서울대병원은 2015. 10. 20.부터 10. 27.까지 임금피크제 도입 등을 내용으로 하는 취업규칙 개정을 위해 소속 노동자들의 찬반투표를 실시했다. 그 결과 찬성률이 28.59%에 그쳤고 취업규칙 개정은 부결되었다. 그런데도 서울대병원은 10. 29. 이사회를 개최하여 부결된 취업규칙 개정안을 통과시켰다. 이는 취업규칙을 불이익하게 변경할 경우에는 근로자들의 동의를 받게 되어 있는 근로기준법을 명백히 위반한 행위이다.

근로기준법 제94조 제1항에 따르면 취업규칙 불이익변경시 과반수 노동조합 또는 노동자 과반수의 동의(판례에 따르면 집단적 의사결정방법에 의한 동의)를 거쳐야 한다. 이를 위반할 경우 개정 취업규칙은 무효가 되고 사용자는 형사처벌의 대상이 된다. 이 조항은 노동조건의 노사대등결정의 원칙을 입법화한 것으로서 규범적으로나 상식적으로 지극히 정당한 취지를 담고 있는 것이다.

그런데 서울대병원은 이러한 법상 절차를 철저히 무시하였다. 이미 법으로 60세 정년이 확정되어 있는 상황에서 임금피크제는 정년연장과 대가관계에 있는 것이 아니다. 따라서 정년 연장을 이유로 한 임금피크제의 실시는 불이익변경에 해당함이 명백하다. 서울대병원도 임금피크제 도입이 불이익변경이라는 점을 잘 알고 있었기 때문에 노동자들을 대상으로 찬반투표를 실시한 것이다. 그래 놓고서는 그 결과가 부결로 나오자 이를 무시하고 일방적으로 개정을 강행한 것이다.

서울대병원은 사회통념상 합리성이 있다면 근로자들에게 불이익한 변경이라도 과반수 동의 없이도 효력을 인정할 수 있다는 판례를 내세운다. 그러나 이 판례는 우리 근로기준법 상의 위와 같은 규정이 없는 일본의 판례를 무분별하게 차용한 것에 불과하다. 즉, 이 판례 자체가 올바르지 못한 것이다. 이에 대해서는 다수의 노동법 학자들이 그런 의견을 피력하고 있다. 최근 대법원도 위 판례가 근로기준법의 명문의 규정에 반하는 해석이므로 엄격한 요건 하에서 제한적으로만 허용되어야 한다고 판시하고 있다.

이러한 사정과 함께 이번 서울대병원의 임금피크제가 임금을 상당 수준 삭감하는 내용이어서 불이익 정도가 매우 크다는 점, 가장 중요한 노동조건인 임금에 관한 사항이라는 점, 정년연장 대상자뿐만 아니라 전체 노동자들의 임금인상률까지도 제한하는 방식이라는 점, 임금삭감에 대한 대상조치가 미미하다는 점, 노동조합은 물론 소속 노동자들의 반대의견이 70% 이상이라는 점 등을 종합하면, 서울대병원의 ‘사회통념상 합리성’ 주장은 억지에 가깝다.

우리는 서울대병원의 위와 같은 행태가 정부의 강압에 의한 것이라고 판단한다. 교육부는 각 국립대병원에 임금피크제 도입을 강요하고 있고, 고용노동부는 임금피크제 도입이 불이익변경이 아닐 수도 있다거나 ‘사회통념상 합리성’이 일반적인 법리라며 사용자의 일방적인 취업규칙 불이익변경이 가능할 수도 있다는 식의 가이드라인 제정을 추진하고 있다. 이러한 정부의 방침은 위법한 것임이 명백하다.

서울대병원을 필두로 다수의 국립대병원과 공공기관이 근로자의 집단적 동의 없는 일방적인 취업규칙 불이익변경을 강행하고 있다. 그로 인해 노동자들의 고용상황과 근로조건이 악화될 것임이 명약관화하다. 이러한 상황을 막기 위해서는 취업규칙을 불법적으로 개정한 서울대병원장 등 책임자들이 처벌되어야 한다. 정부가 이를 회피하거나 방해한다면 이는 정부가 앞장서서 ‘노동 개악’을 자행하고 있음을 실토하는 것이다. 우리는 정부의 노동개악을 저지하기 위해 서울대병원장 등 책임자 처벌에 진력해 나갈 것임을 명백히 밝혀둔다.

윤석열 파면여부 결정이 결국 3월을 넘기게 되었다. 무장 계엄군으로 국회 장악, 수많은 사람들 구금·학살, 계엄명분용 북한과의 국지전 시도까지 이 모든 걸 시도한 흉악범 윤석열이 탄핵되지 않고 있다. 시민들은 피가 마른다. 재앙적 산불의 비극을 마주한 가운데 헌재의 판결지연이 사람들의 가슴을 더욱 타들어가게 하고 있다.

윤석열 탄핵은커녕 어처구니없는 일들이 일어나 왔다. 이 나라에서 단 한 명만을 위한 법적용을 해서 윤석열을 풀어준 검찰과 법원, 위헌위법하다면서도 한덕수를 복귀시킨 헌재는 대다수 사람들의 ’상식’을 배반하고 있다. 쿠데타 잔당들은 위헌판단을 받고서도 헌법재판관을 임명하지 않고 있다. 그 현행범 최상목, 한덕수가 나라를 운영하면서 ’공권력에 도전하면 체포한다’고 평범한 사람들을 윽박지르고 있다. 이들은 산불지원을 해도 모자랄 경찰들을 총동원해 바퀴달린 트랙터의 도로 이동을 가로막고 죄없는 사람들에 폭력을 행사하고 잡아가두며 윤석열을 비호했다. 이런 검찰, 법원, 정권의 노골적 부정의에 자신감을 키운 극우들의 폭력도 갈수록 더 거칠어지고 있다. 이 나라 민주주의가 풍전등화다.

윤석열이 복귀한다면 이 나라는 87년 이전으로 돌아갈 것이고 수많은 생명이 총칼과 군홧발에 짓밟힐 것이다. 우리 단체들, 보건의료단체연합의 단체들은 87년 민주항쟁 직후 만들어졌다. 80년 광주민중항쟁과 87년 민주항쟁의 민중들의 피와 헌신으로 쟁취한 민주적 사회적 권리 위에 우리 단체들과 이 땅의 민주주의가 서 있는 것이다. 우리는 피로 세운 이 민주주의를 지키기 위해 할 수 있는 모든 것을 다할 것이다.

윤석열의 친위쿠데타를 전세계가 생중계로 지켜봤다. 더 이상 무슨 논의가 필요하단 말인가. 헌법재판소는 윤석열을 즉각 탄핵하라. 그러지 않는다면 우리는 분노한 민중들과 함께 항쟁에 나설 것이다.

- 공공의료 회복과 공공의사 양성이 대안

 

정부가 내년도 의대 정원을 3058명으로 동결했다. 2천명 의대증원 계획을 발표한지 14개월여만이다. 의료 파탄을 유발한 의대 증원 정책은 결국 환자의 고통만 남기고 막을 내렸다.

 

윤석열 정권의 의대 증원안은 애초 지역의료나 응급‧분만의료 공백 등의 문제를 해결하기 위한 것이 아니었다. 윤석열 스스로 말한 대로 “의료 산업”을 위해서였다. 윤 정권의 소위 ‘의료개혁’은 국민건강보험 보장 축소, 민영의료보험 활성화, 의료 기업 이윤을 위해 환자 안전을 희생시키는 규제완화였다. 윤석열에게 필요한 건 자본을 위해 돈벌이할 의사였다.

윤 정부는 지역 공공병원 설립을 불허하고, 그나마 있는 공공병원 예산을 삭감해서 경영난을 유발했다. ‘공공의대’ 방식으로 늘리라는 대중의 요구는 반대했다. 환자 생명이나 건강에는 관심이 없었다. ‘지역 중심으로 늘렸다’는 거짓말과 달리 ‘무늬만 지역의대’에 몰아줘 수도권 재벌병원을 챙겼다. 요컨대 민간보험, 민간병원, 의료기업 등을 위한 의대 증원이었다.

또 정치적 목적을 위한 증원이었다. 한 해 2천명이라는 파격적 숫자는 선거를 앞둔 선택이었다. 코로나19 시기 겨우 400명을 늘리는 데도 반대해 파업했던 의사들이 반발할 것은 불 보듯 뻔했는데도, 의사들을 강경진압하는 모습으로 정치적 이득을 보려 강행했다.

결국 무모하고 정당성 없는 정책으로 수많은 환자들이 생명과 건강을 잃었다. 그러므로 정부가 먼저 해야 할 것은 고통받은 수많은 사람들에 대한 깊은 사과여야 한다.

 

윤석열의 의대 증원이 환자를 위한 것이 아니었던 것만큼이나, 전공의‧의대생들의 싸움에도 정당성이 없었다. 그들은 윤석열의 의료민영화를 비판하며 의료공공성 강화를 촉구하거나, 제대로 된 방식의 의대증원을 요구하지 않았다. 오직 어떤 형태의 의대증원에도 반대한다며 파업했다. 이렇듯 대치한 양쪽 어디에도 환자와 시민의 건강이나 생명에 대한 고려는 없었다.

이 과정에서 많은 의사들이 생명에 대한 경시, 왜곡된 엘리트의식 등을 드러내는 비윤리적‧비상식적 발언을 노골적으로 하고, 집단행동에 동의하지 않는 동료들을 낙인찍고 괴롭혔다.

이제 그들이 바라는 대로 의대 정원이 동결됐으므로 복귀하지 않을 명분은 더더욱 없다. 많은 시민들의 인내심이 한계에 봉착해 있다.

 

의대 증원을 둘러싸고 5년 새 두 차례나 전공의 파업으로 의료대란이 벌어졌다. 한국에서 의사들은 경쟁자를 줄이려 의대 증원에 강경 반대한다. 입시경쟁에서 승리한 이들이 ‘시장’에서 고수익을 거두려 의사가 되는 왜곡된 시스템이 낳는 현상이다. 공익에 반하는 의사 파업을 반복해 겪지 않으려면 이처럼 철저히 민간에 맡겨진 의료를 바꿔야 한다. 의료 공공성이 높은 OECD 대다수 국가들은 다르다. 최근 독일 의사들은 정부에 의대 증원을 먼저 요구했다. 유럽에서 의사들은 대개 병상과 인력을 충원해 공공의료를 강화하라고 투쟁한다.

한국 같이 의료가 시장에 맡겨진 나라에선 의사의 숫자만 늘린다고 문제가 해결되지도 않는다. 지금도 도시에는 피부‧미용‧성형, 비만클리닉 간판이 즐비하고, 비급여 돈벌이가 횡행하는데, 대형병원에 수술할 의사가 없고 지역에도 병원과 의사가 없다. 필요한 곳에는 과소하고, 불필요한 곳에 과잉인 것이다. 이런 점을 구분하지 않고 단순히 의사의 절대 수를 ‘추계’하는 셈법에는 한계가 크다. 진정 필요한 곳에 의사를 늘리려면 공공병원을 확충하고, 건강보험 보장성을 높여 비급여를 억제해야 한다. 의사도 공공의대를 설립하거나 국립대의대 정원을 늘려 장학금을 주고 양성하고, 졸업 후 공공의료기관에 의무적으로 일하도록 해야 한다.

윤석열 정권의 의대 증원과 소위 ‘의료개혁’은 문제를 더 악화시킬 의료민영화였다. 군홧발과 탱크와 의료민영화로 생명을 짓밟으려던 윤석열은 파면됐다. 이제 윤석열 식 ‘의료개혁’은 중단돼야 한다. 차기 정부는 의료민영화는 꿈도 꾸지 말아야 한다. 윤석열을 쫓아낸 평범한 사람들이 바라는 건 누구나 어디서든 걱정없이 치료받을 수 있는 공공의료가 바로 선 사회다.

- 이재명 대통령은 윤석열 식 의료비 인상 철회시켜야.

 

오늘(5일) 복지부가 의료급여 정률제를 골자로 하는 의료급여법 시행령 개정안을 입법예고했다.

윤석열 정권이 추진해온 대로 1종 의료급여 수급권자들의 외래 이용시 정액제(1천원~2천원) 본인부담금을 정률제(4%~8%)로 바꾼다는 내용이다.

군사쿠데타를 감행하다 파면된 윤석열 정권의 내각이 여전히 정부부처에 남아 있다. 복지부도 마찬가지다. 이 잔존 ‘내란’ 세력이 빈곤층 의료비 인상 쿠데타를 결국 입법예고한 것이다. 어처구니 없고 분노스럽다.

빈곤단체와 보건의료 단체들이 지적한 대로 이는 빈곤층 의료비를 10배 이상 올릴 수 있는 정책이다. 많이 아플수록 더 많이 오르게 된다. 지금도 의료급여 수급권자는 병원비 부담 때문에 ‘미충족 의료’가 건강보험 가입자보다 훨씬 더 많다. 의료비 인상은 이들의 생명과 건강을 벼랑 끝으로 내몰겠다는 폭거다.

윤 정권은 얼토당토 않게 빈곤층에 ‘과잉의료이용’ 낙인을 찍으며 이를 추진해왔다. 건강보험 가입자에 비해 병원에 많이 간다는 것이다. 그러나 의료급여 수급권자는 노인과 장애인이 많고 가난해서 아픈 이들이 많다. 상대적으로 젊고 비장애인이 많고 건강한 사람들과 비교하는 것 자체가 어불성설이다. 약자들에 거짓 오명을 씌우고 모욕하며 이런 일을 벌여온 것이다.

이제 윤석열이 파면되고 새 정부가 들어섰는데도 여전히 윤석열의 내각과 관료들이 잔존하며 윤석열 정책을 추진하고 있다. 조규홍 복지부 장관만 해도 계엄 국무회의에 참석해 수사를 받는 피의자다. 이들이 국정에 관여해 서민들과 약자의 삶을 파괴하는 있을 수 없는 일이 진행되고 있다.

복지부는 의료급여 정률제 개악을 중단해야 한다. 윤석열 정권과 단절하겠다며 당선된 이재명 대통령은 이 불의한 정책을 철회시켜야 한다.

42ND SESSION OF THE UN HUMAN RIGHTS COUNCIL

INTERNATIONAL SAFE ABORTION DAY – 28 SEPTEMBER 2019

 

Please note that a shorter version of this statement was delivered orally on 23 September 2019 to fit the time requirements of the Human Rights Council.

 

Thank you, President. I deliver this statement on behalf of 317 organizations[i] and 506 individuals.[ii]

 

In the Vienna Declaration and Programme of Action, States explicitly agreed to prioritize the realization of women’s human rights and recognized that all human rights are universal, indivisible, interdependent and interrelated. Yet, 26 years later, women and girls’ human rights and bodily autonomy continue to be routinely violated, including through the denial, criminalization and stigmatization of access to safe and legal abortion – all of which is rooted in the discrimination, oppression, violence and coercion affecting the material conditions that shape people’s lives and ability to exercise their bodily autonomy and human rights.

 

In 1994, Black feminists came together as the Women of African Descent for Reproductive Justice, in reaction to the white supremacy, colonialism and capitalism they observed shaping reproductive politics and inherent in the broader population control narratives. Reproductive justice is centered on the rights to bodily autonomy and self-determination, and to parent and not to parent in safe and healthy environments.[iii] It is rooted in an intersectional analysis and moving beyond an individualistic conception of “choice” to instead place emphasis on the material conditions necessary to exercise reproductive rights. Reproductive justice also addresses the legacy of population control informed by white supremacy and replacement theory, which has resurfaced in current populist politics.

Reproductive justice is achieved when all people are able to enjoy their right to bodily autonomy and sexual and reproductive self-determination. It requires people to enjoy economic, social, and cultural rights and freedoms, and the ability to make and exercise choices not limited by oppression, discrimination, stigma, coercion, violence, lack of opportunities or possible consequences. Treaty bodies and special procedures have echoed this need and recognized that the realization of women’s reproductive rights depends on the material conditions in which they are born, grow, live, work and age, and on power structures and resource distribution at all levels[iv] – in other words, the social and other determinants of health.[v] These include access to housing, safe drinking water, effective sanitation systems, access to justice, and freedom from violence, among other factors, and impact the agency that individuals can exercise with respect to their sexual and reproductive health.[vi] Our discussions on abortion and sexual and reproductive rights cannot continue ignoring these factors.

The realization of reproductive justice, the right to bodily autonomy and substantive equality also requires freedom from control and interference by State and non-State actors, including private companies, donors and multinational corporations, including criminalization of sexual and reproductive behaviors and decisions, restrictive abortion laws, punitive sanctions, and legal restrictions to regulate women’s control over their own bodies.[vii] These laws, policies and practices typically target and disproportionately impact women of color, women from the Global South, women with disabilities, women living in poverty, migrant women, ethnic minorities and indigenous women, women living with HIV, young women and adolescents, sex workers and gender-non-conforming persons based on racial, class, disability and gender stereotypes.[viii]

Today, on 28 September, International Safe Abortion Day, we urge States to respect, protect and fulfill women and girls’ human rights and realize reproductive justice for all. We call on states to:

  • Ensure access to available, accessible, acceptable and quality sexual and reproductive health services as part of universal health coverage and public health systems, including modern contraceptive options, comprehensive abortion and post-abortion care, financed adequately through taxation and free from control from other governments, multilateral agreements and transnational corporations.
  • Remove all legal and social barriers to safe abortion, including its criminalization, which is broader and including sanctions and no sanction regimes, and commit to providing safe abortion services on request.
  • Address social and other determinants of health in law and practice from an intersectional perspective to ensure that they enable all individuals to effectively enjoy their sexual and reproductive rights.[ix]
  • Hold private companies and multinational corporations accountable for unethical research practices, violations and abuses of women and girls’ reproductive rights and bodily autonomy.
  • Prioritize the meaningful participation of local movements, women human rights defenders and feminists demanding accountability for sexual and reproductive health and rights violations, and center their demands and recommendations for the realization of reproductive justice.

국회 정무위의 신용정보법, 인터넷전문은행법 개악 반대

-개인신용정보를 무한대로 사고 팔도록하는 신용정보법안

1. 취지와 목적

  • 국회 정무위원회는 11월 25일 예정된 법안심사1소위와 전체회의에서 신용정보법안(김병욱의원 대표발의)를 통과시킬 것으로 알려지고 있습니다. 신용정보법안은 금융소비자들의 신용정보를 일부 정보를 삭제하거나 대체하는 등 이른바 가명처리한 후 정보주체 동의 없이도 기업들이 사고 팔고 할 수 있도록 하는 것이 주요 내용입니다. 지금도 은행, 카드, 보험, 유통업계가 개인신용정보를 집적하고 공유하는 것이 어렵지 않아서 잊을만 하면 개인정보유출사고나 보이스피싱 등의 관련범죄가 끊이지 않는데, 여기서 더 나아가 정보주체 동의없이 서로 결합하고 판매할 수 있도록 하는 신용정보법안을 통과시킨다면 금융 소비자의 개인정보보호는 포기하겠다는 것과 다르지 않습니다.
  • 한편, 공정거래법 위반 전력을 삭제하여 주주 자격 요건을 완화하는 인터넷전문은행법안(김종석 의원 대표발의)이 어제(11/21) 정무위 법안심사소위를 통과했습니다. 2018년 은산분리 완화에 대한 거센 우려와 반대에 대해 대주주 적격성 요건을 강화하여 부작용을 최소화하겠다는 약속을 법 시행 일 년도 되지 않아 국회가 내팽개친 것입니다.
