5일 대만에서 6명의 사형이 집행된 것은 정의실현과는 관계없는 퇴보적인 결정이라고 국제앰네스티가 밝혔다. 5일 저녁 대만의 4개 교도소에서 남성 6명이 총살형에 처해졌다. 모두 살인으로 사형을 선고받은 사람들이었다.

이들에 대한 사형집행은 지난주 타이페이에서 8세 소녀가 끔찍하게 살해된 사건으로 대중의 분노가 극에 달한 가운데 이루어진 것이었다.

윌리엄 니(William Nee) 국제앰네스티 조사관은 “죄 없는 여학생에게 벌어진 끔찍한 살인 사건에 분노하는 것은 매우 당연한 일이며 이처럼 극악무도한 범죄를 저지른 범인은 반드시 마땅한 처벌을 받아야 하지만, 사형이 그 답이 될 순 없다”며 “사형을 집행하기로 결정한 것은 분노한 대중을 달램으로써 좋은 점수를 얻으려는 정부의 정치적 계산이 엿보인다. 정부는 이날의 결정으로 정치적 리더십의 부재를 증명했다”고 말했다.

총살형에 처해진 6명의 남성은 타이페이 교도소의 청친언, 왕슈팡, 차오 티엔서우와 타이난 교도소의 왕춘친, 가오슝 교도소의 왕유렁, 타이중 교도소의 황추왕 등이다.

대만에서의 사형집행은 모두 비밀리에 진행되고 있으며, 사형수의 가족과 변호인들에게 사전에 고지하는 경우는 거의 없다.

지난 2014년, 대만은 5명에 대해 사형을 집행하고 1명에 대해 새로 사형을 선고했으며, 모두 살인으로 유죄가 선고된 사람들이었다.

대만은 2014년 사형을 집행한 단 22개국 중 하나로, 41개국이었던 20년 전 기록과 비교되는 수치다. 현재 총 140개국이 법적 또는 실질적 사형폐지국이다.

윌리엄 니 조사관은 “이번 사형집행 결정은 사형폐지를 장기적인 목표로 본다던 대만 정부의 발표와 완전히 상반되는 조치다. 정부는 정치적 도구로 사형집행을 이용하는 것을 중단하고, 사형폐지를 위한 첫걸음으로써 공식적으로 사형집행 유예를 선포해야 한다” 고 말했다.

사형이 다른 처벌에 비해 더욱 효과적이라는 설득력 있는 증거는 존재하지 않는다. 사형과 살인 발생률간의 상관관계에 대해 유엔이 포괄적인 연구를 진행한 결과, 사형이 종신형에 비해 범죄 억지력이 더욱 강하다는 과학적인 증거는 찾을 수 없었다.

국제앰네스티는 범죄의 성질 또는 정황, 개인의 유, 무죄 여부와 그 외 특성, 국가의 사형집행 방법에 관계없이 모든 경우에 대해 사형에 반대한다. 사형은 세계인권선언에 명시된 생명권을 침해하는 것이며, 극도로 잔인하고 비인도적이며 굴욕적인 처벌이다.

Taiwan: Six executed in politically motivated decision

The execution of six people in Taiwan today is a regressive decision that does not deliver justice, Amnesty International said.

The six men were executed by firing squad at four different prisons in Taiwan earlier this evening. All had been convicted of murder.

The executions were carried out amidst public outrage following the abhorrent murder of an eight year old girl in Taipei last week.

“The public outrage at the horrific murder of an innocent schoolgirl is totally understandable and the perpetrators of such heinous crimes must face justice, but the death penalty is never the answer,” said William Nee, researcher at Amnesty International.

“The decision to carry out the executions reeks of political calculations by a government attempting to gain points by quelling public anger. The government has today demonstrated a failure of political leadership.”

The six men executed by firing squad were: Cheng Chin-wen, Wang Hsiu-fang, and Tsao Tien-shou at a prison in Taipei; Wang Chun-chin at a prison in Tainan; Wang Yu-lung at a prison in Kaohsiung; and Huang Chu-wang in Taichung.

Executions in Taiwan are shrouded in secrecy, with the families and lawyers of those executed rarely informed in advance.

In 2014, Taiwan carried out five executions and imposed one new death sentence, all involving people convicted of murder.

Taiwan was one of only 22 countries to carry out executions in 2014, compared to 41 countries 20 years ago. A total of 140 states have now abolished the death penalty in law or practice.

“The executions fly in the face of the government’s stated long term goal to abolish the death penalty. The government must cease using executions as a political tool and should establish an official moratorium on executions as a first step towards abolition.”

There is no convincing evidence that the death penalty prevents crime more effectively than other punishments. A comprehensive study carried out by the United Nations on the relationship between the death penalty and homicide rates concluded that research has failed to provide scientific proof that executions have a greater deterrent effect than life imprisonment.

Amnesty International opposes the death penalty in all cases without exception, regardless of the nature or circumstances of the crime; guilt, innocence or other characteristics of the individual; or the method used by the state to carry out the execution. The death penalty violates the right to life as proclaimed in the Universal Declaration of Human Rights. It is the ultimate cruel, inhuman and degrading punishment.

2016년 7월 5일, ‘레소토타임즈’의 창립자 바실돈 페타는 ‘심문자(Scrutator)’로 알려진 풍자 칼럼을 신문에 게재한 이후 명예훼손 및 존엄성 침해(crimen injuria) 혐의로 기소되기도 했다. 이 칼럼은 레소토군의 틀라리 카몰리 중장의 영향력이 행사된 것으로 추측되는 점을 풍자했다.

Lesotho: Shooting of newspaper editor is a chilling attack on freedom of expression

Authorities in Lesotho must launch a prompt, independent and impartial investigation after the editor of the Lesotho Times Lloyd Mutungamiri was left in a critical condition in hospital after being attacked by unknown gunmen on 9 July 2016, Amnesty International said today.

The deplorable attack on the life of the Lesotho Times editor Lloyd Mutungamiri is also an attack on the right to freedom of expression.

The organization has urged authorities to bring those responsible to justice and ensure that journalists in Lesotho can work freely and without threats to their safety. Lloyd Mutungamiri was attacked upon arrival to his home at Ha Thamae, Maseru, where he sustained gunshot wounds. He is currently being treated at Queen Mamohato Memorial Hospital in Maseru.

“The deplorable attack on the life of the Lesotho Times editor Lloyd Mutungamiri is also an attack on the right to freedom of expression. Authorities must leave no stone unturned in getting to the bottom of this act and bring all those suspected of criminal responsibility to justice,” said Muleya Mwananyanda, Amnesty International’s Deputy Director for Southern Africa.

“His shooting is particularly disturbing because it comes amidst increased harassment and intimidation against the newspaper for its investigative journalism work.”

On 5 July 2016, the publisher of the newspaper Basildon Peta was charged with defamation and crimen injuria after the newspaper published a satirical column known as Scrutator. The column satirizedthe perceived influence of the LDF Lieutenant-General Tlali Kamoli.

Lloyd Mutungamiri’s shooting has left journalists in the Lesotho Times newsroom fearing for their lives. The authorities have failed to implement effective protection measures to ensure they can continue carrying out their job in a safe environment.

2012년 11월 21일 러시아의 엄격한 “외국기관”법이 실시된 지 4년째를 맞는 가운데, 그간 100개곳이 넘는 시민단체의 재정이 감소하고 평판이 손상됐으며 직원들은 위협을 당했다고 국제앰네스티가 밝혔다.

새로운 보고서 <’국민의 기관’: 러시아의 ‘외국기관’법 실시 후 4년>에서는 독립적이고 비판적인 비정부단체가 강제 폐쇄되고, 유익한 사회봉사 활동이 제한되고, 광범위한 영역의 정부 정책에 대한 정밀 조사가 차단되는 등, 표현의 자유에 대한 계획적인 공격에 해당하는 조치로 인해 러시아 사회가 큰 대가를 치렀다고 지적하고 있다.

올해 6월 통과된 개정안은 이 법에서 금지한 “정치적 활동”의 범위를 확장해, 사실상 공공 정책 또는 정부 관계자의 행동에 대한 모든 언급 형식을 포함시키는 역할만을 했을 뿐이다.

국제앰네스티는 “외국 기관”으로 분류된 비정부단체 10여개곳 이상의 사례를 검토하고, 이들 단체의 대표 및 직원들과 인터뷰를 진행했다. 이에 포함된 비정부단체는 차별, 여성인권 및 LGBTI 인권 보호, 역사적 기록 보존, 학술연구, 형사사법제도 및 교정제도 개혁, 소비자 권리, 환경 문제 등 광범위한 영역에서 활동하고 있었다. 단 하나 공통점은 이들 단체 모두가 정부 정책을 비판적으로 평가하는 데 사람들의 참여를 독려했다는 것이다.

러시아에서의 모금 활동은 언제나 제한적이지만, 러시아 매체에서 비정부단체를 공격적으로 악마화하면서 기금 마련은 더욱 어려워졌다. “외국기관”법은 비정부단체들이 유일한 대책으로 해외에서 모금을 하게 만들어, 불안정한 자금원으로 상당한 법적 위험과 신임도 하락을 감수하게 하는 효과를 일으켰다. 해외에서 모금을 하고 정치적으로 간주되는 활동에 관여한 비정부단체는 모두 이 법에 따라 법적 책임을 지게 된다.

이 법에서는 “동식물 생태계를 보호하기 위한 활동”은 “정치적”으로 간주해서는 안 된다고 명시했음에도, 최소 21곳 이상의 환경단체가 “외국 기관” 목록에 포함됐다.

러시아 니즈니노브로고드에 위치한 드론트 환경센터는 이 목록에서 제외해 줄 것을 요청했지만, 해외 자금을 받았다는 이유로 거절됐다. 근거로 인용된 모금원 세 가지는 벨로나 무르만스크에서 드론트 소식지 정기구독을 신청하며 지불한 500루블(8달러)과, 드론트가 “외국기관”으로 분류된 또 다른 환경단체인 젤레니미르(‘녹색 세계’)로부터 빌렸다가 조사 전 갚은 금액이었으며, 더욱 충격적인 점은 러시아 정교회에서 운영하는 재단인 소라보트니체스트보의 보조금도 포함되어 있었다는 것이다.

드론트의 아슈카트 카이우모프(Ashkat Kaiumov) 회장은 “알고 보니 [교회에] 키프로스로부터 일부 유입된 현금이 있었고, 이 때문에 법무부가 (법률에 엄격히 준거하여) 이 돈을 ‘해외’ 자본이라고 간주한 것이었다. 정말 이상하고 비현실적인 상황”이라고 밝혔다.

결국 2016년 2월 1일 30만 루블(약 4,800달러)의 벌금을 명령받은 드론트는 지도부의 결정으로 “외국 기관” 목록에서 제외될 때까지 활동을 임시적으로 유예했다. 그 전까지는 정부의 허가를 받지 않아도 되는 미등록 운동으로써 활동을 계속할 예정이다.

드론트의 사례가 단체의 목을 서서히 조르는 대표적인 예라면, 돈 여성협회가 공격당한 사례는 비정부단체에 대한 끈질긴 탄압을 잘 보여준다. 돈 여성협회는 2014년 “외국기관”법에 따라 러시아 법무부가 단체들을 해당 목록에 강제 포함시킬 수 있었던 당시 가장 먼저 표적이 된 단체 중 하나였다. 이에 대응해 활동가들은 활동을 계속하기 위해 돈 여성 재단이라는 새로운 단체를 설립했지만, 2015년 10월 이 역시 “외국기관”으로 공표됐다.

2016년 6월 24일 돈 여성재단의 대표 발렌티나 체레야텐코는 자신이 러시아 형법 330조 1항에 따라 “외국기관”법상 “책임을 고의로 회피”한 혐의로 형사 기소되었다는 통지를 받았다. 발렌티나에게 유죄가 선고될 경우 징역 2년형까지 처해질 수 있다.

국제앰네스티는 러시아 정부에 “외국기관”법을 폐지하고, 비정부단체의 활동에 대한 임의적인 제한을 해제할 것을 촉구한다.

세르게이 니키틴 국장은 “러시아 정부는 시민사회단체의 건설적인 비판을 받아들이고, 이들에게 적대하는 것이 아니라 함께 노력하는 법을 배울 수 있을 만큼 충분히 탄탄해야 한다. 그러기 위해서는 가장 먼저 ‘외국기관’법을 폐지하고, 그 외 비정부단체의 활동에 관한 임의적인 제한 조치를 해제해야 한다”고 말했다.

Russia: Four years of Putin’s ‘Foreign Agents’ law to shackle and silence NGOs

More than a hundred organizations have seen their funding shrink, their reputations tarnished, and their staff intimidated under Russia’s draconian “foreign agents” law, said Amnesty International ahead of the fourth anniversary of its coming into force on 21 November 2012.

A new report ‘Agents of the people’: Four years of “foreign agents” law’ in Russia highlights the high price Russian society has paid as independent critical non-governmental organizations have been forced to close, valuable services have been restricted and scrutiny of government policy in a wide range of areas has been silenced in what amounts to a calculated assault on freedom of expression.

“The foreign agents law was designed to shackle, stigmatise, and ultimately silence critical NGOs. It has caught a wide range of NGOs in its net and come at considerable cost to individual rights and the quality of civic discussion in Russia. The ultimate losers are not just NGOs but Russian society,” said Sergei Nikitin, Director of Amnesty International Russia.

In the last four years, 148 organizations have been included on the list of “foreign agents”, of which 27 have closed down altogether. These NGOs have performed important roles in protecting the rights of ordinary people. In many cases they provided services that the state has failed to provide, such as legal representation or psychological support for victims of discrimination or violence and environmental monitoring.

These vital contributions to the wellbeing of people in Russia are now either blocked or under threat because the NGOs risk being – or have already been – considered to engage in “political activity” and labelled “foreign agents” under the 2012 law.

Amendments to the law passed in June this year have served only to extend the extraordinary breadth of proscribed “political activity”, to include virtually any form of commentary on public policy or the actions of public officials.

Amnesty International examined cases of more than a dozen NGOs listed as “foreign agents” and conducted interviews with their leadership and staff. They include organizations working on a wide range of issues including: discrimination, the protection of women’s and LGBTI rights, the preservation of historical memory, academic research, criminal justice and prison system reform, consumers’ rights, and environmental issues. The one common theme is that all the organizations sought to engage people in the critical evaluation of government policy.

While funding in Russia was always limited, accessing it has become even harder in the wake of the aggressive demonising of NGOs in the Russian media. The effect of the “foreign agents” law has been to make funding from abroad – the only alternative available to NGOs – an insecure source of funds that brings considerable reputational and legal risk. Any NGO which has foreign funding and engages in what is deemed to be political activity is liable to fall foul of that law.

While the law clearly says that “activities to protect the plant and animal world” should not be considered “political”, at least 21 environmental organizations have been included on the “foreign agents” register.

When environmental centre Dront based in Nizhnii Novgorod (Central Russia) applied to be taken off the list, their request was refused on the grounds that they had received foreign funding. The three sources of funding cited were: 500 roubles ($8) from Bellona-Murmansk to subscribe to Dront’s newspaper, Bereginja; a loan from another environmental NGO listed as a “foreign agent”, Zelenyi Mir (Green World), which was repaid by Dront before the inspection; and, even more surprisingly, a grant from Sorabotnichestvo, a foundation run by the Russian Orthodox Church.

“It turned out, [the Church] gets some cash inflow from Cyprus and that’s why our regional Ministry of Justice (in strict conformity with the law, mind you) counted this money as ‘foreign’. It is a strange, surreal situation,” said Dront’s Chair Ashkat Kaiumov.

After Dront was ordered to pay a 300,000 rouble fine (around $4,800) on 1 February 2016 the organization’s leadership decided to temporarily suspend its activities until it is removed from the “foreign agents” list. Meanwhile it will continue working as an unregistered public movement which does not need official sanction.

If the Dront case exemplifies the slow strangulation of an organization, the attack on the Union of the Don Women showcases the persistent persecution of an NGO. It was one of the first organizations to fall under the “foreign agents” law in 2014, when the Ministry of Justice was given powers to compulsorily include organizations into its list. As a response, the activists, set up a new organization, the Foundation of the Don Women, to carry on the work. However in October 2015 this too was declared a “foreign agent”.

On 24 June 2016 its head Valentina Cherevatenko was informed that a criminal case under Article 330.1 of the Russian Criminal Code had been opened against her for “willfully evading responsibilities” under the “foreign agents” law. If found guilty, Valentina could face up to two years in jail

Amnesty International calls on the Russian authorities to repeal the “foreign agents” law and lift arbitrary restrictions on NGOs’ work.

“The Russian authorities should be robust enough to accept constructive criticism from civil society groups and learn to work with them – not against them. The first step on this way is to repeal the ‘foreign agents’ law and lift other arbitrary restrictions on NGOs’ work,” said Sergei Nikitin.

Attacks against journalists Pakistan

파키스탄 정부는 반정부 활동가 수백여 명을 즉시, 조건 없이 석방시키고, 이들에 대한 이동의 자유 제한을 해제하고, 모든 사람이 평화적인 집회의 자유를 행사하도록 보장하기 위해 필요한 모든 조치를 취해야 한다고 국제앰네스티가 밝혔다.

국제앰네스티는 파키스탄 정부가 야당 지도자 임란 칸(Imran Khan)과 그가 속한 테흐리크 에 인사프(Tehreek-e-Insaf) 당의 지지자들에게 불필요하고 과도한 무력을 사용하는 등 진압 강도를 더욱 높인 것에 우려하며 이 같은 요구를 발표했다. 파키스탄 경찰은 시위대를 향해 최루가스와 고무탄을 발사했고, 무차별적인 임의 체포를 대규모로 강행해 수백 명을 구금했다.

국제앰네스티가 입수한 신뢰성 있는 정보에 따르면 이들 수백 명은 파키스탄 형법 144항에 따라 체포되었다. 이 법은 식민 시대 제정된 것으로 4인 이상 모이는 것을 금지하는 가혹한 조항이자, 표현의 자유와 평화적인 집회의 자유를 부당하게 억압하고 있다.

야당 지도자 임란 칸이 속한 테흐리크 에 인사프 당 의원 및 당원들은 현 나와즈 샤리프(Nawaz Sharif) 총리 정권에 반대하는 시위를 벌이기 위해 이슬라마바드(Islamabad)로 향하던 도중 체포됐다.

또한 국제앰네스티는 기자들이 호의적인 보도를 요구하는 시위대로부터 위협을 당하거나 협박을 받고 있다는 정보에 대해서도 우려를 표한다.

참파 파텔 국장은 “기자와 인권옹호자는 시위 과정에서 중요한 역할을 수행한다. 시위를 보도하는 모든 언론인들은 자유롭게, 공격 또는 위협을 받을 우려 없이 자신의 역할을 할 수 있어야 한다”고 말했다.

엘살바도르 법원이 아이를 유산했다는 이유로 4년간 교도소에 수감됐던 여성을 석방하라고 판결한 것은 인권의 위대한 승리라고 국제앰네스티가 밝혔다.

마리아 테레사 리베라(33)는 아이를 유산하고 “고의 살인” 혐의로 징역 40년형이 선고되어 지난 2011년 교도소에 수감됐다.

에리카 게바라 로사스(Erika Guevara-Rosas) 국제앰네스티 미주국장은 “마리아 테레사의 석방으로 여성을 그저 2등 시민으로만 대우하는 국가인 엘살바도르에서 정의를 향한 진전이 또 한 걸음 이루어지게 됐다”며 “마리아 테레사는 단 1초라도 감방에 있어서는 안 될 사람이었다. 여성 수천 명의 목숨을 위험으로 몰아넣을 뿐인 터무니없는 낙태금지법 때문에 지금도 수많은 여성들이 교도소에 수감되어 있는 엘살바도르에서 이번 석방이 변화의 기폭제가 되어야 할 것”이라고 말했다.

마리아 테레사는 자택 화장실에서 거의 의식을 잃은 상태로 피를 심하게 흘리고 있는 모습을 시어머니가 발견하고 병원으로 옮겨졌다가 병원에서 체포되었다. 마리아 테레사가 낙태를 한 것으로 의심한 병원 직원이 경찰에 신고한 것이었다.

재판 과정에서 마리아 테레사의 직장 상사는 마리아 테레사가 2011년 1월에 임신한 사실을 알고 있었다며 불리한 증언을 했다. 이 증언대로라면 유산이 일어날 당시 임신 11개월이었다는 말이 된다. 이처럼 터무니없는 증언도 마리아 테레사의 유죄를 입증하는 증거로 사용됐다.

결국 법원이 혐의를 입증할 증거가 충분하지 않다고 판결하면서 20일 마리아 테레사의 석방이 결정됐다.

1998년 개정된 형법에 따라 엘살바도르에서는 모든 경우에 대해 낙태를 금지하고 있다. 강간, 근친상간으로 인한 임신이거나 산모의 생명이 위험한 상황이라도 마찬가지다. 이로 인해 여성들은 부당한 기소를 당하고, 오용된 형법에 따라 즉시 유죄로 몰리게 되었다. 특히 경제적 여유가 거의 없는 여성들이 낙태금지법에 큰 영향을 받았다.

A court’s decision today to release a woman who spent four years in jail in El Salvador for miscarrying her pregnancy is a great victory for human rights, said Amnesty International.

María Teresa Rivera, 33, was jailed in 2011 and sentenced to 40 years in prison for “aggravated homicide” after having a miscarriage.

“The release of María Teresa is yet another step towards justice in a country where women are treated as mere second class citizens,” said Erika Guevara-Rosas, Americas Director at Amnesty International.

“She should have never been forced to spend one second behind bars. Her release must be a catalyst for change in El Salvador, where dozens of women are put in prison because of an utterly ridiculous anti-abortion law which does nothing but put the lives of thousands of women and girls in danger.”

María Teresa was arrested in a hospital after her mother-in-law found her in her bathroom almost unconscious and bleeding heavily. Staff at the hospital reported her to the police and accused her of having an abortion.

During the trial, one of Maria Teresa’s bosses testified against her saying she knew she was pregnant in January 2011. This would have made her 11 months pregnant by the time the miscarriage took place. The outrageous testimony was used as one of the pieces of evidence to convict her.

The release today came after a judge ruled there was not enough evidence to prove the charges against her.

Following a change in the Penal Code in 1998, abortion in El Salvador has been banned in all circumstances – even when the pregnancy is the result of rape, incest or when the life of the woman is at risk. The change in the law has led to wrongful prosecutions and misapplication of criminal law where women are immediately assumed guilty. Women with few economic resources are particularly affected by the ban.

연대는 분열보다 항상 더 강력하다.

그러나 분열은 세계 각지에서 힘을 받는 것처럼 보인다. 국경의 벽은 더욱 높아지고, 안팎에서 혐오와 공포가 치솟고 있으며, 억압적인 법률은 기본적인 자유를 옥죄고 있다.

미국 대통령 선거 결과는 이 같은 경향을 고스란히 보여주어 전 세계를 충격에 빠뜨렸다. 선거운동 과정에서 여성혐오와 외국인 혐오를 계속 드러냈던 도널드 트럼프가 차기 미국 대통령으로 선출된 것이다.

선거 이후 사람들은 이 사실을 받아들여 가고 있지만, 이러한 결과가 어떤 영향을 미치게 될지 아직도 충분히 납득되지 못한 상태다.

최강대국으로 꼽히는 나라의 대통령 당선인이 혐오와 기본권 보호 거부를 내세운다는 것은 특히 많은 국가에서 달갑지 않은 대우를 받으며 궁지에 몰려있는 인권활동가들에게 더욱 큰 좌절로 다가왔다.

인권 운동은 자신의 권리가 박탈당한다며 지역사회 및 국가 안에서 (주로 가장 취약한 계층의) 타인에게 폭언을 내뱉는 방식으로 정치적 의견을 표출하는 사람들과 합의점을 찾아야 한다. 이들의 두려움과 걱정은 대부분 타당한 것으로, 지도자들은 모든 사람에게 인권과 평등, 존엄을 보장하는 정책을 통해 이 같은 우려와 폭력에 대응해야 한다.

트럼프 당선인은 “보통 사람과 기득권층의 대결”이라는 프레임으로 가져갔음에도, 세계 각지의 많은 사람들은 그의 선거운동을 보며 경악을 금치 못했다. 결국 결과는 사회의 공포와 분노를 고스란히 반영한 것이었다.

이러한 현상은 과거에도 여러 차례 있었다. 우리는 분열을 조장하는 발언이 결국 추한 길로 빠지는 모습을 지켜본 바 있다. 반대 의견을 말하는 것은 범죄로 몰렸고, 사회적 약자들은 악랄한 괴롭힘과 차별, 폭력을 견뎌야 했다.

오바마 대통령의 발언은 실제 본인의 정책 결정의 현실을 훨씬 뛰어넘어, 나라 안팎에서 계속되며 악화되기까지 하는 미국의 인권침해를 감추는 경우가 많았다. 사우디아라비아로 수출된 무기가 예멘에서 중대하고도 제도적인 인권침해를 저지르는 데 사용되고 있다는 증거가 있음에도 무기 수출을 더욱 증가시킨 점과, 미 중앙정보국(CIA)의 드론 공격 활동이 거의 무책임한 수준으로 이루어지고 있음에도 이를 더욱 확대한 점이 그렇다.

트럼프 대통령 당선인의 국제관계 전략이 위태로운 상태인 전 세계 인권 상황에 어떤 영향을 미칠지는 아직 알 수 없으나, 그가 선거운동 중에 했던 유해한 발언들이 정책에도 적용된다면 이로 인한 영향은 중대하고도 광범위할 것이다.

대테러 정책과 국가 안보에 관한 트럼프의 발언은 매우 위험했다. 그의 선거 공약을 기반으로 판단할 때, 트럼프 정부는 고문 금지와 같이 이미 확립된 규범에 대한 미국의 입장을 약화시킬 가능성이 높다. 한편으로는 오바마 정부에서 드러났던 무분별한 불법 대규모 감시 프로그램과 같은 현재의 문제점을 지속시키거나, 더욱 확대시킬 위험도 있다.

트럼프의 정책결정이 그간의 성차별주의적 발언과 일치한다면 여성인권에 있어서는 끔찍한 소식이 될 것이며, 그가 지지했던 외국인혐오와 인종차별은 향후 이주민과 소수민족의 처우에 악영향을 미칠 것이다. 미국 내 난민 재정착이 퇴보하면, 이미 세계 난민의 압도적 다수를 수용하고 있는 가난한 국가들이 더 큰 압박을 받게 될 것이다.

트럼프의 반 무슬림적 발언은 혐오 선동자들을 기세등등하게 하고 미국 안팎에서 공격과 차별을 더욱 부추길 위험이 있다. 이로 인해 많은 소수종교인들에게도 매우 해로운 영향을 줄 것이고, 이러한 분열을 자신들의 목적을 위해 이용하는 무장단체들에게는 신병 모집 수단이 될 수도 있다.

또한, 미국이 세계 인권 제도와 거리를 둘 가능성이 커지면서, 이로 인해 미국 국민도 함께 보호하고 있는 중요한 국제법적 안전조치가 더욱 약화될 수 있다.

절망적인 전망이다.

그러나 미래가 반드시 이렇게 되리라는 법은 없다. 세계 각지에서의 활동을 통해, 우리는 아무리 큰 역경을 마주하더라도 함께 모여 대화하고, 인권에 기반한 긍정적인 변화를 일으키기 위해 나서는 모습을 지켜봤다.

공포와 혐오만이 승리하라는 법은 없다. 오히려 변화의 기폭제가 될 수 있다. 미국과 전 세계 대다수가 모든 사람의 평등과 존엄, 자유를 지지하고 있다는 점은 큰 용기가 된다. 인권의 기저를 이루는 이러한 핵심 가치들은 포기하기에는 너무나 소중하고, 당연히 여기기에는 그 보호가 너무나 취약하다.

당장 혐오와 공포를 멈추는 것이 쉽지는 않을 것이다. 그러나 양심과 인권이 강력한 동기가 된다는 것은 과거에 이미 증명되었다. 위대한 시민권 운동가인 마틴 루터 킹 목사가 “도덕적 우주의 활은 길지만, 그 끝은 정의를 향해 구부러져 있다”고 말했듯이 말이다.

엄청난 역경을 마주하면서도 결연히 투쟁해 온 인권 활동은 수십 년 동안 비약적인 성과를 이뤘다. 이 싸움을 계속해 나가야 한다. 자유와 인권을 깊이 걱정하는 사람들에게, 이제는 분열을 봉합할 타협점을 찾는 것이 현 시대를 대표하는 도전 과제일 것이다.

Rising above division – defending global human rights in the Trump era

That which unites us is always greater than that which divides us.

Yet, around the world, the forces of division seem to be gathering momentum. Walls rising up along borders, hatred and fear welling up within and between populations, repressive laws assailing basic freedoms.

The US election results, the latest development in this deeply troubling trend, caused global shockwaves. After campaigning with a constant refrain of misogyny and xenophobia, Donald J. Trump will be the next US President.

Since the election, the world has been coming to terms with this fact, though its implications have yet to be fathomed fully.

For human rights activists in particular, who already find themselves embattled and “undesirable” in many countries, it raises the stakes immensely that the President-elect of one of the world’s most powerful nations put forward a political platform that championed hate, threatening to disavow many basic human rights protections.

It also drives home the message that the global human rights movement needs to seek common ground with those who feel so disenfranchised that they find political expression by lashing out against others – often the most vulnerable – in their communities and countries. Many of their fears and concerns have valid roots and leaders can help to allay those concerns by responding with policies that ensure human rights, equality and dignity for all, rather than seeking to divide.

Watched with horror by many around the world, the Trump campaign was framed as “people vs. establishment”, but it became an echo chamber for a society’s fear and anger.

The world has been there many times before. We have seen how divisive rhetoric leads down an ugly road – dissenting voices are criminalized and those who are disadvantaged bear the brunt of vicious harassment, discrimination and violence.

President Obama’s rhetoric often soared way above the reality of his policymaking, and masked continuing and sometimes worsening human rights violations by the USA, both home and abroad. They included increasing the arms sale to Saudi Arabia, despite evidence that such arms have been used to commit gross and systematic human rights violations in Yemen, and an expansion of the CIA’s almost totally unaccountable campaign of drone strikes.

We do not yet know how President-elect Trump’s own brand of international relations will affect the already precarious situation of human rights globally, but, if his poisonous rhetoric in the campaign translates into policy, the implications will be grave and far-reaching.

Trump’s triumph will undoubtedly embolden leaders around the world who rely on fear-mongering, whether they are already in power or running for office.

On counter-terrorism and national security, Trump’s rhetoric has been very dangerous. If his campaign promises are anything to go by, his administration seems likely to weaken the US stance on established norms, such as the prohibition on torture. Meanwhile it threatens to continue or expand current overreaches, such as the sprawling, illegal mass surveillance programmes which came to light under the Obama administration.

If Trump’s policy choices match his sexist statements, it will be terrible news for women’s rights, and the xenophobia and racism he has espoused portend very badly for the treatment of migrants and minorities. We can expect a rollback on refugee resettlement into the USA, increasing the pressure on poor countries who already host the overwhelming majority of the world’s refugees.

His anti-Muslim rhetoric risks emboldening hatemongers and fuelling attacks and discrimination, both in the USA and beyond. This could have a deeply damaging ripple effect on members of many religious minorities. It could also serve as a recruitment tool for armed groups that exploit such divisions for their own purposes.

And a likely US retreat from the global human rights system could further weaken crucial international safeguards that also protect people in the USA.

It is a bleak outlook.

But the future does not have to be like this. In our work around the world, we have seen how even people facing great adversity can come together, dialogue, and mobilize to bring about positive change rooted in human rights.

Fear and hate do not have to win the day – they can be a catalyst for change. And it is heartening that the majority of people in the USA and around the world support equality, dignity, freedom for all people – the core values underpinning human rights. Those values are far too precious to discard; their protection far too fragile to take for granted.

Stopping hate and fear in their tracks will not be easy. But the guiding principles of conscience and human rights have proven to be powerful motivators in the past. As the great civil rights leader, the Rev. Martin Luther King, Jr., said: “The arc of the moral universe is long, but it bends towards justice.”

Thanks to the determined struggle of human rights activism through the decades has made leaps forward, often in the face of great adversity. We need to keep up the fight. For those of us who care deeply about freedom and human rights, seeking common ground that heals the divisions is now the defining challenge of our time.
