나이지리아 라고스 주정부는 바디아이스트 비공식 정착촌에서 18일 강제 퇴거당한 수백여 가구를 보호하기 위해 즉시 나서야 할 것이라고 국제앰네스티가 밝혔다.

경찰이 정착촌 주민들에게 퇴거를 통보한 후 18일 오후부터 철거가 시작되었다. 철거 전날 건물 곳곳에 붉은색 페인트로 압류 표시가 칠해졌고, 18일 아침 이른 시간부터 불도저가 마을에 도착했다. 주민들은 철거 불과 하루 전에 퇴거 통보를 받았고, 지금까지 적절한 보상이나 대체 주거지를 제공받지 못했다. 지역정부 역시 퇴거 지역 주민들과 공식적으로 면담을 나눈 바가 전혀 없었다.

모라요 아데바요(Morayo Adebayo) 국제앰네스티 나이지리아 조사관은 “바디아이스트 주민 수백여 명은 이날 아침부터 집 앞에 불도저들이 진을 치고 있는 공포스러운 모습과 함께 하루를 시작해야 했다. 사전에 적절한 통보도 없었던 채로, 이곳 주민들은 항소조차 할 수 없는 법원 판결로 인해 강제 퇴거될 심각한 위기에 처해 있다”며 “라고스 주정부는 이곳 주민들이 자신의 주거지에 자의적, 불법적인 간섭을 받지 않고 보호받을 수 있도록 책임을 다하기 위해 즉시 나서야 한다”고 말했다.

이번 퇴거 위협은 해당 지역단체장이 현재 철거 위기에 놓인 바디아이스트 정착지의 소유권을 주장하며 소를 제기했고, 이에 법원이 원고 승소를 판결하면서 나온 것이다. 그러나 이 판결로 영향을 받게 되는 정착지 주민들은 소송의 당사자가 아니었고, 이 때문에 항소를 제기하는 것도 불가능했다. 또한 지역정부는 강제퇴거와 철거 계획에 대해 주민들과 전혀 상의하지 않았고, 이는 국제법상 의무를 위반하는 것이다.

지난 2013년 2월에도 라고스 주정부는 바디아이스트에 불도저를 보내 200채 이상의 건물을 철거하고 9,000여명을 강제 퇴거했다. 당시 퇴거된 주민들은 지금까지도 적절한 보상이나 실질적인 대안을 제공받지 못했다.

아데바요 조사관은 “집과 직장을 철거하는 것은 주민들의 생계를 파괴하고 수백여 명을 거리에 나앉게 할 뿐만 아니라, 국제법상 국가의 의무마저 위반하는 일”이라며 “이번 판결은 끔찍한 오심으로, 라고스 주정부는 피해 주민들을 보호해야 할 명백한 책임이 있다”고 말했다.

Authorities in Lagos state must act immediately to protect hundreds of families in the informal settlement of Badia East who are being forcibly evicted today, said Amnesty International.

Demolitions began this afternoon after police had been in the community earlier asking residents to move out. Bulldozers had arrived in the informal settlement in the early hours of Friday morning, after repossession notices were daubed across buildings with red paint yesterday. Residents were given just one day’s notice of the demolition and to date, no adequate remedy or alternative housing has been offered and the local chief has not conducted any formal consultation with the affected residents.

“Hundreds of people in Badia East woke up this morning to the frightening sight of bulldozers outside their homes. With wholly inadequate notice, they are at serious risk of being forcibly evicted because of a court ruling which they have no chance to appeal,” said Morayo Adebayo, Nigeria Researcher for Amnesty International.

“The Lagos state government must act urgently to meet its responsibility to ensure that these people are protected from any arbitrary or unlawful interference with their homes.”

This threat of eviction comes after a court ruling in favour of a local chief, who is seeking to reclaim the land on which the homes and structures at risk in Badia East are built. Although this case went to court, those affected by the ruling were not party to this lawsuit, rendering them unable to appeal the judgement.In addition, they have not been consulted at all on the proposed demolitions and evictions as the authorities are required to do under international law.

In February 2013, the Lagos state government sent bulldozers into Badia East, and demolished more than 200 structures, forcibly evicting 9,000 people. Those affected still have not received adequate compensation or an effective remedy.

South East Asia: Immediately step up efforts to rescue thousands at grave risk at sea

South East Asian governments must step up urgent search and rescue efforts to ensure that thousands of people stranded in boats are not left in dire circumstances and at risk of death, Amnesty International said, as another boat carrying hundreds of people thought to be migrants and asylum seekers in desperate conditions is currently awaiting rescue off the Thai coast.

Amnesty International has confirmed that a boat crammed with some 350 people, including children, is currently drifting off the coast of Thailand and Malaysia. The hundreds of people, believed to be from Myanmar or Bangladesh, have been at sea for “many days”, possibly more than two months. Their crew abandoned them several days ago. The passengers are without food and water and are in urgent need of medical care. Thai Navy vessels are currently searching for the boat.

“Governments in South East Asia must act immediately to stop this unfolding humanitarian crisis. It is crucial that countries in the region launch coordinated search and rescue operations to save those at sea – anything less could be a death sentence for thousands of people,” said Kate Schuetze, Amnesty International Asia Pacific Researcher.

“It’s harrowing to think that hundreds of people are right now drifting in a boat perilously close to dying, without food or water, and without even knowing where they are.”

Earlier today, a boat carrying some 500 people was found off the coast of Penang island in northern Malaysia. Malaysian authorities this week said they would use punitive measures, including pushing back boats and deporting migrants and refugees, to send the “right message” to irregular arrivals.

“The Malaysian authorities have a duty to protect and not punish the hundreds of people who reached the country’s shores today. They must be given the medical care they desperately need, and in no circumstances be sent back to sea or transferred to a place where their rights or lives are put at risk,” said Kate Schuetze.

“Comments by the authorities that they will turn back those arriving on boats are an affront to human dignity. What’s more, if authorities follow through with these threats, they will be violating Malaysia’s international legal obligations.”

In the last few days, increasing numbers of people from Myanmar and Bangladesh have arrived by boat in Malaysia and Indonesia. At least one boat with some 400 people believed to be Rohingya was on Monday towed out to sea by the Indonesian Navy, off the coast of Aceh, after it was provided with food and fuel.

A crackdown on irregular arrivals in Thailand seems to have forced smugglers and traffickers to look for new routes. The International Organization for Migration believes that 8,000 people may still be on boats close to Thailand.

The thousands of people who have fled Bangladesh and Myanmar include vulnerable migrants, refugees such as Muslim Rohingya fleeing discrimination and violence in Myanmar, and victims of human trafficking. Many are desperate enough to put their own lives at risk by braving dangerous journeys at sea in order to escape unbearable conditions at home.

“The thousands of lives at risk should be the immediate priority, but the root causes of this crisis must also be addressed. The fact that thousands of Rohingya prefer a dangerous boat journey they may not survive to staying in Myanmar speaks volumes about the conditions they face there,” said Kate Schuetze.

태국 법원은 9월 1일 명예훼손 및 컴퓨터범죄법 위반으로 기소된 온라인 언론매체 푸켓완(Phuketwan)의 앨런 모리슨 편집장과 추티마 시다사티안 기자에 대해 무죄를 선고했다. 태국 컴퓨터범죄법의 해당 조항은 제3자 또는 국민에게 피해를 야기할 가능성이 높은 방법으로 날조 또는 거짓 정보를 유포하는 행위를 처벌하고 있다.

The acquittal of two journalists in Thailand – on trial for reproducing parts of an article on human trafficking – is a welcome move for freedom of expression, but the two should never have had to stand trial in the first place, Amnesty International said.

The online news outlet Phuketwan’s editor Alan Morison and reporter Chutima Sidasathian were today found not guilty of criminal defamation and for violating a provision of the Computer Crime Act. The measure penalizes importing forged or false digital information in a manner likely to cause harm to a third party or the public.

The charges – brought following a complaint by the Thai Royal Navy – stem from one paragraph copied from a Pulitzer Prize-winning article by Reuters, that examined Thailand’s role in the trafficking of Rohingya migrants, published in 2013.

“The acquittal of these two journalists is a positive decision, but the fact is that they should never have had to stand trial in the first place let alone face the possibility of years in jail. The Thai authorities have again shown their disregard for freedom of expression by pursuing this case,” said Josef Benedict, Amnesty International’s South East Asia Campaigns Director.

“Vaguely worded provisions of the Computer Crime Act are being misused as a tool to silence and harass independent media. This law contains provisions which violate human rights and should be repealed or amended immediately to comply with Thailand’s obligations under international law.

“This is just the latest in a long line of attacks on freedom of expression and media outlets since the military seized power in 2014. Thailand’s authorities must stop paying lip service to human rights – unlawful restrictions on freedom of expression must be lifted immediately, including criminal charges and sentences against the growing numbers of prisoners of conscience.”

태국의 수도 방콕과 동북부의 도시 콘카엔에서 학생들과 반쿠데타 활동가들을 임의로 구금한 사건이 22일에만 최소 3건 벌어진 것은, 군부 쿠데타 발발 1년째에 접어들고 있지만 평화적인 반대 시위조차 용인되지 않는 냉혹한 현실을 보여주는 것이라고 국제앰네스티가 22일 밝혔다.

리처드 베넷(Richard Bennett) 국제앰네스티 아시아태평양국장은 “태국 군부정권이 들어선 지 1년이 되었지만 여전히 거리에서는 평화적인 시위가 강경 진압되고 있다”며 “평화적 시위대는 군사정부가 불편하게 여기는 주제에 의문을 제기하거나 정부에 맞섰다는 이유만으로 임의로 체포 또는 구금되어서는 안 된다. 표현의 자유라는 인권을 평화적으로 행사했다는 이유만으로 구금된 사람들은 누구나 즉시 무조건적으로 석방되어야 하며, 모든 혐의는 취소되어야 한다”고 말했다.

또한 “정부는 평화적인 반대 시위자들을 존중은 물론 보호해야 하며, 태국에서의 표현과 집회의 자유를 제한하는 엄격한 법과 관행을 완화해야 한다”고 말했다.

현지시간으로 22일 오후 6시 20분경, 태국 경찰은 방콕 예술문화센터에서 2014년 군부 쿠데타를 반대하는 평화적, 상징적인 시위를 개최하려던 학생과 활동가 20명을 구금했다. 경찰은 상부의 지시를 기다리고 있는 중이라며 이들의 변호사 접견을 허용하지 않았다. 최소 2명 이상의 활동가들이 체포 과정에서 부상을 입어 치료가 필요한 상태인 것으로 알려졌다.

또한 같은 날 오후 3시, 군과 경찰은 방콕의 한 전철역에서 학생과 민주주의 활동가, 택시 운전사를 차례로 체포했다. 이들은 방콕 경찰서에 구금되어 있다가 곧 풀려났다.

세 사람은 모두 시민단체 ‘저항시민’ 소속으로, 현 태국 총리인 프라윳 찬-오차 장군에 대해 지난해 쿠데타를 일으킨 혐의로 방콕의 형사법원에 형사고발을 하러 가던 중이었다. 이 시민단체는 쿠데타 1주년을 맞기 수 일 전부터 이러한 계획을 공개적으로 밝혔던 바 있다. 그 외에 대학생인 시라윗 세리시왓, 2010년 당시 시위 강경진압으로 아들이 정부군에 목숨을 잃었던 판삭 스리셉, 그리고 택시 운전사인 와나키엣 추수완 등 저항시민 소속의 다른 회원들 역시 평화적 반쿠데타 시위를 준비하다 구금되었다.

The arbitrary arrests of students and anti-coup activists in at least three separate incidents today in Thailand’s capital Bangkok and the north-eastern city of Khon Kaen come as a stark reminder of the ongoing intolerance of peaceful dissent a year into military rule, Amnesty International said today.

“Peaceful protesters must not be arbitrarily arrested or detained just because they raise uncomfortable topics or defy military rule. Anyone held merely for peacefully exercising their human right to freedom of expression must be released immediately and unconditionally and all charges dropped.

“The authorities must respect and even protect peaceful dissent and lift draconian restrictions on expression and assembly in Thailand – in law and practice.”

At around 6:20 pm local time, police detained 20 students and activists in Bangkok, who were about to carry out a peaceful, symbolic protest against the 2014 coup at the Bangkok Art and Culture Centre, one of the first sites of spontaneous anti-coup protests last year. Police have denied the group access to lawyers, stating that they are awaiting orders from senior officers. At least two activists are reported to have sustained injuries during the arrest and require medical attention.

In a separate incident in Bangkok at 3 pm today, soldiers and police arrested a student, a pro-democracy activist and a taxi driver at a metro station. They were held at a Bangkok police station and later released.

All three belong to Resistant Citizen, a political protest group, and were on their way to file a criminal complaint at the capital’s criminal court against General Prayuth Chan-ocha, the current Prime Minister, for staging last year’s coup. The group had made their plans public in days preceding the anniversary of the coup. Other members of the group have been detained before for peaceful acts of symbolic protest in the country – including university student Sirawit Serithiwat, Pansak Srithep, whose son was killed by the army during the crackdown on protests in 2010, and taxi driver Wannakiet Chusuwan.

In a third incident, at least seven people were arrested in Khon Kaen, north-eastern Thailand, at the city’s Democracy Monument at around 1 pm, after seven protesters staged a peaceful protest against the coup and forcible evictions of rural communities in extractive and developmental projects. The protesters all belong to Dao Din, a student activist group, and are believed to include members previously arrested for flashing the three-finger “Hunger Games” salute during a speech by General Prayuth in Khon Kaen in November 2014.

News footage shows plainclothes officers breaking up today’s protest before the activists’ arrest. The Dao Din activists were first taken to a military camp and are now being held at a police station in Khon Kaen.

These are just the latest episodes in the Thai authorities’ continuing repression of public dissent in the country, where many people face imprisonment if they engage in political activities. Authorities have granted themselves extensive powers to restrict and deny rights in the name of security – it is high time that they allowed people to peacefully exercise their rights to dissent.

미연방 대법원이 미 전역을 통틀어 합법적으로 동성간 결혼할 권리를 인정하는 역사적인 판결을 내렸다.

스티븐 W 호킨스(Steven W. Hawkins)국제앰네스티 미국지부 사무국장은 “오늘은 동성애자들뿐만 아니라 인권과 평등을 믿는 모두에게 기쁜 날이다”라고 말했다.

이어 “누구든지 자신이 원하는 동반자와 결혼하고 가족을 만들 수 있으며, 이는 국제법상에 명시된 인권이다. LGBT들에 대한 모든 형태의 차별을 개선하기 위해 해야 할 일들이 많이 남아있지만, 긴 기다림 끝에 얻은 이번 판결은 동성커플과 그 가족들에게 다른 이들과 똑같이 존중 받으며 인지될 수 있음을 천명하는 중요한 계기가 되었다”고 강조했다.

US Supreme Court Marriage Ruling a Victory for Human Rights

The Supreme Court of the United States today delivered a historic ruling affirming the right of same-sex couples across the country to legally marry.

“This is a joyous day not just for loving and committed same-sex couples, but for everyone who believes in human rights and equality for all,” said Steven W. Hawkins, executive director of Amnesty International USA.

“The ability to marry the partner of your choice and raise a family is a human right enshrined in international law. While much work remains to be done to ensure that all forms of discrimination against LGBT people are eliminated once and for all, this long-awaited and significant decision affirms that same-sex couples and their families deserve the same respect and recognition as anyone else.”
