2차 세계대전 전후의 일본군 성노예제
1932년부터 2차 세계대전 중 아시아태평양 전역의 여성들이 일본 제국군에 의해 성노예로 강제 동원되었습니다. 일본군은 나이와 빈곤, 계급, 가족 상황, 교육 수준, 국적 또는 인종으로 인해 거짓으로 속이고 유인하기 쉬운 여성들을 주로 대상으로 삼았으며, 강제로 납치하기도 했습니다. 이들은 모두 구금된 채 성노예 생활을 강요받았고, 생존자들은 성노예 생활로 인한 신체적, 정신적 고통과 사회적 고립, 수치심, 극심한 빈곤에 시달려 왔습니다.

일본 정부는 해당 사안에 대해 장기간 법률적 입장만을 내세워 책임을 회피하려 했으며, 일본의 배상 의무는 1951년 샌프란시스코 평화조약을 비롯한 다수의 쌍방 합의 및 조약을 통해 이미 해결된 것이라고 주장해 왔습니다. 국제앰네스티는 근거로 제시된 조약과 합의가 성노예제에 대해서는 다루고 있지 않으며, 피해자 개인에 대한 충분한 배상을 요구하는 조항이 포함되지 않았기 때문에 이러한 일본 정부의 입장은 용납될 수 없다고 보고 있습니다. 일본 정부가 마련한 민간재단인 아시아여성재단(AWF)은 배상에 관한 국제기준을 만족하지 못하고, 생존자들에게는 침묵을 돈으로 사려는 시도로 여겨지고 있습니다.

2013년 5월, 유엔 고문방지위원회는 일본 정부에 “’위안부’ 문제에 대한 ‘피해자 중심적인’ 해결책을 마련하기 위해 즉시 효과적인 법적, 행정적 조치를 취할 것”을 촉구했습니다. 또한 일본이 국가의 법적 책임을 공개적으로 인정하고, 정부와 공직자들의 사실 부정 시도를 중단하고, 관련 자료를 공개하고, 사실 여부를 철저히 조사하고, 생존자들의 권리 침해를 인정하고 이에 대해 배상하고, 성노예제에 대한 교육을 실시해야 한다고 권고했습니다.

국제앰네스티는 일본 정부에 2차 세계대전 중 일본군 성노예제 생존자들의 정의를 구현할 것을 여러 차례 촉구했으며, 전쟁범죄와 반인도적 범죄에 해당할 수 있는 이러한 범죄행위에 대해 일본은 국제법상 충분히 효과적인 배상을 지급해야 할 의무가 있다고 지적했습니다. 최근 2015년 11월에도 국제앰네스티는 일본 정부에 공개서한을 보내, 일본군 성노예제에 대해 생존자들의 관점에서 그들의 요구를 고려하는 “피해자 중심적인” 접근 방식을 택할 것을 권고했습니다.

2015년 12월 28일, 일본과 한국 정부는 2차 세계대전 전후 일본군 성노예제 문제 해결에 합의했습니다. 그러나 완곡하게 “위안부”라 지칭되는 생존자 대다수와 지지 단체들에게는 환영받지 못했습니다. 생존자들은 협상 과정에서 제외된 채, 이들의 의견은 합의 내용에 전혀 반영되지 않았습니다. 일부 생존자들은 이 때문에 이번 합의가 “치욕적”이라는 의견을 표현하고 있습니다.

국제앰네스티는 이전부터 일본 정부 고위 관료와 유명 인사들이 1932년부터 2차대전 종전까지 성노예제가 존재했다는 사실을 부정하거나 정당화해 왔으며 2015년 말 한일 합의 이후로도 이런 태도가 지속되고 있다고 파악했습니다.

일본의 책임을 인정한다는 합의 내용과는 반대로, 일본의 고위 공직자들은 2차대전 전후 성노예제를 용인하는 발언을 계속하고 있습니다. 2016년 1월 14일, 전 일본 문부과학성 부대신을 지낸 자민당의 사쿠라다 요시타카 중의원은 “위안부”가 “직업적인 매춘부”라고 발언했습니다. 이후 발언을 철회하긴 했으나, “위안부” 여성에 대한 제도적인 전쟁범죄를 약화시키려는 시도가 계속되면서 생존자들의 치욕과 고통이 지속되고, 이들에 대한 명예회복이 이루어지지 못하고 있습니다.

이러한 국제법상 범죄를 인정하고, 미래세대를 위해 역사에 사실로 기록하는 것은 무장분쟁 중 저질러진 성폭력 범죄의 재발을 막고 책임자를 처벌하기 위해 필요한 중요한 조치입니다. 이번 합의에 한국 정부가 해당 문제를 다시는 거론하지 않고, 성노예제 생존자들을 기리는 ‘평화의 소녀상’을 서울에서 철거한다는 조항이 포함된 것은 투명성과 진실, 화해를 위한 노력에 역행하는 것으로 보입니다.

중국, 필리핀, 싱가포르, 말레이 반도, 인도네시아 등 아시아태평양 지역 전역의 여성들도 마찬가지로 일본 제국군에 성노예로 강제 동원되었지만 스가 요시히데 일본 관방장관은 한국과의 합의 타결 이후 다른 국가와 다시 “위안부” 문제로 협의할 의사가 없다고 밝혔습니다. 모든 생존자들은 동일한 배상 기회가 제공되어야 하고, 국적에 따라 다른 대우를 받아서는 안 될 것입니다.

권고사항

국제앰네스티는 일본 정부에 다음과 같이 권고합니다.

  • 일본군 성노예제로 인해 직접적인 피해를 입은 사람이라면 생존자, 이미 사망한 피해자, 그 가족을 비롯해 누구든 국적에 상관없이 충분하고 효과적인 배상을 제공하도록 노력해야 합니다.
  • 금전적 배상뿐만 아니라 원상회복, 재활, 정신적 배상과 같이 생존자들이 요구하는 배상을 제공하고, 이를 번복하지 않을 것임을 보장해야 합니다.
  • 배상을 요구하거나 소송을 청구할 생존자들의 권리를 침해할 수 있는 조치를 취해서는 안 됩니다.
  • 한국 정부와 함께 배상이 효과적으로 이루어질 수 있는 제도를 마련해야 합니다.
  • 역사와 공문서, 일본 공교육 제도에서 사용하는 교과서 등에 일본군 성노예제에 대해 정확히 기록함으로써 같은 일이 되풀이되지 않도록 해야 합니다.
  • 성노예제를 부인하거나 정당화하려는 정부 관계자와 유명 인사들의 발언을 철회해야 합니다.

JAPAN- SUBMISSION TO THE COMMITTEE ON THE ELIMINATION OF DISCRIMINATION AGAINST WOMEN

INTRODUCTION
Amnesty International would like to submit the following information for consideration of the United
Nations (UN) Committee on the Elimination of Discrimination against Women in advance of the review
of Japan’s combined seventh and eighth periodic reports. This briefing does not reflect the full range of concerns of the organization in terms of respect, protection and fulfilment of women’s rights in Japan, but looks solely at the recent developments on the issue of Japan’s military sexual slavery system before and during World War II including the recent bilateral agreement between Japan and Republic of Korea (South Korea).

JAPAN’S MILITARY SEXUAL SLAVERY SYSTEM BEFORE AND DURING WORLD
WAR II

Women from throughout the Asia-Pacific region were forced into sexual slavery by the Japanese Imperial Army from 1932 through the duration of World War II. The Japanese Imperial Army targeted women and girls who, because of age, poverty, class, family status, education, nationality or ethnicity, were susceptible to being deceived and trapped into the sexual slavery system. Others were abducted by force. All were detained and forced into slavery. Those who survived suffered, and continue to suffer, from physical and mental ill-health, isolation, shame and often extreme poverty as a result of their enslavement.

The Japanese government has made a prolonged and determined effort to hide behind its legal position on the issue and continued to insist that any obligation to provide reparation was settled in the 1951 San Francisco Peace Treaty and other bilateral peace treaties and arrangements. Amnesty International believed the government’s position was untenable, including because the named treaties and agreements did not cover acts of sexual slavery, and did not preclude individuals from seeking full reparation. The Asian Women’s Fund (AWF), a private fund established by the Japanese government, failed to meet international standards on reparation and was perceived by the survivors as a way of buying their silence.

In May 2013, the UN Committee against Torture urged Japan “to take immediate and effective legislative and administrative measures to find a ”victim-centred” resolution for the issues of “comfort women””. This recommendation urged the State to publicly acknowledge legal responsibility, refute attempts to deny the facts by government authorities and public figures, disclose related materials, investigate the facts thoroughly, recognize the survivors’ right to redress, and educate the public about the system.

Amnesty International has repeatedly called on the government of Japan to provide justice for the survivors of Japan’s World War II military sexual slavery system and noted that Japan has an obligation under international law to provide full and effective reparation for these crimes, which may constitute war crimes and crimes against humanity. As recently as November 2015, Amnesty urged the Japanese government in an open letter to adopt a “victim-centred” approach to the issue that took into account the views and needs of the survivors themselves.

On 28 December 2015, Japan and South Korea reached an agreement to resolve the issue of Japan’s military sexual slavery system before and during World War II. However, this agreement has not been welcomed by majority of survivors (euphemistically referred to as “comfort women”) and the organizations that support of them. Survivors were missing from the negotiation table and were not able to contribute their views concerning the agreement. Some survivors have since expressed the opinion that the deal is “humiliating” because the will of survivors is not reflected. Amnesty International had noted previously that senior Japanese government officials and public figures continued to deny the existence of a military sexual slavery system from 1932 until the end of World War II, or justified the existence of this system and this has continued even after the agreement was reached at the end of 2015.

Contrary to the agreement, which acknowledges Japan’s responsibility, high-profile public figures in Japan continue to make remarks implying that military sexual slavery before and during WW II was acceptable. On 14 January 2016, a senior member of the leading party Liberal Democratic Party(LDP), Yoshitaka Sakurada, a former state minister of education, made remarks that “comfort women” were “professional prostitutes”.5 Though he later retracted his remarks, the continued attempt to undermine systematic war crimes against ”comfort women“ prolongs the humiliation and suffering of the survivors and fails to restore their dignity.

Acknowledging these crimes under international law, and factually recording them in histories for future generations is an important step to ensure non-repetition and end impunity for crimes of sexual violence committed during armed conflicts. The new agreement, which includes a provision that the South Korean government never again raise the issue and that a Peace Monument in Seoul commemorating the survivors of the military sexual slavery system be removed, seems to run counter to efforts of transparency, truth and reconciliation.

While women from across the Asia-Pacific region, including in China, the Philippines, Singapore, Malaya and Indonesia, were also forced into sexual slavery by the Japanese Imperial Army, the Cabinet Secretariat Chief Yoshihide Suga indicated that Japan does not intend to launch new negotiations on the “comfort women” issue with other countries after reaching a deal with South Korea.6 All survivors should have the same access to redress and should not be treated differently based on their nationality.

RECOMMENDATIONS

Amnesty International calls on the Japanese authorities to:

  • Seek to provide full and effective reparation to any individual who has suffered harm as the direct result of the military sexual slavery system, including survivors, non-surviving victims and their families regardless of their nationality;
  • Offer, in addition to compensation, other forms of reparation identified by survivors including measures of restitution, rehabilitation, satisfaction and guarantees of non-repetition;
  • Reject measures, which may undermine the right of survivors, including their ability to seek reparation and access to justice before courts;
  • Work with the government of South Korea to ensure that effective systems are put in place to implement reparation measures;
  • Ensure non-repetition by including an accurate account of Japan’s military sexual slavery system including in histories, public documents and textbooks used in the Japanese educational system.
  • Refute statements made by government authorities and public figures attempting to deny or justify the military sexual slavery system.

카메룬 정부는 북부 지역의 이슬람 학교를 습격해 5세 어린이를 포함한 청소년 84명을 일제 구속하고 6개월간 불법 구금하고 있는 것에 대해, 즉시 이들을 석방해야 할 것이라고 국제앰네스티가 19일 밝혔다.

2014년 12월 20일, 카메룬 정부군은 귀르비딕에 위치한 학교 여러 곳을 습격해 어린이 84명과 교사를 포함한 남성 43명을 체포했다. 체포된 어린이들은 3명을 제외하고 모두 15세 이하였으며 그 중 47명이 10세 이하였다. 정부는 해당 학교가 무장단체 보코하람의 훈련소로 이용되고 있었다고 주장했다.

그로부터 6개월이 지났지만 여전히 어린이들은 아무런 죄목으로도 기소되지 않은 채, 카메룬 북부 도시 마루아의 소년원에 구금되어 있다. 지역당국의 지원이 전혀 없어, 유니세프(Unicef)와 세계식량계획이 침대와 식량을 제공하고 있지만 현재는 이마저도 부족한 실정이다.

스티브 콕번(Steve Cockburn) 국제앰네스티 서-중앙아프리카지역 부국장은 “어린 아이들을 부모로부터 오랜 시간 떼어놓은 채 지원도 거의 하지 않고 있다는 것은 상상도 할 수 없는 일이다. 어린이들은 그저 집으로 돌아가 가족과 함께 지내기만을 바라고 있다. 이 아이들이 보코하람과의 전쟁으로 인한 부수적인 피해를 입어야 할 이유는 없다”며 “어린이들을 구금한다고 해서 보코하람의 위협 속에 살아가는 카메룬 국민들을 보호하는 데 아무런 도움이 되지 않을 것이다. 정부는 보코하람과의 전쟁 중에도 인권을 존중하겠다는 약속을 지켜야 하며, 지체 없이 아이들을 석방해 가족의 품으로 돌아갈 수 있도록 해야 한다”고 말했다.

지난해 카메룬은 국내에서 여러 차례 발생했던 대규모 보코하람 습격에 대응해 북부 지역에서의 정부군 주둔 규모를 크게 확대했다. 수많은 민간인들이 처형되고 납치되었다.

12월 20일, 군경과 헌병 연합군이 귀르비딕 일대를 봉쇄하고, 보코하람에 아이들을 보내고 있다고 지역당국이 지목한 학교 여러 곳을 습격했다. 사전에 전혀 통보된 바 없이 이루어진 것이었다.

학교 습격 당시의 목격자들은 성인 남성과 어린 소년들이 일제히 구속되어, 몇 시간이고 광장에서 기다려야 한 후 강제로 트럭에 태워졌다고 전했다. 어린이들은 4일간 헌병대 본부에 유치되어 있다가, 사회부 관할의 소년원으로 보내졌다. 성인 남성들은 마루아 중앙 교도소로 보내져, 지금도 극도로 열악한 환경 속에 구금되어 있다.

한 어린이는 국제앰네스티 조사관에게 당시의 상황에 대해 이렇게 설명했다. “학교에서 코란을 읽고 있는데 군인들이 쳐들어와서, 신분증을 보여달라고 하고 우리를 심문했어요. 우리 무덤을 파서 그 안에 던져 넣어 버릴 거라고도 했어요. 정말 무서웠어요. 그리고는 선생님들을 마구 때렸는데, 얼굴이 온통 피범벅이 된 선생님도 있었어요.”

국제앰네스티가 확보한 목격자들의 증언에 따르면 당시 보안군은 민가에도 강제로 들이닥쳐 재산을 몰수하고, 주민들에게 뇌물을 요구하기도 했다. 한 주민은 사람들이 잡혀간 아들을 풀어달라며 군인들에게 돈을 주는 모습을 봤다고 했다. “그 날 저는 돈이 없었고, 결국 우리 아이를 끌고 가 버리더군요.“

체포될 당시 많은 사람들이 구타를 당했고, 국제앰네스티가 마루아 교도소에서 만난 39세의 코란 교사 역시 마찬가지였다. 그는 고개를 똑바로 들지 못하고, 혼자 걷지도 못하는 상태였다. 결핵 치료를 위해 병원으로 보내졌지만, 체포되는 과정에서 입은 부상에 대해서는 어떠한 치료도 받지 못했다.

국제앰네스티 조사관들은 어린이들이 구금되어 있는 것에 대해 카메룬 정부의 각 부처에 직접 문제를 제기해 왔다. 대부분 어린이들이 전혀 위협이 되지 않는다는 사실은 인정하면서도, 이들을 석방하고 집으로 돌려보낼 수 있게 책임을 전담하려는 곳은 한 곳도 없어, 구금된 어린이들은 막막한 상태로 방치되고 있다.

국제앰네스티는 15세 이하의 모든 어린이들을 즉시 석방해 가족의 품으로 돌려보낼 것과, 15세 이상의 청소년들은 국제적으로 타당한 죄목의 기소가 이루어지지 않을 경우 즉시 석방할 것을 촉구한다. 아프리카 인권위원회가 권고한 공정재판 권리에 관한 기준에서는 형사책임이 발생하는 최소 연령을 15세로 명시하고 있다.

국제앰네스티는 또한 카메룬 정부에 귀르비딕에서 이루어졌던 집단 체포 및 구금에 대해 독립적인 조사에 착수할 것은 물론, 같은 작전 과정에서 수감된 사람들에게 공정한 재판과 인도적인 수감 환경을 보장할 것을 촉구한다.

Cameroon: End six-month illegal detention of 84 children held following Quranic school raid

Cameroonian authorities must immediately end the six-month illegal detention of 84 children – some as young as five years-old – who were rounded up during a raid on Quranic schools in the far north of the country, Amnesty International said today.

On 20 December 2014, Cameroonian security forces raided a series of schools in a town called Guirvidig, arresting 84 children and 43 men – including many teachers. All but three of the children are under 15 years old and 47 are under 10. The authorities claim the schools were being used as fronts for ‘Boko Haram training camps’.

Six months on, the children remain detained in a children’s centre in Maroua, the main city of the northern region, despite having been charged with no crimes. In the absence of provisions from local authorities, Unicef provided mattresses for the centre while the World Food Programme has been providing food stocks, which are now running low.

It is unthinkable to keep children so young away from their parents for so long, and with so little support. The children want nothing more than to go home and be with their families. They do not deserve to become collateral damage in the war against Boko Haram

“Detaining young children will do nothing to protect Cameroonians living under the threat of Boko Haram. The Government must stand by its promise to respect human rights in the fight against Boko Haram, and release these children so they can be reunited with their families without delay.”

Over the last year Cameroon has significantly scaled up the presence of security forces in the far northern region of the country in response to a series of large-scale Boko Haram attacks on Cameroonian territory. Numerous civilians have been executed and kidnapped.

On 20 December, a joint force of police, gendarmes and army sealed off neighbourhoods of Guirvidig and raided schools that local authorities had accused of recruiting children for Boko Haram. No attacks had previously been reported in the town.

During the raid, witnesses report that the men and boys were rounded up and made to wait for hours in a public square before being forced to board trucks. The children were kept in custody at the gendarmerie headquarters for four days before being transferred to a juvenile centre under the control of the Ministry of Social Affairs. The men were taken to the Central Prison in Maroua, where they still remain in detention in extremely poor conditions.

One child told an Amnesty International researcher what happened: “We were reading the Quran when the security forces stormed our school. They asked for ID cards and interrogated us. They said they would dig our grave and throw us into it. We were scared. Then they roughed up our teachers… some among them had blood all over their faces.”

According to witness testimonies gathered by Amnesty International, the security forces also forcibly entered several houses confiscating assets and asking residents for bribes. One parent saw people giving money to the security forces to secure the release of their arrested sons. “That day, I had no money and they took my kid,” he said.

A number of men were beaten during their arrest, including one 39 year-old Quranic teacher met by Amnesty International at the prison in Maroua. He was not able to hold his head in an upright position and needed assistance to walk. He has been transferred to the hospital to be treated for tuberculosis but is yet to receive any treatment for injuries sustained during his arrest.

Amnesty International researchers have raised the case of the detained children directly with many different Cameroonian authorities. While most recognise that the children pose no threat, none had taken responsibility to facilitate their release and reintegration, leaving the children detained in limbo.

Amnesty International is calling for all children under the age of 15 to be immediately released and returned to their families, and those over 15 to be immediately released unless an internationally recognisable charge is brought against them. 15 is the minimum age of criminal responsibility according to the guidelines on the right to a fair trial as recommended by the African commission on human and people’s rights.

Amnesty also calls on Cameroonian authorities to open an independent enquiry into the mass arrests and subsequent detention at Guirvidig, as well ensuring fair trials and humane prison conditions for the men held during the same operation.

보고서 <'불의를 방송하고, 대량살상을 자랑하다'>는 이란 정부가 2016년 8월 2일 무장단체에 관련됐다는 혐의로 수니파 남성 25명을 집단 처형한 후, 사형집행을 정당화하기 위해 이들의 강제 “자백” 영상을 국영매체 보도로 쏟아내는 방식의 언론 캠페인을 벌였다고 지적했다.

연출된 무대 위에서 “자백”을 하는 이 영상은 ‘악마의 손으로’, ‘깊은 어둠 속에서’ 등 선정적인 제목을 달고 드라마 같은 배경음악이 깔렸다. 일부 영상에서는 극적인 효과를 더욱 높이기 위해 “곧이어 계속됩니다(to be continued)”, “곧 시작(coming soon)”과 같은 영화 예고편 형식의 자막이 삽입됐다.

강요된 ‘자백’

감옥 내부에서 녹음되어 비밀 휴대전화로 온라인상에 게시된 음성에서는 이들 중 많은 사람들이 정보부 구금시설에서 오랫동안 독방 구금된 채로 수개월에 걸쳐 고문을 당한 후 카메라 앞에서 “자백”할 것을 강요받은 것이라고 말했다. 발길질과 주먹질, 전기봉으로 구타를 당하거나 채찍질을 당했고, 수면 부족에 시달리며 음식과 치료약도 받을 수 없었다고 했다.

“달리 방법이 없다고 생각했다. (…) 더 이상의 괴롭힘과 고문을 견딜 수 없었다. (…) 그들[정보부 관료]은 나를 카메라 앞으로 데려가서, 시키는 대로 말만 하면 사건을 종결하고 나를 풀어줄 것이라고 했다.” 이후 처형된 사람들 중 한 명인 모크타르 라히미는 이렇게 말하며, 당시 했던 진술은 이후 유죄를 선고하는 데 이용됐다고도 덧붙였다.

또 다른 한 명인 카베흐 샤리피는 정보부가 준비한 6장짜리 문서를 외우라는 지시를 받았다고 했다.

“정보를 완전히 암기할 때까지 하루에 거의 두 시간씩 연습을 했다. 그들은 심지어 내 손짓까지 지시했고, 내가 독방에 구금되어 있거나 부당대우를 받고 있다고 의심하지 못하도록 밝은 표정을 유지하라고도 했다.”

이란 정부는 선전 영상 공개와 더불어, 처형된 사람들이 응당한 처벌을 받을 만한 극악무도한 범죄자들이라는 선동적인 성명을 연이어 발표했다. “자백” 영상과 마찬가지로, 이러한 성명에서도 사건에 대해 편향적으로 설명하고, 언급한 사람들의 존엄과 평판을 깎아내렸다. 또한 이 사람들이 단체로 광범위한 범죄행위를 저질렀다고 비난하면서도 언급된 범죄 사건에 각자가 어떻게 관련되어 있는지는 정확히 밝히지 않았다.

선동 영상

“자백” 영상에 등장한 카베흐 샤리피, 카베흐 베이시, 샤흐람 아흐마디, 에드리스 네마티 등을 포함한 남성 25명은 2016년 8월 2일 처형됐다. 체포된 후 쿠르드주 사난다지의 정보부 구금시설에 갇혀 있던 로그만 아미니, 바시르 샤흐나자리, 사만 모함마디, 슈레시 알리모라디 등 수니파 남성 4명 역시 영상에서 주로 등장했다.

영상 속에서 이들은 스스로를 처벌받아 마땅한 “테러리스트”라며 반복해서 폄하했다. 또한 자신들이 토위드 바 자하드라는 무장단체와 관련이 있으며, 무장공격을 감행해 “비신자(kuffar)”들을 살해하려 음모했다고 “자백”했다. 일부 영상에서는 자신들을 무장단체 자칭 이슬람국가(IS)와 비교하며, “우리가 저지당하지 않았다면 IS보다 더 끔찍한 잔혹행위를 저질렀을 것”이라고 경고하기도 했다. 이 영상에는 IS가 시리아와 이라크에서 자행한 잔혹행위를 담은 영상이 삽입됐다. 이란 국민들의 주변 지역 안보 위협에 대한 공포를 이용해 이들의 처형을 정당화하려는 명백한 시도였다.

영상 속에 다수의 모순점이 발견되는 것도 “자백”에 대본이 있을 가능성을 시사하는 점이다. 일부의 경우 연관된 범죄가 이들이 체포된 몇 개월 뒤 발생한 것이거나, 범죄에 어떻게 참여했는지가 영상마다 크게 달라지기도 했다.

이 “자백” 영상은 이란 정보부와 보안군이 해당 남성들의 무죄로 추정될 권리 및 강제로 자신에게 불리한 증거를 제출하지 않을 권리를 상당히 침해하고 있음을 잘 보여주고 있다.

이 남성들은 “수니파 원리주의 단체의 일원”으로 무장공격과 암살을 감행했다며 “신성모독”이라는 모호하게 정의된 죄목으로 유죄가 선고됐다. 그러나 이들 중 다수는 사형수로 복역하는 수 년 동안 이러한 활동에 연루된 바가 없다고 재차 부인했다.

국제앰네스티는 해당 사건의 재판 관련 정보가 비밀에 부쳐져, 이처럼 상반된 진술의 어느 쪽도 확인할 수 없었다. 그러나 조사 결과 이들의 재판이 터무니없이 불공정했던 것으로 드러났다. 피고인들은 모두 조사 단계에서 변호사와 면담이 허용되지 않았으며, “자백”을 얻어내기 위해 고문을 당해야 했다고 주장했다. 이렇게 얻어낸 자백은 이들에게 유죄를 선고하는 데 이용됐다.

시민적, 정치적 권리에 관한 국제규약의 당사국으로서, 이란은 고문을 금지, 예방, 처벌해야 하고, 고문으로 받아낸 “자백”을 증거로 인정하지 못하게 하고, 범죄 피고인은 누구나 공정한 재판을 받을 수 있게 보장할 법적 의무가 있다. 번복하지 못하는 사형제도의 특성상, 이러한 사건에서 국제 공정재판 보호조치를 엄격하게 관리하는 것이 더욱 중요하다.

이 영상들은 이란이슬람공화국방송(IRIB), 프레스티비(Press TV) 및 하빌리아연맹(Habilian Association)이라는 단체 등 여러 국영언론매체를 통해 제작, 방송됐다. “자백” 영상 제작에 관여한 관련 기관들 역시 영상에 등장한 사람들 및 그 가족에게 인권침해를 저지른 것에 대해 함께 책임져야 한다.

집단 처형 후 3개월이 지났지만, 이란 정부는 처형된 사형수 각각이 기소되고 유죄 선고를 받은 정확한 범죄 활동에 대해 아무런 정보를 공개하지 않았다. 이는 국제인권법상 모든 형사사건의 판결을 공개하고, 유죄를 선고하게 된 증거와 법적 근거를 분명히 밝혀야 할 의무를 위반하는 것이다.

필립 루서 국장은 “이란 정부는 고문과 부당대우를 통해 받아낸 ‘자백’ 영상의 제작과 방송을 즉시 중단해야 한다. 또한 비밀에 부쳐지는 재판 절차를 공개하고, 법원이 충분히 근거 있는 판결을 내리고 이를 대중에 공개하도록 해야 한다”고 말했다.

국제앰네스티는 이란 정부에 사형제도 폐지를 목적으로 하는 공식적인 사형집행 유예를 즉시 선포할 것을 촉구한다.

배경

2016년 8월 2일 처형된 남성 25명 외에도 다수의 수니파 사람들이 구금되어 있었으며, 대부분은 2009년과 2011년 사이, 이란의 쿠르드 자치지역에서 무력충돌과 암살 사건이 다수 발생하던 시기 체포된 사람들이었다. 정부는 당일 20건의 사형이 집행됐다고 인정했지만, 국제앰네스티가 입수한 신뢰할 만한 정보에 따르면 5건이 추가로 더 집행되어, 총 25명이 처형됐다.

18세 미만의 나이에 체포된 바르잔 나스롤라흐자데흐를 비롯해 수백여 명이 여전히 사형수로 복역하고 있다.

2016년 10월 26일 현재, 올해 들어 이란에서 이루어진 사형집행은 최소 457건이지만 실제 집행 건수는 훨씬 높을 것으로 추정된다.

Iran: Macabre propaganda videos feature forced ‘confessions’ of executed Sunni men

Iran’s authorities have used crude propaganda tactics to dehumanize death penalty victims in the eyes of the public and divert attention away from the deeply flawed trials that led to their death sentences, said Amnesty International in a new report published today.

Broadcasting injustice, boasting of mass killing highlights how the Iranian authorities embarked on a media campaign following the mass execution of 25 Sunni men accused of involvement in an armed group on 2 August 2016, by flooding state-controlled media outlets with numerous videos featuring forced “confessions” in an attempt to justify the executions.

“By parading death row prisoners on national TV, the authorities are blatantly attempting to convince the public of their ‘guilt’, but they cannot mask the disturbing truth that the executed men were convicted of vague and broadly defined offences and sentenced to death after grossly unfair trials,” said Philip Luther, Research and Advocacy Director for the Middle East and North Africa at Amnesty International.

“Iran’s authorities have a duty to bring to justice individuals who carry out armed attacks killing civilians. However, there is never any excuse for extracting forced ‘confessions’ through torture or other ill-treatment and broadcasting them in chilling videos. This is a serious violation of prisoners’ rights and denies them and their families human dignity.”

The stage-managed “confession” videos have sensationalist headlines such as In the Devil’s hands (Dar dast-e Sheytan) and In the depth of darkness (Dar omgh-e tariki) and melodramatic musical backing tracks. In some of the videos, the scenes have been interposed with film trailer style captions such as “to be continued” or “coming soon” to heighten their dramatic effect.

Forced ‘confessions’

In messages recorded inside prison and posted online using a clandestine mobile phone many of the men said that they were forced to give “confessions” on camera after suffering months of torture in Ministry of Intelligence detention centres where they were held in prolonged solitary confinement. They described being kicked, punched, beaten with electric batons, flogged, deprived of sleep and denied access to food and medication.

“I felt I had no options left… I could not bear any more abuse and torture… They [intelligence officials] took me before a camera and told me that my case would be closed and they would release me if I stated what they told me to,” said Mokhtar Rahimi, one of those later executed, adding that the statements he made were then used to convict him.

Another man, Kaveh Sharifi, said he was told to memorize six pages of written text prepared by the Ministry of Intelligence:

“I practised for almost two hours a day until I had the information completely memorized… They even told me how I should move my hands and keep a happy face so that no one would suspect I was held in solitary confinement or ill-treated.”

As well as releasing propaganda videos, the Iranian authorities also issued a series of inflammatory statements similarly describing the executed men as heinous criminals deserving the punishment they received. As with the video “confessions”, the statements provide a skewed description of events and undermine the dignity and reputations of the men featured. They attribute to the men collectively a wide range of criminal activities and do not clarify what involvement each of them had in the reported incidents.

Propaganda videos

Those featured in the “confession” videos include Kaveh Sharifi, Kaveh Veysee, Shahram Ahmadi and Edris Nemati, who were among the 25 men executed on 2 August 2016. Loghman Amini, Bashir Shahnazari, Saman Mohammadi and Shouresh Alimoradi,four Sunni men who have been held in a Ministry of Intelligence detention centre in Sanandaj, Kurdistan Province since their arrests, are also featured prominently.

In the videos the men repeatedly denigrate themselves as “terrorists” who deserve their punishment. They “confess” to being involved with a group called Towhid va Jahad, which they say carried out armed attacks and plotted assassinations of “disbelievers” (kuffar). In some of the videos, they compare themselves to the armed group calling itself Islamic State (IS) and warn that “we would have committed atrocities worse than IS if we had not been stopped”. These videos are interjected with clips showing IS atrocities carried out in Syria and Iraq, in an apparent effort to exploit Iranian people’s fears about security threats elsewhere in the region to justify the men’s executions.

Several inconsistencies also arise within the videos indicating that the “confessions” are likely to have been scripted. In some cases, the men are linked to crimes that occurred months after they had been arrested or the nature of their involvement in the crimes attributed to them changes massively from one video to another.

The “confession” videos illustrate how far Iran’s intelligence and security forces have violated the men’s right to the presumption of innocence as well as the right not to be forced into incriminating themselves.

The men were convicted of the vaguely worded crime of “enmity against God” through “membership of a Sunni Salafist group” and carrying out armed attacks and assassinations. However, many of the men had repeatedly denied their involvement in such activities during their years on death row.

Amnesty International is not able to confirm either of these opposing narratives, not least due to the secrecy surrounding the trials. The organization’s research, however, indicates the men’s trials were blatantly unfair. They were all denied access to a lawyer at the investigation stage, and said they were subjected to torture in order to give “confessions” that were then used to convict them.

As a state party to the International Covenant on Civil and Political Rights, Iran is legally obliged to prohibit, prevent and punish torture, refrain from admitting “confessions” obtained by torture as evidence and ensure a fair trial for all those accused of a crime. Given the irreversible nature of the death penalty, it is even more crucial that in such cases international fair trial safeguards are strictly observed.

The videos were produced and broadcast by different state-associated media outlets, including Islamic Republic of Iran Broadcasting (IRIB), Press TV and an organization called Habilian Association. Any state-controlled bodies involved in the production of the “confession” videos share responsibility for the human rights violations committed against the men featured in their productions and their families.

Three months after the mass execution, the Iranian authorities have failed to provide information about the precise criminal activities that each of the executed men had been charged with and convicted of. This violates Iran’s obligations under international human rights law to issue public judgements in all criminal cases, making clear the evidence and legal reasoning relied upon for the conviction.

“The Iranian authorities must immediately stop producing and broadcasting ‘confessions’ extracted through torture and other ill-treatment. They must also lift the veil of secrecy around trial proceedings and ensure that courts issue well-reasoned judgements, which are made available to the public,” said Philip Luther.

Amnesty International calls on the Iranian authorities to immediately establish an official moratorium on executions with a view to abolishing the death penalty.

Background

The 25 men executed on 2 August 2016 were part of a larger group of Sunni men, most of whom were arrested between 2009 and 2011 when a number of armed confrontations and assassinations took place in Iran’s Kurdistan Province. While the authorities have acknowledged that 20 executions took place that day, Amnesty International has received reliable information about five additional executions, bringing the total to 25.

Scores of the men, including Barzan Nasrollahzadeh, who was arrested when under 18 years of age, remain on death row.

As of 26 October 2016 there have been at least 457 executions carried out in Iran so far this year, however the real figure is likely to be even higher.

Amnesty International opposes the death penalty in all cases without exception regardless of the nature or circumstances of the crime; guilt, innocence or other characteristics of the individual; or the method used by the state to carry out the execution. 올 10월 들어 팔레스타인인이 이스라엘 민간인, 군인, 경찰에 대해 흉기 공격을 시도하거나 직접 흉기로 찌르는 사건이 급격하게 증가했다. 지금까지 팔레스타인인의 총격 또는 흉기 공격으로 이스라엘인 8명이 목숨을 잃었으며, 같은 기간 동안 이스라엘군은 서안지구 점령지역과 이스라엘에서 팔레스타인인 35명 이상을 사살했다. 이 중 헤브론에서 숨진 사람만 최소 14명으로, 모두 흉기 공격을 감행했거나 그럴 것이라고 이스라엘측이 추측한 사람들이었다.

파델 알 카와스메흐의 사망

한편, 이달 초 헤브론 올드시티에서 이스라엘 민간인에게 목숨을 잃은 팔레스타인 소년이 당시 생명을 위협하는 행동을 전혀 하지 않았다는 목격자들의 증언은 이 지역에 거주하거나 근무하는 팔레스타인 민간인들이 처한 위험을 잘 드러내고 있다.

18세 소년 파델 알 카와스메흐(Fadel al-Qawasmeh)는 10월 17일 오전 출근길에 나서던 중 한 이스라엘 민간인에게 총에 맞아 숨졌다. 이스라엘군은 당시 파델이 칼을 가지고 이스라엘인을 찌르려 했다고 주장했으나, 사건이 벌어진 알슈하다 거리는 감시 카메라를 통해 이스라엘군의 삼엄한 감시를 받던 곳이었음에도 불구하고 이러한 주장을 뒷받침할 증거는 전혀 밝혀지지 않았다.

파델 알 카와스메흐는 사살되기 직전 알슈하다 거리의 56번 검문소를 통과했다. 이 지점을 기준으로 헤브론의 표면상 팔레스타인 점령 지역과, 이스라엘 불법 정착촌이 자리잡은 올드시티가 구분된다. 사건 발생 전날과 다음 날 해당 검문소에 있었던 국제앰네스티 조사관들은 이스라엘 군인들이 이곳을 지나는 사람들에게 주머니의 모든 소지품을 꺼내게 하고, 수 차례 금속탐지기를 통과하도록 지시하는 모습을 볼 수 있었다. 젊은 남성의 경우 특히 철저하게 몸수색을 받았기 때문에 파델이 칼을 소지하고 이곳을 통과했을 가능성은 극히 낮았다.

사건이 발생한 위치에서 불과 몇 미터 떨어진 곳에 사는 한 주민은 집에서 계단을 내려오던 도중, 한 젊은 남성이 이스라엘 군인들에게 가로막혀 다시 검문소로 돌아가는 모습을 봤다고 국제앰네스티에 전했다. 그리고는 군인들 옆에 서 있던 흰 옷을 입은 이스라엘 민간인이 이 남성의 뒤를 따라가더니, 머리와 등에 최소 3발 이상 총을 쐈다고 한다. 주민의 증언에 따르면 당시 파델은 손에 아무것도 들고 있지 않았으며, 세 번의 총격 모두 등 뒤에서 쏜 것이었다.

사건 현장을 발코니에서 목격한 또 다른 주민은 마찬가지로 흰 옷을 입은 이스라엘 민간인이 처음부터 총을 들고 있었고, 팔레스타인 소년을 향해 욕설을 하는 것을 들었으며, 이 소년이 누군가를 위협하는 낌새는 전혀 없었다고 전했다.

사건이 벌어지고 몇 초 만에 이스라엘 군인들이 현장에 도착했지만, 파델을 치료하거나 총을 들고 있는 이스라엘인을 체포하려는 움직임은 전혀 보이지 않았다고 한다.

이 주민은 “이스라엘 군인들이 쓰러진 채 피를 흘리고 있는 젊은이 옆에 서 있었는데, 사진만 찍고 있을 뿐 상처를 치료하려는 시도는 전혀 하지 않았다. 군인들은 그렇게 30분 동안 주변에 서 있다가 천을 덮었고, 그걸 보고 소년이 죽었다는 걸 알 수 있었다”고 말했다.

국제앰네스티는 이스라엘 군에 파델 알 카와스메흐가 사망한 정황에 대해 효과적이고 독립적인 조사를 시행할 것과, 파델을 습격한 가해자를 기소할 것을 촉구한다. 또한 군인들이 파델에게 응급처치를 하지 않았다는 진술의 사실 여부도 조사해야 할 것이다.

이스라엘 경찰 대변인은 국제앰네스티에 이미 해당 사건에 대해 조사하고 있는 중이며, 다만 “안보 사건”으로 분류되었기 때문에 이스라엘 정보기관이 조사를 담당하고 있다고 밝혔다.

정형화된 괴롭힘 방식

이스라엘 정착민들이 헤브론과 서안지구 점령지역의 팔레스타인인을 습격하고 괴롭히면서도 아무런 처벌도 받지 않는 것은 이미 오래 전부터 계속되어 온 패턴으로, 때로는 이스라엘군이 이를 노골적으로 지원하거나 묵인하기도 한다. 10월 17일 오전 사건 이후, 마스크를 쓰고 사복을 입은 이스라엘 정보원이 알슈하다 거리의 주택으로 들이닥쳐 현장을 목격한 주민들을 위협하고, 휴대폰으로 촬영한 사진이나 영상을 지우게 했다. 이스라엘군과 정착민들은 이후로도 여러 차례 같은 집 주민들을 공격하고 괴롭혔다.

한 주민은 “여기서는 [이스라엘]경찰에게 신고하는 것도 포기했다”고 말했다.

“신고를 하려면 수 차례 가게를 닫고 경찰서에 찾아가야 하는데, 그러면 며칠이나 장사를 못 하게 된다. 어차피 바뀌는 것도 없다. 경찰은 신고하러 갈 때마다 매우 불친절하게 대한다. 이제는 희망도 버린 상태”라고 덧붙였다.

더욱 엄격해지는 제한

이스라엘군은 정착민들의 공격으로부터 팔레스타인 주민들을 보호하기 위해 나서기는커녕, 29일 헤브론 올드시티에서 팔레스타인인의 이동을 더욱 엄격히 제한하겠다고 발표했다. 그와 함께 이 지역의 팔레스타인 상점을 모두 폐쇄했고, 15세부터 25세 사이의 팔레스타인 남성은 다수의 군 검문소를 통과할 수 없도록 했다.

파델 알 카와스메흐 사망 사건 이후로도 이스라엘 정착민들의 심각한 폭력 사건은 여러 건 발생했다. 10월 17일 또는 18일 밤, 팔레스타인 13세 소년이 헤브론 외곽의 불법 정착촌 키르야트 아르바 주민들이 던진 화염병을 가슴에 맞고 다쳤으며, 소년을 도우려던 사촌 역시 커다란 돌에 맞았다. 사건을 직접 목격한 근처 주민인 다아나 가족은 국제앰네스티에 당시 이스라엘 군인들이 함께 있었지만 전혀 개입하지 않았다고 전했다. 구급차를 불렀지만 공격이 계속된 탓에 현장까지 도착하지 못했다.

필립 루터 국장은 “서안지구 점령지역의 이스라엘인을 포함해, 모든 민간인에 대한 고의적인 공격은 재차 규탄해야 할 일이지만 팔레스타인 가해자는 엄격히 처벌을 받고 있는 한편 이스라엘 정착민들은 처벌에 대한 두려움 없이 팔레스타인 민간인을 해치고 살해까지 할 수 있다. 이스라엘군은 여전히 생명을 위협받는 경우가 아님에도 의심스러운 팔레스타인인을 대상으로 치명적인 무력을 사용하고 있다”며 “이스라엘의 조사 체계는 팔레스타인 민간인을 부당하게 살해한 이스라엘군과 경찰, 민간인을 감싸는 데 지나치게 오랫동안 이용되어 왔다. 국제사회의 압력으로 이처럼 부당한 관행을 끝내고, 팔레스타인인의 생명권 역시 존중되어야 하며 민간인에 대한 공격은 용납될 수 없다는 메시지를 전해야 할 것”이라고 말했다.

The Israeli military must immediately take steps to protect Palestinian civilians from attacks by Israeli settlers in the occupied West Bank and ensure effective investigation of all attacks, including the killing of a Palestinian teenager in Hebron by an Israeli civilian on 17 October, Amnesty International said today.

Since 1 October, there has been a dramatic increase in the number of attempted, alleged and actual stabbing attacks by individual Palestinians on Israeli civilians, soldiers, and police. Eight Israeli civilians have been killed in stabbing or shooting attacks by Palestinians. In the same period, Israeli forces have shot and killed more than 35 Palestinians in the occupied West Bank and Israel, including at least 14 in Hebron, either after stabbings were carried out or when the Israeli authorities alleged stabbing attacks were intended.

Amnesty International found evidence that at least some of the killings of Palestinians by Israeli forces in Hebron were extrajudicial executions, and four more Palestinians have been killed by Israeli forces in Hebron since Tuesday morning. But Palestinian residents of Hebron have told Amnesty International that they feel just as threatened by the Israeli civilians, many of them armed, living in illegal settlements in and around the city.
“In the space of less than a month, attacks by Israeli settlers on Palestinians in Hebron have escalated from what was already an unacceptably high level,” said Philip Luther, Director for the Middle East and North Africa Programme at Amnesty International.

“Israeli forces must fulfil their duties to protect Palestinian civilians living under occupation from attacks by settlers, work to prevent settler violence, and hold those responsible to account, particularly in Hebron. Their apparent failure to intervene during some of the recent settler attacks effectively makes them complicit.”

Killing of Fadel al-Qawasmeh

Eyewitness accounts stating that a Palestinian killed by an Israeli civilian in the Old City of Hebron earlier this month was not threatening the life of anyone at the scene highlight the dangers faced by Palestinian civilians living and working in the area.

On the morning of 17 October, 18-year-old Hebron resident Fadel al-Qawasmeh was walking to work when he was shot and killed by an Israeli civilian. The Israeli military claim that he had a knife and intended to stab the Israeli civilian but have released no evidence to support these claims, despite the fact that al-Shuhada Street, where the incident took place, is heavily monitored by video cameras operated by Israeli forces.

Shortly before he was shot, Fadel al-Qawasmeh had passed through Checkpoint 56 on al-Shuhada Street, which separates the section of Hebron ostensibly under Palestinian control from the Old City where illegal Israeli settlements are located. Amnesty International researchers present at the checkpoint the day before and after the shooting observed Israeli soldiers ordering people to remove items from their pockets and pass through the metal detector multiple times. Young men were particularly thoroughly searched, making it highly unlikely that Fadel al-Qawasmeh would have been able to smuggle a knife through.

A resident of a house on al-Shuhada Street, a few metres away from the scene of the shooting, told Amnesty International that as he was coming down the stairs of his home, he saw a young man being stopped by Israeli soldiers and turned back towards the checkpoint. He then reported seeing an Israeli civilian dressed in white, who had been standing next to the soldiers, follow the man up the road before shooting him at least three times in the head and back. He told Amnesty International that Fadel al-Qawasmeh had nothing in his hands, and all the shots were fired from behind.
Interviewed separately, a resident of another house on al-Shuhada Street who was watching from a balcony said that she saw an Israeli civilian of the same description holding a firearm in the moments before the shooting, and that she had heard him cursing the Palestinian youth. She did not see or hear any indications that the Palestinian youth was threatening anyone.

She saw Israeli forces approaching the scene within seconds, but they did not attempt to give medical treatment to Fadel al-Qawasmeh, or to arrest the settler holding the firearm.

“I saw Israeli soldiers standing next to the youth, who was lying on the ground bleeding. They were taking photos and did not attempt to treat his wounds. They stood around him for about 30 minutes and then they covered him and we knew he was dead,” she told Amnesty International.

Amnesty International is calling on the Israeli authorities to conduct an effective, independent investigation into the circumstances of the killing of Fadel al-Qawasmeh, and for the perpetrator of the attack to be brought to justice. The investigation should also examine whether soldiers failed to provide medical treatment for Fadel al-Qawasmeh.

An Israeli police spokesperson told Amnesty International that an investigation had been opened, but that as it was classified as a “security incident”, it was being handled by the Israel Security Agency.

A pattern of harassment

Settlers have long attacked and harassed Palestinians in Hebron and the rest of the occupied West Bank with impunity, and sometimes with the apparent assistance or acquiescence of Israeli forces. Later on the morning of 17 October, masked Israeli security personnel in civilian clothing stormed the house on al-Shuhada Street, threatened the residents who had been watching, and deleted photos and videos they had taken on their phones. Israeli forces and settlers have attacked and harassed residents of the same home several times since.

“We’ve given up complaining to the [Israeli] police here,” a resident of al-Shuhada Street told Amnesty International.

“In order to make a complaint, we have to close the store, go to the police station several times, and so lose several days of work. Nothing happens. The police treat us very badly when we go to make the complaint. I’ve given up hope.”

Deepening restrictions

Instead of taking steps to protect Palestinians from settler attacks, the Israeli military yesterday announced more restrictions on Palestinian movement in Hebron’s Old City, closing Palestinian stores in the area and prohibiting male Palestinians between the ages of 15 and 25 from passing through the numerous military checkpoints in the area.

Since the killing of Fadel al-Qawasmeh, there have been other serious incidents of violence perpetrated by settlers. On the night of 17/18 October, a 13-year-old Palestinian was wounded in the chest by a Molotov cocktail thrown by settlers from the illegal settlement of Kiryat Arba, on the outskirts of Hebron; his cousin trying to help him was hit by a large rock. Members of the Da’ana extended family, who live next to the settlement and witnessed the attack, told Amnesty International that Israeli forces were present and failed to intervene. An ambulance was called but was unable to reach the house due to the ongoing attack.
“While we again condemn all deliberate attacks on civilians, including Israeli civilians in the occupied West Bank, Palestinian perpetrators of such attacks do not enjoy impunity. On the other hand, Israeli settlers can harm and even kill Palestinian civilians seemingly without consequences, and Israeli forces continue to use lethal force against Palestinians they suspect, even when their lives are not at risk,” said Philip Luther.

“For far too long, Israel’s investigation mechanisms have served to shield Israeli military and police forces, as well as Israeli civilians, responsible for killing Palestinian civilians unlawfully. International pressure is needed to end this impunity, and send the message that Palestinians’ right to life matters and that all attacks on civilians will not be tolerated.”

태국 보안군의 고문 실태를 기록하고 이에 대한 보고서를 발표했다는 이유로 국제앰네스티 태국지부 의장을 비롯한 유명 인권활동가 3명이 27일 기소될 위기에 처한 가운데, 태국 정부는 이들에 대한 형사 수사를 즉시 취소해야 할 것이라고 국제앰네스티가 경고했다.

솜차이 홈라오르, 안차나 힘미나, 지난달 국제앰네스티 태국지부 이사장으로 임명된 포르펜 콩카콘키엣 등 3명은 “형사상 명예훼손” 및 “컴퓨터 범죄” 혐의로 기소되었으며 유죄가 선고될 경우 징역 5년과 미화 4,800달러의 벌금에 처해질 수 있다. 이들 3명은 7월 26일까지 파타니 경찰서에 신고해야 한다.

살릴 셰티(Salil Shetty) 국제앰네스티 사무총장은 “태국 정부가 고문금지법을 도입하겠다고 약속한 것과 동시에 끔찍한 고문 관행을 폭로했다는 이유로 활동가들을 박해하고 있는 것은 잔인한 모순이다. 태국 정부는 이들 활동가 3명에 대한 형사 수사를 중단하고 혐의를 취소해야 하며, 이들이 제기했던 매우 중대한 인권침해 문제에 대해 독립적이고 공정한 조사를 지시해야 한다. 국가의 의무는 인권활동가를 보호하는 것이지, 보안군이 처벌받지 않도록 막아주는 것이 아니다”라고 말했다.

솜차이 홈라오르, 포르펜 콩카콘키엣, 안차나 힘미나는 다문화재단과 두아자이 그룹(Hearty Support Group)의 회원으로, 치안이 불안정한 남부 지역에서 태국군과 경찰이 자행한 고문 및 부당대우 54건을 기록한 보고서를 지난 2016년 2월에 발표했다.

2016년 5월 17일 이들을 고소한 태국 내부보안작전 제4사령부는 고문보고서에서 중점적으로 다뤄진 남부 지역의 보안작전을 담당하고 있다.

3명의 활동가에게 적용된 혐의는 오래 전부터 계속되어 온 인권옹호자 탄압 시도 유형의 반복에 불과하다. 이는 활동가들의 권리를 보호해야 할 국제적 의무를 명백히 위반하는 것이다.

2014년 쿠데타 이후 태국 군사정부는 표현과 집회, 결사의 자유를 광범위하게 제한하는 등 모든 형태의 반대 의견을 억압하려는 노력에 박차를 가했다. 오는 8월 7일 국민투표에 부쳐질 헌법초안에 반대한다는 이유로 지난 3개월간 정부가 기소한 사람만 100명이 넘는다.

살릴 셰티 사무총장은 “유명 활동가 3인에게 이같은 일이 벌어진다면, 누구도 군사정부의 손아귀에서 벗어날 수 없으며 누구도 안전하지 못하다는 메시지를 전하고 있는 것”이라고 말했다.

국제앰네스티는 표현의 자유를 행사한 것만으로 수감된 사람은 모두 양심수로 간주하며, 이들을 조건 없이 즉시 석방할 것을 촉구한다.

배경

솜차이 홈라오르는 인권침해를 기록하는 단체인 다문화재단(Cross Cultural Foundation) 의 상임고문이자 전 회장이며, 포른펜 콩카콘키엣은 같은 단체의 국장이다.

지난달 포른펜 콩카콘키엣은 국제앰네스티 태국지부 이사회의 의장으로 선출되었고, 이는 다문화재단에서의 활동과는 별개의 직책이다.

국제앰네스티는 이들이 발표한 고문보고서의 준비 또는 발표 과정에 관여하지 않았다.

한편, 태국은 2015년 12월 17일, 128개 유엔 회원국과 함께 인권옹호자들에 대한 정부의 박해 및 보복 행위를 자제할 것을 촉구하는 유엔 결의안을 지지한 바 있다.

Thailand: Amnesty International Thailand’s Chair and other activists face jail for exposing torture

The Thai authorities must immediately drop the criminal investigation against three of the country’s most prominent human rights activists, including the chair of Amnesty International Thailand, who could be charged tomorrow for documenting and publishing a report about torture by Thai security forces, the organization warned.

Somchai Homla-or, Anchana Heemmina, and Porpen Khongkaconkiet, who was appointed Chair of the Amnesty International Thailand board last month, face the prospect of five years behind bars and a fine of US $4,800 if found guilty on charges of “criminal defamation” and “computer crimes”. The three are due to report to Pattani police station on 26 July.

“At a time when the Thai government has promised to introduce anti-torture legislation, it is a cruel paradox that they are harassing activists for exposing the abhorrent practice,” said Salil Shetty, Secretary General of Amnesty International.

“The Thai authorities should immediately stop the criminal investigation, drop the charges against these three activists and order an independent and impartial investigation into the very serious human rights violations they have raised. It is the state’s duty to protect human rights activists, not to shield security forces from accountability.”

Somchai Homla-or, Porpen Khongkaconkiet and Anchana Heemmina are members of the Cross Cultural Foundation, Dua Jai Group (Hearty Support Group. Together, they published a report in February 2016 documenting 54 cases of torture and other ill-treatment by the Royal Thai police and Royal Thai army in the volatile southern provinces, where the reported acts of torture took place.

The complaint against them was filed on 17 May 2016 by the Internal Security Operations Command Region 4, which is responsible for security operation in the southern provinces – the focus of their report on torture.

The allegations against the three are merely the latest in a longstanding pattern of attempts to intimidate human rights defenders, in clear breach of Thailand’s international obligations to protect their rights.

Since the 2014 coup, Thailand’s military government has stepped up efforts to stifle all forms of dissent, including by imposing broad restrictions on the rights to freedom of expression, assembly and association. In the past three months alone, authorities have initiated charges against more than 100 individuals for opposing a draft constitution that is the subject of a 7 August national referendum.

“If this can happen to three well-known activists then the message the military government is sending is that no one is beyond their reach and no one is safe,” said Salil Shetty.

Amnesty International considers any person who is imprisoned solely for expressing their rights to freedom of expression as prisoners of conscience, and calls for their immediate and unconditional release.

Last month, Pornpen Khongkachonkiet was elected Chair of Amnesty International Thailand’s board, a position she holds independent of her work with the Cross Cultural Foundation.

On 17 December 2015, Thailand was one of 128 United Nations member states to support the UN resolution that calls on authorities to refrain from intimidating and mounting reprisals against human rights defenders.
