전쟁과 인권침해, 충격적인 인도주의적 위기의 수렁에 빠져 버린 남수단의 어느 한 구석진 지역, 대부분이 간과하고 있는 인권 위기로부터 피해 온 난민들은 오늘도 이곳으로 끊임없이 몰려오고 끊임없이 수많은 난관에 부딪히고 있다.

이다와 아융 톡 지역의 난민캠프는 남수단 통일 주(Unity State – 현재 남수단 내전으로 가장 치열한 접전이 벌어지는 지역의 이름으로는 잔인하게도 역설적인 이름이다)의 북쪽 끄트머리이자, 2011년 7월 수단으로부터 독립한 이후 지도에 선명하게 새겨진 남수단의 국경과 매우 가까운 지역에 위치해 있다.

이곳의 난민들은 이웃나라 수단의 남부 코르도판에서 온 사람들로, 코르도판 지역은 4년간 이어진 무력분쟁과 수단 정부군의 대규모 무차별 공격으로 인권 위기에까지 이르렀지만 크게 주목받지는 못하고 있는 곳이다.

이들 난민의 수는 약 95,000명 정도로, 매일 계속해서 늘어나고 있다. 전쟁으로 황폐화된 남수단에까지 피난을 오는 절박함이란 어떤 것일지 상상해 보라. 남부 코르도판에서 계속되는 폭격과 공포, 기근을 견디는 것에 비하면 훨씬 나은 선택이라는 것이다.

통일 주의 난민들은 주로 두 곳의 난민캠프에 정착해 있다. 현재 우리 팀이 지내고 있는 이다 캠프에 70,000명, 근처의 아융 톡 캠프에 나머지 25,000명이 있다. 앰네스티의 조사팀으로 이다 캠프를 찾은 것은 3년 연속 세 번째다. 이미 이곳의 산적한 문제들에 대해서는 잘 알고 있었고 마음이 편치 않았던 터라, 믿기 힘들리만치 취약한 상태에 놓인 이곳 난민들의 인권을 보장할 해결책 마련을 위해 더욱 박차를 가해야만 한다고 생각했다.

말로 다하지 못할 잔혹행위로부터 살아남은 사람들은 이곳에서 의식주, 물과 같은 기본적인 생활요건을 구하는 등 일상으로 돌아가기 위해 안간힘을 쓰고 있다. 하늘의 별 따기나 마찬가지인 교육에 대한 열망을 채우는 것도 마찬가지인 듯하다.

2011년 마련된 이후로 이다 캠프의 위치에 대해서는 지금까지도 논란이 계속되고 있다. 수단군과 반군인 수단인민해방운동(SPLA-N)간의 교전이 계속되고 있는 수단의 국경으로부터 불과 20km밖에 떨어지지 않은 지역이기 때문이다.

우리 팀이 2012년 이곳에 도착했을 당시 나이엘 지역의 새로운 난민캠프로 난민들을 이주시키고자 하는 시도가 진행 중이었다. 그러나 나이엘은 우기가 되면 늪지대로 변할 위험이 있었고, 결국 무산되었다. 2013년에 이곳을 찾았을 때는 아융 톡 지역으로의 이주를 계획하고 있었다. 이번에는 반군 점령지역 근처에 위치한 이다와는 달리, 수단군이 점령한 국경 지역에 가까워진다는 이유로 다들 이주를 꺼렸다.

하지만 시간이 흐르고 아융 톡 캠프에도 난민들이 자리를 잡기 시작했다. 대부분 새로 도착한 난민들이었다. 남부 코르도판 지역의 폭격이 절정에 이르는 건기인 12월 말 이후로 10,000명이 정착했다.

난민캠프의 위치와 이주에 관한 논란 속에는 타당한 우려와 터무니없는 소문이 뒤섞여 가득했다. 최대한 난민보호원칙을 고수하려 했지만, 정치적 입장을 배제할 수는 없었다.

그렇기에 이번에 방문했을 때에도 누구나 가장 먼저 떠올린 주제가 새로운 캠프 부지와 이주 계획이었던 것은 놀랍지도 않은 일이었다. 이번에도 어김없이 입장 차이는 있다. 남수단 정부가 승인하고 유엔과 공여국들이 지지하는 지역이 있는 한편, 난민 대표들은 다른 지역을 고집하고 있다. 이 문제가 어떻게 해결될지는 전혀 모를 일이다. 난민들에게 총을 들이밀고 트럭에 강제로 실을 일은 없겠지만, 난민 문제를 놓고 이리저리 밀고 당기기를 계속하는 다른 세력들이 많은 것도 사실이다.

특히 인상 깊었던 것은 캠프의 난민 대표 중 한 사람이 했던 말로, 이전에도 비슷한 말을 들어본 적이 있었다. 그 사람은 이렇게 물었다. ‘왜 우리의 의견은 들어주지 않는가? 우리의 안전에 대해, 우리 아이를 학교에 보내고, 곡식과 가축을 기르면서 삶을 재건하게 될 장소에 대해 우리가 스스로 결정할 수는 없는가?’ 지난번 이곳을 방문했을 때 한 난민 여성이 열변을 토하며 했던 말이 떠올랐다. 자신과 아이들이 가장 안전할 곳은 그 누구보다도 자신이 가장 잘 안다는 것이었다.

이곳에 올 때마다 언제나 통감하는 걱정거리 중 하나는 교육이다. 이번에도 역시 캠프에 머무르는 동안 언제나 주로 나오는 대화 주제는 교육에 대한 것이었다.

난민들이 이다 캠프에 장기간 정착해서는 안 된다는 것이 국제 공여국들의 입장이기 때문에, 영속성을 부여할 것이라고 우려되는 계획이나 프로그램 다수에 대해서는 투자하기를 거부했다. 여기에는 학교도 포함되어 있다. 65,000명이 살고 있는 캠프에서 학교에 다닐 나이의 어린이의 수는 얼마나 될까? 초등학생 나이인 어린이만 약 16,000명에 이른다. 이다 캠프가 생긴 지 4년이 지났지만, 국제사회가 지원해 설립된 학교는 한 곳도 없다. 어린이의 인생 중 4년이 허비되어 버린 것이다. 유니세프에서 지급한 파란 책가방도 없고, 유럽연합에서 지원금을 받는 선생님도 없고, 캐나다와 호주에서 보내 온 공책과 연필도 없으며, 남아프리카가 지어 준 학교 건물도 없다. 모든 어린이들은 어떤 상황이든 관계없이 자유롭게 의무 초등교육을 받을 권리가 있음에도 불구한 일이다.

물론 아융 톡 캠프에는 학교가 마련되어 있다. 이곳으로 이주할 만한 이점이 되는 것이다. 그러나 그렇게 이주한 난민은 일부일 뿐, 대부분은 이다 캠프에 남았다. 여전히 수천여 명의 청소년들은 잠자리와 마찬가지로 최소한의 자재로만 지어진 임시 학교에서 공부하고 있다. 난민들 중에서 교사로 자원한 사람들은 최선을 다해 가르치고 있다. 이들 중에는 교사였던 사람도 있지만, 대부분은 평범한 사람들이다. 학부모들은 1년에 약 4달러 가량의 교육비를 내야 하는데, 이곳 난민들 대부분에게는 마련하기 힘겨운 액수일뿐더러, 무상으로 초등교육을 받아야 할 기본권을 침해하는 것이다.

이다와 아융 톡 캠프 각각에 어떤 이점이 있든, 또한 현재 논란이 되고 있는 두 지역의 위치가 어떻든 간에, 교육권이라는 중요한 인권이 협상 카드처럼 이용되고 있다는 것이 어쩐지 우려가 된다.

왜냐하면, 오늘 한 대표가 했던 말과 같이, 교육이 중단되면 한 세대를 잃게 되기 때문이다. 그리고 이처럼 간과되고 있는 인권 위기에 처한 어느 한 구석진 곳의 난민들은, 이처럼 큰 손실을 감당할 여력이 없다.

‘Stop education, lose a generation’ – Tough lessons for refugees fleeing Sudan’s overlooked crisis

In a forgotten corner of South Sudan – a country itself mired in war, human rights violations and a staggering humanitarian catastrophe – refugees from a largely overlooked human rights crisis continue to arrive and continue to face immense challenges.

The refugee camps of Yida and Adjoung Thok lie inside the northern tip of the country’s Unity State (a cruelly ironic name for a state that has seen some of the worst fighting in the country’s current civil war), very close to the border that was etched into atlases when it gained independence from Sudan in July 2011.

They have arrived here from neighbouring Sudan’s Southern Kordofan state, where an overlooked human rights crisis has played out during four unrelenting years of armed conflict and at the Sudanese armed forces’ massive and indiscriminate military assault.

These refugees number around 95,000 and continue to arrive daily. Just imagine the desperation that makes fleeing to war ravaged South Sudan, a more attractive option than enduring the bombing, terror and hunger in Southern Kordofan.

In Unity State, refugees are primarily divided between two camps: 70,000 in Yida, where we are today, and another 25,000 in nearby Adjoung Thok. This is the third time in three years that I have been to Yida with an Amnesty team. Already I feel heavy with the familiarity of the immense challenges here, and determined that we must press harder for solutions that ensure the rights of an incredibly vulnerable population are upheld.

Here the survivors of untold endless atrocities grapple with normalising their lives; seeking basic needs of food, water, shelter and clothing and perhaps even satisfy the yearning of a much elusive education.

Since it was set up in 2011, there has been controversy about Yida’s location, only some 20 kilometres from the border with a country where war continues to rage between the Sudanese military and the Sudan People’s Liberation Army – North (SPLA-N) opposition forces.

We were here in 2012 and there were efforts under way to encourage refugees to move to a new camp, Nyel, which it was feared would turn into a swampy bog during the rainy season. That failed. We were here in 2013 and the plan was a move to the new Adjoung Thok site. This time refugees feared it took them closer to a border area controlled by the Sudanese military, whereas the border near Yida is patrolled by the SPLA-N.

With time, however, Adjoung Thok has begun to fill up, mainly with newly arriving refugees (there have been 10,000 since the end of December, the dry season which saw a spike in bombings in Southern Kordofan).

Those debates about location and moving were fraught with legitimate fears and rampant rumours. They were about sticking to refugee protection principles, but politics have played a role as well.

And so, on this current visit it comes as no surprise that the first topic on everyone’s mind is, again, a new site and plans to move. And once again there is disagreement. The South Sudanese government has approved one site, now backed by the UN and donor states; refugee leaders are pressing for another. It is not at all clear how it will unfold. There is no prospect of forcing refugees onto trucks at gunpoint. But there are many other forces pushing and pulling them in several different directions.

Particularly telling for me today were the words from one of the leaders in the camp, variations of which I’ve heard before. He asked: why don’t our views matter? Why don’t we get to decide about our own security, where we will send our kids to school, and where we will try to rebuild our lives by growing a bit of food? I remembered the fiery insistence of a refugee woman on my last visit that she was the one, better than anyone, who knew where she and her children would be safest.

One pressing concern that has repeatedly come up so poignantly every time I have been here is education. It has again certainly been prominent in all of our conversations in the camp today.

Because international donors think refugees shouldn’t be settling in Yida for the long term, they have refused to fund a number of programmes and initiatives that they fear would give it a sense of permanence. That has included schools. Imagine the numbers of school-age children in a camp of 65,000 people. There are around 16,000 of primary school age alone. Four years into Yida’s existence, there are no schools funded by the international community – four wasted years in a child’s life. No UNICEF blue backpacks, no teachers salaried by the European Union, no notebooks and pencils coming in from Canada and Australia, no schools constructed by South Africa. This is despite the fact that all children, whatever their circumstances, have a right to free and compulsory primary education.

Schools are on offer in Adjoung Thok of course; and that is meant be an incentive to move there. It has encouraged some, but most remain at Yida. So thousands of students are learning in makeshift schools built with the same rudimentary materials as the shelters they sleep in. Volunteers from among the refugee community (some of whom were teachers, most not) do their best to teach. And refugee families are asked to pay a school fee (the equivalent of about $4 per year, which most families here struggle to come up with, and which runs contrary to that universal right to free primary education).

Regardless of the merits of Yida versus Adjoung Thok, or of the two locations that are the subject of the current dispute, there is something worrying about using such an important human right, the right to education, as a bargaining chip.

Because as one leader put it to us today, when you stop education, you lose a generation. And this overlooked crisis in a forgotten corner cannot afford that loss.

무하마두 부하리(Muhammadu Buhari) 나이지리아 대통령이 지난 5일 니제르델타 오고니랜드 지역의 방제사업에 신탁기금을 투입하겠다고 발표한 것은 환영할 일이나, 쉘의 비효율적인 방제방법이 전면 재정비되지 않는다면 그 효과는 제한적인 수준에 그칠 것이다.

니제르델타를 방문하고 돌아온 마크 더멧(Mark Dummett) 국제앰네스티 기업과인권 조사관은 “이제는 북극 원유 추출 사업을 노리고 있는 쉘이 기름 방제대책에 대한 유엔 전문가집단의 조언을 오랜 시간이 지난 지금까지도 적절히 따르지 못하고 있다는 것은 말도 안 되는 일”이라며 “쉘이 기름 방제방법을 대폭 개선하지 않는 한 부하리 대통령의 계획은 실패할 것이며, 오고니랜드 주민들은 계속해서 고통받게 될 것”이라고 말했다.

신탁기금 조성은 유엔 환경프로그램(UNEP)이 4년 전 오고니랜드의 기름오염 사고에 대해 보고서를 발표하면서 중점적으로 권고한 사항이다. UNEP는 이에 더불어 쉘의 방제방법에 대해 방법론적 검토를 거치고 유출사고에 대한 심각한 늑장 대응 문제를 해결하는 등의 개선이 시급히 이루어져야 한다고 촉구했다.

그러나 8월 유출사고 발생 현장을 방문한 국제앰네스티 조사관들은 쉘측이 최근 방제사업을 실시했다고 보고한 지역의 토양과 인근 수역에서 여전히 남아 있는 기름을 발견했다.

방제사업을 위해 조성된 기금은 오고니랜드 주민 대표단과 유엔, 나이지리아에서 원유를 추출하는 원유기업 및 나이지리아 정부가 직접 감독하게 된다. 정부는 ‘주주’들이 최초 1,000만달러를 기금에 투자할 것이라고 밝혔으나 누가 주주가 될 것인지는 분명하지 않다.

UNEP는 최소 30년까지 걸릴 수 있는 방제사업의 최초 5년간 발생하는 비용을 충당하려면 10억달러의 기금이 마련되어야 한다고 추정했으나, 이에 비해 1,000만달러는 턱없이 부족한 수준이다. UNEP는 보고서를 통해 원유기업과 정부 양측이 모두 기금 마련에 기여할 것을 권고했다.

마크 더멧 조사관은 “오고니랜드 지역은 수 년 동안 계속된 원유 유출로 황폐화되고 있지만 쉘의 방제작업은 전혀 효력을 나타내지 못하고 있다”며 “2011년 UNEP는 쉘의 오염지역 방제방법에 다수의 심각한 문제점이 존재한다고 지적한 바 있다. 그러나 직접 오염지역을 방문해 보니 여전히 기름때가 곳곳에 널려 있었다. 직접 본 바로는 그 이후로 거의 아무런 변화가 없었다”고 말했다.

나이지리아 정부는 5일 보도자료를 발표하고, “오랫동안 미뤄져 왔던 기금마련 등의 UNEP 권고사항 적용을 빠르게 진행하기 위해 다수의 조치를 취할 것을 부하리 대통령이 승인했다”고 밝혔다.

신탁기금 조성은 나이지리아 시민단체 및 국제앰네스티를 비롯한 국제 비정부단체가 중점 요구한 사항으로, 국제앰네스티는 UNEP 보고서가 발표된 지 4년째인 2015년 8월 4일 부하리 대통령에게 이러한 기금 마련을 요청하는 합동서한을 제출했다.

쉘은 1993년 오고니랜드에서 강제 철수했으나, 여전히 이 지역에 남아 있던 쉘의 송유관에서 원유유출 사고가 발생해 이에 대한 책임이 있다.

오고니랜드는 니제르델타에서 원유 유출로 오염된 수많은 지역 중 단 한 곳에 불과하다. 국제앰네스티가 최근 통계를 분석한 결과 로열 더치 쉘(Royal Dutch Shell)과 이탈리아 다국적 거대 석유기업인 ENI는 지난해 니제르델타에서 550건 이상의 원유 유출이 있었음을 인정했다. 이에 비해 1971년부터 2011년까지 유럽 전 지역을 통틀어 발생한 원유 유출 사고는 평균적으로 한 해 10건씩에 불과했다.

Nigeria: Shell must match government’s commitment to clean oil spills

Shell must match the Nigerian government’s new commitment to tackle oil pollution in the Niger Delta by dramatically improving how it cleans up spills, Amnesty International said today.

President Muhammadu Buhari’s announcement on Wednesday of a trust fund to pay for the clean-up of the Ogoniland region in the Niger Delta is welcome, but if Shell’s ineffective clean-up methods are not fully overhauled, its impact will be limited.

“It is scandalous that Shell – which now wants the world to trust it to drill in the Arctic – has failed to properly implement the UN’s expert advice on oil spill response after so long,” said Mark Dummett, Amnesty International’s Researcher on Business and Human Rights, who has just returned from the Niger Delta.

“President Buhari’s initiative will fail, and the Ogoni people will continue to suffer, as long as Shell fails to make significant changes to the way it approaches oil spill clean-up.”

The establishment of the trust fund was a key recommendation of the United Nations Environment Programme (UNEP), which published a study on oil pollution in Ogoniland four years ago. The UNEP study also called for Shell’s clean-up methods to be urgently overhauled, including reviewing its methodology and addressing serious delays in responding to spills.

But researchers from Amnesty International investigating spill sites in the region have this month found oil on the soil and in nearby water bodies, in areas where Shell contractors are reported to have recently carried out remediation.

The fund will be overseen by representatives of the Ogoni people, the United Nations, the oil companies operating in Nigeria and the government itself. According to the government, “stakeholders” will pay an initial $10 million into the fund, but it is not clear who these stakeholders will be.

$10 million is far below the $1 billion that the UNEP said should be paid into the fund to cover the first five years of a clean-up job which could take up to 30 years. The UNEP study recommended that the contributions should be made by both the oil industry and the government.

“Ogoniland has been devastated by years of oil spills and Shell’s clean-up operations have been utterly ineffective,” said Mark Dummett.

“In 2011 UNEP highlighted numerous serious problems with the way Shell cleans up oil sites. But we have visited multiple sites and found oil pollution lying all around. From what we are seeing, little has changed since then.”

A government press statement on Wednesday said that President Buhari “approved several actions to fast-track the long delayed implementation” of the UNEP report including the establishment of the fund.

Shell was forced to leave Ogoniland in 1993, but its pipelines run through the area and it is responsible for leakages from these pipes.

Ogoniland is only one part of the Niger Delta that has been affected by oil pollution. Royal Dutch Shell and the Italian multinational oil giant ENI have admitted to more than 550 oil spills in the Niger Delta last year, according to an Amnesty International analysis of the companies’ latest figures. By contrast, on average, there were only 10 spills a year across the whole of Europe between 1971 and 2011.

폴란드의 법제도가 레즈비언, 게이, 양성애자, 성전환자, 인터섹스(LGBTI)와 그 외의 소수자들을 증오범죄로부터 보호하기에는 턱없이 부족한 수준이라고 국제앰네스티가 새로운 보고서를 통해 밝혔다. 이번 국제앰네스티 보고서는 폴란드 총선까지 2개월도 채 남지 않은 17일 공개됐다.

보고서 <증오의 표적으로, 법에 외면받다(영문)>는 폴란드의 증오범죄 관련법에서 노숙인과 장애인, LGBTI 등의 소수자들이 완전히 배제된 현실을 다루고 있다.

마르코 페롤리니(Marco Perolini) 국제앰네스티 유럽중앙아시아 차별문제 전문가는 “폴란드 법제도는 일부 소수자 집단은 보호하면서도 다른 소수자들은 방치하는 이중적인 성격이 있다. 폴란드에서 동성애자, 장애인 또는 노숙인이라는 이유만으로 공격을 당하더라도 경찰에서는 증오범죄가 아니라 일반 범죄 사건으로 다룰 것이다. 이처럼 법적 보호에 차별을 두는 위험한 조치는 즉시 개선되어야 한다”고 말했다.

폴란드의 LGBTI는 폴란드 전역에서 만연하고 뿌리 깊은 차별을 경험하고 있다. 신뢰성 있는 공식 통계는 발표되지 않았지만, 폴란드의 대표적 LGBTI 단체인 ‘동성애혐오 반대 운동’은 2014년 한 해에만 동성애자 또는 성전환자를 대상으로 발생한 증오범죄 사건이 최소 120건 이상에 이른다고 기록했으며, 실제 수치는 훨씬 더 높을 것으로 추정된다.

폴란드의 도시 슈체츤(Szczecin)의 경우, 이곳에 사는 LGBTI들은 2014년 1월 24세 게이 남성이 게이 클럽을 나서던 길에 잔인하게 폭행당해 사망하는 사건이 벌어진 뒤로 두려움 속에 살아가고 있다고 전했다. 이 남성의 시신은 얼굴이 멍으로 뒤덮이고 바지가 벗겨진 채로 근처 공사 현장에서 발견되었는데, 결국 최종 사인은 수 차례 웅덩이에 얼굴을 처박혀 익사한 것으로 밝혀졌다.

정부는 이 사건이 동성애 혐오로 인한 살인일 가능성을 무시했고, 법원은 가해자 2명에 대해 유죄를 선고하는 과정에서 일반 범죄와 다름없이 취급했다.

2015년 5월 지비에츠(Zywiec)에서는 반(反)나치 활동가이자 거리예술가인 다리우즈(Dariuz)가 자신이 그린 무지개 벽화 앞에서 “게이 매춘부”라는 욕설과 함께 발로 걷어차이고 침을 맞는 사건이 벌어졌다. 그러나 가해자에 대한 판결문에서는 이러한 욕설을 단순히 “비속어”라고 지칭했을 뿐, 동성애 혐오표현에 대해서는 전혀 언급하지 않았다.

또한 폴란드에서는 지난 수 년간 노숙인들을 대상으로 잔혹한 폭행 사건이 수 차례 벌어지기도 했다. 그러나 이러한 폭행이 최소한 일부나마 피해자의 사회경제적 위치로 인해 유발된 범죄였음에도 불구하고 경찰은 평범한 일반 범죄로 취급하고 있다.

지난 2012년 10월 제슈프(Rzeszów)에서는 가해자들이 노숙인 스테인슬로(Stanisław)를 폭행하고 몸에 불을 지르는 사건이 발생했다. 이들은 이전에도 노숙인들을 “심심해서” 공격한 적이 있다고 인정했음에도 법원에서는 범행 동기의 심각성을 판결에 반영하지 않았다.

페롤리니는 “그간 폴란드는 인종차별과 외국인혐오에 기반한 증오범죄 문제를 해결하고자 긍정적인 조치를 취해 왔다. 그러나 이들과 마찬가지로 매일 같은 공포와 괴롭힘에 시달리는 다른 소수자들은 동일한 대우를 받지 못하고 있다”며 “폴란드는 모든 소수자들이 차별로부터 동등하게 보호받도록 해야 할 국제법상 의무가 있다. 정부가 이를 다하지 못하고 있다는 사실 자체만으로도 사실상 차별과 다름없다”고 말했다.

동등한 보호가 이루어지지 않는다는 것은 곧 장애, 성적 지향성, 성 정체성, 사회경제적 지위에 대한 차별인식을 바탕으로 공격하는 문제를 해결하기 위해 특수 검사, 경찰 조정관 등과 같은 제도적 절차가 전혀 마련되지 않았다는 것이다. 또한 이와 같은 증오범죄를 예방하고, 모든 사건을 조사하고, 가해자를 기소하기 위해 실질적인 정책을 수립하려는 노력조차 전무한 상태다.

폴란드 정부는 이들 소수자들이 공격당한 사건에 대해 전국적 통계 자료를 수집하려는 제도적인 노력도 기울이지 않고 있어, 정부가 증오범죄 문제의 규모를 파악할 방도가 전혀 없다.

폴란드 형법을 개정하고자 하는 노력은 고착 상태에 빠져 있다. LGBTI와 장애인, 노약자를 증오범죄로부터 보호한다는 내용의 법안은 지난 2012년 상정되었지만 지금까지도 일부 폴란드 사회의 거센 반발에 부딪히고 있다. 2015년 한 의원은 이 법안을 “성병을 부추기는 역겨운 젠더 이념을 도입하려는 시도”라고 비난하기도 했다.

이 문제는 올해 10월 25일 열리는 폴란드 국회의원 총선거를 앞두고 계속해서 논쟁을 불러일으킬 것으로 보인다.

마르코 페롤리니는 “폴란드는 국내의 모든 소수자들이 법에 의해 동등한 보호를 받을 수 있도록 이번에야말로 반드시 구체적인 조치에 나서야 한다. 차후 구성될 새로운 정부와 의회는 무엇보다 인권을 가장 우선하고, 차별을 철폐하는 것이 최우선 목표가 되어야 할 것이다. 폴란드 안에서는 그 누구도 자신의 존재만으로 폭력적인 공격을 당할 공포 속에서 살아가서는 안 된다”고 말했다.

Poland abandoning hundreds of victims of hate crimes

Poland’s legal system falls dangerously short when it comes to protecting lesbian, gay, bisexual, transgender and intersex (LGBTI) people and other minority groups from hate crimes, Amnesty International said in a new report today less than two months ahead of general elections.

Targeted by hatred, forgotten by law shows how the state has excluded whole communities from hate crime legislation, including homeless people, people with disabilities and the LGBTI community.

“Poland has a two-tiered legal system that protects some minority groups but leaves others to fend for themselves. If you are a gay man or woman, a person with a disability or a homeless person in Poland and attacked because of who you are, the police will just treat it as an ordinary crime, not as a hate crime – this dangerous protection gap must be closed immediately,” said Marco Perolini, Amnesty International’s expert on discrimination in Europe and Central Asia.

The LGBTI community in Poland faces widespread and ingrained discrimination across the country. While there are no reliable official statistics, Campaign against Homophobia, a major Polish LGBTI organization, recorded at least 120 homophobic or transphobic hate crimes in 2014 alone, though the true figure is believed to be much higher.

In the city of Szczecin, members of the LGBTI community spoke of living in fear since a 24-year-old gay man was brutally beaten to death after leaving a gay club in January 2014. His body was found on a nearby construction site with his face covered in bruises and his trousers pulled down – the eventual cause of death was drowning, as his face had been pushed into a puddle repeatedly.

Authorities ignored the possibility that the killing could have been motivated by homophobia and the court treated the attack as a common crime when it convicted the two men responsible.

In May 2015, Dariusz, an anti-Nazi activist and street artist, was kicked and spat on in front of one of his murals depicting a rainbow in Zywiec, while verbally abused as a “faggot whore”. But in the written record of the judgment against the man responsible, the insults are simply called “vulgar”, with no mention of a homophobic motive.

Poland has also seen a number of vicious beatings of homeless people over the past years. But despite some of the attacks were at least partially motivated by the victims’ socioeconomic status, they have been treated as ordinary crimes by the police.

Stanisław, a homeless person living in Rzeszów, was beaten up and set alight in October 2012. Although the perpetrators acknowledged they had attacked other homeless people out of “boredom” in the past, the sentence did not reflect the gravity of the motivation.

“Poland has taken some commendable steps to tackle hate crimes motivated by racism and xenophobia. But it is difficult to swallow that other minority groups who live with the same daily fears and harassment have not been given the same priority,” said Marco Perolini.

“Poland has obligations under international law to ensure that all minority groups are equally protected from discrimination. The fact that authorities are failing to do so is actually discriminatory in itself.”

The protection gap means that there are no institutional mechanisms – like specialized prosecutors or police coordinators – to deal with attacks based on discrimination along the lines of disability, sexual orientation, gender identity or social and economic status. Nor are there any efforts to develop effective policies to prevent these hate crimes, investigate all cases and prosecute those responsible.

Poland lacks a systematic effort to collect data on attacks against these groups by the state, meaning that authorities have no way of knowing the scope of the problem.

Efforts to reform the criminal code have stalled, despite a bill being tabled in 2012 to protect LGBTI individuals, people with disability or older people from hate crimes. The proposal has met furious resistance from some parts of Polish society, with one MP in 2015 calling it an attempt “to introduce a sick ideology of gender which promotes sexual pathologies”.

The issue is likely to remain contentious ahead of Poland’s general elections on 25 October this year.

“Poland must once and for all take concrete steps to ensure that all minority groups in the country receive the same protection by law. The next government and parliament must make human rights a priority, and top of the list should be to end discrimination. No person in Poland should have to live in fear of violent attacks just because of who they are,” said Marco Perolini.

2016년 1월 인권단체 국제앰네스티는 아프리카 콩고 지역 코발트(Cobalt) 채굴 광산에서 발생하고 있는 아동노동 및 인권유린 실태와 글로벌 IT 기업들의 연관성을 다룬 보고서를 웹사이트에 게재하였습니다.

국제앰네스티는 해당 보고서에서 삼성SDI가 콩고 광산에서 아동 노동을 통해 채굴된 코발트를 공급받아 배터리를 생산했다는 주장을 제기하였고, 해당 주장과 관련하여 삼성SDI는 코발트 관련 협력회사에 대한 조사를 실시하고 있습니다. 서면 조사결과의 정합성 확인을 위해 6월부터 현장실사를 실시할 계획입니다. 그리고 2016년말까지 코발트 업스트림에 대한 보고서를 홈페이지에 공개토록 하겠습니다.

한편, 삼성SDI는 아동노동 등 인권 침해에 대해 엄격한 무관용 원칙에 따라 적극적인 조사와 개선 활동을 전개하고 있습니다.

2016년 4월 22일, 삼성SDI는 OECD, CCCMC*가 주관하고 콩고민주공화국 등 정부기관, NGOs, 코발트 공급회사, 이차전지 제조사, IT기업들이 참석한 코발트 이슈 공동 대응 국제 워크숍에 참석하여 콩고 광산의 인권문제를 개선하고 투명성을 높이기 위한 방안을 협의했습니다. 앞으로도 지속가능한 코발트 공급에 대한 공동의 이니셔티브(Initiative)에 적극 참여하는 한편, 공급망에 대한 지속적인 조사를 통해 광물 조달과정의 투명성과 추적성을 높이고 공급망 내의 인권 보호를 위하여 협력회사들과 함께 다각적인 노력을 펼쳐나갈 계획입니다.

Samsung SDI’s efforts for responsible mineral procurement

In January 2016, a global human rights NGO, Amnesty International disclosed a report of relations between IT companies and child labor or human rights issues occurred in cobalt mines in Congo, Africa.

In the report, Amnesty claimed that Samsung SDI produced batteries using cobalt mined from child labor in Congo. Therefore, Samsung SDI has begun investigations on its cobalt suppliers, and it plans to conduct site visits(due diligence) in order to verify the results of document investigation. We will share the report of upstream supply chain of cobalt on our website by the end of 2016.

Meanwhile, we are expanding our activities in investigating and improving issues related to human rights including child labor, in accordance with the zero tolerance policy.

On April 22, 2016, Samsung SDI attended. The International Workshop in the Resonsible Cobalt Supply Chain that was organized by the OECD and CCCMC* for joint actions toward cobalt issues. at the workshop, we discussed plans to improve human rights issues and increase transparency in Congo mines along with the Congo government institutions, NGOs, cobalt suppliers, secondary cell manufacturers, and IT companies. Furthermore, we will not only engage in joint initiative for sustainable supply chain of cobalt, but also take measures to secure transparency and human rights with our suppliers through continuous monitoring of the supply chain.

On top of conflict minerals matters, issues regarding human rights violations and environmental degradation caused by the mining of minerals, such as tin on Bangka Island, Indonesia and cobalt in the Democratic Republic of the Congo, are raising concerns among stakeholders. . . . [C]hild labor has long been highlighted as a problem at cobalt mines in the Democratic Republic of the Congo and has recently come to garner much attention. Given the nature of this issue, however, joint efforts among governments, NGOs and corporations are urgently needed. Samsung is well aware of the corporate world’s responsibilities and roles with problems caused by the mining of minerals. As a result, we have pledged to redouble our efforts and find ways to resolve these challenges by listening to greater numbers of stake-holders and actively participating in joint initiatives.

네팔의 헌법 개정에 반대하는 시위대를 향해 경찰이 발포하는 사례가 잇따르면서 최소 20명이 숨진 가운데, 네팔 보안군은 시위대에 과도한 무력 사용을 자제해야 할 것이라고 국제앰네스티가 밝혔다.

격화되는 시위를 진압하기 위해 보안군이 무력을 사용하고 실탄을 발사하면서 8월부터 이미 40명 이상이 목숨을 잃었고, 사망자 대부분은 시위대였다.

네팔 국가인권위원회와 국제앰네스티를 비롯한 시민사회의 조사 결과, 사망자가 발생한 시위의 경우 대부분 보안군의 무력 사용이 과도하고 부적절하거나 불필요해, 국제법 기준을 위반하는 것으로 드러났다.

데이빗 그리피스(David Griffiths) 국제앰네스티 동남아시아 조사국장은 “최근 수 주 동안 40명이 넘는 사람이 목숨을 잃었고, 이들 대부분이 시위대였다. 국제앰네스티는 네팔 정부에 보안군을 통제하고 과도한 무력을 사용하지 못하도록 할 것을 재차 촉구한다”고 말했다.

21일 무력충돌이 발생한 태국 남부의 비랏나가르, 빌간지, 말랑와 지역은 특히 최근 긴장이 높아지고 있던 지역이다. 이들은 신규 헌법에서 남부 평원지대의 부족별 거주지역을 통합하고 새로운 주별 경계를 나눈 것에 반발하고 나섰다.

제정까지 7년 이상이 소요된 신규 헌법에서는 네팔을 7개 주로 구성된 비종교적 민주공화국으로 선포했다. 그러나 소수민족의 대표성을 반영하기에 충분하지 못하다는 주장과, 네팔을 다시 힌두교 국가로 선포해야 한다는 힌두교 활동가들의 거센 반발에 부딪혀 왔다.

데이빗 그리피스 국장은 “네팔 신규 헌법은 이외에도 시급히 다뤄져야 할 주요 인권 문제를 다수 포함하고 있다. 특히 여성과 소외계층의 권리를 명백하고 충분하게 보호하지 못하고 있다”고 말했다.

Nepal: Police restraint urged as at least 20 more shot amid Constitution-related protests

Security forces in Nepal must refrain from using excessive force against protesters, Amnesty International said after at least 20 protesters were shot when security forces opened fire on several demonstrations against the country’s new constitution.

Force and the use of live ammunition by security forces to contain often violent protests have already claimed more than 40 lives in Nepal since August, most of them protesters.

Investigations by Nepal’s National Human Rights Commission and civil society, including Amnesty International, have found that in many of the protest-related deaths, the force used by security forces was excessive, disproportionate or unnecessary, contrary to international legal standards.

“More than 40 people, the majority of them protesters, have been killed in recent weeks. We continue to urge the Nepali authorities to rein in their security forces and prevent them from using excessive force,” said David Griffiths, Research Director for South Asia at Amnesty International.

Today’s clashes took place in the southern cities of Biratnagar, Birgunj and Malangawa where tensions have been high for weeks because of controversial federal boundaries drawn up in the new constitution, which split up the homelands of ethnic groups from Nepal’s southern plains.

The constitution, which took more than seven years to complete, defines Nepal as a secular republic divided into seven federal provinces. It has been fiercely opposed by ethnic minority groups who argue that it does not afford them sufficient representation, as well as Hindu activists who believe the constitution should have restored Nepal as a Hindu nation.

“The new constitution has a number of major human rights shortcomings which also need to be urgently addressed. In particular, the rights of women and marginalized communities are not clearly and sufficiently protected,” said David Griffiths.

중국 법원이 인권변호사 푸즈창에 대해 징역형과 3년의 집행유예를 선고한 것은 표현의 자유를 옹호하는 사람에게 족쇄를 채우려 하는 중국 정부의 고의적인 시도라고 국제앰네스티가 22일 밝혔다.

22일 베이징의 한 법원은 푸즈창에 대해 “분란을 조장하고 물의를 일으킨 것”과 “인종 혐오를 조장”했다는 혐의로 징역 3년과 집행유예 3년을 선고했다. 이러한 판결의 주된 근거는 푸즈창이 소셜미디어에 올린 총 600여자의 게시물 7건으로, 중국 정부 관료와 경찰을 비판하는 내용이었다.

윌리엄 니(William Nee) 국제앰네스티 중국 조사관은 “푸즈창이 또 하루를 감옥에서 보내지 않아도 된다는 것은 분명 긍정적인 일이나, 이것이 매우 부당한 판결이라는 사실은 숨길 수 없다. 푸즈창은 범죄를 저지르지 않았으며, 이번 유죄 판결은 중국에서 가장 용기 있는 인권변호사가 변호 활동을 할 수 없도록 실질적으로 족쇄를 채운 것”이라며 “푸즈창은 이미 18개월이 넘는 시간을 구금되어 있었으며, 이렇게 오랫동안 조사를 벌였음에도 정부가 수집할 수 있었던 유일한 ‘증거’는 정부를 비판한 게시물 7건뿐이었다. 푸즈창은 중국에서 가장 적극적으로 표현의 자유를 옹호한 사람이며, 단지 표현의 자유를 행사했다는 이유만으로 재판을 받고 있다”고 말했다.

22일 오전, 경찰은 베이징 제2중급인민법원 앞에서 푸즈창을 지지하기 위해 모인 활동가들 최소 12명을 체포했다.

푸즈창의 재판이 열린 12월 14일에는 신원을 알 수 없는 사람들과 경찰이 법원 앞에 있던 외신 기자들과 외교관, 푸즈창의 지지자들을 난폭하게 해산시켰다. 지지자들 중 약 20명이 경찰에 체포되었고, 평화적인 시위에 참여했다는 이유로 현재 최소 4명이 형사 구금되어 있으며 변호사 접견도 허용되지 않고 있다. 이외에도 지지자 중 5명의 행방을 알 수 없어, 마찬가지로 구금됐을 것으로 우려된다.

윌리엄 니 조사관은 “푸즈창의 재판이 있던 법원 앞에서 벌어진 경찰의 부끄러운 활동은 오히려 중국에 푸즈창과 같은 표현의 자유를 옹호하는 사람이 반드시 필요한 이유를 더욱 부각시켰을 뿐이다. 푸즈창에 대한 지지를 평화적으로 표현한 것만으로 구금된 사람들 역시 모두 조건 없이 즉시 석방되어야 한다”고 말했다.

 

배경

푸즈창은 2014년 5월 6일 베이징에서 1989년 천안문 사태에 대한 조사를 촉구하는 민간 세미나에 참석했다가 처음으로 경찰에 체포되었다. 중국 정부의 투명성 증진과 부정부패 폭로를 목적으로 하는 활동가 연합 ‘신공민 운동’ 관련 사건 등, 다수의 ‘민감한’ 인권 사건의 변호를 맡았다.

Guilty verdict against lawyer Pu Zhiqiang a gross injustice

The three year suspended prison sentence handed down against human rights lawyer Pu Zhiqiang is a deliberate attempt by the Chinese authorities to shackle a champion of freedom of expression, Amnesty International said today.

On Tuesday, a court in Beijing sentenced Pu Zhiqiang to three years in prison, suspended for three years, for “picking quarrels and provoking troubles” and “inciting ethnic hatred”. The conviction was primarily based on seven social media posts, in total approximately 600 characters, in which Pu criticized government officials and polices.

“Clearly it is positive that Pu Zhiqiang is unlikely to spend another night in jail, yet that cannot hide the gross injustice against him. He is no criminal and this guilty verdict effectively shackles one of China’s bravest champions of human rights from practicing law,” said William Nee, China Researcher at Amnesty International.

“Pu Zhiqiang has already been detained for more than 18 months, and despite investigating Pu for so long, the only ‘evidence’ the authorities could muster against him were seven social media posts in which he criticized the government. He is one of China’s most courageous defenders of the right to freedom of expression, and he’s been persecuted for simply exercising that right.”

On Tuesday morning, police detained at least 12 activists outsideBeijing No. 2 Intermediate People’s Court who had come to show their support for Pu Zhiqiang.

At Pu’s trial on 14 December, unidentified individuals and police manhandled foreign journalists, diplomats and his supporters outside the court. Approximately 20 of his supporters were taken away by police. At least four people are now criminally detained for taking part in the peaceful protest, and have been denied access to lawyers. A further five supporters have not been heard from since and it is feared they are also detained.

“The disgraceful police operation outside Pu Zhiqiang’s trial only underscores why China needs defenders of free speech like Pu more than ever. All those detained solely for peacefully expressing their support for Pu should also be immediately and unconditionally released,” said William Nee.

Background

Pu Zhiqiang was originally detained by police on 6 May 2014, after he attended a private seminar in Beijing that called for an investigation into the 1989 Tiananmen crackdown. He has represented individuals in many ‘sensitive’ human rights cases, including those linked with the ‘New Citizens’ Movement’, a loose network of activists who aim to promote government transparency and expose corruption.
