전쟁과 인권침해, 충격적인 인도주의적 위기의 수렁에 빠져 버린 남수단의 어느 한 구석진 지역, 대부분이 간과하고 있는 인권 위기로부터 피해 온 난민들은 오늘도 이곳으로 끊임없이 몰려오고 끊임없이 수많은 난관에 부딪히고 있다.

이다와 아융 톡 지역의 난민캠프는 남수단 통일 주(Unity State – 현재 남수단 내전으로 가장 치열한 접전이 벌어지는 지역의 이름으로는 잔인하게도 역설적인 이름이다)의 북쪽 끄트머리이자, 2011년 7월 수단으로부터 독립한 이후 지도에 선명하게 새겨진 남수단의 국경과 매우 가까운 지역에 위치해 있다.

이곳의 난민들은 이웃나라 수단의 남부 코르도판에서 온 사람들로, 코르도판 지역은 4년간 이어진 무력분쟁과 수단 정부군의 대규모 무차별 공격으로 인권 위기에까지 이르렀지만 크게 주목받지는 못하고 있는 곳이다.

이들 난민의 수는 약 95,000명 정도로, 매일 계속해서 늘어나고 있다. 전쟁으로 황폐화된 남수단에까지 피난을 오는 절박함이란 어떤 것일지 상상해 보라. 남부 코르도판에서 계속되는 폭격과 공포, 기근을 견디는 것에 비하면 훨씬 나은 선택이라는 것이다.

통일 주의 난민들은 주로 두 곳의 난민캠프에 정착해 있다. 현재 우리 팀이 지내고 있는 이다 캠프에 70,000명, 근처의 아융 톡 캠프에 나머지 25,000명이 있다. 앰네스티의 조사팀으로 이다 캠프를 찾은 것은 3년 연속 세 번째다. 이미 이곳의 산적한 문제들에 대해서는 잘 알고 있었고 마음이 편치 않았던 터라, 믿기 힘들리만치 취약한 상태에 놓인 이곳 난민들의 인권을 보장할 해결책 마련을 위해 더욱 박차를 가해야만 한다고 생각했다.

말로 다하지 못할 잔혹행위로부터 살아남은 사람들은 이곳에서 의식주, 물과 같은 기본적인 생활요건을 구하는 등 일상으로 돌아가기 위해 안간힘을 쓰고 있다. 하늘의 별 따기나 마찬가지인 교육에 대한 열망을 채우는 것도 마찬가지인 듯하다.

2011년 마련된 이후로 이다 캠프의 위치에 대해서는 지금까지도 논란이 계속되고 있다. 수단군과 반군인 수단인민해방운동(SPLA-N)간의 교전이 계속되고 있는 수단의 국경으로부터 불과 20km밖에 떨어지지 않은 지역이기 때문이다.

우리 팀이 2012년 이곳에 도착했을 당시 나이엘 지역의 새로운 난민캠프로 난민들을 이주시키고자 하는 시도가 진행 중이었다. 그러나 나이엘은 우기가 되면 늪지대로 변할 위험이 있었고, 결국 무산되었다. 2013년에 이곳을 찾았을 때는 아융 톡 지역으로의 이주를 계획하고 있었다. 이번에는 반군 점령지역 근처에 위치한 이다와는 달리, 수단군이 점령한 국경 지역에 가까워진다는 이유로 다들 이주를 꺼렸다.

하지만 시간이 흐르고 아융 톡 캠프에도 난민들이 자리를 잡기 시작했다. 대부분 새로 도착한 난민들이었다. 남부 코르도판 지역의 폭격이 절정에 이르는 건기인 12월 말 이후로 10,000명이 정착했다.

난민캠프의 위치와 이주에 관한 논란 속에는 타당한 우려와 터무니없는 소문이 뒤섞여 가득했다. 최대한 난민보호원칙을 고수하려 했지만, 정치적 입장을 배제할 수는 없었다.

그렇기에 이번에 방문했을 때에도 누구나 가장 먼저 떠올린 주제가 새로운 캠프 부지와 이주 계획이었던 것은 놀랍지도 않은 일이었다. 이번에도 어김없이 입장 차이는 있다. 남수단 정부가 승인하고 유엔과 공여국들이 지지하는 지역이 있는 한편, 난민 대표들은 다른 지역을 고집하고 있다. 이 문제가 어떻게 해결될지는 전혀 모를 일이다. 난민들에게 총을 들이밀고 트럭에 강제로 실을 일은 없겠지만, 난민 문제를 놓고 이리저리 밀고 당기기를 계속하는 다른 세력들이 많은 것도 사실이다.

특히 인상 깊었던 것은 캠프의 난민 대표 중 한 사람이 했던 말로, 이전에도 비슷한 말을 들어본 적이 있었다. 그 사람은 이렇게 물었다. ‘왜 우리의 의견은 들어주지 않는가? 우리의 안전에 대해, 우리 아이를 학교에 보내고, 곡식과 가축을 기르면서 삶을 재건하게 될 장소에 대해 우리가 스스로 결정할 수는 없는가?’ 지난번 이곳을 방문했을 때 한 난민 여성이 열변을 토하며 했던 말이 떠올랐다. 자신과 아이들이 가장 안전할 곳은 그 누구보다도 자신이 가장 잘 안다는 것이었다.

이곳에 올 때마다 언제나 통감하는 걱정거리 중 하나는 교육이다. 이번에도 역시 캠프에 머무르는 동안 언제나 주로 나오는 대화 주제는 교육에 대한 것이었다.

난민들이 이다 캠프에 장기간 정착해서는 안 된다는 것이 국제 공여국들의 입장이기 때문에, 영속성을 부여할 것이라고 우려되는 계획이나 프로그램 다수에 대해서는 투자하기를 거부했다. 여기에는 학교도 포함되어 있다. 65,000명이 살고 있는 캠프에서 학교에 다닐 나이의 어린이의 수는 얼마나 될까? 초등학생 나이인 어린이만 약 16,000명에 이른다. 이다 캠프가 생긴 지 4년이 지났지만, 국제사회가 지원해 설립된 학교는 한 곳도 없다. 어린이의 인생 중 4년이 허비되어 버린 것이다. 유니세프에서 지급한 파란 책가방도 없고, 유럽연합에서 지원금을 받는 선생님도 없고, 캐나다와 호주에서 보내 온 공책과 연필도 없으며, 남아프리카가 지어 준 학교 건물도 없다. 모든 어린이들은 어떤 상황이든 관계없이 자유롭게 의무 초등교육을 받을 권리가 있음에도 불구한 일이다.

물론 아융 톡 캠프에는 학교가 마련되어 있다. 이곳으로 이주할 만한 이점이 되는 것이다. 그러나 그렇게 이주한 난민은 일부일 뿐, 대부분은 이다 캠프에 남았다. 여전히 수천여 명의 청소년들은 잠자리와 마찬가지로 최소한의 자재로만 지어진 임시 학교에서 공부하고 있다. 난민들 중에서 교사로 자원한 사람들은 최선을 다해 가르치고 있다. 이들 중에는 교사였던 사람도 있지만, 대부분은 평범한 사람들이다. 학부모들은 1년에 약 4달러 가량의 교육비를 내야 하는데, 이곳 난민들 대부분에게는 마련하기 힘겨운 액수일뿐더러, 무상으로 초등교육을 받아야 할 기본권을 침해하는 것이다.

이다와 아융 톡 캠프 각각에 어떤 이점이 있든, 또한 현재 논란이 되고 있는 두 지역의 위치가 어떻든 간에, 교육권이라는 중요한 인권이 협상 카드처럼 이용되고 있다는 것이 어쩐지 우려가 된다.

왜냐하면, 오늘 한 대표가 했던 말과 같이, 교육이 중단되면 한 세대를 잃게 되기 때문이다. 그리고 이처럼 간과되고 있는 인권 위기에 처한 어느 한 구석진 곳의 난민들은, 이처럼 큰 손실을 감당할 여력이 없다.

‘Stop education, lose a generation’ – Tough lessons for refugees fleeing Sudan’s overlooked crisis

In a forgotten corner of South Sudan – a country itself mired in war, human rights violations and a staggering humanitarian catastrophe – refugees from a largely overlooked human rights crisis continue to arrive and continue to face immense challenges.

The refugee camps of Yida and Adjoung Thok lie inside the northern tip of the country’s Unity State (a cruelly ironic name for a state that has seen some of the worst fighting in the country’s current civil war), very close to the border that was etched into atlases when it gained independence from Sudan in July 2011.

They have arrived here from neighbouring Sudan’s Southern Kordofan state, where an overlooked human rights crisis has played out during four unrelenting years of armed conflict and at the Sudanese armed forces’ massive and indiscriminate military assault.

These refugees number around 95,000 and continue to arrive daily. Just imagine the desperation that makes fleeing to war ravaged South Sudan, a more attractive option than enduring the bombing, terror and hunger in Southern Kordofan.

In Unity State, refugees are primarily divided between two camps: 70,000 in Yida, where we are today, and another 25,000 in nearby Adjoung Thok. This is the third time in three years that I have been to Yida with an Amnesty team. Already I feel heavy with the familiarity of the immense challenges here, and determined that we must press harder for solutions that ensure the rights of an incredibly vulnerable population are upheld.

Here the survivors of untold endless atrocities grapple with normalising their lives; seeking basic needs of food, water, shelter and clothing and perhaps even satisfy the yearning of a much elusive education.

Since it was set up in 2011, there has been controversy about Yida’s location, only some 20 kilometres from the border with a country where war continues to rage between the Sudanese military and the Sudan People’s Liberation Army – North (SPLA-N) opposition forces.

We were here in 2012 and there were efforts under way to encourage refugees to move to a new camp, Nyel, which it was feared would turn into a swampy bog during the rainy season. That failed. We were here in 2013 and the plan was a move to the new Adjoung Thok site. This time refugees feared it took them closer to a border area controlled by the Sudanese military, whereas the border near Yida is patrolled by the SPLA-N.

With time, however, Adjoung Thok has begun to fill up, mainly with newly arriving refugees (there have been 10,000 since the end of December, the dry season which saw a spike in bombings in Southern Kordofan).

Those debates about location and moving were fraught with legitimate fears and rampant rumours. They were about sticking to refugee protection principles, but politics have played a role as well.

And so, on this current visit it comes as no surprise that the first topic on everyone’s mind is, again, a new site and plans to move. And once again there is disagreement. The South Sudanese government has approved one site, now backed by the UN and donor states; refugee leaders are pressing for another. It is not at all clear how it will unfold. There is no prospect of forcing refugees onto trucks at gunpoint. But there are many other forces pushing and pulling them in several different directions.

Particularly telling for me today were the words from one of the leaders in the camp, variations of which I’ve heard before. He asked: why don’t our views matter? Why don’t we get to decide about our own security, where we will send our kids to school, and where we will try to rebuild our lives by growing a bit of food? I remembered the fiery insistence of a refugee woman on my last visit that she was the one, better than anyone, who knew where she and her children would be safest.

One pressing concern that has repeatedly come up so poignantly every time I have been here is education. It has again certainly been prominent in all of our conversations in the camp today.

Because international donors think refugees shouldn’t be settling in Yida for the long term, they have refused to fund a number of programmes and initiatives that they fear would give it a sense of permanence. That has included schools. Imagine the numbers of school-age children in a camp of 65,000 people. There are around 16,000 of primary school age alone. Four years into Yida’s existence, there are no schools funded by the international community – four wasted years in a child’s life. No UNICEF blue backpacks, no teachers salaried by the European Union, no notebooks and pencils coming in from Canada and Australia, no schools constructed by South Africa. This is despite the fact that all children, whatever their circumstances, have a right to free and compulsory primary education.

Schools are on offer in Adjoung Thok of course; and that is meant be an incentive to move there. It has encouraged some, but most remain at Yida. So thousands of students are learning in makeshift schools built with the same rudimentary materials as the shelters they sleep in. Volunteers from among the refugee community (some of whom were teachers, most not) do their best to teach. And refugee families are asked to pay a school fee (the equivalent of about $4 per year, which most families here struggle to come up with, and which runs contrary to that universal right to free primary education).

Regardless of the merits of Yida versus Adjoung Thok, or of the two locations that are the subject of the current dispute, there is something worrying about using such an important human right, the right to education, as a bargaining chip.

Because as one leader put it to us today, when you stop education, you lose a generation. And this overlooked crisis in a forgotten corner cannot afford that loss.

이집트 법원이 사진기자 ‘샤칸’의 사건을 형사법원에 회부하며 미결구금 기간을 연장시킨 것은 이집트의 인권과 법치주의에 또다시 큰 타격을 입힌 결정이라고 국제앰네스티가 밝혔다. ‘샤칸’이라는 이름으로 잘 알려진 사진기자 마흐무드 아부 제이드와 마찬가지로 2년이 넘는 시간을 재판도 없이 구금되어 있는 사람은 이집트 전역에 수백여 명에 이른다.

사이드 부메두하(Said Boumedouha) 국제앰네스티 중동-북아프리카 국장대행은 “형사법원이 재판 날짜를 정할 때까지 샤칸의 구금을 연장하기로 결정한 것은 부끄러운 일이며 국제인권기준을 명백히 위반하는 것이다. 또한 미결구금 기간을 최대 2년으로 제한하고 있는 이집트 헌법과 국내법 역시 위반하고 있다”며 “오랜 시간 동안 재판 날짜를 기다리게 하는 방법으로 수백 명을 고의적으로 구금함으로써 이집트 정부는 자국법을 무시하면서까지 모든 반대세력을 탄압하기 위해 수단과 방법을 가리지 않겠다는 의지를 명백히 보이고 있다”고 말했다.

샤칸은 지난 2013년 8월 14일, 수도 카이로의 라바아 알 아다위야 광장에서 연좌농성을 벌이던 시위대를 이집트 보안군이 강경 진압하는 과정에서 현장 사진을 촬영했다가 체포되었다. 이 날 이집트 전역에서 최대 1,000명이 목숨을 잃었고, 같은 날 샤칸과 함께 체포된 사람은 무슬림형제단 소속 단원과 지지자들을 포함해 수백여 명에 이르렀다.

사이드 부메두하 국장대행은 “샤칸이 ‘범죄’를 저질렀다고 한다면 기자로서의 정당한 활동의 일환으로 사진을 촬영했다는 것뿐으로, 이 때문에 700일이 넘게 불법 구금되어 있다는 것은 그야말로 터무니없는 일이다. 샤칸은 표현의 자유를 행사했다는 이유만으로 구금된 양심수며, 즉시 무조건적으로 석방되어야 한다. 그에 대한 모든 혐의 역시 취소되어야 한다”고 말했다.

샤칸의 변호인단은 담당 검사로부터 샤칸의 사건이 2015년 8월 11일 형사법원으로 회부되었다는 통보를 받았다고 국제앰네스티에 전했다. 같은 날 무슬림형제단의 고위 간부 모하메드 바디에를 비롯한 400명 역시 형사법원에 회부되었다고 발표됐다.

샤칸의 변호인단은 혐의 목록과 피고인 수, 해당 사건에 적용된 형법 조항 등 검사의 형사법원 회부 결정에 관련된 중요 문서를 열람할 권한이 주어지지 않아, 변호 역량을 제대로 발휘하지 못했다. 또한 변호인들은 담당 검사가 지난 주 형사재판에 회부된 피고인 중 샤칸은 포함되지 않았다고 말했던 터라, 17일 샤칸 역시 함께 회부된 사실을 알고 큰 충격을 받았다고도 전했다.

샤칸의 변호인단은 샤칸의 미결구금 기간이 이집트 법으로 정해진 2년을 초과했으므로 즉시 샤칸을 석방할 것을 촉구하며 항소법원에 항소를 제기했다. 이에 대해 수 일 내로 판결이 내려질 예정이다. 체포 당시 샤칸은 언론사 데모틱스(Demotix)에 제공할 사진을 촬영하고 있었으며, 데모틱스 역시 검찰 측에 같은 내용을 확인했다. 이집트에서는 현재 단순히 자신의 소명을 다하고 표현의 자유를 행사했다는 이유만으로 최소 18명 이상의 기자들이 구금되어 있다.

샤칸과 함께 같은 날 구금된 400여명은 “금지단체 소속”(정부가 이후 ‘테러 단체’라고 선언한 무슬림형제단을 지칭), “화기 소지”, 살인 등의 날조된 동일한 혐의로 심문을 받았다. 샤칸은 2년 전 검찰 조사에서 무슬림형제단과의 관련성과 모든 혐의에 대해 부인했다.

샤칸의 사건은 체포 당시부터 결함이 있는 상태였다. 샤칸은 변호사가 동석하지 않은 채 심문을 받았고, 카이로 경찰서의 지나치게 좁은 유치장에 구금된 채 고문과 부당대우에 시달렸다. 이후 아부 자바알 교도소로 옮겨졌지만 찌는 듯한 8월의 더위 속에서 교도소 밖의 경찰차에 갇힌 채 7시간을 보냈고, 안으로 들어간 이후에도 또다시 구타를 당했다. 현재는 악명 높은 토라 교도소의 매우 열악한 구금 환경 속에서 수감되어 있다.

샤칸은 2015년 4월 국제앰네스티에 보내온 편지에서 자신의 비참한 구금 환경을 설명하면서, “이집트 교도소에서는 짐승처럼 대우한다”며 자신의 무기한 구금 상태는 “정신적으로 견디기 어렵다”고 전했다.

또한 샤칸은 체포되기 전부터 C형 간염 진단을 받은 상태였으나, 가족들은 샤칸이 약물 치료를 받지 못해 건강이 악화되고 있다고 국제앰네스티에 호소했다. 가족들은 이러한 건강상의 이유로 검찰에 여러 차례 석방을 탄원했지만 아무런 성과도 없었다.

샤칸이 체포된 지 며칠 후인 2013년 8월 17일, 정부는 카이로 시내의 한 이슬람 사원에 들이닥쳐 이곳에서 몸을 피하고 있던 아일랜드 출신 양심수 이브라힘 할라와(Ibrahim Halawa)와 시위대 등 327명을 추가로 체포했다. 18일 현재 이들이 구금된 기간은 2년 2일로, 마찬가지로 현행 이집트법에서 규정하는 미결구금기한을 초과한 상태다.

국제법에서는 미결구금은 최후의 수단으로 이루어져야 하며, 피고인에 상당한 도주 위험이 있거나, 타인에게 해를 끼칠 위험이 있거나, 증거 또는 조사에 개입할 위험이 있는 특정한 경우에만 적용될 수 있다고 강조하고 있다. 또한 각 사건마다 구금의 필요성과 지속적인 합법성에 대해 검토가 이루어져야 한다. 이집트 형사소송법 143조는 미결구금기간을 최대 2년까지로 제한하고, 이 기간 내로 판결이 내려지지 않은 구금자는 즉시 석방하라고 명시하고 있다.

사이드 부메두하 국장대행은 “정당한 이유 없이 수백여 명을 2년 넘게 구금하는 것은 정부에 반기를 든 사람들의 입을 막겠다는 명백한 보복 조치”라고 말했다.

샤칸의 구금이 연장되기 며칠 전, 압델 파타 알 시시 이집트 대통령은 검찰에 최대 7일까지 구금 기간을 제한 없이 연장할 수 있는 권한을 부여함으로써 장기간 구금하기 더욱 쉬워지는 신규 ‘반테러법’에 서명했다. 이에 따르면 이집트 법에서 명시하고 있는 2년 제한은 실질적으로 효력을 잃게 된다.

이 법에서 ‘테러 행위’라고 규정하는 범위는 지나치게 넓어, 정부는 이에 따라 평화적인 정부 비판론자들과 기자 등을 모호한 이유로 구금하고 자유롭게 탄압할 수 있게 된다. 또한 이 법은 테러리스트의 공격에 대한 정보 또는 통계를 보도하는 기자에게 과도한 벌금을 부과해, 독립적인 언론보도를 실질적으로 금지하는 역할도 한다. ‘테러리스트의 공격’이 무엇인지는 정부의 해석에 따라 달라진다.

국제앰네스티는 2015년 8월 12일 이집트 대통령에게 신규 ‘반테러법’을 폐지하거나, 이집트 헌법과 국제인권법에 상응하도록 근본적으로 개정할 것을 촉구하는 서한을 발송했다.

이집트 정부는 지난 2013년 11월에도 표현의 자유와 평화적인 결사의 자유를 막고 모든 반대세력을 탄압하기 위한 목적으로 매우 엄격한 ‘시위법’을 제정한 바 있다.

Egypt: Photojournalist ‘Shawkan’ among 700 held for more than two years in pre-trial detention

The decision by an Egyptian court to refer the case of a photojournalist to a criminal court while extending his pre-trial detention, represents yet another hefty blow to human rights and the rule of law in the country, said Amnesty International. Mahmoud Abu Zeid, widely known as Shawkan, is among hundreds who have been held in pre-trial detention for more than two years across the country.

“The decision to extend the detention of Shawkan until the criminal court sets a date for the trial, is disgraceful and a blatant violation of international human rights standards. It also contravenes the Egyptian constitution and national law which limits pre-trial detention to an already prolonged period of two years if the detainee is not sentenced within that period” said Said Boumedouha, Acting Director of Amnesty International’s Middle East and North Africa Programme.

“By arbitrarily detaining hundreds of people for lengthy periods pending trial, the Egyptian authorities are sending a clear message that they will stop at nothing to quash all signs of dissent – even flouting their own laws in the process.”

Shawkan was arrested on 14 August 2013 while he was taking pictures during the violent dispersal of the Rabaa al-‘Adaweya sit-in by the Egyptian security forces. Up to 1,000 people were killed on that day across Egypt. He was among hundreds of people, including many supporters and members of the Muslim Brotherhood, arrested that day.

“Shawkan’s only ‘crime’ was taking photographs as part of his legitimate work as a journalist – his unlawful detention for more than 700 days is simply outrageous. He is a prisoner of conscience detained solely for exercising his right to freedom of expression, he must be released immediately and unconditionally. All the charges against him must be dropped,” said Said Boumedouha.

Shawkan’s lawyers told Amnesty International that the public prosecutor informed them that he had in fact been referred to the criminal court on 11 August 2015, when it was announced that Mohamed Badie, a senior Muslim Brotherhood figure and 400 others were also referred to the criminal court.

His lawyers have been denied access to key documents related to the case including the prosecutor’s referral decision which includes a list of charges, number of defendants, and penal code provisions applicable in the case, undermining their ability to prepare their defence. They also told Amnesty International that the prosecutor had initially denied that Shawkan was among those referred to trial last week and they were shocked to discover yesterday that his case was referred to the court with others.

The lawyers have submitted an appeal to the Court of Appeal calling for the immediate release of Shawkan as his detention has exceeded the legal limit of two years in pre-trial detention under Egyptian law. The court is to rule on the appeal within the coming few days. At the time of his arrest, Shawkan was on assignment for Demotix, a photo agency, who confirmed to the prosecutor he had been working for them. At least 18 journalists are currently behind bars in Egypt simply for doing their jobs and exercising their right to freedom of expression.

Shawkan and 400 others detained in the same case were questioned in relation to a set of identical trumped up charges including “belonging to a banned group”, (the Muslim Brotherhood which the authorities later declared a “terrorist” organization), “possessing firearms” and murder. Shawkan denied having ties to the Muslim Brotherhood and all charges against him during the prosecutor investigations two years ago.

His case has been flawed from the moment of his arrest. He was questioned by a prosecutor in the absence of a lawyer and suffered torture and other ill-treatment while he was held in an overcrowded cell at a police station in Cairo. Later he was transferred to Abu Zabaal prison where he was held for seven hours in a police van outside the prison in the sweltering August heat before being allowed inside, where he was once again beaten. He is now at the infamous Tora prison where he is held in very poor detention conditions.
In a letter describing his dire detention conditions to Amnesty International published in April 2015, Shawkan said he was treated “like an animal in Egyptian prisons” and said his indefinite detention is “psychologically unbearable”.

He was also diagnosed with Hepatitis C before his arrest and his family have told Amnesty International he is being denied medication so his health is deteriorating. The family has also submitted many appeals to the prosecutor requesting his release on medical grounds without success.

The authorities also arrested 327 people a few days later on 17 August 2013 including Ibrahim Halawa, an Irish national and prisoner of conscience, after storming a mosque in downtown Cairo where he and other protesters had sought refuge. Today they will have been detained for two years and two days, also exceeding the pre-trial detention limit under current Egyptian law.

International law stresses that pre-trial detention must be a measure of last resort and may only be applied in specific cases if it is established that there is a substantial risk of flight, harm to others or interference with the evidence or investigation. There must be an ongoing examination of the continuing lawfulness and necessity of detention in each individual case. The Egyptian Code of Criminal Procedures in its article 143 limits pre-trial detention to up to two years and orders the immediate release of a detainee if not sentenced within that period.

“Locking hundreds of people up in pre-trial detention for two years or more without justification is clearly a punitive measure to silence those who dare to challenge the official narrative,” said Said Boumedouha.

The extension of Shawkan’s detention comes the day after Egypt’s President Abdel Fattah al-Sisi signed a new “counterterrorism law” that will make it even easier for the authorities to hold detainees for long periods by giving the public prosecutor the power to detain people for investigation up to seven days renewable to similar periods without a limit. This effectively removes the two year limit prescribed under Egyptian law.

The law’s definition of what constitutes a “terrorist act” is overly broad and grants the authorities free rein to detain peaceful government critics, including journalists, on vague grounds. The law also effectively bans independent reporting by imposing hefty fines for journalists who report information or statistics about terrorist attacks that differ from what has been announced by the state.

Amnesty International sent a memorandum to the president on 12 August 2015 urging him to either drop the law or fundamentally revise it to bring it in line with the Egyptian constitution and international human rights law.

국제앰네스티는 8일 아일랜드의 낙태 인식에 대한 여론조사 결과를 발표하면서, 아일랜드 정부에 대해 세계에서 가장 엄격한 수준인 아일랜드의 낙태금지법을 개정해야 한다는 압박이 더욱 강력해지고 있다고 밝혔다.

국제앰네스티와 레드씨 리서치마케팅(RED C Research and Marketing)이 진행한 이번 여론조사 결과 아일랜드 국민 대다수는 낙태가 형사범죄가 아니라고 생각했으며, 낙태 시술을 받은 산모나 시술을 한 의사가 형사처벌을 받는 현행법에 찬성하지 않는 것으로 나타났다.

아일랜드 정부가 낙태를 합법화해야 할 것이냐는 질문에는 67%가 찬성하고 25%가 반대했다. 아일랜드에서 합법적으로 낙태 시술을 받을 수 있는 기반을 크게 넓히는 것에 대해서는 81%가 찬성한다고 밝혔다.

콜름 오고만(Colm O’Gorman) 국제앰네스티 아일랜드지부 이사장은 “아일랜드 국민들의 낙태에 대한 인식이 상당히 변화했다는 것은 명백하다. 대부분의 아일랜드 국민들은 이제 여성들의 처지를 더욱 이해하고 있으며, 낙태 시술을 받았다는 이유로 처벌받아서는 안 된다고 확고히 생각하고 있다”고 말했다.

주요 설문 결과는 다음과 같다.

이번 설문조사는 아일랜드의 낙태 관련법에 관한 여론을 보다 깊이 이해하고자 지난 5월 레드씨 리서치마케팅이 실시한 것으로, 아일랜드의 낙태 정책을 인권친화적으로 개정할 것을 촉구하는 국제앰네스티 캠페인의 일환이다. 또한 대상자들에게 아일랜드에서 낙태 시술이 가능한 시기는 언제여야 하는지에 대한 개인적인 의견 역시 함께 물었다. 설문 결과는 레드씨와 국제앰네스티가 교차 확인을 거쳤다.

레드씨는 2015년 5월 11~14일 아일랜드의 성인 대표 표본집단 1,000여명을 대상으로 전화 설문을 실시했다. 표본크기는 연령, 성별, 사회경제적 지위 및 거주지역을 바탕으로 설정했다.

2015년 6월 9일, 국제앰네스티는 아일랜드의 낙태금지법이 인권법 위반임을 보여주는 보고서 <그녀는 범죄자가 아니다: 아일랜드 낙태금지법의 영향>을 발표했다. 보고서가 발표된 후 유엔 역시 아일랜드에 지나치게 엄격한 관련법을 개정할 필요가 있다고 전하기도 했다.

The Irish government is under growing pressure to reform its anti-abortion law, one of the most restrictive in the world, Amnesty International said today as it published results of an opinion poll on public attitudes to abortion in Ireland.

The poll, carried out for Amnesty International by RED C Research and Marketing, shows that the majority of people in Ireland are not aware that abortion is a criminal offence. The vast majority disagree with the current criminal sanctions for women who have abortions, or doctors who provide abortions.

Asked whether the Irish government should decriminalize abortion, 67% agreed and 25% disagreed. 81% are in favour of significantly widening the grounds for access to legal abortions in Ireland.

“It is clear that Irish views on abortion have undergone a major transformation. People in Ireland are now, on the whole, more understanding of the situations women find themselves in and firmly believe that women should not be criminalized for having an abortion,” said Colm O’Gorman, Executive Director of Amnesty International Ireland.

“This poll demonstrates that on the issue of abortion Ireland’s people are clearly way ahead of their government leaders. The conversation we urgently need in Ireland on abortion is a challenging one, but it must happen.

“The Irish government should put this issue to the people as a matter of priority. Decriminalizing abortion is not only a human rights obligation – it is what people in Ireland want. And this means repealing the 8th Amendment,” said Colm O’Gorman.

Headline figures are as follows:

· 64% of people did not know it is a crime to get an abortion in Ireland when a woman’s life is not at risk.
· Less than one in 10 (9%) knew the penalty for having an unlawful abortion in Ireland is up to 14 years imprisonment.
· Only 7% agreed that women should be imprisoned for up to 14 years for having an unlawful abortion.
· Only 13% of people agreed that doctors should be imprisoned for up to 14 years for performing an unlawful abortion.
· 71% agreed that classifying abortion as a crime contributes to the distress and stigma felt by women who have had abortions.
· 65% of respondents agreed Ireland’s abortion ban makes women have unsafe abortions.
· 68% agree that Ireland’s abortion ban does not stop most women who want an abortion from having one.

The poll also found that 70% of respondents agree that women have an international human right to an abortion when their pregnancy is a result of rape or incest, where their life or health is at risk, or in cases of fatal foetal impairment. On 24 June 2015 the United Nations Committee on Economic, Social and Cultural Rights reiterated this right when it called on Ireland to revise its abortion laws to bring them in line with international human rights standards.

“81% percent of people were in favour of access to abortion beyond the current Irish legal position. This comprises the 36% who believe abortion should be allowed where the woman’s life is at risk, the pregnancy is a result of rape or incest, where the woman’s health is at risk, or where there is a fatal foetal abnormality, and the 45% who would go further and allow women to access abortion as they choose. 9% were in favour of access just where the woman’s life is at risk, the current legal position,” said Bryan Cox, director at Red C Research and Marketing.

“What also struck us is how few respondents declined to answer questions or had no opinion. Clearly people have views they want to express.”

The poll was conducted by Red C in May to establish a deeper understanding of public attitudes to Ireland’s laws on abortion, and is part of Amnesty International’s campaign calling for a human rights compliant abortion framework in Ireland. The poll also asked respondents for their personal views on when access to abortion should be provided in Ireland. The polling results were then cross-compared across these groups.

RED C conducted more than 1,000 telephone interviews among a nationally representative sample of the adult population between 11-14 May 2015. The sample size was quota controlled by age, gender, socio-economic status and region.

On 9 June 2015, Amnesty International issued a report showing that Ireland’s abortion laws violate human rights law, She Is Not a Criminal: The Impact of Ireland’s Abortion Law. Since then, the United Nations has also told Ireland it needs to change its restrictive laws.

Amnesty International commissioned this poll before publishing its report to gauge public opinion in Ireland prior to its being influenced by the report or the ensuing public debate.

러시아 정부가 국내 비정부단체들의 후원 경로를 차단하기 위해 미국의 자선단체인 ‘국립 민주주의기금(NED)’을 ‘바람직하지 않은’ 단체로 등록하고 활동을 금지하면서, 외국기관을 엄격히 제한하는 신규 법을 28일 처음으로 적용했다고 국제앰네스티가 밝혔다.

올해 5월 시행된 이 법을 이용해 러시아 검찰청은 NED의 러시아 내 활동은 이제 사실상 불법이라고 밝히고, 법무부에 NED를 ‘바람직하지 않은 단체’로 등록할 것을 요청했다.

존 달후이센(John Dalhuisen) 국제앰네스티 유럽-중앙아시아 국장은 “소위 ‘바람직하지 않은 단체’의 명단을 작성하는 부끄러운 조치는 최근 수 년간 러시아 시민사회를 조직적으로 철저히 탄압하려 하고 있는 정부가 보여준 또 하나의 최악의 모습”이라며 “러시아에서 활동하는 외국기관을 표적으로 한 이번 신규 법은 명백히 표현과 결사의 자유를 제한하기 위한 것이다. 이 법을 계속해서 적용하게 되면 국민의 인권을 보호하고 정부를 견제하는 러시아 단체의 활동이 막대한 영향을 받게 될 것”이라고 말했다.

러시아 검찰청은 28일 NED의 활동이 “’러시아 연방의 헌정질서와 방위능력, 국가안보’를 위협하고 있다”고 밝혔다.

NED가 저질렀다는 불법행위로는 선거를 독립적으로 감시하는 영리, 비영리단체에 기부한 것, 불특정한 “정치적 활동”을 벌인 것, “(러시아)군의 권위를 실추시킨 것” 등이 지목됐다.

NED는 수 년 동안 러시아의 주요 인권활동과 시민사회활동에 자금을 지원해 왔다.

러시아에서 활동하고 있는 다른 국제 시민단체 역시 빠른 시일 내로 표적이 될 것으로 예상된다.

7월 21일 이후, ‘바람직하지 않은 단체’로 지목된 단체 중 찰스 스튜어트 모트 재단과 맥아더 재단등 최소 2개 단체는 정부의 탄압을 피하고자 러시아에서의 자선사업을 중단하기로 결정했다고 발표했다.

존 달후이센 국장은 “안타깝게도 이번 법을 통해 실제 탄압만큼이나 위협만으로도 충분히 큰 영향을 미친다는 것이 증명되고 있으며, 정부의 탄압 표적이 될 것이라는 위험만으로도 이미 인권활동가와 비정부단체, 자선단체가 러시아에서 중요하고도 정당한 활동을 하지 못하도록 낙인을 찍는 것과 같은 효과를 일으키고 있다”고 말했다.

양면 공격

러시아 정부의 외국기관 탄압은 소위 “외국기관의 기능을 수행하는 단체”, 즉 해외에서 자금을 받고, 막연한 “정치적 활동”에 관여하고 있는 러시아 NGO의 활동을 중단시키고자 지난 2012년 마련된 또다른 법의 연장선상에 있다.

이 법에 따르면 “외국기관”으로 분류된 NGO는 정부에 등록해야 한다. 동시에 국영 언론매체는 이러한 NGO들을 비방하며 전례 없는 흑색선전을 벌인다.

러시아 법무부에 ‘외국기관’으로 등록된 NGO는 총 81개로, 이 중 7개 단체는 이후 명단에서 제외되었다. 이번 달에만 전국적 선거 감시단체 네트워크의 일원인 ‘골로스우랄’과 2개 인권단체 등의 5개 단체가 명단에 새로 등록되었다.

‘외국기관’으로 등록된 단체 중 최소 24곳이 과거 NED로부터 후원을 받은 바 있다.

존 달후이센 국장은 “해외 후원단체를 직접 겨냥한 것은 정부가 위협으로 간주하고 있는 러시아 NGO들에 대한 자금 지원을 끊기 위한 것”이라며 “정부는 이러한 ‘외국기관’ 및 ‘바람직하지 않은’ 해외 단체에 대한 음험한 법을 지체 없이 폐지해야 한다”고 말했다.

‘외국기관’으로 등록된 단체 다수가 정부에 대해 장기적인 법적 투쟁을 벌이고 있는 한편, 단체와 활동에 대한 흑색선전에 반발하며 폐쇄를 결정한 단체도 많다.

가장 최근 이러한 결정을 내린 단체는 지난 주 폐쇄한 ‘국제 고문반대위원회’로, 러시아 인권활동가들이 2000년 설립한 이후 경찰 구류 및 교도소 수감 중 벌어지는 고문과 부당대우를 조사하고 고발하는 활동을 벌였다.

현재 약 200여건의 구금 중 인권침해 의혹을 조사하고 있는 이 단체는 28일 모스크바에서 기자회견을 열고, ‘고문방지위원회’라는 새로운 이름으로 활동을 이어갈 예정이라고 밝혔다.

Russia begins blacklisting ‘undesirable’ organizations

Russian authorities today used a draconian new law on “undesirable” foreign organizations for the first time to blacklist the US-based charity National Endowment for Democracy (NED) in an attempt to cut a funding lifeline to Russian NGOs, said Amnesty International.

Using the law, which came into force in May this year, the Office of the Prosecutor General announced that NED’s work in the country is now effectively illegal and asked the Ministry of Justice to register it as an “undesirable organization”.

“This reprehensible move to blacklist so-called ‘undesirable organizations’ marks another low point for Russian authorities that have systematically sought to slash and burn the country’s civil society in recent years,” said John Dalhuisen, Europe and Central Asia Programme Director at Amnesty International.

“The new law targeting foreign organizations working in Russia is expressly designed to curtail freedom of expression and association. Its continued use will have a devastating impact on the work of national organizations that defend human rights of ordinary Russians and keep the authorities in check.”

The Office of the Prosecutor General today announced that NED’s activities “pose a threat to ‘constitutional order of the Russian Federation, defence potential and security of the state’”.

Among NED’s alleged infractions were its donations to commercial and non-profit organizations that independently monitor elections, as well as for undefined “political activities” and “discrediting service in the [Russian] armed forces”.

Over the years, NED’s funding has supported frontline human rights and other civil society activities in Russia.

Other international organizations with Russian offices are expected to be targeted in the near future.

Since 21 July, at least two of those earmarked, the Charles Stewart Mott Foundation and the MacArthur Foundation, have announced decisions to close down their philanthropic work in Russia to avoid the prospect of being targeted.

“Sadly with the ‘undesirables’ law, its bark is proving as bad as its bite, and the mere threat of being targeted is already having a stigmatizing effect on human rights defenders, NGOs and charities doing vital and legitimate work in Russia,” said John Dalhuisen.

Two-pronged attack

The crackdown on foreign organizations follows in the footsteps of a separate 2012 law aimed at stopping the work of so-called “organizations performing the function of foreign agents”, Russian NGOs which receive foreign funding and engage in loosely defined “political activities”.

Under the law, NGOs labelled “foreign agents” must be registered as such. At the same time, there is an unprecedented smear campaign waged against NGOs in the government-controlled media.

In all, 81 NGOs have been listed in the Ministry of Justice’s register of “foreign agents”, seven of which have later been declassified as such. Five new NGOs were added to the list only this month, including “Golos-Ural”, part of a country-wide network of election watchdogs, and two human rights NGOs.

Among the listed “foreign agents”, at least 24 have benefitted from NED’s funding in the past.

“The direct targeting of foreign funders is calculated to dry up philanthropic support to Russian NGOs that the authorities deem a threat,” said John Dalhuisen.

“The authorities should move to repeal the insidious laws on ‘foreign agents’ and ‘undesirable’ foreign organizations without delay.”

Many organizations blacklisted as “foreign agents” have engaged in lengthy legal battles against the authorities, while others have chosen to shut down in protest at the smear campaign against them and their work.

In the past week, the Interregional Committee against Torture became the latest organization to do so. This award-winning NGO was set up by Russian human rights defenders in 2000 to investigate and denounce torture and other ill-treatment in police custody and prisons.

The NGO, which has a current caseload of around 200 allegations of abuses in detention, announced at a Moscow press conference today that it will keep on doing its crucial work under a new name, the Committee to Prevent Torture.

태국 정부는 위구르인 50명을 고문, 강제실종, 처형될 위험이 있는 중국으로 강제 송환해서는 안 되며, 중국은 이미 송환된 위구르인 100여명의 행방을 공개해야 할 것이라고 국제앰네스티가 밝혔다.

9일 오전 태국 정부는 동아시아와 중앙아시아 지역의 투르크계 소수민족인 위구르인 약 109명을 중국으로 강제 송환했다고 밝혔다. 이들은 지난 2014년 3월 태국에 불법 입국한 혐의로 구금되어 있었다.

1980년대 이후 위구르족은 중국 정부로부터 제도적이고 광범위한 인권침해의 표적이 되어 왔다.

니콜라 베클란(Nicholas Bequelin) 국제앰네스티 동아시아 지역국장은 “태국은 위구르인 109명을 중국에 강제로 돌려보냄으로써 국제법을 위반했다. 이는 그들에게 가장 무거운 형벌을 선고한 것이나 다름없는 일이다. 중국으로 송환된 위구르인들이 구금되고, 고문을 당하고, 일부는 사형에 처해지는 등 갑자기 행방이 묘연해진 경우를 이미 여러 차례 지켜본 바 있다”며 “이들을 중국에 강제로 송환하는 것은 비열한 행위이자 국제법을 위반하는 것이다. 태국 정부가 중국으로의 강제송환을 계속한다면, 많은 사람들의 생명을 위태롭게 만들 것”이라고 밝혔다.

태국은 중대한 인권침해를 당할 실질적 위험이 있는 국가 또는 관할 구역으로의 강제송환을 금지하는 농르풀망(Non-refoulement)원칙의 당사국이다. 농르풀망 원칙은 수많은 국제기준에 명시되어 있으며, 국제관습법으로 인정받아 관련 조약의 비준 여부와 상관없이 모든 국가에 구속력을 지닌다.

또한 망명자를 고문 및 그 외 부당대우를 당할 위험이 있는 나라로 강제 송환하는 것은 태국이 당사국인 고문방지협약 역시 위반하는 것이다.

Thailand must not send Uighurs to Chinese torture

The Thai authorities must not return 50 ethnic Uighurs to China, where they are at risk of being tortured, forcibly disappeared and executed, and China must reveal the whereabouts of more than 100 already deported, said Amnesty International.

This morning, the Thai authorities confirmed that they have deported to China some 109 Uighurs – the Turkic ethnic group living in Eastern and Central Asia. They were part of a group detained for irregular entry into Thailand in March 2014.

Since the 1980s, the Uighurs have been the target of systematic and extensive human rights violations by the Chinese authorities.

“Thailand has violated international law by forcibly returning some 109 Uighurs to China. This is akin to sentencing them to the worst punishment imaginable. Time and time again we have seen Uighurs returned to China disappearing into a black hole, with some detained, tortured and in some cases, sentenced to death and executed,” said Nicholas Bequelin, Regional Director for East Asia at Amnesty International.

“Deporting these people is a despicable act, and illegal under international law. If the Thai authorities go ahead with any further deportations, they will be putting the lives of many at risk.”

Thailand is bound by the principle of non-refoulement, which prohibits the transfer of people to any country or jurisdiction where they would be at real risk of serious human rights violations or abuses. This principle is enshrined in numerous international instruments, and has achieved the status of customary international law, binding on all states, regardless of whether they have ratified the relevant treaties.

The forcible return of people to a country where they could face torture and other ill-treatment would also violate the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, to which Thailand is a state party.

엘살바도르의 극단적인 낙태금지법에 따라 유산이나 응급상황을 겪은 여성들이 불법 낙태 시술을 받은 혐의로 갇히면서, 수백 명 자녀의 삶에 참담한 영향을 끼치고 있다고 국제앰네스티가 11월 30일 발표한 보고서를 통해 밝혔다.

보고서 <헤어진 가족, 끊어진 인연>에서는 터무니없는 낙태금지법으로 갇힌 여성의 아이들이 대부분 금전적으로 힘든 상황에 부닥치거나 어머니와 연락을 주고받지도 못하는 현실이 담겨있다.

아스트리드 발렌시아(Astrid Valencia) 국제앰네스티 중앙아메리카 조사관은 “엘살바도르 정부는 유산이나 임신 합병증을 겪은 여성을 부당하게 가둘 때마다 그 자녀들 역시 가난과 정신적 고통 속에 살아가도록 내몰고 있다”며 “임신 합병증을 겪은 여성들에게만 적용되는 엘살바도르의 ‘유죄 추정의 원칙’으로 수백 명이 희생되었고, 여성들은 최대 40년까지의 징역형에 처했으며, 의사와 환자 사이에 절대적인 공포 분위기가 조성되었다. 지금이야말로 엘살바도르의 이러한 시대착오적인 낙태금지법을 철폐해야 할 때”라고 말했다.

모든 경우에 대한 낙태 시술이 범죄화됨에 따라 최소 19명 이상의 여성들이 근거가 미약하거나 결정적이지 못한 증거로도 살인과 같은 중대한 범죄로 유죄 선고를 받고, 장기간의 징역형에 처해 현재 교도소에 갇혀 있다. 이들 중 대부분은 가정의 생계를 책임지고 있었다. 이런 여성들이 투옥되면 가족들이 벌이하고 아이들을 돌봐야 하는데, 주로 극심하게 어려운 상황에 처한 경우가 많았다.

경제적 수입이 전혀 없고, 교도소가 집에서 멀리 떨어진 탓에 대부분의 가족은 사랑하는 가족을 면회하기도 어렵다. 일부의 경우 수개월 넘게 자녀를 만나지 못하는 여성들도 있었다.

유산을 겪은 이후 ‘고의 살인’ 죄로 징역 40년형을 선고받고 현재 수감 중인 32세 여성 마리아 테레사 리베라는 2011년 갇힌 이후 지금까지 열 살 난 아들을 만난 것이 겨우 4번에 불과했다.

마리아 테레사의 아들은 그녀가 수감된 교도소로부터 수 시간 떨어진 곳에 할머니와 함께 살고 있는데, 교도소를 한번 방문하려면 엄두도 못 낼 정도로 비싼 비용이 든다. 마리아 테레사가 벌어오던 수입이 끊기고, 정부의 지원도 없어 마리아 테레사의 시어머니 역시 손자를 키우는 데 큰 어려움을 겪고 있다.

마리아 테레사는 욕실에서 거의 실신한 상태로 피를 심하게 흘리고 있는 것을 시어머니가 발견해 병원에 옮겨졌으나 그 자리에서 체포되었다. 병원 직원이 낙태한 것으로 의심하고 경찰에 신고했던 것이다.

재판 과정에서 마리아 테레사의 직장 상사 중 한 명이 그녀가 임신한 사실을 2011년 1월에 이미 알고 있었다며 불리한 증언을 했다. 이 증언이 사실이라면 유산 당시 임신 11개월째였다는 말이 된다. 이처럼 터무니없는 증언조차도 유죄를 선고하는 근거로 이용됐다.

마리아 테레사의 어린 아들은 어머니의 부당한 구금으로 유난히 힘든 시간을 보내고 있다.

마리아 테레사의 시어머니인 “이사벨”은 교도소를 방문할 때마다 겪는 고통에 대해, “손자를 데리고 처음 면회를 갔을 때는 정말 힘들었다. 손자는 심하게 울음을 터뜨렸고 나도 마찬가지였다. 아이는 교도소를 떠나지 않으려고 했다. 너무나 고통스러워서 아이를 데리고 나가는 것도 잠시 포기해야 했다. 아이에게도, 엄마에게도 너무나 힘든 일이기 때문이었다”고 전했다.

테오도라 델 카르멘 바스케스는 2008년 직장에서 사산한 후 “고의 살인” 죄로 징역 30년이 선고됐다. 그녀의 11살 난 아들은 면회를 거의 오지 못한다.

테오도라는 2008년 30년 형을 선고받았다. 11살 난 아들은 엄마를 거의 만날 수 없다.

베르타(가명) 역시 이와 비슷하게 임신 합병증을 겪고 기소되어 거의 1년간을 감옥에서 보냈다. 수감되어 있던 기간의 절반 동안은 열 살 난 아들을 만날 수 없었다.

“베르타”는 2010년 7월 출혈이 심한 상태로 지역 병원을 찾았다가 체포되었다. ‘고의 살인’ 죄로 기소되었지만 정작 본인은 임신한 사실조차 몰랐다. 재판이 시작할 때까지 변호사를 만나지도 못했다. 베르타가 기소된 죄목으로 유죄가 선고되면 최대 징역 50년형까지 처할 수 있었다. 사법절차가 시작된 지 거의 1년 만에 베르타는 무죄가 선고됐다. ‘치료 목적, 윤리적, 우생적 낙태 비범죄화를 위한 시민단체’라는 지역 인권단체의 소속 변호사들이 새로운 증거를 제출한 덕분이었다.

그러나 재판 과정과 교도소에 갇혔던 당시의 경험은 베르타와 가족들의 삶에 엄청난 상처를 남겼다.

베르타는 당시의 경험 때문에 여전히 정신적으로 힘든 상태이며, 이후 어떤 형태의 보상이나 배상도 받지 못했다고 국제앰네스티에 전했다.

베르타는 “몇 년이 지나더라도 그 때로 인한 고통은 여전히 마음속 깊은 곳에 남아 있다”고 말했다.

베르타의 어머니는 당시 베르타가 부당하게 교도소에 갇히면서 끼친 영향에 대해, “딸이 감방에서 지내는 동안 추위로 고생하고 있을 것을 생각하니 잘 때도 이불을 덮지 못했다. 이불을 덮지 않으면 함께 고통을 나눌 수 있겠다고 생각했기 때문이었다. 지금도 아무리 추워도 이불을 덮지 못하는 걸 보니 여전히 상처가 아물지 않은 것 같다. 지금은 베개도 딱딱한 바위처럼 느껴진다. 예전과는 전혀 달라졌다”고 국제앰네스티에 전했다.

아스트리드 발렌시아 조사관은 “엘살바도르 정부는 어린아이들에게 이처럼 감당할 수 없는 고통을 선고하기보다는, 여성을 그저 ‘출산 기계’로 취급하는 것만이 목적인 현행법을 재검토하는 데 여력을 집중해야 할 것”이라고 말했다.

1998년 개정형법에 따라, 엘살바도르는 강간, 근친상간에 의한 임신이거나 산모의 생명이 위험에 처한 경우에도 상관없이 모든 경우에 대한 낙태 시술을 금지했다. 이로 인해 여성들이 즉시 유죄로 몰리며 부당한 기소와 형법의 오적용이 계속되고 있다. 경제적으로 넉넉하지 못한 여성들은 특히 낙태금지법으로 더욱 큰 영향을 받았다.

EL SALVADOR’S TOTAL ABORTION BAN SENTENCES CHILDREN AND FAMILIES TO TRAUMA AND POVERTY

El Salvador’s extreme anti-abortion law is having a devastating effect on the lives of scores of children whose mothers, having suffered miscarriages or other obstetric emergencies, are being held behind bars accused of having illegal abortions, said Amnesty International in a new report today.

Separated families, broken ties, reveals how children of women jailed under the absurd anti-abortion law are often left facing difficult financial circumstances and prevented from staying in touch with their mothers.

“Each time authorities in El Salvador unfairly lock up a woman for having a miscarriage or suffering pregnancy related complications, they are also condemning her children to a life of poverty and trauma,” said Astrid Valencia, Central America Researcher at Amnesty International.

“El Salvador´s ‘guilty until proven innocent’ approach when it comes to women who suffer pregnancy-related complications has cost scores of lives, landed women in prison for up to 40 years and created an environment of absolute fear amongst doctors and patients. It is high time for El Salvador to abolish this outdated ban.”

At least 19 women are currently in jail, in the context of a total criminalization of abortion, convicted of serious offences such as homicide and sentenced to long prison terms on weak or inconclusive evidence. Most of them were their household’s main breadwinners. Since their incarceration, their extended families are responsible for providing and looking after their children, often in extremely difficult circumstances.

The lack of financial resources and the long distances between their homes and the prisons prevents many of the families from visiting their loved ones in prison. In some cases, women were not able to see their children for months.

Maria Teresa Rivera, a 32-year-old woman currently serving a 40 year prison sentence for “aggravated homicide” after having a miscarriage has only seen her ten-year-old son four times since she was jailed in 2011.

The boy lives with his grandmother several hours away from the prison and the journey is prohibitively expensive. Without Maria Teresa’s income and with no official support, her mother- in- law is also struggling to provide for her grandson.

Maria Teresa was arrested in a hospital after her mother-in-law found her in her bathroom almost unconscious and bleeding heavily. Staff at the hospital reported her to the police and accused her of having an abortion.

During the trial, one of Maria Teresa’s bosses testified against her saying she knew she was pregnant in January 2011. This would have made her 11 months pregnant by the time the miscarriage took place. The outrageous testimony was used as one of the pieces of evidence to convict her.

María Teresa´s young son is having a particularly difficult time dealing with his mother’s unfair detention.

“Isabel”, María Teresa´s mother in law, told Amnesty International of the traumatic visits to the prison: “The first time I took the child it was very hard. He cried a lot and I did too. He didn’t want to leave the prison. It was so hard that I stopped taking him for a while because it was tough for both of them.”

Similarly, Bertha (not her real name), spent nearly a year in jail also prosecuted for homicide after suffering a pregnancy-related complication. She was not able to see her 10- year-old son during half the time she was in prison.

“Bertha” was arrested in July 2010 in a local hospital, where she had arrived heavily bleeding. She was charged with “aggravated homicide” although she did not know she was pregnant. “Bertha” did not meet her lawyer until the trial started. The penalty for the crime she was accused of could be as high as 50 years in jail. Bertha was found innocent almost a year after the process against her began, when lawyers from the local human rights group Citizen Group for the Decriminalization of Therapeutic, Ethical and Eugenic Abortion provided new evidence on the case.

The trial and the time she was forced to spend in jail, however, left a profound mark on Berta’s life and her relatives.

She told Amnesty International that she is still traumatized by the experience and said she has not receive any kind of compensation or reparation measures.

“Even though several years have passed, the pain stays deep inside,” she said.

Talking about the impact of Bertha’s unfair incarceration on her family, her mother said: “To sleep, I couldn’t use the covers because during those days, when she was in the cells, I would start to think that she was suffering from the cold and so I wouldn’t cover myself so that I could experience her suffering. And now, I can’t use the covers even if I’m cold, so I know I’m still affected by it. Now, the pillow feels like a stone…I’m not the person I used to be.”

“Instead of sentencing children to this unbearable suffering, authorities in El Salvador should focus their energies in reviewing legislation that serves no purpose but to treat women as little more than ‘human vessels’,” said Astrid Valencia.

Following a change in the Penal Code in 1998, abortion in El Salvador has been banned in all circumstances – even when the pregnancy is the result of rape, incest or when the life of the woman is at risk. The change in the law has led to wrongful prosecutions and misapplication of criminal law where women are immediately assumed guilty. Women with few economic resources are particularly affected by the ban.
