세계 이주민의 날: 각국 정부, 난민 위기 대응 나서야

세계 각국 정부는 언제나 같은 경로를 이용하면서 같은 인권침해에 노출되고 있는 이주민과 난민들을 보호하기 위해 나서야 할 것이라고, 세계 이주민의 날을 맞아 국제앰네스티가 밝혔다.

올해는 동남아시아 지역의 이주민들이 특히 취약한 상황에 처했다. 2015년 5월, 미얀마와 방글라데시를 떠난 수천 명의 난민들은 벵골 만과 안다만 해에서 선원들에게 끔찍한 학대를 당했다. 살인과 구타를 당하는 것은 물론 비인도적이고 굴욕적인 환경에 오랫동안 갇혀 있어야 했다.

인신매매와 밀수에 대한 태국 정부의 강경 단속으로 선원들이 난민선을 버리고 떠나면서 해상에 표류하게 된 이주민과 난민들이 결국 인도네시아와 말레이시아에서 제공한 임시 거주지에 정착하는 일도 있었다.

참파 파텔(Champa Patel) 국제앰네스티 동남아시아국장은 “2015년 세계적인 난민 위기에 전세계의 이목이 집중되었음에도 정작 이주민들은 크게 주목받지 못하고 있다”며 “이주민들은 사람다운 삶을 바라는 것조차 불가능하게 만드는 극심한 가난과 역경 때문에 고향을 떠나야만 하는 경우가 많다. 난민과 마찬가지로 이들 역시 위험한 비공식 경로를 이용하면서 인신매매업자들에 의한 착취와 구금, 사망의 위험에 속수무책인 상태”라고 말했다.

동남아시아

동남아시아 지역 국가들은 이주민과 난민들이 계속해서 안다만 해와 벵골 만을 가로지르는 위험한 뱃길을 택하고 있음에도, 법집행만을 최우선하며 이들의 안전은 고려하지 않고 있다.

국제앰네스티는 동남아 지역 국가들에게 수송 중인 이주민들을 보호하고 이들의 안전을 보장하기 위해 구체적인 조치를 취할 것을 촉구한다.

중앙아메리카, 멕시코

국제앰네스티는 또한 멕시코 정부에 대해 미국으로 향하기 위해 중앙아메리카를 지나는 이주민들을 보호하라고 촉구했다. 이 경로는 세계에서 가장 위험한 길로 여겨지고 있다.

보호자가 없는 어린이도 다수 포함된 이들 이주민 대부분은 중앙아메리카로부터 극심한 폭력과 가난을 피해 미국에 가고자 한다. 그 과정에서 납치와 실종, 성폭행, 살인까지 다양한 인권침해행위에 노출되는 끔찍한 여정을 감수할 수밖에 없다.

2013년 멕시코 정부가 법의학위원회를 창설한 것은 바람직한 조치였으나 이것만으로는 충분치 않다. 2010년과 2012년 사이 멕시코 북동부 타마울림파스와 누에보레온 주에서 벌어진 이주민 학살 사건에 대한 정부 조사는 여전히 한심할 수준으로 더디게 진행되고 있으며 지금도 계속되고 있는 납치와 살인, 실종 가해자들이 기소되는 경우도 거의 없다.

International Migrants Day: Governments Must Address Crisis

Governments must act to protect migrants fleeing through the same routes and exposed to the same abuses as refugees, said Amnesty International on International Migrants Day.
Migrants in South-East Asia have been particularly vulnerable this year. In May 2015, thousands of people from Myanmar and Bangladesh were subjected to horrific abuses at the hands of boat crews in the Bay of Bengal and the Andaman Sea. Abuses included killings, beatings and being kept in inhuman and degrading conditions.

Following the crackdown on trafficking and smuggling by the Thai authorities, crews abandoned their boats, leaving migrants and refugees stranded at sea, before they were eventually granted temporary shelter in Indonesia and Malaysia.

“While the world’s attention was focused on the global refugee crisis in 2015, migrants remained largely invisible,” said Champa Patel, South-East Asia Director at Amnesty International.

“Migrants are often forced to leave their homes due to extreme poverty and hardship that have rendered hopes for a dignified life impossible.”

“Just like refugees, they are vulnerable to exploitation by human traffickers, detention, and death on dangerous and irregular routes.”

South-East Asia

Governments in the region continue to prioritize law enforcement measures, even as migrants and refugees continue to attempt the deadly sea journey across the Andaman Sea and the Bay of Bengal, which do not address the safety of those attempting passage.
Amnesty International is calling on South-East Asian governments to put concrete measures in place to ensure the safety and protection of migrants in transit.

Central America and Mexico

Amnesty International is also calling on the Mexican government to protect migrants from across Central America en route to the USA – one of the most dangerous routes in the world.

The majority of migrants, many of whom are unaccompanied children, are trying to reach the USA from Central America, fleeing extreme levels of violence and poverty. Migrants are forced to undertake harrowing journeys where they are exposed to a range of abuses including abductions, disappearances, sexual violence and murder.

The creation of the Forensic Commission by the Mexican government in 2013 is a step towards the right direction, but it is not enough. Investigations by the state into the migrant massacres that occurred between 2010 and 2012 in the states of Tamaulipas and Nuevo León in north-eastern Mexico are still woefully slow and those responsible for ongoing abductions, killings and disappearances are rarely prosecuted.

일본에서 18일 또 다시 남성 2명을 처형한 가운데, 일본 정부의 비난 받아 마땅한 사형제도 사용은 중단될 기미가 보이지 않는다고 국제앰네스티가 밝혔다. 아베 신조 총리 내각이 들어선 이후로 일본에서 사형이 집행된 것은 이번으로 총 14건이 된다.

18일 이른 아침 도쿄 교도소에서 츠다 스미토시(63)가 교수형에 처해졌다. 일본에서 참심재판을 통해 사형이 선고된 사형수 중 처음으로 형이 집행된 츠다는 2011년 이웃 주민 3명을 살해한 혐의로 유죄를 선고받았다. 같은 날 일본 북동부 센다이 교도소에서 처형된 와카바야시 카즈유키(39)는 2007년 2명의 사망자를 낸 강도와 폭행 사건으로 사형이 선고됐다.

로젠 라이프(Roseann Rife) 국제앰네스티 동남아시아 지역 조사국장은 “사람을 죽음에 몰아넣고야 말겠다는 일본 정부의 의지는 오싹할 수준이며, 더 많은 생명이 희생되기 전에 당장 이를 중단해야 한다. 사형은 범죄를 해결할 수 있는 정의나 해답이 아니며, 생명을 존중하지 않는 잔인한 처벌 형태”라며 “일본 정부는 사형제도 폐지를 향한 첫걸음으로 즉시 사형집행에 관한 유예를 공식 선포해야 한다”고 말했다.

일본은 사형제도에 있어서는 시대를 역행하며, 세계에서 사형집행을 강행하고 있는 소수의 국가들 중 하나에 속하기도 한다. 2014년 현재 22개국만이 사형을 계속 집행하고 있는 반면 2015년 11월 현재 법적 또는 실질적 사형폐지국인 국가는 총 140개국이다.

몽골의 경우 지난 12월 초, 몽골에서 사형을 폐지한다는 내용의 법안이 의회를 통과해 2016년 9월 발효될 예정이다.

로젠 라이프 조사국장은 “일본 정치인들이 몽골의 엘벡도르지 대통령과 같이 나서서 리더십을 발휘하지 않는다면 일본은 계속해서 시대에 뒤처질 수밖에 없다”며 “전 세계, 특히 동아시아 지역에서 일본은 사형제도를 계속 사용하며 잘못된 주장을 고집하고 있다”고 말했다.

배경
일본의 사형집행은 비밀리에 이루어져, 보통 사형수는 불과 몇 시간 전에 고지를 받으며 일부 경우에는 전혀 사전 고지가 없을 수도 있다. 사형수 가족이나 변호사는 형이 집행된 이후에나 연락을 받는 경우가 대부분이다.

일본에 사형수에 대한 적절한 법적 안전조치가 존재하지 않는다는 점은 유엔 관련 전문가들이 널리 비판한 문제다.
피고인은 적절한 법적 자문을 구할 수 없으며, 사형이 선고될 수 있는 사건이라면 의무적으로 거쳐야 할 필수 항소 절차도 없다. 정신적, 지적 장애가 있는 사람들도 형이 집행되거나 사형수로 복역하고 있는 것으로 알려지고 있다.

국제앰네스티는 범죄의 성격이나 정황, 가해자의 유, 무죄 여부 또는 그 외 특성, 국가의 사형집행 방식에 상관없이 모든 경우에 대해 사형을 반대한다. 사형은 생명권을 침해하는 것이며, 극도로 잔인하고 비인도적이며 굴욕적인 형벌이다.

Japan: Two men hanged as disgraceful executions continue

The Japanese authorities’ reprehensible use of the death penalty shows no sign of letting up as another two men were executed today, taking the total number of executions to 14 under the government of Prime Minister Shinzo Abe, Amnesty International said.
Sumitoshi Tsuda, 63, was hanged in the early hours of Friday morning at Tokyo detention centre, the first execution of a person sentenced to death in a lay judge trial. He was convicted in 2011 of killing three of his neighbours. Kazuyuki Wakabayashi, 39, was executed at Sendai detention centre in north-east Japan. He was sentenced to death in 2007 for robbery and violence which left two people dead.
“The Japanese authorities’ willingness to put people to death is chilling and must end now before more lives are lost. The death penalty is not justice or an answer to tackling crime, it is a cruel form of punishment that flies in the face of respect for life,” said Roseann Rife, East Asia Research Director at Amnesty International.

“Japan should immediately introduce an official moratorium on executions as a first step towards abolition of the death penalty.”
Japan is on the wrong side of history when it comes to the death penalty and among a small minority of countries around the world that continue to execute people. In 2014, only 22 countries carried out executions while, as at November 2015, 140 countries globally have abolished the death penalty in law or practice.
The Mongolian parliament passed legislation in early December that will abolish the death penalty in the country when it comes into effect in September 2016.
“If the politicians of Japan don’t step up and show some leadership, as President Elbegdorj of Mongolia did, Japan will continue to fall behind the times,” said Roseann Rife.

“Japan’s continued use of the death penalty makes it stand out for all the wrong reasons – across the world, and increasingly also in the East Asia region.”
Background
Executions in Japan are shrouded in secrecy with prisoners typically given only a few hours’ notice, but some may be given no warning at all. Their families and lawyers are usually notified about the execution only after it has taken place.
The lack of adequate legal safeguards for death row inmates in Japan has been widely criticized by UN experts.
This includes defendants being denied adequate legal counsel and a lack of a mandatory appeal process for capital cases. Several prisoners with mental and intellectual disabilities are also known to have been executed or remain on death row.
Amnesty International opposes the death penalty in all cases without exception, regardless of the nature or circumstances of the crime, the guilt, innocence or other characteristics of the offender or the method used by the state to carry out the execution. The death penalty violates the right to life and is the ultimate cruel, inhuman and degrading punishment.

부르키나파소의 조혼, 강제결혼 풍습으로 13세 가량의 소녀 수천 명이 유년기를 박탈당하고 있으며, 피임에 드는 비용과 기타 장벽으로 임신 여부나 시기조차 선택하지 못하고 있다고 국제앰네스티가 26일 발표한 보고서를 통해 밝혔다.

보고서 <강압당하고 부정당하는 소녀들: 부르키나파소의 강제결혼과 피임 장벽>은 여성들이 임신 여부와 시기를 스스로 결정하려다 위협받거나 폭행당하는 일이 빈번히 벌어지고 있는 실태를 공개했다.


“일부 지역에서는 18세가 되기 전에 결혼한 여성이 전체 여성의 절반 이상을 차지했다. 이러한 일이 반복되어서는 안 된다.”

알리오네 티네(Alioune Tine) 국제앰네스티 서,중앙아프리카 지역국장은 “자신의 삶조차 스스로 결정하지 못하는 여성들이 너무나도 많다. 결혼 여부와 시기, 상대를 결정하거나 임신 여부를 선택할 권리도 인정받지 못하고 있다. 일단 결혼을 하면 여성들은 가능한 한 빨리 아이를 갖는 것이 당연시된다. 어린 나이에 임신을 하면 산모가 사망하거나 인생을 뒤바꿀 만큼 심각한 신체 손상을 경험하게 될 위험이 급격히 증가한다. 결혼 후에도 학교를 다니거나 학업을 마칠 기회가 주어지는 여성은 거의 없다”고 말했다.

“일부 지역에서는 18세가 되기 전에 결혼한 여성이 전체 여성의 절반 이상을 차지했다. 이러한 일이 반복되어서는 안 된다. 가족들과 지역사회 모두, 여성의 신체에 대해 마음대로 결정하고 장래 꿈을 이룰 기회를 박탈할 수는 없다”고 말했다.

국제앰네스티는 2014년과 2015년에 걸쳐 여성 379명과 인터뷰하고, 피임 관련 의료 서비스를 받지 못하는 여러 가지 장벽에 대해 기록했다. 결혼생활에서 가까스로 도망친 조혼, 강제결혼 피해자 35명과도 인터뷰를 나눴다.

부르키나파소에서는 법적으로 17세 이상인 여성만 결혼이 가능하지만, 북부 사헬 지역에서는 15세부터 17세 사이의 여성 중 절반 이상(51.3%)이 이미 결혼한 상태였다.

조혼과 강제 결혼
부르키나파소에서는 가족간의 유대를 강화하거나 사회적 지위를 얻기 위해, 또는 물건, 돈, 서비스와 교환하기 위해 딸을 결혼시키기도 한다. 이번 보고서에는 일부 지역에서 ‘포그 렌가(Pog-lenga)’, 또는 ‘추가 여자’로 신부가 결혼할 때 조카를 함께 데려와 시댁 식구와 결혼시키는 풍습에 대해서도 기록했다.

결혼식 당일 도망친 15세 소녀 셀린은 고모부의 친척과 강제로 결혼해야 했던 이야기를 전했다.
“그 남자와는 결혼하고 싶지 않았지만 고모가 ‘도망가면 죽인다’고 했어요. 남편의 집에서 도망쳤지만, 마을로 돌아왔더니 가족들이 이제 같이 살 수 없다고 했어요.”

강제결혼을 거부한 여성들은 가족과 사회로부터 폭행 위협 등의 엄청난 압박에 시달리게 된다.
13세 소녀 마리아는 “아빠가 이미 아내가 5명이나 있는 70세 할아버지와 나를 결혼시키려 했다. 결혼하지 않으면 죽이겠다고 협박했다”고 말했다.
남편의 집에서 도망친 마리아는 여성 쉼터에 몸을 피하기 위해 3일 동안 거의 170km를 걸어야 했다.

임신에 대한 선택권도 없어
국제앰네스티가 인터뷰한 여성들 거의 대부분이 남편에게 피임 문제를 거론했다가 언어적, 신체적 폭력을 당한 적이 있다고 답했다. 재정적인 권한도 없어 피임도구를 사려면 남편에게 돈을 부탁해야 한다고도 말했다.

25세 빈투는 국제앰네스티에 이렇게 전했다.
“막내아이를 임신하기 직전, 무료 피임 주간을 이용하려 찾아갔지만 너무 늦게 도착해서 이미 끝났더라구요. 남편에게 돈을 부탁했더니 화를 냈어요. 남편은 안 된다고만 했고, 우리 문화로는 여자들은 남편이 하는 말을 무조건 듣고 따라야 하거든요. 돈을 달라고 하면 식료품을 사려고 해도 때리는데, 피임을 하려 한다고 하면 어떻게 될 지는 뻔한 일이죠.”

피임 비용을 절감하려는 정부의 노력에도 불구하고 대부분의 여성들은 피임 물품을 구입할 여력이 없다고 말했다.
공식 통계에 따르면 현대식 피임법을 사용하는 여성은 16% 미만으로, 그렇지 않을 경우 원치 않거나 위험한 임신을 하게 될 확률이 급격하게 높아진다. 유엔 기구에서도 피임법 사용만으로 산모 사망률을 크게 줄일 수 있다고 강조한 바 있다.

교외지역에 거주하는 15세부터 19세 사이 여성 청소년 중 약 30%가 임신 중이거나 이미 첫 아이를 출산한 것으로 나타났다. 이 시기에 임신할 경우 20세 이상인 여성들보다 임신 또는 출산 중 사망할 위험이 2배 이상 높다.

법 개정 시급히 필요
부르키나파소는 이미 조혼과 강제결혼을 법적으로 금지하고 있지만 그 내용은 부적절하고 차별적으로, 남성의 결혼 가능 최저 연령은 21세인 반면 여성은 17세로 규정하고 있다. 또한 이 법은 국가에 신고된 결혼에만 적용될 뿐, 실제 이루어지는 결혼 중 대부분을 차지하는 전통적, 종교적 결혼은 해당되지 않는다.

정부는 문제가 되는 법 조항을 개선하겠다고 약속한 바 있지만, 모든 결혼이 국가에 등록되어 확인할 수 있도록 하고, 남녀에 똑같이 결혼 가능 연령을 18세로 지정하는 등 법 개정에 더욱 시급히 착수해야 한다.

또한 정부는 여성들이 임신 중에 의료 접근을 막는 핵심인 재정적 장벽을 해소하기도 했다.

국제앰네스티는 이에 따른 후속 조치와 여성들이 일부 피임 물품만이라도 안전하고 은밀하고 무료로 사용할 수 있게 할 것을 촉구한다.

티네 국장은 “부르키나파소는 세계에서 조혼, 강제결혼율이 가장 높은 국가이자 피임률이 가장 낮은 국가”라며 “어린 소녀들이 자신의 신체와 삶, 미래에 대한 결정을 스스로 내릴 수 있도록 정부가 이들의 권리를 보호하는 것이 가장 중요하다. 최근 조혼 풍습을 타파하겠다고 약속한 것은 환영할만한 진전이지만, 이러한 약속이 일상적인 현실로 이루어지지 않는다면 어린 소녀들이 그 대가를 치르게 될 것”이라고 말했다.

My Body, My Rights 캠페인
국제앰네스티는 2015년 7월 부르키나파소에서도 여성들이 직면한 문제의 인식을 높이는 글로벌 캠페인 My Body My Rights를 시작했다. 부르키나파소 대통령은 국제앰네스티가 발표한 인권선언서에 서명하고, 강제결혼과 조혼에 더욱 강경한 태도로 임할 것을 약속했다.

Burkina Faso: Forced and early marriage puts thousands of girls at risk

Early and forced marriage in Burkina Faso is robbing thousands of girls as young as 13 of their childhood, while the cost of contraception and other barriers prevent them from choosing if and when to have children, Amnesty International said in a report published today.

Coerced and denied: Forced marriages and barriers to contraception in Burkina Faso exposes how many women and girls are threatened or beaten when they try to make their own decisions about when to marry or have children.

In some parts of Burkina Faso, more than half of all girls are married off before they turn 18. This has to stop.

“Once married, girls are expected to have children as soon as possible. Early pregnancies greatly increase the risk of girls dying or experiencing life-changing physical injuries. Very few have the chance to go to school or complete their education.
“In some parts of Burkina Faso, more than half of all girls are married off before they turn 18. This has to stop. Neither family members nor the wider community should be able to make decisions about a girl’s body, denying her the chance to fulfil her own hopes and dreams for the future.”

Amnesty International researchers interviewed 379 women and girls in 2014 and 2015, documenting the multiple barriers that prevent them from accessing contraceptive health services. They spoke to 35 victims of early and forced marriage who managed to escape.

Under Burkina Faso law, girls should be aged 17 or older before they marry, yet more than half of girls (51.3%) aged 15-17 are already married in the Sahel region in the north of the country.

Forced and early marriage

Families in Burkina Faso often marry off girls to consolidate family alliances, acquire social status or in exchange for goods, money and services. The report also documents the practice in some areas of “Pog-lenga” or “bonus woman” where a bride may also bring her niece to the family of her husband as an additional girl for marriage.

Céline, a 15-year-old girl who fled on her wedding day, told Amnesty International how she was forced to marry a relative of her aunt’s husband:
“I did not want to marry the man. My aunt told me ‘if you flee, we will destroy you’. I fled my husband’s home, but when I got to the village my family said I could not live with them.”

Girls who resist forced marriage face huge pressure from their families and society, including threats of violence.

Maria, a 13-year-old girl, said:
“My dad married me [off] to a 70-year-old man who already has five wives. My dad threatened me saying if I don’t join my husband he will kill me.”

Maria fled his house and walked nearly 170km over three days to seek refuge at a shelter for young girls.

No choice over birth control

Nearly all the women and girls interviewed by Amnesty International said that they suffer verbal abuse or physical violence when they raise the issue of birth control with their partners. They also said that their lack of control over financial resources meant that they had to ask for money from their partners to buy contraceptive products.

Bintou who is 25 years old told Amnesty International:

“Right before I became pregnant with my youngest child, I went to take advantage of the free contraception week, but I arrived too late, it was already over. I had asked my husband for money. He got angry. He would systematically say no and in our culture, when the husband says something, women have to listen and obey. Asking for money already leads to beatings when it’s for groceries, so you can imagine when you want money for contraceptives.”

Despite the government’s efforts to reduce the cost of contraceptives, most women and girls said that they could not afford to buy them.

According to official figures, less than 16% of women use a modern method of contraception, dramatically increasing the risk of unwanted and sometimes high-risk pregnancies. UN agencies have highlighted that contraceptive use could greatly reduce maternal deaths.

Nearly 30% of 15- to 19-year-old girls and young women in rural areas are pregnant or have had their first baby despite the risk that they are twice as likely to die during pregnancy or childbirth as those over the age of 20.

Urgent need for reform

Under Burkina Faso law, early and forced marriage is already banned, but in an inadequate and discriminatory way: the age limit for marriage is 21 for males but 17 for females. The law only applies to marriages registered by the state – a fraction of the marriages taking place – but not traditional and religious ones.

The government has committed to changing the law but it needs to undertake these legal reforms urgently to ensure that all marriages are registered and checked, and to make 18 the minimum age of marriage for everyone.

The government has also lifted key financial barriers faced by women in accessing health care during pregnancy.

Amnesty International is calling on it take the next step and make at least some contraceptive products, which women can use safely and discreetly, available free of charge.

“Burkina Faso has some of the highest rates of early and forced marriage in the world, and one of the lowest use of contraceptives,” said Alioune Tine.
“It is crucial that the government upholds the rights of girls to make their own decisions about their bodies, lives and future. Recent commitments to end child marriage constitute a welcome step, but until those promises become an everyday reality, girls will pay the price.’’

My Body My Rights campaign

Amnesty International launched its global My Body My Rights campaign in Burkina Faso in July 2015, seeking to raise awareness about barriers women and girls face. The organization published a human rights manifesto signed by the current President, who committed to taking a tougher stance on forced and early marriage.

지난 1일 중국 입법부를 통과한 이번 국가보안법은 ‘국가 안보’를 광범위하고 모호한 단어로 규정하고 있으며 정치, 문화, 금융, 인터넷 등의 다양한 영역에 적용된다.

니콜라 베클란(Nicholas Bequelin) 국제앰네스티 동아시아 지역국장은 “이번 신규 법안에서 규정하는 ‘국가 안보’는 사실상 무한한 수준이다. 이 법은 인권활동가, 정부에 비판적인 사람, 그 외의 반정부 세력 등 정부의 마음에 들지 않는 사람은 누구나 처벌하고 감시할 수 있는 백지수표와 같은 권한을 부여하고 있다”고 밝혔다.

“이 법은 국가 안보보다는 공산당의 국가 통제력을 잃지 않으려는 것과 더욱 관계가 있음이 명백하다. 공산당의 집권과 정치력 독점은 이번 법에서 ‘국가 안보’의 일환으로 명시되어 있다”며 “중국 정부는 오래 전부터 ‘체제 전복 선동’, ‘분리주의’, ‘국가기밀 유출’ 과 같은 국가 안보 명목의 혐의를 적용해 왔다. 이번에 새롭게 마련된 국가보안법에서는 그 범위가 더욱 확대되어 이러한 경향을 악화시킬 가능성이 높다”고 말했다.

또한 “중국 정부는 이 법을 즉시 폐지하고 백지화해야 한다. 국민의 인권을 보호하기 위해 무엇보다도 필수적으로 취해야 할 조치로, 국가 안보와 개인의 인권 사이에서 균형을 맞출 수 있는 적절한 안전장치가 마련되어야 할 것”이라고 말했다.

China: Scrap draconian new national security law

The Chinese government must immediately repeal a new national security law that gives the authorities sweeping powers to crack down on and suppress human rights, Amnesty International said.

China’s legislature today passed the law which defines “national security” in broad and vague terms, covering areas including politics, culture, finance and the internet.

“The definition of ‘national security’ under this new law is virtually limitless. The law gives a blank cheque to the government to punish and monitor anyone it does not like – human rights activists, government critics and other opposition voices,” said Nicholas Bequelin, Amnesty International’s Regional Director for East Asia.

“This law clearly has more to do with protecting the Communist Party’s control of the country than with national security. The leadership of the Party and its monopoly on political power is explicitly listed as being part of ‘national security’ in the law.”

“The government has long been using national security charges, such as ’inciting subversion’, ’separatism’ and ’leaking state secrets’ to suppress and imprison activists and government critics. The expansive definition given by the new law is likely to further this trend.”

“Chinese authorities must scrap this law immediately and go back to the drawing board. Among other essential measures to protect people’s human rights, there need to be adequate safeguards put in place to balance security with individuals’ human rights.”

미래에셋의 주요 계열사들이 박현주 회장이 실소유한 골프장에서 법인카드를 집중적으로 사용한 사실이 드러나 오너 회사를 향한 이른바 ‘일감 몰아주기’가 아니냐는 의혹이 제기된다. 뉴스타파 확인 결과 3개 계열사들이 이 골프장에서 사용한 법인카드 총액은 6개월에 28억 원이 넘는 것으로 나타났다.

3개 주요계열사, 오너 소유 골프장에서 반년동안 28억 원 법인카드 결제

미래에셋은 지난 2013년 4월 강원도 홍천에 위치한 27홀 규모의 골프장 ‘홍천 블루마운틴CC’를 개장했다. 이 골프장은 ‘맵스프런티어사모27호펀드’라는 사모펀드가 소유하고 있다. 이 사모펀드의 가장 큰 지분(75%)을 갖고 있는 곳은 미래에셋자산운용. 박 회장과 그의 특수관계인들이 95%가 넘는 지분을 가지고 있다. 골프장의 실소유주가 박현주 회장인 셈이다.

뉴스타파는 2013년 미래에셋 주요 계열사들의 골프장 관련 법인카드 지출내역을 입수했다. 이 자료에 따르면 미래에셋자산운용, 미래에셋증권, 미래에셋생명 3개 계열사는 블루마운틴CC가 개장한 2013년 4월부터 10월까지 이 골프장에서 총 28억 2천만 원을 법인카드로 결제했다.

이 골프장의 휴일 오전 그린피는 34만 원 수준이다. 여기에 카트료와 캐디피를 포함하면, 한 명 당 게임비는 40만 원 안팎이다(4인 1팀 기준). 단순 계산상으로 반년만에 28억 원을 사용하기 위해선 3개 계열사의 임직원 4028명 전원(2013년 당시 기준)이 1.7회씩 골프장을 이용해야 한다.

법인카드를 통한 ‘일감 몰아주기’는 조직적이고 지속적으로 나타났다. 블루마운틴CC 개장 후 이 3개 계열사들의 골프장 관련 법인카드 지출은 일제히 3배에서 6배 이상 늘었다. 또 골프장 관련 법인카드 지출 대부분이 블루마운틴CC에서 사용돼 그 비중이 70~95%에 이르는 것으로 나타났다. 골프 비수기인 한여름(7, 8월)에도 이같은 법인카드 지출은 일정 수준 이상으로 유지됐다.

‘돈줄’ 골프장, 호텔 운영권도 박현주 회장 가족회사에

‘일감 몰아주기’는 이뿐만이 아니다. 2015년 이후 이 골프장의 운영권을 갖고 있는 곳은 미래에셋의 또다른 비금융계열사 ‘미래에셋컨설팅’이다. 미래에셋이 보유한 대표적인 국내 호텔인 광화문 포시즌스 호텔도 이 회사가 운영권을 갖고 있다.

미래에셋의 호텔, 골프장 시설 운영권을 확보하면서 이 회사의 계열사 매출은 2013년 13억 원에서 2016년 132억 원으로 10배 이상 뛰었다. 전체 매출도 2013년 73억 원에서 2016년 1064억 원으로 대폭 늘었다.

문제는 이 회사가 사실상 박현주 회장의 가족회사라는 점이다. 박 회장과 그의 친인척들이 보유한 지분은 91.86%에 이른다. 미래에셋 그룹의 지배구조상 이 회사는 또다른 계열사 미래에셋캐피탈과 함께 그룹 전체를 지배하는 핵심 회사다. 이 회사가 그룹 내 안정적인 자금원을 확보해 몸집을 키워가며 박현주 회장 일가의 그룹 내 입지도 함께 커지는 형국이다.

이에 대해 미래에셋 측은 “블루마운틴CC는 미래에셋 계열사들의 필요에 따라 자율적으로 사용되고 있다”며 “박현주 회장은 2010년부터 현금성 자산인 모든 배당금을 사회에 기부하고 있다”고 말했다.

다음달 초대형IB 인가 절차 돌입…미래에셋 도덕성 도마 위에

미래에셋 그룹은 올해 들어서만 금감원으로부터 기관주의와 기관경고 조치를 포함 총 6차례의 제재 조치를 받았다. 정치권에서는 미래에셋의 이름을 딴 금융소비자 보호 법안(일명 ‘미래에셋방지법’, 박용진 더불어민주당 의원 발의)을 내놓은 상황이다.

다음달 금융당국은 미래에셋대우를 포함한 대형금융사 5곳에 대해 초대형IB 인가 절차에 들어갈 예정이다.

파키스탄이 사형집행을 재개한 이후 처형된 사람이 300명에 육박하게 되면서, 세계 최다 사형집행국이라는 불명예를 얻었다고 국제앰네스티가 24일 밝혔다.

파키스탄 정부는 11월 25일 압둘 바시트(Abdul Basit)에 대한 사형을 집행할 예정으로, 하반신마비 환자인 이 남성은 복역 중 결핵성 뇌수막염 진단을 받았다. 해당 교도소에는 교수대에 서지 못하는 사형수의 형 집행에 대한 규칙이 없기 때문에 압둘의 처형은 여러 차례 연기되었다.

국제앰네스티는 사형이 적용될 수 있는 사건마다 반드시 고려해야 할 공정재판기준과 안전조치를 상습적으로 위반하며 강행되는 이러한 사형집행이 파키스탄 인권상황에 심각한 오점으로 남게 되었다고 밝혔다.

데이빗 그리피스(David Griffiths) 국제앰네스티 동남아시아 조사국장은 “파키스탄이 이처럼 열성적으로 사형을 집행하는 것은 사형제도를 반대하는 세계적인 추세와 인권을 모욕하는 일이다. 하반신마비 환자인 압둘 바시트의 이번 사형집행이 유보된다 하더라도 파키스탄에서는 여전히 거의 하루에 한 명 꼴로 처형되고 있다”며 “이처럼 가차없는 사형집행은 파키스탄의 인권상황에 어두운 그림자를 드리우는 것은 물론, 효과적인 정책도 아니다. 파키스탄 정부가 이를 통해 테러 위협에 성공적으로 대응했다는 증거는 없다. 실제로 교도소 관계자들은 국제앰네스티에 이슬람 수니파 무장단체 라슈카르에장비(Lashkar-e-Jhangvi)가 사형이 집행된 단원의 ‘순교’를 기념하며 사탕을 나눠주기도 했다고 전했다”고 말했다.

국제앰네스티가 기록한 사형집행 건수는 현재까지 공식적으로 확인된 수치로 299건이다. 특히 2015년 10월에만 45명이 처형되며 사형집행 재개 이후 가장 많은 사형이 집행된 달이 되었다. 지금까지 처형된 사형수들은 대부분 테러 관련 범죄로 유죄가 선고된 사람들이 아니었고, 2008년 파키스탄이 사형집행 유예를 선언한 이후로 사형집행을 재개하게 된 원인이었던 지난 12월 탈레반의 페샤와르 학교 학살 사건 역시 마찬가지였다.

초기에는 테러 관련 범죄에 대해서만 사형집행을 재개했으나 수 개월이 지나자 더욱 넓은 범위의 범죄에 대해서도 사형이 집행되고 있다.

국제앰네스티는 범죄의 성격이나 정황, 개인의 유죄 여부나 기타 특성, 사형집행 방식에 상관없이 모든 국가의 모든 경우에 대해 사형을 반대한다.

데이빗 그리피스 국장은 “대부분의 사형선고가 국제공정재판기준을 만족하지 않는 재판을 통해 내려지고 있다. 이러한 재판은 피고인이 적절한 변호사를 선임하지 못하거나, 고문으로 입수한 증거와 같이 국제법상 인정할 수 없는 증거를 채택하는 것 등이 특징”이라며 “파키스탄은 즉시 모든 사형집행을 중단하고, 인권적 의무에 따라, 이제야말로 사형을 단계적으로 폐지하기 위한 조치에 나서야 한다”고 말했다.

Pakistan will imminently have executed 300 people since it lifted a moratorium on executions, shamefully sealing its place among the world’s worst executioners, Amnesty International said today.

On 25 November, Pakistani authorities are set to execute Abdul Basit, a man with paraplegia who developed tubercular (TB) meningitis while on death row. His execution has been postponed several times, since the prison has no rules on how to hang someone who cannot stand on the scaffold.

Amnesty International said the executions are a serious stain on Pakistan’s human rights record, compounding repeated violations of fair trial standards and other safeguards that must be observed in all death-penalty cases.

“Pakistan’s ongoing zeal for executions is an affront to human rights and the global trend against the death penalty. Even if the authorities stay the execution of Abdul Basit, a man with paraplegia, Pakistan is still executing people at a rate of almost one a day,” said David Griffiths, South Asia Research Director at Amnesty International.

“Not only are these relentless executions casting a large shadow over Pakistan’s human rights record, they are also ill-conceived. There is no evidence to suggest they have successfully countered the terrorism threat in the country. Indeed, prison officials told Amnesty International that the banned Lashkar-e-Jhangvi group distributed sweets to celebrate the ‘martyrdom’ of one their members executed in prison.”

Amnesty International has recorded 299 executions to date, based on publicly-reported figures. Forty-five were recorded in October 2015 alone, the deadliest month since the moratorium on executions was lifted. A majority of those executed so far were not convicted of offences related to terrorism, even though it was a Taliban massacre – of mostly schoolchildren in Peshawar last December – that prompted the authorities to lift the moratorium in place since 2008.

It was initially lifted for terrorism-related offences only – but within months, executions for a wider range of crimes were being carried out.

Amnesty International opposes the death penalty at all times in all countries, regardless of the nature or circumstances of the crime; guilt, innocence or other characteristics of the individual; or the method used by the state to carry out the execution.

“Many death sentences are handed down after trials that do not meet international fair trial standards. These trials are characterised by prisoners not receiving adequate legal counsel and by the acceptance of evidence inadmissible under international law, such as evidence obtained as a result of torture,” said David Griffiths.

“Pakistan should halt executions immediately, comply with its human rights obligations, and take steps to phase out this punishment once and for all.”
