불법 공매도 발생 종목과 위반자 비공개로
가짜 주주 보호하는 금융위

지난 2014년부터 2021년 2월 24일까지(약 7년 2월) 발생한 불법 무차입 공매도 건수가 총 300건, 위반자는 101개사, 피해 종목은 217개사나 되었다. 위반자의 94%는 외국인 투자자였다. 적발이 어렵다는 측면에서 드러난 건수는 빙산의 일각이라고 볼 수 있다. 이러한 불법을 방지하기 위해서는 적발하여 조치하는 것도 중요하지만, 범죄를 저지른 자가 누구인지, 어떤 종목에서 발생했는지의 실태 공개도 중요하다. 따라서 금융당국이라면 마땅히 이러한 실태를 시장에 투명하게 알려 자발적으로 감시와 자정이 가능하도록 해야 한다. 하지만 어떻게 된 일인지 금융위원회는 범죄 정보를 숨겨 불법을 저지른 가짜 주주들을 보호하고, 진짜 주주들이 피해를 입도록 방치하고 있다.

무차입 공매도 발생 종목과 위반자 비공개

경실련은 최근 무차입 공매도 실태를 파악하기 2019년부터 2021년 2월까지 적발했던 종목과 위반자명, 무차입 공매도 수량, 위반금액 등에 대해 금융위원회에 정보 공개 청구를 했으나, 중요한 위반자명과 종목명은 비공개 결정을 내렸다. 납득하기 어려운 점은 위반자명은 그렇다 치고, 무차입 공매도 발생 종목에 대해서는 2019년 정보 공개 청구를 했을 때에는 공개를 했었다. 하지만 이번엔 어떤 연유에서인지 종목명도 비공개했다. 비공개 결정에 대해 이의 신청까지 했으나, 이상한 근거를 들면서 결국 비공개했다. 이에 경실련은 6월 7일 금융위의 비공개 결정에 대한 처분 취소 소송을 제기하는 기자회견을 개최하여 관련 정보를 투명하게 공개할 것을 촉구했다.

불법 공매도 피해 현황은 공개 대상 정보

금융위는 「공공기관의 정보공개에 관한 법률」 제9조 제1항 제1호·제7호·8호와 「금융실명거래 및 비밀보장에 관한 법률」 제4조 제1항의 근거해 종목을 비공개했다. 정보공개법 제9조 제1항 제1호에 따라 공공기관이 보유 및 관리하는 정보 중 다른 법률에 따라 비밀이나 비공개 사항으로 규정된 정보는 비공개 할 수 있으며, 금융실명법 제4조 제1항은 금융회사 등에 종사하는 자가 금융 거래의 명의인의 동의 없이 거래 정보를 누설하는 것을 금지하고 있다. 하지만 금융위는 금융실명법에서 언급하고 있는 금융회사와는 성격이 다르다. 즉, 「금융위원회 설치 등에 관한 법률」에 의해 설치된 공공기관으로써 영리를 목적으로 하는 금융회사와는 달리 금융소비자를 보호하고, 자본시장을 관리·감독하는 의무가 있다. 따라서 금융위가 금융회사에 해당한다는 것을 전제로 비공개한 것은 타당하지가 않다.

다음으로 금융위가 비공개 사유로 제시한 정보공개법 제1항 7호도 타당하지 않다. 금융위는 피해 종목 정보가 ‘경영상·영업상 비밀에 관한 사항으로 공개될 경우, 법인 등의 정당한 이익을 현저히 해칠 우려가 있다고 인정된 정보’로 판단하여 비공개했다. 영업비밀과 관련된 법률, 즉 「부정경쟁방지 및 영업비밀보호에관한법률」 제2조 제2호에는 ‘영업비밀이란 공공연히 알려져 있지 아니하고 독립된 경제적 가치를 가지는 것으로서 상당한 노력에 의하여 비밀로 유지된 생산방법, 판매방법, 그밖에 영업활동에 유용한 기술상 또는 경영상의 정보’라고 밝히고 있다. 하지만 불법 공매도 피해 종목과 위반자명은 자본시장법을 위반한 것으로서 보호해줘야 할 영업비밀에 해당하지 않는다고 볼 수 있다. 백번 양보해서 이를 영업비밀이라고 본다고 해도 불법을 저지른 위반자의 이익을 정당한 이익이라고 할 수도 없어 마땅히 공개함이 타당하다. 나아가 불법 공매도 피해 현황이 공개되어도 특정인에게 이익 또는 불이익을 줄 우려도 없다.

공공기관의 정보공개에 관한 법률 제9조(비공개 대상 정보)
① 공공기관이 보유·관리하는 정보는 공개 대상이 된다. 다만, 다음 각 호의 어느 하나에 해당하는 정보는 공개하지 아니할 수 있다.
7. 법인·단체 또는 개인(이하 “법인 등”이라 한다)의 경영상·영업상 비밀에 관한 사항으로서 공개될 경우 법인 등의 정당한 이익을 현저히 해칠 우려가 있다고 인정되는 정보. 다만, 다음 각 목에 열거한 정보는 제외한다.
나. 위법·부당한 사업활동으로부터 국민의 재산 또는 생활을 보호하기 위하여 공개할 필요가 있는 정보
8. 공개될 경우 부동산 투기, 매점매석 등으로 특정인에게 이익 또는 불이익을 줄 우려가 있다고 인정되는 정보

금융위가 할 일은 가짜 주주 보호가 아닌 진짜 주주 권익 보호

한시적으로 금지되었던 공매도가 재개된 지도 벌써 두 달이 넘었다. 공매도가 재개된 종목 중심으로 외국인 투자자의 많은 공매도 물량이 쏟아지고 있다. 7월 12일 기준으로 누적 공매도 거래대금이 코스피는 22조 5,754억원, 코스닥은 5조 8,573억 원이나 되었다. 불법 공매도를 차단 또는 적발할 수 있는 시스템이 없어 많은 불법 공매도가 발생하고 있을 수 있다. 그럼에도 금융위는 무차입 공매도에 대한 솜방망이 수준의 과징금과 형사 처벌을 도입했다고 자화자찬하며 제도와 시스템 개선, 시장조사 없이 안일하게 있다. 이러는 사이 진짜 주주들은 가짜 주주들에 의해 계속적인 피해를 보고 있다. 현재의 공매도 제도가 자본력과 정보력이 있는 가짜 주주들에게 편리함과 이익을 주고 있기 때문이다. 따라서 금융위가 해야 할 일은 진짜 주주들의 권익을 보호하기 위해 ▲불법 공매도를 근절하기 위한 적발 시스템 도입과 수기거래 방지 ▲불법 공매도에 대한 징벌적 수준의 과징금과 형사 처벌 강화 ▲재대차 금지 ▲5% 이상 대주주의 주식 대여 금지 등의 제도 개선을 해야 한다.

진짜 주주들의 적극적인 행동도 필요

‘동학개미’, ‘천만 투자자시대’라는 용어가 등장할 정도로 개인 투자자들의 영향력이 커진 것은 사실이다. 하지만 제도 개선 권한을 가지고 있는 정부와 국회는 여전히 개인 투자자들의 목소리에 귀를 기울이지 않는다. 따라서 적극적인 캠페인과 의견 개진을 통해 정부와 국회를 압박할 필요가 있다. 경실련에서는 불법 공매도 피해 종목과 위반자명에 대한 정보공개행정소송을 계기로 불법 공매도 세력을 옹호하는 금융위에 경종을 울려 제 역할을 하도록 ‘공매도 투기 종목 조사 촉구 서명 캠페인’을 진행하고 있다. 공매도 재개 이후 공매도가 상위 종목을 중심으로 개인 투자자들의 서명을 받아, 불법 여부, 시세조종 여부 등을 철저히 조사해줄 것을 촉구하고자 함이다. 이러한 운동에 개인 투자자들도 적극 동참하여 금융위에 강력한 목소리를 전달해야 한다. 움직이지 않으면 정부와 정치권, 불공정한 제도는 절대 바뀌지 않는다.

수도권 기초단체장 부동산 재산 분석

경실련은 지난 8월 20일(목) 경실련 강당에서 수도권 기초단체장의 부동산 재산을 분석 발표하는 기자회견을 개최했다. 서울 구청장 25명의 부동산 재산은 이미 발표한 바 있으나, 이번에는 경기도 시장·군수 30명과 인천 구청장 10명까지 추가로 분석하여 수도권 전체 기초단체장 65명의 재산을 살펴보았다. 이번 조사발표는 경실련과 경실련 경기도협의회가 공동으로 진행했다.

기초단체장은 지역의 도시계획 정책과 각종 인허가권을 가지고 있다. 특히 수도권의 재개발·재건축 등 도시 및 주택정책은 전국 부동산 시장에 미치는 영향이 크기 때문에 수도권 기초단체장의 역할은 더욱 중요하다. 경실련과 경실련 경기도협의회는 해당 기초단체장의 부동산 소유 상황을 알리며 시민들이 지역 부동산 정책에 관심을 가질 수 있도록 이번 조사결과를 발표했다.

신고가액 기준 65명의 재산은 1인당 평균 15.4억 원이며, 이 중 부동산 재산은 10.8억 원으로 70%를 차지하고 있다. 부동산 기준 상위 10명의 부동산은 평균 39억 원으로 국민 평균(3억 원)의 13배나 되는 것으로 나타났다. 최고 부자는 김영종 서울 종로구청장으로 76억 원을 보유하고 있다. 2위는 정순균 서울 강남구청장으로 70.1억 원을 보유하고 있으며, 3위는 조은희 서울 서초구청장으로 50.1억 원을 보유하고 있다. 경기 단체장 중 최고 부동산 부자는 엄태준 이천시장으로 47억 원을 보유하고 있다. 상위 10위에는 포함되지 않았으나 인천 단체장 중에서는 이재현 서구청장이 15.5억 원을 보유해 가장 많았다. 지역별 주택가격의 격차가 기초단체장의 자산 격차로도 이어진 것으로 판단된다.

특히 김영종, 정순균, 조은희, 엄태준 등 상위 4명의 단체장은 34억~72억 원의 상가건물을 보유한 상가 부자인 것으로 나타났다. 정부는 부동산 가격 급등 원인을 다주택자의 투기로 국한하여 주택 보유세만 올리고, 상가건물 등의 보유세는 전혀 올리지 않았다. 때문에 수십 억 원대의 상가건물을 보유한 상가 부자 단체장들도 보유세 특혜가 막대할 것으로 예상된다. 게다가 상가건물의 신고가액은 주택 공시가격보다 시세반영률이 더 낮은 공시지가로 신고되고 있고, 주소지 상세 내역도 비공개되고 있어 시세파악조차 어려운 현실이다.

본인, 배우자 기준 다주택자는 65명 중 16명으로 24%나 되는 것으로 나타났다. 특히 다주택 보유 상위 5명의 주택 수는 34채로 1인당 평균 7채씩 보유하고 있다. 다주택 1위는 백군기 용인시장으로 14채를 보유하고 있다. 이 중 13채는 배우자 명의로 보유한 한남동 연립주택이며, 1채는 서초구 방배동 아파트이다. 본인의 지역구에는 임차권만 소유하고 있다. 다주택 2위는 서철모 화성시장으로 9채의 주택을 소유하고 있다. 이 중 충청도에 단독주택 1채를 제외하고는 연식이 20년 이상 된 소규모의 주공아파트만 8채를 소유하고 있다. 본인 명의 6채 아파트와 배우자 명의로된 2채의 아파트를 소유하고 있다. 아파트 위치도 고양시와 군포시로 언제든지 재개발 또는 재건축이 진행될 수 있는 지역으로 판단되기에 부동산 투기에 대한 의심을 걷을 수 없다. 이 외 성장현 서울 용산구청장, 문석진 서대문구청장도 각각 4채씩 보유하고 있다.

수도권 65명의 부동산 재산 분석결과, 선출직 기초단체장들도 국민 보유 부동산 재산의 4배 정도를 보유하고 있고, 다주택 비중은 24%나 됐다. 때문에 문재인 정부 이후 집값 상승에 따른 국민 고통을 외면하고 국민 눈높이에서 집값 거품을 제거하기 위한 부동산정책 개혁에 적극 나서지 못한 것이 아닌지 의구심을 가질 수밖에 없다. 문재인 정부 출범 이후 지난 3년 동안 집값 폭등으로 불로소득 주도 성장이 지속되는 가장 큰 원인은 이 정부의 정책 결정권자인 중앙정부와 지방정부의 고위공직자 책임이 크다.

경실련 보도 이후 백군기 용인시장은 ‘실제 내 집은 아들과 공동소유한 아파트 한 채뿐입니다’라는 해명자료를 발표하며 13채 연립주택 1동이 재혼한 배우자가 보유한 소형 원룸 13개의 낡은 연립주택으로 본인 재산이 아님을 강조했다. 경실련은 백 시장의 본질과 상관없는 엉뚱한 해명을 비판하며 공직자로서 부동산 관련 안이한 인식이 드러났음을 지적했다. 고위공직자들에게는 더욱 엄격한 기준이 적용되어야 한다. 경실련은 우리나라 고위공직 사회가 투명하고 깨끗해졌다고 판단될 때까지 공직자들의 자산이 얼마나 되는지 얼마나 성실하게 신고했고 어떤 자산을 보유했는지 등을 계속 알려 나갈 것이다.

질병은 같아도 병원비는 천차만별

병원비는 예측하기 어렵다. 병원 한 번 가서 생각지도 못한 고액의 청구서를 받고 놀란 경험도 있겠지만, 병원에 꾸준히 방문해야 하는 중증환자들에게는 총 진료비의 실체가 두려워 막막한 경우도 있다. 뭐라 부르든 질병을 치료하고 예방하기 위해 발생하는 비용은 기호식품이나 사치품을 고르고 지불하는 금액과는 다르다. 건강과 생명을 유지하기 위해 필수적인 지출이기에 대다수 국민에게 병원비는 건강과 생계에 직접적인 영향을 미친다.

우리나라는 보건의료정책을 시행하여 의료비로 인한 어려움에 대비한다. 건강보험과 같은 사회보장제도를 만들어 국민에게 보험료를 강제로 징수하고, 아플 때 병원비를 지원하는 식이다. 경실련은 이러한 사회보장제도가 제대로 정착하여 모든 국민이 의료비 부담에서 벗어나고 의료서비스를 차별 없이 이용하길 바란다. 국민 의료비 부담을 덜기 위한 방안과 대안 정책을 마련하기 위해 예측이 힘들고 과도해 보이는 의료비의 실태가 필요했다. 그래서 비급여에 주목해 병원별 가격실태를 비교·분석해보았다.

“비급여”

비급여는 쉽게 말해 국가에서 비용을 지원해주지 않는 진료 항목을 말한다. 지원이 없다 보니 금액이 나오는 대로 환자 본인이 전액을 부담해야 한다. <그림 1>처럼 진료 영역은 건강보험이 적용되는 급여(A)와 적용되지 않는 비급여(B)로 나뉜다. 만약 내가 받는 진료가 급여(A) 항목일 경우 일부는 건강보험공단(A1)이 나머지는 환자 본인(A2)이 부담한다. 여기에 급여 항목이 아닌 비급여(B) 항목을 함께 진료받았다면 금액이 추가되기 때문에, 우리가 직접 내는 병원비는 ‘A2+B’가 된다.

결국 우리가 내는 병원비는 국가의 건강보험 혜택을 받아 일정 부분이 차감된 비용이다. ‘건강보험이 적용되는 영역인데 나도 어느 정도는 부담해야 하는 금액(A2)’과 ‘건강보험이 적용되지 않아서 그냥 다 내야 하는 금액(B)’인 것인데 예측할 수 없는 의료비 문제는 바로 B 때문이다. 이 비급여 가격은 시장에서 마음대로 결정되므로 우리가 어떤 병원을 가는지에 따라 그 수준이 천차만별이다.

경실련은 비급여의 꽃이라 불리는 MRI와 초음파 검사비를 알아보았다. 그중에서도 환자들이 가장 많이 이용하는 부위별 항목으로 선정했고, 해당 항목을 운영하는 병원별로 가격을 종합했다. 종합병원급 이상, 즉 상급종합병원과 종합병원의 전수를 조사했으니 우리가 흔히 대형병원으로 알고 있는 곳은 모두 조사했다고 보면 된다.

결과적으로 동일한 항목의 비급여 가격임에도 병원에 따라 최대 70만 원 차이가 났다. 옵션 없는 기본으로 조사했고 회당 가격을 구했을 뿐이니 실생활에서 가격 편차는 더 크게 벌어질 수 있다. 건강보험이 적용되는 급여 가격은 국가가 적정하다고 판단한 기준 가격이 있지만, 비급여 가격은 각 병원에서 자체적으로 설정하다 보니 이렇게 큰 격차가 발생한다. 어느 병원을 고르는지에 따라 의료비 폭탄이 떨어질 수 있는 것이다.

건강보험 환자에게 부여되는 비급여는 통제가 필요하다.

가격이란 유동적이며, 상대적인 가치를 지닌다. 어떤 병원에서는 비싸고, 또 어떤 병원에서는 저렴한 것이 자연스럽다고 생각할 수 있다. 그런데 의료비 수준을 평가하고 관리하는 이유는 처음으로 돌아가 사회보장제도의 특성 때문이기도 하다. 우리는 미리 국가에 병원비를 지불하고 병원에 갈 일이 생기면 일정 부분 돌려받는다. 건강보험의 재원은 우리 주머니이고, 건강보험 환자에게 부과되는 비급여는 마땅히 국가 통제의 대상인 것이다.

경실련은 건강보험 환자에게 부과되는 비급여 진료비의 완전 공개와 이를 통한 철저한 비급여 관리를 촉구한다. 미용 목적의 성형수술, 피부과 시술 등과 같이 건강보험료 투입이 필요 없는 선택적 진료 영역은 그냥 두거나 과도할 경우 비난 한 번 하면 그만이다. 그러나 필수치료를 위해 국민에게 징수한 건강보험료는 투입부터 활용까지 세밀하게 감시하고 관리해야 한다. 우리가 낸 재원에 대해 의료기관 수익의 측면에서만 바라보아 철저히 숨기려 하는 것은 사회구성원으로서 이기적이고 옳지 않은 자세다. 의료서비스가 가지고 있는 공적 특성, 건강보험이라고 하는 사회보장시스템의 통제 필요성 등을 고려하여 사회 각 주체들이 국민 의료비 부담을 덜기 위한 정책적 합의에 이르길 바란다.
