Statement on Procedural Integrity and Democratic Standards

The May 1 ruling by the Supreme Court concerning Democratic Party presidential candidate Lee Jae-myung has drawn significant international attention. Foreign media, legal experts, and diplomatic voices have engaged deeply with the case, underscoring a shared global interest in the integrity of Korea’s democratic institutions. We are grateful for this engagement.

Our position remains grounded in respect for judicial independence. However, the timeline and handling of the Supreme Court’s decision in the case continue to raise legitimate concerns—ones rooted in Korean legal standards and precedent, not partisanship.

Under the Supreme Court’s own internal regulations, full-bench deliberations require prior submission and review of legal research reports. In this instance, the case was reassigned and deliberated on the same day, with a final judgment issued within just nine days, despite involving over 70,000 pages of legal materials.

Further, Article 11 of the Public Official Election Act intends to safeguard candidates from undue legal disadvantage during campaigns—particularly when not under arrest or convicted. When judicial action is accelerated to this extent in the final weeks of an election, it naturally raises questions of equal treatment and procedural balance.

These domestic protections also reflect global standards, such as Article 14(3)(b) of the ICCPR, which guarantees sufficient time and facilities to prepare a defense. Yet our emphasis remains on ensuring consistency with Korean legal expectations and democratic principles.

This is not merely about one candidate. It is about ensuring that due process applies equally to protect all—especially when democratic legitimacy is on the line.

We call on the international community to view this case not through a political lens, but through one of procedural fairness and democratic integrity. We welcome continued engagement, constructive dialogue, and support for the standards that uphold faith in democracy and the rule of law.
