동남아시아: 해상 표류 중인 난민 수천 명, 즉시 구조 나서야

동남아시아 국가들은 보트에 표류하고 있는 수천여 명이 죽음의 위기와 절박한 상황 속에 방치되지 않도록 긴급 수색구조 작전에 나서야 한다고 국제앰네스티가 밝혔다. 이주민과 난민들로 추정되는 수백여 명을 실은 배가 현재 태국 연안에서 구조를 기다리고 있다.

국제앰네스티는 어린이를 포함해 약 350명을 가득 태운 보트 한 척이 현재 태국과 말레이시아 연안에 표류하고 있음을 확인했다. 미얀마 또는 방글라데시 출신으로 추정되는 이들은 바다 위에서 “오랜 시간”을 보냈으며, 최소 2개월 이상 지났을 것으로 보인다. 선원들은 수일 전에 배를 버리고 떠났으며, 배에 탄 사람들은 식량과 물이 없는 채로, 시급히 치료가 필요한 상태다. 현재 태국 해군이 보트를 수색 중에 있다.

케이트 슛체(Kate Schuetze) 국제앰네스티 아시아태평양 조사관은 “동남아시아 국가들은 즉시 이처럼 충격적인 인도주의적 위기를 종식시키기 위해 즉시 행동해야 한다. 해당 지역의 국가들이 조난자 구조를 위해 공동 수색구조 작전을 펼치는 것이 무엇보다 중요하다. 그렇게 하지 못할 경우 수천 명에 대한 사형선고나 마찬가지일 것”이라며 “지금 당장 수백 명이 물이나 식량 없이, 현재 자신들이 어디에 있는지도 모르는 채 죽음을 코앞에 둔 위험한 상태로 표류하고 있다는 것을 생각하면 끔찍한 일”이라고 말했다.

이보다 앞선 13일 오전에는 말레이시아 북부 페낭 섬 연안에서 500여명을 실은 배 한 척이 발견됐다. 말레이시아 정부는 배를 돌려보내고 난민들을 강제 추방하는 등의 강경책을 사용해 불법 입국자들에게 “올바른 메시지”를 전할 것이라고 밝힌 바 있다.

슛체 조사관은 “말레이시아 정부는 13일 해안에 도착한 수백 명을 처벌할 것이 아니라 지켜야 할 의무가 있다. 가장 절실히 필요한 의료적 지원을 제공하고, 어떠한 경우에도 이들을 바다로 돌려보내거나, 인권 또는 생명을 위협받는 장소로 보내는 일은 없어야 한다”며 “배에 타고 있던 사람들을 돌려보내겠다는 정부의 발언은 인간의 존엄성에 대한 모욕이다. 또한 만약 정부가 경고한 대로 조치할 경우, 말레이시아의 국제법적 의무를 위반하게 될 것”이라고 말했다.

지난 수 일간 미얀마와 방글라데시에서 배를 타고 말레이시아, 인도네시아로 도착한 난민의 수가 부쩍 증가했다. 11일에는 미얀마의 로힝야족으로 추정되는 400여명을 태운 보트 최소 한 척 이상이 인도네시아 아체 연안에서 발견되어, 식량과 연료를 전달받은 후 인도네시아 해군에게 예인되었다.

태국이 불법 입국을 단속하면서 밀수업자와 밀입국 브로커들이 새로운 경로를 물색할 수밖에 없었던 것으로 보인다. 국제이주기구(IOM)는 태국 근해에 여전히 8,000명 가량이 배를 타고 표류 중일 것으로 추정하고 있다.

방글라데시와 미얀마를 떠난 수천 명은 주로 미얀마에서 차별과 폭력을 피해 온 이슬람계의 로힝야족과 같은 취약한 이주민, 난민들과 인신매매의 피해자들로 구성되어 있다. 대부분 고향에서의 견딜 수 없는 상황을 벗어나고자 목숨을 걸고 위험한 바다로 나올 만큼 절박한 사람들이다.

슛체 조사관은 “위험에 처한 수천 명의 생명이 가장 우선되어야 하지만, 이러한 위기상황의 근본적인 원인 역시 해결되어야 할 것이다. 수천여 명에 이르는 로힝야족 사람들이 미얀마에 남아있기보다 위험한 밀항을 택했다는 사실은 현지의 상황에 대해 많은 것을 시사하고 있다”고 말했다.

South East Asia: Immediately step up efforts to rescue thousands at grave risk at sea

South East Asian governments must step up urgent search and rescue efforts to ensure that thousands of people stranded in boats are not left in dire circumstances and at risk of death, Amnesty International said, as another boat carrying hundreds of people thought to be migrants and asylum seekers in desperate conditions is currently awaiting rescue off the Thai coast.

Amnesty International has confirmed that a boat crammed with some 350 people, including children, is currently drifting off the coast of Thailand and Malaysia. The hundreds of people, believed to be from Myanmar or Bangladesh, have been at sea for “many days”, possibly more than two months. Their crew abandoned them several days ago. The passengers are without food and water and are in urgent need of medical care. Thai Navy vessels are currently searching for the boat.

“Governments in South East Asia must act immediately to stop this unfolding humanitarian crisis. It is crucial that countries in the region launch coordinated search and rescue operations to save those at sea – anything less could be a death sentence for thousands of people,” said Kate Schuetze, Amnesty International Asia Pacific Researcher.

“It’s harrowing to think that hundreds of people are right now drifting in a boat perilously close to dying, without food or water, and without even knowing where they are.”

Earlier today, a boat carrying some 500 people was found off the coast of Penang island in northern Malaysia. Malaysian authorities this week said they would use punitive measures, including pushing back boats and deporting migrants and refugees, to send the “right message” to irregular arrivals.

“The Malaysian authorities have a duty to protect and not punish the hundreds of people who reached the country’s shores today. They must be given the medical care they desperately need, and in no circumstances be sent back to sea or transferred to a place where their rights or lives are put at risk,” said Kate Schuetze.

“Comments by the authorities that they will turn back those arriving on boats are an affront to human dignity. What’s more, if authorities follow through with these threats, they will be violating Malaysia’s international legal obligations.”

In the last few days, increasing numbers of people from Myanmar and Bangladesh have arrived by boat in Malaysia and Indonesia. At least one boat with some 400 people believed to be Rohingya was on Monday towed out to sea by the Indonesian Navy, off the coast of Aceh, after it was provided with food and fuel.

A crackdown on irregular arrivals in Thailand seems to have forced smugglers and traffickers to look for new routes. The International Organization for Migration believes that 8,000 people may still be on boats close to Thailand.

The thousands of people who have fled Bangladesh and Myanmar include vulnerable migrants, refugees such as Muslim Rohingya fleeing discrimination and violence in Myanmar, and victims of human trafficking. Many are desperate enough to put their own lives at risk by braving dangerous journeys at sea in order to escape unbearable conditions at home.

“The thousands of lives at risk should be the immediate priority, but the root causes of this crisis must also be addressed. The fact that thousands of Rohingya prefer a dangerous boat journey they may not survive to staying in Myanmar speaks volumes about the conditions they face there,” said Kate Schuetze.

국제앰네스티는 보고서 발표 이후 전 세계적으로 삼성과 애플에 자사제품의 배터리 원료인 코발트 공급과정에서 벌어지는 인권침해를 조사하고 해결할 것을 촉구하는 탄원을 진행했습니다. 이 결과, 삼성 <2016 지속가능경영 보고서>와 삼성SDI <2015 지속가능성 보고서>를 통해 시급한 대응과 문제점 해결을 위한 방안 모색을 위해 노력할 것을 약속했습니다.

삼성SDI의 책임있는 광물 조달을 위한 노력
2016년 1월 인권단체 국제앰네스티는 아프리카 콩고 지역 코발트(Cobalt) 채굴 광산에서 발생하고 있는 아동노동 및 인권유린 실태와 글로벌 IT 기업들의 연관성을 다룬 보고서를 웹사이트에 게재하였습니다.

국제앰네스티는 해당 보고서에서 삼성SDI가 콩고 광산에서 아동 노동을 통해 채굴된 코발트를 공급받아 배터리를 생산했다는 주장을 제기하였고, 해당 주장과 관련하여 삼성SDI는 코발트 관련 협력회사에 대한 조사를 실시하고 있습니다. 서면 조사결과의 정합성 확인을 위해 6월부터 현장실사를 실시할 계획입니다. 그리고 2016년말까지 코발트 업스트림에 대한 보고서를 홈페이지에 공개토록 하겠습니다.

한편, 삼성SDI는 아동노동 등 인권 침해에 대해 엄격한 무관용 원칙에 따라 적극적인 조사와 개선 활동을 전개하고 있습니다.

2016년 4월 22일, 삼성SDI는 OECD, CCCMC*가 주관하고 콩고민주공화국 등 정부기관, NGOs, 코발트 공급회사, 이차전지 제조사, IT기업들이 참석한 코발트 이슈 공동 대응 국제 워크숍에 참석하여 콩고 광산의 인권문제를 개선하고 투명성을 높이기 위한 방안을 협의했습니다. 앞으로도 지속가능한 코발트 공급에 대한 공동의 이니셔티브(Initiative)에 적극 참여하는 한편, 공급망에 대한 지속적인 조사를 통해 광물 조달과정의 투명성과 추적성을 높이고 공급망 내의 인권 보호를 위하여 협력회사들과 함께 다각적인 노력을 펼쳐나갈 계획입니다.

Samsung SDI’s efforts for responsible mineral procurement

In January 2016, a global human rights NGO, Amnesty International disclosed a report of relations between IT companies and child labor or human rights issues occurred in cobalt mines in Congo, Africa.

In the report, Amnesty claimed that Samsung SDI produced batteries using cobalt mined from child labor in Congo. Therefore, Samsung SDI has begun investigations on its cobalt suppliers, and it plans to conduct site visits(due diligence) in order to verify the results of document investigation. We will share the report of upstream supply chain of cobalt on our website by the end of 2016.

Meanwhile, we are expanding our activities in investigating and improving issues related to human rights including child labor, in accordance with the zero tolerance policy.

On April 22, 2016, Samsung SDI attended. The International Workshop in the Resonsible Cobalt Supply Chain that was organized by the OECD and CCCMC* for joint actions toward cobalt issues. at the workshop, we discussed plans to improve human rights issues and increase transparency in Congo mines along with the Congo government institutions, NGOs, cobalt suppliers, secondary cell manufacturers, and IT companies. Furthermore, we will not only engage in joint initiative for sustainable supply chain of cobalt, but also take measures to secure transparency and human rights with our suppliers through continuous monitoring of the supply chain.

Management of Minerals at Issue
On top of conflict minerals matters, issues regarding human rights violations and environmental degradation caused by the mining of minerals, such as tin on Bangka Island, Indonesia and cobalt in the Democratic Republic of the Congo, are raising concerns among stakeholders. . . . [C]hild labor has long been highlighted as a problem at cobalt mines in the Democratic Republic of the Congo and has recently come to garner much attention. Given the nature of this issue, however, joint efforts among governments, NGOs and corporations are urgently needed. Samsung is well aware of the corporate world’s responsibilities and roles with problems caused by the mining of minerals. As a result, we have pledged to redouble our efforts and find ways to resolve these challenges by listening to greater numbers of stake-holders and actively participating in joint initiatives.

네팔의 헌법 개정에 반대하는 시위대를 향해 경찰이 발포하는 사례가 잇따르면서 최소 20명이 숨진 가운데, 네팔 보안군은 시위대에 과도한 무력 사용을 자제해야 할 것이라고 국제앰네스티가 밝혔다.

격화되는 시위를 진압하기 위해 보안군이 무력을 사용하고 실탄을 발사하면서 8월부터 이미 40명 이상이 목숨을 잃었고, 사망자 대부분은 시위대였다.

네팔 국가인권위원회와 국제앰네스티를 비롯한 시민사회의 조사 결과, 사망자가 발생한 시위의 경우 대부분 보안군의 무력 사용이 과도하고 부적절하거나 불필요해, 국제법 기준을 위반하는 것으로 드러났다.

데이빗 그리피스(David Griffiths) 국제앰네스티 동남아시아 조사국장은 “최근 수 주 동안 40명이 넘는 사람이 목숨을 잃었고, 이들 대부분이 시위대였다. 국제앰네스티는 네팔 정부에 보안군을 통제하고 과도한 무력을 사용하지 못하도록 할 것을 재차 촉구한다”고 말했다.

21일 무력충돌이 발생한 태국 남부의 비랏나가르, 빌간지, 말랑와 지역은 특히 최근 긴장이 높아지고 있던 지역이다. 이들은 신규 헌법에서 남부 평원지대의 부족별 거주지역을 통합하고 새로운 주별 경계를 나눈 것에 반발하고 나섰다.

제정까지 7년 이상이 소요된 신규 헌법에서는 네팔을 7개 주로 구성된 비종교적 민주공화국으로 선포했다. 그러나 소수민족의 대표성을 반영하기에 충분하지 못하다는 주장과, 네팔을 다시 힌두교 국가로 선포해야 한다는 힌두교 활동가들의 거센 반발에 부딪혀 왔다.

데이빗 그리피스 국장은 “네팔 신규 헌법은 이외에도 시급히 다뤄져야 할 주요 인권 문제를 다수 포함하고 있다. 특히 여성과 소외계층의 권리를 명백하고 충분하게 보호하지 못하고 있다”고 말했다.

Nepal: Police restraint urged as at least 20 more shot amid Constitution-related protests

Security forces in Nepal must refrain from using excessive force against protesters, Amnesty International said after at least 20 protesters were shot when security forces opened fire on several demonstrations against the country’s new constitution.

Force and the use of live ammunition by security forces to contain often violent protests have already claimed more than 40 lives in Nepal since August, most of them protesters.

Investigations by Nepal’s National Human Rights Commission and civil society, including Amnesty International, have found that in many of the protest-related deaths, the force used by security forces was excessive, disproportionate or unnecessary, contrary to international legal standards.

“More than 40 people, the majority of them protesters, have been killed in recent weeks. We continue to urge the Nepali authorities to rein in their security forces and prevent them from using excessive force,” said David Griffiths, Research Director for South Asia at Amnesty International.

Today’s clashes took place in the southern cities of Biratnagar, Birgunj and Malangawa where tensions have been high for weeks because of controversial federal boundaries drawn up in the new constitution, which split up the homelands of ethnic groups from Nepal’s southern plains.

The constitution, which took more than seven years to complete, defines Nepal as a secular republic divided into seven federal provinces. It has been fiercely opposed by ethnic minority groups who argue that it does not afford them sufficient representation, as well as Hindu activists who believe the constitution should have restored Nepal as a Hindu nation.

“The new constitution has a number of major human rights shortcomings which also need to be urgently addressed. In particular, the rights of women and marginalized communities are not clearly and sufficiently protected,” said David Griffiths.

중국 법원이 인권변호사 푸즈창에 대해 징역형과 3년의 집행유예를 선고한 것은 표현의 자유를 옹호하는 사람에게 족쇄를 채우려 하는 중국 정부의 고의적인 시도라고 국제앰네스티가 22일 밝혔다.

22일 베이징의 한 법원은 푸즈창에 대해 “분란을 조장하고 물의를 일으킨 것”과 “인종 혐오를 조장”했다는 혐의로 징역 3년과 집행유예 3년을 선고했다. 이러한 판결의 주된 근거는 푸즈창이 소셜미디어에 올린 총 600여자의 게시물 7건으로, 중국 정부 관료와 경찰을 비판하는 내용이었다.

윌리엄 니(William Nee) 국제앰네스티 중국 조사관은 “푸즈창이 또 하루를 감옥에서 보내지 않아도 된다는 것은 분명 긍정적인 일이나, 이것이 매우 부당한 판결이라는 사실은 숨길 수 없다. 푸즈창은 범죄를 저지르지 않았으며, 이번 유죄 판결은 중국에서 가장 용기 있는 인권변호사가 변호 활동을 할 수 없도록 실질적으로 족쇄를 채운 것”이라며 “푸즈창은 이미 18개월이 넘는 시간을 구금되어 있었으며, 이렇게 오랫동안 조사를 벌였음에도 정부가 수집할 수 있었던 유일한 ‘증거’는 정부를 비판한 게시물 7건뿐이었다. 푸즈창은 중국에서 가장 적극적으로 표현의 자유를 옹호한 사람이며, 단지 표현의 자유를 행사했다는 이유만으로 재판을 받고 있다”고 말했다.

22일 오전, 경찰은 베이징 제2중급인민법원 앞에서 푸즈창을 지지하기 위해 모인 활동가들 최소 12명을 체포했다.

푸즈창의 재판이 열린 12월 14일에는 신원을 알 수 없는 사람들과 경찰이 법원 앞에 있던 외신 기자들과 외교관, 푸즈창의 지지자들을 난폭하게 해산시켰다. 지지자들 중 약 20명이 경찰에 체포되었고, 평화적인 시위에 참여했다는 이유로 현재 최소 4명이 형사 구금되어 있으며 변호사 접견도 허용되지 않고 있다. 이외에도 지지자 중 5명의 행방을 알 수 없어, 마찬가지로 구금됐을 것으로 우려된다.

윌리엄 니 조사관은 “푸즈창의 재판이 있던 법원 앞에서 벌어진 경찰의 부끄러운 활동은 오히려 중국에 푸즈창과 같은 표현의 자유를 옹호하는 사람이 반드시 필요한 이유를 더욱 부각시켰을 뿐이다. 푸즈창에 대한 지지를 평화적으로 표현한 것만으로 구금된 사람들 역시 모두 조건 없이 즉시 석방되어야 한다”고 말했다.

 

배경

푸즈창은 2014년 5월 6일 베이징에서 1989년 천안문 사태에 대한 조사를 촉구하는 민간 세미나에 참석했다가 처음으로 경찰에 체포되었다. 중국 정부의 투명성 증진과 부정부패 폭로를 목적으로 하는 활동가 연합 ‘신공민 운동’ 관련 사건 등, 다수의 ‘민감한’ 인권 사건의 변호를 맡았다.

Guilty verdict against lawyer Pu Zhiqiang a gross injustice

The three year suspended prison sentence handed down against human rights lawyer Pu Zhiqiang is a deliberate attempt by the Chinese authorities to shackle a champion of freedom of expression, Amnesty International said today.

On Tuesday, a court in Beijing sentenced Pu Zhiqiang to three years in prison, suspended for three years, for “picking quarrels and provoking troubles” and “inciting ethnic hatred”. The conviction was primarily based on seven social media posts, in total approximately 600 characters, in which Pu criticized government officials and polices.

“Clearly it is positive that Pu Zhiqiang is unlikely to spend another night in jail, yet that cannot hide the gross injustice against him. He is no criminal and this guilty verdict effectively shackles one of China’s bravest champions of human rights from practicing law,” said William Nee, China Researcher at Amnesty International.

“Pu Zhiqiang has already been detained for more than 18 months, and despite investigating Pu for so long, the only ‘evidence’ the authorities could muster against him were seven social media posts in which he criticized the government. He is one of China’s most courageous defenders of the right to freedom of expression, and he’s been persecuted for simply exercising that right.”

On Tuesday morning, police detained at least 12 activists outsideBeijing No. 2 Intermediate People’s Court who had come to show their support for Pu Zhiqiang.

At Pu’s trial on 14 December, unidentified individuals and police manhandled foreign journalists, diplomats and his supporters outside the court. Approximately 20 of his supporters were taken away by police. At least four people are now criminally detained for taking part in the peaceful protest, and have been denied access to lawyers. A further five supporters have not been heard from since and it is feared they are also detained.

“The disgraceful police operation outside Pu Zhiqiang’s trial only underscores why China needs defenders of free speech like Pu more than ever. All those detained solely for peacefully expressing their support for Pu should also be immediately and unconditionally released,” said William Nee.

Background

Pu Zhiqiang was originally detained by police on 6 May 2014, after he attended a private seminar in Beijing that called for an investigation into the 1989 Tiananmen crackdown. He has represented individuals in many ‘sensitive’ human rights cases, including those linked with the ‘New Citizens’ Movement’, a loose network of activists who aim to promote government transparency and expose corruption.

63 CSOs Call on JBIC to Reject Financing for Batang Coal Plant in Indonesia

At the proposed project site of the controversial 2,000-megawatt coal-fired power plant in Batang, Central Java, Indonesia, further cases of human rights violations have been reported. Most recently, the Indonesian army has put and leveled the soil in the majority of farmlands which the landowners have not yet agreed to sell for the project.

 

On September 25, the undersigned 63 organizations from 20 countries, have submitted the urgent petition as below to call on Japan Bank for International Cooperation (JBIC) to reject financing for the project, which has been pushed through in the forcible way, neglecting the local people’s opinion and rights.

 

Despite this serious human rights violation against the local community, JBIC is still considering funding the coal plant in Batang, which will cost US$ 4 billion. Japanese companies, “J Power” Electric Power Development Co. and Itochu Corp, have already decided to invested in the project. And JBIC is currently planning to finance around US$ 1.6 billion.

 

Ongoing and strong concerns regarding a loss of livelihoods, such as farming and fishing, have been raised persistently by local communities, and the project has been unable to proceed for nearly four years. 67 landowners who own some of the proposed project site are still refusing to sell their land.

 

In the end of July, three local villagers came to Japan to submit their objection to JBIC and talked directly to the Japanese decision-makers and public about the serious human rights violations they have experienced, such as intimidation and arbitrary arrest at the hands of the army, the police and the thugs. To date, JBIC hasn't yet decided its finance for the project mainly due to the incompletion of the land acquisition. But the military has already cleared and leveled the farmland which the landowners haven't yet sold. This situation might be used by JBIC as a excuse for the completion of land acquisition. And JBIC might make a loan agreement with the project proponent on the occasion of the deadline for the financial closure of this project, or around October 6, 2015.

 

The urgent petition calls on JBIC to reject financing for the project, following its own environmental and social guidelines. JBIC must sincerely listen to the concerns and opinion of the local people, but being not complicit in those serious human rights violations against the local community the project has resulted in.

Urgent Request to Reject Japanese Public Financing

for the Proposed Batang Coal-fired Power Plant, Central Java, Indonesia

 

 

At the proposed project site of the Batang Coal-Fired Power Plant in Central Java, Indonesia, which the Japan Bank for International Cooperation (JBIC) is currently considering its finance for, the military engineer of the Indonesian army has resumed land clearing with heavy equipment since September 11, 2015. They have put and leveled the soil in the majority of farmlands which the landowners have not yet agreed to sell or to be acquired, and have also destroyed almost all the irrigation systems for their farmlands. We, the undersigned 63 organizations from 20 countries, express our strong objection against and deep regret at the forcible way with which the project has been pushed through, neglecting the local people’s opinion and rights and committing human rights violations in a highly oppressive manner, and call on JBIC not to finance for the project. 

 

Ongoing and strong concerns regarding loss of livelihoods, such as farming and fishing, and health impacts from pollution, have been raised persistently by local communities, and the project has been unable to proceed for nearly four years. During this period, community leaders opposing the project and landowners refusing to sell their land in the proposed project site have been subject to repeated human rights violations, such as intimidation, violence, and arbitrary arrest and detention at the hands of the army, the police, and other actors. Despite these human rights violations, 67 landowners who own some of the proposed project site are still refusing to sell their land. Also, an administrative court case has been filed at Semarang City, Central Java, questioning the legality of the acquisition process based on Law No. 2 of 2012 on Land Acquisition in this project, and the public hearing is still continuing. 

 

On July 29, 2015, 23 members of the local community submitted an official objection to JBIC. In the submission, the local community pointed out how the project has failed and will fail to comply with many provisions of the JBIC Guidelines for Confirmation of Environmental and Social Considerations (the Guidelines), as it has made/will make their life worse and has caused/will cause violations of human rights. JBIC have already conveyed the local community’s objections to the project proponent, according to “Summary of Procedures to Submit Objections concerning JBIC Guidelines.” And the project proponent under the Guidelines is expected to take steps to bring the project into compliance by making appropriate environmental and social considerations. 

 

For one and a half month, however, there have been no improvements on the ground. Instead, further cases of human rights violations have been reported from the local area. The intimidation to force the landowners to sell their land has been continuing by local thugs, who are supposedly hired by the pro group for the project and visited the landowners’ houses in the midnight. When President Joko Widodo came to Batang for the “kick-off construction” ceremony on August 28, 2015, the local community who are opposing the project tried to convey their opposition to the President. But high-pressure water cannons belonging to the army and police prevented them from even coming close to the ceremony venue. Further, despite not having any “consent” of the landowners and farmers, the land clearing work has commenced again by heavy equipment of the Indonesian army since September 11, 2015, who just very easily destroyed the land which used to be very fertile enough for the farmers to harvest the rice three times a year.

 

This situation raises two important questions for us: first is whether the project proponent and the Indonesian government, who have important roles to play in terms of environmental and social considerations in this project, currently have intention to implement the project with appropriate environmental and social considerations according to the Guidelines, and the second is whether they actually have capacity to implement the project with appropriate environmental and social considerations in the future. 

 

JBIC Guidelines states that “If, as a result of its environmental review, JBIC judges that appropriate environmental and social considerations are not ensured, it will encourage the project proponent, through the borrower, to undertake appropriate environmental and social considerations. If appropriate environmental and social considerations are not undertaken, there may be cases where funding is not extended.” 

 

As the deadline for the financial closure of the project is October 6, 2015, it is assumed that JBIC would is being urged to make a decision. Given the following situations, we call on JBIC to reject financing for the project, taking the outcomes of its environmental reviews into account for decisions on funding: 

 

 

(i) In the objection paper, the local community pointed out how the project has failed and will fail to comply with many provisions of JBIC Guidelines, which haven’t been improved or solved yet. 

 

(ii) Even after JBIC had already conveyed the contents of the objection paper to the project proponent, no appropriate environmental and social consideration has been made since then (to rectify matters). 

 

(iii) In light of the factors, such as the intention and the capacity of the project proponent and host government, who have important roles to play in this project, it is very uncertain whether appropriate environmental and social considerations can be ensured after JBIC makes a decision to finance the project. 

 

 

We request that the Japanese government and JBIC sincerely listen to the concerns and opinion of the local people and take a strong and resolute position to reject its finance, but being not complicit in those serious human rights violations against the local community the project has resulted in. We will wait for your response.

그린피스(Greenpeace) 러시아지부와 북코카서스 환경감시단(Environmental Watch for the North Caucasus)의 자원 소방관과 활동가들은 지역 활동가 교육과 산불 진화 작업에 공동으로 참여하기 위해 크라스노다르 지역을 방문했다. 그런데 9월 8일 밤, 몽둥이와 칼, 고무탄 권총으로 무장한 복면 괴한 8여명이 이들이 야영하던 장소에 공격을 가했다. 이로 인해 활동가 여러 명이 다쳤으며 그 중 두 명은 입원치료를 받아야 했다. 괴한들은 텐트를 망가뜨리고, 자동차 타이어를 칼로 긋고 앞 유리를 부수는 등의 피해도 입혔다.

한편 같은날 코사크* 복장을 한 사람들이 러시아 비상부 기지를 방문하려던 활동가들을 가로막고, 이 지역을 떠나라고 한 사건도 있었다. 활동가들은 익명의 협박을 받고, 야영지는 낙서로 훼손되기도 했다.

Russia: Violence against Greenpeace activists amid ongoing assault on freedom of association

Responding to the violent attack last night by masked men on activists from Greenpeace Russia and Environmental Watch for the North Caucasus camp in Krasnodar Region (Southern Russia), Amnesty International said:

“The violent attack on Greenpeace and Environmental Watch activists who came to Krasnodar Region to help extinguish forest fires takes a step further the ongoing assault on the right to freedom of association in Russia. Whoever is behind this vicious act, it clearly happens in the context of reprisals and smear campaigns against independent civil society organizations which have been orchestrated by the authorities. Failure to investigate this incident promptly and effectively, and to protect the activists from further violence would be akin to official acquiescence in this attack,” said Sergei Nikitin, Head of Amnesty International’s office in Russia.

Background

Volunteer fire-fighters and activists from Greenpeace Russia and Environmental Watch for the North Caucasus had come to Krasnodar Region to train local activists and jointly help extinguish forest fires. On the night of 8 September, a group of around eight masked men armed with batons, knives and rubber-bullet pistols attacked the site where they were camping. Several activists were injured, and two had to be hospitalised. The assailants also damaged their tents and slashed their vehicles’ tyres and broke their windscreens.

On 8 September a group of men dressed as Cossacks (uniformed paramilitaries who are often involved informally in local policing), prevented the activists from visiting the base camp used by the Ministry of Emergencies personnel. The Cossacks told them to leave the region. The activists had also received anonymous threats, and their campsite was vandalised with graffiti.
