Death penalty 2016: Alarming surge in recorded executions sees highest toll in more than 25 years

  • Dramatic surge in executions globally– highest number recorded by Amnesty International in more than 25 years
  • Three countries – Iran, Pakistan and Saudi Arabia – responsible for almost 90% of all recorded executions
  • For the first time ever, the majority of the world’s countries were abolitionist for all crimes after four more countries abolished the death penalty in 2015

A dramatic global rise in the number of executions recorded in 2015 saw more people put to death than at any point in the last quarter-century. The surge was largely fuelled by Iran, Pakistan and Saudi Arabia, Amnesty International found in its review of the global use of the death penalty.

At least 1,634 people were executed in 2015, a rise of more than 50% on the year before and the highest number Amnesty International has recorded since 1989. This total does not include China where thousands more were likely executed, but where death penalty data is treated as a state secret.

“The rise in executions last year is profoundly disturbing. Not for the last 25 years have so many people been put to death by states around the world. In 2015 governments continued relentlessly to deprive people of their lives on the false premise that the death penalty would make us safer,” said Salil Shetty, Amnesty International’s Secretary General.

“Iran, Pakistan and Saudi Arabia have all put people to death at unprecedented levels, often after grossly unfair trials. This slaughter must end.

“Thankfully, countries that execute belong to a small and increasingly isolated minority. The majority of states have turned their back on the death penalty, and in 2015 four more countries completely removed this barbaric punishment from the laws.”

Rise fuelled by Iran, Pakistan and Saudi Arabia

The global rise in executions was mainly fuelled by three countries, who together were responsible for 89% of all executions in 2015 (excluding China).

Pakistan continued the state-sanctioned killing spree it embarked on when it lifted a moratorium on civilian executions in December 2014. More than 320 people were sent to the gallows in 2015, the highest number Amnesty International has ever recorded for Pakistan.

Iran put at least 977 people to death in 2015, compared to at least 743 the year before – the vast majority for drug-related crimes. Iran is also one of the world’s last executioners of juvenile offenders, in flagrant breach of international law. The country put to death at least four people who were under 18 at the time of the crime for which they were convicted in 2015.

In Saudi Arabia, executions rose by 76% on 2014’s figures, as at least 158 people were put to death last year. Most were beheaded, but authorities also used firing squads and sometimes displayed executed bodies in public.

There were notable jumps in the number of executions recorded in some other countries as well, including Egypt and Somalia.

The number of countries executing rose, from 22 in 2014 to 25 in 2015. At least six countries who had not put anyone to death in 2014 did so in 2015, including Chad where executions were carried out for the first time in more than a decade.

The top five executioners in the world in 2015 were China, Iran, Pakistan, Saudi Arabia and the USA – in that order.

Several states, including China, Iran and Saudi Arabia, continued to sentence people to death for crimes – including drug trafficking, corruption, “adultery” and “blasphemy” – that do not meet the international legal standards of “most serious” to which the use of the death penalty must be restricted under international law.

Year of extremes

Despite the setbacks in 2015, the world continues its march towards abolition of the death penalty. Some developments last year offered hope and showed that countries that cling to the death penalty belong to an isolated minority.

Four countries completely abolished the death penalty from their laws in 2015 – Fiji, Madagascar, Republic of Congo and Suriname. Mongolia also passed a new criminal code abolishing the death penalty, which will take effect later in 2016.

For the first time ever, a majority of the world’s countries – 102 – have now fully abolished the death penalty. In total, 140 states across the globe are abolitionist in law or practice.

“2015 was a year of extremes. We saw some very disquieting developments but also developments that give cause for hope. Four countries completely abolished the death penalty, meaning the majority of the world has now banned this most horrendous of punishments,” said Salil Shetty.

“Whatever the short-term setbacks, the long-term trend is still clear: the world is moving away from the death penalty. Those countries that still execute need to realize that they are on the wrong side of history and abolish the ultimate cruel and inhuman form of punishment.”

REGIONAL SUMMARIES
Americas

The Americas region continued to make progress towards ending the use of the death penalty. For the seventh consecutive year, the USA was the only country to execute. The USA carried out 28 executions, the lowest number since 1991. The number of death sentences imposed (52) was the lowest number recorded since 1977. The US state of Pennsylvania imposed a moratorium on executions – all in all, 18 US states have fully abolished the death penalty.

Trinidad and Tobago was the only other country in the region apart from the USA to impose death sentences.

Asia-Pacific

There was a sharp increase in executions in Asia-Pacific in 2015, mainly due to Pakistan which accounted for almost 90% of all executions (excluding China) recorded by Amnesty International in the region. Bangladesh, India and Indonesia all resumed executions in 2015. In Indonesia, 14 people were put to death for drug-related offences during the year.

China remained the world’s top executioner, and Amnesty International believes that thousands of people were put to death and thousands of death sentences were imposed in 2015. There are signs that the number of executions in China has decreased in recent years, but the secrecy around the death penalty makes this impossible to confirm for certain.

Europe and Central Asia

Belarus was the only country in the region to use the death penalty. While the country did not execute anyone in 2015, at least two new death sentences were imposed.

Middle East and North Africa

Use of the death penalty spiked in 2015 in a region that is already an enormous cause for concern. All countries in the region – except Oman and Israel – imposed death sentences, while eight states executed people. At least 1,196 executions were carried out, an increase of 26% on the figures recorded for 2014, and mainly due to the rises in Iran and Saudi Arabia. Iran alone accounted for 82% of all executions recorded in the region.

Sub-Saharan Africa

There were both positive and negative developments in Sub-Saharan Africa. Madagascar and Republic of Congo both abolished the death penalty completely, and the number of death sentences imposed fell sharply from 909 in 2014 to 443 in 2015, mainly due to a reduction in Nigeria.

The number of executions recorded dropped slightly – from 46 to 43 – on the year before. Chad, however, resumed executions after more than twelve years when 10 suspected Boko Haram members were put to death by firing squad in August.

Amnesty International opposes the death penalty in all cases without exception, regardless of the nature or circumstances of the crime; guilt, innocence or other characteristics of the individual; or the method used by the state to carry out the execution. There is no evidence whatsoever that the death penalty is a more effective deterrent to crime than other forms of punishment.

South East Asia: Inaction paves theway for future refugee disaster

South East Asian governments have so far failed to take sufficient action to protect refugees and migrants one month after a key summit to address the crisis that saw thousands of people stranded on boats over the past months, Amnesty International said in an open letter today.

The SpecialMeeting on Irregular Migration in the Indian Ocean in Bangkok on 29 May brought 17 countries together to discuss the humanitarian crisis unfolding in the Andaman Sea and the Bay of Bengal.

“One monthafter the Bangkok summit, there are few signs that governments are doing what is necessary to address the desperate plight of migrants and refugees. There’s still inadequate coordination on search and rescue operations, and a lack of clear protection measures for people who have landed on their shores,” said Richard Bennett, Amnesty International’s Asia Pacific Director.

TheInternational Organization for Migration at one point in May estimated that there were as many as 8,000 people – refugees and migrants mainly from Myanmar and Bangladesh – stranded on boats close to Thailand.

Indonesia and Malaysia have since committed to providing temporary protection for up to a year for 7,000 people on the condition that third governments resettle or repatriate them.

The nextsailing season will likely start in October when seas are calmer and refugees and migrants will again take to boats to leave their home countries.

“Inactionnow could pave the way for disaster later. Although it might look like the worst of the immediate crisis at sea is over, it is likely to escalate again once the sailing season starts. Those facing persecutions in their home countries will continue to flee to seek asylum. It is crucial that regional governments put measures in place to ensure that more lives are not lost, and ensure there are safe and legal means for seeking asylum or migrating,” said Richard Bennett.

In the openletter, Amnesty International urges the governments of the Association of South East Asian Nations (ASEAN), Australia and Bangladesh to take urgent measures to address the crisis. ASEAN foreign ministers are scheduled to meet in Kuala Lumpur, Malaysia from 1-6 August 2015.
Measuresmust include stepping up coordinated search and rescue efforts, ensuring that human rights of migrants and refugees are protected and respected, and addressing the root causes of the current crisis, in particular by calling on thegovernment of Myanmar to end systematic discrimination against the Rohingya minority.

“Now is the time not to relax but to intensify efforts to address he situation of refugees and migrants who have or are likely to undergo dangerous journeys at sea. This latest episode in a long-standing crisis is by no means over and should be at the top of the agenda for regional governments. The upcoming ASEAN meeting is another opportunity to put in place comprehensive measures for regional action,” said Richard Bennett.

Rudi Netto

Pardon Snowden: A Response to the Washington Post

Joshua Franco (@joshyrama) is a Researcher/Advisor on Technology and Human Rights

Three years ago, when Edward Snowden was first revealed to be the source of news reports about unlawful mass surveillance programs by the US government, he said, “I don’t want public attention because I don’t want the story to be about me. I want it to be about what the US government is doing.”

Now, three years later, in the midst of a campaign by the ACLU, Human Rights Watch, Amnesty International and others to pardon Snowden, that risk appears to be greater than ever. A recent editorial by the Washington Post (and at least one other similar piece by Harvard professor Jack Goldsmith) are arguing against a pardon for Snowden. In doing so, they risk dangerously – and incorrectly – minimizing the gravity of the human rights abuses he revealed in an effort to deny a pardon to the whistleblower himself.

These arguments are based on a few flawed premises that need to be corrected.

Premise 1: There is no privacy overseas
The arguments are based on the premise that people outside the USA have no privacy rights. This is wrong.

The Washington Post distinguishes programs such as the cell phone metadata collection program under Section 215 of the PATRIOT ACT (which it grudgingly admits may have raised privacy concerns) and “overseas” programs such as PRISM, which it contends are “clearly legal, and not clearly threatening to privacy.”

Goldsmith likewise cites approvingly the idea that: “The problem is [Snowden] disclosed vastly more than [Section 215 surveillance], involving foreign intelligence not of Americans but of individuals who aren’t American citizens in other countries. No changes were generally made in those programs and Americans don’t really care.” Indeed, Goldsmith seems to believe there is a clear distinction to be made between domestic spying programs, which he concedes were in need of reform and greater transparency, and overseas spying, which he repeatedly states are “obviously lawful.”

For the rest of the world, where opposition to US spying is widespread, this is a difficult premise to accept. Even if these programs are “obviously lawful” under US law (a proposition that is hard to square with ongoing litigation), that says nothing about the question of whether US law comports with its international legal obligations. Nowhere in the numerous international human rights treaties to which the United States is party is there a get-out clause saying that a state’s human rights obligations end at their physical borders. As the United Nations High Commissioner for Human Rights and the Special Rapporteur on Human Rights and Counter-Terrorism have noted, states have an obligation to respect human rights in their surveillance operations overseas as well as at home. If that argument seems far-fetched to you, think how you would feel about foreign governments scooping up all of your personal communications.

Premise 2: “Overseas” surveillance does not affect Americans

The Post and Prof. Goldsmith believe “overseas” surveillance does not affect Americans. This is also incorrect.

Professor Goldsmith expresses bafflement at how the US Constitution could justify revelations of overseas spying. For example, he asks – presumably rhetorically – “why did [Snowden’s] oath to the Constitution justify disclosure that NSA had developed MonsterMind, a program to respond to cyberattacks automatically [?]” It is odd that he did not see fit to acknowledge Snowden’s answer to this question: “[MonsterMind] means violating the Fourth Amendment, seizing private communications without a warrant, without probable cause or even a suspicion of wrongdoing. For everyone, all the time.”

Without discussing the technical details of all the programs Snowden revealed, or those which Goldsmith cites, I think this response merits some reflection. It illustrates how, given the global and interconnected nature of the internet, there simply is no way to separate domestic and overseas spying in many cases.

It is comforting for people to believe that the Section 215 cell phone metadata program was the only NSA program affecting Americans, and that the other programs affect “only” the rest of the world, but even if this distinction were legally decisive, it is simply not true.

Consider section 702 of the FISA Amendment Act, the law used to justify mass surveillance programs such as PRISM and UPSTREAM that collect massive amounts of data from private company servers and fiber optic cables. These programs are not “targeted” in any meaningful sense – allowing tens of thousands of targets under a single order – and also impact Americans. As the Brennan Center for Justice has pointed out:
“The [US] administration routinely asserts that Section 702 of FISA targets only foreigners overseas. These statements create a false impression that only foreigners’ communications are sought or acquired. In fact, anyone who talks to or about a target is subject to surveillance.”

Moreover, the many – and largely unknown – programs authorized under Executive Order 12333 – also meant to be used only abroad – likely have massive impacts on Americans’ privacy.
Some of this is because the law allows collection of some types of information about Americans under these programs, but it is also due to the nature of the internet. When you log into a website that routes through foreign countries, when you store your information in “cloud” services that may be overseas, you may be subject to the surveillance of these “overseas” communications even without leaving your couch in the middle of the USA. In this interconnected world, it is just not possible to do mass surveillance in a way that leaves Americans unaffected.

Premise 3: A public interest defense would be a blank check for leakers

Those who argue that Snowden should come home to answer for his deeds in court tend to downplay the significance of the fact that the US Espionage Act contains no public interest defense. In other words, the question of whether the leaks were justified as revealing human rights abuses is simply immaterial to whether a leaker spends decades in prison or not. Given the cruel treatment meted out against Chelsea Manning, this omission in law all but guarantees that those who know of government wrongdoing are very unlikely to come forward about it.
The Washington Post admits this legal shortcoming but argue against a public interest defense by saying that “it’s not clear how the law could allow that without creating a huge loophole for leakers.”

This argument again betrays a lack of curiosity about the legal world beyond U.S. borders. Indeed, several countries allow this very defense, and many more require a showing of harm to justify penalizing whistleblowers in the first place, seemingly without disastrous consequences for their national security. And if further clarity is needed, the Washington Post could do worse than to consult the Tshwane Principles on National Security and the Right to Information, drafted after a global consultation that included government representatives, and which explicitly lay out the terms for a public interest defense. The Parliamentary Assembly of the Council of Europeendorsed the Tshwane Principles after considering whistleblower protections in relation to the Snowden case.

Both the Washington Post and Professor Goldsmith devote a good deal of space to arguing that the harm Snowden’s revelations did to national security was significant, and that he should thus not be pardoned. But the public interest defense is not about arguing that a leak did no harm, but rather that it could be outweighed by its good.

And this belies the very problem with the lack of whistleblower protections in US law. The Post and Goldsmith base their opposition to a pardon on their own assessment of the relative harm and benefit of Snowden’s leaks, but this is exactly the debate that a US court would not be allowed to have. Good faith revelations of human rights abuses should not lead to prosecution, but if they do, it is essential that this defense be available. In its absence, we are left having to depend on the government’s argument of “trust us, but we can’t show you any evidence.” Some people may instinctively want to trust the government on this, but if Snowden’s leaks havetaught us anything, it should be that we need to be able to verify the government’s claims.

World leaders’ neglect of refugees condemns millions to death and despair

  • Worst refugee crisis since World War II.
  • One million refugees desperately in need of resettlement.
  • Four million Syrian refugees struggling to survive in Turkey, Lebanon, Jordan, Iraq and Egypt.
  • More than three million refugees in sub-Saharan Africa, and only a small fraction offered resettlement since 2013.
  • 3,500 people drowned while trying to cross the Mediterranean Sea in 2014 — 1,865 so far in 2015.
  • 300 people died in the Andaman Sea in the first three months of 2015 due to starvation, dehydration and abuse by boat crews.

World leaders are condemning millions of refugees to an unbearable existence and thousands to death by failing to provide essential humanitarian protection, said Amnesty International as it published a new briefing in Beirut today, ahead of World Refugee Day on 20 June.

The Global Refugee Crisis: A conspiracy of neglect explores the startling suffering of millions of refugees, from Lebanon to Kenya, the Andaman Sea to the Mediterranean Sea, and calls for a radical change in the way the world deals with refugees.

“We are witnessing the worst refugee crisis of our era, with millions of women, men and children struggling to survive amidst brutal wars, networks of people traffickers and governments who pursue selfish political interests instead of showing basic human compassion,” said Salil Shetty, Amnesty International’s Secretary General.

We are witnessing the worst refugee crisis of our era, with millions of women, men and children struggling to survive amidst brutal wars, networks of people traffickers and governments who pursue selfish political interests instead of showing basic human compassion.
Salil Shetty, Amnesty International’s Secretary General.

“The refugee crisis is one of the defining challenges of the 21st century, but the response of the international community has been a shameful failure. We need a radical overhaul of policy and practice to create a coherent and comprehensive global strategy.”

Amnesty International is setting out a proposal to reinvigorate the system for refugee protection and urging states to make firm commitments to live up to their individual legal obligations and renew their commitment to international responsibility-sharing. Amongst the actions Amnesty International is urging governments to take are:

  • A commitment to collectively resettle the one million refugees who currently need resettlement over the next four years.
  • To establish a global refugee fund that will fulfil all UN humanitarian appeals for refugee crises and provide financial support to countries hosting large numbers of refugees.
  • The global ratification of the UN Refugee Convention.
  • To develop fair domestic systems to assess refugee claims and guarantee that refugees have access to basic services such as education and healthcare.

“The world can no longer sit and watch while countries like Lebanon and Turkey take on such huge burdens. No country should be left to deal with a massive humanitarian emergency with so little help from others, just because it happens to share a border with a country in conflict,” said Salil Shetty.

Salil Shetty.
“Governments across the world have the duty to ensure people do not die while trying to reach safety. It is essential that they offer a safe haven for desperate refugees, establish a global refugee fund and take effective action to prosecute trafficking gangs. Now is the time to step up protection for refugees, anything less will make world leaders accomplices in this preventable tragedy.”

Syria: World’s largest refugee crisis

More than four million refugees have fled Syria, 95% of them are in just five main host countries: Turkey, Lebanon, Jordan, Iraq and Egypt.

These countries are now struggling to cope. The international community has failed to provide them, or the humanitarian agencies supporting refugees with sufficient resources. Despite calls from the UNHCR, the UN Refugee Agency, far too few resettlement places have been offered to Syrian refugees.

The situation is so desperate that some of Syria’s neighbours have resorted to deeply troubling measures, including denying desperate people entry to their territory and pushing people back into the conflict.

Since the beginning of 2015, Lebanon has severely restricted entry to people fleeing Syria. The Lebanese authorities issued new guidelines whereby Syrian nationals are required to fulfil specific criteria in order to enter. Since these criteria were imposed, there has been a significant drop in registration of Syrian refugees – in the first three months of 2015 UNHCR registered 80% fewer Syrian refugees than in the same period in 2014.

Mediterranean: The most dangerous sea route

The Mediterranean is the most dangerous sea route for refugees and migrants. In 2014, 219,000 people made the crossing under extremely dangerous conditions and 3,500 died attempting it.

In 2014, the Italian authorities rescued over 170,000 people. However in October 2014, Italy, under pressure from other EU member states, cancelled the rescue operation, Mare Nostrum, which was replaced by the much more limited Operation Triton (by the EU border agency, Frontex).

Operation Triton did not have a sufficiently broad search and rescue mandate, had fewer vessels and a significantly smaller area of operation. This contributed to a dramatic increase in the number of lives lost in the Mediterranean. As of 31 May 2015, 1,865 people had died attempting the Mediterranean crossing, compared to 425 during the same period in 2014 (according to the IOM).

Follow several horrific cases of loss of life in the Mediterranean, at the end of April, European leaders finally increased resources for search and rescue. Triton’s resources and area of operation were increased to match Mare Nostrum’s. In addition European states such as Germany, Ireland and the UK have deployed ships and aircrafts, additional to Operation Triton resources to further boost capacity for assisting people at sea. These measures, which had long been advocated for by Amnesty International, are a welcome step towards increasing safety at sea for refugees and migrants.

The European Commission also proposed that EU states offer 20,000 additional resettlement places to refugees from outside the EU. While this proposal is a step forward, 20,000 is too small a number to adequately contribute to international responsibility-sharing.

For example, Syrian refugees faced with reduced humanitarian assistance in the main host countries and with no prospect of returning home in the near future, are likely to continue to attempt to cross the Mediterranean to reach Europe. Without sufficient safe and legal alternative routes for refugees – but also for migrants – people will continue to risk their lives.

Africa: Forgotten crises

There are more than three million refugees in sub-Saharan Africa. Outbreaks of fighting in countries including South Sudan and the Central African Republic (CAR), have led to an increasing number of people on the move – fleeing conflict and persecution. Of the top 10 countries globally from which people are fleeing as refugees, five are in are in sub-Saharan Africa. Four of the top ten refugee-hosting countries are in sub-Saharan Africa

The conflicts and crises in the region have led to an influx of refugees to neighbouring countries, many of which already host tens of thousands of long-standing refugee populations from countries such as Somalia, Sudan, Eritrea and Ethiopia, among others.

In some of these situations, as in the case of South Sudan and Sudan, refugees are hosted by countries that are themselves beset by conflict.

The refugee crises in Africa receive little or no attention in regional or global political forums. In 2013 fewer than 15,000 refugees from African countries were resettled and UN humanitarian appeals have been severely underfunded. For example, as a result of the conflict which broke out in South Sudan in December 2013, more than 550,000 people became refugees, the majority of whom are now in Ethiopia, Sudan, Kenya and Uganda. Only 11% of the UN’s South Sudan regional refugee response plan was funded as of 3 June 2015.

South East Asia: Turning away the desperate

In the first quarter of 2015, UNHCR reported that some 25,000 people attempted to cross the Bay of Bengal. This is approximately double the figure for the same period in 2014. This Bay of Bengal sea route is predominantly used by Muslim Rohingya from Myanmar and Bangladeshi nationals.

On 11 May, the International Organization for Migration estimated that there were 8,000 people stranded on boats close to Thailand. Many of those aboard were believed to be Rohingya fleeing state-sponsored persecution in Myanmar.

During May, Indonesia, Malaysia and Thailand turned back boats carrying hundreds of refugees and migrants desperate for help, despite the dangers they faced. UNHCR estimates that 300 people died at sea in the first three months of 2015 due to “starvation, dehydration and abuse by boat crews”.

On 20 May Indonesia and Malaysia changed course, announcing that they would provide “temporary shelter” for up to 7,000 people still at sea. However, this temporary protection would only last for up to a year, and on condition that the international community would help with repatriation or resettlement of the people. Indonesia, Malaysia and Thailand have not ratified the UN Refugee Convention.

Elsewhere, a terrible precedent has been set in the region by the Australian government whose hard-line approach to asylum-seekers attempting to arrive by boat has, under the guise of saving lives, violated its responsibilities under refugee and human rights law.

“From the Andaman to the Mediterranean people are losing their lives as they desperately seek safe haven. The current refugee crisis will not be solved unless the international community recognizes that it is a global problem that requires states to significantly step up international cooperation. Later this week UNHCR will release their annual statistics on refugees and we will likely find that the crisis is getting worse. It is time for action,” said Salil Shetty.
