국제앰네스티의 공습 사례 분석에 따르면, 러시아군과 시리아군이 지난 3개월 동안 알레포 북부 지역으로의 진격로 확보를 위해 조직적, 의도적으로 병원을 공격한 것으로 나타난다.

시리아 허술한 정전 협상이 타결된 이후에도 시리아 정부군과 동맹군은 의료시설에 대한 공격을 강화했다.

국제앰네스티는 지난 12주 동안 알레포 북부 지역에서 병원과 의료센터, 진료소를 의도적으로 노리고 공격한 6개 이상의 충격적인 증거를 확보했다. 시리아 각지의 의료 시설을 의도적으로 공격하는 양상이 계속해서 나타났다. 의료종사자를 포함해 민간인 최소 3명을 숨지게 하고, 44명이 부상당한 공격은 전쟁 범죄에 해당한다.

국제앰네스티는 6개 병원에서 근무한 의료진 및 터키, 시리아의 인도주의 단체와 인터뷰를 했다. 이들은 2016년 2월 해당 지역에 대한 공습이 잦아지고 치료가 시급한 민간인들이 급증하면서 어려운 상황에 처해 있다고 호소했다.

알레포 북서쪽 아나단과 흐레이탄에서 근무하는 의료진들이 국제앰네스티에 알린 내용에 따르면, 병원과 기반시설을 공격해 마을이나 도시의 주민들을 모두 내보냄으로써 지상군의 진격을 용이하게 하는 것이 시리아 정부의 전략이라고 했다.

아나단의 한 의사는 “병원, 수도, 전력시설은 언제나 가장 먼저 공격 대상이 된다. 이것이 파괴되면 주민들은 생존에 필요한 시설을 사용하지 못한다. 아나단에서도 같은 일이 벌어지고 있다. 2월 2일 야전병원과 의료센터가 공격을 당한 이후 2월 중순에 이미 주민 대부분이 아나단을 빠져나간 상태다. 야전병원은 거의 제 기능을 못하고 있고, 의료센터는 문을 닫았다. 문제는 이곳 주민 모두가 피난을 떠날 수 있는 것은 아니라는 점이다. 떠나지 못하고 남은 사람들은 의료적 지원이 절실한 노인들”이라고 말했다.

티라나 하산 국장은 “알레포 주변 반군 점령 지역의 병원은 러시아와 시리아 정부군의 가장 우선적인 공격 목표가 되었다. 전투 지역에 거주하는 민간인들은 생존에 필수적인 수단을 잃었기 때문에 피난을 떠날 수밖에 없다.”고 말했다.

국제앰네스티가 인터뷰한 모든 사람들은 공격받은 병원 주변에 군용차량이나 검문소, 군인, 전선이 전혀 없었으며, 병원은 인도적 역할만을 수행했을 뿐이라고 증언했다.

적대행위에 직접적으로 참여하지 않은 민간인과 병원 및 의료시설 등의 민간 시설을 의도적으로 공격하는 것은 국제인도법, 전쟁법 위반 행위이자 전쟁범죄에 해당한다. 전쟁법상 병원과 의료시설은 인도적 기능 외에 무기 저장고 등 “적에게 해로운 행위”를 저지르는 데 이용되는 경우가 아니고서야 특별히 보호받아야 할 대상이다.

예외의 경우라 하더라도 충분한 시간제한을 두고 사전경고가 이루어져야 하고, 이러한 경고가 무시됐을 경우에만 공격할 수 있다.

티라나 하산 국장은 “국제앰네스티는 이미 여러 차례 시리아와 러시아 정부에 국제인도법을 준수할 것을 촉구했고, 러시아 정부에는 군의 병원 공격과 인권침해행위에 대해 신뢰 있고 독립적인 조사를 진행하라고도 요청한 바 있다”며 “의료진과 의료시설은 모두 공격 대상이 아니라 존중되고 보호받아야 할 대상이다. 알레포 주 북부 지역의 병원들이 새로운 공격 전선이 되면서, 부상자와 환자들은 터키 국경에 발이 묶여 있거나 시리아 내에서 죽고 있다. 병원 치료를 받지 못하도록 국가정부가 막는 것은 용납될 수 없다. 의도적으로 병원마다 공격을 가하는 것 역시 용납할 수 없다”고 말했다.

배경과 증언

시리아 현지 단체인 시리아인권네트워크(Syrian Network for Human Rights)에 따르면 2015년 9월부터 알레포 주의 8곳을 포함해 27개 이상의 병원이 러시아와 시리아군으로부터 공격을 받았다. 시리아-미국 의학협회(Syrian American Medical Society, SAMS)는 2015년 12월 이후 알레포 지역의 병원 최소 13개가 공습 대상이 되었으며, 그 중 한 곳은 2월 15일 지대지 미사일 공격을 받았다고 국제앰네스티에 전했다. 총 14건의 공격으로 의료진 4명과 민간인 45명이 숨졌다.

인권의사회(Physicians for Human Rights)는 시리아 분쟁이 시작된 이후 분쟁당사자들에 의한 의료시설 공격이 최소 346건 이루어졌으며 이로 인해 의료진 705명이 숨졌다고 발표했다. 이러한 공격의 대다수가 시리아 정부군과 동맹군이 가한 것이었다.

국제앰네스티는 이 중 2015년 12월부터 2016년 2월 알레포 북부에서 이루어진 6건의 공습에 주목했다.

알레포 주 북부 지역 공습
2016년 1월 말, 시리아 정부군은 누불, 자흐라 지역을 봉쇄한 반정부 무장단체를 저지하기 위해 러시아군의 공습 지원을 받으며 알레포 북부에 지상공격을 감행했다. 이로 인해 누불과 자흐라는 물론 터키에서 알레포로 가는 공급 경로도 차단됐다. 2월 1일, 시리아군은 쿠르드, 아랍, 아시리아계가 연합한 시리아 민주군과 함께 같은 지역에 공격을 이어갔다.
알레포 북부에서 터키 국경과 인접한 밥 알 살람으로 피난을 온 주민들이 국제앰네스티에 전한 내용에 따르면, 2월 첫째 주부터 러시아군과 시리아군의 공습이 급증하면서 수천 명이 피난을 갈 수밖에 없었다. 공습 지역에 병원이 전혀 없어서 부상자들은 치료를 받기 위해 차로 몇 시간이나 이동해야 했다. 알레포 지역 안팎에서 근무하는 의사 및 의료진들은 인터뷰에서 공습이 시작될 때 의료시설이 가장 먼저 표적이 되었고, 이는 의료시설을 파괴해 부상자들이 치료받지 못하게 하려는 의도인 것 같다고 밝혔다.

텔 리파트
시리아 민주군에 속한 쿠르드계 무장단체인 ‘인민수비대(YPG)’가 텔 리파트를 점령하기 이틀 전인 2월 15일에 이 지역을 빠져 나왔다는 의사 2명과 활동가 1명이 앰네스티에 전한 바에 따르면, 2월 8일 이 지역에 지상공격이 시작됨과 동시에 한 주간 야전병원, 재활센터, 신장투석센터 등의 의료시설 3곳이 모두 직접적으로 미사일 공격을 받았다고 한다. 이어진 공격으로 의료진 6명과 민간인 환자 3명이 부상을 입었고, 이 지역에서 사용 가능한 의료시설은 사라지게 되었다.

야전병원과 재활센터, 신장투석센터를 관리하는 의사 “파라즈”(안전상의 이유로 가명 사용)는 “2월 초 알레포 북부 지역 마을들을 점령하며 세력을 키우기 시작한 YPG가 텔 리파트 쪽으로 진격해 왔고, 이들이 접근하자 러시아군과 시리아군은 의료시설을 공격 대상으로 삼았다. 그 결과 무차별적인 포격으로 부상을 입은 민간인들은 병원이 없어 터키 국경까지 이송되어야 했다”고 전했다.

최근 공격이 벌어지기 수 주 전인 2015년 12월 19일 오후 2시 45분에는 텔 리파트에서 특수 아동들을 치료하던 건물에 직접적인 공습이 이루어졌다. 이 곳 관리인의 말에 따르면 2014년 설립되어 알레포 북부 전역에서 매달 어린이 250명을 수용하던 곳이었다.

마스칸 마을
터키의 독립의사협회(Independent Doctors Association: IDA)에 소속된 한 의사는 알레포 북부에 위치한 마을인 마스칸에서 공습이 더욱 격렬해지고 지상공격이 임박하면서 2월 1일 이들이 지원하던 야전병원을 철수시킬 수밖에 없었다고 전했다. 의료진과 환자들이 모두 대피한 다음 날, IDA는 공습을 받아 파괴된 야전병원의 사진을 받았다.

이렇게 버려진 마을은 2월 15일 시리아 정부군이 점령했다. 국제앰네스티는 파괴된 장소의 사진과, 야전병원이 테러리스트들의 치료 장소로 쓰였다고 주장하는 시리아군의 영상을 검토했다. 국제인도법상 인도주의적 역할을 수행하는 병원과 의료시설은 보호받아야 하며, 부상당한 군인을 치료하는 경우에도 마찬가지다.

아나단
아나단에서 근무하는 의사와 한 의료인이 전한 바에 따르면, 1월 27일과 2월 2일, 러시아군 또는 시리아군의 전투기가 가한 두 차례의 공습으로 야전병원 한 곳이 일부 파괴되었고 재활센터는 사용이 불가능해졌다.

재활센터에서 일하던 한 물리치료사는 “2월 1일 공습이 더욱 심해지더니, 다음 날 아침 8시 30분에 센터 건물이 미사일 공격의 표적이 됐다. 센터에 출근하던 길에 큰 폭발이 일어난 것을 목격했고, 도착해 보니 입구에는 운전사의 시신이 있었고 환자 2명과 의료진 5명이 중상을 입은 상태였다. 이들은 아나단 밖으로 이송해야 했다. 이제 재활센터는 사용할 수 없는 상태다. 고가의 의료 장비도 상당수가 파괴되었다. 2014년부터 운영해 치료가 필요한 사람이라면 누구든 치료를 해 왔던 곳이다”라고 말했다.

흐레이탄
흐레이탄의 바그다드 병원은 2015년 12월 25일 직접 공격의 표적이 되어 심각한 피해를 입었다. 이 병원에서 근무하던 의사와 직원은 러시아군 또는 시리아군의 전투기가 병원을 직접 노려 미사일 공격을 가하면서 직원 10명과 민간인 환자 최소 20명이 부상을 입었고 병원이 폐허가 됐다고 전했다. 직원이었던 알리 하메도는 이날 공습으로 목숨을 잃었다. 공습 이후 병원은 운영되지 못하고 있다.

흐레이탄의 의사 “압둘라”(안전상의 이유로 가명 사용)는 “지하 병원조차도 안전하지 못하다. 1년 전 공습을 피할 수 있을 거란 생각에 병원을 지하로 옮겼지만 미사일은 지하층까지 관통할 수 있었다. 병원을 마련하고 부상자와 병자를 치료하기 위해 수십만 달러를 투자했지만 이제 흐레이탄에 남은 병원은 없다”고 말했다.

2월 6일 공격을 피해 흐레이탄을 떠난 한 가족은 마지막으로 도시를 떠난 것이 자신들이라고 전했다. 이 가족의 아버지는 “흐레이탄에서 평생을 살았지만 이렇게 텅 빈 모습은 본 적이 없다. 도시를 떠나지 못하는 매우 소수의 가족들이 남아 있을 뿐이다. 병원을 비롯한 도시의 기반시설이 공습으로 모두 파괴된 탓에 살기 위해 필요한 시설이 남아 있지 않다”고 말했다.

러시아 국방부는 2월 4일부터 11일 사이 알레포의 “테러리스트”를 대상으로 공습을 가했지만 민간인을 표적으로 삼은 바는 없다고 밝혔다. 민간인 수백여 명이 숨지고 민간 건물에도 여러 차례 공격이 이루어졌다는 강력한 증거가 있음에도 불구하고 러시아 정부는 시리아에서 민간인을 숨지게 하거나 민간시설을 파괴한 사실에 대해 계속해서 부인하고 있다. 2월 11일 러시아 국방부는 알레포 북부 지역의 공습이 미국 주도 연합군의 소행이라고 비난했고, 미국은 이를 부인했다. 미국 중앙사령부(CENTCOM)는 미국 주도 연합군이 2월 1일과 4일 사이 알레포 북부 마라 지역에서 무장단체 자칭 이슬람국가(IS)를 대상으로 공습을 가했다고 밝혔다.

Syrian and Russian forces targeting hospitals as a strategy of war

Russian and Syrian government forces appear to have deliberately and systematically targeted hospitals and other medical facilities over the last three months to pave the way for ground forces to advance on northern Aleppo, an examination of airstrikes by Amnesty International has found.

Even as Syria’s fragile ceasefire deal was being hammered out, Syrian government forces and their allies intensified their attacks on medical facilities.

“Syrian and Russian forces have been deliberately attacking health facilities in flagrant violation of international humanitarian law. But what is truly egregious is that wiping out hospitals appears to have become part of their military strategy,” said Tirana Hassan, Crisis Response Director at Amnesty International.
“The latest string of attacks on health facilities north of Aleppo appears to be part of a pattern of attacks on medics and hospitals, a strategy that has destroyed scores of medical facilities and killed hundreds of doctors and nurses since the start of the conflict.”

The organization has gathered compelling evidence of at least six deliberate attacks on hospitals, medical centres and clinics in the northern part of the Aleppo Countryside governorate in the past 12 weeks. The attacks, which killed at least three civilians including a medical worker, and injured 44 more, continue a pattern of targeting health facilities in various parts of Syria which amounts to war crimes.

Amnesty International researchers spoke to medical workers from the six medical facilities and several humanitarian organizations in Turkey and Syria, who described their struggle to cope with the high number of civilians in need of medical treatment following the recent escalation of airstrikes on the area in February 2016.

Several medical workers from Anadan and Hreitan, two towns north-west of Aleppo, told Amnesty International that the Syrian government’s strategy is to empty an entire town or village of residents by targeting hospitals and infrastructure to facilitate the ground invasion.
A doctor from Anadan said: “Hospitals, water and electricity are always the first to be attacked. Once that happens people no longer have services to survive. This is what happened in Anadan. By mid-February most of the residents had fled the city after the field hospital and medical centre were attacked on 2 February. The field hospital is barely operating and the centre closed. The problem is that not everyone is able to leave the city. The ones who stayed behind are elderly people who are in desperate need of medical treatment.”
“Hospitals in opposition-controlled areas around Aleppo became a primary target for the Russian and Syrian government forces. This eliminated a vital lifeline for the civilians living in those embattled areas, leaving them no choice but to flee,” said Tirana Hassan.
All of the people interviewed by Amnesty International said that there were no military vehicles, checkpoints, fighters or front lines near the hospitals that were attacked and that the hospitals were exclusively serving their humanitarian function.
Deliberate attacks on civilians not directly participating in hostilities and on civilian objects, including hospitals and other medical facilities, violate international humanitarian law (also known as the laws of war) and amount to war crimes. Under the laws of war, hospitals and medical units enjoy special protection. They only lose their protection from attacks if they are being used outside their humanitarian function to commit “acts harmful to the enemy” such as to store weapons.

Even in the case of such misuse, a warning has to be issued setting a reasonable time limit and an attack can only take place after such a warning has remained unheeded.

“We have repeatedly called on the Syrian and Russian governments to abide by international humanitarian law and have urged Russia to conduct credible, independent investigations into its forces’ attacks on hospitals and other serious violations,” said Tirana Hassan.
“All medical workers and all health facilities should be respected and protected instead of being targeted. The injured and sick people are stranded at the Turkish border or dying inside Syria because hospitals have become the new front line in the offensive on the northern part of the Aleppo Countryside governorate. There is no excuse for a government to prevent people from accessing medical care. There is no excuse for deliberately targeting hospital after hospital.”

Background and testimonies
According to the Syrian Network for Human Rights, a local monitoring group, at least 27 hospitals, including eight in Aleppo governorate, have been targeted by Russian and Syrian government forces since September 2015. The Syrian American Medical Society (SAMS) told Amnesty International that since December 2015 at least 13 hospitals had been targeted in Aleppo by airstrikes and one by a surface-to-surface missile on 15 February. A total of four medical staff workers and 45 civilians were killed in these 14 attacks.

Physicians for Human Rights has reported that, since the conflict began, at least 346 attacks on medical facilities have been carried out by parties to the conflict, with 705 health workers killed. Syrian government forces and their allies have been responsible for the overwhelming majority of these.

Amnesty International’s researchers focussed on six attacks in northern Aleppo between December 2015 and February 2016.

The offensive on the northern part of Aleppo Countryside
During the last week of January 2016, Syrian government forces supported by Russian airstrikes began a ground offensive in the northern part of the Aleppo Countryside governorate to break the siege imposed by non-state armed groups on the towns of Nubul and Zahraa. This cut off the supply route from both this area and Turkey to Aleppo city. On 1 February, the Syrian government forces and the Syrian Democratic Forces, which include Kurdish, Arab and Assyrian groups, continued their offensive in the same area.
Civilians who fled the northern part of the Aleppo Countryside governorate to the Bab al-Salam border crossing into Turkey told Amnesty International that Russian and Syrian government airstrikes escalated in the first week of February, forcing thousands of people to flee. With no functioning hospitals left in the area, many of those injured in the airstrikes were forced to drive for hours to obtain medical help. Interviews with doctors and medical workers in and around Aleppo indicate that health facilities were among the first buildings targeted in a series of airstrikes at the start of the offensive, which they believe were intended to reduce the capacity of health facilities and prevent the injured from receiving medical treatment.

Tel Rifaat
Two doctors and an activist from Tel Rifaat who left two days before the People’s Protection Unit (YPG), part of the Syrian Democratic Forces, took control of the town on 15 February told Amnesty International that all three health facilities, including a field hospital, a rehabilitation centre and a kidney dialysis centre were directly targeted by missiles during the week beginning on 8 February, just as the ground offensive on the town began. The attacks injured six members of the medical team and three civilian patients and left the population with no working medical facility.
Doctor “Faraj” (his real name has been withheld for security reasons), who manages the field hospital, rehabilitation and kidney dialysis centre, told Amnesty International:
“The Kurds started gaining control of some villages in the northern part of Aleppo Countryside at the beginning of February and they were advancing towards Tel Rifaat. As they approached, Russian and Syrian forces targeted medical facilities. As a result, the civilians injured from the indiscriminate shelling had to be transferred to the Syrian/Turkish border because the hospitals were no longer operational.”
Several weeks before the current offensive, on 19 December 2015 at 2.45pm, a direct airstrike destroyed a centre in Tel Rifaat which provided medical care for children with special needs. According to the centre’s manager, it had been set up in 2014 and received 250 children per month from all over the northern part of Aleppo Countryside.

Maskan village
A doctor from the Independent Doctors Association (IDA) in Turkey told Amnesty International that the field hospital they support in Maskan, a village in the northern part of Aleppo Countryside, had to be evacuated on 1 February because of intensifying airstrikes and an imminent ground invasion of the village. A day after the medical staff and patients evacuated, the IDA received images of the field hospital destroyed by an airstrike.

The Syrian government gained control of the deserted village on 15 February. Amnesty International reviewed the images of the destruction and a video of government forces inside the field hospital claiming that the facility was used by terrorists to treat the war wounded. International humanitarian law protects hospitals and health facilities carrying out their humanitarian function, including providing medical treatment to wounded fighters.

Anadan
Doctors and a medical worker in Anadan told Amnesty International how two airstrikes on 27 January and 2 February by Russian or Syrian warplanes partially destroyed a field hospital and rendered a rehabilitation centre out of service. A physiotherapist at the rehabilitation centre said:
“The airstrikes intensified on 1 February. The next day at 8.30am the centre was targeted by a missile. I was on my way to work when I saw and heard the explosion. When I arrived I saw the driver’s body at the entrance, two patients and five from the medical team severely injured. We had to transfer them outside of Anadan. Now the centre is out of service. We lost a lot of expensive equipment. We provided treatment to whoever is in need and we have been operating since 2014.”

Hreitan
Baghdad Hospital in Hreitan was directly targeted on 25 December 2015 and severely damaged. A doctor and another medical worker at the hospital told Amnesty International that a Russian or Syrian warplane fired missiles directly at the hospital, injuring 10 medical staff and at least 20 civilian patients, and leaving the facility in ruins. Medical worker Ali Hamedo was killed by the strike. The hospital has been unable to function since.
Doctor “Abdullah” (his real name has been withheld for security reasons) from Hreitan said: “Not even underground hospitals are safe. We moved the hospital underground a year ago assuming that it will be protected from the airstrikes. But the missiles were able to penetrate the underground levels. We have spent hundreds of thousands of dollars to equip the hospital and provide treatment to the injured and sick but now Hreitan has no more hospitals.”
A family from Hreitan who fled the attacks on 6 February told Amnesty International that they were the last ones to leave. The father said, “I have lived in Hreitan all my life and I have never seen it deserted. Very few families remained because they can’t leave the city. The airstrikes destroyed the city’s infrastructure including hospitals so there are no more services for us to be able to survive.”
According to the Russian Ministry of Defence, Russian warplanes carried out strikes on “terrorists’ objects” in Aleppo between 4 and 11 February but denied targeting civilians. The Russian authorities continue to deny killing any civilians or damaging any civilian infrastructure in Syria, despite strong evidence indicating many hundreds of such deaths and multiple attacks on civilian buildings. On 11 February, the Russian Ministry of Defence accused the US-led coalition of being responsible for the attacks on the northern part of Aleppo Countryside, an accusation denied by the USA. According to the US Central Command (CENTCOM), the US-led coalition carried out strikes on the armed group calling itself Islamic State in Mar’a in the northern part of Aleppo Countryside between 1 and 4 February.

7월 30일 미얀마에서 대규모 사면으로 양심수 최소 11명이 석방된 것은 올바른 방향으로 나아간 조치이나, 여전히 수감되어 있는 수백여 명의 평화적 활동가들을 즉시 모두 석방시켜야 할 것이라고 국제앰네스티가 밝혔다.

미얀마 정부는 지난 30일 대통령 특별사면을 실시해 총 6,966명을 석방했다. 이날 석방된 수감자 중에는 기자, 평화적 시위대, 억압받는 이슬람계 소수민족인 로힝야족 지도자 등 국제앰네스티가 양심수로 지정한 최소 11명이 포함되어 있다.

루퍼트 애보트(Rupert Abbott) 국제앰네스티 동남아시아-태평양 조사국장은 “이들 양심수 11명이 겪어야 했던 고초는 그 어떤 것으로도 보상할 수 없겠으나, 이제 이들이 풀려나 가족의 품으로 돌아갈 수 있게 되었다는 것은 매우 기쁜 일이다. 그러나 이들 중 누구도 처음부터 수감되어서는 안 됐다는 사실은 여전히 남아 있다”며 “지난해 미얀마에서 평화적 활동가들이 체포되거나 박해 받는 일이 놀랄 만큼 급증하면서, 더욱 많은 양심수들이 교도소에 수감되어 고통받는 모습을 지켜본 바 있다. 정부가 인권옹호자, 학생, 기자, 정부 비판자들을 탄압할 수 있도록 허용하는 법률이 남아있는 한, 이번과 같은 사면조치의 장기적인 효과는 미미할 것”이라고 말했다.

이번 사면은 7월 초 미얀마 총선이 2015년 11월 8일 실시될 것이라고 발표된 데 따른 것이다. 이처럼 대규모 사면이 이루어진 것은 지난 2014년 10월, 미얀마에서 2건의 주요 국제 정상회담이 개최되기 불과 몇 주를 앞두고 수천여 명의 수감자들이 석방된 이후 처음이다.

루퍼트 애보트 국장은 “미얀마 정부는 그간 정치적으로 중요한 시기에 맞춰 이번과 같은 사면을 발표해 왔다. 정부는 이번 사면이 다가오는 11월 총선을 앞두고 유권자의 환심을 사려는 것에 불과한 조치가 아니라는 것을 반드시 증명해야 한다. 여전히 수감되어 있는 평화적 활동가 수백여 명을 석방하고, 단지 인권을 평화적으로 행사했다는 이유만으로 수감될 위기에 놓인 사람들의 혐의를 취소하는 조치가 뒤이어 이루어져야 할 것”이라고 말했다.

7월 30일 사면 대상에 포함된 양심수는 다음과 같다.

비 미드데이 선(Bi Midday Sun)지 소속 언론인 쩌 저 하잉, 윙 팅, 투라 아웅, 잉 밍 툰, 쩌 민 카잉은 2014년 7월 반정부 지도자 아웅산 수치와 소수민족 대표들이 과도정부를 구성했다는 내용의 오보를 발표했다는 이유로 각각 징역 2년형에 처해졌다.

소수민족 미차웅칸족의 지도자 세인 싼은 미차웅칸족의 토지를 놓고 벌어진 분쟁을 해결하지 못한 정부를 비판하며 열린 평화적 시위에 여러 차례 참여했다는 이유로 징역 2년형을 선고받았다.

지역사회단체 ‘민주주의 물결 운동(MDCF)’에 소속된 평화적 활동가 팅 마웅 치는 2014년 양곤에서 허가 없이 시위를 벌인 혐의로 징역 1년 6월에 선고됐다.

로힝야족 지도자 바 싸르, 쩌 킨, 쩌 민트와 그의 아들 흘라 민트는 2015년 3월 수감되었다. 네 사람은 지난 2013년 4월 정부가 실시한 인구조사에서 로힝야족이 인정되지 않자 이에 반발해 일어난 시위 중 체포되었다. 당시 시위로 인해 결국 정부는 인구조사 실시를 유예하게 되었다. 네 명은 각각 징역 5년에서 8년을 선고받았다.

MYANMAR: PRISONERS OF CONSCIENCE RELEASED IN AMNESTY BUT SCORES REMAIN BEHIND BARS

The release of at least 11 prisoners of conscience in a mass prisoner amnesty in Myanmar today is a step in the right direction, but authorities must immediately clear the country’s jails of the scores of peaceful activists who still remain behind bars, Amnesty International said.

The Myanmar authorities today released 6,966 people as part of a Presidential prisoner amnesty. Among those freed are at least 11 men who Amnesty International has designated prisoners of conscience – including journalists, peaceful protesters and community leaders from the repressed Muslim Rohingya minority.

“We have seen an alarming increase in arrests and harassment of peaceful activists in Myanmar in the past year, with an increasing number of prisoners of conscience languishing behind bars. Releases like the one today will have little long-term effect if the laws that allow the authorities to crackdown on human rights defenders, students, journalists and government critics remain on the books.”

Today’s amnesty follows the announcement earlier this month that Myanmar will hold general elections on 8 November 2015. It is the first mass prisoner amnesty since October 2014, when thousands were released a few weeks ahead of Myanmar hosting two major international summits.

“Myanmar’s authorities have a track record of announcing prisoner amnesties, like the one today, at politically opportune times. The government must prove that this is more than an empty gesture to curry favour ahead of the November elections. The next step must be to release the scores of peaceful activists who still remain behind bars, and to drop charges against those facing imprisonment simply for peacefully exercising their human rights,” said Rupert Abbott.

Prisoners of conscience included in today’s prisoner amnesty include:
Kyaw Zaw Hein, Win Tin, Thura Aung, Yin Min Htun, and Kyaw Min Khaing, all media workers from the Bi Midday Sun newspaper, each sentenced to two years in prison after the paper published claims that opposition leader Aung San Suu Kyi and ethnic leaders had been elected as an interim government in July 2014.

Michaungkan community leader Sein Than, sentenced to two years in prison for participating in a series of peaceful protests in response to failures by the authorities to resolve his community’s land dispute.

Peaceful activist Tin Maung Kyi, a member of the community-based organization the Movement for Democratic Current Force (MDCF), who was sentenced to one and a half years in prison for protesting without permission in Yangon in 2014.

Rohingya leaders Ba Thar, Kyaw Khin, Kyaw Myint and his son Hla Myint, who were imprisoned in March 2015. The four men were first arrested in April 2013 following a community protest against the government-led population registration exercise, which did not allow members of the community to identify as Rohingya. Protests forced the authorities to suspend the registration exercise. The four men were sentenced to between five and eight years in prison.

올해 초 미얀마에서 박해를 피하기 위해 난민이 된 로힝야족 성인 남녀와 어린이들이 몸값을 지불하지 못한 경우 인신매매업자들에게 살해되거나 심한 폭행을 당했고, 참혹하고 비인도적인 환경에 갇혀 있었다고 국제앰네스티가 21일 발표한 신규 보고서를 통해 밝혔다.

보고서 <죽음의 여정: 동남아시아의 난민과 인신매매 위기(영문)>는 로힝야족 난민 100명 이상과 나눈 인터뷰 내용을 바탕으로 하고 있다. 미얀마와 방글라데시에서 안다만 해를 건너 인도네시아에 도착한 이들 난민 중 다수가 어린이였으며, 대부분이 인신매매 피해자였다.

우기가 끝나고 이미 “항해기”가 시작된 가운데, 수천여 명 이상이 또다시 뱃길에 오를 것으로 예상된다. 국제앰네스티는 동남아시아 지역 국가에 난민 위기 대책을 시급히 마련할 것을 촉구한다.

안나 시어(Anna Shea) 국제앰네스티 난민 조사관은 “벵골 만과 안다만 해상에서 배 안에 갇힌 로힝야족 난민들이 매일같이 당하는 신체적 폭행은 말로 표현하기조차 끔찍한 수준이다. 이들은 미얀마는 탈출했지만, 또 다른 악몽과 맞바꾼 것에 불과했다. 어린이들조차 이러한 폭행의 예외는 아니었다”며 “충격적인 점은 인터뷰를 나눈 난민들이 그 중 그나마 해안에 상륙할 수 있었던 ‘운이 좋은’ 경우였으며, 그렇지 못한 수많은 다른 사람들은 바다에서 익사하거나 인신매매를 통해 강제 노역 현장으로 보내졌다는 사실이다. 각국 정부는 이와 같은 인도적 비극이 되풀이되지 않도록 더욱 철저히 대비해야 한다”고 말했다.

2015년 5월, 태국 정부가 인신매매 타도에 나서자 인신매매 업자들이 사람들을 바다 위에 버려두고 떠나면서 수천 명의 난민과 이주민들이 식량과 물, 치료가 절실히 필요한 상태로 수 주 동안 해상에 좌초되는 끔찍한 사건이 벌어졌다.

유엔은 2015년 1월과 6월 사이 최소 370명 이상이 숨진 것으로 추정하고 있으나, 국제앰네스티는 실제 사망자 수가 이보다 훨씬 많을 것으로 보고 있다. 국제앰네스티와 인터뷰를 나눈 목격자들은 난민과 이주민을 가득 실은 채 비슷한 상황에 처했던 배가 수십 척 더 있었다고 증언했지만, 유엔 관계자에 따르면 인도네시아와 말레이시아에 상륙한 배는 다섯 척에 불과했다. 수백, 혹은 수천 명은 여전히 행방을 알 수 없는 상태로, 바다를 건너던 도중 사망했거나 강제노역 현장으로 보내졌을 가능성이 있다.

돈을 노린 폭행과 살인

다수의 로힝야족 사람들은 선원들이 몸값을 지불하지 못한 사람을 살해하는 모습을 목격한 적 있다고 말했다. 인신매매 업자에게 사살되기도 했고, 바다에 던져져 익사하도록 방치되기도 했다. 식량과 물이 부족해서, 또는 질병으로 사망하는 사람들도 있었다.

난민들은 아주 큰 배 안에서 수 개월 동안 갇혀 지내며, 인신매매 업자들이 가족에게 연락해 몸값을 요구하면서 심하게 폭행했다고 증언했다. 한 15세 난민 소녀는 선원들이 방글라데시에 있는 아버지에게 전화를 걸고, 그녀를 폭행하면서 비명소리를 들려준 후, 몸값으로 미화 1,700달러를 지불하게 했다고 말했다.

사실상 모든 로힝야족 성인 남녀와 어린이들이 본인이 구타를 당한 적이 있거나, 다른 사람들이 심각한 신체적 폭행을 당하는 것을 목격한 적이 있다고 증언했다. 사람들은 식량을 구걸하거나, 움직이거나, 화장실 사용을 요청했다는 이유만으로 철봉이나 플라스틱 곤봉으로 몇 시간에 걸쳐 구타를 당했으며, 대부분 그로 인해 장기적인 신체적, 정신적 상처가 남았다.

이러한 폭행은 주로 놀랍게도 규칙적이고 조직적인 방법으로 이루어졌다. 15세 로힝야족 소년은 “아침에는 3번, 오후에는 3번, 밤에는 9번을 때렸다”고 말했다.

본국에서의 박해

로힝야족이 이처럼 절박하게 떠나려 하는 것은 미얀마에서 수십 년 동안 계속되고 있는 로힝야족에 대한 박해와 차별 때문이다. 미얀마는 사실상 로힝야족의 국적을 법적으로 인정하지 않고 있다. 가장 최근에는 2012년에도 벌어진 로힝야족에 대한 폭력적인 탄압으로 인해 수만 명이 좁은 수용소에 몰려 절박한 환경 속에서 살아갈 수밖에 없게 되었다.

미얀마 또는 방글라데시의 인신매매 업자에게 납치되었다는 사람들이 있는 반면, 싼 값에 말레이시아로 가는 안전한 경로를 알려주겠다는 말에 속은 사람들도 있었다. 업자들이 강제노역으로 팔아 넘길 대상을 찾기 위해 흔하게 사용하는 수법이다.

안나 시어 조사관은 “로힝야족이 처한 현 상황이 너무나 절박하기 때문에 난민 위기의 근본적인 원인이 해결되지 않는 한 이들은 계속해서 목숨을 걸고 바다를 건너려 할 것이다. 미얀마 정부는 즉시 로힝야족에 대한 박해를 중단해야 할 것”이라고 말했다.

참혹한 환경

로힝야족 난민들은 바다를 건너는 동안 비인도적이고 굴욕적인 환경에 갇혀 지내야 한다. 좁은 배에 지나치게 많은 난민을 태운 탓에 사람들은 극도로 비좁은 공간에서, 때로는 수 개월 동안을 앉은 채로 보낼 수밖에 없다. 인도네시아 아체 만에서 난민 구조 작업을 도왔던 한 지역 주민은 악취가 너무나 심해 구조대가 배에 탈 수 없을 정도였다고 전했다.

식량과 물도 턱없이 부족해, 하루에 배급 받는 식량은 보통 쌀 한 컵에 불과했다. 인도네시아에 상륙한 로힝야족 대부분이 극도로 쇠약한 상태였고, 오랜 시간 비좁은 공간에 앉아 있었던 탓에 걷기가 힘들었으며, 탈수와 영양실조, 기관지염, 독감에 시달리고 있었다.

인도네시아의 환경

2015년 5월, 인도네시아, 말레이시아, 태국은 난민을 가득 태운 배가 상륙하지 못하도록 돌려보내고, 수만 명의 절박한 난민들이 배에서 내리지 못하게 했다. 이에 대해 국제적인 비난이 잇따르자 인도네시아와 말레이시아는 결국 2016년 5월까지 다른 국가들도 난민을 수용한다는 조건하에 다수의 난민을 받아들이기로 합의했다.

인도네시아는 아체 지역에 수백여 명의 취약한 난민들이 정착할 수 있도록 자원을 투자하고, 지역 시민사회 및 국제기구와 공조해 난민들의 기본생활요건을 충족시킬 수 있도록 노력하고 있는 점에 대해서는 인정받아야 할 것이다. 그러나 정부가 2016년 5월 이후에도 난민 거주를 허용할 것인지에 대해 확인한 바가 없는 만큼, 장기적인 해결 방안에 대해서는 여전히 심각한 문제가 남아 있다.

권고사항

안나 시어 조사관은 “인신매매를 타도하기 위한 동남아시아 지역 국가간의 공조협력 없이는 이 지역에서 가장 취약하고 절박한 상태에 놓인 사람들은 또다시 중대한 인권침해행위의 피해자가 될 것”이라며 “각국 정부는 인신매매업자들이 지난 2015년 5월과 같이 사람의 생명이나 인권을 위험에 빠뜨리지 못하도록 대책 마련에 나서야 하고, 또한 해상 수색구조작전 시행을 위해 신속히 행동해야 한다”고 말했다.

국제앰네스티는 동남아시아 지역 국가들에게, 또 다른 해상의 인권 재앙이 벌어질 때까지 기다리지 말고 지금 바로 행동에 나설 것을 촉구한다.

Southeast Asia: Persecuted Rohingya refugees from Myanmar suffer horrific abuses at sea

Women, men and children trafficked, held in hellish conditions, beaten or killed for ransom

New “sailing season” crisis looms in Bay of Bengal and Andaman Sea

Rohingya women, men and children attempting to flee persecution in Myanmar by boat earlier this year were killed or severely beaten by human traffickers if their families failed to pay ransoms, and kept in hellish, inhuman conditions, Amnesty International reveals in a new report today.

Deadly journeys: The refugee and trafficking crisis in Southeast Asia is based on interviews with more than 100 Rohingya refugees – mainly victims of human trafficking, and many of them children – who reached Indonesia after fleeing Myanmar or Bangladesh across the Andaman Sea.

With the monsoon over and a new “sailing season” already underway, thousands more could be taking to boats. Amnesty International is urging regional governments to urgently step up their response to the crisis.

“The daily physical abuse faced by Rohingya who were trapped on boats in the Bay of Bengal and Andaman Sea is almost too horrific to put into words. They had escaped Myanmar, but had only traded one nightmare for another. Even children were not spared these abuses,” said Anna Shea, Refugee Researcher at Amnesty International.

“The shocking truth is that those we spoke to are the ‘lucky’ ones who made it to shore – countless others perished at sea or were trafficked into forced labour situations. Governments must do more to prevent this human tragedy from recurring.”

The harrowing events that unfolded in May 2015 – triggered by Thailand’s crackdown on human trafficking, and the traffickers’ subsequent abandonment of people at sea – left thousands of refugees and migrants stranded for weeks in desperate need of food, water and medical care.

While the UN estimates that at least 370 people lost their lives between January and June 2015, Amnesty International believes the true figure to be much higher. Eyewitnesses who spoke to Amnesty International saw dozens of large boats full of refugees and migrants in similar circumstances, but only five boats landed in Indonesia and Malaysia according to UN sources. Hundreds – if not thousands – of people remain unaccounted for, and may have died during their journeys or been sold for forced labour.

Deaths and beatings for money

Many Rohingya said that they had seen crew members kill people when their families failed to pay ransoms. Some people were shot by the traffickers on the boats while others were thrown overboard and left to drown. Others died because of lack of food and water or disease.

Refugees described how they were kept for months on very large boats and severely beaten while traffickers contacted their family members, demanding a ransom. One 15-year-old Rohingya girl said the crew called her father in Bangladesh, made him listen to her cries while they beat her, and told him to pay them about USD 1,700.

Virtually every Rohingya woman, man and child said they had either been beaten themselves or seen others suffer serious physical abuse. People were beaten with metal or plastic batons – sometimes for several hours – simply for begging for food, moving or asking to use the toilet. Many have been left with long-term physical or psychological scars from the violence.

Beatings were often carried out in a chillingly routine and systematic way. One 15-year old Rohingya boy said: “In the morning you were hit three times. In the afternoon you were hit three times. At night you were hit nine times.”

Persecuted at home

The Rohingyas’ desperation stems from decades of persecution and discrimination in Myanmar, where they are effectively denied citizenship under national law. Waves of violence against the Rohingya, most recently erupting in 2012, have forced tens of thousands into overcrowded camps where they live in desperate conditions.

Some people said that they had been abducted by traffickers in Myanmar or Bangladesh, whereas others had been promised a safe passage to Malaysia for a nominal fee – a tactic commonly used by traffickers looking to coerce people into forced labour.

“The Rohingya are so desperate that they will continue to risk their lives at sea until the root causes of this crisis are addressed – the Myanmar government must immediately end its persecution of the Rohingya,” said Anna Shea.

Hellish conditions

The Rohingya were kept in inhuman and degrading conditions during their journeys. Boats were severely overcrowded, with people forced to sit in extremely cramped positions, sometimes for months on end. A local man who helped rescue people off the coast of Aceh in Indonesia said that the stench was so bad that rescuers could not board.

Food and water was severely lacking and rations usually consisted of a small cup of rice per day. Many of the Rohingya who reached Indonesia were emaciated, had difficulty walking after being cramped for so long, and suffered from dehydration, malnourishment, bronchitis, and flu.

Conditions in Indonesia

In May 2015, Indonesia, Malaysia and Thailand initially pushed overcrowded vessels back from their shores and prevented thousands of desperate passengers from disembarking. Following international criticism, Indonesia and Malaysia eventually agreed to admit a number of asylum-seekers, on the condition that another country accept them by May 2016.

Indonesia should be recognized for devoting resources to housing hundreds of vulnerable people in its Aceh province, and working to fulfill their basic needs in cooperation with local civil society and international agencies. But there are serious unanswered questions about a long-term solution, as the government has not clarified whether the refugees can stay beyond May 2016.

Recommendations

“Without cooperation between governments to combat human trafficking, grave human rights abuses will again be perpetrated against some of Southeast Asia’s most vulnerable and desperate people,” said Anna Shea.

“Governments must ensure that initiatives against traffickers do not put people’s lives or human rights at risk, which is what happened in May 2015. They must also act quickly to implement maritime search and rescue operations.”

Amnesty International is urging Southeast Asian states to act now, and not wait for another human rights disaster at sea.

IT 기업들은 중국의 억압적인 인터넷 규제 거부해야

오는 16일 중국에서 세계인터넷대회가 개최되는 가운데, 국제앰네스티는 IT 업체들이 세계 사이버공간 규제에 영향력을 행사하려는 중국 정부의 시도에 동조해서는 안 될 것이라고 밝혔다. 이러한 시도는 표현의 자유를 통제하고 인권침해를 악화시킬 수 있다.

16일부터 3일간 중국 동부 우전에서 열리는 제2회 세계인터넷대회는 세계적인 기술 업체의 고위 임원들이 한자리에 모이는 행사로, 시진핑 중국 주석 역시 참석할 예정이다.

중국은 세계에서 가장 억압적인 인터넷 검열을 시행하고 있는 나라 중 하나이다. 중국 정부는 모호하게 규정된 법을 이용해 온라인상에서 표현의 자유를 행사했다는 이유만으로 사람들을 탄압의 표적으로 삼고 있다. 시진핑 주석이 취임한 이후 온라인상에 의견을 표현한 것만으로 구금된 사람은 수백 명에 이른다.

로젠 라이프(Roseann Rife) 국제앰네스티 동아시아사무소 조사국장은 “중국 정부가 국가의 주권과 안보 강화라는 명목 아래 온라인상 규칙을 새로 규정함으로써 검열과 감시가 만연한 환경을 만들려 하고 있다. 이는 인터넷 자유에 대한 전면적인 공격”이라며 “애플(Apple)과 구글(Google), 페이스북(Facebook), 링크드인(LinkedIn), 마이크로소프트(Microsoft)를 비롯한 IT 기업들은 중국의 억압적인 인터넷 규제 제도에 반대하고, 이익보다 사람과 원칙을 우선할 것을 각오해야 한다”고 말했다.

2014년부터 중국 정부는 세계 사이버공간 관리에 있어 “인터넷 주권”의 중요성을 더욱 홍보하고 있다.

중국 정부는 이미 두 번이나 세계적 인터넷 업체들로부터 서약서에 서명을 받으려 시도했다. 2014년 우전에서 열린 제1회 세계인터넷대회에서 정부는 참석 업체들을 대상으로 “모든 국가의 인터넷 주권을 존중”할 것을 국제사회에 촉구하는 내용의 선언문에 서명하게 하려 했지만 결국 수포로 돌아갔다.

또한 올해 9월에는 시진핑 주석의 미국 워싱턴주 방문을 앞두고 미국 IT업체들에게 재차 서약서에 서명하게 하려 했다. 이 서약서는 서명한 대상이 “중국의 국가 안보를 해치지 말아야” 하고, 중국 내 중국인 사용자들의 자료를 보관하고, “사회 전역의 감독을 수용”해야 한다는 내용을 담고 있다. 이러한 표현은 IT 업체의 수집 정보와 활동에 대해 정부가 무제한적인 권한을 가져야 한다는 중국 정부의 입장을 뒷받침하는 것이다.

그러나 중국 정부가 억압적인 행보를 취하더라도 IT 기업들은 사생활의 자유와 표현의 자유, 불법 구금되지 않을 자유 등과 같은 국제법상 인권을 존중할 독립적인 의무가 있다. 그러므로 인권침해에 기여하지 않기 위해서는 이에 의문을 제기하고 조치를 취해야 할 것이다.

심각한 수준의 검열

로젠 라이프 국장은 “중국의 ‘인터넷 주권’이 끼치는 영향은 매우 현실적이고 엄청난 수준이다. 여성인권활동가와 반부패 활동가, 정치개혁 논의를 촉구하던 사람들은 정부의 온라인 검열로 모두 침묵 당한 채 장기간의 징역형에 처할 위기를 맞았다”며 “IT기업들은 이러한 억압을 모른체하거나, 인터넷 주권이라는 개념을 인정해서는 안 된다. 인터넷 주권은 표현의 자유와 사생활의 자유에 대한 공격”이라고 말했다.

지난 14일, 변호사 푸지창에 대한 재판이 베이징에서 열렸다. 유명 인권변호사인 푸지창은 소셜미디어에 총 600자 분량의 정부를 비판하는 글 7건을 게시했다가 “분란을 조장”하고 “인종 혐오를 선동”했다는 혐의로 8년의 징역형에 처하게 됐다.

중국에서는 페이스북, 인스타그램(Instagram), 트위터(Twitter)와 같은 소셜미디어서비스를 비롯해 수천여 곳의 웹사이트가 여전히 차단된 상태다. 1989년 천안문 사태에 대한 언급을 포함해 수백여 건의 글이 소셜미디어와 검색 결과에서 검열되고 있다. 중국의 ‘인터넷 짜르’로 불리는 루웨이 국가인터넷정보공실 주임은 이러한 인터넷 통제가 질서 유지를 위해 반드시 필요한 조치라며 옹호하고 있다.

최근 상정된 신규 사이버보안법은 이미 엄격한 검열과 광범위한 감시가 이루어지고 있는 중국의 현 상황을 더욱 악화시킬 뿐이다. 이 법은 테러방지법과 같은 다른 법 조항과 마찬가지로 “인터넷 주권”을 지키기 위해 인터넷서비스 제공자들에게 중국 내 모든 개인정보를 보관할 것과 영장이나 독립적인 감독 없이도 정부에 관련 자료를 제공할 것을 요구하고 있다

배경

2014년 11월 우전에서 열린 제1회 세계인터넷대회 회장 밖에서 시위대 7명이 체포되었다. 이들은 중국 정부에 차단된 웹사이트 접속 허용을 촉구하라는 시위를 벌이고 있었다.

국가정부가 기술을 이용해 표현의 자유를 탄압하고, 인권침해 및 부정부패에 관한 정보를 검열하고, 안보라는 명목으로 무차별적인 대규모 감시를 벌이는 경향이 세계 각지에서 부쩍 증가하고 있으며, 기업이 이러한 활동에 동조하는 경우도 많다.

미국과 영국 정부는 미국 국가안전보장국(NSA)과 영국 정보통신본부(GCHQ)가 전세계적인 규모로 사생활의 자유를 침해하는 무차별적인 대규모 감시 프로그램을 시행하면서 온라인상의 자유를 약화시켰다. 미국과 영국 정부의 보편적 감시 프로그램과 이를 충분히 개선하라는 요구를 계속해서 거부하는 태도는 다른 국가에 위험한 선례를 남기게 되었다.

인터넷 업체들은 세계적인 활동에 있어 국제법상 인권을 존중해야 할 의무가 있으며, 여기에는 중대한 인권침해를 피하기 위한 사전적 조치가 수반되어야 한다. 충분한 안전조치와 관리감독 없이 개인정보를 수집하고 중국 정부와 공유할 것을 요구하는 것은 기업으로 하여금 인권을 존중할 의무에 반하는 행동을 하라는 요구와 같다. 기업은 표현의 자유 및 이와 관련된 인권을 존중하기 위해 이에 맞서야 할 것이다. 또한 자발적, 무비판적으로 개인정보를 공개하는 것은 심각한 결과를 초래할 수 있기 때문에 삼가야 한다.

Tech companies must reject China’s repressive internet rules

Tech firms must reject the Chinese authorities’ efforts to influence global internet governance in ways that would curb freedom of expression and exacerbate human rights abuses, Amnesty International said ahead of China hosting a major internet summit.

President Xi Jinping is expected to address senior executives of global tech firms attending the three-day World Internet Conference in Wuzhen, eastern China, which starts on Wednesday.

The Chinese government runs one of the world’s most repressive internet censorship regimes. The authorities continue to use vaguely-worded laws to arbitrarily target individuals for solely exercising their right to freedom of expression online.Since President Xi Jinping came to power, hundreds of people have been detained solely for expressing their views online.

“Under the guise of sovereignty and security, the Chinese authorities are trying to rewrite the rules of the internet so censorship and surveillance become the norm everywhere. This is an all-out assault on internet freedoms,” said Roseann Rife, East Asia Research Director at Amnesty International.

“Tech companies, including Apple, Google, Facebook, LinkedIn and Microsoft, must be prepared to say no to China’s repressive internet regime and put people and principles before profits.”

Since 2014, the Chinese government has increasingly promoted its notion of “internet sovereignty” for global internet governance.

The authorities have twice attempted to elicit written pledges from global internet companies. At the inaugural Wuzhen Internet Conference in November 2014, the authorities’ efforts to get companies to sign a declaration which called on the international community to “respect the internet sovereignty of all countries” ended in failure.

In September this year, the Chinese government tried again to secure written pledges from US tech firms ahead of President Xi Jinping’s state visit to Washington. The pledge committed the signatories to ensuring that they would not “harm China’s national security”, that companies would store Chinese users’ data within China, and that they would “accept supervision of all parts of society”. Such wording would support the Chinese government’s position that it should have unchecked powers to access the operations and information collected by tech companies.

Despite the repressive actions of the Chinese government, technology companies have an independent responsibility to respect international human rights, including the right to privacy, freedom of expression and freedom from unlawful detention. This means that they must ask questions and put measures in place to ensure that they do not contribute to human rights violations.

Devastating censorship

“The impact of China’s “internet sovereignty” is real and devastating. It is women’s rights activists, anti-corruption campaigners and those urging debate on political reforms who are silenced, and face the threat of long prison sentences for falling foul of the authorities’ online-censorship,” said Roseann Rife.

“Tech companies must not turn a blind eye to such repression or give credence to any notion of internet sovereignty that is an attack on the rights to freedom of expression or privacy.”

On Monday, the trial of lawyer Pu Zhiqianq took place in Beijing. The renowned human rights lawyer faces up to eight years in prison on the charges of “picking quarrels and provoking troubles” and “inciting ethnic hatred”, primarily on the basis of seven social media posts, in total around 600 characters, in which he criticized the government.

Thousands of websites remain blocked in China, including social media services like Facebook, Instagram and Twitter. Scores of phrases are censored on social media and in internet search results including any mention of the 1989 Tiananmen Square crackdown. Lu Wei, China’s internet czar has defended the controls, describing them as necessary to maintain order.

A proposed new cyber security law would only exacerbate China’s already strict internet censorship and extensive surveillance. The law, together with provisions in other laws such as the Anti-Terrorism Law, would require service providers to store all personal data within China, and turn it over to the authorities without any judicial authorization or independent oversight, to preserve “internet sovereignty”.

Background

In November 2014, seven people were detained for demonstrating outside the first World Internet Summit in Wuzhen. The protesters had called on the Chinese authorities to allow access to banned websites.

Governments across the globe are increasingly using technology to crackdown on freedom of expression, censor information on human rights violations and corruption, and to carry out indiscriminate mass surveillance in the name of security, often in collaboration with corporate actors.

The US and UK governments have undermined online freedoms globally with the indiscriminate mass surveillance programmes run by the National Security Agency (NSA) and General Communications Headquarters (GCHQ) which are violating the right to privacy on a global scale. The US and UK governments’ ubiquitous surveillance programmes and their continuing refusal to meaningfully reform them have set a dangerous precedent for other countries.

Internet companies have a responsibility to respect international human rights in their global operations. This entails putting pro-active measures in place so that serious human rights abuses can be avoided. A law requiring companies to store and share private information with the Chinese authorities without sufficient safeguards and adequate oversight would require them to act contrary to their responsibility to respect human rights – companies should challenge such measures in order to respect freedom of expression and related rights. They should not voluntarily and uncritically disclose private information because of the serious implications that this would have.

시리아 정부가 지난 4년 간 대규모로 놀랍도록 치밀하게 수만 건에 이르는 강제실종을 자행해 온 사실이 드러났다고 국제앰네스티가 5일 발표한 보고서를 통해 밝혔다.

보고서 <감옥과 무덤 사이: 시리아의 강제실종>은 시리아 정부가 반인도적 범죄에 해당하는 조직적이고 만연한 강제실종을 통해 수익을 얻고 있다고 폭로했다. 비밀 암시장을 이용해 실종된 가족의 생사를 어떻게는 알아내려는 사람들로부터 무자비하게 돈을 착취한 것이다.

필립 루터(Philip Luther) 국제앰네스티 중동-북아프리카국장은 “시리아 정부가 주도한 강제실종은 국민들을 대상으로 냉정하게 계산되어 만연하게 이루어지고 있는 공격이다. 이는 시리아 전역에 공포 분위기를 조성하고 일부의 반대 의견조차도 묵살하기 위해 치밀하게 조직된 반인도적 범죄”라며 “이번 보고서는 시리아에서 흔적조차 없이 사라진 강제실종 피해자 수만 명의 가족들이 겪어야 했던 충격과 트라우마, 그리고 금전적 이득을 위해 잔인하게 착취당한 가슴 아픈 사연을 담고 있다”고 말했다.

강제실종의 규모는 충격적인 수준이다. 시리아 인권네트워크가 기록한 바에 따르면 2011년부터 지금까지 최소 65,000명이 실종되었으며, 그 중 58,000명이 민간인이었다. 실종자들은 보통 좁고 열악한 환경의 감방에 구금되어 외부와 완전히 차단되며, 질병과 고문, 즉결 처형으로 많은 수가 목숨을 잃는다.

시리아에서 지나치게 뿌리 깊게 자리잡은 강제실종으로 인해 “중간업자” 또는 “중개인”이 활동하는 암시장도 생겨났다. 이들은 실종자의 행방이나 생사만이라도 알고자 하는 절박한 가족들로부터 수백에서 수만 달러를 받아 챙긴다. 이렇게 받은 돈은 “국가 경제의 큰 부분”을 이바지하게 된다는 것이 한 시리아 인권활동가의 설명이다. 수도 다마스커스의 한 변호사 역시 이렇게 챙기는 현금이 “정부의 알짜 수입원으로, 국가재정을 여기에 의존할 정도에 이르렀다”고 국제앰네스티에 전하기도 했다.

강제실종의 피해자 중에는 시위대와 인권활동가, 기자, 의사, 인도주의적 활동가와 같이 정부의 뜻에 평화적으로 반대하던 사람들이 포함되어 있다. 그 외에 국가에 충성을 다하지 않는 것으로 의심되거나 가족이 정부에 수배된 사람들 역시 강제실종의 대상이 됐다.

일부의 경우, 특히 지난 2년 동안 강제실종은 보복을 가하거나 금전적 이득을 취하는 방법으로 이용되어 왔으며, 이로 인해 실종의 악순환이 더욱 깊어지고 있다.

실종된 가족의 생사를 알아내기 위해 재산을 처분하거나 평생 모은 저축을 중개인에게 지불하고도 거짓 정보를 얻는 경우도 있다. 2012년 형제 3명이 모두 실종된 한 남성은 국제앰네스티와의 인터뷰에서 세 형제의 행방을 알아내려고 미화 15만 달러 이상의 빚을 졌지만 아무런 성과가 없었다고 했다. 이 남성은 현재 빚을 갚기 위해 터키에서 일을 하고 있다.

필립 루터 국장은 “강제실종은 소중한 생명을 해칠 뿐만 아니라, 사랑하는 사람을 잃은 가족들의 고통과 맞바꿔 지하경제를 이끌고 있다. 이들 가족에게 남은 것은 불어나는 빚더미와, 사랑하는 가족의 크나큰 빈자리 뿐”이라고 말했다.

실종된 가족에 대해 수소문하려 하면 체포되거나 그들조차 강제 실종될 위험이 있기 때문에, 남은 방법은 결국 이러한 “중개인”에게 의존하는 것 외에는 거의 없다. 형제의 행방을 정부에 직접 물었던 한 남성은 3개월 동안 구금되었고, 독방에서 몇 주를 보내야 했다. 실종된 아들을 찾기 위해 다마스커스로 향했던 또 다른 남성은 도중에 군 검문소에서 체포되었으며, 이후로 지금까지 소식을 들을 수 없었다.

2년 전 강제실종된 시리아 인권변호사 칼릴 마투크(Khalil Ma’touq)의 친구는 강제실종이 “시리아 국민을 공포에 빠뜨리려는 정부의 거대한 전략”의 일부라고 밝혔다. 칼릴의 딸 라님 마투크 역시 2개월 전 실종되었으며, 구금된 채 끔찍한 경험을 해야 했다.

치과의사인 라니아 알라바시(Rania Alabbasi)의 경우는 특히 충격적인 사례다. 2013년 가택 수색으로 남편이 체포된 지 며칠 후, 라니아와 2세부터 14세 사이인 6명의 자녀 역시 모두 체포되었으며, 지금까지 가족 모두가 행방을 알 수 없는 상태다. 이들 부부가 지역사회에서 인도주의적 지원 활동을 했기 때문에 표적이 된 것으로 추정된다.

이번 보고서는 강제실종 이후 피해자의 가족과 친구들이 심리적 트라우마, 괴로움, 절망감과 육체적 고통에 시달리는 안타까운 모습도 보여준다. 2012년 강제 실종된 유세프의 형제 사에드는 지금까지도 어머니가 눈물이 마를 날이 없다며 “가끔 한밤중에 일어나 보면 어머니께서는 주무시지도 않고 형의 사진만 보며 울고 계신다”고 했다.

필립 루터 국장은 “강제 실종은 시리아 정부가 의도적으로 벌이는 잔혹한 활동이다. 정부는 수십만 명의 말 못할 고통을 간단히 끝낼 수 있는 충분한 권한이 있다. 그저 보안군에게 납치 활동을 중단하라고 명령하고, 실종된 가족의 행방이나 생사를 가족들에게 알리고, 자신의 권리를 평화적으로 행사했다는 이유만으로 수감된 모든 사람들을 즉시 조건 없이 석방하면 되는 것”이라고 말했다.

유엔과 일부 국가들이 이미 강제 실종에 대해 규탄한 바 있지만, 이제는 비난 이상의 더욱 강력한 조치가 필요한 때다. 1년 8개월 전인 2014년 2월 유엔 안전보장이사회는 시리아에서의 강제 실종 중단을 촉구하는 2139번 결의안을 채택했지만, 이것이 시행되기까지는 아직도 갈 길이 멀다.

필립 루터 국장은 “실질적인 행동 없는 비난만으로는 강제실종 피해자들에게 아무런 도움이 되지 않는다. 유엔 안전보장이사회는 시리아의 상황을 시급히 국제형사재판소에 회부하고, 자산동결 등의 구체적인 제재를 통해 시리아 정부가 강제 실종 중단에 나서도록 압박해야 한다”며 “최근 시리아 내에서 군사작전을 시작한 이란과 러시아 등 시리아 정부를 지지하는 국가들은 자국의 지원으로 자행된 대규모의 반인도적 전쟁범죄로부터 자유로울 수 없다. 바사르 알 아사드 정권의 중요한 후원국인 러시아는 강제 실종이라는 잔혹하고 야비한 활동을 중단하도록 시리아 정부를 설득할 수 있는 유일한 위치에 있다”고 말했다.

Syria: State profits from crimes against humanity as policy of enforced disappearances drives black market

The vast scale and chillingly orchestrated nature of tens of thousands of enforced disappearances by the Syrian government over the past four years is exposed in a new report by Amnesty International published today.

Between prison and the grave: Enforced disappearances in Syria reveals that the state is profiting from widespread and systematic enforced disappearances amounting to crimes against humanity, through an insidious black market in which family members desperate to find out the fates of their disappeared relatives are ruthlessly exploited for cash.

“This report describes in heart-breaking detail the devastation and trauma of the families of the tens of thousands of people who have vanished without trace in Syria, and their cruel exploitation for financial gain.”

The scale of the disappearances is harrowing. The Syrian Network for Human Rights has documented at least 65,000 disappearances since 2011 – 58,000 of them civilians. Those taken are usually held in overcrowded detention cells in appalling conditions and cut off from the outside world. Many die as a result of rampant disease, torture and extrajudicial execution.

Enforced disappearances have become so entrenched in Syria they have given rise to a black market in which “middlemen” or “brokers” are paid bribes ranging from hundreds to tens of thousands of dollars, by family members desperate to find out the whereabouts of their loved ones or whether they are even still alive. Such bribes have become “a big part of the economy” according to one Syrian human rights activist. A lawyer from Damascus also told Amnesty International the bribes are “a cash cow for the regime… a source of funding they have come to rely on”.

Those forcibly disappeared include peaceful opponents of the government such as demonstrators, human rights activists, journalists, doctors and humanitarian workers. Others have been targeted because they are believed to be disloyal to the government or because their relatives are wanted by the authorities.

In some cases, especially in the last two years, enforced disappearances have been used opportunistically as a means to settle scores or for financial gain, further fuelling the cycle of disappearances.

Some families have sold their property or given up their entire life savings to pay bribes to find out the fate of their relatives – sometimes in exchange for false information. One man whose three brothers were disappeared in 2012 told Amnesty International he had borrowed more than US$150,000 in failed attempts to find out where they are. He is now in Turkey working to pay back his debts.

“As well as shattering lives, disappearances are driving a black market economy of bribery which trades in the suffering of families who have lost a loved one. They are left with mounting debts and a gaping hole where a loved one used to be,” said Philip Luther.

Family members who try to inquire about disappeared relatives are often at risk of arrest or being forcibly disappeared themselves, which gives them little choice but to resort to using such “middlemen”. One man who asked the authorities about his brother’s whereabouts was detained for three months and spent several weeks in solitary confinement. Another man who went to Damascus to look for his disappeared son was arrested at a military checkpoint on the way and has not been heard from since.

A friend of Syrian human rights lawyer Khalil Ma’touq, who was forcibly disappeared two years ago, said enforced disappearances are part of “a grand strategy by the government to terrorize the people of Syria”. His daughter Raneem Ma’touq was also disappeared for two months and had a horrifying experience in detention.

In one particularly shocking case, Rania Alabbasi, a dentist, was arrested in 2013 along with her six children aged between two and 14 years old, days after her husband was seized during a raid on their home. The entire family has not been heard of since. It is believed they may have been targeted for providing humanitarian assistance to local families.

The report gives a tragic insight into the psychological trauma, anguish, despair and physical suffering experienced by family members and friends after an enforced disappearance. Saeed, whose brother Yusef was forcibly disappeared in 2012, said his mother never stops crying now. “Sometimes in the night I wake up and she is awake, looking at his picture and crying,” he said.

“Enforced disappearances are part of a deliberate, brutal campaign by the Syrian government. It is entirely within their power to put an end to the unspeakable suffering of scores of thousands simply by ordering security forces to stop enforced disappearances; informing families of the whereabouts or fate of their disappeared relatives; and immediately and unconditionally releasing all those imprisoned for peacefully exercising their rights,” said Philip Luther.

While some states and the UN have condemned enforced disappearances, much more is needed than words of censure. More than a year and a half ago, in February 2014, the UN Security Council adopted Resolution 2139, which calls for an end to enforced disappearances in Syria, but it has yet to take further steps to ensure it is implemented.

“Words which are not followed up by concrete action will not help the victims of enforced disappearances.
