their products had come from prior to Amnesty International’s contact.

The report shows that companies along the cobalt supply chain are failing to address human rights risks arising in their supply chain.

Today there is no regulation of the global cobalt market. Cobalt does not fall under existing “conflict minerals” rules in the USA, which cover gold, coltan/tantalum, tin and tungsten mined in DRC.

“Many of these multinationals say they have a zero tolerance policy for child labour. But this promise is not worth the paper it is written when the companies are not investigating their suppliers. Their claim is simply not credible,” said Mark Dummett.

“Without laws that require companies to check and publicly disclose information about where they source minerals and their suppliers, companies can continue to benefit from human rights abuses. Governments must put an end to this lack of transparency, which allows companies to profit from misery.”

Amnesty International and Afrewatch are calling on multinational companies who use lithium-ion batteries in their products to conduct human rights due diligence, investigate whether the cobalt is extracted under hazardous conditions or with child labour, and be more transparent about their suppliers.

The organizations are also calling on China to require Chinese extractive companies operating overseas to investigate their supply chains and address human rights abuses in their operations. The organizations say Huayou Cobalt should confirm who is involved in mining and trading its cobalt (and where) and make sure it is not buying cobalt mined by child labour or in dangerous conditions.

“Companies must not simply discontinue a trading relationship with a supplier or embargo DRC cobalt once human rights risks have been identified in the supply chain. They must take remedial action on the harm suffered by people whose human rights were abused,” said Mark Dummett.

세계 굴지의 식품 및 생활용품 제조사들이 판매 중인 식품과 화장품, 생활용품에 사용되는 팜유는 여덟 살까지 어린 아이를 끔찍한 환경에서 일하게 하는 등 원산지 인도네시아에서의 충격적인 인권 침해로 얼룩져 있다고, 국제앰네스티가 보고서를 통해 밝혔다.

보고서 <팜유에 얽힌 거대한 추문: 대기업의 상표 이면에 벌어지는 노동착취>는 세계 최대 팜유 생산업체인 싱가포르계 기업농 윌마르(Wilmar)가 운영하는 인도네시아의 팜유 농장을 조사하고, 이곳에서 생산된 팜유가 9개 다국적기업으로 공급되는 과정을 추적했다. 9개 기업AFAMSA, ADM, 콜게이트파몰리브(Colgate-Palmolive), 엘리번스(Elevance), 켈로그(Kellogg’s), 네슬레(Nestlé), 피앤지(Procter & Gamble), 래킷벤키저(Reckitt Benckiser), 유니레버(Unilever) 등이다.

메그나 아브라함(Meghna Abraham) 국제앰네스티 상임조사관은 “기업은 자사의 공급망에서 벌어지는 노동 착취를 모른 체하고 있다. 소비자에게 자사의 팜유 생산망에서 착취가 이루어지는 일은 없을 것이라고 약속했음에도 불구하고, 대형 브랜드 업체들은 끔찍한 인권침해로 수익을 창출하기를 계속하고 있다. 이러한 조사 결과는, 지속가능한 팜유를 사용했다고 주장하는 제품을 구매하며 윤리적인 소비를 하고 있다고 여겼던 소비자라면 누구나 충격을 받을 내용”이라고 말했다.

또한 “콜게이트, 네슬레, 유니레버와 같은 대기업은 자사의 제품에 ‘지속가능한 팜유’를 사용했다고 소비자들을 안심시키고 있지만, 앰네스티 조사 결과 그렇지 않다는 것이 드러났다. 아동노동과 강제 노역으로 생산된 팜유는 전혀 지속 가능하다고 할 수 없다. 윌마르의 팜유 생산과정에서 드러난 인권침해는 별개의 사건이 아니라 제도적인 것이며, 윌마르의 운영 방식으로 충분히 예상된 결과”라며 “2015년 한 해 모두 합쳐 3,250억 달러의 순이익을 올린 9개 기업이, 박봉을 받는 팜유 노동자들의 형편없는 처우에 대해 아무것도 하지 못한다는 것은 잘못된 것”이라고 밝혔다.

국제앰네스티는 매그넘(Magnum) 아이스크림, 콜게이트 치약, 도브(Dove) 화장품, 노르(Knorr) 수프, 킷캣(KitKat), 팬틴(Pantene) 샴푸, 아리엘(Ariel) 세제, 컵라면 등의 인기 제품에 윌마르의 인도네시아 농장에서 생산된 팜유가 사용되었는지 여부를 소비자에게 공개하라고 해당 기업에 요청하는 캠페인을 벌일 예정이다.

대기업 공급망 내의 제도적인 착취

국제앰네스티는 윌마르 계열사 2곳, 공급업체 3곳이 소유한 인도네시아 칼리만탄과 수마트라의 야자농장에서 일하는 노동자 120명과 인터뷰를 했다. 조사 결과 다음과 같은 광범위한 인권침해가 드러났다.

  • 여성은 급료를 삭감하겠다는 위협을 받으며 강제로 오랜 시간을 일하고, 최저임금보다 낮은 임금을 받으며 심한 경우 일당이 미화 50달러에 불과했다. 연금이나 건강보험도 없이 불안한 고용환경이 유지됐다.
  • 여덟 살까지 어린 아이들이 위험하고 고된 육체노동을 하고 있으며, 농장에서 일하는 부모를 돕기 위해 학교를 그만둔 경우도 있었다.
  • 노동자들은 파라콰트로 인해 심각한 질환을 앓고 있었다. 맹독성 화학물질인 파라콰트는 유럽연합(EU)은 물론 윌마르에서도 사용을 금지하고 있지만 여전히 농장에서 제초제로 사용되고 있다.
  • 2015년 8월부터 10월까지 계속된 산불로 공기오염이 위험한 수준이고, 이 때문에 호흡기가 손상될 위험이 있음에도 노동자들은 적절한 안전장비 없이 야외에서 노동을 해야 한다.
  • 노동자들은 터무니없이 높은 목표량을 채우기 위해 장시간 노동을 해야 한다. 20미터 높이의 나무에서 열매를 따기 위해 중장비를 사용해야 하는 등 고도의 육체노동을 필요로 하는 경우가 많다. 노동자들은 이러한 목표를 달성하려고 시도하다 상당한 신체적 고통을 받을 수 있고, 바닥에 떨어진 야자나 설익은 열매는 따지 못하게 하는 등의 다양한 불이익을 받을 수도 있다.
  • 윌마르는 농장 운영 과정에서 노동 문제가 다수 발생했고 지금도 진행 중이라고 인정했다. 이러한 착취에도 불구하고, 국제앰네스티가 인도네시아에서 조사한 야자농장 5개곳 중 3곳이 지속가능한 팜유 생산을 위한 협의회(Roundtable on Sustainable Palm Oil, RSPO)로부터 “지속 가능한” 팜유를 생산하는 곳으로 인증받았다. RSPO는 여러 차례의 환경 문제를 겪은 팜유 생산분야를 깨끗하게 관리하고자 2004년 설립된 조직이다.

시마 조시(Seema Joshi) 기업과인권 국장은 “이 보고서는 기업들이 더 철저한 조사를 막기 위해 RSPO를 방패막이로 사용하고 있음을 명백히 보여준다. 국제앰네스티 조사 결과 이들 기업은 서류상으로는 강력한 정책을 마련해 놓고 있지만, 윌마르의 공급망에서 명백히 드러난 인권침해 위험을 검증했다고 증명할 수 있는 기업은 한 곳도 없었다”고 말했다.

 

조사 결과 제기되는 지속 가능성 주장에 대한 의문

윌마르에서 발표한 수출 자료 및 정보를 이용해, 국제앰네스티 조사관들은 이곳에서 생산된 팜유가 세계적인 식품 및 생활용품 제조업체 9곳으로 공급된 과정을 추적했다. 이들 기업과 접촉한 결과 7개 기업에서 윌마르의 인도네시아 농장에서 팜유를 구입한다는 점을 확인했지만, 이 팜유가 사용된 제품에 대한 상세내용을 기꺼이 공개한 기업은 켈로그와 래킷벤키저 단 2개에 불과했다.

1개 업체를 제외한 모든 해당 업체가 RSPO 회원이었으며, 자사 웹사이트 또는 상품 표기에 “지속가능한 팜유”를 사용한다고 밝히고 있다. 국제앰네스티가 접촉한 업체 중 노동착취가 벌어지고 있다는 사실을 부정한 곳은 없었지만, 윌마르 농장에서의 노동권 침해 문제를 해결하기 위해 취한 행동의 구체적인 예시를 제시한 곳도 없었다.

시마 조시 국장은 “소비자들은 노동착취와 관련된 제품이 어떤 것인지 알고 싶을 것이다. 주요 공급업체가 운영하는 농장에서 이처럼 끔찍한 착취가 벌어지고 있음을 알면서도, 해당 기업들은 영향을 받은 특정 제품이 무엇인지에 대해서는 철저히 비밀에 부치고 있다”며 “기업은 자사 제품에 사용되는 재료에 대해 더욱 투명해야 한다. 우리 슈퍼마켓 선반에 진열된 제품의 원료가 어디에서 공급된 것인지 공개해야 한다. 그렇게 하지 않는다면 이들 기업은 계속해서 노동착취로 이익을 창출하고, 어느 정도 착취에 일조하게 될 것이다. 구매대에서 윤리적인 선택을 하고 있다고 생각하던 소비자들을 전혀 존중하지 않고 있다”고 말했다.

최악의 아동노동 드러나

이번 보고서는 윌마르 계열사와 공급업체가 소유, 운영하는 농장에서 8세에서 14세 사이 아동들이 위험한 노동을 강행하고 있는 실태에 대해 기록했다. 어린이들은 유독한 제초제가 사용되는 농장에서 안전장비 없이, 12~25kg에 이르는 야자열매 자루를 나르는 일을 한다. 학교를 그만두고 부모와 함께 온종일, 또는 하루의 대부분을 일하기도 한다. 학교를 마치고 오후에 일을 하거나, 주말 및 휴일에 일하는 아이들도 있다.

윌마르 소유 농장에서 야자열매를 수확하고 나르는 14세 소년은 국제앰네스티와의 인터뷰에서, 열두 살 때 아버지가 몸이 아파 목표량을 채우지 못하게 되면서 학교를 그만뒀다고 말했다. 열 살, 열두 살 난 동생들도 학교를 마치고 농장에서 일하고 있다고 한다.

2년 정도 매일 아버지를 도왔어요. 학교에서는 6학년까지 공부했어요. 아버지가 더 이상 일을 할 수 없어서 아버지를 도우려고 학교를 그만뒀어요. 아프셨거든요. 학교를 그만둔 게 후회가 돼요. 더 똑똑해지려고 학교에 가는 게 좋았어요. 선생님이 되고 싶었죠.”

어린 나이에 육체적으로 무리하고 고된 노동을 하는 것은 신체적 손상을 유발할 수 있다. 마찬가지로 아버지를 돕기 위해 학교를 그만두고 윌마르 공급업체에서 일하는 10세 소년은 여덟 살 때부터 아침 6시에 일어나 떨어진 야자열매를 모아 옮겼다고 한다. 일요일을 제외하고 매일 6시간씩 일했다고 했다.

저는 학교에 안 가요. 떨어진 열매 자루를 혼자 옮기는데, 자루를 반만 채워야 옮길 수 있어요. 너무 무거워서 옮기기 힘들어요. 비가 오는 날에도 똑같이 일하지만 힘들어요. 손이 아프고 몸이 쑤셔요.”

강제노동, 저임금, 차별, 독성 화학물질 노출 등에 처한 여성노동자

이번 보고서는 여성을 정규직이 아닌 비정규 일용직으로 고용하며, 건강보험과 연금 등의 사회보장서비스를 받지 못하게 하는 차별적인 행태를 지적했다. 또한 강제노동 사례와, 현장 반장이 여성노동자의 노동을 착취하기 위해 임금을 주지 않거나 삭감하겠다고 위협한 사례도 함께 기록했다. 야자농장 유지 관련 부서에서 일하는 한 여성은 직접적, 간접적인 위협을 당하며 더 오랜 시간 일하도록 압력을 받는다고 말했다.

내 목표치를 달성하지 못하면 그들은 계속 일하라고 하지만 추가로 일한 시간에 대해서는 수당을 받지 못해요. 친구와 함께 반장에게 가서 너무 지쳤으니 퇴근하겠다고 말했죠. 그랬더니 반장은 일하기 싫으면 집에 가서 다시 오지 말라고 했어요. 목표가 말도 안 되는 끔찍한 수준이라 정말 힘들어요. 일을 마치고 나면 발, 손, 등이 아파요.”

인도네시아의 노동법은 강력해서 이러한 노동착취 대부분이 형사 범죄에 해당할 수 있지만, 제대로 시행되지 않고 있다. 국제앰네스티는 인도네시아 정부에 법집행을 개선하고 보고서에서 제시한 인권침해에 대해 조사할 것을 촉구한다.

국제앰네스티 조사관들은 조사 대상 농장에서 직접 원재료를 공급받은 특정 정제소 또는 제분소의 팜유가 합작회사를 통해 콜게이트, 래킷벤키저, 네슬레, ADM, 엘레번스, AFAMSA, 켈로그 등 7개 기업으로 공급되는 과정을 추적했다. 나머지 2개 업체인 유니레버와 피앤지는 인도네시아의 윌마르에서 팜유를 공급받는다는 점은 확인했지만, 공급된 팜유가 어느 정제소를 거쳤는지를 묻는 앰네스티의 질문에는 답변하지 않았다. 이들이 인도네시아산 팜유를 공급받는다는 것과, 국제앰네스티가 조사한 농장의 팜유가 윌마르의 정제소 15개곳 중 11개곳으로 공급된다는 점으로 미루어 유니레버와 피앤지 역시 문제가 된 정제소 중 최소 1곳 이상으로부터 공급받고 있을 가능성이 매우 높다.

국제앰네스티는 해당 업체들에 윌마르 인도네시아 농장에서 공급된 팜유를 사용한 소매품 목록을 확인해 달라고 요청했고, 단 2개 업체(켈로그, 레킷벤키저)만이 확인하겠다고 답했다. 콜게이트와 네슬레는 인도네시아의 윌마르 정제소에서 팜유를 공급받는다고 인정했다. 국제앰네스티는 이 정제소가 보고서에서 조사한 농장과 연결되어 있다고 봤다. 그러나 콜게이트와 네슬레는 앰네스티가 열거한 제품 중에는 윌마르의 인도네시아 농장에서 생산된 팜유가 사용된 제품이 없다면서도, 어떤 제품이 사용됐는지는 밝히지 않았다. 유니베르와 피앤지는 제품 목록을 검토하지 않았고, 나머지 3개 업체는 막연하게 언급하거나 답변을 하지 않았다.
