경실련 등 RLA 수상단체 및 수상자 공동 핵무기 철폐  UN 탄원서 제출

 

지속 가능한 미래를 보장하기 위해 세계 미래 협의회 (World Future Council, WFC) 회원들과 대안 노벨상 (바른생활상: Right Livelihood Awards, RLA) 수상자들은 핵무기 폐기를 촉구했습니다. 1월 19일 발표 된 공동성명에서 58명의 WFC 회원들과 RLA 수상자들은 지속 가능한 미래를 보장하기 위해 정부가 핵 위험 감소 및 군축에 대한 조치를 취할 것을 촉구하였습니다.

해당 성명은, 1월 20일 조셉 바이든 미국 대통령의 취임식과 1월 22일 핵무기 금지 조약의 발효를 위한 UN 최초 성명인 제 1호 결의안의 75 주년에 맞춰 발표됐습니다. 지난 1946년 1월 24일에 채택 된 UN 총회 결의안 제1호에서 “핵무기 및 기타 대량 살상 무기 제거”라는 전 지구적인 목표를 설정한 바 있습니다.

“183개 당사국들이 참여한 ‘생물 및 독소 무기 협약 (1972)’에서 생물학무기를 폐지했으며, 193개 당사국들이 참여한 ‘화학 무기 협약 (1993)’에서 화학무기를 폐지하였습니다. 이제, 우리는 3등급 대량 살상 무기인 핵무기를 폐지 할 때입니다.”—Paul Walker (미국) 군축운동연합 부의장 / RLA 2013년 수상자

“9개의 핵무장 국가들이 보유한 14,000개의 핵무기는 인류와 미래 세대에 실존적 위협이됩니다. 핵무기는 전염병을 해결하거나, 기후변화를 안정시키고 지속가능발전 목표를 달성하는 데  필요한 재정과 인적 자원을 소비하는 데 쓸모가 없으며, 무력 사용이나 위협 없이 평화적 방법으로 UN 회원국들의 분쟁을 해결할 것을 명시하는 UN헌장에 위배되는 것입니다.”—Maria Fernanda Espinosa, WFC 회원 / 제73차 UN총회 의장

Joint statement by World Future Council members and Right Livelihood Laureates on the occasions of the Entry-into-Force of the Treaty on the Prohibition of Nuclear Weapons and the 75th anniversary of UN Resolution 1 (1)

 

We, Right Livelihood Laureates and members of the World Future Council, express deep concern about the existential threat to humanity and the planet from the 14,000 nuclear weapons possessed by nine nuclear-armed States, many of them poised for use at a moment’s notice by decision of unstable leaders or through use by accident, miscalculation or crisis escalation.

 

The production, deployment, testing, use and threat to use nuclear weapons violate the Right to Life and other international law, threaten current and future generations, provoke international conflicts and consume resources required to address the COVID-19 pandemic and climate change, and to achieve the Sustainable Development Goals.

The very first resolution of the United Nations General Assembly, UN Res 1 (1) which was adopted by consensus on January 24, 1946, established the UN goal of the elimination of nuclear weapons and other weapons of mass destruction. It is time to fulfil that goal.

On January 22, 2021, the Treaty on the Prohibition of Nuclear Weapons (TPNW) will enter into force making it illegal for States Parties to develop, test, produce, manufacture, acquire, possess, deploy, use or threaten to use nuclear weapons or to assist or encourage such acts. The treaty is an important measure by the 51 non-nuclear countries who have ratified, and others who may subsequently join, to advance the abolition of nuclear weapons through national nuclear prohibition measures and international promotion.

We encourage all ratifying states to adopt comprehensive implementing measures, to include the prohibition of the threat, use, production, testing, transit and financing of nuclear weapons within their territorial jurisdiction. In particular, the prohibition of nuclear weapons transit and financing, including public investments in the nuclear weapons industry, would impact considerably on the nuclear arms race and on the policies and practices of the nuclear-armed states.

In addition, we encourage the ratifying states to establish ministerial positions, public advisory committees and disarmament education funds to facilitate public education and effective policy to further advance the objective of a nuclear-weapon-free world, as has already been done, for example, in New Zealand.

The nuclear armed and allied states have said that they will not join the Treaty. As such, they will not be bound by it. However, they cannot escape their individual and collective obligations to achieve nuclear disarmament. They agreed to this in UNGA Resolution 1 (1). Most of them also agreed to this in joining the Non-Proliferation Treaty, Article VI of which requires them to achieve nuclear disarmament. In addition, they are bound by customary international law prohibiting the threat or use of nuclear weapons as affirmed by the International Court of Justice in 1996 and the UN Human Rights Committee in 2018.

The Entry-into-Force of the TPNW on January 22, and the 75th anniversary of UNGA Resolution 1 (1) on January 24, 2021, provide opportune occasions for non-nuclear governments and civil society to remind the nuclear armed and allied states of the illegality of the threat or use of nuclear weapons and of their nuclear disarmament obligations, and call on them to implement these immediately.

The nuclear armed and allied states claim that they require nuclear deterrence for their security. However, they have a legal obligation under the UN Charter (Article 2) to achieve security without reliance on the threat or use of force in their international relations. In addition, the UN and many regional bodies and treaty organisations, provide mechanisms for achieving security and resolving conflicts through common security approaches including diplomacy, negotiation, mediation, arbitration and adjudication – instead of through militarism and war.

And, if we have learned anything from the climate crisis, unprecedented biodiversity loss and the COVID-19 pandemic, it is that militarism and weapons, including nuclear weapons, are useless in addressing the key human security issues of today and tomorrow.

The 1972 Biological and Toxin Weapons Convention (BTWC), with 183 States Parties, has abolished biological weapons, and the 1993 Chemical Weapons Convention (CWC), with 193 States Parties, has abolished chemical weapons.  It is now time to abolish the third class of weapons of mass destruction, nuclear weapons.

Measures the nuclear-armed and allied states should take include;

  1. Affirm that nuclear war cannot be won and must never be fought, stand down their nuclear forces and affirm policies never to initiate a nuclear war;
  2. Replace nuclear deterrence with security frameworks based on human security and common security, including acceptance of the compulsory jurisdiction of the International Court of Justice for international disputes not resolved by other means;
  3. Collectively join the TPNW, or alternatively start negotiations in a series of Summits or in a UN negotiating forum on the elimination of nuclear weapons under strict and effective international verification and enforcement;
  4. Cut nuclear weapons budgets, end investments in the nuclear weapons industry, and redirect these investments and budgets to support the United Nations, COVID-19 management and recovery, drastic reductions in carbon emissions to protect the climate, achievement of the Sustainable Development Goals, and public education for disarmament and the peaceful resolution of conflict; and
  5. Commit to achieving the complete, global elimination of nuclear weapons no later than 2045, the 100th anniversary of the United Nations.

In this way, humanity can abolish nuclear weapons and help assure a sustainable future.

해외학자들, 조희연 교육감 무죄 촉구를 위한 공개 탄원

해외학자들이 공개 탄원서를 작성하고 한국 재판부에 조희연 교육감의 무죄를 촉구해 화제다. 해외학자들은 1심에서 선거법 위반으로 유죄 판결을 받은 조 교육감을 위해, 2심을 주관할 김상환 재판장에게 무죄 판결을 요구하는 공개 탄원서를 전달할 예정이다. 이 탄원서에는 23일 오후 6시 (미 동부) 현재 7개국에서 44명이 서명했다.

해외학자들은 공개 탄원서에서 한국에서 민주주의가 후퇴하고 언론과 표현의 자유가 잠식되어 가는 것에 깊은 우려를 금치 못한다고 말했다. 또 선거 과정에서 내놓은 의견을 기소하는 것은 표현의 자유라는 정당한 권리가 침탈당하는 명백한 사례라고 못 박으며 조 교육감에 대한 허위사실 공표로 인한 당선무효는 부당하다고 주장했다.

이들은 세계인권위원회가 명예훼손의 비 형사 범죄화와 더불어 형사법의 엄격한 적용을 권고하고 있고, 세계 여러 나라에서 명예훼손을 비 형사범죄하고 있다고 말했다. 특히 선거 시기에 후보자에 대한 비판과 검증에 대해서는 최대한의 자유가 보장되어야 하며, 한국의 사법부도 이런 세계적 추세와 원칙을 존중하여야 할 것이라고 당부했다.

조 교육감의 선거법 위반 사건과 관련하여, 조희연 교육감은 결코 허위사실을 말하거나 지어내지도 않았을뿐더러, 그가 제기한 의혹은 이미 잘 알려진 언론인에 의해 불거졌으며 인터넷을 통해 광범위하게 퍼져 나가고 있었다고 지적했다.

또 조 교육감이 상대편 후보와 관련한 의혹을 제기한 이유는 유권자들이 충분한 정보를 갖고 결정을 내리도록 돕기 위함이었다고 말하고, 이는 민주주의의 요체이자 핵심적인 정치적 표현의 자유에 속하는 것으로, 허위사실 공표로 단죄하는 것은 옳지 않다고 주장했다.

해외학자들은 프리덤하우스, 국경없는기자회, 국제앰네스티, 오픈넷이니셔티브, 유엔인권위원회, 표현의자유 유엔특별보고관 등 여러 국제기구가 한국에서 표현의 자유가 점점 더 악화하여 가고 있다고 평가하고 있으며, 재판부는 이러한 국제사회의 우려를 이해해야 한다고 말했다.

이들은 한국의 인권과 표현의 자유에 관심이 있는 전 세계의 많은 사람들이 이 사건을 지켜보고 있다고 말하고, 재판부의 현명한 판결을 부탁한다고 거듭 촉구했으며, 국적을 막론한 해외 지식인들에게 지지해달라고 호소했다.

조희연 서울시 교육감은 지난해 6월 교육감 선거 당시, 상대편 후보였던 고승덕 후보에게 그와 두 자녀의 미국영주권 소유 의혹을 해명할 것을 요구했으며, 한 보수 교육 단체의 고발로 기소돼 1심에서 당선무효형인 벌금 500만 원을 선고받았다.

조 교육감은 재판 결과로 인해 선거에서 이뤄져야 할 표현의 자유와 언론의 자유가 위축되지 않길 바란다고 말하며 항소했으며, 대법원에서 유죄 확정 판결을 받을 경우 교육감직을 상실하게 된다.

존경하는 김상환 재판장님께.
저희들은 최근 조희연 서울시 교육감이 서울 중앙지방법원에서 공직선거법 제 250조 2항 허위사실 공표죄 위반으로 당선무효에 해당하는 벌금 500만원의 유죄판결을 받은 데 대해 큰 충격을 받았습니다. 그 사건(2015노1385)이 이제 재판장님의 제 6 형사부에 배당이 되어 있어, 외람되지만 저희들의 간곡한 의견을 전하고자 하오니 참고하여 주시면 대단히 감사하겠습니다.

저희들은 해외에서 한국의 민주주의와 인권에 커다란 관심을 갖고 있는 학자들로서, 특히 이 사건은 인간의 보편적인 표현의 자유와 인권과 밀접한 관련이 있어, 각자의 국적 여하와 상관없이 이 사건에 대한 의견을 표명하고 고려를 당부하는 일은 꼭 필요한 일이라고 믿습니다.

저희들은 지난 몇 년 사이 한국의 민주주의가 후퇴하고 언론과 표현의 자유가 조금씩 잠식되어 가는 것에 대해 깊은 우려를 가지고 있습니다. 이러한 변화는 명예훼손죄와 선거법의 남용, 북한과 관련한 논의를 막기 위한 국가보안법의 적용, 인터넷에 대한 정부통제 등 여러 형식으로 표현되고 있습니다. 특히 선거과정에서 내놓은 의견을 기소하는 발전된 산업국가에서는 극히 드문 현상을 보면서 한국에서 표현의 자유와 관련하여 민주주의를 사랑하는 많은 이들이 심각한 문제로 느끼는 것은 당연한 일일 것입니다. 안타깝게도 조희연 교육감의 재판은 해외에 거주하는 사람 들에게 표현의 자유라는 정당한 권리가 침탈 당하는 명백한 사례로 받아 들여 질 것입니다.

존경하는 재판장님.
저희는 대한민국에서 나타나고 있는 명예훼손의 과도한 형사범죄화와 선거운동의 제한 경향에 대해 새로운 접근이 필요하다고 생각합니다. 유엔 인권위원회는 명예훼손을 비(非)형사범죄화하거나 형사법의 적용은 매우 심대한 사안에 한해 엄격하게 적용해야 한다고 권고하고 있고, 세계 여러 나라가 명예훼손을 비(非)형사범죄화하고 있습니다. 특히 선거시기 후보자에 대한 비판과 검증에 대해서는 최대한의 자유가 보장되어야 하며, 국가가 후보자의 정견과 후보의 적격성을 제기하는 것을 막거나 유권자가 그에 대해 토론하는 것은 막아서는 안되며, 후보자간 공방에 대해 진실과 허위에 관한 최종적인 판단은 원칙적으로 유권자의 몫이어야 한다는 것이 국제사회의 추세이자 합의입니다. 한국의 사법부도 이런 세계적 추세와 원칙을 존중하여야 한다고 믿습니다.

존경하는 재판장님.
저희가 알기로 조 교육감은 선거 과정에서 기자회견을 열어 고승덕씨가 미국 영주권자라고 말한 일이 없으며, 단지 미국 영주권자라는 의혹에 대해서 해명을 하라는 요구를 한 적이 있을 뿐입니다. 조희연 교육감은 결코 허위사실을 말한 바가 없고, 허위사실을 지어 내지도 않았습니다. 이 의혹은 잘 알려진 언론인이 제기하였고, 인터넷을 통하여 광범위하게 퍼져 나가고 있는 상황이었습니다. 교육감 선거라는 상황을 고려할 때, 유권자들이 교육감 후보와 그 자녀들이 영주권자인지 여부에 대해 유권자에게 알리라고 하는 것은 지극히 정당한 의견의 표명이었습니다. 이를 허위사실 공표로 단죄하는 것은 옳다고 보기 어렵습니다. 제기되고 있는 의혹에 대하여 확인 또는 부인을 할 수 있는 능력이나, 또 그렇게 해야 할 책임을 가진 사람은 조교육감이 아니라 고승덕 후보였습니다. 왜냐하면 고후보 만이 그 자신과 자녀들의 영주권 보유 여하에 대한 직접적 당사자만이 알 수 있는 정보를 가지고 있기 때문입니다. 실제로 고후보는 자신의 미국비자를 보여 줌으로써 영주권을 가지고 있지 않다는 점을 신속하고 설득력 있게 밝혔고, 두 후보간의 논쟁은 며칠 사이에 종식이 되었습니다.

또 조교육감이 “고승덕 후보는 미국 영주권을 취득하였다”고 말한 적이 없으며, 오히려 그러한 의혹이 여러 곳에서 제기되고 있으므로 고후보가 진실을 밝혀 이 의혹을 잠재우기를 제안한 것에 불과함을 말해 두고자 합니다. 1심 재판에서 “고후보는 영주권을 가지고 있다”라는 진술과 “고후보가 영주권을 가지고 있다는 의혹이 제기되고 있다”라는 진술 사이의 중대한 차이를 일축해 버렸지만, 이 두 진술은 실체적으로나 함의에 있어서나 중대한 차이가 있음이 틀림없습니다.

조교육감이 고후보의 영주권 보유와 관련한 의혹의 존재를 제기한 이유는 유권자들의 잠재적 이익이 될 수 있는 사안에 대하여 진실을 밝힐 필요가 있었기 때문이었습니다. 고 후보의 영주권 보유 여부를 투표에 반영할 것인지 아닌지는 궁극적으로 유권자들의 몫이었습니다. 후보자들이 선거기간에 유권자들이 충분한 정보를 갖고 결정을 내리도록 돕기 위하여 상대방에 대해 정보를 요구하는 진술을 하는 것은 제대로 작동하는 민주주의의 요체이자 핵심적인 정치적 표현의 자유에 속한다고 하겠습니다.

한국법을 해석하는 일은 한국법원의 몫이지 저희 같은 국외자가 할 일은 아닙니다. 하지만 법원은 한국의 민주주의의 동맹국과 유엔을 포함한 국제 사회가 한국의 표현의 자유의 현 상황에 대해 갖고 있는 우려를 이해해야 합니다. 한국은 세계 15위의 경제대국이며, 공고화되어 가는 민주주의로 널리 인정을 받고 있고, 또 폭압적인 독재체제가 북쪽에 자리잡고 있는 한반도에 중대한 희망의 등불이라고 할 수 있습니다. 때문에 프리덤하우스, 국경없는 기자회, 국제엠네스티, 오픈넷이니셔티브, 유엔인권위원회, 표현의자유 유엔특별보고관 등 여러 국제기구들이 한국의 표현의 자유가 점점 더 악화되어 가고 있다는 자료를 내놓는 것을 보며 특히 더 가슴 아프게 느낍니다.

한국의 인권과 표현의 자유에 관심을 가지고 있는 전세계의 많은 사람들이 이 사건을 지켜보고 있습니다. 조희연 후보가 고승덕 후보에게 영주권 관련 의혹의 해명을 요구한 것은 허위사실 유포라 볼 수도 없으며, 선거 결과에 실제로 영향을 끼친 사안도 아닙니다. 저희는 고등법원에서 이 사건의 전심 판결을 바로 잡아서, 조교육감이 선거를 통하여 부여 받은 책무를 잘 수행할 수 있게 해 주시기를 진심으로 부탁드립니다. 감사합니다.

Open Letter to the Appellate Court in Support of Seoul Education Superintendent Dr. Cho Hee-yeon

Dear Presiding Judge Kim:

We are writing with respect to the case of Dr. Cho Hee-Yeon, Superintendent of Education for Seoul Special Metropolitan City (2015No1385), in which the lower court found Dr. Cho guilty of proclaiming false facts under Article 250-2 of Public Official Election Act. We understand this case is currently before your court, and with your permission we would like to comment on the merits of the case as we understand it.

We are scholars concerned about democracy and human rights in Korea. We believe that we can legitimately voice our concerns about this case regardless of our nationalities, because it is related to the universal human right to freedom of expression.

For some time, we have been concerned about the subtle erosion of freedom of expression in South Korea. This development has manifested itself in several ways, including the abuse of criminal defamation and campaign laws, the use of the National Security Law to stifle debate on North Korea, and government control of the internet. Now, it appears that the prosecution of an opinion made during the election campaign—unusual among the advanced industrial states—is yet another reason for democracy advocates to be concerned about the freedom of expression in South Korea. Sadly, it appears to outsiders that the case of Dr. Cho is a high-profile example of a legitimate right to freedom of speech being curtailed.

We believe that the current South Korean court’s approach to excessive criminalization of defamation and restriction of election campaign should be changed. The UN Human Rights Committee recommends that all member states should consider decriminalizing defamation, emphasizing that the application of the criminal law should only be countenanced in the most serious of cases. In particular, it is a widely accepted norm in the international community that free speech during election campaigns should be fully guaranteed. A state should not bar the candidates from freely presenting their views and qualifications, nor prevent the voters from learning and discussing them. The consensus is that not the state but the voters should decide the right and wrong of the political controversies between the candidates. We hope that South Korean courts will respect the standards of the international human rights community.

As we understand the case, Dr. Cho conducted a press conference during his campaign for the Superintendent of Education, requesting his opponent Mr. Ko Seung Duk to tell the truth and present evidence about the allegation that he and his two daughters have had permanent residency in the United States. We understand that Dr. Cho did not fabricate this allegation. The allegation had been already raised by a well-known journalist and had been widely disseminated on the internet. In the context of a campaign for the Superintendent of Education, it seems legitimate that voters have information on the permanent residency of the candidates and their children. The person with the ability (and indeed, the responsibility) to confirm or deny this allegation was Mr. Ko not Dr. Cho, as it was Mr. Ko who has direct and personal knowledge of the residency of himself and his children. Indeed, Mr. Ko quickly and convincingly showed that he had not had a green card while in the U. S. by presenting copies of his visas. Thus the controversy between the two candidates was resolved in a couple of days. Also, we understand the election was determined by other issues and this controversy about U.S. permanent residency did not make any significant difference to the election outcomes.

It is also worth noting that Dr. Cho did not say that “Ko Seung Duk had obtained permanent residency in the United States” but rightly stated there were allegations to this effect and asked him to tell the truth about it. While the lower court discounted the important difference between “Mr. Ko had had permanent residency” and “there are allegations that Mr. Ko had had permanent residency,” the two statements are significantly different in substance and connotation.

It is undisputed that there were allegations concerning Mr. Ko’s residency. The point of raising these allegations was to discover the truth with respect to an issue of potential interest to voters. It is ultimately up to voters to decide whether the issue of Mr. Ko’s permanent residency should influence their vote. Statements by candidates during election campaigns that seek information about opponents to assist voters in making informed decisions constitute core political speech that lies at the heart of a functioning democracy.

The interpretation of Korean law is a matter for Korean courts, not for outsiders. Nevertheless, the court should be aware of concerns that exist among Korea’s democratic allies and the international community, including the United Nations, about the state of freedom of expression in the country. Korea is the world’s 15th largest economy, widely recognized as a consolidated democracy, and an important beacon of hope on the Korean peninsula, where it faces a repressive dictatorship in the North. It is thus particularly saddening to see evidence provided by a range of international organizations– Freedom House, Reporters without Borders, Amnesty International, OpenNet Initiative, United Nations Human Rights Committee, and UN Special Rapporteur on Freedom of Opinion and Expression—that South Korea has experienced a subtle erosion of freedom of expression.

We would like to remind you of the fact that many people around the world, deeply concerned about the fate of human rights and the freedom of expression in Korea, are closely watching the court proceeding in this case. Dr. Cho’s request for a clarification of the allegations concerning Mr. Ko’s permanent residency should not be viewed as an act of proclaiming false facts. Furthermore, the debate had not influenced the result of the election. In this regard, we genuinely hope that Seoul High Court will correct the trial court’s wrongful decision and that Dr. Cho can continue to work as the Superintendant of Education for Seoul Special Metropolitan City as mandated by the electorate.
