42ND SESSION OF THE UN HUMAN RIGHTS COUNCIL

INTERNATIONAL SAFE ABORTION DAY – 28 SEPTEMBER 2019

 

Please note that a shorter version of this statement was delivered orally on 23 September 2019 to fit the time requirements of the Human Rights Council.

 

Thank you, President. I deliver this statement on behalf of 317 organizations[i] and 506 individuals.[ii]

 

In the Vienna Declaration and Programme of Action, States explicitly agreed to prioritize the realization of women’s human rights and recognized that all human rights are universal, indivisible, interdependent and interrelated. Yet, 26 years later, women and girls’ human rights and bodily autonomy continue to be routinely violated, including through the denial, criminalization and stigmatization of access to safe and legal abortion – all of which is rooted in the discrimination, oppression, violence and coercion affecting the material conditions that shape people’s lives and ability to exercise their bodily autonomy and human rights.

 

In 1994, Black feminists came together as the Women of African Descent for Reproductive Justice, in reaction to the white supremacy, colonialism and capitalism they observed shaping reproductive politics and inherent in the broader population control narratives. Reproductive justice is centered on the rights to bodily autonomy and self-determination, and to parent and not to parent in safe and healthy environments.[iii] It is rooted in an intersectional analysis and moving beyond an individualistic conception of “choice” to instead place emphasis on the material conditions necessary to exercise reproductive rights. Reproductive justice also addresses the legacy of population control informed by white supremacy and replacement theory, which has resurfaced in current populist politics.

Reproductive justice is achieved when all people are able to enjoy their right to bodily autonomy and sexual and reproductive self-determination. It requires people to enjoy economic, social, and cultural rights and freedoms, and the ability to make and exercise choices not limited by oppression, discrimination, stigma, coercion, violence, lack of opportunities or possible consequences. Treaty bodies and special procedures have echoed this need and recognized that the realization of women’s reproductive rights depends on the material conditions in which they are born, grow, live, work and age, and on power structures and resource distribution at all levels[iv] – in other words, the social and other determinants of health.[v] These include access to housing, safe drinking water, effective sanitation systems, access to justice, and freedom from violence, among other factors, and impact the agency that individuals can exercise with respect to their sexual and reproductive health.[vi] Our discussions on abortion and sexual and reproductive rights cannot continue ignoring these factors.

The realization of reproductive justice, the right to bodily autonomy and substantive equality also requires freedom from control and interference by State and non-State actors, including private companies, donors and multinational corporations, including criminalization of sexual and reproductive behaviors and decisions, restrictive abortion laws, punitive sanctions, and legal restrictions to regulate women’s control over their own bodies.[vii] These laws, policies and practices typically target and disproportionately impact women of color, women from the Global South, women with disabilities, women living in poverty, migrant women, ethnic minorities and indigenous women, women living with HIV, young women and adolescents, sex workers and gender-non-conforming persons based on racial, class, disability and gender stereotypes.[viii]

Today, on 28 September, International Safe Abortion Day, we urge States to respect, protect and fulfill women and girls’ human rights and realize reproductive justice for all. We call on states to:

  • Ensure access to available, accessible, acceptable and quality sexual and reproductive health services as part of universal health coverage and public health systems, including modern contraceptive options, comprehensive abortion and post-abortion care, financed adequately through taxation and free from control from other governments, multilateral agreements and transnational corporations.
  • Remove all legal and social barriers to safe abortion, including its criminalization, which is broader and including sanctions and no sanction regimes, and commit to providing safe abortion services on request.
  • Address social and other determinants of health in law and practice from an intersectional perspective to ensure that they enable all individuals to effectively enjoy their sexual and reproductive rights.[ix]
  • Hold private companies and multinational corporations accountable for unethical research practices, violations and abuses of women and girls’ reproductive rights and bodily autonomy.
  • Prioritize the meaningful participation of local movements, women human rights defenders and feminists demanding accountability for sexual and reproductive health and rights violations, and center their demands and recommendations for the realization of reproductive justice.

백남기 농민 유족, 가족 비방 글에 대한 명예훼손 고소장 접수

  1. 지난달 25일 고인의 선종 이후 인터넷과 SNS를 통해 고인과 유족들에 대한 허위사실과 근거 없는 비난을 담은 글들이 유포되면서 위로받고 아픔을 치유해야할 가족들은 인신공격에 무방비 상태로 노출되었습니다. 뿐만 아니라 가족들이 연명치료를 거부하여 고인을 사망에 이르게 했다며 오늘(11일) 가족들을 ‘살인’혐의로 고발하였습니다.

 

  1. 경찰의 물대포에 맞아 317일간 사투를 벌이다 사망에 이른 고인의 죽음 앞에 엄정한 수사와 책임자처벌이 중요하기에 유족들은 적극적으로 대응해오지 않았습니다. 그러나 근거 없는 허위사실 유포로 ‘아버지가 위독한 상황에서 휴양지로 여행을 떠나는 비정한 딸’로 만들고, 부모와 남편을 잃은 가족을 ‘살인범’으로 만드는 행태를 더 이상 두고 볼 수 없어 법적 조치를 취하기로 하였습니다.

 

  1. 오늘(11일) 유족들은 장기정(자유청년연합대표), 김세의(MBC기자), 윤서인(만화가)씨를 정보통신망 이용촉진 및 정보보호 등에 관한 법률 위반(허위사실 적시 명예훼손) 혐의로 서울중앙지검에 고소합니다. 장기정 씨는 가족들을 ‘부작위에 의한 살인죄’로 고발하겠다는 내용의 글을 자신의 페이스북 계정에 올렸고, 김세의‧윤서인 씨는 고인의 막내딸이 아버지가 위중한 상황에서 휴양지로 휴가를 갔다는 내용의 글‧그림을 게시하였습니다. 허위사실이 적시된 이 게시물들은 인터넷 공간을 통해 빠르고 무분별하게 확산되었습니다. 진상규명과 책임자처벌을 위해 애도와 추모의 시간마저 마음껏 보낼 수 없는 유족들에게 다시 한 번 씻을 수 없는 상처를 입히고 법적대응에 나서도록 만든 피고소인들에게 최소한의 양심이라도 있는지 묻고 싶습니다. 검찰의 엄정한 수사를 촉구하는 바입니다. 아울러 변호인단은 오늘 오후에 있었던 장기정 씨의 故 백남기 농민 가족들에 대한 고발건에 대해서도 무고여부를 검토하여 추가적으로 강력히 대응할 예정입니다.

 

  1. 고소장을 접수한 이 시간에도 고인과 유족들에 대한 명예훼손과 비난 행위는 계속되고 있습니다. 지금이라도 고인의 죽음과 유족 앞에 최소한의 예의를 갖추고자 한다면 당장 이러한 행위를 멈추어야할 것입니다. 변호인단은 형사고소뿐만 아니라 조만간 민사소송도 제기할 예정이며, 실정법뿐만 아니라 인간으로서의 기본적 도를 넘어선 일체의 명예훼손과 비방행위에 대해 단호히 대응해나갈 것입니다.

한반도 평화 위협하는 사드배치 중단 촉구

릴레이 1인 시위에 들어가며

 

1. 오늘 11시, 광화문 세월호 광장에서 민주사회를 위한 변호사모임 미군문제연구위원회(위원장 : 하주희) 소속 위원들은 한반도 평화 위협하는 사드배치 중단 촉구 릴레이 1인 시위 기자회견을 개최하였으며, 오는 2. 29(월)까지 주한미대사관 앞에서 릴레이 1인시위(월~금 12:00~13:00)를 이어갈 계획입니다.

 

2. 기자회견 후 이어진 주한미대사관 앞 1일차 1인시위에서는 하주희 민변 미군문제연구위원장이 경찰들에게 저지당하여 강제로 이동되는 일이 있었으며, 앞으로 우리 미군문제연구위원회는 1인 시위가 차질 없이 진행될 수 있도록 조치를 강구할 예정입니다.

한반도 평화 위협하는 ‘사드’배치 용납할 수 없다.

 

오늘 우리는 매우 절박한 심정으로 1인 시위에 나선다.

 

사드배치는 위헌이다.

 

한국에 사드를 배치하는 문제가 연일 뉴스의 첫 번째를 장식하고 있다. 한미당국은 미사일 방어체계의 일부인 사드가 북한에 대해서만 운용될 것이라고 주장하고 있으나 주변국 중국과 러시아의 반응은 사뭇 다르다. 중국 외교장관은 사드가 중국을 겨냥한 칼춤이라고까지 했고, 러시아 역시 즉각 반발하고 나섰다.

 

특히 사드의 불완전성, 북한에 대한 군사적 효용성에 대해서는 국내전문가 뿐만 아니라 미국내에서까지 문제제기가 나오고 있다.

 

이런 상황에서 국민과 국회에게 단 한차례의 동의도 구하지 않고 사드를 즉각적으로 배치한다고 하는 것은 위헌이다.

 

우리 헌법은 항구적인 평화와 평화적 통일을 선언하고 있다. 우리 국민 모두는 개인의 행복추구를 위한 전제로서 평화롭게 살아갈 권리를 가지고 있다. 그러나 사드배치는 우리 국민들 모두를 국제사회 분쟁의 한 가운데로 몰아감으로써 항시적인 불안과 대립을 야기한다. 중국의 경제보복에 대한 경고와 최대 규모의 한미합동군사훈련의 예고가 벌써 그 위험성을 드러낸다.

 

사드 배치는 한미상호방위조약에도 위배된다.

 

한미상호방위조약 3조에 의해서 한미가 행할 수 있는 공동방위행동의 범위는 한반도 내에 국한된다. 그런데 사드가 중국을 겨냥한 것이라면 이는 그 자체로 한미상호방위조약에 위반되며, 주한미군의 주둔 목적에도 위배된다. 만약 그렇다면 우리 정부가 국민들의 재산을 수용하여 부지나 시설을 제공할 이유도 없다.

 

즉각 평화를 위한 대화에 나서야 한다.

 

분단과 북한이라는 ‘상수’에 대한 가장 적합하고 유일한 대응은 무기를 배치하여 끝없는 군비경쟁을 하는 것이 아니라 평화체제를 구축하기 위한 대화에 나서는 일이다. 한미당국은 실질적인 문제해결을 위한 대화에 적극 나서라.

 

우리는 사드 배치만이 유일한 결론인 것처럼 이성을 잃고 달려가는 한미 당국의 태도를 용납할 수 없다. 우리는 평화를 원한다.

민변 통일위원회와 한국기독교교회협의회의 북한 해외식당 종업원    리은경 외 11명 공동접견 기자회견 및

인신보호구제신청 사건 재판부 보정명령 관련 통일부 긴급 면담 결과

  1. 민주언론을 위한 귀 언론사의 노고에 감사드립니다.   2. 민주사회를 위한 변호사모임 통일위원회 (‘민변 통일위’)소속 변호사 4명과 한국기독교교회협의회 소속 목사 16명은(첨부 참석자 명단 참조) 6월 3일 오전 10시 30분 중앙합동신문센터 정문 앞에서 공동기자회견 후 북한 해외식당 종업원 리은경 외 11명에 대한 면담 및 접견신청과 서신 및 물품 전달신청을 하였습니다.   3. 국정원은 30일 내에 결과를 통지한다는 내용의 신청서 접수증만 교부하고 이외에는 아무 답변을 하지 않았습니다. ‘탈북 종업원들이 구금되어 있는 것이 아니라 보호되고 있는 것이기 때문에 변호사의 조력이 필요하지 않다’는 국정원의 입장에 의할지라도 종교인들과의 면담을 막을 근거는 되지 못합니다. 그런데 종교계 인사들의 접견마저 거부한 국정원은 탈북 종업원들이 보호받는게 아니라는 것을 다시 한번 스스로 인정한 것이라 할 수 있습니다.   4. 또한 민변 통일위 변호사들의 접견 신청은 인신보호구제신청사건의 보정명령에 따라 피수용자들의 가족관계를 확인하기 위한 것이기도 하였습니다. 지난 24일 민변 통일위에서 제기한 인신보호구제신청 사건에서 담당 재판부는 1) 위임장을 작성한 가족들과 피수용자들의 가족관계를 증명할 서류 등으로 가족관계를 소명할 것(5.31.자) 2) 민변 통일위 변호사들에 대한 위임의사를 소명할 것(6.1.자)을 내용으로 하는 각 보정명령을 하였습니다. 국정원은 국가기관으로서 사법부의 판단에 협조해야함에도 불구하고, 법원의 명령을 이행하기 위한 변호사들의 접견신청에도 묵묵부답으로 일관하는 모습을 보였습니다. 민변 통일위 변호사들은 인신보호구제청구 사건을 비롯한 현재까지의 경과가 담긴 서신, 피수용자들이 작성할 위임계약서, 가족사진 및 가족들의 위임장을 전달해달라고 신청하였습니다. 국정원은 지금이라도 협조해야할 것입니다.   5. 한편 오늘 오후3시 민변 통일위 채희준, 천낙붕, 장경욱, 오민애 변호사는 통일부 이산가족과 하무진 과장, 이주영 사무관과 30분가량 면담을 진행하였습니다. 현재 인신보호구제신청 사건에서 법원의 보정명령이 나왔고 가족관계를 소명해야할 상황을 설명하며 북한주민접촉신고 수리의 필요성을 전하기 위한 면담자리였습니다. 오는 7일까지 수리여부를 결정하여 통보하여주기로 하였습니다.   6. 오는 14일 인신보호구제청구 사건 심문기일이 예정되어있습니다(14:10, 서울중앙지방법원 서관321호). 추후 접촉신고 수리여부를 비롯한 진행 경과에 많은 관심과 취재 부탁드립니다   □ 기자회견 진행순서   0. 사회 : 장경욱 변호사 1. 한국기독교교회협의회 그간 활동 및 면담신청 경과보고 : 정진우 소장 2. 종교인 면회의 필요성과 당위성 : 노정선 위원장 3. 민변 통일위원회 그간 활동 및 접견신청 경과보고 : 천낙붕 변호사 4. 인신보호구제심사 사건 법원의 보정명령에 따른 북한 해외식당 종업원 12인의 피구금자에 대한 변호인 접견의 필요성 : 채희준 변호사 5. 면담 및 접견진행 6. 면담 및 접견 시 결과 보고 / 불허 시 향후 대응계획 발표   참석자 명단 민주사회를 위한 변호사 모임 채희준 변호사 장경욱 변호사 천낙붕 변호사 오민애 변호사   노정선교수 (NCCK 화해와 통일위원장 위원장) 전용호목사 ( “ 부위원장) 나핵집목사( “ 부위원장) 이문숙목사( “ 부위원장) 송병구목사 ( “ 위원) 정상시목사 ( “ ) 신승민목사 ( “ 국장) 강석훈목사 (NCCK 홍보실장) 노혜민목사 ( “ 부장) 정진우목사 (NCCK 인권센터 소장) 황필규목사 ( 이사) 박승렬목사 (“) 김성복목사(“) 김영균목사(“) 김영철목사(“) 박정범목사 (NCCK “ 간사)

사망진단서 작성에 요구되는 법령상 주의의무를 현저히 위반하여 유가족에게 막대한 정신적 손해를 입힌 백선하 및 서울대학교병원 등에 대한 손해배상 및 사망진단서 정정청구소송 제기

  1. 故 백남기 농민의 유족은 오늘, 故 백남기 농민의 사인 등에 관한 사망진단서 작성에 요구되는 법령상 주의의무를 현저히 위반하여 유족에게 극심한 정신적 손해를 입힌 백선하 교수(서울대학교병원 신경외과)와 서울대학교병원을 상대로 총 90,000,000원의 손해배상을 청구하고, 백선하 교수와 권신원 레지던트를 상대로 사망진단서의 ‘병사’ 기재를 ‘외인사’ 기재로 바꿀 것을 청구하는 소송을 서울중앙지방법원에 제기(전자접수)합니다.

 

  1. 지난 2015년 11월 14일, 경찰의 살인적인 물대포에 직격당해 의식불명(급성 경막하출혈 등)에 빠졌던 백남기 농민이 최초의 의식불명상태에서 의식을 한번도 회복하지 못한 채로 지난 2016년 9월 25일에 사망하였습니다. 이에 망인의 담당의사였던 백선하(서울대학교병원 신경외과)는 레지던트 권신원에게 심폐정지가 망인의 직접사인이며, 병사했다는 취지의 사망진단서를 작성하도록 지시하였습니다.

 

  1. 백선하는 대한의사협회에 소속된 의사로서 의료법 및 동법 시행규칙, 대한의사협회의 ‘진단서 등 작성·교부 지침’을 준수할 의무가 있습니다. 그러나 백선하는 사망원인으로 기록할 수 없는 심폐정지를 사망의 원인으로 기재하게 하고, 직사살수 피격에 따른 ‘외인사’가 명백한 망인의 사망을 ‘병사’로 기재하는 등 고의·과실로 위 의무들을 위반하였습니다.

 

이러한 백선하의 불법행위로 인하여, 망인의 사인에 대한 불필요한 논란이 증폭되었고 유가족들은 한 달이나 망인의 장례를 치르지 못한 채 엄청난 정신적 고통을 겪어야만 했습니다.

 

  1. 이번 사건은 국민들에게 신뢰를 주어야 할 전문가가 그 책무를 망각하고 책임을 회피하여 큰 사회적 물의를 일으킨 사건입니다. 백선하 교수와 서울대병원은 사인을 올바르게 기재하지 않은 법률적·사회적 책임을 져야 할 것입니다. 유가족과 변호인단은 사필귀정(事必歸正)의 자세로 故 백남기 농민의 죽음과 관련된 모든 진실을 밝히고 책임이 있는 자들에게 끝까지 법적 책임을 추궁하겠습니다.

스타케미칼 차광호를 석방하라

스타케미칼 해고자 복직을 요구하며 높이 45m의 공장 굴뚝에서 408일간 농성을 벌여온 차광호 조합원이 금속노조와 사측과의 합의에 따라 어제(8일) 저녁 농성을 해제하고 굴뚝에서 내려왔다. 그런데 경찰은 차광호 조합원을 지정병원에서 30분간 건강검진만 실시한 후 곧바로 유치장에 입감시켰다. 현재 검찰은 그에 대한 구속영장 청구를 검토하고 있다고 한다. 우리는 이러한 수사기관의 조치가 매우 부당하다고 생각한다.

지금 차광호 조합원에게 무엇보다 필요한 것은 병원에서의 정밀진단과 심신의 치료이다. 이는 목숨을 건 고공농성을 지켜보았던 가족과 동료들이 간절히 요구하고 있는 것이기도 하고, 사정을 잘 모르는 사람들도 상식적으로 충분히 수긍할 수 있는 일이다. 그런데도 경찰이 차광호 조합원에 대해 체포영장을 집행하고 검찰이 구속수사를 하겠다고 하는 것은 절대적인 요양이 필요한 환자를 잡아다가 가두어두고 수사를 하겠다는 것으로서 매우 반인권적인 처사이다.

이 사건 조사가 급박한 것도 아니다. 알려진 바와 같이 이번 노사합의에는 회사가 관련 형사사건의 고소를 취하한다는 내용이 포함되어 있다. 농성은 1년 이상 계속되어온 상태였고, 보도자료, 언론기사 등을 통하여 차광호 조합원의 주장과 입장, 사실관계 등은 거의 모두 공개되어 있다. 경찰이 408일간의 고공농성을 끝낸 당일 차광호 조합원을 체포하여 조사할 이유가 전혀 없다.

우리 형사소송법은 불구속수사가 원칙이고 구속을 위해서는 증거인멸이나 도주 우려의 사유가 있어야 한다. 이 건의 경우 408일간 공장 굴뚝을 점거한 것은 모두가 아는 사실이라서 애당초 인멸할 증거란 것이 없다. 또 전체 해고 근로자들을 위하여 사측과 협상을 요구해왔고, 마침내 사측과 협상으로 농성을 끝낸 마당에 그가 도주할 이유는 전혀 없다.

고공농성 노동자에 대한 검찰의 구속영장 청구는 이전에도 기각되었다. 2011년 한진중공업 김진숙 지도위원, 지난 3월 쌍용자동차 해고자 김정욱·이창근, 지난 4월의 통신 비정규직노동자들에 대해 청구된 구속영장이 모두 기각됐다. 이런 사례들만을 놓고 보더라도 차광호 조합원에 대한 체포와 구금이 무리한 수사임을 분명히 알 수 있다.

우리는 경찰과 검찰이 차광호 조합원을 즉각 석방할 것을 강력히 요구한다. 그렇게 하는 것이 최소한 인간의 얼굴을 한 법의 집행임을 믿어 의심치 않는다. 경찰과 검찰이 끝내 차광호 조합원에 대한 구속영장을 청구한다면, 그것은 스스로 법의 정신을 훼손하고 최소한의 균형 감각도 상실하는 것임을 명심해야 한다. 극한투쟁으로 심신이 지쳐 있는 노동자를 또 다시 구금하는 것은 지나치게 가혹한 법집행이다. 경찰과 검찰이 현명한 조처를 행할 것을 기대한다.
