2005년 5월 우즈베키스탄 정부군에 수백여 명의 시위대가 목숨을 잃은 ‘안디잔 학살 사건’ 10주기를 맞은 가운데, 안디잔 사건은 반드시 독립적으로 조사되어야 하며, 현재 시위 관련자들에 대해 진행 중인 기소 절차 역시 중단되어야 한다고 국제앰네스티가 밝혔다.

우즈베키스탄의 안디잔에서 여성과 어린이를 포함해 대부분 평화적으로 시위를 벌이던 사람들을 정부군이 무차별적으로 총살한 사건으로부터 10년이 지났지만, 수백여 명이 불법 구금되거나 기소될 위험 속에서 살아가고 있는 한편, 해당 사건에 대해 문제를 제기하는 사람들은 누구나 괴롭힘 또는 공격을 당할 위기에 처해 있다.

존 달후이센(John Dalhuisen) 국제앰네스티 유럽-중앙아시아 국장은 “안디잔 학살로 거리에 흩뿌려진 피가 다 마르기도 전에 당시의 참상을 덮어버린 공포와 기밀의 장막을 이제는 걷어버려야 할 때다. 우즈베키스탄 정부는 학살의 책임자들을 처벌하는 대신, 당시 시위에 관련되었다고 의심되는 사람들을 무자비하게 기소하고, 고문하고, 불공정한 재판을 거쳐 불법적으로 수감시키고 있다”고 말했다.

또한 “유럽과 미국 정부는 우즈베키스탄의 이러한 현실을 비롯해 그 외의 충격적인 인권침해행위를 계속해서 외면하고 있다. 전략적 동맹국의 심기를 거스를까 우려하는 듯하다. 당시 사건에 대한 독립적이고 국제적인 조사는 오랜 시간 지체되고 있지만, 불처벌 관행을 종식시키고 안디잔 학살의 피해자들에게 정당한 처우와 보상을 보장하기에는 아직 늦지 않았다”고 말했다.

배경정보

유럽연합(EU)은 안디잔 학살에 대해 무기금수조치 등의 제재 조치로 대응하며, 우즈벡 정부가 해당 사건에 대해 적절한 조사를 진행할 것을 제재 철회의 핵심 요건으로 제시했다. 그러나 2009년 10월 EU는 안디잔 사건에 대한 조사가 이루어지지 않았음에도 이에 대한 언급 없이 무기금수조치를 해제했다. 미국 정부 역시 학살 사건에 대한 조사를 촉구했지만, 2004년부터 우즈벡의 인권상황을 어느 정도 문제 삼아 부과했던 군사적 원조 제한을 2012년 1월 해제했다.

올해 들어 양국간의 군사적 관계는 새로운 군사협력 5개년 계획이 시행되면서 매우 굳건해졌다. 우즈벡 정부는 전면적이고 공정한 조사위원회를 설립하라는 유엔 인권위원회, 유엔 고문철폐위원회 등의 국제기구의 권고사항을 거부한 바 있다.

2013년 4월 우즈베키스탄의 인권상황을 공개적으로 검토하는 유엔 정례인권검토 자리에서 우즈벡 대표는 “안디잔 문제[에 대한 국제적 조사 여부]는 더 이상 논의하지 않겠다”고 밝혔다. 조사에 대한 필요성을 언급한 유럽 국가는 없었다.

2015년 4월, 국제앰네스티는 보고서 <비밀과 거짓: 우즈베키스탄의 고문으로 인한 거짓 자백(영문)>을 통해 우즈베키스탄의 사법제도에서 고문과 부당대우가 중심적인 역할을 하고 있음을 폭로하고, 국가 안보에 위협이 된다고 여겨지는 단체는 정부의 탄압을 받고 있는 실태를 공개했다.

Uzbekistan: Decade-long wait for justice for victims of Central Asia’s forgotten massacre

The killing of hundreds of protesters by Uzbekistani security forces in May 2005 must be independently investigated and the ongoing persecution of those connected to the unrest must end, Amnesty International said on the 10th anniversary of the Andizhan killings.

A decade after security forces indiscriminately gunned down mostly peaceful demonstrators, including women and children, in the city of Andizhan, scores of men and women have been unlawfully imprisoned or live in fear of prosecution whilst anyone who raises the issue in the country faces harassment or attack.

“It is time to lift the veil of fear and official secrecy that descended on the Andizhan killings even before the blood was dry on the streets. Instead of bringing those responsible for these killings to account, the Uzbekistani authorities have relentlessly persecuted those it suspects of involvement in the protests, torturing them, trying them unfairly and imprisoning them unlawfully,” said John Dalhuisen, Amnesty International Director for Europe and Central Asia.

“Governments in Europe and the USA have continued to turn a blind eye to this and other appalling human rights abuses in Uzbekistan, seemingly for fear of upsetting a strategic ally. Whilst an independent international investigation into the killings is long overdue, it is not too late to end impunity and ensure justice and reparation for the victims of Andizhan.”

Background

The response of the EU to the killings was an arms embargo and other targeted sanctions and a key requirement that the Uzbekistani authorities should properly investigate the killings. However, in October 2009 the EU embargo was lifted without mention of the lack of an Andizhan investigation. The US government also called for an investigation into the killings but in January 2012 waived restrictions on military aid to Uzbekistan originally imposed in 2004, due in part to the country’s human rights record.

This year the military relationship between the two countries strengthened significantly with the implementation of a new five-year plan for military cooperation. The Uzbekistani government has rejected recommendations by international bodies, including the United Nations Human Rights Council and the UN Committee against Torture, to institute a full and impartial inquiry.

At the public examination of Uzbekistan’s human rights record at the UN’s Universal Periodic Review in April 2013 the Uzbekistani delegation stated that “the issue [of an international investigation into the events] of Andizhan is closed for us”. No European state mentioned the need for an investigation.

In April 2015 an Amnesty International report Secrets and Lies: Forced confessions under torture in Uzbekistan, revealed how torture and other ill-treatment plays a central role in the country’s justice system and the government’s clampdown on any group perceived as a threat to national security. 엘살바도르 법원이 아이를 유산했다는 이유로 4년간 교도소에 수감됐던 여성을 석방하라고 판결한 것은 인권의 위대한 승리라고 국제앰네스티가 밝혔다.

마리아 테레사 리베라(33)는 아이를 유산하고 “고의 살인” 혐의로 징역 40년형이 선고되어 지난 2011년 교도소에 수감됐다.

에리카 게바라 로사스(Erika Guevara-Rosas) 국제앰네스티 미주국장은 “마리아 테레사의 석방으로 여성을 그저 2등 시민으로만 대우하는 국가인 엘살바도르에서 정의를 향한 진전이 또 한 걸음 이루어지게 됐다”며 “마리아 테레사는 단 1초라도 감방에 있어서는 안 될 사람이었다. 여성 수천 명의 목숨을 위험으로 몰아넣을 뿐인 터무니없는 낙태금지법 때문에 지금도 수많은 여성들이 교도소에 수감되어 있는 엘살바도르에서 이번 석방이 변화의 기폭제가 되어야 할 것”이라고 말했다.

마리아 테레사는 자택 화장실에서 거의 의식을 잃은 상태로 피를 심하게 흘리고 있는 모습을 시어머니가 발견하고 병원으로 옮겨졌다가 병원에서 체포되었다. 마리아 테레사가 낙태를 한 것으로 의심한 병원 직원이 경찰에 신고한 것이었다.

재판 과정에서 마리아 테레사의 직장 상사는 마리아 테레사가 2011년 1월에 임신한 사실을 알고 있었다며 불리한 증언을 했다. 이 증언대로라면 유산이 일어날 당시 임신 11개월이었다는 말이 된다. 이처럼 터무니없는 증언도 마리아 테레사의 유죄를 입증하는 증거로 사용됐다.

결국 법원이 혐의를 입증할 증거가 충분하지 않다고 판결하면서 20일 마리아 테레사의 석방이 결정됐다.

1998년 개정된 형법에 따라 엘살바도르에서는 모든 경우에 대해 낙태를 금지하고 있다. 강간, 근친상간으로 인한 임신이거나 산모의 생명이 위험한 상황이라도 마찬가지다. 이로 인해 여성들은 부당한 기소를 당하고, 오용된 형법에 따라 즉시 유죄로 몰리게 되었다. 특히 경제적 여유가 거의 없는 여성들이 낙태금지법에 큰 영향을 받았다.

A court’s decision today to release a woman who spent four years in jail in El Salvador for miscarrying her pregnancy is a great victory for human rights, said Amnesty International.

María Teresa Rivera, 33, was jailed in 2011 and sentenced to 40 years in prison for “aggravated homicide” after having a miscarriage.

“The release of María Teresa is yet another step towards justice in a country where women are treated as mere second class citizens,” said Erika Guevara-Rosas, Americas Director at Amnesty International.

“She should have never been forced to spend one second behind bars. Her release must be a catalyst for change in El Salvador, where dozens of women are put in prison because of an utterly ridiculous anti-abortion law which does nothing but put the lives of thousands of women and girls in danger.”

María Teresa was arrested in a hospital after her mother-in-law found her in her bathroom almost unconscious and bleeding heavily. Staff at the hospital reported her to the police and accused her of having an abortion.

During the trial, one of Maria Teresa’s bosses testified against her saying she knew she was pregnant in January 2011. This would have made her 11 months pregnant by the time the miscarriage took place. The outrageous testimony was used as one of the pieces of evidence to convict her.

The release today came after a judge ruled there was not enough evidence to prove the charges against her.

Following a change in the Penal Code in 1998, abortion in El Salvador has been banned in all circumstances – even when the pregnancy is the result of rape, incest or when the life of the woman is at risk. The change in the law has led to wrongful prosecutions and misapplication of criminal law where women are immediately assumed guilty. Women with few economic resources are particularly affected by the ban.

그러나 분열은 세계 각지에서 힘을 받는 것처럼 보인다. 국경의 벽은 더욱 높아지고, 안팎에서 혐오와 공포가 치솟고 있으며, 억압적인 법률은 기본적인 자유를 옥죄고 있다.

미국 대통령 선거 결과는 이 같은 경향을 고스란히 보여주어 전 세계를 충격에 빠뜨렸다. 선거운동 과정에서 여성혐오와 외국인 혐오를 계속 드러냈던 도널드 트럼프가 차기 미국 대통령으로 선출된 것이다.

선거 이후 사람들은 이 사실을 받아들여 가고 있지만, 이러한 결과가 어떤 영향을 미치게 될지 아직도 충분히 납득되지 못한 상태다.

최강대국으로 꼽히는 나라의 대통령 당선인이 혐오와 기본권 보호 거부를 내세운다는 것은 특히 많은 국가에서 달갑지 않은 대우를 받으며 궁지에 몰려있는 인권활동가들에게 더욱 큰 좌절로 다가왔다.

인권 운동은 자신의 권리가 박탈당한다며 지역사회 및 국가 안에서 (주로 가장 취약한 계층의) 타인에게 폭언을 내뱉는 방식으로 정치적 의견을 표출하는 사람들과 합의점을 찾아야 한다. 이들의 두려움과 걱정은 대부분 타당한 것으로, 지도자들은 모든 사람에게 인권과 평등, 존엄을 보장하는 정책을 통해 이 같은 우려와 폭력에 대응해야 한다.

오바마 대통령의 발언은 실제 본인의 정책 결정의 현실을 훨씬 뛰어넘어, 나라 안팎에서 계속되며 악화되기까지 하는 미국의 인권침해를 감추는 경우가 많았다. 사우디아라비아로 수출된 무기가 예멘에서 중대하고도 제도적인 인권침해를 저지르는 데 사용되고 있다는 증거가 있음에도 무기 수출을 더욱 증가시킨 점과, 미 중앙정보국(CIA)의 드론 공격 활동이 거의 무책임한 수준으로 이루어지고 있음에도 이를 더욱 확대한 점이 그렇다.

트럼프 대통령 당선인의 국제관계 전략이 위태로운 상태인 전 세계 인권 상황에 어떤 영향을 미칠지는 아직 알 수 없으나, 그가 선거운동 중에 했던 유해한 발언들이 정책에도 적용된다면 이로 인한 영향은 중대하고도 광범위할 것이다.

대테러 정책과 국가 안보에 관한 트럼프의 발언은 매우 위험했다. 그의 선거 공약을 기반으로 판단할 때, 트럼프 정부는 고문 금지와 같이 이미 확립된 규범에 대한 미국의 입장을 약화시킬 가능성이 높다. 한편으로는 오바마 정부에서 드러났던 무분별한 불법 대규모 감시 프로그램과 같은 현재의 문제점을 지속시키거나, 더욱 확대시킬 위험도 있다.

트럼프의 반 무슬림적 발언은 혐오 선동자들을 기세등등하게 하고 미국 안팎에서 공격과 차별을 더욱 부추길 위험이 있다. 이로 인해 많은 소수종교인들에게도 매우 해로운 영향을 줄 것이고, 이러한 분열을 자신들의 목적을 위해 이용하는 무장단체들에게는 신병 모집 수단이 될 수도 있다.

또한, 미국이 세계 인권 제도와 거리를 둘 가능성이 커지면서, 이로 인해 미국 국민도 함께 보호하고 있는 중요한 국제법적 안전조치가 더욱 약화될 수 있다.

그러나 미래가 반드시 이렇게 되리라는 법은 없다. 세계 각지에서의 활동을 통해, 우리는 아무리 큰 역경을 마주하더라도 함께 모여 대화하고, 인권에 기반한 긍정적인 변화를 일으키기 위해 나서는 모습을 지켜봤다.

공포와 혐오만이 승리하라는 법은 없다. 오히려 변화의 기폭제가 될 수 있다. 미국과 전 세계 대다수가 모든 사람의 평등과 존엄, 자유를 지지하고 있다는 점은 큰 용기가 된다. 인권의 기저를 이루는 이러한 핵심 가치들은 포기하기에는 너무나 소중하고, 당연히 여기기에는 그 보호가 너무나 취약하다.

당장 혐오와 공포를 멈추는 것이 쉽지는 않을 것이다. 그러나 양심과 인권이 강력한 동기가 된다는 것은 과거에 이미 증명되었다. 위대한 시민권 운동가인 마틴 루터 킹 목사가 “도덕적 우주의 활은 길지만, 그 끝은 정의를 향해 구부러져 있다”고 말했듯이 말이다.

Rising above division – defending global human rights in the Trump era

That which unites us is always greater than that which divides us.

Yet, around the world, the forces of division seem to be gathering momentum. Walls rising up along borders, hatred and fear welling up within and between populations, repressive laws assailing basic freedoms.

The US election results, the latest development in this deeply troubling trend, caused global shockwaves. After campaigning with a constant refrain of misogyny and xenophobia, Donald J. Trump will be the next US President.

Since the election, the world has been coming to terms with this fact, though its implications have yet to be fathomed fully.

For human rights activists in particular, who already find themselves embattled and “undesirable” in many countries, it raises the stakes immensely that the President-elect of one of the world’s most powerful nations put forward a political platform that championed hate, threatening to disavow many basic human rights protections.

It also drives home the message that the global human rights movement needs to seek common ground with those who feel so disenfranchised that they find political expression by lashing out against others – often the most vulnerable – in their communities and countries. Many of their fears and concerns have valid roots and leaders can help to allay those concerns by responding with policies that ensure human rights, equality and dignity for all, rather than seeking to divide.

Watched with horror by many around the world, the Trump campaign was framed as “people vs. establishment”, but it became an echo chamber for a society’s fear and anger.

The world has been there many times before. We have seen how divisive rhetoric leads down an ugly road – dissenting voices are criminalized and those who are disadvantaged bear the brunt of vicious harassment, discrimination and violence.

President Obama’s rhetoric often soared way above the reality of his policymaking, and masked continuing and sometimes worsening human rights violations by the USA, both home and abroad. They included increasing the arms sale to Saudi Arabia, despite evidence that such arms have been used to commit gross and systematic human rights violations in Yemen, and an expansion of the CIA’s almost totally unaccountable campaign of drone strikes.

We do not yet know how President-elect Trump’s own brand of international relations will affect the already precarious situation of human rights globally, but, if his poisonous rhetoric in the campaign translates into policy, the implications will be grave and far-reaching.

Trump’s triumph will undoubtedly embolden leaders around the world who rely on fear-mongering, whether they are already in power or running for office.

On counter-terrorism and national security, Trump’s rhetoric has been very dangerous. If his campaign promises are anything to go by, his administration seems likely to weaken the US stance on established norms, such as the prohibition on torture. Meanwhile it threatens to continue or expand current overreaches, such as the sprawling, illegal mass surveillance programmes which came to light under the Obama administration.

If Trump’s policy choices match his sexist statements, it will be terrible news for women’s rights, and the xenophobia and racism he has espoused portend very badly for the treatment of migrants and minorities. We can expect a rollback on refugee resettlement into the USA, increasing the pressure on poor countries who already host the overwhelming majority of the world’s refugees.

His anti-Muslim rhetoric risks emboldening hatemongers and fuelling attacks and discrimination, both in the USA and beyond. This could have a deeply damaging ripple effect on members of many religious minorities. It could also serve as a recruitment tool for armed groups that exploit such divisions for their own purposes.

And a likely US retreat from the global human rights system could further weaken crucial international safeguards that also protect people in the USA.

It is a bleak outlook.

But the future does not have to be like this. In our work around the world, we have seen how even people facing great adversity can come together, dialogue, and mobilize to bring about positive change rooted in human rights.

Fear and hate do not have to win the day – they can be a catalyst for change. And it is heartening that the majority of people in the USA and around the world support equality, dignity, freedom for all people – the core values underpinning human rights. Those values are far too precious to discard; their protection far too fragile to take for granted.

Stopping hate and fear in their tracks will not be easy. But the guiding principles of conscience and human rights have proven to be powerful motivators in the past. As the great civil rights leader, the Rev. Martin Luther King, Jr., said: “The arc of the moral universe is long, but it bends towards justice.”

Thanks to the determined struggle of human rights activism through the decades has made leaps forward, often in the face of great adversity. We need to keep up the fight. For those of us who care deeply about freedom and human rights, seeking common ground that heals the divisions is now the defining challenge of our time.

국제앰네스티는 모술에서 동쪽으로 약 20km 떨어진 카렘레쉬 마을의 북부 지역에 백린탄이 투하되었다는 신뢰성 있는 증언과 사진 증거를 확보했다. 백린은 공기와 접촉하면 극도의 고온으로 타오르는 발화물질이다.

도나텔라 로베라(Donatella Rovera) 국제앰네스티 위기대응 상임고문은 “백린은 근육과 뼈까지 태우며 끔찍한 부상을 유발할 수 있는 물질이다. 투하된 백린탄 중에는 일부분만 발화했다가, 수 주 뒤 다시 타오를 가능성도 있다”며 “주변에 눈에 띄는 경고 문구가 극소수나마 표시되어 있다고 해도, 이로 인해 앞으로 수 일, 수 주 동안 모술 주변에서 피난을 떠나는 민간인들이나 집을 확인하러 돌아온 카렘레쉬 마을 주민들은 심각한 피해를 입을 위험에 처할 수 있다”고 밝혔다.

카렘레쉬 마을은 2014년 8월 대부분 아시리아인이었던 주민들이 무장단체 자칭 이슬람국가(IS)를 피해 달아난 이후 계속해서 인구가 감소하고 있지만, 피난민들이 모술에서 에르빌로 향하는 도중 백린 오염지역을 통과할 수 있는 만큼 백린은 명백히 현존하는 위험이다.

도나텔라 로베라 상임고문은 “이라크군과 연합군은 민간인이 근접한 지역에 절대 백린탄을 사용하지 말아야 한다. 백린탄 사용 당시에 민간인이 없었다 해도 위험이 잔류할 수 있으므로, 안전한 방법으로 군사적 목적을 달성할 수 없을 경우 목적 달성을 위해 절대적으로 필요한 경우가 아니라면 백린탄을 공중에서 폭발시켜서는 안된다”고 말했다.

뉴욕타임즈(New York Times)지의 한 사진기자가 10월 20일 촬영한 사진에는 카렘레쉬 마을 부근에서 폭발하는 백린탄의 모습이 찍혀 있다. 당시 카렘레쉬 남쪽으로 수 킬로미터 떨어진 함다니바(카라코쉬)에서 IS와 이라크군의 교전이 벌어지고 있었다.

사진을 촬영한 기자는 같은 날 여러 차례 같은 폭탄이 투하된 것을 목격했다며, 15분 간격으로 네 차례 폭발했다고 국제앰네스티에 전했다. 폭탄을 투하한 것이 이라크 중앙정부군인지, 쿠르드 자치정부의 페쉬메르가 군인지, 미국 주도 연합군인지는 분명하지 않다.

이 사진들에는 직경 125~250m 범위에 백린탄 116개를 투하하는 미국산 155mm 발사체 M825A1과 같은 것으로 보이는 확산 형태가 나타났다. 국제앰네스티는 이스라엘군의 캐스트 리드 작전(Operation Cast Lead) 중 가자 지구에서 같은 무기가 사용된 정황을 기록한 바 있다.

백린은 짙은 연막을 뿌려 적군의 움직임을 방해하거나, 다음 공격 대상을 표시하기 위해 가장 많이 사용되는데, 이번 경우에 왜 백린을 사용했는지는 아직 밝혀지지 않았다. 이러한 목적으로 백린을 사용하는 것이 금지된 것은 아니지만, 백린탄을 사용할 때마다 반드시 극도의 주의를 기울여야 한다. 민간인이 주변에 있을 경우에는 절대 사용하지 말아야 한다.

백린탄은 땅에 묻히거나 물 속에 떨어질 경우 일시적으로 불이 꺼지지만, 공기 중으로 나올 경우 그와 동시에 다시 발화하게 된다. 오염 지역을 지나다 우연히 이것을 발견한 무고한 민간인들에게 심각한 위험을 초래할 수 있다. 백린은 절대 대인 무기로 사용될 수 없다.

도나텔라 로베라 상임고문은 “백린탄을 사용한 군은 민간인의 우연한 피해 위험을 최소화하기 위해 백린 오염 가능성이 있는 지역을 절대 필수적으로 알려야 한다”며 “이러한 정보는 이라크 내 의료진들에게 환자의 부상 유형을 미리 알릴 수 있기 때문에 매우 중요하다. 안타깝게도 가자지구에서는 의사들이 환자의 화상이 백린으로 인한 것임을 몰라서 적절한 치료를 하지 못했고, 결국 화상이 더욱 악화되어 죽어가는 사람들을 목격했다”고 말했다.

모술과 인근 지역에서 무장단체 자칭 이슬람국가(IS)의 점령지역에 사는 주민들은 IS가 외부로 나가는 것을 금지하고 있기 때문에 피난을 떠나려면 엄청난 위험을 감수해야 하고, 이 지역 탈환을 놓고 교전이 계속되고 있기 때문에 전장에서 십자포화를 당할 수도 있다. 이들이 또 다른 위험을 피하는 데 기력을 더 낭비해서는 안 된다.

국제앰네스티는 백린은 특히 무차별적인 효과를 일으킬 가능성이 높은 물질이므로, 민간인 밀집 지역 인근에서 사용하는 것은 무차별적 공격에 해당해 전쟁범죄가 될 수 있다고 앞서 강조한 바 있다.

배경

미국 주도 국제연합군의 지원을 받아 이라크군과 쿠르드군은 무장단체 (자칭 이슬람국가) IS로부터 이라크 제2의 도시 모술을 탈환하기 위한 작전을 10월 17일부터 시작했다.

그 후로 최대 10,500명이 강제실향민이 되었으며, 150만 명은 모술과 근교 지역에 여전히 갇혀 있는 상태다.

The use of white phosphorus around the city of Mosul could pose a deadly risk to civilians fleeing the fighting in the coming days and weeks, Amnesty International said today.

The organization received credible witness and photographic evidence of white phosphorus projectiles fired over an area north of the village of Karemlesh, about 20 kilometres east of Mosul. White phosphorus is an incendiary substance which burns at extremely high temperatures upon exposure to air.

“White phosphorus can cause horrific injuries, burning deep into the muscle and bone. It is possible that some of it will only partially burn and could then reignite weeks after being deployed,” said Donatella Rovera, Senior Crisis Response Adviser at Amnesty International.

“This means that civilians who flee the fighting around Mosul or residents returning to check on their homes in Karemlesh in the coming days or weeks would be at risk of serious harm even though there may be few visible warning signs.”

Karemlesh has been depopulated since the predominately Assyrian population fled the armed group calling itself Islamic State (IS) in August 2014, but white phosphorus poses a clear and present danger to civilians fleeing Mosul towards Erbil who may pass through the contaminated area.

“We are urging Iraqi and coalition forces never to use white phosphorus in the vicinity of civilians. Even if civilians are not present at the time of its use, due to the residual risks they should not use airburst white phosphorus munitions unless it is absolutely necessary to achieve military objectives which cannot be accomplished through safer means,” said Donatella Rovera.

Photographs taken by a New York Times photographer on 20 October show white phosphorus munitions bursting near Karemlesh. Clashes between IS and Iraqi government forces were taking place in Hamdaniya (Qaraqosh), a few kilometres south of Karemlesh at the time.

The photographer told Amnesty International that he witnessed the same munitions being deployed at different times of the day, including four over a 15-minute period. It is not clear whether the projectiles were fired by Iraqi central government forces, Peshmerga forces of the Kurdistan Regional Government (KRG), or forces belonging to members of the US-led coalition.

The photographs show a dispersal pattern that appears consistent with the US-made 155-mm M825A1 projectile, which ejects 116 felt wedges containing white phosphorus over an area between 125 – 250 metres wide. Amnesty International documented its use in Gaza during Israel’s 2008-2009 Operation Cast Lead.

White phosphorus is most often used to create a dense smoke screen that can obscure the movement of troops from enemy forces, and to mark targets for further attack, although it is not yet clear why it was used in this case. While its use for such purposes is not prohibited, extreme caution is warranted whenever it is deployed. It should never be used in the vicinity of civilians.

If buried by soil or water, white phosphorus wedges can be temporarily extinguished, but they spontaneously reignite if they are uncovered, presenting a serious hazard for unsuspecting civilians who may accidentally uncover them as they walk through the affected area. White phosphorus should never be used as an anti-personnel weapon.

“It is absolutely imperative that the forces using white phosphorus publicize details of areas potentially contaminated by the substance, to minimize the risk of accidental harm to civilians,” said Donatella Rovera.

“Such information is also crucial for medical professionals operating in Iraq so that they are aware of the kind of injuries they are treating. Tragically we witnessed people dying in Gaza because doctors were not aware that their patients’ burns were caused by white phosphorus and were thus not able to dispense the right treatment, resulting in the wounds deteriorating.”

Residents of Mosul and surrounding areas under the control of the armed group calling itself Islamic State (IS), are facing huge risks as IS prevents them from leaving and they risk being caught in the cross fire as the battle to recapture the area continues. No effort should be spared to avoid exposing them to further risks.

Amnesty International has previously highlighted that white phosphorus is particularly prone to indiscriminate effects, and therefore its use in the vicinity of civilian concentrations constitutes an indiscriminate attack and can be a war crime.

Background

An operation by Iraqi and Kurdish forces, supported by the US-led international coalition, to retake Mosul, Iraq’s second largest city, from the (armed group calling itself Islamic State) IS began on 17 October.

Upwards of 10,500 people have been displaced since then, while up to 1.5 million people remain trapped in Mosul and its outskirts.

이철성 경찰청장 사과에 대한 긴급 논평

경찰청장 사과, 면피용에 머물러서는 안 된다

故 백남기 농민 사건 발생 581일 만에 이철성 경찰청장이 공식적으로 사과했다. 경찰이 늦게나마 국민 앞에 사과한 것에 대해서는 한걸음 진전했다고 보이나 그 내용과 방법에 있어서 충분하지 않았다. 경찰이 이날 밝힌 입장이 책임 있는 사과로 받아들여지기 위해서는 백남기 농민 사망에 대한 진상 규명, 책임 추궁 등 정의 실현, 효과적인 배상, 재발 방지를 위한 제도 개혁이 병행되어야만 한다. 그래야만 면피용 사과로 책임을 회피하려 한다는 비판에서 자유로울 수 있을 것이다.

먼저 경찰은 이번 사건과 관련해 한석진, 최윤석 경장 등 살수요원을 비롯하여 당시 현장지휘관이었던 신윤균 총경 나아가 구은수 전 서울청장, 강신명 전 경찰청장 등에 대한 포괄적이고 철저한 진상조사를 실시하고 그에 따라 책임을 물어야 할 것이다.

또한, 지난 4월 6일 백남기 손해배상청구 소송에서 재판부는 당시 작성한 청문감사보고서와 관계자들의 진술서를 제출하라고 명령했지만, 경찰은 이에 항고하며 서류 제출을 거부하고 있다. 이는 합리적 배상을 지연시키고 방해하는 행태로밖에 보이지 않는다. 경찰은 즉각 청문감사보고서를 법원에 제출하고 배상을 위한 적극적인 조치를 취해야 할 것이다.

경찰은 물대포 사용과 관련해 대통령령인 ‘위해성 경찰장비의 사용기준 등에 관한 규정’에 사용요건을 엄격하게 제한하는 등 법제화하겠다는 입장을 밝혔다. 하지만 백남기 농민을 쓰러뜨려 숨지게 한 물대포의 위해성에 대한 논란은 계속되고 있다. 특히 경찰은 2008년 외부 기관이 아닌 내부 직원들을 동원해 안전성 실험을 시행한 것으로 드러났으며 이후 진행된 실험에 대해서는 공개된 바 없어 물대포의 안전성이 신뢰받을 수준으로 검증되었다고 할 수 없는 상황이다. 경찰은 국회, 시민사회 등이 참여하는 가운데 현재 보유 중인 모든 물대포에 대한 안전성 검사를 전면적으로 시행하고 이를 바탕으로 물대포 계속 사용 여부 등을 원점에서 재검토해야 할 것이다.

김희진 국제앰네스티 한국지부 사무처장은 “서울대병원과 경찰에서 잘못된 사실을 바로잡고 사과한 만큼 검찰에서는 독립적이고 불편부당하며 신속한 수사를 통해 기소를 더 이상 미뤄서는 안된다”며 “이번 사건의 책임자가 법의 심판을 받음으로써 불필요하거나 과도한 물리력 사용은 정당화될 수 없다는 것을 상기시켜야 한다”고 강조했다. 끝.

국제앰네스티는 11월 5일 새로운 정책보고서 ‘국제인권기준에서 본 한국 내 평화적 집회의 자유’를 발표하며 평화적 집회의 자유를 보장해야 할 국제인권법 및 헌법상의 의무에도 불구하고 한국의 국내법 규정 및 관행은 국제인권기준에 미치고 못하고 있다고 밝혔다.

미신고 집회 주최나 신고 범위 일탈 행위에 대한 형사처벌, 특정 장소 및 시간대에 대한 일괄적 집회 금지, 당국에 교통소통 등의 사유로 광범위한 제한을 부과하거나 금지할 수 있는 재량권을 가진다는 점 등 집회및시위에관한법률(집시법)의 다수 규정들은 평화적 집회의 자유에 대한 권리가 완전히 향유되도록 보장해야 할 한국 정부의 국제인권법기준상 의무에 배치되는 것이다.

국제앰네스티 한국지부 김희진 사무처장은 “평화적 집회의 자유는 권리지, 당국의 허가를 받아야 하는 특권이 아니다. 하지만 단지 미신고집회를 개최했다는 이유만으로 주최자가 처벌되고, 경찰이 집회를 금지∙제한할 수 있는 광범위한 재량권을 행사한다는 점에서 한국에서 집회의 자유는 사실상 경찰의 허가대상으로 전락해버렸다.”라고 밝혔다.

또 국제앰네스티는 이번 정책보고서에서 집시법상 집회 해산 요건이 국제인권법기준에서 허용되는 범위를 벗어나는 수준으로 지나치게 광범위한 점, 집회 현장에서의 차벽 사용, 대규모 경력 배치, 집회 해산시 물대포가 운용되는 방식 등 경찰의 집회 관리 전반에서 드러나는 문제점을 지적했다.

단지 미신고집회를 개최했다는 이유만으로 주최자가 처벌되고, 경찰이 집회를 금지∙제한할 수 있는 광범위한 재량권을 행사한다는 점에서 한국에서 집회의 자유는 사실상 경찰의 허가대상으로 전락해버렸다.

김희진 사무처장은 “집회 현장에서 경찰의 제1차적 임무는 사람들이 평화롭게 집회할 수 있도록 촉진자의 역할을 수행하는 것이다. 하지만, 진압장비로 중무장한 대규모 경력 배치, 광범위한 차벽 사용 등 경찰이 집회 관리에서 보여주는 모습은 이와는 거리가 있다”고 말했다.

또, “더 우려되는 부분은 집회시 불법적 물리력 사용에 대한 책무성 담보가 제대로 이뤄지지 않는다는 점이다. 1년 전 민중총궐기대회에서 경찰의 물대포에 맞아 쓰러졌다가 지난 9월 25일에 사망한 백남기 농민의 경우, 아직까지 과도한 물리력 행사에 대한 책임으로 정식으로 기소된 사람은 단 한 명도 없다. 더 늦기 전에 불법적 물리력 행사에 책임이 있는 사람이 법의 심판을 받도록 해야 한다.”고 강조했다.

이번 정책보고서 발표는 최근 국제사회에서 제기되는 한국의 평화적 집회의 자유 보장 실태에 대한 우려와도 궤를 같이 하는 것으로, 유엔 자유권위원회는 지난 해 한국의 자유권규약 이행상황 전반을 점검한 뒤 채택한 최종견해에서 실질적 허가제로 운용되는 신고제도, 과도한 물리력 행사, 차벽 사용 등에 평화적 집회의 권리가 심각히 제한되고 있다는 우려를 표했으며, 올해 초 한국을 방한한 평화적 집회 및 결사의 자유에 대한 권리에 관한 유엔 특별보고관 역시 비슷한 우려를 제기한 바 있다.

국제앰네스티는 한국의 치안 당국과 입법자들이 이번 정책보고서에 담긴 권고들에 귀를 기울여 한국 내 모든 사람이 평화적 집회의 권리를 완전히 향유하도록 법률과 관행상 필요한 조치를 취할 것이라 기대한다고 밝혔다.
