 특히 이번 환경도시위원회의 결정은 도민사회의 우려와 민의를 전혀 반영하지 않은 결정이다. 도민사회는 일관되게 이번 한진의 지하수 증산이 제주특별법 상 공수화 원칙을 흔들 수밖에 없음을 지적하여 왔다. 제주특별법상 공수화원칙은 1980년대 과도한 지하수의 난개발에 대한 지하수 오염과 고갈 등의 위기의식에서 시작되어 1995년 먹는샘물 개발법 통과에 따라 지하수 고갈의 위기가 현실로 다가오자 이를 막기 위해 만들어졌다.

 이에 따라 먹는샘물은 제주도공기업만이 취수해 판매하도록 하여왔다. 다만 한진의 경우 법 제정 이전에 허가를 받은 사항이 있어 이를 인정해 1일 100톤에 한해 먹는샘물을 제조 판매하도록 한 기득권을 일정부분 인정해 준 것이다. 따라서 기존 100톤 이상의 증산을 위해서는 새로운 허가를 받아야 한다는 것이 도민사회의 일관된 입장이었다. 하지만 이런 법리적 검토나 공론화 과정을 제대로 거치지 않은 체 대기업의 일방적인 요구를 그대로 수용하면서 공수화 원칙의 근간이 사라질 위기에 놓여버린 것이다.

 원천적인 문제는 지하수의 공수화 원칙을 버리고 도의회에 동의안을 제출한 제주도에게 있으나 이를 견제하고 막아내야할 도의회가 그 역할을 하지 못한 것은 매우 경악스런 일이다. 특히 당론을 내세우며 제주도지하수 공수화를 천명해 왔던 더불어민주당 의원들까지 이런 결정을 내린 점은 실망을 넘어 분노를 일으키기에 충분하다. 물론 공수화 원칙 포기에 앞장선 바른정당 의원들 역시 그 책임에서 자유로울 수 없다.
