지난 1월 30일, 부산에서 온 이 모씨는 충남 서천군에 있는 고 유 모 할머니의 묘소를 참배했다. 자신의 잘못으로 세상을 떠난 할머니와 17년 만에 마주한 것이다.
할머니 죄송합니다. 세월은 흘렀지만 그 때 한 행동은 지금도 후회하고 반성하고 있습니다. 부디 좋은데 가셔 가지고 편안한 안식을 갖기를 빌어드리겠습니다. 정말 죄송합니다.

그렇다. 이 씨는 1999년 2월 6일 전북 완주군 삼례에서 발생한 나라슈퍼 강도치사 사건의 3인조 범인 가운데 한 명이다.
그러나 이 씨는 아무런 처벌을 받지 않았다. 대신 처벌을 받은 사람은 당시 마을 부근에 살던 19~20살 청년 3명이다.

빈집털이 전과가 있던 이들은 처음엔 범행을 부인했지만 경찰의 폭행과 강압적인 수사에 못이겨 허위 자백을 했다. 검찰은 3명을 강도치사 혐의로 기소했고 이들은 각각 징역 6년과 4년,3년을 선고받아 복역했다.
그런데 사건 17년 만에 진범이 다시 입을 열었다. 숨진 유 모 할머니에게 마지막까지 물을 떠다 먹이며 인공호흡을 시도했던 범인, 이 모씨다.
이 씨는 억울한 옥살이를 했던 삼례 청년 3명을 지난 1월 29일 만나 손을 맞잡으며 사과했다. 그리고 이미 30대 중반을 넘어선 청년들은 진범의 용서를 받아들였다. 고맙다는 말과 함께.

진범이 자신의 범행을 고백하고 피해자들에게 용서까지 구한 지금. 당시 삼례 청년들에게 엉뚱한 죄값을 치르게 했던 경찰은 어떤 입장일까?
취재진은 피해자들과 함께 당시 이들을 조사했던 경찰들을 찾아나섰다.

그러나 이들 모두 하나같이 취재진을 피했고 피해자들을 외면했다. 당시 수사는 최선을 다한 것일 뿐이라는 말만 되풀이했다.

억울한 옥살이를 했던 피해자 임명선씨는 이렇게 말한다.
그냥 우리 잘못했다 그렇게 말 한마디라도 했으면 그래도 괜찮을 건데 그 말 한마디도 못하고 막 피해다니고 도망다니니까, 깝깝하죠.
살인을 저지른 진범은 “자신이 할머니를 죽였다”고 고백했고 용서를 빌었다. 뿐만 아니라 자신들 때문에 죄를 뒤집어 쓴 청년들의 억울함을 풀어주겠다고 용기를 내고 있다.
반면 중학교도 제대로 나오지 못한, 지적장애를 갖고 있던 청년들에게 죄를 뒤집어 씌웠던 공권력은 한마디 사과도 없이 침묵하고 있다.
용서받지 못할 자는 과연 누구일까?
경찰의 기습적인 음주 단속에 항의하다 경찰의 팔을 꺾었다며 공무집행방해 혐의로 기소돼 유죄 판결을 받았다가 대법원에서 무죄 판결을 받은 박철 씨가 다시 재심을 받을 수 있게 됐다.
청주지방법원 충주지원(판사 황병호)은 지난 24일 박 씨가 법원을 상대로 제기한 재심청구를 받아들인다고 결정했다. 충주지원은 결정문에서 “재심대상판결의 소송절차에서 발견되지 못한 새로운 증거가 발견됐고, 이 새로운 증거들은 재심대상판결을 그대로 유지할 수 없을 정도의 고도의 개연성이 인정되는 명백한 증거에 해당한다”며 박 씨가 법원을 상대로 제기한 재심청구를 받아들였다.
형사소송법 제420조 제5호에 따르면 유죄의 선고를 받은 자에 대해 무죄 또는 면소, 형의 선고를 받은 자에 대해 형의 면제 또는 원판결이 인정한 죄보다 경한 죄를 인정할 명백한 증거가 새로 발견된 때 재심을 청구할 수 있다. 이 조항에 따라 재심이 열릴 경우, 사실상 무죄 판결이 날 것으로 예상할 수 있다. 충주지원은 국립과학수사연구원이 화질을 개선한 동영상, 법영상분석 전문가의 감정서, 유도경기지도학 교수의 동영상 분석결과 등을 새로 발견된 ‘명백한’ 증거로 인정했다.

박 씨는 지난 2009년 6월 경찰의 기습적인 음주 단속에 항의하다 경찰의 팔을 꺾어 공무집행을 방해했다는 혐의로 입건됐고 대법원에서 벌금 200만 원 확정판결을 받았다. 그런데 박 씨의 재판에 증인으로 나왔던 부인 최옥자 씨가 위증 혐의로 입건돼 다시 유죄판결을 받아 교육공무원직에서 파면됐다.
이후 아내의 재판에 증인으로 섰던 박 씨가 다시 위증 혐의로 기소돼 재판을 받다 2014년 4월 1심에서는 벌금 500만 원 형을 받았으나 이듬해 8월 2심에서 무죄를 선고받았고 대법원에서도 무죄 확정 판결을 받았다. 이에 따라 박 씨는 올해 1월 충주지원에 첫 번째 유죄 판결 사건(공무집행방해 혐의)에 대한 재심을 청구했다. 부인 최 씨도 두 번째 위증 판결 사건에 대해 재심을 청구했고 재심을 개시할 지 여부가 조만간 결정 날 것으로 보인다.
박 씨 부부의 재심 사건을 맡고 있는 박준형 재심 전문 변호사는 “재심 개시가 확정되면 무죄 판결이 난다”며 “검사가 개시 결정에 대해 불복을 할 수는 있지만, 불복을 해도 개시 결정이 바뀌지는 않을 것”이라고 말했다.
박 씨는 “경찰과 검찰, 법원 모두에게 책임이 있다고 생각한다”며 “서로 견제하지 못하는 사법 시스템을 개혁하는 계기가 됐으면 좋겠다”고 말했다.
한편 박 씨는 공무집행 과정에서 팔이 꺾였다고 주장했던 경찰 박 모 씨를 지난 2월 직권남용체포, 모해위증 혐의로 고소했다. 하지만 충북음성경찰서는 이달 6일 직권남용체포 혐의에 대해서는 ‘공소권 없음’, 모해위증 혐의에 대해서는 ‘혐의없음’ 의견으로 검찰에 송치해 경찰의 자기 식구 감싸기라는 비판이 나오고 있다.

전 세계의 110개 평화단체들과 146인의 평화운동가들은 당면한 동북아와 한반도 위기에 대해 무력 사용을 반대하고 외교적 해결을 촉구하였습니다. 전 세계 평화와 군축을 위해 활동하는 이들은 이번 서한을 통해 지금의 위기가 오판과 우연에 의해 핵전쟁으로까지 비화된다면 전 세계는 핵참화를 피하기 어려울 것이라고 우려하며 △선제적 무력 사용 반대, △도발적인 군사연습 중단, △동북아비핵지대안 검토, △한국전쟁 종전, △6자회담 재개, △유럽연합의 외교적 협상 지원 환영, △외교적 해결 우선 등 7개 요구사항을 제시하였습니다.
이들은 이러한 입장을 담은 서한을 지난 9월 7일 남⋅북⋅미⋅중⋅러⋅일 등 6개국 대통령(또는 수상)과 유엔주재 대표, 유엔안보리 회원국, 안토니오 구테레스 유엔 사무총장 그리고 페데리카 모게리니 유럽연합 외교안보 고위대표에게 보냈다고 밝혔습니다.
이번 공동서한에는 퍼그워시 회의(Pugwash Conference), Campaign for Nuclear Disarmament(영국), Coalition for Peace Action(미국), 원수폭금지협의회(일본), 참여연대(한국) 등 전세계 24개국에서 활동하는 평화단체들과 1976년 노벨평화상 수상자인 메어리드 코리건 매과이어(Mairead Corrigan Maguire)를 비롯한 대표적 평화운동가들이 함께 하였습니다.

▣ 공동서한 국문
동북아 상황의 외교적 해결을 호소합니다
전 세계에서 평화와 군축을 위해 활동하는 ‘어볼리션(Abolition) 2000’의 회원단체들을 대신하여 미국과 북한에 동북아가 직면하고 있는 전쟁 직전의 상황에서 한 걸음 물러나, 대신 전쟁을 막기 위한 외교적 접근법을 택하라고 촉구합니다.
우리는 군사 갈등이 발발하는 것을 막고 나아가 근본적인 갈등을 해결하기 위해 즉시 협상에 나설 것을 요구합니다. 그러한 협상은 양자 간은 물론 중국, 일본, 북한, 러시아, 한국, 미국을 포함하는 새로운 6자회담 틀을 통해 이뤄져야 합니다.
북한의 핵‧미사일 능력을 두고 고조되는 긴장과 군사 갈등 위협은 외교적 해법이야말로 필수적이며 최우선임을 다시금 일깨워줍니다. 전쟁 위기가 높아지고 오판과 우연, 또는 의도에 의해 핵무기가 사용될 수도 있다는 사실은 매우 끔찍한 일입니다.
1950년에서 1953년까지 이어진 한국전쟁에서 목숨을 잃은 사람들의 수는 남북, 중국, 미국 등 다 합해 총 300만 명을 넘습니다. 만일 전쟁이 다시 발발한다면, 특히 핵무기가 사용된다면 사망자 수는 훨씬 더 많을 것입니다. 한반도에서 발발하는 핵전쟁은 핵 참사로 전 세계를 집어 삼킬 것이며 이는 우리 모두가 알듯이 문명의 종말을 가져올 것입니다.
전쟁보다 외교적 해법을 지지하며, 우리는 다음과 같이 요구합니다.
- 우리는 그 어느 측의 선제적 무력 사용에도 반대합니다. 이는 역효과를 낳을 것이며 상황을 핵전쟁으로 이끌 것입니다.
- 우리는 모든 측에 군국주의적 수사와 도발적인 군사 연습을 그만두기를 촉구합니다.
- 우리는 중국, 일본, 북한, 러시아, 한국, 미국이 3+3 방식의 동북아 비핵지대 수립을 위한 단계적이고 포괄적인 접근법을 검토하기를 권합니다. 이는 일본과 한국에서 두 개 이상의 정당의 지지를 받고 있으며 북한 정부도 관심을 가지고 있습니다.
- 우리는 중국, 일본, 북한, 러시아, 한국 그리고 미국이 또한 한국전쟁(1950-1953)을 공식적으로 끝내도록 1953년 정전협정을 전환하기 위한 가능한 옵션과 양식을 고려할 것을 권합니다.

Appeal for a diplomatic solution in North East Asia
The Abolition 2000 members and affiliated networks listed below, representing peace and disarmament organisations from around the world, call on the United States and North Korea to step back from the brink of war in North East Asia, and instead adopt a diplomatic approach to prevent war.
We call for the immediate commencement of negotiations to prevent a military conflict from erupting, and to resolve the underlying conflicts. Such negotiations should take place both bilaterally and through a renewed Six-Party framework involving China, Japan, North Korea, Russia, South Korea and the United States.
The escalating tensions and threat of military conflict over North Korea's nuclear and missile capabilities makes a diplomatic solution of vital importance and the highest priority. The increasing risk of war - and possibly even the use of nuclear weapons by miscalculation, accident, or intent - is frightening.
More than three million citizens of Korea, China, USA and other countries lost their lives in the Korean War from 1950-1953. Should a war erupt again, the loss of lives could be considerably worse, especially if nuclear weapons are used. Indeed, a nuclear conflict erupting in Korea could engulf the entire world in a nuclear catastrophe that would end civilization as we know it.
In supporting diplomacy rather than war, we:
- Oppose any pre-emptive use of force by any of the parties, which would be counter-productive and likely lead to nuclear war;
- Call on all parties to refrain from militaristic rhetoric and provocative military exercises;
- Encourage China, Japan, North Korea, Russia, South Korea and the United States to consider the phased and comprehensive approach for a North-East Asian Nuclear-Weapon-Free Zone with a 3+3 arrangement*, which already has cross-party support in Japan and South Korea and interest from the North Korean government;
- Encourage China, Japan, North Korea, Russia, South Korea and the United States to also consider options and modalities for turning the 1953 Armistice Agreement into a formal end to the 1950-1953 Korean War;
- Welcome the call of the UN Secretary-General for a resumption of Six-Party talks and his offer to assist in negotiations;
- Welcome also the offer of the European Union to assist in diplomatic negotiations, as they did successfully in the negotiations on Iran’s nuclear program;
- Call on the United Nations Security Council to prioritise a diplomatic solution to the conflict
* The 3+3 arrangement would include Japan, South Korea and North Korea agreeing not to possess or host nuclear weapons, and would require China, Russia and the USA agreeing not to deploy nuclear weapons in Japan, South Korea or North Korea, nor to attack or threaten to attack them with nuclear weapons.

노골적으로 외도를 권하는 기혼 남녀 만남 중개 사이트인 “애슐리 매디슨”, 여기에 가입한 한국인들은 얼마나 될까, 또 그들은 누구일까?
최근 미국과 영국, 캐나다 등 영미권 국가들에서는 애슐리 매디슨의 가입자 정보가 해킹으로 유출돼 큰 이슈가 됐다. 뉴스타파는 이 데이터를 입수해 한국인 가입자들과 관련한 정보를 분석했다. 그리고 분석 결과 이 사안이 단순한 말초적 호기심을 충족시키는 것을 넘어, 한국 사회의 한 단면을 보여주고 더 나아가 공적 감시의 영역에도 해당한다고 판단했다. 이러한 판단에 입각해 뉴스타파 제작진은 여러 차례 진지한 논의 끝에 보도를 결정했다.
분석 결과, 가입 당시 자신의 국가를 한국이라고 표시한 사람은 무려 66만 7천 2백 96명이었다. 가입자 숫자로는 전체 53개 국가 가운데 9위, 인구 대비 가입자 비율로는 17위였다.

애슐리 매디슨은 지난해 한국 서비스를 시작했지만 두 달도 채 지나지 않아 사이트 폐쇄를 당했고 올해 초 간통죄 위헌 결정이 나자 4월에 서비스를 재개했다. 당시 애슐리 매디슨은 대규모 기자회견을 열 정도로 한국 시장에 대한 기대감을 숨기지 않았다. 그리고 불과 석달 만에 가입자 정보가 유출됐는데, 한국 가입자는 이미 60만 명을 돌파한 것이다. 짧은 영업 기간을 감안하면 결코 적다고 할 수 없는 숫자다.
한국보다 인구가 두 배 이상 많은 일본의 경우, 이번에 유출된 데이터를 보면 전체 가입자 수도 한국보다 훨씬 적었고, 인구 대비 가입자 비율은 한국의 4분의 1 수준이었다.

뉴스타파가 입수한 파일에는, 가입자의 이메일 계정과 닉네임, 최종 이메일 답변 시점, 접속 위치 등의 정보가 들어있었다. 우선, go.kr과 korea.kr 도메인을 가진 공무원들의 이메일 계정이 얼마나 있는지 확인해 봤다. 확인 결과 go.kr 도메인을 가진 계정이 67건, korea.kr을 가진 계정이 169건이었다. (이메일을 보냈더니 40통이 반송되었으므로 유효한 메일 주소는129건으로 추정된다. 뉴스타파는 각 정부 기관에 해당 메일이 유효한 메일인지를 묻는 정보 공개를 청구했으며 답을 기다리고 있다.)
go.kr 도메인을 가진 이메일 가운데는 경기도청 소속이 12건으로 가장 많았고, 서울시청 3건, 서울의 각 구청이 8건 등 지자체 소속 공무원들이 많았다. police.go.kr , 즉 경찰청 도메인의 이메일 계정도 4건 나왔다. scourt.go.kr 도메인, 즉 법원 직원의 업무용 메일 주소는 1개, spo.go.kr 도메인, 즉 검찰 직원의 업무용 메일 주소는 3개 포함돼 있었다. 특히 법원과 검찰 직원의 이메일 계정은 모두 실제로 존재하는 계정으로 확인됐다. 청와대 도메인을 가진 이메일도 2개 발견됐지만 하나는 [email protected], 다른 하나는 [email protected] 이어서 정상적인 개인 사용자의 계정으로 보기는 어려웠다. 이밖에 각 시도의 교육청, 소방서, 각종 공공 기관들의 도메인을 가진 이메일 계정도 다수 발견됐다.
ac.kr 도메인을 가진 계정, 즉 대학교와 연관된 계정은 240개나 나왔다. 상당수는 학생이나 대학원생, 대학교 교직원의 이메일 계정이었고 교수로 확인된 계정은 23개였다. 뉴스타파가 이 교수들에게 이메일을 통해 질의한 결과 이 가운데 3명은 가입 사실을 인정했고, 2명은 메일 주소 도용을 주장했으며 나머지는 아무런 응답도 하지 않았다.
공영방송 kbs의 경우, kbs.co.kr 도메인을 가진 메일 주소가 8개 발견됐으며 이 가운데 4명은 실제 kbs의 전현직 직원으로 확인됐다. 이 가운데 3명은 취재나 프로그램 제작 업무에 종사하는 사람들로, 모두 취재나 프로그램 제작 때문에 가입했다고 말했다.
개신교 목사의 이메일 역시 2개가 발견됐다. 그러나 그 가운데 하나는 가입자의 접속 위치가 미국으로 되어 있었다. 나머지 한 명의 목사는 “시대적인 경향과 성 문화를 알기 위해 가입했으며 이것은 설교의 소재가 될 수 있다. 한 번 가입해 둘러보았을 뿐 그 뒤로는 한 번도 접속을 하지 않았다”고 해명했다.
대기업 직원들의 이메일 역시 다수 발견됐다. 우리나라 10대 기업의 도메인을 가진 이메일 계정만 추려봤더니 모두 114건이 나왔다. 기업별로는 삼성이 47건으로 가장 많았고 sk가 33건, 두산이 14건으로 뒤를 이었다. 사기업 직원들의 경우 사생활임을 고려해 이메일을 보내거나 메일의 유효성을 확인하는 작업은 별도로 하지 않았다. 따라서 이 가운데 몇 개가 유효한 계정인지는 알 수 없다.

성적 자기 결정권을 가진 성인이 애슐리 매디슨에 가입하거나 혹은 더 나아가 이를 외도의 수단으로 활용한다고 해도 제3자가 이에 대해 왈가왈부할 수는 없다.특히 이번 사건으로 정보가 유출된 당사자들은 불법 해킹으로 인한 개인 정보 유출의 피해자이기도 하다. 뉴스타파 취재진은 이 점에 깊이 유의해 수집한 이메일을 철저히 관리했으며 당사자 취재 범위 역시 공적 영역으로만 한정했다. 공무원이나 공기업의 직원, 국립대학교의 교직원이 업무용 메일로 이같은 사이트에 가입하거나 활동을 한 것으로 보이는 경우, 또 개인 메일로 가입했다 하더라도 선출직이나 고위 공직자인 경우, 또한 높은 도덕성이 요구되는 종교인이 가입한 경우가 바로 그런 경우였다.
