세계 각국은 난민들에게 필수적인 인도적 지원을 제공하지 않음으로써 수백만 명의 난민을 견딜 수 없는 생활고 속으로 몰아넣고, 수천 명을 사망에 이르게 하고 있다고 국제앰네스티가 밝혔다.

국제앰네스티는 6월 20일 세계 난민의 날을 앞두고 15일 레바논 베이루트에서 신규 브리핑을 발표했다. <세계 난민 위기: 방관의 모의>는 레바논에서 케냐, 안다만 해, 지중해 등에서 수백만 명의 난민이 처한 충격적인 고통에 대해 알아보고, 국제사회의 난민 문제에 대한 접근 방식을 근본적으로 바꾸어야 한다고 촉구하고 있다.

살릴 셰티(Salil Shetty) 국제앰네스티 사무총장은 “현재 우리는 당대 최악의 난민 위기를 목도하고 있다. 수백만 명의 남녀와 어린이들이 잔혹한 전쟁과 인신매매, 기본적인 인간에 대한 연민을 보이기보다 이기적으로 정치적 이익만을 추구하는 정부 사이에서 고통받고 있다”며 “현재의 난민 위기는 21세기의 대표적인 도전 과제지만 이에 대한 국제사회의 대처는 부끄러운 실패에 그치고 있다. 일관성 있고 포괄적인 국제적 전략 마련을 위해 관련 정책과 관행을 근본적으로 재검토해야 한다”고 말했다.

국제앰네스티는 난민 보호 제도의 활성화 방안을 제시하면서, 각국 정부에 각자의 법적 의무를 이행할 것과 국제적 책임 공유에 전념할 것을 확고히 결의해야 한다고 촉구했다. 국제앰네스티가 세계 정부에 촉구하는 행동은 다음과 같다.

  • 향후 4년 안에 재정착이 시급한 난민 1백만 명에 대해 일괄적으로 재정착 사업에 착수하겠다고 약속할 것
  • 난민 위기에 대한 유엔의 인도주의적 요청을 모두 충당할 수 있는 국제 난민 기금을 마련하고, 대규모의 난민을 수용하고 있는 국가에 대해 재정적으로 지원할 것
  • 유엔 난민 협약을 비준할 것
  • 난민의 요구사항을 반영하고, 난민 역시 교육 및 병원과 같은 기본적인 복지 서비스를 이용할 수 있도록 보장하는 공정한 국내적 제도를 마련할 것

살릴 셰티 사무총장은 “국제사회는 더 이상 레바논, 터키 등의 국가들이 이처럼 막대한 부담을 지고 있는 현실을 가만히 앉아서 지켜만 봐서는 안 된다. 그 어떤 국가도 이렇게 엄청난 인도주의적 위기상황을 단지 분쟁국가와 우연히 국경을 맞대고 있다는 이유만으로 주변의 도움도 없이 스스로 해결하도록 방치될 수는 없다”고 말했다.

또한 “세계 각국은 사람들이 안전한 곳을 찾으려다 목숨을 잃지 않도록 보장해야 하는 의무가 있다. 국가정부가 절박한 난민들을 위해 안전한 피난처를 제공하고, 국제난민기금을 마련하고, 인신매매단을 기소해 실질적인 행동에 나서는 것이 무엇보다 중요하다. 이제는 난민 보호를 위해 더욱 박차를 가해야 할 때로, 그렇지 않으면 세계는 충분히 막을 수 있었던 이번 비극의 공범이 될 것”이라고 말했다.

시리아: 세계 최대의 난민 위기

시리아를 떠난 난민은 400만 명 이상으로, 이 중 95%가 터키, 레바논, 요르단, 이라크, 이집트 등의 불과 5개 국가에 수용되어 있다.

이들 국가 역시 이제는 한계에 이르렀다. 국제사회는 이들 5개국과 난민을 지원하는 인도주의 단체에 충분한 자원을 제공하지 않고 있다. 유엔난민기구(UNHCR)가 여러 차례 요청했음에도 불구하고 시리아 난민에게 제공된 재정착 장소는 턱없이 부족하다.

너무나 어려운 상황인 나머지 시리아의 일부 인접국들은 국경을 넘어오려는 절박한 사람들을 거부하고 분쟁지역으로 돌려보내는 등의 매우 걱정스러운 방법에 의존하고 있다.

2015년에 들어서면서 레바논은 시리아 난민들의 입국을 매우 엄격히 제한하고 있다. 레바논 정부는 시리아 국민이 입국하려면 특정 조건을 만족해야 하는 새로운 입국 기준을 발표했다. 이러한 기준이 시행된 이후로 시리아 난민의 등록 역시 큰 폭으로 감소해, 2015년 3월까지 UNHCR에 등록된 시리아 난민의 수는 2014년 같은 기간에 비해 80% 적은 수치였다.

지중해: 가장 위험한 해상 경로

지중해는 난민과 이주민에게 가장 위험한 해상 경로다. 2014년에는 극도로 위험한 환경에서도 지중해를 건넌 사람이 21만 9,000명에 달했으며 3,500명이 도해를 시도하다 목숨을 잃었다.

2014년 한 해 동안 이탈리아 정부가 구조한 사람은 17만 명이 넘는다. 그러나 2014년 10월, 다른 EU 회원국들의 압박으로 이탈리아는 결국 ‘마레 노스트룸’ 구조 작전을 취소하고, 대신 EU 국경기관 프론텍스(Frontex)가 마련한 훨씬 제한적인 수준의 ‘트리톤’ 작전을 채택했다.

트리톤 작전은 수색구조 권한이 충분히 넓지 않고, 동원 가능한 선박 수도 적으며 작전 지역 역시 상당히 축소되었다. 이 때문에 지중해에서의 사망자 수가 급격히 증가하는 원인이 됐다. 국제이주기구(IOM)에 따르면 2015년 5월 31일 현재까지 지중해를 건너려다 목숨을 잃은 사람의 수는 1,865명이며 이는 2014년 같은 기간 425명이 사망했던 것과 비교되는 수치다.

지중해에서의 끔찍한 희생 사건을 여러 차례 겪은 후인 4월 말, 유럽 각국 정상들은 마침내 수색구조 자원을 확충하기로 결정했다. 트리톤 작전의 자원과 작전 지역은 마레 노스트룸 작전과 같은 수준으로 확대됐다. 또한 독일, 아일랜드, 영국 등의 유럽 국가들이 트리톤 작전의 해상 지원역량을 강화하기 위해 추가적으로 선박과 비행기를 배치했다. 국제앰네스티가 오랫동안 추진해 왔던 이러한 조치들이 취해진 것은 난민과 이주민의 해상 안전을 강화하는 데 있어 환영할만한 진전이다.

유럽위원회 역시 EU 이외 국가의 난민들에게 재정착 장소 20,000곳을 추가적으로 제공할 것을 EU 회원국들에 제안했다. 이러한 제안이 한 걸음 내디딘 것이기는 하나, 국제적인 책임 공유에 충분히 기여하기에는 20,000곳은 턱없이 부족하다.

예를 들어, 가까운 시일 내로 고향에 돌아갈 가망이 전혀 없는 처지에서 주요 난민 수용국으로부터 인도적 지원까지 삭감되는 처지에 놓인 시리아 난민들은 유럽으로 가기 위해 계속해서 지중해를 건너려고 시도할 가능성이 높다. 난민뿐만 아니라 이주민에게도 안전하고 합법적인 대체 경로가 충분히 마련되지 않는다면 사람들은 목숨을 건 도해를 계속하게 될 것이다.

아프리카: 잊혀진 위기

아프리카 사하라 이남 지역의 난민 수는 300만 명 이상에 이른다. 남수단과 중앙아프리카공화국(CAR) 등의 국가에서 발발한 전쟁으로, 분쟁과 기소를 피해 떠나는 사람들의 수가 더욱 증가하게 되었다. 세계에서 가장 많은 난민이 빠져 나오는 상위 10개국 중 5개국이 아프리카 사하라 이남 지역의 국가다. 가장 많은 난민을 수용하고 있는 상위 10개국 중 4개국 역시 마찬가지다.

아프리카 사하라 이남 지역의 분쟁과 위기로 인해 난민들은 주변국으로 몰려들게 되었다. 이들 국가 중 많은 수가 이미 소말리아, 수단, 에리트레아, 에티오피아 등에서 온 난민 수만 명을 장기적으로 수용하고 있는 상태다.

남수단과 수단의 경우와 같이, 자국의 분쟁에 시달리고 있는 국가조차도 난민을 수용하는 경우도 있다.

아프리카 지역의 난민 위기는 지역적, 세계적 정치 토론에서 거의, 또는 전혀 관심을 받지 못한다. 2013년 재정착이 이루어진 아프리카 지역 난민은 15,000명 이하에 불과했으며 유엔의 인도주의적 요청은 심각한 자금 부족을 겪고 있다. 예를 들면, 2013년 12월 남수단에서 무력 분쟁이 시작된 결과 55만 명 이상이 난민이 되었고, 이들 중 대다수는 현재 에티오피아, 수단, 케냐, 우간다에 수용되어 있다. 유엔의 남수단 지역 난민 대응 계획에 대한 자금 투자율은 2015년 6월 3일 현재 불과 11%에 그치고 있다.

동남아시아: 절박한 사람들을 돌려보내다

UNHCR은 2015년 1분기 동안 약 25,000명이 벵골 만을 건너려 시도했다고 발표했다. 이는 2014년 같은 기간에 비해 약 2배로 증가한 숫자다. 벵골 만을 통한 경로는 미얀마의 이슬람계인 로힝야족과 방글라데시인들이 주로 이용하는 길이다.

5월 11일, 국제이주기구(IOM)는 태국 연안에서 좌초된 배에 8,000명이 타고 있었을 것으로 추정했다. 이들 중 대부분은 미얀마에서 국가가 조장하는 박해를 피해 떠난 로힝야족이었을 것으로 추정된다.

5월 인도네시아, 말레이시아, 태국은 도움이 절실한 상태의 난민과 이주민 수백 명이 처한 위험에도 불구하고 이들이 탄 배를 다시 돌려보냈다. UNHCR는 2015년 들어 3월까지 300명이 “기아와 탈수, 선원들의 폭행”으로 바다 위에서 숨졌을 것으로 추정하고 있다.

5월 20일 인도네시아와 말레이시아는 정책 노선을 변경해, 여전히 바다 위에 표류하고 있는 난민과 이주민에게 최대 7,000명까지 “임시 쉼터”를 제공하겠다고 밝혔다. 그러나 이러한 임시적 보호는 최대 1년에 그치고, 난민들의 본국 송환 또는 재정착을 국제사회가 돕는다는 조건 하에서만 가능하다. 인도네시아, 말레이시아, 태국 등은 유엔 난민협약을 아직 비준하지 않았다.

이외에도, 호주 정부는 배로 들어오려는 난민 신청자들에게 강경 대응하면서, 생명을 구한다는 명목으로 난민법과 인권법적 의무를 위반하며 해당 지역에 충격적인 전례를 만들었다.

살릴 셰티 총장은 “안다만 해에서 지중해까지 사람들은 필사적으로 안전한 피난처를 찾으려다 목숨을 잃고 있다. 작금의 난민 위기는 각국이 국제적 협력을 크게 확대해야 하는 세계적인 문제라는 것을 국제사회가 인식하지 않는 이상 해결되지 않을 것이다. 이번 주말 UNHCR은 연간 난민 통계 수치를 발표할 예정인데, 난민 위기가 더욱 악화되고 있다는 사실만을 알게 될 가능성이 높다. 이제는 행동할 때다”라고 말했다.

World leaders are condemning millions of refugees to an unbearable existence and thousands to death by failing to provide essential humanitarian protection, said Amnesty International as it published a new briefing in Beirut today, ahead of World Refugee Day on 20 June.

The Global Refugee Crisis: A conspiracy of neglect explores the startling suffering of millions of refugees, from Lebanon to Kenya, the Andaman Sea to the Mediterranean Sea, and calls for a radical change in the way the world deals with refugees.

“We are witnessing the worst refugee crisis of our era, with millions of women, men and children struggling to survive amidst brutal wars, networks of people traffickers and governments who pursue selfish political interests instead of showing basic human compassion,” said Salil Shetty, Amnesty International’s Secretary General.

“The refugee crisis is one of the defining challenges of the 21st century, but the response of the international community has been a shameful failure. We need a radical overhaul of policy and practice to create a coherent and comprehensive global strategy.”

Amnesty International is setting out a proposal to reinvigorate the system for refugee protection and urging states to make firm commitments to live up to their individual legal obligations and renew their commitment to international responsibility-sharing. Amongst the actions Amnesty International is urging governments to take are:

  • A commitment to collectively resettle the one million refugees who currently need resettlement over the next four years.
  • To establish a global refugee fund that will fulfil all UN humanitarian appeals for refugee crises and provide financial support to countries hosting large numbers of refugees.
  • The global ratification of the UN Refugee Convention.
  • To develop fair domestic systems to assess refugee claims and guarantee that refugees have access to basic services such as education and healthcare.

“The world can no longer sit and watch while countries like Lebanon and Turkey take on such huge burdens. No country should be left to deal with a massive humanitarian emergency with so little help from others, just because it happens to share a border with a country in conflict,” said Salil Shetty.

“Governments across the world have the duty to ensure people do not die while trying to reach safety. It is essential that they offer a safe haven for desperate refugees, establish a global refugee fund and take effective action to prosecute trafficking gangs. Now is the time to step up protection for refugees, anything less will make world leaders accomplices in this preventable tragedy.”

Syria: World’s largest refugee crisis

More than four million refugees have fled Syria, 95% of them are in just five main host countries: Turkey, Lebanon, Jordan, Iraq and Egypt.

These countries are now struggling to cope. The international community has failed to provide them, or the humanitarian agencies supporting refugees with sufficient resources. Despite calls from the UNHCR, the UN Refugee Agency, far too few resettlement places have been offered to Syrian refugees.

The situation is so desperate that some of Syria’s neighbours have resorted to deeply troubling measures, including denying desperate people entry to their territory and pushing people back into the conflict.

Since the beginning of 2015, Lebanon has severely restricted entry to people fleeing Syria. The Lebanese authorities issued new guidelines whereby Syrian nationals are required to fulfil specific criteria in order to enter. Since these criteria were imposed, there has been a significant drop in registration of Syrian refugees – in the first three months of 2015 UNHCR registered 80% fewer Syrian refugees than in the same period in 2014.

Mediterranean: The most dangerous sea route

The Mediterranean is the most dangerous sea route for refugees and migrants. In 2014, 219,000 people made the crossing under extremely dangerous conditions and 3,500 died attempting it.

In 2014, the Italian authorities rescued over 170,000 people. However in October 2014, Italy, under pressure from other EU member states, cancelled the rescue operation, Mare Nostrum, which was replaced by the much more limited Operation Triton (by the EU border agency, Frontex).

Operation Triton did not have a sufficiently broad search and rescue mandate, had fewer vessels and a significantly smaller area of operation. This contributed to a dramatic increase in the number of lives lost in the Mediterranean. As of 31 May 2015, 1,865 people had died attempting the Mediterranean crossing, compared to 425 during the same period in 2014 (according to the IOM).

Follow several horrific cases of loss of life in the Mediterranean, at the end of April, European leaders finally increased resources for search and rescue. Triton’s resources and area of operation were increased to match Mare Nostrum’s. In addition European states such as Germany, Ireland and the UK have deployed ships and aircrafts, additional to Operation Triton resources to further boost capacity for assisting people at sea. These measures, which had long been advocated for by Amnesty International, are a welcome step towards increasing safety at sea for refugees and migrants.

The European Commission also proposed that EU states offer 20,000 additional resettlement places to refugees from outside the EU. While this proposal is a step forward, 20,000 is too small a number to adequately contribute to international responsibility-sharing.

For example, Syrian refugees faced with reduced humanitarian assistance in the main host countries and with no prospect of returning home in the near future, are likely to continue to attempt to cross the Mediterranean to reach Europe. Without sufficient safe and legal alternative routes for refugees – but also for migrants – people will continue to risk their lives.

Africa: Forgotten crises

There are more than three million refugees in sub-Saharan Africa. Outbreaks of fighting in countries including South Sudan and the Central African Republic (CAR), have led to an increasing number of people on the move – fleeing conflict and persecution. Of the top 10 countries globally from which people are fleeing as refugees, five are in are in sub-Saharan Africa. Four of the top ten refugee-hosting countries are in sub-Saharan Africa

The conflicts and crises in the region have led to an influx of refugees to neighbouring countries, many of which already host tens of thousands of long-standing refugee populations from countries such as Somalia, Sudan, Eritrea and Ethiopia, among others.

In some of these situations, as in the case of South Sudan and Sudan, refugees are hosted by countries that are themselves beset by conflict.

The refugee crises in Africa receive little or no attention in regional or global political forums. In 2013 fewer than 15,000 refugees from African countries were resettled and UN humanitarian appeals have been severely underfunded. For example, as a result of the conflict which broke out in South Sudan in December 2013, more than 550,000 people became refugees, the majority of whom are now in Ethiopia, Sudan, Kenya and Uganda. Only 11% of the UN’s South Sudan regional refugee response plan was funded as of 3 June 2015.

South East Asia: Turning away the desperate

In the first quarter of 2015, UNHCR reported that some 25,000 people attempted to cross the Bay of Bengal. This is approximately double the figure for the same period in 2014. This Bay of Bengal sea route is predominantly used by Muslim Rohingya from Myanmar and Bangladeshi nationals.

On 11 May, the International Organization for Migration estimated that there were 8,000 people stranded on boats close to Thailand. Many of those aboard were believed to be Rohingya fleeing state-sponsored persecution in Myanmar.

During May, Indonesia, Malaysia and Thailand turned back boats carrying hundreds of refugees and migrants desperate for help, despite the dangers they faced. UNHCR estimates that 300 people died at sea in the first three months of 2015 due to “starvation, dehydration and abuse by boat crews”.

On 20 May Indonesia and Malaysia changed course, announcing that they would provide “temporary shelter” for up to 7,000 people still at sea. However, this temporary protection would only last for up to a year, and on condition that the international community would help with repatriation or resettlement of the people. Indonesia, Malaysia and Thailand have not ratified the UN Refugee Convention.

Elsewhere, a terrible precedent has been set in the region by the Australian government whose hard-line approach to asylum-seekers attempting to arrive by boat has, under the guise of saving lives, violated its responsibilities under refugee and human rights law.

“From the Andaman to the Mediterranean people are losing their lives as they desperately seek safe haven. The current refugee crisis will not be solved unless the international community recognizes that it is a global problem that requires states to significantly step up international cooperation. Later this week UNHCR will release their annual statistics on refugees and we will likely find that the crisis is getting worse. It is time for action,” said Salil Shetty.

이후 과도정부가 수립되었지만 반카다피 세력 출신 무장단체들이 아무런 처벌 없이 심각한 범죄를 저지르는 것을 막을 수는 없었다. 리비아는 2014년 5월부터 민병대와 무장단체 간의 충돌로 또다시 새로운 무력 분쟁에 휩싸였고, 2개 정부로 분열되는 등 여전히 깊은 갈등에 시달리고 있다.

리비아의 인권은 다음과 같은 일곱 가지 방식으로 공격받고 있다.

1. 분쟁 양측 모두 민간인과 민간 시설에 무차별적이고 직접적인 공격을 가하는 등 전쟁범죄와 중대한 인권침해행위를 저질렀다. 정치적 또는 인종적 소속, 출신, 의견 때문에 납치되고 고문을 당한 사람은 수백여 명에 이른다.

2. 무장단체의 활동이 통제불능 수준에 이르렀다. 자칭 ‘이슬람국가’(IS)는 특정 지역을 점령한 후 극단적으로 해석한 이슬람 율법을 적용해 주민들을 공포에 빠뜨리고 있다. 여성들에게 엄격한 이슬람식 복장을 강요하거나, 공개처형 방식으로 살인을 저지르고 피해자의 시신을 공개된 장소에 방치하는 경우도 있었다. 또한 채찍질형이나 절단형을 공개적으로 집행하고, 이러한 범죄행위를 소셜 미디어상에 홍보하기도 했다.

3. 난민과 이주민들은 심각한 인권침해에 노출되어야 했다. 리비아 안팎의 밀입국 경로를 따라 수많은 사람들이 고문, 착취, 성폭행을 당하거나 무기한 구금을 당했다. 항해에 적합하지 않은 배를 이용해 리비아에서 지중해를 건너 유럽으로 가려던 사람도 수천 명에 이르렀다. 2015년 한 해 동안 2,880명 이상이 북아프리카 지역에서 이탈리아로 향하려다 바다에서 목숨을 잃었다


4. 리비아 전역에서 벌어지는 분쟁과 폭력으로 가장 큰 타격을 받는 것은 민간인들이다. 약 250만 명이 깨끗한 식수, 위생시설, 식량 등의 인도적 도움이 필요한 상황이며, 43만 명 이상이 강제이주를 당했다. 전투로 인해 수많은 병원과 의원이 문을 닫고, 파괴되거나 이용할 수 없는 상태가 되었다. 리비아 어린이 중 약 20%가 학교에 다니지 못하고 있다. 유엔은 의료지원과 교육, 난민과 이주민 보호 등 리비아 국민 130만 명에게 기본적인 서비스를 제공하기 위한 인도적 지원을 요청했지만 지원된 액수는 필요 총액의 불과 1%에 그쳤다.
5. 자유로운 발언이 공격당하고 있다. 언론인과 인권활동가, NGO 활동가들은 여러 무장단체로부터 위협을 받거나 납치, 살해당하기까지 한다. TV 방송국들은 로켓 추진식 수류탄으로 공격을 받아 파괴되고 불탔다. 국경없는기자회는 2015년 1월부터 11월 사이 언론인을 대상으로 한 공격이 30회 이상 벌어졌다고 기록했다.

6. 여성들의 인권이 후퇴하고 있다. 여성 활동가들은 위협과 협박을 당했고, 남성 동반인 없이 이동하는 여성들은 무장단체에 상습적으로 희롱을 당했다. 조혼이 더욱 쉬워지고, 남성은 법원의 승인 없이 아내와 이혼할 수 있게 하는 등 한층 더 여성차별적인 조항을 담은 법이 새로 제정됐다.

2011년 11월, 유엔 안전보장이사회는 카다피 정권의 <중대한 제도적 인권침해>에 관한 보고서가 발표된 후 만장일치로 리비아 상황을 국제형사재판소(ICC)에 회부했지만, ICC는 리비아의 불안정한 정세와 자원 부족을 이유로 계속해서 조사에 착수하지 못하고 있다. 최근 리비아 상황의 추가 조사를 위해 지원을 요청한 ICC의 파투 벤수다 검사는 자신의 요청이 받아들여질 가능성이 거의 없다고 시사하기도 했다.
유엔 안전보장이사회는 또한 인권침해와 폭력행위를 저지른 관련자들에 대해 자산 동결, 출국 금지 등의 제재를 가한다는 내용의 결의안을 다수 채택했지만 지금까지도 시행될 기미는 보이지 않는다.

Libya since the ‘Arab Spring’: 7 ways human rights are under attack

Five years ago, an initially peaceful uprising in Libya quickly developed into armed conflict involving Western military intervention and eventually ended when Colonel Mu’ammar al-Gaddafi was killed in October 2011.

Successive governments then failed to prevent newly-formed militias of anti al-Gaddafi fighters from committing serious crimes for which they never faced justice. The country remains deeply divided and since May 2014 has been engulfed in renewed armed conflict.

Here are seven ways human rights are under attack across the country:

1. All sides have committed war crimes and serious human rights abuses, including indiscriminate and direct attacks on civilians and their property. Hundreds have been abducted and tortured because of their perceived political or tribal affiliation, origin or opinion.

2. Armed groups are out of control. The so-called Islamic State (IS) took over certain areas where it has carried out public execution-style killings, sometimes leaving victims’ corpses on public display. It has also carried out public floggings and amputations, and publicized some crimes on social media.

3. Migrants and refugees face serious abuse. Many are tortured, exploited and sexually abused along the smuggling route in and out of Libya. Others have been detained indefinitely. Thousands have also sought to leave Libya and cross the Mediterranean Sea to Europe in unseaworthy vessels. In 2015, more than 2,880 drowned while attempting the journey from northern Africa to Italy.

4. Civilians bear the brunt of the conflict and violence across the country. Nearly 2.5 million people need humanitarian help including clean water, sanitation and food. Many hospitals and clinics are closed, damaged or inaccessible due to the fighting. Around 20% of children in Libya are not able to go to school.

5. Free speech is under attack. Journalists, human rights activists and NGO workers have been threatened, abducted and assassinated by various armed groups. TV stations have been vandalized, set ablaze and attacked with rocket-propelled grenades. Reporters Without Borders recorded more than 30 attacks against journalists between January and November 2015.

6. Women’s rights are in retreat. Women activists have been intimidated and threatened, and women travelling without a male companion have been harassed by militias. New laws discriminated against women even further, for example by making child marriage easier and allowing men to divorce their wives without obtaining court approval.

7. The legal system is barely functioning. Courts in some cities are closed because it’s so dangerous, and judges and lawyers have been attacked and abducted. Thousands of people seen as being loyal to al-Gaddafi have been detained for years without charge or trial. The trial of 37 former officials for alleged war crimes and other offences was deeply flawed, including its failure to investigate allegations of torture of the defendants.

경찰이 정착촌 주민들에게 퇴거를 통보한 후 18일 오후부터 철거가 시작되었다. 철거 전날 건물 곳곳에 붉은색 페인트로 압류 표시가 칠해졌고, 18일 아침 이른 시간부터 불도저가 마을에 도착했다. 주민들은 철거 불과 하루 전에 퇴거 통보를 받았고, 지금까지 적절한 보상이나 대체 주거지를 제공받지 못했다. 지역정부 역시 퇴거 지역 주민들과 공식적으로 면담을 나눈 바가 전혀 없었다.

모라요 아데바요(Morayo Adebayo) 국제앰네스티 나이지리아 조사관은 “바디아이스트 주민 수백여 명은 이날 아침부터 집 앞에 불도저들이 진을 치고 있는 공포스러운 모습과 함께 하루를 시작해야 했다. 사전에 적절한 통보도 없었던 채로, 이곳 주민들은 항소조차 할 수 없는 법원 판결로 인해 강제 퇴거될 심각한 위기에 처해 있다”며 “라고스 주정부는 이곳 주민들이 자신의 주거지에 자의적, 불법적인 간섭을 받지 않고 보호받을 수 있도록 책임을 다하기 위해 즉시 나서야 한다”고 말했다.

이번 퇴거 위협은 해당 지역단체장이 현재 철거 위기에 놓인 바디아이스트 정착지의 소유권을 주장하며 소를 제기했고, 이에 법원이 원고 승소를 판결하면서 나온 것이다. 그러나 이 판결로 영향을 받게 되는 정착지 주민들은 소송의 당사자가 아니었고, 이 때문에 항소를 제기하는 것도 불가능했다. 또한 지역정부는 강제퇴거와 철거 계획에 대해 주민들과 전혀 상의하지 않았고, 이는 국제법상 의무를 위반하는 것이다.

Authorities in Lagos state must act immediately to protect hundreds of families in the informal settlement of Badia East who are being forcibly evicted today, said Amnesty International.

Demolitions began this afternoon after police had been in the community earlier asking residents to move out. Bulldozers had arrived in the informal settlement in the early hours of Friday morning, after repossession notices were daubed across buildings with red paint yesterday. Residents were given just one day’s notice of the demolition and to date, no adequate remedy or alternative housing has been offered and the local chief has not conducted any formal consultation with the affected residents.

“Hundreds of people in Badia East woke up this morning to the frightening sight of bulldozers outside their homes. With wholly inadequate notice, they are at serious risk of being forcibly evicted because of a court ruling which they have no chance to appeal,” said Morayo Adebayo, Nigeria Researcher for Amnesty International.

“The Lagos state government must act urgently to meet its responsibility to ensure that these people are protected from any arbitrary or unlawful interference with their homes.”

This threat of eviction comes after a court ruling in favour of a local chief, who is seeking to reclaim the land on which the homes and structures at risk in Badia East are built. Although this case went to court, those affected by the ruling were not party to this lawsuit, rendering them unable to appeal the judgement.In addition, they have not been consulted at all on the proposed demolitions and evictions as the authorities are required to do under international law.

In February 2013, the Lagos state government sent bulldozers into Badia East, and demolished more than 200 structures, forcibly evicting 9,000 people. Those affected still have not received adequate compensation or an effective remedy.

“The demolition of their homes and businesses will not only destroy livelihoods and render hundreds homeless, it will also be a breach of the states’ duty under international law,” said Morayo Adebayo.

몽골 국회가 사형을 역사 속으로 사라지게 만든 국가 대열에 합류하면서 몽골 인권에 중대한 성과를 이룩하게 되었다고 국제앰네스티가 4일 밝혔다.

지난 3일 몽골 국회는 모든 범죄에 대해 사형을 폐지하는 형법개정안을 통과시켰다. 이렇게 채택된 새 형법은 2016년 9월부터 발효될 예정이며, 이로써 극도로 잔인하고 비인도적이며 굴욕적인 형벌인 사형을 완전히 폐지한 국가는 총 102개국이 된다.

로젠 라이프(Roseann Rife) 국제앰네스티 동아시아 조사국장은 “몽골의 역사적인 사형 폐지 결정은 위대한 인권적 성과다. 전세계적으로 사형은 이제 과거의 일이 되어 가고 있다. 몽골 사례의 여파가 신속히 전 아시아 지역으로 퍼져나가기를 기대한다. 사형집행을 강행하고 있는 국가들도 이처럼 잔인하고 비인도적인 형벌을 폐지하기 위해 나아가야 할 길이 명백해졌다”고 말했다.

올해 들어서만 피지, 마다가스카, 수리남 등 3개국이 이미 사형을 폐지했다.

몽골에서 사형집행이 이루어진 것은 지난 2008년이 마지막으로, 당시 사형제도는 국가 기밀로 취급되고 있었다. 그 이후로 사형폐지를 향해 계속해서 진전을 보인 끝에 지난 4일 역사적인 국회 표결로 이어질 수 있었다.

2010년 차히아긴 엘베그도르지 몽골 대통령은 모든 사형수의 형을 감형하고 예정된 사형집행 일정을 유예할 것을 발표했다. 또한 2012년에는 몽골의 사형폐지를 약속하는 내용의 국제조약을 비준했던 바 있다.

엘베그도르지 대통령은 몽골이 생명권을 완전히 존중하기 위해서는 사형에 등을 돌려야 한다고 꾸준히 발언해 왔다. 사형 위협만으로는 범죄에 대해 억지력을 발휘하지 못하며, 어떠한 사법제도라도 오심의 위험은 언제나 내재되어 있다는 것이 그의 주장이었다.

로젠 라이프 국장은 “차히아긴 엘베그도르지 대통령은 사형제도의 오류를 폭로했다. 몽골의 사형 폐지 과정에서 나타난 정치적 리더십은 다른 아시아 국가에서도 마찬가지로 발휘되어야 할 것이다. 사형집행을 강행하고 있는 국가들은 역사의 잘못된 편에 서 있다”고 말했다.

세계에서 소수의 국가만이 사형제도를 유지하고 있으며, 국제법과 국제기준을 완전히 위반하는 방법으로 사형을 적용하고 있다. 올해 초 인도네시아가 세계적인 비판에도 불구하고 사형집행을 재개한 한편, 파키스탄은 2014년 12월 사형집행 유예를 해제한 이후 지금까지 최소 300여명을 처형했다. 동아시아에서는 중국, 일본, 북한, 대만 등이 모두 2015년에도 사형을 집행했다.

국제앰네스티는 범죄의 성격이나 정황, 개인의 유죄 여부나 기타 특성, 국가가 사형을 집행하는 방식에 관계없이 모든 경우의 사형에 반대한다.

Mongolia: Historic vote abolishes death penalty

Mongolia’s parliament became the latest to consign the death penalty to the history books, in a major victory for human rights in the country, said Amnesty International today.

On Thursday, lawmakers voted in favour of a new Criminal Code that abolishes the death penalty for all crimes. The new Criminal Code will take effect from September 2016, and would bring the total number of countries to have completely abandoned this ultimate cruel, inhuman and degrading punishment to 102.

“Mongolia’s historic decision to abolish the death penalty is a great victory for human rights. The death penalty is becoming a thing of the past across the world,” said Roseann Rife, East Asia Research Director at Amnesty International.

“Mongolia has set an example which we hope will quickly ripple across Asia. The countries that continue to execute have been shown a clear path to follow to end this cruel and inhumane punishment.”

Three countries – Fiji, Madagascar and Suriname – have already abolished the death penalty this year.

The last execution in Mongolia was in 2008 and the death penalty remained classified as a state secret. Since then, the country has taken a series of steps towards abolition culminating in yesterday’s historic parliamentary vote.

In 2010, the country’s President, Tsakhiagiin Elbegdorj, commuted all death sentences and announced a moratorium on all executions. In 2012, Mongolia ratified an international treaty committing the country to the abolition of the death penalty.

President Tsakhiagiin Elbegdorj has repeatedly said Mongolia must turn its back on the death penalty in order to fully respect the right to life. He argued that the threat of executions does not have a deterrent effect and the risk of a miscarriage of justice is inherent in any system of justice.

“President Tsakhiagiin Elbegdorj exposed the fallacy of the death penalty. The political leadership shown in abolishing the death penalty in Mongolia needs to be repeated elsewhere in Asia. Countries that continue to execute are on the wrong side of history,” said Roseann Rife.

A minority of countries continue to use the death penalty, in ways that are completely contrary to international law and standards. Earlier this year, Indonesia resumed executions amidst worldwide criticism, while Pakistan has executed at least 300 people since it lifted a moratorium on executions in December 2014. In East Asia, China, Japan, North Korea, and Taiwan have all carried out executions in 2015.

Amnesty International opposes the death penalty in all cases without exception, regardless of the nature or circumstances of the crime; guilt, innocence or other characteristics of the individual; or the method used by the state to carry out the execution.

시에라리온 정부는 임신한 학생 수 천명의 등교를 금지하고 곧 있을 시험에도 응시하지 못하도록 했다. 국제앰네스티는 6일 발표한 보고서 <수치와 비난: 위험에 처한 시에라리온 임신부 여학생들의 인권>을 통해 이 같은 실태 밝히고 시에라리온 정부에 즉시 이 같은 금지 조치를 해제할 것을 촉구한다.

사브리나 마흐타니(Sabrina Mahtani) 국제앰네스티 서아프리카 조사관은 “학교에서 임신한 학생을 제외시키고 중요한 시험 응시를 금지하는 것은 차별이며, 충격적인 결과를 초래하게 될 것이다. 사람은 누구나 교육받을 권리가 있으며, 이는 정부가 처벌로써 임의로 박탈할 수 있는 것이 아니다”라며 “시에라리온이 끔찍한 에볼라 사태에서 벗어나고있는 시점에 이러한 학생들이 소외되지 않는 것이 무엇보다 중요하다”고 말했다.

이 같은 논란은 지난 4월 2일 교육과학기술부장관이 발표한 성명에서 시작되었다. 장관은 소위 ‘순결한 여학생’들을 부정적인 영향으로부터 보호하겠다는 명분으로 임신한 여학생이 ‘학교’에 드나드는 것을 금지하겠다고 발표했다. 또 임신 여부를 판단하는 신체검사를 강요하여 학생들은 수치스럽고 굴욕적인 경험을 해야했다. 일부 학생들의 경우 선생님들이 임신 여부를 ‘검사’한다며 가슴과 배를 만지기도 했다.

한 18세 소녀는 국제앰네스티에 시험 응시를 허락 받기 위해서 모든 여학생들이 선생님들로부터 검사를 받아야 했다고 말했다. 이 소녀는 “선생님들이 임신했는지 알아보려고 가슴과 배를 만졌다. 어떤 학생들은 소변 검사를 받아야 했다. 선생님 중에는 검사할 때 장갑을 낀 사람도 있었다. 내 차례가 되었을 때는 매우 창피한 기분이었다. 선생님들에게 임신 사실을 들킬까 봐 겁이 나서 도망간 학생들도 많았다. 임신한 여학생 약 12명은 시험을 치르지 못했다.”고 전했다.

이렇게 임신을 ‘검사’하는 관행은 정부 정책에 포함된 것이 아님에도 여기저기서 시행되고 있다. 국제앰네스티는 시에라리온 정부에 이처럼 여학생들에게 수치스럽고 굴욕적으로 대우하는 것을 즉시 금지할 것을 촉구한다.

2015년 10월 말, 아일랜드, 영국 등으로부터 2016년 7월까지 지원을 받아 임신부 여학생들을 위한 임시 대체 수업이 마련되었다. 정부는 3천 명 이상의 청소년 임신부들이 이러한 임시 수업을 신청했다고 주장하고 있으나, 정규 수업과는 다른 조건과 시간에 진행되며, 여전히 시험 응시는 금지하고 있다. 또한 지역 전문가들 역시 수업 선택의 폭이 좁은 것과, 주류 교육으로부터 지속적으로 제외시킴으로써 낙인 효과를 일으킬 수 있다는 점을 비판하고 있다.

국제앰네스티는 대체 수업의 질과 내용이 정규 수업과 동등해야 하며, 학교에 다니기를 원치 않는 학생들도 참여할 수 있게 할 것을 촉구한다.

국제앰네스티와 인터뷰를 가진 여학생 중에는 대체 제도를 지지한다는 학생들도 있는 반면, 친구들과 함께 같은 학교를 다니고 싶어하는 학생들도 있었다. 국제앰네스티는 정부와 공여국들에 정규 학교에 다니기를 원치 않는 학생들도 대체 수업에 참여할 수 있도록 할 것을 촉구한다.

지난해 에볼라 바이러스 사태로 시에라리온의 모든 학교는 감염률을 줄이기 위한 긴급 조치로 2014년 6월부터 2015년 4월까지 폐쇄되었다. 이 기간 동안 청소년 임신 비율이 증가했는데, 대부분 성폭력으로부터 여학생들을 보호하지 못하는 등의 인권침해로 인한 임신이었다. 격리 조치와 이미 한계에 이른 의료 시스템으로 인해 학생들은 원치 않는 조기 임신으로부터 스스로를 보호할 수 있도록 성과 재생산건강에 대한 지원이나 조언을 구하는 것이 불가능했다. 학교에서의 성교육은 제한적인 수준으로, 10년 전 내전이 끝나고 교육과정에서 삭제되었다.

사브리나 마흐타니 조사관은 “시에라리온에서 청소년 임신부는 비난과 수치의 대상이다. 이들은 삶에서 앞으로 나아갈 수 있고, 이른 시기에 임신했다고 해서 남은 인생까지 결정되는 것은 아님을 확인할 가장 중요한 기회를 박탈당하고 있다”며 “시에라리온이 에볼라 사태로부터 다시 일어서고 있는 가운데, 국제앰네스티가 만난 임신부 여학생들은 국가 재건을 돕고자 하는 소망을 피력했고, 많은 학생들이 지금 가장 절실히 필요한 간호사, 의사, 변호사가 되고 싶어했다. 이들을 주류 교육으로부터 제외시키는 관행이 뒤집히고, 시험 응시 금지 조치가 해제되지 않는 한 이 소녀들의 꿈은 이루어질 수 없을 것”이라고 말했다.

2014년 3월 시작되어 2015년까지 계속된 시에라리온의 에볼라 바이러스 사태는 전국민에게 남녀노소 가릴 것 없이 피해를 입혔고, 그렇지 않아도 약자인 어린 소녀들에게 특히 큰 영향을 미쳤다.

임신한 학생을 교육과정에서 제외시키고 시험 응시를 금지한 것은 에볼라 발병보다 앞서 이루어진 것이나, 학교 수업을 재개하는 날 이러한 금지 조치를 공식적으로 발표한 것은 또다른 논란과 시에라리온의 여러 문제에 대한 우려에 불을 붙였다. 시에라리온 인권위원회는 이러한 금지 조치가 차별이자 낙인 찍기이며, 이로 인해 임신부 소외가 더욱 악화될 가능성이 크다고 평가했다.

시에라리온 교육과학기술부는 에볼라 발병 이후 청소년 임신이 더욱 증가했다고 스스로도 인정한 바 있다. 금지 조치로 얼마나 많은 여학생들이 영향을 받게 될 것인지는 분명하지 않다. 공식 통계에 따르면 3천 명으로 예상되지만, 상황을 지켜보는 전문가들은 실제 청소년 임신부 수가 이보다 훨씬 높은 1만여 명일 것으로 추정하고 있다.

현재 모든 임산부 학생이 응시할 수 없는 주요 시험은 적어도 두 가지이다. 먼저 기초교육검정시험(BECE)은 고등학교나 직업학교 등의 고위 교육기관으로 진학하려는 학생이라면 누구나 통과해야 하는 시험이다. 두 번째는 서아프리카 고등학교 검정시험(WASSCE)으로, 영어, 수학, 과학, 예술은 물론 경제 등 상업 과목까지 포함한 다양한 과목에 대해 응시할 수 있다. 서아프리카 고등학교 검정시험은 대학에 진학하기 위해 반드시 필요함은 물론, 잠재적 고용주들에게도 중요한 시험이다.

Sierra Leone: Pregnant schoolgirls excluded from school and banned from exams

Thousands of pregnant girls, excluded from mainstream schools and barred from sitting upcoming exams, risk being left behind as Sierra Leone moves forward from the Ebola crisis, Amnesty International said in a report published today.

The report, Shamed and blamed: Pregnant girls’ rights at risk in Sierra Leone, reveals how the prohibition, confirmed by the government in April this year and sometimes enforced through humiliating physical checks, not only stigmatizes an estimated 10,000 girls but risks destroying their future life opportunities. With exams scheduled for 23 November, Amnesty International is calling on authorities to immediately lift the ban.

“Excluding pregnant girls from mainstream schools and banning them from sitting crucial exams is discriminatory and will have devastating consequences. Education is a right and not something for governments to arbitrarily take away as a punishment,” said Sabrina Mahtani, Amnesty International’s West Africa Researcher.

“As Sierra Leone moves forward from the devastating Ebola crisis, it is vital that these girls, are not left behind.”

On 2 April the Minister of Education, Science and Technology issued a statement banning pregnant girls from “school settings”. The justification given for this policy – namely to protect “innocent girls” from negative influences – only serves to reinforce stigma through language that blames and shames pregnant girls.

Amnesty International has documented how this ban has been enforced in some schools through humiliating and degrading treatment of girls. Girls have been subjected to degrading physical searches and tests. Some have had their breasts and stomachs felt by teachers to “test” for pregnancy. Others have been compelled by their school to take pregnancy tests.

Amnesty International interviewed 52 girls, some of whom said they felt scared at the possibility of being accused of being pregnant, while others described the feeling of humiliation at being physically assessed.

One 18 year-old girl told Amnesty International how all girls were checked by teachers before they were allowed to sit an exam:

“They touched our breasts and stomachs to see if we were pregnant. Some girls were made to take urine tests. One of the teachers was wearing gloves when she was checking us. I felt really embarrassed when this happened to me. Many girls left as they were scared the teachers would find out they are pregnant. About 12 pregnant girls did not sit their exams.”

Whilst the way in which girls are “tested” for pregnancy is not part of government policy, the practice is widely known. Amnesty International is calling on the government to issue urgent directives banning such humiliating and degrading treatment of girls.

In late October 2015 temporary alternative classes for pregnant school girls funded until July 2016 by donor countries, particularly Ireland and the UK, were introduced.

While the government claims that more than 3,000 pregnant schoolgirls have registered for this scheme, the classes are held in different premises or at different times to their peers and the girls are still banned from exams. It has also been criticized by local experts for its lack of choice and the stigmatizing effect of persistent exclusion from mainstream education.

Amnesty International urges that the attending of the alternative system, which should be of equal quality and content, be optional for those girls who do not wish to continue at mainstream school.

While some of the girls interviewed by Amnesty International said they support the alternative system, others wanted to attend school with their peers. Amnesty International has called on the government and the donors to make the alternative system optional for those girls who do not wish to continue at mainstream school.

As the Ebola crisis spread last year, schools in Sierra Leone were closed between June 2014 and April 2015 as part of emergency measures to reduce infection rates. During this period, there was an increase in adolescent pregnancy. Many of these pregnancies resulted from rights violations including failure to protect girls from sexual violence. Quarantines and an already overstretched healthcare system, meant that girls were not able to access sexual and reproductive health support or advice to protect themselves from early and unwanted pregnancies. Sex education in schools is limited and was removed from the curricula after the war over a decade ago.

In 2004, after the end of the civil war, the Truth and Reconciliation Commission recommended that the government stop the practice of excluding pregnant girls from education. The Commission called this practice “discriminatory and archaic”.

“Pregnant girls are being blamed and shamed in Sierra Leone. They are being denied key chances to move forward with their lives, and to ensure early pregnancy does not become the event that determines the rest of their lives,” said Sabrina Mahtani.

“As the country emerges from the Ebola crisis, pregnant girls we met expressed their desire to help build up their country. Many wanted to become much needed nurses, doctors or lawyers. Unless their exclusion from mainstream education is reversed and the ban from sitting exams is lifted these girls’ dreams will not be realized.”

Background

The Ebola crisis that struck Sierra Leone in March 2014 and continued throughout 2015 hit all parts of the country’s population, with already marginalized groups like girls particularly affected.

The exclusion of pregnant girls from mainstream education and from sitting exams pre-dates the outbreak of Ebola; however, the official declaration of the ban when schools re-opened has sparked renewed debate and concern about this issue in Sierra Leone. The Human Rights Commission of Sierra Leone described the ban as discriminatory, stigmatizing and likely to worsen the marginalization of pregnant girls and women.

The Ministry of Education, Science and Technology has itself recognized that there has been an increase in adolescent pregnancy during the Ebola outbreak. It is not clear how many girls are affected the ban. Official figures suggest three thousand, but experts mapping the situation indicate that the true figure is far higher, likely to be an estimated 10,000 pregnant girls.

There are at least two crucial exams that all visibly pregnant girls are currently unable to take. Firstly, there is the Basic Education Certificate Examination (BECE), which is the exam all students must pass to guarantee admission into senior secondary school or other higher level education centre, such as vocational schools. The second key set of exams are the West African Senior School Certificate Examination (WASSCE), which can be taken in a range of subjects including English, mathematics, sciences and arts, as well as economics and other commercial subjects. The WASSCE exams are necessary to get into university or college and are also important for potential employers.
