5일 대만에서 6명의 사형이 집행된 것은 정의실현과는 관계없는 퇴보적인 결정이라고 국제앰네스티가 밝혔다. 5일 저녁 대만의 4개 교도소에서 남성 6명이 총살형에 처해졌다. 모두 살인으로 사형을 선고받은 사람들이었다.

이들에 대한 사형집행은 지난주 타이페이에서 8세 소녀가 끔찍하게 살해된 사건으로 대중의 분노가 극에 달한 가운데 이루어진 것이었다.

윌리엄 니(William Nee) 국제앰네스티 조사관은 “죄 없는 여학생에게 벌어진 끔찍한 살인 사건에 분노하는 것은 매우 당연한 일이며 이처럼 극악무도한 범죄를 저지른 범인은 반드시 마땅한 처벌을 받아야 하지만, 사형이 그 답이 될 순 없다”며 “사형을 집행하기로 결정한 것은 분노한 대중을 달램으로써 좋은 점수를 얻으려는 정부의 정치적 계산이 엿보인다. 정부는 이날의 결정으로 정치적 리더십의 부재를 증명했다”고 말했다.

총살형에 처해진 6명의 남성은 타이페이 교도소의 청친언, 왕슈팡, 차오 티엔서우와 타이난 교도소의 왕춘친, 가오슝 교도소의 왕유렁, 타이중 교도소의 황추왕 등이다.

대만에서의 사형집행은 모두 비밀리에 진행되고 있으며, 사형수의 가족과 변호인들에게 사전에 고지하는 경우는 거의 없다.

지난 2014년, 대만은 5명에 대해 사형을 집행하고 1명에 대해 새로 사형을 선고했으며, 모두 살인으로 유죄가 선고된 사람들이었다.

대만은 2014년 사형을 집행한 단 22개국 중 하나로, 41개국이었던 20년 전 기록과 비교되는 수치다. 현재 총 140개국이 법적 또는 실질적 사형폐지국이다.

윌리엄 니 조사관은 “이번 사형집행 결정은 사형폐지를 장기적인 목표로 본다던 대만 정부의 발표와 완전히 상반되는 조치다. 정부는 정치적 도구로 사형집행을 이용하는 것을 중단하고, 사형폐지를 위한 첫걸음으로써 공식적으로 사형집행 유예를 선포해야 한다” 고 말했다.

사형이 다른 처벌에 비해 더욱 효과적이라는 설득력 있는 증거는 존재하지 않는다. 사형과 살인 발생률간의 상관관계에 대해 유엔이 포괄적인 연구를 진행한 결과, 사형이 종신형에 비해 범죄 억지력이 더욱 강하다는 과학적인 증거는 찾을 수 없었다.

국제앰네스티는 범죄의 성질 또는 정황, 개인의 유, 무죄 여부와 그 외 특성, 국가의 사형집행 방법에 관계없이 모든 경우에 대해 사형에 반대한다. 사형은 세계인권선언에 명시된 생명권을 침해하는 것이며, 극도로 잔인하고 비인도적이며 굴욕적인 처벌이다.

Taiwan: Six executed in politically motivated decision

The execution of six people in Taiwan today is a regressive decision that does not deliver justice, Amnesty International said.

The six men were executed by firing squad at four different prisons in Taiwan earlier this evening. All had been convicted of murder.

The executions were carried out amidst public outrage following the abhorrent murder of an eight year old girl in Taipei last week.

“The public outrage at the horrific murder of an innocent schoolgirl is totally understandable and the perpetrators of such heinous crimes must face justice, but the death penalty is never the answer,” said William Nee, researcher at Amnesty International.

“The decision to carry out the executions reeks of political calculations by a government attempting to gain points by quelling public anger. The government has today demonstrated a failure of political leadership.”

The six men executed by firing squad were: Cheng Chin-wen, Wang Hsiu-fang, and Tsao Tien-shou at a prison in Taipei; Wang Chun-chin at a prison in Tainan; Wang Yu-lung at a prison in Kaohsiung; and Huang Chu-wang in Taichung.

Executions in Taiwan are shrouded in secrecy, with the families and lawyers of those executed rarely informed in advance.

In 2014, Taiwan carried out five executions and imposed one new death sentence, all involving people convicted of murder.

Taiwan was one of only 22 countries to carry out executions in 2014, compared to 41 countries 20 years ago. A total of 140 states have now abolished the death penalty in law or practice.

“The executions fly in the face of the government’s stated long term goal to abolish the death penalty. The government must cease using executions as a political tool and should establish an official moratorium on executions as a first step towards abolition.”

There is no convincing evidence that the death penalty prevents crime more effectively than other punishments. A comprehensive study carried out by the United Nations on the relationship between the death penalty and homicide rates concluded that research has failed to provide scientific proof that executions have a greater deterrent effect than life imprisonment.

Amnesty International opposes the death penalty in all cases without exception, regardless of the nature or circumstances of the crime; guilt, innocence or other characteristics of the individual; or the method used by the state to carry out the execution. The death penalty violates the right to life as proclaimed in the Universal Declaration of Human Rights. It is the ultimate cruel, inhuman and degrading punishment.

태국의 수도 방콕과 동북부의 도시 콘카엔에서 학생들과 반쿠데타 활동가들을 임의로 구금한 사건이 22일에만 최소 3건 벌어진 것은, 군부 쿠데타 발발 1년째에 접어들고 있지만 평화적인 반대 시위조차 용인되지 않는 냉혹한 현실을 보여주는 것이라고 국제앰네스티가 22일 밝혔다.

리처드 베넷(Richard Bennett) 국제앰네스티 아시아태평양국장은 “태국 군부정권이 들어선 지 1년이 되었지만 여전히 거리에서는 평화적인 시위가 강경 진압되고 있다”며 “평화적 시위대는 군사정부가 불편하게 여기는 주제에 의문을 제기하거나 정부에 맞섰다는 이유만으로 임의로 체포 또는 구금되어서는 안 된다. 표현의 자유라는 인권을 평화적으로 행사했다는 이유만으로 구금된 사람들은 누구나 즉시 무조건적으로 석방되어야 하며, 모든 혐의는 취소되어야 한다”고 말했다.

또한 “정부는 평화적인 반대 시위자들을 존중은 물론 보호해야 하며, 태국에서의 표현과 집회의 자유를 제한하는 엄격한 법과 관행을 완화해야 한다”고 말했다.

현지시간으로 22일 오후 6시 20분경, 태국 경찰은 방콕 예술문화센터에서 2014년 군부 쿠데타를 반대하는 평화적, 상징적인 시위를 개최하려던 학생과 활동가 20명을 구금했다. 경찰은 상부의 지시를 기다리고 있는 중이라며 이들의 변호사 접견을 허용하지 않았다. 최소 2명 이상의 활동가들이 체포 과정에서 부상을 입어 치료가 필요한 상태인 것으로 알려졌다.

또한 같은 날 오후 3시, 군과 경찰은 방콕의 한 전철역에서 학생과 민주주의 활동가, 택시 운전사를 차례로 체포했다. 이들은 방콕 경찰서에 구금되어 있다가 곧 풀려났다.

세 사람은 모두 시민단체 ‘저항시민’ 소속으로, 현 태국 총리인 프라윳 찬-오차 장군에 대해 지난해 쿠데타를 일으킨 혐의로 방콕의 형사법원에 형사고발을 하러 가던 중이었다. 이 시민단체는 쿠데타 1주년을 맞기 수 일 전부터 이러한 계획을 공개적으로 밝혔던 바 있다. 그 외에 대학생인 시라윗 세리시왓, 2010년 당시 시위 강경진압으로 아들이 정부군에 목숨을 잃었던 판삭 스리셉, 그리고 택시 운전사인 와나키엣 추수완 등 저항시민 소속의 다른 회원들 역시 평화적 반쿠데타 시위를 준비하다 구금되었다.

세 번째 사건으로, 태국 북동부 콘카엔의 민주주의 기념비에서 오후 1시경 시위대 7명이 쿠데타와 채굴 개발 사업으로 인한 교외 지역의 강제퇴거에 반대하며 평화적인 시위를 벌였다가 최소 7명이 체포되었다. 이들은 모두 학생단체 다오딘(Dao Din)의 회원으로, 지난 2014년 11월 콘카엔에서 프라윳 총리의 연설 도중 영화 ‘헝거 게임’에 등장하는 세 손가락 경례를 했다가 체포된 학생들도 이 단체 소속인 것으로 알려졌다.

뉴스로 보도된 화면에서는 활동가들이 체포되기 전 사복 경찰들이 22일 시위를 해산시키는 장면이 담겼다. 다오딘 소속 활동가들은 체포된 후 군부대로 이송됐다가 현재는 콘카엔의 한 경찰서에 구금되어 있다.

리처드 베넷 국장은 “이날의 사건들은 계속되는 태국 정부의 반대세력 탄압의 연장선상일 뿐이다. 현재 태국에서는 정치적 활동에 참여할 경우 징역에 처해질 수도 있는 상황이다. 정부는 안보라는 이름으로 인권을 인정하지 않고 억압하기 위해 스스로의 초월적 권한을 용인하고 있다. 지금이야말로 사람들이 반대의견을 평화적으로 표현할 수 있도록 허용해야 할 때”라고 말했다.

The arbitrary arrests of students and anti-coup activists in at least three separate incidents today in Thailand’s capital Bangkok and the north-eastern city of Khon Kaen come as a stark reminder of the ongoing intolerance of peaceful dissent a year into military rule, Amnesty International said today.

“A full year since the Thai military declared martial law and took power, we are seeing how peaceful dissent is still being steamrolled in the streets,” said Richard Bennett, Asia-Pacific Programme Director at Amnesty International.

“Peaceful protesters must not be arbitrarily arrested or detained just because they raise uncomfortable topics or defy military rule. Anyone held merely for peacefully exercising their human right to freedom of expression must be released immediately and unconditionally and all charges dropped.

“The authorities must respect and even protect peaceful dissent and lift draconian restrictions on expression and assembly in Thailand – in law and practice.”

At around 6:20 pm local time, police detained 20 students and activists in Bangkok, who were about to carry out a peaceful, symbolic protest against the 2014 coup at the Bangkok Art and Culture Centre, one of the first sites of spontaneous anti-coup protests last year. Police have denied the group access to lawyers, stating that they are awaiting orders from senior officers. At least two activists are reported to have sustained injuries during the arrest and require medical attention.

In a separate incident in Bangkok at 3 pm today, soldiers and police arrested a student, a pro-democracy activist and a taxi driver at a metro station. They were held at a Bangkok police station and later released.

All three belong to Resistant Citizen, a political protest group, and were on their way to file a criminal complaint at the capital’s criminal court against General Prayuth Chan-ocha, the current Prime Minister, for staging last year’s coup. The group had made their plans public in days preceding the anniversary of the coup. Other members of the group have been detained before for peaceful acts of symbolic protest in the country – including university student Sirawit Serithiwat, Pansak Srithep, whose son was killed by the army during the crackdown on protests in 2010, and taxi driver Wannakiet Chusuwan.

In a third incident, at least seven people were arrested in Khon Kaen, north-eastern Thailand, at the city’s Democracy Monument at around 1 pm, after seven protesters staged a peaceful protest against the coup and forcible evictions of rural communities in extractive and developmental projects. The protesters all belong to Dao Din, a student activist group, and are believed to include members previously arrested for flashing the three-finger “Hunger Games” salute during a speech by General Prayuth in Khon Kaen in November 2014.

News footage shows plainclothes officers breaking up today’s protest before the activists’ arrest. The Dao Din activists were first taken to a military camp and are now being held at a police station in Khon Kaen.

These are just the latest episodes in the Thai authorities’ continuing repression of public dissent in the country, where many people face imprisonment if they engage in political activities. Authorities have granted themselves extensive powers to restrict and deny rights in the name of security – it is high time that they allowed people to peacefully exercise their rights to dissent.

쯔위 덕 본 차이잉원 "대처 존경한다"?

차이잉원 총통에 대한 기대와 우려

2016년 1월 16일, 대만에서 최초의 여성 총통(차이잉원)이 선출되었다. 대만 야당인 민진당(DPP)이 의회 과반수를 차지한 것도 처음이었다. 도대체 어떻게 이런 일이 일어났을까? 새 정부에 대해 대만 시민사회가 갖는 기대와 우려는 무엇일까?

 

'해바라기' 운동과 시민사회의 분노

지난 2014년 3월 17일, 대만 입법원 내정위원회에서 국민당 장칭중(張慶忠) 입법의원이 '양안서비스무역협정(Cross-Strait Service Trade Agreement)'를 30초 만에 국회에서 통과시키자 많은 사람들이 국회의 불투명한 절차에 대해 분노하였다. 그리고 이는 3월 18일부터 4월 10일까지 약 24일간 국회 입법원을 점거한 '해바라기' 운동으로 이어졌다.  

많은 사람들은 '대의 정치'가 이미 손쓸 수 없는 지경에 이르렀고 사람들의 의견을 대표하지 못한다는 사실을 깨달았다. 양안서비스무역협정 문제만이 아니라 핵발전소 설립, 핵폐기물 이슈, 노동자 해고, 강제철거 등 많은 사회적 이슈들이 사람들의 분노를 불러일으켰다. 

 

현재 대만의 대부분의 입법안들은 인권적 관점은 배제한 채, 주요 양당의 이익을 바탕으로 논의되고 있다. 거대 정당이나 전통적인 지역 파벌에 의해 인적, 물적 네트워크들이 장악되었다. 그렇기 때문에 사람들은 선택의 여지가 없거나 최악은 아닌 후보자들을 선택할 수밖에 없다. 또한 시대에 맞지 않는 헌법 조항으로 인해 18-20세 사이 청년들은 투표권한이 없다.  

 

'해바라기' 운동 이후, 점점 더 많은 청년들은 시대역량(New Power Party), 사회민주당(Social Democratic Party), 자유대만당(Liberal Taiwan Party), 녹색당(Green Party)등 새로운 정당을 조직하기 시작했다. 하지만 현재 선거 제도 자체가 소수정당에 매우 불리하다. 각 정당은 3.5% 이상 득표해야 보조금을 받을 수 있다. 이는 거대 정당만이 정부로부터 수백만 대만 달러의 보조금을 받아 네트워크와 자원을 늘릴 수 있는 기회를 갖는다는 것을 의미한다. 다시 말하면 소수정당은 자원 부족으로 선거에 많은 돈을 쓰면서도 충분한 득표를 하지 못한 경우 보조금 등 아무것도 얻지 못하게 된다는 것을 뜻하기도 한다. 

 

2016년 선거 

국민당(KMT)의 8년 집권 기간 동안 대만 국민들은 많은 분노와 실망감을 느꼈다. '해바라기' 운동 이후 많은 사람들이 민진당이 집권당이 되어야 한다고 생각하기 시작했다. 그리고 민진당 스스로도 그들이 차기 집권당이 되어야 한다고 생각하기 시작했다. 

 

그러나 대선 후보 토론회 과정에서 대만 국민들의 요구가 충분히 표출되지는 않았다. 과거에 언론은 대선 후보 토론회 개최시 각각 다른 시민사회단체들을 초청해 후보자들에게 질문을 던지게 했다. 그렇지만 이번에는 토론회를 개최하는 주최측이 시민사회단체를 전혀 초청하지 않았으며 인터넷을 통한 질문만을 받았다. 대부분의 질문들은 논리적이지 않거나 인권적 시각이 반영되어 있지 않았다.

쯔위 효과

선거 하루 전날, 한국 연예기획사에 소속된 16살 대만 소녀가 논란의 중심에 섰다. 이 소녀가 속한 걸그룹은 한 한국 방송프로그램에 나와 각자 출신국의 국기를 들고 사진을 찍었다. 그러던 중 이 사진을 본 중국 본토의 다른 가수가 이를 비난하며 중국 사람들에게 대만 국기를 들고 있는 쯔위를 보이콧하라고 부추겼다. 보이콧이 계속되자 해당 연예기획사는 쯔위에게 공개 사과를 시켰고 이 사건은 사람들의 분노를 일으키게 만들었다.

 

양안서비스무역협정 반대 운동 동안 반중 정서와 대만 민족주의 그리고 포퓰리즘이 유행했었다. 쯔위 사태는 이러한 반중 정서를 극대화시켰으며 대만의 독립을 지지하는 정당에 표를 몰아주는 효과를 가져왔다.  

 

2016년 이후, 민진당이 가진 전권  

2012년 민진당은 소수 정당에 불과했다. 민진당은 집권당이었던 국민당이 의회 내 민진당 활동을 보이콧해 정당 활동을 제대로 할 수 없다고 비난해왔다. 2016년 선거에서 민진당은 총통 배출은 물론 의회 과반수를 넘는 113석을 차지했다. 새로 등장한 정당들 중에 시대역량당만 5석을 차지했으며 다른 정당들은 의석을 차지하지 못했다. 

 

시민사회의 기대와 우려 

이번 선거기간동안 차이잉원은 시민사회가 제안한 몇 가지 이슈에 대해 지지하는 입장을 표명하였다. 2012년 대선에서 몇 가지 인권 정책들을 제안했던 차이잉원은 2016년 대선 때에는 5개의 사회복지 정책을 제안하고 동성결혼, 헌법 개정, 의회 개정, 국가인권위원회 설립 등 주요 인권 이슈에 지지 입장을 표명했다. 사법 제도 개혁을 위한 소통 창구를 만들겠다고도 약속했다. 또한 민진당은 국회의원 후보로 시민사회 출신의 많은 전문가들을 임명했다. 그러나 사형제, 강제 철거와 같은 예민한 이슈는 언급하지 않았다. 시민사회는 추후 차이잉원 총통이 동성결혼, 선주민 권리와 자치행정, 국가인권위원회 설립, 공공주거, 노동권, 사회복지제도, 장애인과 노인의 권리, 이주민과 난민 이슈를 해결하고 입법화하기를 기대하고 있다. 

 

이런 기대와 달리 차이잉원 총통이 그동안 여러 차례 마거릿 대처 영국 전 총리를 존경한다고 말한 것에 대해서는 우려하지 않을 수 없다. 정권교체까지 약 4개월이 남아있는 시점에서 마잉주 현 총통이 정권을 잡고 있는 동안 논쟁적인 정책들을 다 통과시키지는 않을까 매우 우려스럽다. 

 

뿐만 아니라 민진당이 집권하는 기간 동안 의회 내에 이들을 견제할 만한 야당 세력이 없다는 것 역시 매우 우려스러운 점이다. 국민당 8년 집권기간 동안, 민진당은 정부 정책을 모니터링하고 인권을 침해하는 법들을 개정하기 위해 많은 시민사회단체들과 협력해왔다. 민진당이 여당이 된 지금, 시민사회단체들은 예전 민진당 입장이 그대로 유지될 것인지에 대해서 걱정하고 있다.  

 

민진당은 의회, 선거 제도, 헌법 등을 개혁하겠다고 약속했다. 지금 민진당이 할 수 있는 개혁 정책들은 많이 있다. 민진당이 거대 여당이 된 지금, 이를 파기할 어떠한 명분도 없다. 대만 시민사회단체들은 새로운 정부가 시의적절하지도 않고 공평하지 않은 정책 및 제도들을 개혁하는지 계속해서 감시하고 촉구해나갈 것이다.

인도네시아 아체 주 정부가 40명이 넘는 스리랑카 타밀족 비호신청자들에게 경고사격을 하고 바다로 돌려보내려 위협하는 등 명백한 국제법 위반행위를 저지르며 이들의 생명을 위협하고 있다고 국제앰네스티가 17일 밝혔다.

조세프 베네딕트(Josef Benedict) 국제앰네스티 동남아시아-태평양 캠페인국장은 “이같이 생명을 위태롭게 하는 위협적인 전략 대신, 인도네시아 정부는 이들이 안전하게 정박하고 유엔난민기구의 면담을 받을 수 있도록 허용해야 한다”고 밝혔다.

아체 지방 경찰은 해안으로 도망치려는 스리랑카 타밀족 여성 5명에게 경고사격으로 위협했다. 이후 아체 주 정부는 연안에 머물고 있던 난민선을 강제송환하기 위해 바다로 돌려보내려고 시도했다. 배에 탄 사람 중에는 만삭의 임신부와 어린이 9명이 포함되어 있다.

반다 아체 이민국 대변인은 17일, 타밀족 비호신청자들이 3주 전 스리랑카를 출발했으며, 이들이 인도네시아에 정박하는 것을 허가하지 않을 것이라고 밝혔다. 이들 난민이 원래 향하려던 목적지는 호주의 크리스마스 섬이었다.

아체 주 경찰의 후세인 하미디(Husein Hamidi) 경감은 타밀족 난민에게 식량을 제공하고 보트를 수리한 후, 정책에 따라 해군이 이들을 공해상으로 돌려보낼 준비를 하고 있다고 밝혔다.

조세프 베네딕트 국장은 “인도네시아는 지난해 안다만 해에서 표류하던 난민과 이주민 수백여 명에게 지원을 제공하며 국제사회로부터 얻은 신뢰를 자기 손으로 내다 버리고 있다. 2015년 5월 당시 난민 위기와는 대조적으로, 당국이 지난 한 주간 보여준 행보는 다른 나라들이 저지르는 악명 높은 태도를 답습하는 것이다.”고 밝혔다.

The Indonesian authorities in Aceh are endangering the lives of a group of more than 40 Sri Lankan Tamil asylum seekers by firing warning shots and threatening to push them back out to sea in flagrant violation of international law, Amnesty International said today.

Instead of deploying these crude intimidation tactics that could put the lives of men, women and children at risk, the Indonesian authorities should come together to allow them to disembark safely so the UN Refugee Agency can interview them.

Today’s latest attempt to force the boat off the coast of Indonesia’s Aceh province and back out to sea comes a day after local Aceh police fired warning shots in the air, terrifying at least five Sri Lankan Tamil women who tried to run ashore. The group aboard the boat includes a heavily pregnant woman and nine children.

On Friday, a Banda Aceh immigration office spokesman said the Tamil asylum seekers who set out from Sri Lanka three weeks ago will not be allowed to disembark in Indonesia. Their original intended destination was Australia’s Christmas Island.

Aceh police chief Inspector Gen. Husein Hamidi said that after providing food to the group of Sri Lankan Tamils and repairing their boat, the policy and navy were preparing to push them back into international waters.

“Indonesia risks squandering the good will it generated when it provided assistance last year to hundreds of refugees and migrants who had been stranded on the Andaman Sea. In contrast to what happened in May 2015, developments this week invite comparisons with other countries that have a notorious record of setting desperate people adrift and at risk of death on the high seas,” said Josef Benedict.

The immigration office, police and navy in Aceh have ignored Indonesian Vice President Jusuf Kalla’s directions to provide the group with shelter. Instead, they have blocked off the area, denying the Sri Lankan Tamil asylum seekers access to the shore.

UNHCR officials are on standby in Aceh province, ready to interview the group of Sri Lankan Tamil asylum seekers to verify their identities and determine their status.

“The immigration office and security forces in Aceh are flouting the authority of their own Vice President and not letting the UNHCR do its job. Consistent standards must be applied across the board, with all Indonesian authorities working together with recognized international bodies,” said Josef Benedict.

Aceh fishermen discovered the boat off the coast of Aceh province on 11 June. They subsequently reported the boat to the Indonesian Navy who have not allowed the people on the boat to disembark and apply for asylum, arguing the asylum-seekers lack the proper documentation. Under international law, neither a lack of documentation nor irregular entry precludes people from seeking asylum.

The boat began a hazardous journey from India after those on board reportedly fled Sri Lanka, where the members of the Tamil minority have suffered past persecution. Despite many recent improvements, there are still concerns about discriminatory practices against Tamils by law enforcement officials.

The group had set out from India, more than 1,700 km away, on a boat bearing an Indian flag. They had been travelling for more than three weeks headed for Australia. As they neared the coast of Aceh, bad weather struck, stranding their boat off Lhoknga.

The UN Human Rights Council noted in April that Sri Lanka saw a spate of arrests of Tamils under the Prevention of Terrorism Act (PTA). Arrests carried out under the PTA have, in a number of cases, failed to meet the minimum standards of due process laid out in directives by Sri Lanka’s National Human Rights Commission. Sri Lankan Tamils remain deeply concerned about what they say is a persistent culture of surveillance in the north and east of the country.

보고서 <최소한의 약속, 거의 없는 성과: 2022 월드컵을 앞둔 카타르의 이주노동자 인권침해>에서는 국제앰네스티가 선정한 이주노동자 인권 문제 9가지에 대해 카타르 정부의 대응을 ‘점수판’에 평가하고 있다. 1년이 지난 현재 이 중 5개 문제에 대해서만 제한적인 수준의 진전이 이루어졌고, 4개 문제에 대해서는 아무런 성과도 내지 못했다.

무스타파 카드리(Mustafa Qadri) 국제앰네스티 걸프지역 이주인권조사관은 “카타르는 이주노동자 문제에 제대로 대응하지 못하고 있다. 지난해 정부는 카타르의 이주노동자 처우를 개선하겠다고 약속했지만, 실제로는 인권 보호 면에서 의미 있는 성과를 전혀 보여주지 않고 있다”고 말했다.

12개월이 넘는 시간 동안, 여전히 후원자와 고용주의 손에 운명이 달려 있는 카타르의 150만 명 이상의 이주노동자들을 위해 법과 정책, 관습적으로 변화한 점은 거의 없다. 출국 허가, 카팔라 제도에 따른 일자리 변경 제한, 내국인 노동자 보호, 노동조합 결성 또는 가입의 자유와 같이 필수적인 사안에 대해서는 전혀 성과가 없었다.

카드리 조사관은 “처우 개선의 목표 및 기준에 대해 분명한 지침이 존재하지 않기 때문에, 카타르가 이주노동자 인권침해 문제를 해결하고자 하는 의지가 있는가에 대해 심각하게 우려가 된다. 즉각적인 조치를 취하지 않는다면 지난해 카타르 정부의 약속이 2022년 월드컵 개최에 집중하기 위한 단순한 대외적 수단이었다고 치부될 위험에 놓이게 될 것”이라고 말했다.

다음주인 5월 29일, 세계축구협회(FIFA)의 신임 회장이 선출될 예정이다. FIFA는 카타르의 이주노동자 착취 문제를 우선해야 할 분명한 책임이 있으며, 공사를 막론하고 이주노동자 인권 보호를 위해 실질적인 개혁을 시행할 것을 카타르 정부에 촉구해야 한다.

카드리 조사관은 “FIFA는 러시아와 카타르의 월드컵 개최국 선정 관련 비리 혐의를 조사하고, 월드컵 경기 일정을 조정하는 과정에서 많은 시간과 돈, 정치적 자본을 소모했다. 그러나 2022년 카타르 월드컵이 착취와 인권침해를 기반으로 하지 않기 위해 진정으로 노력하는 모습은 지금까지 전혀 보여주지 않고 있다”며 “FIFA는 정부를 비롯해 카타르 월드컵 개최를 주관하는 2022년 카타르 월드컵 조직위원회 등 주요 협력 파트너, 그 외 책임자들과 함께 긴밀히 협력하여 월드컵 개최와 관련된 인권침해를 막기 위해 노력해야 한다”고 말했다.

지난해 정부가 제시한 개혁안 중 가장 핵심적인 내용으로, 이주노동자들의 급료 지급 방식을 변경하기 위해 전자지불 시스템을 도입하겠다던 공약은 여전히 시행 준비 중에 있다. 최근 수 개월 동안 국제앰네스티와 인터뷰를 가진 이주민들은 여전히 급료를 제때, 혹은 아예 받지 못하고 있다고 호소했다.

또한 2014년 말까지 노동 감시관 300명을 배치하겠다는 목표 역시 달성하지 못했다. 건설 현장의 안전이 향상되고, 착취를 일삼던 악덕 고용알선업체를 규제하고, 노동착취 피해자들의 사법 접근성이 향상되는 등의 제한적인 진전을 보이는 데 그쳤다.

2014년 5월 정부가 발표했던 개혁안이 모두 약속대로 시행된다 하더라도, 이주노동자의 착취가 만연해진 근본적인 원인을 해결하기에는 역부족이다.

2013년 11월, 국제앰네스티는 보고서를 통해 건설 이주노동자들의 착취와 인권침해가 만연한 수준이며 일부는 강제노동 수준에까지 해당된다고 폭로한 바 있다. 그 후로 카타르 정부는 이러한 인권침해를 뿌리뽑겠다는 강력한 의지를 드러냈지만, 대부분의 이주민들에게는 거의 아무것도 변한 것이 없었다.

올해 국제앰네스티와 인터뷰를 가진 스리랑카 출신 이주노동자 란지스(Ranjith)는 5개월 전 카타르에 온 후로 지금까지 급료를 받지 못하고 있다고 했다. 신분증도, 계약서도 없는 상태로 란지스는 공업지구의 노동자 캠프에서 비좁고 지저분한 숙소에 머물고 있다.

“저는 일을 해서 아내와 아이들에게 보낼 돈을 벌고 싶을 뿐인데, 후원자 때문에 일터를 옮길 수가 없어요. 경찰서에 가 봤자 저를 체포해서 강제 추방시킬 거예요. 신분증이 없으니까요.”

카드리 조사관은 “국제앰네스티가 만연한 이주민 착취 실태를 공개한 지 1년 반 이상이 지났는데도, 이러한 인권침해의 근본 원인을 해결하려는 노력은 거의 이루어지지 않았다는 것이 현실이다. 2022년 카타르 월드컵까지 1년 더 가까워졌다. 변화가 이루어지기까지 남은 시간은 계속해서 줄어들고 있다”며 “카타르의 건설 붐이 계속되고 있고, 이주노동자 인구가 250만 명까지 증가할 예정인 만큼 시급히 개혁해야 할 필요성은 그 어느 때보다 더욱 절실하다”고 말했다.

노동 착취 문제를 해결하기 위해 필요한 조치를 취하기는커녕, 최근 카타르 정부의 행보는 인권침해를 뿌리뽑기보다 덮어버리기를 바라는 것이 아닌지 의문을 일으키고 있다.

카타르에서 이주노동자들의 노동 환경에 대해 조사하던 기자와 인권활동가들은 정부로부터 구금과 심문을 당할 위기에 처했다. 지난 4월에만 해도 각각 이주노동자 착취 실태를 조사하던 독일 방송사 WDR과 영국 BBC의 기자들이 구금되었다.

카드리 조사관은 “이들을 구금하고 위협함으로써 이주노동자들의 노동 실태를 기록하지 못하게 하려는 것은 정부가 카타르에서 인권을 침해받고 있는 수만 명의 끔찍한 현실을 다루기보다, 국가적 이미지에 더 신경쓰고 있음을 보여주는 것”이라고 말했다.

Mounting risk of World Cup built on abuse as Qatar fails to deliver reforms

More than a year after Qatar’s government promised limited reforms to improve migrant labour rights, hopes of true progress are fading fast, says Amnesty International in a new briefing published today.

The briefing, Promising little, delivering less: Qatar and migrant labour abuse ahead of the 2022 Football World Cup, features a ‘scorecard’ that rates the authorities’ response to nine fundamental migrant labour rights issues identified by Amnesty International. A year later, only limited progress has been achieved on five of these issues, in four areas the authorities have failed to make any improvements.

“Qatar is failing migrant workers. Last year the government made promises to improve migrant labour rights in Qatar, but in practice, there have been no significant advances in the protection of rights,” said Mustafa Qadri, Gulf migrant rights researcher at Amnesty International.

Over the last 12 months, little has changed in law, policy and practice for the more than 1.5 million migrant workers in Qatar who remain at the mercy of their sponsors and employers. On the crucial issues of the exit permit, the restriction on changing employers in Qatar’s kafala system, protection of domestic workers and the freedom to form or join trade union – there has been no progress whatsoever.

“The lack of a clear roadmap of targets and benchmarks for reform leaves serious doubts about Qatar’s commitment to tackling migrant labour abuse. Without prompt action, the pledges Qatar made last year are at serious risk of being dismissed as a mere public relations stunt to ensure the Gulf state can cling on to the 2022 World Cup,” said Mustafa Qadri.

FIFA is set to elect its new president next week, on 29 May. Football’s world governing body has a clear responsibility to prioritise the issue of exploitation of migrant workers in Qatar and must publicly and privately call on the Qatari authorities to implement effective reforms to protect migrant worker rights.

“FIFA has spent much time, money and political capital investigating alleged corruption in the Russia and Qatar World Cup bids, and agonising over the scheduling of the tournament. But the organisation has yet to demonstrate any real commitment to ensuring Qatar 2022 is not built on a foundation of exploitation and abuse,” said Mustafa Qadri.

“FIFA must work closely with the government, the Qatar 2022 Supreme Committee – the body responsible for organising the Qatar World Cup – major corporate partners and others responsible for delivering the tournament to prevent abuses linked to the staging of the World Cup.”

The most significant reform proposed by the government last year: the introduction of an electronic wage system to change the way migrants’ salaries are paid, is still in the process of being implemented. Many migrants interviewed by Amnesty International in recent months still complained of late or non-payment of wages.

Qatar has also failed to meet its target to have 300 labour inspectors in place by the end of 2014.There has been only limited progress on measures to improve safety on construction sites, regulate exploitative recruitment agencies and improve access to justice for victims of labour exploitation.

Even if all the reforms Qatar announced in May 2014 had been implemented, these measures would not be sufficient to address the root causes behind widespread exploitation of migrant workers.

In November 2013, a report published by Amnesty International revealed that abuse and exploitation of migrant construction workers was rife and in some cases amounted to forced labour. Although Qatar has since repeatedly expressed a strong desire to stamp out this abuse, for many migrants very little has changed.

Ranjith, a Sri Lankan migrant worker interviewed by Amnesty International this year, has not been paid since he arrived in Qatar five months ago. He has no ID and no contract. His accommodation in a workers camp in the Industrial Area is cramped and filthy.

“I just want to work and earn some money for my wife and children, but because of my sponsor I can’t change jobs. If I go to the police they will arrest me and deport me because I do not have an ID,” he told Amnesty International.

“The reality is that more than a year and half after Amnesty International highlighted rampant exploitation of migrants –little has been done to address the root causes of this abuse. We are one year closer to Qatar’s 2022 World Cup – time for changes to be implemented is running out,” said Mustafa Qadri.

“With Qatar’s construction boom continuing and the migrant worker population set to expand to 2.5 million, the need for urgent reform is more pressing than ever.”

Rather than take the necessary action to address labour exploitation, recent action by the Qatari authorities raises questions about whether they are more interested in covering up abuse than stamping it out.
Journalists and human rights workers investigating conditions for migrant workers in Qatar have faced detention and interrogation by the authorities. In the past month alone, journalists doing separate investigations into exploitation of migrant workers for the German broadcaster WDR and the BBC have been detained.

“Seeking to silence those documenting the conditions of migrant workers by detaining and intimidating them sends the message that the government is more concerned about its image than dealing with the appalling reality of the tens of thousands of men and women who are abused in Qatar,” said Mustafa Qadri.
