1. 취지와 목적
 - 지난 6년간 시리아 내전으로 인해 45만 명 이상이 사망하고 1천 2백 만 명에 달하는 국내외 난민이 발생한 상황임. 최근 정부군이 장악한 알레포 동부 지역은 간헐적으로 적대행위가 계속되어 주민들의 피난은 수시로 중단과 재개를 반복하고 있고, 지금 이 시각에도 러시아와 시리아 공군이 쏟아 붓는 미사일과 포탄이 주민들의 생명을 앗아가고 있음.
 - 이러한 대규모 인명 피해와 난민 발생에도 불구하고 러시아, 미국, 이란, 터키 등 국가들의 정치·군사적 개입과 무기 판매는 시리아 상황을 악화시키고 있으며 피해는 확대되고 있음. 
 - 이러한 시리아 상황에 대한 우려를 표하고 한국을 비롯한 국제사회의 관심을 촉구하기 위해 시리아 내전에 정치적·군사적 개입 해온 국가들 대사관 앞과 주요 도심지역에서 동시다발 1인 시위를 진행하고자 함. 이번 1인 시위를 통해 시리아 전역에 대한 공습 즉각 중단과 알레포를 비롯한 모든 지역 주민들의 안전한 피난 보장, 한국정부의 시리아 난민 인정을 촉구할 예정임.

세계 난민위기 대응 8개 계획

세계 선진국들이 어찌할 바를 모르고 서로 언쟁만 벌이는 동안 끔찍한 인도적 환경에서 고통받고 있는 수백만 명을 외면하고 있는 도덕적 참사는 후세에 부끄러운 유산으로 남게 될 것이라고 국제앰네스티가 밝혔다. 국제앰네스티는 12일 세계적인 난민 위기에 대응하기 위한 8개 계획을 발표했다.

시리아, 이라크, 아프가니스탄의 끔찍한 폭력 사태와, 사하라 이남 아프리카 및 다른 지역에서 벌어진 수 차례의 무력 분쟁으로 인해 전 세계 난민의 수는 역사적으로도 유례 없는 수준으로 증가했다. 한편 동남아시아 지역에서는 다시 “항해기”에 들어서면서, 미얀마의 탄압을 피해 떠나왔으나 인신매매와 그 외 인권침해의 희생자로 전락하게 되는 로힝야족 수천여 명이 이에 포함될 것으로 예상된다.

이처럼 세계적인 난민 위기에 대처하는 방식은 부끄러운 수준으로, 특히 세계적으로 선진국에 속하는 국가들은 인도주의적 원조와 난민 재정착 요청을 모두 무시하고 있다. 재정착이 필요한 난민은 115만 명에 이르지만 선진국들이 제공한 재정착지는 그 중 불과 약 10%만을 수용할 규모에 그쳤다. 그러는 동안 개발도상국들은 난민 수백만 명을 거의 아무런 지원 없이 수용하고 있는 실정이다.

살릴 셰티(Salil Shetty) 국제앰네스티 사무총장은

“전례 없이 계속되는 세계적인 난민 위기로 수백만 명이 절망 속에 살아가고 있지만 선진국들의 대응은 참담한 수준이다. 지금이 바로 후대에 길이 남게 될 중요한 순간으로, 이들이 대응 방향을 바꾸지 않는 한 매우 혹독한 역사의 심판을 받게 될 것”

이라며 “국제적인 난민보호제도는 2차대전 이후 중요한 안전조치로 마련되었지만, 선진국들이 전쟁과 탄압을 피해 온 취약한 사람들을 보호하지 못하고 안타까운 실책을 계속해서 범할 경우 무용지물로 전락할 위험이 있다”고 말했다.

부담 감내해야 하는 빈곤국

최근 수 개월 동안 유럽연합 국가에 입국한 난민의 수가 증가했다는 내용이 언론에 대서특필된 반면, 현실은 세계 각지의 난민 위기로 인한 부담을 빈곤국들이 모두 감당해야만 하는 상황이다. 주로 중동, 아프리카, 아시아 지역의 개발도상국들이 현재 총 1,950만명의 난민 중 86%를 수용하고 있다.

이러한 부담을 나누기 위한 선진국들의 노력은 턱없이 부족한 수준이다. 난민 위기에 대한 인도주의적 원조는 계속해서, 대부분 심각할 정도로 예산이 부족한 상태다. 예를 들어 지난 10월 2일 시리아 난민에 대한 유엔의 인도주의적 지원 요청은 필요 예산의 46%를 모금하는 데 그쳤으며, 남수단 난민을 위한 원조 기금은 초라하게도 목표액의 17%만을 채웠다. 이는 난민들이 식량, 의료품, 그 외 인도주의적 지원을 받는 데 참담하리만치 큰 영향을 미치고 있다.

“수천 명이 바다에서 목숨을 잃거나 철조망 아래의 비참한 환경에서 살아가고 있는 동안, 많은 국가들은 이처럼 전례 없는 위기에 맞서기보다 사람들을 국경 밖으로 쫓아낼 방법을 강구하기에만 바쁘다. 이는 매우 심각한 도덕적 파탄이다” 살릴 셰티

살릴 셰티 사무총장은 “다음 달 터키에서 열릴 G20 총회에서 각국 정상들은 세계적인 난민 위기 해결을 위해 유지 가능한 인도적 기금 확보를 보장할 수 있도록 분명한 일정과 함께 구체적인 계획을 마련하기 전까지는 회의장을 떠나서는 안 될 것이다. 그렇지 못할 경우 리더십의 완전한 실패로 돌아가게 될 것”이라며 “수천 명이 바다에서 목숨을 잃거나 철조망 아래의 비참한 환경에서 살아가고 있는 동안, 많은 국가들은 이처럼 전례 없는 위기에 맞서기보다 사람들을 국경 밖으로 쫓아낼 방법을 강구하기에만 바쁘다. 이는 매우 심각한 도덕적 파탄”이라고 말했다.

8개 계획

결국 난민 위기는 그 근본적인 원인이 해결되면 종식될 수 있다. 국가정부는 분쟁과 만연한 인권침해를 끝내기 위해 노력해야 할 것이나, 이는 달성하기 어려울뿐더러 오랜 시간이 필요한 일이다.

그러나 세계적인 난민 위기로 인한 끔찍한 여파를 줄이기 위해 선진국들이 지금 바로 나설 수 있는 일도 있다. 국제앰네스티는 다음 8개 우선 영역에 대해 구체적인 행동에 나설 것을 촉구한다.

  1. 난민 위기에 대해 지속적이고, 충분하고, 예측 가능한 기금을 마련하라: 난민 위기에 관한 모든 인도적 기금은 반드시 충분한 투자를 받아야 하고, 더불어 대규모의 난민을 수용하고 있는 국가들에게 의미 있는 재정적 지원을 제공함으로써 난민과 지역사회에 필요한 서비스를 제공할 수 있도록 도와야 한다.
  2. 유엔난민기구(UNHCR)가 확인한 재정착 필요 난민들을 모두 이주시켜라: UNHCR 발표에 따르면 현재 취약한 상태로 재정착이 필요한 난민들은 115만 명에 이른다. 국제앰네스티는 향후 2년 내로 이 숫자가 145만 명까지 증가할 수 있다고 추정한다.
  3. 난민에게 안전하고 합법적인 입국 경로를 마련하라: 모든 사람들은 피난할 권리를 행사하기 위해 위험한 뱃길을 떠날 필요가 없어야 한다. 정부는 난민의 가족 재통합을 더욱 간편하게 하고, 대상 국가로 이주해 망명을 신청할 수 없는 조건에 있는 취약한 난민들에게 인도적 비자를 발급할 수 있도록 하고, 해외 난민들에게 자국의 취업비자와 학생비자 발급 비율을 일정 부분 할당해야 한다.
  4. 생명을 구하라: 국가정부는 이주 정책을 적용하기보다 조난자 구조를 우선해야 한다. 바다를 건너려 하는 난민들을 비롯해 사람들이 목숨을 잃을 위기에 처했을 경우 정부는 수색구조 작전에 충분히 투자하고 즉시 조난자를 구조해야 한다.
  5. 국경지대에 도달한 난민들에게 입국을 허용하라: 이러한 난민들은 유효한 여행서류를 소지했는지 여부와 상관없이 공식적인 국경통과지역을 지나도록 허가 받아야 한다. 정부는 본국의 탄압이나 폭력을 피해 온 사람들을 막는 어떠한 조치도 취해서는 안 된다. 이러한 조치에는 비자 또는 관련 서류 없이는 입국을 거부하거나, 난민들이 국경을 넘지 못하도록 사람들의 등과 경계 울타리를 떠밀거나, 위험한 경로를 택할 수밖에 없게 하는 것 등이 포함된다.
  6. 외국인혐오와 인종차별 타파를 위해 노력하라: 정부는 난민과 이주민이 경제적, 사회적 문제의 원인이라고 암시하거나 직접적으로 언급하는 것과 같이 먼저 외국인혐오에 빠지지 않도록 주의해야 한다. 또한 인종차별 또는 그 외의 차별을 명시하고 있거나, 사실상 그로 이어질 수 있는 법과 관행을 개정해야 한다. 또한 외국인혐오나 인종차별에 기반한 폭력 문제를 해결하기 위해 효과적인 정책을 마련해야 한다.
  7. 인신매매 타파를 위해 노력하라: 정부는 인신매매조직을 수사 및 기소할 수 있도록 효과적인 조치를 취해야 한다. 또한 인신매매 피해자들에게 보호와 지원을 제공하고, 이들이 난민지위 인정 또는 재정착 절차를 신청할 수 있도록 해야 한다. 인신매매 타파를 위한 모든 노력은 반드시 사람들의 안전을 최우선으로 해야 한다.
  8. 난민협약을 전세계적으로 비준하고, 국내적으로 강력한 난민 제도를 마련하라: 국가정부는 난민 지위를 신청하고 누릴 수 있는 권리를 법적으로 인정하고, 난민 신청을 공정하게 평가할 수 있는 절차를 마련하고, 난민의 기본권과 교육, 의료 등의 서비스 접근을 보장해야 한다.

Catastrophic moral failure as rich countries leave millions of refugees to cruel and uncertain fates

Eight-point plan to respond to global refugee crisis

The catastrophic moral failure of world leaders who dither and squabble among themselves while callously leaving millions of people to suffer in disastrous humanitarian conditions will define their legacy for generations to come, said Amnesty International today as it released an eight-point plan to tackle the multiple global refugee crises.

Horrific violence in Syria, Iraq, Afghanistan, and multiple conflicts in sub-Saharan Africa and elsewhere have brought the global refugee population to historic highs. Meanwhile Southeast Asia’s “sailing season” is again getting under way, with many more refugees likely to join the thousands of Rohingya who have fled persecution in Myanmar, only to fall prey to trafficking and other abuses.

The response to these global refugee crises has been shameful, particularly from the world’s richest countries, who have ignored appeals for humanitarian aid and to resettle vulnerable people. Wealthy countries have offered resettlement places to only around a tenth of the 1.15 million people who need them. Meanwhile developing counties are hosting millions of refugees with almost no support.

“The unprecedented multiple global refugee crises are leaving millions of people in desperation, but the response of the wealthy countries is a catastrophic failure. This is a pivotal moment which will define current world leaders’ legacy for generations to come ? history will judge them very harshly unless they change course,” said Salil Shetty, Secretary General of Amnesty International.

“The international refugee protection regime drawn up as a crucial safeguard after World War II risks being left in tatters if world leaders continue in their deplorable failure to protect vulnerable people fleeing war and persecution. Refugees have an international right to seek and enjoy asylum.”

Poor countries bearing the brunt

While the increase in the number of refugees reaching the European Union has dominated headlines in recent months, the reality is that poorer countries are being forced to bear the brunt of coping with the world’s multiple refugee crises. Developing countries mainly in the Middle East, Africa and Asia are currently hosting 86% of the world’s total 19.5 million refugees.

Wealthier countries are not doing nearly enough to share the burden. Humanitarian appeals for refugee crises are consistently ? and often severely ? underfunded. For example, as of 2 October, the UN’s humanitarian appeal for Syrian refugees was only 46% funded, while the appeal for South Sudan refugees only reached a pitiful 17% of its goal. This is having a devastating impact on refugees’ access to food, medicine and other humanitarian assistance.

“When the G20 leaders meet next month in Turkey, they should not leave the room until they have a concrete plan with clear timelines to guarantee full and sustainable humanitarian funding for the world’s multiple refugee crises; anything less will be an utter failure of leadership,” said Salil Shetty.

“Instead of rising to the challenge of this unprecedented crisis, many governments have been busy devising ways to keep people outside their borders while thousands are dying at sea or enduring squalid conditions in the shadow of razor-wire fences. This is moral bankruptcy of the highest order.”

Eight-point plan

Ultimately, refugee crises end when their root causes are addressed. States should seek to end conflicts and widespread human rights abuses, but these goals are difficult to achieve and take time.

However, there are things the world’s richest countries can do right now to lessen the devastating impact of the world’s refugee crises. Amnesty International is calling for concerted action in eight priority areas:

  1. Continuous, sufficient and predictable funding for refugee crises: all humanitarian appeals for refugee crises must be fully funded, in addition to providing meaningful financial support to countries hosting large numbers of refugees to help them provide services to refugees and their host communities.
  2. Fulfilling all resettlement needs identified by the UN Refugee Agency (UNHCR): 1.15 million vulnerable refugees currently need resettlement, according to UNHCR. Amnesty International estimates this number could increase to 1.45 million over the next two years.
  3. Safe and legal routes for refugees: people should not have to embark on dangerous journeys to seek their right to refuge. States should facilitate family reunification for refugees, introduce humanitarian visas to allow vulnerable refugees who do not qualify for resettlement to travel to these states and apply for asylum, and allocate a proportion of their work and student visas programmes to refugees in other countries.
  4. Saving lives: states must prioritize saving people in distress over implementing immigration policies. In situations where people are in danger of death, including ? but not limited to ? people attempting sea crossings, states should invest in search and rescue operations and immediately come to the rescue of people in distress.
  5. Ensure access to territory for refugees arriving at borders: those seeking asylum should be allowed to enter through official border crossings, regardless of whether or not they have valid travel documents. States should refrain from taking any measures that prevent people from fleeing a country where they face persecution or violence; these include refusal of entry without visas or other documentation, push backs and border fences that prevent refugees from entering a country or forces them to take dangerous routes.
  6. Combat xenophobia and racism: governments must refrain from engaging in xenophobia themselves, for example by implying or directly claiming asylum-seekers and migrants are to blame for economic and social problems. Governments must also reform any laws or policies that explicitly or practically result in racial or other forms of discrimination. Governments must also have effective policies to address xenophobic and racial violence.
  7. Combat trafficking: states must take effective action to investigate and prosecute trafficking gangs. States should offer protection and assistance to victims of trafficking and ensure they have access to refugee status determination procedures and/or resettlement opportunities. All efforts to combat trafficking and people smuggling must put people’s safety first.
  8. Global ratification of the Refugee Convention and developing robust domestic refugee systems: states must recognize in law the right to seek and enjoy asylum, have fair domestic procedures to assess refugee claims and must guarantee refugees their fundamental rights and access to services, such as education and healthcare.

지난 2월, 알란 무하마드(30)와 여동생인 기안(28)은 말 한 마리의 양쪽에 매달린 채 이라크에서부터 바위투성이의 험한 산을 넘어 터키로 향했다. 어린 여동생은 말을 끌고 앞서 걸었고, 어머니와 동생들은 뒤에서 무거운 휠체어를 밀며 가파르고 거친 산길을 따라 올랐다.

교사인 알란과 기안은 태어날 때부터 근위축증을 앓았다. 두 사람에게 몸을 움직이는 것은 언제나 힘겨운 일이지만, 무장단체 자칭 이슬람국가(IS)의 폭탄과 박격포가 이들이 살던 시리아 북부 알 하사카흐에 떨어지면서 가족들은 피난을 떠나야 할 때임을 깨달았다. 하지만 어디로 간단 말인가?

알란 가족은 터키의 국경을 넘고자 세 가지 방법을 시도했지만 그 때마다 모두 터키 경찰로부터 총격을 받았다고 했다. 결국 이라크의 국경을 넘는 길을 선택했다. 이라크에서 1년 반 정도 머무르던 이들은 IS의 진격으로 다시 몸을 피해야 했다. 알란의 아버지는 이곳에서 막내여동생과 함께 계속 이동했고, 이들은 먼저 독일에 이르렀다.

알란을 처음 만난 것은 지난 7월 그리스 아테네에서 80km 떨어진 릿소나 난민 캠프에서였다. “정말 힘든 여정이었죠.” 알란이 말했다. “‘평범한 사람’에게도 고된 길인데, 장애인이 여길 지나온다는 건 기적 같은 일이에요. 두 나라(이라크와 터키) 사이 국경지대는 모두 산이거든요.”

알란 가족은 터키에서 간신히 밀입국 브로커와 접촉해, 그리스로 보내주는 조건으로 한 사람당 750달러를 지불했다. 브로커들은 9m 가량 크기의 보트에 약 30명이 타고 이동한다며 이들을 안심시켰다고 한다. 그러나 정작 해안에서 이들을 맞이한 것은 길이 6m에 불과한 고무 보트였고, 60여명이 태워 달라며 아우성치고 있었다. 브로커들은 알란과 기안의 휠체어를 실을 공간이 없다고 했다.

알란과 기안은 해안에 휠체어를 버릴 수 밖에 없었고, 가족들의 도움을 받아 보트에 몸을 실었다.

출항하고 얼마 안 돼 보트 엔진이 요란한 소리를 내더니 멈춰 버렸고, 이들이 탄 보트는 터키 해상에서 표류하고 말았다. “정말 무서웠어요. 네 시간 정도를 바다 위에 떠 있었죠.” 알란은 “주변을 둘러보는 곳마다 아기와 어린 아이들이 울음을 터뜨리고 있었어요. …어머니께서는 정신을 잃으셨고, 여동생도 더는 못 버티겠다고 말했었죠”라고 회상했다.

결국 보트에 타고 있던 사람들이 겨우 모터를 다시 작동시켰고, 여정은 계속됐다. 보트는 마침내 그리스 해안경비대에 구조되어 키오스 섬으로 옮겨졌고, 이 곳에서 알란과 기안은 휠체어를 다시 받을 수 있었다.

알란 가족이 섬에 도착한 것은 3월 12일로, EU-터키 협상이 발효되기 불과 며칠 전이었다. 다른 유럽 국가들의 국경은 닫힌 상태였다.

입국이 허가되어 독일에 있는 아버지와 합류할 수 있으리란 실낱 같은 희망은 부서졌고, 가족 재결합에 대해 논의하려던 유럽 망명지원국과의 면담 약속도 실현되지 못했다. 가족들은 대신 그리스 본토로 향하는 연락선에 탈 수 있었고, 여기서부터 버스를 타고 리소나 난민 캠프로 이동했다.

리소나는 외딴 숲 한가운데 위치한 버러진 군용 기지에 마련된 야외 캠프다. 물리적 조건부터 험난한 이곳은 한낮이면 찌는 듯한 무더위가 계속된다. 주어지는 식량은 너무나 열악한 수준이라 대부분이 버려지는데, 이 때문에 야생 멧돼지들이 꼬이기도 한다. 특히 모래로 뒤덮인 땅과 여기저기 튀어나온 나무 뿌리 때문에 알란과 기안은 이동하기가 더욱 어렵고, 겨울이 다가오면서 상황은 더욱 악화되고 있다.

난민을 환영한다는 유럽 국민들에게 감사합니다. 그리고 그렇지 않은 사람들에게는 두려워하지 말라고 말하고 싶어요.

하지만 이런 어려움에도 불구하고 알란은 여전히 긍정적이다. 알란은 NGO들이 텐트를 쳐 마련한 임시 교실에서 어린이들에게 영어를 가르쳤는데, 이 어린이들의 쾌활한 열정은 캠프의 비참한 환경과 극명하게 대비된다. 북유럽으로 향하는 소위 ‘발칸 경로’가 폐쇄되고, 유럽 국가 정상들이 난민 재정착과 이전에 관해 제대로 조치를 취하지 못하면서 약 6만 명의 난민과 이주민들은 그리스에 발이 묶인 채 계속되는 공포와 막막함 속에서 살아가고 있다. 알란과 그 가족 역시 아버지와 막내 여동생과 기약 없는 시간을 떨어져 지내야 한다.

하지만 알란은 변화가 일어날 것이란 기대를 놓지 않는다. “우리 중에는 의사도 있고, 선생님도 있어요. 전쟁 때문에 모국을 떠났을 뿐이니까요.” 알란은 이렇게 말했다. “난민을 환영한다는 유럽 국민들에게 감사합니다. 그리고 그렇지 않은 사람들에게는 두려워하지 말라고 말하고 싶어요.”

Strapped onto either side of a horse, 30 year-old Alan Mohammad and his 28 year-old sister Gyan crossed craggy mountains from Iraq and into Turkey last February. Their younger sister walked ahead, leading the horse. Their mother, brother and younger sister trailed behind, pushing heavy wheelchairs up the steep unpaved path.

Alan and Gyan, both teachers, have both suffered from muscular dystrophy since birth. Mobility has always been hard for them but, as the bombs and mortars of the armed group that calls itself Islamic State (IS) rocked their home in Al-Hasakah, in northeastern Syria, the family knew it was time to move on. But where could they go?

They told us how on three occasions they tried to cross the border into Turkey but each time were fired on by Turkish police. So they tried a different escape route, crossing the border into Iraq. The family stayed in Iraq for a year-and-a-half until the approach of IS made it necessary for them to flee again. From there their father carried on with their youngest sister, and eventually reached Germany.

I first met Alan in July in Ritsona refugee camp, about 80km from Athens. “It was a very difficult journey,” he told me. “For ‘normal people’ it is very difficult. But for disabled people it is like a miracle because all the borders between the two countries [Iraq and Turkey] are mountains.”

Once in Turkey the family managed to contact a people smuggler, who they paid $750 each for passage to Greece. The family described how smugglers assured them that there would be around 30 people travelling in a boat that would be nine meters long. But when they arrived on the beach they found that the inflatable boat was only six meters long and there were around 60 people clamouring to get on board. The smugglers told Alan and Gyan that there would be no space for their wheelchairs.

They had no choice but to leave the wheelchairs on the shore, and with the help of their family they crammed themselves into the boat.

Shortly after they set off the engine spluttered and cut out, leaving them adrift in Turkish waters. “It was terrifying. We were in the water for around four hours,” recalls Alan. “Everytime I looked around I saw babies and children crying… My mother became faint and at one point my sister told me she could not go on any more.”

Eventually some of the people on the boat managed to restart the motor and they continued their journey. They were finally rescued by the Greek coast guard and taken to the island of Chios where Alan and Gyan were given wheelchairs.

They arrived on the island on 12 March, just days before the EU-Turkey deal came into effect. The borders of other European countries were now closed to them.

Any hopes that they might be permitted to join their father in Germany were dashed and an appointment with the European Asylum Support Office to discuss family reunification failed to materialize. Instead the family were made to board a ferry to the mainland and from there they were taken by bus to Ritsona refugee camp.

Ritsona is an isolated open camp on an abandoned military base situated in the middle of a forest. Physical conditions there are challenging, with sweltering temperatures during the day. The food provided is so poor that much of it gets thrown away, attracting wild boars. The sandy ground and protruding tree roots make it particularly hard for Alan and Gyan to get around, and with winter approaching conditions are set to get much worse.

Yet despite these difficulties, Alan remains positive. He teaches English in a makeshift tented classroom provided by NGOs, the children’s cheerful enthusiasm contrasting starkly with the miserable conditions of the camp. The closure of the so-called Balkan route into northern Europe and the failure of European leaders to resettle and relocate refugees has left almost 60,000 refugees and migrants stranded in Greece, living in a state of constant fear and uncertainty. It has also meant that Alan and his family will remain separated from their father and younger sister for an unknown period of time.

But Alan remains hopeful that things will change. “Here we have doctors and teachers. We left our country because of the war,” he says. “I want to say to the European people that want to welcome refugees, thank you. And to the others, don’t be afraid.”

 - 2011년 3월, 아사드 세습 독재정권에 맞선 시위로 시작된 시리아 내전이 6년째 접어들면서 내전으로 인해 40만 명 이상이 사망하고 480만 명이 국외 난민이 된 상황임. 
- 올해 들어 알레포는 정부군에 포위돼 재앙을 맞고 있음. 11월 중순부터 러시아군은 알레포에 공습을 퍼부었고 지난 12일 정부군이 도시를 장악했으나 정부군이 장악한 알레포 동부지역에는 아직 5만 명의 주민이 남아있는 것으로 추산됨. 
- 물과 음식, 의약품 지원이 끊기고 전기조차 없는 상태에서 주민들은 공습에 숨지거나 정부군 보복에 희생되고 있음. 정부군은 주민들이 알레포를 떠날 수 있도록 해주기로 약속했으나 피난 재개와 중단이 반복되고 있음.
- 이에 공포 속에서 피난을 희망하는 알레포의 모든 사람의 안전한 대피를 보장하고 시리아 전역의 무차별 공습중단과 시리아 상황에 대한 평화적 해결을 촉구하는 기자회견을 개최하고자 함.

유럽의 전례 없는 난민 유입 문제를 해소하기 위해 1월 28일 유럽연합(EU)의 의장국 네덜란드가 제안한 계획은 그리스의 난민과 망명신청자를 터키로 불법 송환하는 것이 핵심이므로, 근본적인 결함이 존재한다고 국제앰네스티가 경고했다.

그리스에 있는 수만 명을 정당한 법적 절차나 망명 신청 기회조차 제공하지 않고 돌려보내기 위해 터키를 “안전한 제3국”으로 명명하는 것은 유럽법과 국제법을 모두 명백히 위반하는 것이다.

존 달후이센(John Dalhuisen) 국제앰네스티 유럽중앙아시아국장은 “이처럼 근본적으로 결함이 있는 제안을 인도주의로 포장한 속임수에 당해서는 안 된다. 에게 해를 통해 밀려들어오는 절박한 난민들을 막기 위한 정치적 편법임은 의심할 여지가 없다”며 “난민들에게 망명 신청 기회조차 주지 않으면서 실질적으로 국경을 봉쇄하고 수만 명을 부당하게 돌려보내는 조건을 바탕으로 한 난민 재정착 계획은 도덕적 파탄 수준이다. 세계적인 난민 위기에 대한 범유럽적 대응은 오랫동안 혼란에 빠진 상태가 지속됐기 때문에 시급히 해법이 필요하다. 그러나 그 과정에서 법을 위반하고 국제적 의무를 무시할 수는 없다”고 말했다.

국제법상 분쟁과 박해를 피해 떠난 취약한 사람들은 보호를 요청할 경우 거부당해서는 안 되며, 망명을 신청할 권리가 있다.

이번 제안이 실현된다면, 빠르면 올 봄부터 EU 회원국들은 터키를 “안전한 제3국”으로 간주하고 에게 해를 통해 그리스로 향하는 모든 망명 신청자들을 터키로 돌려보내게 된다. 국제앰네스티는 이러한 절차가 국제법상 불법인 강제송환에 해당할 수 있다고 경고한 바 있다.

터키가 이렇게 돌려보낸 난민들을 받아들이는 대신, EU 주요 회원국들은 현재 터키에서 수용 중인 난민 15~20만명을 자발적으로 수용한다는 계획이다.

터키의 난민과 망명신청자에 대해서는 심각한 우려가 제기되어 왔다. 현재 터키는 시리아 난민 250만명을 비롯해 아프가니스탄, 이라크 등 다른 국가의 난민과 망명신청자 25만명을 수용하고 있다. 시리아를 제외하면 실제로 난민 신청이 받아들여지는 경우는 거의 없다.

또한 국제앰네스티는 지난 2015년 9월부터 EU와 터키 간의 난민 논의가 진행되는 동시에 터키 정부가 수십, 수백 명까지 이르는 난민과 망명신청자들을 불법으로 체포한 정황에 대해 기록했다. 이들은 버스에 태워져 1,000km 이상 떨어진 격리 수용소로 보내졌고, 이곳에서 독방에 수감되었다. 며칠에 걸쳐 족쇄가 채워진 채 구타를 당하거나, 본국으로 강제 송환된 경우도 있는 것으로 알려졌다.

달후이센 국장은 “난민들은 터키를 안전한 국가라고 생각하지 않을 것이다. 대부분의 자국민들에게조차 안전한 국가가 아니다. 최근 수개월 동안 난민들은 이라크와 시리아로 불법 송환되거나, 망명 신청 절차가 진행될 기약조차 없이 수 년을 잊혀진 채 방치되어 왔다”며 “터키에서 EU 국가로 대규모 재정착을 진행하겠다는 것은 좋은 계획이나, 비정규적으로 입국하려는 사람들을 빠르게 돌려보낸다는 조건을 붙인 것은 사람의 생명과 맞바꾸는 것이나 마찬가지다.

최근 수년간 유럽으로 향하는 경로 한 곳을 봉쇄하면 필연적으로 난민들은 보호를 요청하기 위해 더욱 위험한 다른 경로를 택했다. 유럽으로 향하는 안전한 합법적 경로를 마련하는 것만이 유일하게 지속 가능한 해결책”이라고 말했다.

아직 공개되지 않은 이번 계획의 세부적인 내용은 디데릭 삼솜(Diederik Samsom) 네덜란드 노동당 대표가 28일 네덜란드 신문 ‘데 폴크스크란트(De Volkskrant)’와의 단독 인터뷰를 통해 일부 공개할 예정이다. 네덜란드는 현재 EU 의장국으로, 이번 계획에 대한 EU 회원국들의 지지를 기대하고 있다.

Dutch plan for EU ‘refugee swap’ with Turkey is morally bankrupt

A new plan to tackle unprecedented refugee flows to Europe, mooted by the Dutch Presidency of the European Union today, is fundamentally flawed since it would hinge on illegally returning asylum seekers and refugees from Greece to Turkey, Amnesty International warned.

Plans to label Turkey a “safe third country” in order to ferry back tens of thousands of people from Greece without due process or access to asylum application procedures would blatantly violate both European and international law.

“No one should be fooled by the humanitarian sheen of this fundamentally flawed proposal. It is political expediency, plain and simple, aimed at stopping the flows of desperate people across the Aegean Sea,” said John Dalhuisen, Europe and Central Asia Director at Amnesty International.

“Any resettlement proposal that is conditional on effectively sealing off borders and illegally pushing back tens of thousands of people while denying them access to asylum procedures is morally bankrupt. The pan-European response to the global refugee crisis has long been in disarray, so solutions are needed, and fast. But there is no excuse for breaking the law and flouting international obligations in the process.”

Under international law, vulnerable people fleeing conflict and persecution must not be denied access to protection and have a right to have their asylum claims considered.

If the plan goes ahead, as soon as this spring, EU countries would begin considering Turkey a “safe third country”, a designation which would lead to them pushing back all asylum-seekers intercepted on the sea crossing to Greece. Amnesty International warned these would amount to illegal push-backs under international law.

In return for Turkey accepting those who are pushed back, a core group of EU countries would voluntarily resettle between 150,000 and 250,000 refugees currently hosted in Turkey.

There are serious concerns about the situation of refugees and asylum-seekers in Turkey. The country hosts an estimated 2.5 million Syrian refugees and 250,000 refugees and asylum-seekers from other countries including Afghanistan and Iraq. Asylum applications for non-Syrians are rarely processed in practice.

In addition, Amnesty International has documented how, since September 2015, in parallel with EU-Turkey migration talks, the Turkish authorities have unlawfully rounded up scores – possibly hundreds – of refugees and asylum-seekers. They have been herded onto buses and transported more than 1,000 kilometres to isolated detention centres where they have been held incommunicado. Some report being shackled for days on end, beaten and forcibly transported back to the countries they had fled.

“Turkey cannot possibly be considered a safe country for refugees. It is not even a safe country for many of its own citizens. In recent months refugees have been illegally returned to Iraq and Syria, while refugees from other countries face years in limbo before their applications will ever be heard,” said John Dalhuisen.

“A large-scale resettlement scheme for refugees from Turkey to the EU is a good idea, but making it conditional on the swift return of those crossing the border irregularly is tantamount to bartering in human lives.

“In recent years, blocking one route to Europe has inevitably led to refugees taking another, often more dangerous, route to seek protection. Offering safe, legal routes to Europe is the only sustainable solution for the refugee situation.”

While the full plan has yet to be made public, the Dutch social-democrat leader Diederik Samsom revealed some details in an exclusive interview today with the national newspaper De Volkskrant. The Netherlands currently holds the EU Presidency and is seeking backing for the proposal from other EU member states.

페데리카 모게리니(Federica Mogherini) 유럽연합(EU) 외교안보 대표가 도널드 트럼프(Donald Trump) 미국 대통령의 차별적인 행정명령에 강력히 대응했다.

트럼프 미국 대통령은 이슬람권 7개 국가 사람들의 입국을 모두 금지하고 미국의 난민 정착 프로그램을 유예하는 내용의 행정명령을 발표한 바 있다. 트럼프 대통령의 서명 하나로 이미 수년간 미국에서 거주한 셀 수 없이 많은 사람이 공항에 발이 묶였고, 가족과 지역사회가 파괴되었다.

유럽은 장벽을 무너뜨리는 역사와 전통이 있다.

9일 트럼프 행정부와의 첫 회동을 위해 미국을 방문한 모게리니 대표는 “유럽은 장벽을 무너뜨리고 다리를 놓는 것을 축하하는 역사와 전통이 있다”라며, 트럼프의 장벽 쌓기 정책을 중단하고 난민 수용 정책을 유지할 것을 호소했다.

이러한 모게리니의 트럼프 정책 비판은 그동안 늦장 대응과 침묵으로 일관한 EU 관계자들과 비교해 필요한 것이며 환영할 만하다.

다만, 모게리니 대표의 발언은 공허하다. 유럽의 장벽도 무너지지 않았기 때문이다. EU 역시 가혹한 난민 및 이주민 정책을 재검토하고, 국제인권법에 상응하는 수준으로 개선해야 한다.

“감옥 같아서 숨을 쉴 수 없어요.” 2016년 유럽에 피난을 온 시리아 난민 헤다(Heda)의 가슴 아픈 말이다. 헤다와 두 명의 자녀는 터키로 송환되기를 기다리며 구금 시설에 갇혀있다. 구금시설은 이들에게 불안한 현실의 장벽이다.

모게리니 대표의 말과는 상반되는 사례는 또 있다. 베오그라드의 망명 신청자들은 오도 가도 못하는 신세가 되어 얼어붙은 추위에서 살아남기 위해 창고에서 쓰레기를 태우고 있다. 이들은 유럽에 도착한 뒤로 어디를 가든 장벽과 울타리가 진로를 가로막았다.

트럼프의 행정명령이 난민과 이를 수용하는 국가에 재앙적 충격과 다름없지만, EU가 정작 자신의 난민 및 이주민 입국 제한 조치에 대해서는 인정하지 않으면서 미국 정부를 비판한다는 것은 모순이다.

지난해 3월 발효된 EU-터키 간 합의는 그리스의 섬 지역에 비공식적인 경로로 상륙한 시리아인을 모두 터키로 돌려보낸다는 내용으로, 이는 터키가 난민에게 안전한 장소라는 잘못된 주장에 근거하고 있다. EU 회원국들은 그리스 섬 지역에서 터키로 송환되는 난민에 따라 터키에 있는 시리아 난민 1명씩을 받아들이기로 동의했지만, 이 합의가 순수하게 난민, 또는 터키와의 연대를 표현하는 것이라고 보기는 어렵다. 현재 터키에 있는 시리아 난민은 280만 명이 넘지만, 합의가 발효된 이후 지금까지 EU가 수용한 난민은 3,000여 명에 불과하다.

보호를 요구할 법적 권리가 있는 사람들이 자신의 안전과 기본권도 보장되지 않는 국가로 송환된다는 점에서 EU-터키 간 합의는 인권침해가 본질적인 문제이다.

마찬가지로, 그리스 섬에 묶인 난민들 역시 자동으로 억류돼 불결한 생활 환경에서 안전을 걱정하며 살고 있다. 망명절차에 접근하는 것도 까다로운데다, 망명을 신청하는 데만 수 개월을 기다려야 한다. 국제앰네스티는 비호 신청자들을 터키로 불법 송환한, 명백한 국제법 위반 사례에 대해 기록하기도 했다.

트럼프의 이동 금지 명령에 항의하며 유럽인 수천 명이 거리로 쏟아져 나왔다. EU 대표들에게 국제법을 증진하고 난민을 보호하라는 여론의 압력은 더욱 거세지고 있다. 그러나 EU가 무책임하고 비인도적인 이주 정책을 고집하는 한, 트럼프를 비판하는 EU 대표들의 목소리는 힘을 얻지 못할 것이다.
