국회 법사위에 사학비리 감싸는 검찰 국감철저 요구

수원대 등 5개대학 사학비리에 대한 검찰 비호를 국정감사에서 밝히고 조치 취해야

수원대 비리 이인수는 즉각 구속하도록 조치시켜야

우리나라의 사학비리는 세계적으로 부끄러운 일입니다. 하지만 지금 사학비리는 검찰이 편들지 않으면 성립할 수 없습니다. 교육부나 감사원에서 위법하다고 판정한 사안에 대해서도 검찰이 혐의를 축소하거나 무혐의로 처분하는 일이 비일비재합니다. 

 

교육은 미래사회의 기둥입니다. 사학의 비리문제는 학생들이 보고 배우는 현장이기에 위중한 점이 있습니다. 이를 바로 잡지 않고서는 나라가 바로 설 수 없습니다. 

 

지난 봄 두차례에 걸쳐 5개대학의 교수들이 공동기자회견을 통해 검찰의 비호사례를 발표하고 올바른 사학비리 수사를 촉구하는 기자회견을 가졌음에도 이렇다 할 변화가 없는 상태입니다.

 

특히 수원대 비리 이인수는 올해 5월 21일 네 번째 고발을 당하고 일백억원 이상  횡령혐의가 있음에도 아직 구속이 되지 않고 압수수색 조차 받지 않고 있습니다. 그런 이인수에 대해 수원대교협은 대통령 검찰총장 대검감찰부에 수차례의 진정을 내었음에도, 수원지검은 꿈쩍도 하지 않고 이인수를 비호하고 있다는 의혹이 있습니다. 

 

그러는 사이 수원대는 교육환경이 엉망인 상태로 멍들어가고 있습니다. 구속되지 않은 상태의 이인수가 학교행정을 막후조종하고 있다는 개연성이 나타나고 있는 가운데, 3년연속 평가에서 하위를 기록하면서 학생들에게 막대한 불이익을 주고 있습니다. 막대한 등록금 적립금은 쌓아둔 채로 아직도 교육에 제대로 환원하지 않고 있습니다. 

더 이상 두고 볼 수 없습니다. 검찰은 당장 이인수를 사회와 격리시켜야 합니다.

 

이에 국회 법제사법위원회는 이번 국정감사에서 제대로 사실관계를 감사하고 검찰이 하루속히 제대로 된 조치를 취할 수 있도록 강구해주기를 공개적으로 요구합니다.

 

 

수원대 비리 이인수를 비호하는 수원지검의 행태를 고발한다 

 

수원대 비리 이인수는 지난 4년간 네 차례의 고발과 수사의뢰가 진행되어왔고, 그 어느 하나 무겁지 않은 혐의가 없습니다. 이 지경인데도 지금껏 구속은커녕 압수수색 한번 하지 않는 검찰의 태도는 도무지 이해할 수 없습니다. 

 

이인수는  2014년에 TV조선 관련 배임 등 14건과 이사회 회의록 조작 등 34건의 불법⦁부적정행위로 세 차례에 걸쳐 고발된 바 있습니다. 감사원 감사와 교육부 종합감사를 통해 드러난 명백한 범죄인데도 검찰은 17개월만에 내놓은 수사결과, 단 한 건외에 모두 불기소 처리하였습니다. 보다 못한 법원은 직권으로 정식 재판에 회부하였습니다. 검찰의 망신입니다. 그 결과 작년 2017년 10월 서울고등법원이 벌금 천만 원을 선고하였고 현재 쌍방 상소로 대법원에 심리 중에 있습니다. 

 

이후 작년말 교육부 사학혁신추진단이 수원대 실태조사를 한 결과  110억원의 배임 및 횡령 혐의로 이인수 등을 검찰에 수사의뢰하였고, 교육부는 학교법인 고운학원 이사회에 이인수의 ‘파면’처분을 통보하였습니다. 그리고 이인수처남인 교무부처장 최형석을 해임하라는 중징계 처분을 내렸습니다. 그로부터 반년 후 올해 5월 21일, 또다시 수원대교수협의회 등이 약 27억원에 달하는 교비 횡령(특정경제가중처벌법위반)과 교비회계수입 전출로 인한 사립학교법 위반 등의 혐의로 이인수를 검찰에 고발하였습니다. 현재 이인수는 2018.1에 법인에 의해 총장직에서 ‘해임’된 상태입니다.

 

작년 가을에 학생들도 3,200여명이 나섰습니다. 학생들은 “부모님들이 그리고 우리가 밤낮으로 알바 하며 힘겹게 마련한 등록금은 고스란히 총장 일가의 주머니로 들어가는 등 수원대는 상아탑이 아닌 총장 일가의 개인사업장으로 전락했으며, 그렇게 수천억원대 적립금을 쌓아놓고도 2015∼2016년 교육부에서 시행한 대학구조개혁평가에서 2년 연속 하위 평가를 받아 부실 대학으로 전락했다”고 그를 엄벌해달라는 탄원서를 내면서 강력한 처벌을 요구하였습니다. 그리고 실제로 학생들중 88명이 등록금환불 소송을 벌렸고 이중에 40여명 이상이 끝까지 소송에 참여하여 대법원에서 승소판결을 받았습니다. 이 승소는 바로 이인수가 얼마나 반사회적 교육부실을 저질렀는지를 입증하고 있습니다.

 

게다가 지난 8월 교육부 대학평가에서 ‘경영진의 비리’를 이유로 ‘역량강화대학’으로 지정받아 정원 10% 감축 등 막대한 타격을 입었습니다. 그는 지금도 막후에서 모든 학교경영을 좌자우지 하고 있다는 의혹을 받고 있습니다. 이 상태에서 학생들에게 돌아가는 피해는 더 이상 두고 볼 수 없는 상태입니다.  

 

국회 법사위는 이번 국정감사에서 검찰의 권한남용과 직무유기를 철저히 감사해서 조치해주시기를 희망합니다.

국제 평화단체, 한반도⋅동북아 위기에 대한 외교적 해결 촉구

퍼그워시 회의 등 전세계 110개 평화단체, 무력사용 반대 입장 담은 서한을

전 세계의 110개 평화단체들과 146인의 평화운동가들은 당면한 동북아와 한반도 위기에 대해 무력 사용을 반대하고 외교적 해결을 촉구하였습니다. 전 세계 평화와 군축을 위해 활동하는 이들은 이번 서한을 통해 지금의 위기가 오판과 우연에 의해 핵전쟁으로까지 비화된다면 전 세계는 핵참화를 피하기 어려울 것이라고 우려하며 △선제적 무력 사용 반대, △도발적인 군사연습 중단, △동북아비핵지대안 검토, △한국전쟁 종전, △6자회담 재개, △유럽연합의 외교적 협상 지원 환영, △외교적 해결 우선 등 7개 요구사항을 제시하였습니다.

 

이들은 이러한 입장을 담은 서한을 지난 9월 7일 남⋅북⋅미⋅중⋅러⋅일 등 6개국 대통령(또는 수상)과 유엔주재 대표, 유엔안보리 회원국, 안토니오 구테레스 유엔 사무총장 그리고 페데리카 모게리니 유럽연합 외교안보 고위대표에게 보냈다고 밝혔습니다. 

 

이번 공동서한에는 퍼그워시 회의(Pugwash Conference), Campaign for Nuclear Disarmament(영국), Coalition for Peace Action(미국), 원수폭금지협의회(일본), 참여연대(한국) 등 전세계 24개국에서 활동하는 평화단체들과 1976년 노벨평화상 수상자인 메어리드 코리건 매과이어(Mairead Corrigan Maguire)를 비롯한 대표적 평화운동가들이 함께 하였습니다.

▣ 공동서한 국문

 

동북아 상황의 외교적 해결을 호소합니다

 

전 세계에서 평화와 군축을 위해 활동하는 ‘어볼리션(Abolition) 2000’의 회원단체들을 대신하여 미국과 북한에 동북아가 직면하고 있는 전쟁 직전의 상황에서 한 걸음 물러나, 대신 전쟁을 막기 위한 외교적 접근법을 택하라고 촉구합니다. 

 

우리는 군사 갈등이 발발하는 것을 막고 나아가 근본적인 갈등을 해결하기 위해 즉시 협상에 나설 것을 요구합니다. 그러한 협상은 양자 간은 물론 중국, 일본, 북한, 러시아, 한국, 미국을 포함하는 새로운 6자회담 틀을 통해 이뤄져야 합니다. 

 

북한의 핵‧미사일 능력을 두고 고조되는 긴장과 군사 갈등 위협은 외교적 해법이야말로 필수적이며 최우선임을 다시금 일깨워줍니다. 전쟁 위기가 높아지고 오판과 우연, 또는 의도에 의해 핵무기가 사용될 수도 있다는 사실은 매우 끔찍한 일입니다. 

 

1950년에서 1953년까지 이어진 한국전쟁에서 목숨을 잃은 사람들의 수는 남북, 중국, 미국 등 다 합해 총 300만 명을 넘습니다. 만일 전쟁이 다시 발발한다면, 특히 핵무기가 사용된다면 사망자 수는 훨씬 더 많을 것입니다. 한반도에서 발발하는 핵전쟁은 핵 참사로 전 세계를 집어 삼킬 것이며 이는 우리 모두가 알듯이 문명의 종말을 가져올 것입니다. 

 

전쟁보다 외교적 해법을 지지하며, 우리는 다음과 같이 요구합니다.

  1. 우리는 그 어느 측의 선제적 무력 사용에도 반대합니다. 이는 역효과를 낳을 것이며 상황을 핵전쟁으로 이끌 것입니다. 
  2. 우리는 모든 측에 군국주의적 수사와 도발적인 군사 연습을 그만두기를 촉구합니다. 
  3. 우리는 중국, 일본, 북한, 러시아, 한국, 미국이 3+3 방식의 동북아 비핵지대 수립을 위한 단계적이고 포괄적인 접근법을 검토하기를 권합니다. 이는 일본과 한국에서 두 개 이상의 정당의 지지를 받고 있으며 북한 정부도 관심을 가지고 있습니다. 
  4. 우리는 중국, 일본, 북한, 러시아, 한국 그리고 미국이 또한 한국전쟁(1950-1953)을 공식적으로 끝내도록 1953년 정전협정을 전환하기 위한 가능한 옵션과 양식을 고려할 것을 권합니다. 
  5. 우리는 6자회담을 재개하라는 유엔 사무총장의 요구와, 협상을 지원하겠다는 그의 제안을 환영합니다. 
  6. 우리는 이란 핵 프로그램 협상을 성공적으로 이끌었던 것처럼 외교적 협상을 지원하겠다는 유럽연합(EU)의 제안 역시 환영합니다. 
  7. 우리는 유엔 안전보장이사회에 갈등에 대한 외교적 해결을 우선시할 것을 요구합니다. 

 

* 3+3 틀은 일본, 한국, 북한이 핵무기를 보유하거나 반입하지 않고, 중국과 러시아, 미국이 일본, 한국, 북한에 핵무기를 배치하지도, 이들을 핵무기로 공격하겠다고 위협하지도 않을 것을 요구합니다.

Appeal for a diplomatic solution in North East Asia

 

The Abolition 2000 members and affiliated networks listed below, representing peace and disarmament organisations from around the world, call on the United States and North Korea to step back from the brink of war in North East Asia, and instead adopt a diplomatic approach to prevent war. 
 
We call for the immediate commencement of negotiations to prevent a military conflict from erupting, and to resolve the underlying conflicts. Such negotiations should take place both bilaterally and through a renewed Six-Party framework involving China, Japan, North Korea, Russia, South Korea and the United States.
 
The escalating tensions and threat of military conflict over North Korea's nuclear and missile capabilities makes a diplomatic solution of vital importance and the highest priority. The increasing risk of war - and possibly even the use of nuclear weapons by miscalculation, accident, or intent - is frightening. 
 
More than three million citizens of Korea, China, USA and other countries lost their lives in the Korean War from 1950-1953. Should a war erupt again, the loss of lives could be considerably worse, especially if nuclear weapons are used. Indeed, a nuclear conflict erupting in Korea could engulf the entire world in a nuclear catastrophe that would end civilization as we know it.
 
In supporting diplomacy rather than war, we:
 

  1. Oppose any pre-emptive use of force by any of the parties, which would be counter-productive and likely lead to nuclear war;
  2. Call on all parties to refrain from militaristic rhetoric and provocative military exercises; 
  3. Encourage China, Japan, North Korea, Russia, South Korea and the United States to consider the phased and comprehensive approach for a North-East Asian Nuclear-Weapon-Free Zone with a 3+3 arrangement*, which already has cross-party support in Japan and South Korea and interest from the North Korean government;
  4. Encourage China, Japan, North Korea, Russia, South Korea and the United States to also consider options and modalities for turning the 1953 Armistice Agreement into a formal end to the 1950-1953 Korean War;
  5. Welcome the call of the UN Secretary-General for a resumption of Six-Party talks and his offer to assist in negotiations;
  6. Welcome also the offer of the European Union to assist in diplomatic negotiations, as they did successfully in the negotiations on Iran’s nuclear program;
  7. Call on the United Nations Security Council to prioritise a diplomatic solution to the conflict

 
* The 3+3 arrangement would include Japan, South Korea and North Korea agreeing not to possess or host nuclear weapons, and would require China, Russia and the USA agreeing not to deploy nuclear weapons in Japan, South Korea or North Korea, nor to attack or threaten to attack them with nuclear weapons.

상지대학교가 사학비리로 쫒겨난 김문기 전 총장을 우상화하는 교육을 학생들에게 강요하고 있는 것으로 드러났다. 김문기 전 총장이 쓴 책을 교재로 사용하는 인성교육 수업을 모든 신입생들이 듣도록 강제하고 있는 것이다. 학생들 사이에선 인성교육이 아니라 ‘김문기 종교’수업이라는 비판까지 나오고 있다.

상지대, 김문기 우상화한 책으로 신입생들에게 인성교육 강요

상지대는 올해부터 김문기 전 총장이 쓴 교재로 인성교육을 진행하고 있다. 1학점 짜리 수업인 인성교육은 교양필수 과목은 아니지만, 대학 측이 일괄적으로 수강신청을 해 모든 신입생들이 듣도록 하고 있다. 인성교육 강의는 2005년부터 시행돼 왔지만 김문기 씨가 쓴 교재로 수업을 진행하는 것은 올해가 처음이다.

문제는 교재의 내용이다. 김문기 전 총장은 상지대 재단 이사장 시절 공금횡령, 부정입학 등 혐의로 기소됐고, 1994년 대법원에서 부정입학 비리가 인정돼 징역 1년 6월을 선고 받고 이사장 자리에서 물러난 사학비리 전과자다. 2014년 8월 다시 총장으로 다시 상지대에 복귀했지만, 복귀한 지 11개월 만에 다시 교육부 감사에서 교육용 재산을 부당하게 사용한 점이 드러나 지난해 7월 총장직에서도 해임됐다

하지만 상지대 인성교육 교재인 <김문기 선생의 철학 ‘상지정신’>책은 김문기 전 총장을 마치 위인처럼 묘사했다. 상지대가 인성교재로 사용하고 있는 <김문기 선생의 철학 ‘상지정신’>이라는 책에는 아래와 같이 김문기 씨를 일방적으로 미화한 내용이 나온다.

김문기 선생은 평생을 살아오시면서 매사에 충실했다…김문기 선생은 젋은이들에게 교수 자리를 주선한 것이 부지기수이며 직장도 많이 잡아 주었으니 이 또한 남을 위한 충 아닌가? 열거하면 끝도 없다.13P

김문기 선생께서는 교육, 사회, 정치, 문화, 체육 모든 분야에서 커다란 업적을 남기셨고, 각 분야에 기여한 공로가 인정되어 훈장과 큰 상을 수상하신 분이다.16p(책의 저자는 김문기 씨지만, 김문기를 선생으로 표현하고 경어체로 서술한 점을 봤을 때, 다른 사람이 써준 것으로 보인다)

김문기 전 총장을 일방적으로 미화한 이 교재에는 사실관계가 틀린 내용도 나온다. 책 곳곳에는 김 전 총장이 상지학원 설립자라고 표현돼 있지만 그는 설립자가 아니다. 2004년 대법원은 상지학원 설립 당초 임원과 관련한 소송에서, 상지학원 설립자는 상지학원의 전신인 청암학원의 고 원홍묵 선생이라고 판결했다. 또 2014년 교육부도 김문기 전 총장이 상지학원 정관에서 김문기 등 8명을 설립당초 임원으로 변경한 것에 대해 원래대로 원홍묵 등 8인으로 시정하라고 요구한 바 있다.

이같이 사실관계도 다르고 김 전 총장을 일방적으로 미화한 책으로 인성교육을 받는 학생들은 강한 불만을 드러내고 있다. 총학생회가 신입생 200명을 대상으로 의견서를 접수한 결과 187명이 인성교육을 반대한다고 표명했다. 신입생 의견서에는 “인성교육은 김문기 종교다”, “인성교육과 상관없는 쓰레기 수업”등등의 불만이 담겨있다. 실제 취재진이 만난 상지대 신입생 임홍렬(산업디자인과 1)씨는 “인성교육은 사학비리 전과자로 판명된 사람의 입장을 학생들에게 세뇌시키는 수업”이라며 “400만 원 넘는 등록금을 내면서 이런 수업을 필수로 들어야 한다는 게 답답하다”고 말했다.

상지영서대도 올해부터 인성교육 ‘교양필수 과목으로…김문기 책 1500권 교비로 구입

이같은 인성교육은 상지대와 같은 재단인 상지영서대에서도 실시하고 있는 것으로 확인됐다. 상지영서대는 올해부터 인성교육을 교양필수 과목으로 지정했다. 교재는 상지대가 사용하는 <김문기 선생의 철학 ‘상지정신’>으로 동일하다.

취재결과, 상지영서대는 1500권에 달하는 교재를 구입하는 데 교비 900만 원을 사용한 것으로 확인됐다. 학생 등록금을 김문기 전 총장을 우상화하는 교육에 사용한 것이다. 책의 저자가 김문기 전 총장인만큼 책의 인세도 김 전 총장에게 흘러갔을 것으로 보인다.

상지대는 교재 구입비의 출처를 밝히지 않고 있다. 언론 대응을 담당하는 상지대 언론홍보팀은 “인성교육은 특성화기초대학에서 모두 관리하는 것으로 타 부서에선 일체 내용을 모른다”고 말했다. 특성화기초대학 이제원 학장에게 인성교육 수업을 개설한 목적은 무엇인지, 교재는 어떤 비용으로 구입했는지 물었으나 답변이 오지 않았다.

낯뜨거운 교재를 동원해 김문기 전 총장을 우상화하는 작업은 인성교육 말고도 학교 곳곳에서 이뤄지고 있다. 김문기 전 총장은 지난해 7월 총장에서 해임됐지만, 학교 본관에는 1층부터 5층까지 김문기 전 총장의 사진이 걸려있다. 상지대 대학원관 1층 입구에는 김문기 전 총장의 정치활동에 관한 영상이 상영되고 있다.

상지대 정문 옆에는 대저택을 방불케하는 김문기 기념관도 세워져 있다. 기념관에는 김문기 전 총장이 쓴 책을 그대로 옮겨놓은 듯 자신을 미화한 게시물들로 가득하다. 이 곳은 학교역사를 제대로 알린다는 목적으로 지역주민들과 총동창회에 개방하고 있지만, 총학생회에 대해서는 주거침입이라며 방문을 막고 있다.

김문기 전 총장이 자신의 기념관에서 업무를 보며 여전히 학교운영에 개입하고 있다는 지적도 제기된다. 방정균 한의예과 교수(전 상지대 비상대책위원장)는 “김문기 기념관에 보직교수들이 수시로 드나들면서 김문기 전 총장에게 허가받고 재가받고 그러고 있는 상황”이라며 “김문기 씨가 법적으로는 상지대와 관계가 정리됐다지만, 여전히 이사회와 학교행정을 좌지우지하고 있다”고 지적했다.

그동안 불금파티는 MBC와 KBS 앞에서 열었는데요, 더 많은 시민들과 함께 하기 위해 청계광장에서 불금파티를 엽니다. 제작중단 중인 마봉춘 아나운서 #허일후 님이 사회를 보고, #전인권 님과 #한영애 님이 초대손님으로 옵니다. 그리고, KBS와 MBC의 보도로 가슴이 무너져내렸던 #416가족합창단도 함께 합니다.

 

6번 째 불금파티는 공영방송 언론인들이 시민들과 함께 만나는 자리로 준비하고 있습니다.
그동안 KBS와 MBC에서 어떤 말도 안 되는 일들이 벌어졌는지 확인할 수 있습니다.

2014년 8월 상지대 총장으로 학교로 복귀한 김문기 전 상지대 이사장.

지난해 7월, 김 씨는 상지대 총장에서 해임됐다. 그러나 김 씨는 총장에서 해임된 뒤에도 자신이 장악한 이사회를 바탕으로 학교의 절대 권력자로 군림하고 있다. 자신에 대해 비판적인 목소리를 냈던 교수와 학생들 수십 명을 징계하는가 하면, 이사회와 학교의 주요 보직에는 자신의 친인척과 지인을 배치해 놓았다.

이렇게 김 씨가 학교를 좌지우지하면서 상지대는 대학구조개혁 평가에서 D-를 받고, 지방대학 특성화(CK-1) 사업이 중단돼 교육부가 예산을 회수해가는 등 깊은 상처를 입고 있다.

끝나지 않은 ‘김문기와의 싸움’…이어지는 징계

2014년과 2015년도 총학생회에서 활동하며 김문기 총장 퇴진 운동을 펼쳐온 전종완 씨. 2015년에는 총학생회장을 맡아 김문기 반대를 외치며 삭발을 하고, 본관 옥상에 오르고 국회 앞 상경 집회를 이끌었다. 학교 측은 업무방해와 총장 집무실 무단 난입 등을 이유로 전 씨를 두 차례 징계한 끝에 올해 2월, 제적을 통보했다. 전 씨는 “김문기 씨 쪽에서 보기에는 내가 눈엣가시였을 것이다. 그래서 보복성, 징계성으로 제적한 것”이라고 말했다.

구재단과 김문기 복귀 반대 투쟁의 최전선에 섰던 정대화 교수. 2014년 12월, 상지대 이사회는 정 교수를 파면했다. 이어 박병섭, 공제욱, 방정균 교수가 2015년 7월, 나란히 파면당했다. 학교 비방과 선동, 명예훼손 등이 이유였다. 교원소청심사위원회와 법원은 이들 4명의 교수에 대해 파면 무효를 결정했지만 복직은 이뤄지지 않고 있다.

이렇게 지금까지 모두 40명이 넘는 교수와 직원, 학생들이 징계를 받거나 재계약, 재임용이 거부됐다. 김문기 전 총장을 반대하는 학교 구성원들이 쫓겨나는 동안 김문기, 그리고 구재단과 가까운 인물들은 하나 둘 학교의 요직을 차지했다.

이사회 장악한 김문기…요직 차지하는 측근들

지난 2014년 교육부 특별종합감사에서 부당 채용된 것으로 드러나 총장 해임 사유까지 됐고, 결국 직권면직 됐던 김문기 전 총장의 측근, 남 모 씨와 조 모 씨는 얼마 지나지 않아 각각 총무부장과 학생지원부 과장으로 다시 학교에 복귀했다.

김문기 반대 교수들의 징계 관련 소송에서 구재단 측, 즉 김문기 쪽을 대리해 온 정석영 변호사는 지난 해 11월, 석좌교수로 채용됐다.

강의나 연구 활동은 전혀 하지 않고 있지만 급여로 매달 800만 원이 지급되고 있다. 정 변호사는 구재단을 대리한 소송의 수임료를 교수 급여로 받고 있는 것이 아니냐는 취재진의 질문에 ‘그런 부분도 감안한 것이다. 학교가 다른 소송 대리인을 선임할 경우 많은 비용이 드는데 내가 석좌교수로 있으면서 학교가 재정을 절감하는 측면이 있을 것’이라고 말했다. 사실상 소송 수임료를 급여 형태로 교비에서 변칙 지출하는 게 아니냐는 의혹이 제기된다.

김문기 씨는 정관에 상근 임원직을 신설해 자신의 장남 김성남 씨를 연봉 1억 3천 상당의 상임이사 자리에 앉히고 친척 관계인 최선용, 김일남 씨, 그리고 같은 문중 인사인 김길래 씨를 이사로 기용하면서 이사회를 완전히 장악했다. 총장에서 물러났지만 김 씨가 여전히 교내에서 막강한 권력을 휘두를 수 있는 배경이다.

김문기 체제 아래 무너지는 학교 운영

상지대가 이렇게 김 씨에 의해 좌지우지되면서 학교는 급속하게 망가지고 있다. 상지대는 3년마다 있는 대학구조개혁 평가에서 지난해 D-를 받았다. 지난 7월 파면된 박병섭 상지대 법학과 교수는 “평가 지표를 보면 학생들의 취업 지원 예산 등이 일반 예산보다 훨씬 높은 점수가 부과돼 있다. 그런데 우리학교는 오히려 그 예산을 깎은 것이다. 바보가 아니면 점수를 안 받기로 작정한 것”이라고 지적했다.

상지대는 2014년 김문기 씨가 총장이 되기 전, 지방대학 특성화(CK-1) 사업에 선정돼 95억 원의 국비 지원을 확보했지만 김 씨가 총장으로 들어온 후 교육부와 약속한 이행사항을 지키지 않아 사업이 중단되고 국비 지원금이 환수되는 상황도 벌어졌다.

지난 9일, 취재를 위해 찾은 상지대 캠퍼스 한가운데서 김문기 씨를 만날 수 있었다. 그는 현재 상지대 상임이사인 자신의 장남 김성남 씨와 함께 학교 부동산 관련 서류를 검토하고 있었다. 총장에서 해임됐는데도 여전히 학교를 떠나지 않고 있는 이유를 묻자 “내가 설립자기 때문에 일이 있을 때마다 학교에서 좀 와달라고 한다. 오늘은 학교 부지 이런 것을 정리해 주려고 온 것”이라고 밝혔다.

상지대 비상대책위원회는 지난 10일, 교육부에 상지대 사태를 해결하기 위한 공익감사를 청구했다. 지난 2014년 교육부의 특별종합감사로 김문기 씨가 총장에서 해임됐지만 여전히 사태가 해결될 기미를 보이지 않고 있는데 따른 것이다.

방정균 상지대 한의예과 교수는 “지난 교육부 감사에서 이사회에 대한 감사는 거의 진행되지 않았다. 김문기 전 총장 해임 후에도 사태가 악화되고 있으면 당연히 재감사를 나와야 한다. 교육부의 이사회 개편, 임시이사 파견이 유일한 해결책이라고 할 수 있는데, 빨리 진행됐으면 하는 바람”이라고 밝혔다.

"공익제보자 보호, 사각지대 없애자"

사학비리 공익제보 사례 발표 및 제보자 보호 강화를 위한 입법방만 모색 토론회

○취지
- 공익제보자를 보호하기 위한 제도로 ‘공익신고자보호법’과 ‘부패방지 및 국민권익위원회 설치에 관한 법률(이하 부패방지법)‘이 있지만, 사학비리 공익제보자들은 제대로 보호하지 못하고 있습니다.
- 공익신고자보호법은 사립학교법 위반 또는 회계부정에 따른 업무상 횡령 등은 공익침해 행위로 보지 않고 있고, 부패방지법도 공공기관의 부패행위만을 다루고 있어, 사립학교의 부패행위는 신고대상에서 제외되어 있기 때문입니다. 이로 인해 사학비리 공익제보자들은 학교측의 보복행위에 그대로 노출되어 있는 상황입니다. 실제 서울 동구마케팅고등학교, 하나고등학교의 비리를 알린 교사들은 학교로부터 파면, 해임, 담임배제 등 부당한 처분과 각종 불이익 처분을 받으며, 고통 받고 있습니다.
- 최근 교육 분야의 부패가 심각하다는 사회적 인식에 기반 하여 청탁금지법에 사립학교 임직원을 포함시킨 만큼, 사학비리 공익제보자를 보호하기 위한 제도 개선은 더 이상 늦출 수 가 없습니다.
- 이에 사학비리 공익제보자들에 대한 불이익조치 현황을 살펴보고, 제보자 보호를 강화를 위한 입법방안을 모색해 보고자 합니다.
