만평 작가 아테나 파르가다니와 그 변호사가 서로 악수를 나눈 것만으로 “간통에는 해당하지 않는 부적절한 성적 관계” 혐의로 재판을 받게 된 것은 터무니없고 지나칠 뿐만 아니라 명백히 정치적인 이유로 이루어진 것이라고 국제앰네스티가 밝혔다. 이들에 대한 재판은 3일 테헤란 일반형사법원에서 시작되었다.
국제앰네스티가 양심수로 간주하는 아테나 파르가다니와 그의 변호사 모하마드 모기미는 두 사람 모두 유죄가 선고될 경우 채찍질형 99번까지 처해질 수 있다. 국제앰네스티는 파르가다니가 표현의 자유를 행사했다는 이유만으로 두 사람이 구금되었다고 보고 있다.
라하 바레이니(Raha Bahreini) 국제앰네스티 조사관은 “이번 사건은 터무니없을 뿐만 아니라, 남녀가 악수를 나누는 것을 형사범죄로 간주하며 사생활의 권리를 명백히 침해하는 것”이라며 “이는 정치적인 이유로 이루어진 것으로, 이란 정부가 아테나를 괴롭히고 변호사가 제대로 변호하지 못하도록 막으려는 명백한 시도다. 이란 정부는 이처럼 젊은 양심수를 괴롭히고 위협하지 말고, 즉시 무조건적으로 기소를 취소하고 석방해야 할 것”이라고 말했다.
국제앰네스티가 파악한 바에 따르면 아테나 파르가다니는 4일 열린 재판에 직접 변호사를 선임하지 못했으며, 공정한 재판을 받지 못했을 우려가 있다.
아테나 파르가다니와 모함마드 모기미는 아테나의 재판이 열렸던 6월 13일, 교도소에서 악수를 나눴다가 “간통에는 해당하지 않는 부적절한 성적 관계” 혐의로 기소되었다. 당시 체포된 모함마드는 3일 후 약 6만 달러에 이르는 보석금을 내고 석방되었다.
지난 6월 아테나 파르가다니는 이란 국회의원들과 아야톨라 알리 카메네이 국회의장을 원숭이, 소 등의 동물로 묘사한 풍자 만평을 발표해 이들을 모욕한 혐의 등 다수의 죄목으로 징역 12년 9월에 처해졌다.
아테나가 2009년 이란 대통령 선거 이후 정부가 시위를 진압하는 과정에서 희생된 피해자 유족들의 권리를 공개적으로 옹호했던 것 역시 유죄 선고의 원인이 됐다.
교도소 수감 중에도 아테나는 교도관들로부터 성적 모욕과 욕설 등의 폭언을 들어야 했다. 아테나는 이에 항의하며 지난 9월 3일간 단식 투쟁을 벌였지만 괴롭힘은 계속되고 있다.
Iran: Indecency trial of jailed cartoonist and her lawyer for shaking hands absurd
The trial of satirical cartoonist Atena Farghadani and her lawyer on a charge of “illegitimate sexual relations falling short of adultery” after they shook hands is not only absurd and extreme but clearly politically motivated, said Amnesty International ahead of the General Criminal Court session starting tomorrow in Tehran.
Both Atena Farghadani, whom Amnesty International regards as a prisoner of conscience, and her lawyer Mohammad Moghimi may face up to 99 lashes if found guilty. The organization believes the cartoonist and activist has been detained solely for exercising her right to freedom of expression.

“It is clearly both absurd and a violation of the right to privacy to consider a man and a woman shaking hands as a criminal offence,” said Raha Bahreini, an Amnesty International researcher.
“These charges are politically motivated and they are a blatant attempt by the Iranian authorities to harass Atena and hinder her lawyer’s work representing her. Instead of subjecting this young prisoner of conscience to further harassment and intimidation, the Iranian authorities must immediately drop these charges and free her immediately and unconditionally.”
Amnesty International has learnt that Atena Farghadani is going to tomorrow’s hearing without having secured a lawyer of her own choice and fears that she won’t receive a fair trial.
Atena Farghadani and Mohammad Moghimi were charged with “illegitimate sexual relations short of adultery” after they shook hands in prison after her trial on 13 June. Mohammad was arrested, and released three days later after he had paid a bail amounting to around $60,000.
In June, Atena Farghdani was sentenced to 12 years and nine months in prison for multiple offences including insulting Iran’s MPs and its Supreme Leader Ayatollah Ali Khamenei after publishing a series of satirical cartoons depicting legislators as monkeys, cows and other animals.
Her conviction also stemmed from her speaking out publicly on the rights of the families of victims of the government’s crackdown following Iran’s 2009 presidential elections.
Whilst in prison, Atena Farghadani has been verbally abused with sexual slurs and other insults by both prison officials and guards. Despite a three-day hunger strike by Atena Farghadani in September, the harassment continues.
