나이지리아 라고스 주정부는 바디아이스트 비공식 정착촌에서 18일 강제 퇴거당한 수백여 가구를 보호하기 위해 즉시 나서야 할 것이라고 국제앰네스티가 밝혔다.

경찰이 정착촌 주민들에게 퇴거를 통보한 후 18일 오후부터 철거가 시작되었다. 철거 전날 건물 곳곳에 붉은색 페인트로 압류 표시가 칠해졌고, 18일 아침 이른 시간부터 불도저가 마을에 도착했다. 주민들은 철거 불과 하루 전에 퇴거 통보를 받았고, 지금까지 적절한 보상이나 대체 주거지를 제공받지 못했다. 지역정부 역시 퇴거 지역 주민들과 공식적으로 면담을 나눈 바가 전혀 없었다.

모라요 아데바요(Morayo Adebayo) 국제앰네스티 나이지리아 조사관은 “바디아이스트 주민 수백여 명은 이날 아침부터 집 앞에 불도저들이 진을 치고 있는 공포스러운 모습과 함께 하루를 시작해야 했다. 사전에 적절한 통보도 없었던 채로, 이곳 주민들은 항소조차 할 수 없는 법원 판결로 인해 강제 퇴거될 심각한 위기에 처해 있다”며 “라고스 주정부는 이곳 주민들이 자신의 주거지에 자의적, 불법적인 간섭을 받지 않고 보호받을 수 있도록 책임을 다하기 위해 즉시 나서야 한다”고 말했다.

이번 퇴거 위협은 해당 지역단체장이 현재 철거 위기에 놓인 바디아이스트 정착지의 소유권을 주장하며 소를 제기했고, 이에 법원이 원고 승소를 판결하면서 나온 것이다. 그러나 이 판결로 영향을 받게 되는 정착지 주민들은 소송의 당사자가 아니었고, 이 때문에 항소를 제기하는 것도 불가능했다. 또한 지역정부는 강제퇴거와 철거 계획에 대해 주민들과 전혀 상의하지 않았고, 이는 국제법상 의무를 위반하는 것이다.

지난 2013년 2월에도 라고스 주정부는 바디아이스트에 불도저를 보내 200채 이상의 건물을 철거하고 9,000여명을 강제 퇴거했다. 당시 퇴거된 주민들은 지금까지도 적절한 보상이나 실질적인 대안을 제공받지 못했다.

아데바요 조사관은 “집과 직장을 철거하는 것은 주민들의 생계를 파괴하고 수백여 명을 거리에 나앉게 할 뿐만 아니라, 국제법상 국가의 의무마저 위반하는 일”이라며 “이번 판결은 끔찍한 오심으로, 라고스 주정부는 피해 주민들을 보호해야 할 명백한 책임이 있다”고 말했다.

Nigeria: Hundreds face forced eviction as bulldozers descend on informal settlement

Authorities in Lagos state must act immediately to protect hundreds of families in the informal settlement of Badia East who are being forcibly evicted today, said Amnesty International.

Demolitions began this afternoon after police had been in the community earlier asking residents to move out. Bulldozers had arrived in the informal settlement in the early hours of Friday morning, after repossession notices were daubed across buildings with red paint yesterday. Residents were given just one day’s notice of the demolition and to date, no adequate remedy or alternative housing has been offered and the local chief has not conducted any formal consultation with the affected residents.

“Hundreds of people in Badia East woke up this morning to the frightening sight of bulldozers outside their homes. With wholly inadequate notice, they are at serious risk of being forcibly evicted because of a court ruling which they have no chance to appeal,” said Morayo Adebayo, Nigeria Researcher for Amnesty International.

“The Lagos state government must act urgently to meet its responsibility to ensure that these people are protected from any arbitrary or unlawful interference with their homes.”

This threat of eviction comes after a court ruling in favour of a local chief, who is seeking to reclaim the land on which the homes and structures at risk in Badia East are built. Although this case went to court, those affected by the ruling were not party to this lawsuit, rendering them unable to appeal the judgement.In addition, they have not been consulted at all on the proposed demolitions and evictions as the authorities are required to do under international law.

In February 2013, the Lagos state government sent bulldozers into Badia East, and demolished more than 200 structures, forcibly evicting 9,000 people. Those affected still have not received adequate compensation or an effective remedy.

“The demolition of their homes and businesses will not only destroy livelihoods and render hundreds homeless, it will also be a breach of the states’ duty under international law,” said Morayo Adebayo.

전세계 기자, 예술가, 활동가 수천 명이 터키에서 구금된 기자 120여명의 석방을 요구하는 국제앰네스티의 캠페인에 동참했다.

가우리 반 굴리크(Gauri van Gulik) 국제앰네스티 유럽 부국장은 “터키는 쿠데타 실패 이후 대대적인 숙청 작업으로 세계에서 언론인을 가장 많이 구금한 국가가 됐다. 대부분은 수 개월째 구금되어 있으면서도 여전히 기소된 죄목조차 알 수 없는 상태”라며 “이번 달 국민투표 시행을 앞두고 있는 만큼 현재 터키는 그 어느 때보다도 언론의 자유가 필요하다. 이번 캠페인으로 감옥에서 고통받고 있는 수백 명의 언론인을 전 세계가 잊지 않고 있다는 것을 보여주게 될 것”이라고 말했다.

국제앰네스티가 개최하고 국제펜클럽(PEN)과 국경없는기자회(RSF), 인덱스 온 센서십(Index on Censorship) 등 다수의 단체가 후원하는 이번 캠페인은 참여자들이 문구를 들고 촬영한 자신의 ‘셀카’를 해시태그 #FreeTurkeyMedia와 함께 게시하고 지지를 표하도록 독려하는 활동이다. 이미 예술가 아이웨이웨이(Ai Weiwei)가 활동에 힘을 실었으며, 주나르(Zunar), 스티브 벨(Steve Bell), 마틴 로슨(Martin Rowson) 등의 만화가들이 심사위원으로 참여해 전세계 만화가 수십여 명의 투고작을 심사할 예정이다.

400일 이상 구금돼 있다가 석방된 이집트의 알자지라 기자 모하메드 파흐미(Mohamed Fahmy), 피터 그레스테(Peter Greste), 바헤르 모하메드(Baher Mohammed) 3명은 터키 언론 해방 캠페인에 목소리를 보태며, 5월 3일 세계 언론자유의 날의 전세계 공동 행동을 더욱 빛낼 예정이다.

피터 그레스테(Peter Greste)는 트위터를 통해 “알 자지라 기자들의 석방을 요구하는 것이 옳다면, 터키의 언론해방을 요구하는 것도 옳은 일”이라고 말했다.

모하메드 파흐미는 “세계인들은 나와 피터 그레스테, 바헤르 모하메드 세 사람이 석방되기까지 함께 연대했다. 이제는 함께 터키 언론을 해방하자(#FreeTurkeyMedia)”고 밝혔다.

바헤르 모하메드 역시 21일 트위터를 통해 “터키 언론을 해방하라(#FreeTurkeyMedia). 언론인들은 구금되어서는 안 된다”고 밝혔다.

10월 17일 이스탄불 법원은 국제앰네스티 터키지부 사무국장 및 이사장 등 인권옹호자 11명에 대한 공소장을 접수했다. 국제앰네스티는 이들에 대한 근거 없는 혐의는 전부 기각됐어야 한다고 말했다.

터키지부 국장과 이사장을 포함한 인권옹호자를 ‘테러’혐의로 기소한 것은 터키 주요 인권옹호자들의 활동을 제약하기 위한 정치적인 목적이 있는 것이다.

존 달후이센 국제앰네스티 유럽 담당 국장은 “(인권옹호자에 대한) 기소는 날조된 테러 혐의를 유죄로 입증할 만한 증거를 하나도 제시하지 못했다”며 “이스탄불 법원이 이들에 대한 공소장을 접수한 것은 이러한 터무니없는 사법적 실패에 마침표를 찍을 수 있는 절호의 기회를 놓친 것”이라고 말했다.

그는 “이는 터키 주요 인권옹호자들의 활동을 제약하기 위한 목적의 정치적 기소”라며 “말도 안 되는 기이한 혐의가 담긴 공소장을 읽어봤다면 누구든지 그렇게 생각할 수밖에 없을 것”이라고 말했다.

기소된 인권옹호자 11명은 오는 10월 25일 이스탄불 법원에서 열리는 첫 공판에 참석할 예정이다. 먼저 기소된 타네르 킬리지Taner Kiliç 국제앰네스티 터키지부 이사장은 10월 26일 이즈미르 법원에서도 재판을 받게 된다. 국제앰네스티는 두 재판에 각각 참관인을 파견할 예정이다.

 

배경정보

타네르 킬리지 국제앰네스티 터키지부 이사장이 체포된 지 한 달 만인 지난 7월 5일 이딜 에세르İdil Eser 국제앰네스티 터키 사무국장 등 인권활동가 10명이 체포됐다. 이들은 다양한 ‘무장 테러리스트 조직’의 일원이라는 혐의로 기소되었다. 이 혐의로는 최대 징역 15년까지 선고 받을 수 있다.

지난 10월 4일 이스탄불 검찰은 타네르 이사장을 포함한 이스탄불10Istanbul 10에 대하여 공소장을 제출했다. 이는 타네르 이사장이 10월 26일 예정된 재판 외에도 10월 25일 열리는 ‘뷔위카다 사건Büyükada’에 대한 재판도 받게 되었다. 검찰은 공소장에서 타네르 이사장이 뷔위카다 워크샵* 준비 사실을 알고 있었다고 시인했으며, 그가 이딜 사무국장 및 피고인 중 한 명과 접촉한 사실이 있다는 혐의로 타네르 이사장을 추가로 재판에 넘길 것을 요청했다.

Attack in Orlando Shows Utter Contempt for Human Life

“Last night’s shooting in Orlando demonstrated utter contempt for human life, and our thoughts are with the victims of these attacks and the city of Orlando. The U.S. government must uphold its obligations under international law and address gun violence as the human rights crisis that it is. 코트디부아르의 대도시 아비장(Abidjan)의 외곽에 위치한 인구 4,500명의 작은 마을 지비(Djibi), 이 마을에서도 외딴곳에 조그마한 보건소가 자리 잡고 있다. 건물 중심부까지 이어진 개방형 복도를 따라가다 보면 정확히 10년 전, 근처 항구에서 유독성 폐기물 54만 리터를 실은 트럭이 줄지어 폐기물을 버리고 가던 장소 두 곳이 눈에 들어온다. 당시 아비장에는 이런 매립지가 곳곳에 널려 있었다.

이 유독성 폐기물은 다국적 원유거래업체 트라피규라(Trafigura)가 배출한 것이다. 트라피규라는 2006년 여름 3개월 동안 유럽 해상 원유처리시설을 운영했는데, 더러운 석유를 정제해 가솔린과 혼합한 후 서아프리카 등지에 휘발유로 판매했다.

이 과정에서 유독한 화학폐기물이 함께 발생했지만, 트라피규라는 이 물질을 안전하게 폐기할 수 있는 방법을 전혀 알지 못했고, 결국 단돈 미화 17,000달러(약 1천 900만원) 도 안 되는 비용으로 현지 업체를 고용해 서아프리카에서 가장 큰 도시인 아비장 인근 18개 곳에 폐기물을 매립했다.

이렇게 버려진 폐기물은 아비장 시민들에게 참담한 영향을 미쳤다. 6개월 만에 수만 명이 병원과 보건소로 몰려들어 호흡곤란과 구토, 두통, 눈 충혈, 코피, 피부 병변 등의 증상을 호소했다. 정부 통계에 따르면 15명이 숨졌다.

코트디부아르 정부는 폐기물 매립으로 인한 엄청난 영향을 인정하고 지비 마을에 보건소를 세웠다. 당시 긴급대응에 참여했던 한 의사는 “마을 주민 전원이 폐기물의 피해자일 가능성이 높다”고 했다. 국제앰네스티와 그린피스는 당시 참사를 다룬 2012년 보고서 <유독한 진실(The Toxic Truth, 영문)>에서 지비 마을 주변에 버려진 폐기물의 양이 약 7만 리터에 이를 것으로 추정했다. 다른 매립지에서 초과된 오염토양 자루들도 2010년 중반까지 이곳에 보관됐다. 코트디부아르 정부는 지난해 말에서야 이 오염토 처리가 완료되었다고 발표했다.

폐기물 매립 10년째를 맞는 지금, 지비 마을의 보건소는 당시 재앙의 유독한 유산을 상징적으로 보여준다.

2016년 7월 방문했을 당시 이 보건소는 버려진 듯한 느낌이었다. 직원은 단 세 명으로, 출산 서비스 담당자 2명과 일주일에 한 번 방문하는 간호사 1명이 전부였다. 마을 사람들은 보건소가 약을 살 예산도 없다고 했다. 복도는 환자 한 명 없이 텅 비었고, 병원에서 흔히 들을 수 있는 분주한 소리와 어린아이의 울음소리도 전혀 들리지 않았다.

피해자들은 보건소와 비슷하게 자신들도 버려진 기분이라고 했다. 트라피규라가 일부 보상금을 지급했지만, 아직도 많은 피해자들이 아무런 보상도 받지 못했다. 건강검진을 받은 사람도 없었고, 폐기물 속 화학물질로 인한 장기적 위험성에 대해 분석이 이루어지지도 않았다. 피해자 대부분은 폐기물에 무엇이 들어 있었는지도 모르는 상태다. 트라피규라는 폐기물의 정확한 성분과 그 잠재적 영향에 대해 지금까지 아무것도 공개하지 않았다. 아비장 주민들은 아직도 비가 많이 오는 날엔 폐기물 냄새를 맡을 수 있다며, 매립지가 완전히 정화되지는 않았을 거라고 한다. 그런데도 사람들은 매립지에 채소를 심어 기르고 있다.

적절한 정보와 대응은 여전히 공백인 상태로 주민들에게 남겨진 ‘유독한’ 유산은 공포와 착취 속에 견고히 유지되고 있다.

공포. 우리가 인터뷰한 아비장 주민 38명 중 거의 모든 사람들이 폐기물 속 화학물질을 들이마신 것 때문에 지금까지도 몸이 좋지 않다고 생각하고 있었다. 정부는 2015년 모든 매립지에 대한 정화사업이 완료되었다고 발표만 했을 뿐, 지금까지 이 내용이 확인된 바는 없다. 사람들은 자신과 가족들에게 장기적인 영향을 미치지는 않는지 걱정하고 있었다. 특히 건강검진을 받은 사람이 아무도 없었고, 폐기물에 무엇이 들어있는지도 정확히 알 수 없기 때문이었다.

착취. 일말의 보상이라도 받으려는 절박한 노력으로 피해자들은 트라피규라에 소송하면 보상을 받을 수 있다는 막연한 이야기에 소송 비용과 추후 지급될 보상금 일부를 요구하는 단체들에 가입했다. 이러한 단체들 중 일부는 순수하게 피해자들에게 도움을 주기보다는 돈을 버는 데 더 관심이 있는 것처럼 보이기도 한다. 가입비는 미화 2달러에서 8달러 사이로 다양한 한편, 어떤 단체의 피해자들은 가입비와 기타 부대비용을 포함해 미화 35달러를 내야 했다고 말했다. 큰돈은 아닐 수 있지만, 피해자 대부분이 재산이 거의 없는 상태이고, 이러한 단체 중에는 가입자가 5만 명에 이르는 곳도 있다. 또한, 만약 이러한 단체로 보상금이 직접 지급될 경우 피해자들에게 분배하지 않을 위험이 있다. 실제로 이 사건과 관련해 영국의 한 단체가 손해배상청구를 통해 약 600만 달러를 받았지만 피해자들은 보상금을 받지 못한 경우도 있었다.

수년간의 분쟁과 불안을 거친 끝에 코트디부아르는 올바른 방향으로 나아가고 있다. 정부의 요청과 노력으로 유엔 환경프로그램은 최근 모든 매립지의 오염물질이 완전히 정화되었는지 확인하는 작업을 마쳤고, 이에 대해 올해 말 보고서를 발표할 예정이다. 정부는 또한 지역 연구소에 지비 마을 피해자 전원의 건강 검진을 요청하기도 했다.

그러나 트라피규라에 폐기물의 정확한 성분을 공개하라고 최종적으로 압박하고, 폐기물에 노출된 모든 주민들의 건강을 검진하고 건강상, 환경상 장기적으로 영향을 미칠 잠재적 위험성의 분석 및 공개를 요구하는 등, 정부는 피해자들을 지원하고 주민들을 안심시키기 위해 더 많은 조치를 취할 수 있다. 또한, 그래야 한다.

우리가 인터뷰한 사람 중 한 명은 “트라피규라가 고비를 넘겼다”고 했다. 피해자들은 그런 사치를 누리지 못하고 있다.

현재 트라피규라는 폐기물 매립에 대한 책임을 부인하며, 현지 업체가 안전하고 합법적으로 폐기할 것이라 여겼다는 입장(자세히보기, 영문)을 유지하고 있다.

Ten years after toxic waste dumping, victims in the dark

A small health centre sits at the edge of Djibi, a village of 4,500 people on the outskirts of the bustling city of Abidjan, Côte d’Ivoire. Through the open-ended corridor that runs down the middle of the building you can see two of the many sites around Abidjan where, exactly ten years ago, truck after truck dumped over 540,000 litres of toxic waste unloaded from a ship at the nearby port.

The toxic waste was made by multinational oil trader Trafigura. For three months over the summer of 2006, Trafigura essentially operated a floating oil refinery on the seas of Europe. On board that ship Trafigura treated a dirty oil product, mixed it with gasoline and then sold it as petrol in West Africa among other places.

This process also produced dangerous chemical waste that Trafigura had no idea how to dispose of safely. The waste was eventually dumped at 18 sites around Abidjan, the largest city in West Africa, by a local company Trafigura hired to dispose of it for just under US$17,000.

The dumping had a devastating effect on the people of Abidjan – in the next six months tens of thousands streamed into its hospitals and health centres suffering from symptoms like breathing difficulties, vomiting, headaches, weeping eyes, nosebleeds and skin lesions. Authorities reported 15 deaths.

The government built the health centre in Djibi in recognition of the significant impact of the dumping on the village. One doctor involved in the emergency response said he thought it “likely that the entire population of that village were victims of the waste”. In a 2012 report on the disaster, The Toxic Truth, Amnesty International and Greenpeace estimated that around 70,000 litres of waste were dumped near Djibi. Overflowing bags of toxic soil from other dumpsites were stored there until mid-2010. The Côte d’Ivoire government only announced nine months ago that the treatment of that soil had been completed.

As we mark the 10th anniversary of the dumping, Djibi’s health centre symbolises the toxic legacy of this disaster.

The clinic felt abandoned when I visited in July 2016. There were only three people there – two providing maternity services and the other a nurse who visited once a week. Villagers told us it has no money to buy medication. Its corridors were totally empty of patients, devoid of the cries of children and the normal hustle and bustle of hospitals.

Victims told us that they feel similarly abandoned. While Trafigura provided some compensation, many victims have not received any compensation. No one has ever checked-up on their health or assessed the potential long-term risks of the chemicals in the waste. Most still don’t know what was in the waste – to this day Trafigura has never disclosed the exact contents of the waste and its potential impacts. Abidjan residents believe the dumpsites have not been fully cleaned-up because they can still smell the waste when it rains heavily. Despite this, people grow vegetables on the dumpsites.

Two things have inevitably filled this vacuum in information and action, prolonging an already toxic legacy.

The first is fear.

Of the 38 Abidjan residents we spoke to, nearly all believe they are still ill from inhaling chemicals in the waste. The government only announced in December 2015 that the dumpsites have been fully cleaned-up, although this is yet to be confirmed. People worry about any long-term impacts on them and their families – especially because no one has ever checked-up on their health and because they don’t know exactly what was in the waste.

The second thing to fill that vacuum is exploitation.

In a desperate search for some sense of justice, victims have joined associations that make unsubstantiated guarantees of compensation from Trafigura through legal claims in return for upfront fees and a share of any damages that are awarded. It can seem that some of these associations are more interested in making money than genuinely helping victims. While joining fees can vary between US$2 and US$8, victims in one group told us they had paid fees and other charges of US$35 each. This may not sound much but many of the victims have little money and some of these associations have up to 50,000 members. There is also a risk that, if compensation money is paid directly to the associations, they won’t distribute it to their members – as happened to around $6 million of the money awarded in one UK claim concerning the disaster.

After years of conflict and civil unrest, Côte d’Ivoire is taking steps in the right direction. At the government’s request and cost, the United Nations Environment Programme recently finished checking if all the dumpsites had been fully decontaminated. It plans to issue its report later this year. The government has also asked a local laboratory to check the health of all victims in Djibi village.

But governments can and need to do more to support and reassure the victims – including finally compelling Trafigura to disclose the exact contents of the waste, checking the health of all people exposed to the waste and assessing and disclosing the potential long-term health and environmental risks.

As I leave Abidjan I share the victims’ feeling that they have been abandoned to their own fate. As one person we interviewed said, “Trafigura has turned the page”. The victims don’t have that luxury.
