정보공개 청구 교육을 할 때마다 수강생들에게 공공기관의 어떤 정보를 알고 싶어서 교육을 듣느냐고 질문한다. 그때마다 항상 나오는 답변이 “구청에서 돈 쓴 내용을 알고 싶다”는 것이다. 물론 정보공개 청구는 구청에서 돈을 어떻게 썼는지 살펴보기 위한 좋은 방법이다. 하지만 정보공개 청구는 청구하고, 답변이 올 때까지 시간이 걸린다. 자칫 비공개 통지라도 나온다면 더 시간이 걸리고, 이의신청 절차까지 밟는 와중에 더 에너지를 소모해야 한다.

사실 ‘구청에서 돈 쓴 내용’은 굳이 정보공개 청구를 하지 않더라도, 이미 구청에서 매일 공개하고 있다. 지방재정법 제60조 5항에서 "지방자치단체의 장은 해당 지방자치단체의 세입ㆍ세출예산 운용상황을 특별한 사유가 없으면 매일 주민에게 공개하여야 한다. 이 경우 주민이 인터넷 홈페이지를 통하여 세입ㆍ세출예산 운용상황을 세부사업별로 조회할 수 있도록 하여야 한다"고 하여, 세출예산 운용상황, 즉 '구청이 돈 쓴 내용'을 매일매일 공개하도록 하는 것이 2015년부터 법으로 의무화 되어 있다. 시민들이 지방자치단체의 재정과 관련한 내용은 수시로 확인할 수 있도록 해야 한다는 취지로 만들어진 제도라 할 수 있다.

그러나 이렇게 매일 세출예산 운용상황을 공개하고 있다는 사실 자체가 아직 널리 알려져 있지 않다. 또, 그 정보를 지자체 홈페이지에서 찾기 어렵게 되어 있다는 것도 문제다. 오늘은 은평구의 사례를 통해 ‘구청이 쓴 돈’의 내역을 어떻게 확인할 수 있는지 함께 살펴보고자 한다.

은평구의 ‘돈 쓴 내역’ 확인하기

은평구의 경우, 구청 홈페이지 메뉴에서 열린 행정 - 예산/결산을 클릭하면 [세입세출예산 운용현황]이라는 링크가 나온다. 여길 클릭하면 은평구 세입세출 공개라는 페이지가 뜬다.

이 사이트는 서울특별시에서 운영하는 서울재정포털의 하위 페이지로, 서울재정포털에서는 서울시의 각종 재정 정보들을 확인할 수 있을 뿐만 아니라, 은평구 뿐 아니라 서울시 25개 자치구의 세입세출 내역을 모두 살펴볼 수 있다.

각 자치구 페이지에서는 크게 세입세출총괄, 세입운용상황, 세출운용상황 정보를 확인 가능하다.

세입세출총괄은 한마디로 매일 지자체의 총수입액과 총지출액, 그리고 잔액 현황을 확인할 수 있는 메뉴다. 현재 다른 자치구들은 이 메뉴를 통해서 세입세출 내역을 살펴볼 수 있는데, 은평구의 경우 무슨 이유인지는 몰라도 얼마 전부터 검색이 제대로 되지 않아, 세입세출총괄 내역을 확인할 수 없는 상황이다.

세입운용상황은 역시 일 단위로 지자체의 세입 현황을 살펴볼 수 있는 메뉴다. 일반회계, 특별회계로 나누어, 매일 매일 지자체의 수입이 어떠한지 살펴볼 수 있다. 한 달 동안 구청에서 얼마나 수입이 생기는지 궁금하다면, 세입운용상황 메뉴에서 검색해보자. 2021년 1월 기준으로 은평구가 거둔 세입은 1063억 원에 달한다는 사실을 쉽게 확인할 수 있다.

이번에 집중적으로 살펴볼 메뉴는 세출운용상황이다. 세출운용상황은 말 그대로 지자체가 돈을 쓰는 내역, 세출의 상황을 살펴볼 수 있는 메뉴다. 세출운용상황에서 다시 세부 메뉴로 예산집행현황, 사업 및 예산정보, 지출정보라는 탭이 나오는데, 예산집행현황 탭에서는 분야별 예산 집행 총계를 살펴볼 수 있다. 하지만 어째서인지 다른 자치구와 다르게 은평구는 이 메뉴도(!) 제대로 작동하지 않는다. 시급한 개선이 필요하다.

불광천 관리에 돈이 얼마나 쓰이는지 궁금하다면!

‘구청이 돈 쓴 내용’을 제대로 살펴보기 위해서는 사업및예산정보 탭이 중요하다. 부서별로 어떤 사업에 얼마나 예산을 책정하고 있는지, 사업 내용은 무엇인지 살펴볼 수도 있고 사업에서 예산을 집행한 내역도 일자별로 확인할 수 있기 때문이다. 세부사업명으로도 검색이 가능한 것도 편리한 부분이다. 은평구민이라면 누구나 한번쯤 걸어봤을 불광천, 관리에 예산이 얼마나 쓰이는지 궁금하면 세부사업명에 불광천을 키워드로 넣고 검색을 하면 된다. 불광천이라는 키워드가 들어간 구청의 사업 예산들을 한 눈에 살펴볼 수 있다.

‘불광천 유지 관리’라는 사업이 눈에 띄어서 사업내역을 클릭하면, 어떤 목적으로 이뤄지는 사업이고 사업 추진 근거는 무엇인지, 사업의 내용은 어떻게 되는지 확인할 수 있다. 우리가 궁금한 것은 ‘돈을 쓴 내역’이니까, 지출현황을 살펴보자.

가을마다 불광천을 분홍빛으로 물들이는 코스모스 종자 구매비는 90만원, 레인보우 다리를 꾸미는 꽃모에는 32만 4800원이 쓰인다. 또, 불광천 꽃길 조성에 들어간 사업비는 4800여만원 임을 확인할 수 있다.

만약 사업별로 지출 내역을 검색하는 것이 아니라, 좀 더 포괄적으로 구청의 지출 내역을 살펴보고자 한다면 지출정보 탭을 클릭한다. 부서별 / 세부사업 키워드 별/ 기간별로 본인이 원하는 설정을 통해 구청의 지출 내역을 자유롭게 검색할 수 있고, 또 엑셀 파일로 다운로드 받아 분석할 수도 있다.

이렇게 서울재정포털을 활용한다면, 굳이 정보공개 청구를 하지 않더라도 구청의 예산 지출 내역을 언제든지 살펴볼 수 있다. 문득 구청에서 하는 사업에 돈이 얼마나 쓰이는지 궁금해졌을 때, 혹시 부풀려진 공사 예산은 없는지 궁금할 때 얼마나 돈을 쓰고 있는지 가장 빠르게 확인할 수 있는 방법이다. 아직 시민들에게 잘 알려지지 않은 세출예산 공개제도, 의문이 생길 때마다 적극적으로 활용해보자.

국정원 불법사찰 진상규명 특별법 제정 촉구 기자회견을 개최했습니다

박지원 국가정보원장이 오늘(8/27, 금 오후 3시) 이명박 정부 시기 국정원이 18대 국회의원, 언론인, 연예인, 시민단체 등에 대한 광범하게 불법사찰한 것과 관련해 '국민사찰 종식 선언 및 대국민 사과문’을 발표했습니다.

국정원은 지난 8월 24일 불법사찰 관련 자체감찰 결과를 국회 정보위원회에 보고했습니다. 그러나 국회 정보위원회에 보고된 국정원의 자체감찰 결과는 이명박 정부 시기와 18대 국회의원에 한정된 것으로 매우 제한된 결과로 국정원 불법사찰의 전모를 밝혔다고 할 수 없습니다.

이에 국정원감시네트워크, 내놔라내파일시민행동, 환경운동연합, 한국환경정의는 오늘(8/27) 오후 4시에 <국정원 불법사찰 진상규명 특별법 제정 촉구 기자회견 > 진행했습니다.

아쉬운 국정원장의 대국민 사과, 특별법 제정 통해 전모를 밝혀라

늦었고, 진정성 부족하며, 떠밀려서 한 사과

전모 아직도 밝혀지지 않아 특별법 제정 서둘러야

진상규명위원회 설치, 정보공개 특례, 정보 영구 폐기, 책임자 처벌 등 담겨야

박지원 국정원장이 오늘 지난 정부 국가정보원(이하 국정원)이 자행한 불법 사찰과 공작에 대해 대국민 사과를 했다. 만시지탄이지만 정부의 공식 사과라는 점에서 의미를 부여할 수 있다. 하지만, 박근혜 대통령 탄핵과 정권교체가 있은지 약 4년 반이 지난 시점에서야 공식 사과가 나왔다는 점에서 유감스럽게도 매우 늦었다. 또한 민간인 불법 사찰과 공작은 국정원이 기획했고, 대통령과 청와대가 결정했으며, 정부의 주요 부처와 검찰과 같은 사정기관이 공동으로 실행했다는 점에서, 비록 전임 정부가 자행한 일이지만 국정의 최고책임자인 대통령이 사과하는 것이 필요하다. 국정을 통할하고, 국정원을 지휘감독할 수 있는 유일한 지위를 가진 대통령의 의지 표명이 중요하기 때문이다.

아직 국정원은 민간인 불법 사찰과 공작에 대해 전모를 밝히지 않고 있다. 사찰 기록은 여전히 국정원이 보관하고 있고, 피해자에게 알려주지 않고 있다. 이런 점에서 국정원의 사과가 진정성이 있는지 의심할 수밖에 없다. 초유의 국정원장의 대국민사과는 사찰피해자들이 정보공개 운동을 벌여 국정원과 소송전에서 이김으로써 만행이 공개되고, 국회가 대국민사과가 포함된 결의안을 통과 시켰기 때문에 떠밀려서 한 것으로 볼 수 있다. 이런 점에서 국정원의 자체 정화 의지는 매우 약하다고 본다.

과거 국정원의 만행은 하늘을 가릴 정도로 많다. 댓글부대를 운용했고, 대통령 선거에 개입했다. 이명박 정부 시기 국정원은 정권 입맛에 맞지 않는 연예인을 비방하려 나체 성행위 사진을 합성하여 인터넷에 유포했다. 정권이 추진하는 4대강 사업 반대 환경단체와 활동가들을 사찰하고, 제압하기 위한 공작을 수행했다. 문화예술계 좌파를 척결한다며 블랙리스트를 만들어 각종 불이익을 주고 퇴출 공작을 벌였다. 국정원 특활비를 전용해서 정권 차원에서 제3노총 건설을 추진했고, MBC 파업을 방해했으며, 각종 노조와해 공작을 벌였다. 여야를 가리지 않고 정권에 걸림돌이 되는 정치인들의 비리를 캐고, 보수단체를 동원해서 시국광고와 규탄집회를 사주했다. 노무현 전대통령의 부인 권양숙 여사를 북경까지 따라가 미행했고, 사위 곽상언 변호사를 감시했다. 명진 스님을 뒷조사하고 승적 박탈을 기획했다. 서울중앙지검과 긴밀히 소통하면서 정치인들의 수사와 재판 상황 및 계획을 수집했다. 이에 개입했을 것으로 보이는 흔적이 있다. 현재까지 드러난 만행도 이렇게 많지만, 아직 빙산의 일각일 것이 분명하다. 철저한 진상규명이 절실히 필요하다.

시간은 이렇게 흘러가는데 과제는 산더미처럼 쌓여 있다. 국정원은 늑장 진상규명을 통해 가해자들에게 공소시효가 만료되는 특혜를 베풀고 있다. 첫번째 과제는 민간인 불법 사찰과 공작에 대해 전모를 밝히는 것이다. 진상을 낱낱이 밝혀 국민들께 보고해야 한다. 피해자들에게 알려줘야 한다. 국정원이 최근 국회 정보위에 보고한 바에 따르면, 국정원이 18대 국회의원들을 동향에 관해 사찰하고, 비리의혹 수사 정보를 취득한 사실을 이제야 알아냈다고 한다. MBC PD수첩에 따르면, 국정원이 위안부 할머니들의 일본에서 활동 계획 등을 일본에 넘겼다는 의혹이 제기됐다. 국정원의 악행이 어디까지 뻗쳐 있는지 알 길이 없고, 드러난 사실은 빙산의 일각에 불과하다. 이에 국정원의 정치관여를 명백히 금지한 1994년도 이후 자행한 불법 사찰과 공작에 대한 철저한 진상규명이 필요하다. 두번째 과제는 진상규명 과정에서 피해자들에게 가해사실을 알려주고, 사찰과 공작 정보를 투명하게 선제적으로 해당 피해자에게 제공하는 것이다. 그 후 불법 취득한 사찰정보는 영구히 폐기해야 한다. 세번째 과제는 정권 변동에도 불구하고 항구적으로 사찰과 공작을 방지할 수 있도록 제도적으로 금지해야 한다.

이제 공은 국회로 넘어갔다. 국정원 흑역사 진상규명을 위한 특별법 입법을 서둘러야 한다. 시민사회는 올초 진상규명 특별법안을 마련하여 여당에 발의를 제안했지만, 그 법안은 아직 발의조차 되지 않았다. 야당은 특별법안 발의를 추진하고 있는지 알길이 없고, 오히려 박형준 당시 청와대 홍보기획관과 같은 사찰 관련자를 감쌌다. 지난 달 국회를 통과한 국정원 흑역사 청산 결의안에는 국정원에게 특별법 제정에 따라 진상 규명 및 재발 방지를 위한 조치를 성실히 이행하도록 촉구하는 내용이 담겨있다. 국회는 이 결의안을 통해 국민들에게 특별법 제정에 관한 의지를 표명한 것이다. 국정원에 대한 촉구의 전제가 되는 특별법을 신속히 제정해야 한다.

이 특별법에 담겨야 할 내용은 ∆ 독립적이고 실질적 조사권이 있는 진상조사위원회 설치, ∆ 사찰과 공작의 전모를 밝히는 진상규명, ∆ 사찰정보 목록을 피해자에게 사전 통지하는 등 정보 공개에 관한 특례 규정, ∆ 사찰정보 조사 중 폐기 금지, 조사 후 영구 폐기, ∆ 책임자 처벌을 위해 조사기간 중 공소시효 정지, 정무직 외 협조 조건부 불처벌, ∆ 피해자 명예회복 조치와 재발방지를 위한 조치에 관한 권고이다. 이와 더불어 재발을 방지하기 위해 국정원에 국회가 추천한 독립적인 정보감찰관을 두고, 정치관여 목적 정보수집죄를 신설하며, 공소시효를 연장하는 내용으로 국정원법을 개정해야 한다.

우리는 다음과 같이 요구한다.

첫째, 국회는 신속히 국정원 민간인 사찰과 공작 진상규명을 위한 특별법을 제정하라.

둘째, 대통령은 대국민 사과를 하고, 재발방지 약속을 공표하라.

셋째, 대통령 선거 후보들은 국정원을 동원하여 민간인 사찰과 공작을 하지 않겠다는 공개 선언을 하라.

'원문공개율' 보다 더 중요한 것은 시민들의 편의성!

2016년 원문정보 공개율이 34.5%로 226개 기초지자체 중 225위였던 원주시, 2019년에는 원문정보공개율을 67%까지 두배 가까이 끌어올려 당당히 강원도 도내 18개 시군 중 1위를 기록했다고 하는데요,

문제는 높은 원문공개율의 비밀 속에 '꼼수'가 숨어있다는 것. 지역신문인 원주투데이가 원주시의 원문공개 문서 상당수가 문서 겉표지만 부분공개한 '빛 좋은 개살구' 라는 것 지적하는 기사를 냈습니다. (기사 링크 : 행정정보공개 도내 1위, 꼼수였다)

이런 식으로 표지만 공개하는 경우가 정말 많습니다. 간담회 건의사항 내용이 궁금한 시민은 결국 정보공개 청구를 할수밖에 없는 셈입니다.

사실 원문공개율을 끌어올려서 지표 성과를 좋게 만들기 위해, 문서의 표지만 부분공개하는 꼼수는 원주시만의 일이 아닙니다. 전체 지방자치단체 중 가장 정보공개를 잘한다는 서울시 역시 84%가 넘는 원문공개율을 자랑하고 있으나, 실상을 따져보면 전체 문서 중 '부분공개'를 제외한 '공개문서'는 40% 수준에 불과합니다. 이 중 표지만 공개하고 있는 '꼼수 공개'가 얼마나 될지는 더 확인해봐야겠지만, 상당히 많은 문서들이 결재문서의 본문과 실질적인 내용이 들어있는 첨부파일은 비공개 처리한 채 표지만 공개하고 있는 경우가 많습니다.

이러한 관행은 '원문공개율'을 정보공개제도 평가의 중요한 지표로 여기는 관행과 무관하지 않은데요, 정보공개 분야에서 성과를 내기 위해 원문공개율을 높이려다 보니, 정작 시민들에게 필요한 정보들은 비공개 처리하고 표지만 공개하는 황당한 일들이 벌어지고 있는 것입니다. 이는 현재 원문공개율을 산정할 때 공개 + 부분공개 문서를 모두 포함시키고 있기 때문에 벌어지는 일이기도 합니다.

시민들이, 자신이 원하는 공공기관의 정보를 누구나 쉽고 간편하게 접근할 수 있도록 하는 것이 정보공개제도의 원 취지입니다. 원문공개란 그러한 취지에 맞도록 비공개할 근거가 없는 문서들을 시민들에게 바로 공개하도록 한 제도입니다.

그런데 정작 원문공개율이 평가의 지표로 자리잡으면서, 원문공개율을 높이기 위해 별다른 판단 없이 표지만 공개하는 부분공개 문서들이 늘어나는 부작용이 생겨나고 있는 것입니다. 이는 오히려 정보를 찾는 시민들에게 짜증만 유발하게 됩니다.

정보공개센터 역시 공공기관이나 지자체 담당자들을 만날 때, 정보공개 정책에서 정말로 중요한 것은 '원문공개율'에 집착하는 것이 아니라고 누누히 이야기하곤 합니다. 정말로 공공기관이 정보공개를 잘 하고 싶다면, 어떻게 해야 시민들이 편리하게 정보공개 메뉴를 활용할 수 있을지, 정보공개 메뉴의 UI나 사전공개 정보들의 접근 용이성을 개선하는 것 부터 고민할 필요가 있습니다. 특히 게시판 형태로 수백개의 사전공개 정보들을 나열해서, 정작 내가 살펴보고 싶은 정보를 찾기 위해서는 하나하나 게시판 페이지를 넘겨봐야 하는 공공기관 홈페이지들은 꼭 개선할 필요가 있다고 생각합니다 ^^;

'지표'를 우선하는 것이 아니라 시민의 눈으로, 시민의 입장에서 제도를 개선하는 것, 모든 행정의 기본이 되어야 하지 않을까요? 2020년에는 좀 실질적인 변화가 만들어지길 기대합니다.
