"답은 공수처밖에 없다" 

권력이 있는 자에게는 관대하고, 없는 이들에게 가혹한 한국 검찰. 검찰이 막강한 권한을 정권에 따라, 입맛에 따라 휘두를 때마다 시민들은 "권력으로부터 독립적인 수사기구, 고위공직자비리수사처 설치"를 요구해왔습니다. 현직 검사의 성추행 폭로와 수사 외압 의혹까지 제기된 지금, 검찰의 '셀프 수사', '셀프 개혁'은 시민들의 신뢰를 얻을 수 없습니다. 

그런데도 자유한국당은 반대를 위한 반대로 공수처 설치를 막고 검찰개혁을 온 몸으로 거부하고 있습니다. 

자유한국당의 공수처 반대 입장을 바꾸고 20년 간 묵혀왔던 사회적 과제인 공수처를 도입하기 위해서는 끊임없는 시민들의 목소리가 필요합니다. 

<공수처설치촉구공동행동(경실련, 민변, 참여연대, 한국투명성기구, 한국YMCA전국연맹, 흥사단)>은 공수처 법안을 논의해야 할 국회 사법개혁위원회와 법제사법위원회를 모니터링하고 국회를 압박하는 칼럼을 연재할 예정입니다. 공수처설치촉구공동행동은 공수처 설치를 촉구하는 서명캠페인을 진행하고 있습니다. 시민여러분의 참여가 공수처 설치를 앞당길 수 있습니다. <서명하러가기>

고위공직자의 부패문제에 대한 대응을 위해서 별도의 기구가 필요하다는 논의가 제기된 것도 어느덧 20년이 넘었다. 고위공직자의 부패를 방지하기 위한 기구의 설치에 관한 내용을 담은 시민사회의 법률안이 국회에서 처음 접수된 것은 1996년이라고 한다. 1996년이면 '서태지와 아이들'이 은퇴를 선언하고, H.O.T.가 '전사의 후예'로 데뷔한 해다. 그 오랜 시간 동안 국회에서 논의가 진척이 전혀 되지 않은 상황에서 우리는 대체 어떤 일을 겪었어야 했는지 돌아보자.

 

그 긴 시간 동안 신문 1면에서 김현철, 김홍일·김홍업·김홍걸, 노건평, 이상득 그리고 최순실의 이름을 보아야 했다.  오랜 군부독재를 끝내고 이른바 문민화된 정권이 들어선 이후에도 꾸준히 대통령 최측근 또는 친인척이 정권 말에 구속되었던 역사가 지속·반복되었던 것이다. 이를 두고 우리 사회가 최고 권력자 최측근을 한 번도 빠짐없이 구속시켰으니 사법정의가 살아있었다고 평가할 이는 없을 것이다. 오히려 왜 매 정권마다 대통령 최측근의 비리가 거듭 반복되었고, 결국에는 대통령 탄핵이라는 미증유의 사태까지 벌어졌어야 하는지 되짚어 보는 것이 사안의 본질에 대한 정확한 접근이 아닐까?

 

고위 공직자 부패의 원인과 해결을 위해서는 여러 가지 방안이 필요하겠지만, 무엇보다도 고위공직자의 부패를 감시하고 사정을 담당해야 할 검찰의 제자리 찾기를 우회할 수는 없다. 권력에 굴종하지 않고 독립성을 갖춰야 할 검찰이 오히려 권력의 정치적 도구로 전락했기 때문에, 국민들만 불행해질 수밖에 없었던 것이다.

 

그러나 해결책을 검찰의 독립성 보장이라는 미명에 매달려서도 안 된다. 이 경우 자칫 검찰의 민주적 통제라는 요청을 외면하는 결과로 이어질 수 있기 때문이다. 결론적으로 검찰에 대한 '민주적 통제'의 요청과 현재 법 체계에서 갖고 있는 검찰의 막강한 권한에 대한 '합리적 배분'이라는 과제를 동시에 충족하는 중층적인 입법과제가 제기되는 것이다.

 

다양한 검찰개혁을 위한 입법과제 중에서도 대통령을 정점으로 하는 고위공직자의 비리에 대한 사정을 효과적으로 담당하기 위한 별도의 기구인 '고위공직자비리수사처'를 설치할 필요성은 빼놓을 수 없는 코어 솔루션이다.

 

수없이 긴 시간 동안 공수처 설치를 반대해온 것은 사실 정치권과 검찰이었다. 검찰은 자신의 영향력이 축소될 것을 우려했고, 정치권 역시 당리당략적 접근으로 일관해왔다. 이 때문에 공수처 설치는 몽상적인 대안으로 치부되고, 대신에 특검제도와 특별감찰관 제도 도입으로 대체되었던 것이 현실이었다.

 

그러나 특검제도와 특별감찰관 제도를 통해서 대통령을 위시한 고위공직자의 부패비리를 방지하고 해결하는 데에는 구조적 한계가 있다는 것이 '박근혜 게이트'를 통해서 분명하게 드러났다. 우선 현재의 특검제도는 상시적·전문적으로 권력형 비리와 고위공무원들의 부정부패사건 등을 수사하고 검찰의 권한남용을 통제하는 것이 아니라 특정 사건 발생 이후 대통령이 특검을 임명하여 한시적으로 활동하는 제도이기 때문에 '사후약방문'이 될 수밖에 없다는 점이다. 또 많은 특검이 정치권력으로부터 독립성을 유지하지 못하고, 실질적으로 권력의 눈치를 본 축소수사에 그친 경우도 적지 않았다.

 

대통령 친인척 및 측근을 대상으로 한 특별감찰관 제도 역시 마찬가지였다. 현재의 특별감찰관제도는 감찰대상과 감찰범위 등이 매우 제한적일 뿐만 아니라 감찰권 이외에 수사·기소권이 부여되지 않았다는 점 등에서 한계가 명확하다. 더구나 실제로 박근혜 정권에서 이석수 특별감찰관이 청와대 감찰을 시작하자, 오히려 우병우의 역습에 직면해야 했고 결국 사임을 했던 것이다.

 

결과적으로 이제는 현재 제도가 갖는 한계를 선언하고, 고위공직자비리수사처의 설치를 더 이상 미룰 수 없는 시대가 도래한 것이다. 주지하다시피 현재 20대 국회에서는 다양한 공수처 법안이 제기되었다. 2016년에는 민주당과 국민의 당이 힘을 모아서 박범계·이용주 의원안이 발의되었고, 정의당에서도 노회찬 의원안이 발의되었다. 

 

또 2017년에는 더불어민주당 양승조 의원안과 바른당의 오신환 의원안이 입법발의된 상황이었다. 2017년 가을에는 정부도 움직였다. 법무부에 설치된 자문기구인 법무·검찰개혁위원회에서는 아주 개혁적인 '공수처 설치 권고안'이 발표되었고, 법무부도 2017년 10월 - 비록 그 내용상 한계는 있지만- 자체적안 '공수처' 법안에 대한 도입 입장을 밝힌 것이다.

 

이제 국회가 할 일은 명확하다. 우리 현실에 맞는 괜찮은 공수처가 설치될 수 있도록 현재 발의된 다양한 법안들을 기반으로 국회에서 보다 많은 숙의를 통해서 정선된 안을 만들어 의결하는 것이다. 그러나 국회가 자신의 임무를 철저히 방기하고 있다. 2018년 초에는 6월까지 활동할 사법개혁특별위원회가 설치되었지만, 적어도 3월 말까지는 공수처에 관해서는 어떠한 논의도 예정이 없다. 그러니까 박근혜 전 대통령의 탄핵이 1년이 지난 지금까지도 국회에서 '공수처' 논의는 여전히 공전되고 있는 것이다. 그리고 그사이에 믿을 수 없게도 H.O.T.는 무한도전에서 재결합 무대를 보여주었다. 공수처 설치보다 H.O.T.재결합이 더 빠를 것이라고 생각한 시민이 있었을까?

 

촛불시민도 공수처 설치가 당장 많은 것을 해결해줄 보증수표라고 생각하지는 않는다. 모든 제도는 시작시점에는 삐걱거리기 마련이다. 그러나 촛불이 기다리는 것은 '완성형' 공수처도 아니다. 공수처가 성장하고 자리를 잡는데에 시간과 서사가 필요하다는 점을 시민들이 더 잘 알고 있다. 그러나 더 이상 공수처의 설치를 미루는 것은 국회의 횡포일 따름이다. 촛불시민은 올 해에는 공수처가 데뷔할 수 있기를 바라고 있을 뿐이다. 응답하라 2018국회여.

공공의료 강화를 위한 새로운 모델, 민간병원의 공공병원화

 

부산은 대표적으로 건강이 나쁜 도시이다. 서울과 비교했을 때 기대수명이 많게는 9.7세까지 차이가 났으며(2014년 기준, 서울 서초구와 부산 동구의 격차), 피할 수 있는 죽음도 16개 구군 중 강서구를 제외한 15개 구군이 서울의 모든 자치구보다 높게 나타났다(2013년 기준).

하지만 아이러니하게도 의료공급은 과잉된 대표적인 도시가 부산이기도하다. 병상수가 전국에서 1~2위를 다툴 정도로 많으며 요양병원 병상의 수는 전국에서 단연 1위를 차지하고 있다. 병원은 많은데 왜 건강이 나쁠까? 그 해답을 공공의료에서 찾기로 했다.

지난 9월 8일 건강정책학회와 부산대학교 공공보건의료정책센터 공동주최로 “의료의 공공성 확대·강화 어떻게 할 것인가? - 부산 침례병원 사태를 중심으로” 토론회가 부산일보사 소강당에서 개최되었다. 건강불평등 해소 운동을 진행하고 있는 사회복지연대는 지난 7월에 파산한 침례병원 사태를 공공의료강화의 기회로 삼기위해 ‘민간병원의 공공병원화’라는 공공병원 확대의 새로운 모델을 고민해 왔고 침례병원 파산에 따른 새로운 공공병원 설립을 위한 부산시민대책위와 함께 토론회에 참여하였다.

토론회에 참석한 부산의대 윤태호 교수의 발제에 따르면 부산은 7대 특·광역시 중 공공의료 수준이 취약하며(2015년 기준: 의료기관 수 6등, 병상 수 5등) 시민의 건강수준을 개선하기 위한 정책을 수행하는 것이 어려운 실정에 놓여있다.

 

 

때문에 공공병원의 확대가 필요한데, 의료공급과잉인 상태에서 새로운 병원을 짓는 것 방법보다는 민간병원을 공공이 인수(투자)하여 공공병원을 확충하는 방안이 효율적이며 600병상규모의 대형병원인 침례병원이 그 첫 사례로 적합하다는 발제가 이어졌다.

이후 토론에서는 성남의료원의 사례를 들어 주민들이 간절하게 원하고 자랑할 수 있는 공공병원, 민간병원이라 할지라도 민주적으로 운영될 수 있도록 주민이 이사회에 참여하는 병원 등 공공성 확대를 위한 병원의 미래상에 대한 토론과 침례병원을 공공이 인수하기 위한 현실적인 방안과 한계 등의 토론들이 이어졌다.

토론회의 좌장을 맡았던 김용익 전 의원은 민간병원의 공공병원화는 향후 공공의료를 강화하는데 필수적인 방법이며, 민간병원을 공공병원화 하는 침례병원의 사례와 주민들이 참여하고 자랑스러워할 수 있도록 올바른 공공병원 운영을 추진하는 진주의료원의 재개원의 사례를 함께 고민하며 부울경 지역의 공공의료를 강화시키기 위해 노력해야 한다고 이야기했다.

사회복지연대는 지난 2013년, 부산일보사와 공동기획한 ‘건강최악도시부산’시리즈 이후로 부산의 건강불평등 해소와 공공의료 강화를 위해 노력해왔다. 토론회를 통해 이번 침례병원사태가 오히려 기회가 될 수 도 있다는 생각이 들기도 한다. 물론 민간병원을 공공이 인수하는 것이 쉬운 길은 아니겠지만 건강최악도시부산이 건강최고도시 부산으로 거듭날 수 있도록 사회복지연대는 계속해서 활동할 것이다.

'2017 권리로 요구하는 천안시 사회복지 정책제안 토론회'

시민 정책참여과정을 통해 모은 시미느이 목소리를 천안시 정책으로 제안

 

참여예산복지네트워크(사무국 : 복지세상을 열어가는 시민모임)는 9월 19일(화) 권리에 기반한 시민 정책참여과정으로 시민이 직접 천안시에 필요한 정책 7건을 발표하는 ‘2017 권리로 요구하는 천안시 사회복지 정책제안 토론회’를 천안축구센터에서 진행하였다.

정책제안 토론회는 아동, 청소년, 노인, 장애인, 이주민, 자활참여주민, 대학생 등 7개 영역에서 158명의 복지 당사자와 사회복지기관․단체 현장 실무자가 직접 권리워크숍과 원탁회의, 정책모니터링에 참여하며 문제점과 개선방안을 도출한 결과, 최종 7건의 정책을 천안시에 요구하는 자리이다.

 

2017년 시민 정책참여과정은 아동부터 노인, 장애인 등 총 158명이 4월 인권교육을 시작으로 각각 8번의 권리워크숍을 통해 320여가지 결핍점을 생생하게 이야기한 후, 75명이 한 자리에 모여 ‘권리원탁회의’를 통해 16가지 주제 중 ‘내 삶에서 가장 결핍된 점’에 대해 세부토의를 진행하고 우선순위 투표를 거쳤다. 이후 네트워크 기관․단체와 당사자가 함께 정책모니터링을 통해 실태와 문제점, 개선방안을 도출한 후 최종적으로 ‘저소득층 중․장년층 1인가구 고독사 예방 및 보호대책 마련’ 등 총 7건의 정책제안서를 작성하였다. 제안된 제안서는 9월 초 천안시 각 해당 부처에 정책을 전달하고 부서별로 의견서를 수렴하였다.

 

정책별 천안시 해당부서 사전 검토의견 수렴은 올해로 4년째 시행하고 있는 과정으로 사전 검토의견을 요청하기 이전보다 시민들의 삶을 더욱 살피며 책임 있게 정책을 수행하는 등 긍정적인 효과를 나타내고 있다. 그러나 부서검토 결과 7건 중 4건이 미반영과 보류 결과를 보이며, 절반이 넘게 시민의 의견이 반영되지 못하였다.

특히 저소득층 특수촬영 의료비 지원의 경우 참여예산복지네트워크에서 3년동안 제안하여 2015년 천안시장 공약사업에 포함되어 조례제정 후 시행하고 있으나, 지원되는 질환의 폭이 좁아 2016년 말 기준 18.%의 예산집행률을 보이며 실질적으로 지원이 필요한 저소득층에게 제대로 이루어지지 않고 있다. 또한 저소득층 중․장년층 1인가구 고독사의 경우 기록적인 고령화와 가파른 1인가구 증가세와 맞물리면서 전국적으로 급증하며 사회문제로 떠올랐다. 현재 고독사 관련 공식적인 정부차원의 통계는 없는 상태이며, 이와 관련있는 무연고 사망자 통계의 경우 전국 222개 지자체 중 천안시가 6위로 지난해 27명이 무연고 사망자가 발생하였다. 이에 지자체별로 중․장년층 1인가구에 대한 전수조사를 실시하고 대책을 마련하는 반면 천안시는 아직 고독사 예방을 위한 조사나 대책을 마련하지 않고 있다.

 

참여예산복지네트워크는 토론회 이후 조례개정 등을 통해 제안한 정책이 실행될 수 있도록 간담회 등을 진행할 예정이며, 사회복지예산의 양적인 확대 뿐 아니라 실질적으로 시민들이 필요로 하는 정책이 될 수 있도록 활동하고자 한다.

공동서한

국제 평화단체, 한반도⋅동북아 위기에 대한 외교적 해결 촉구

퍼그워시 회의 등 전세계 110개 평화단체, 무력사용 반대 입장 담은 서한을

미국과 북한 등 주요국가들에 전달

전 세계의 110개 평화단체들과 146인의 평화운동가들은 당면한 동북아와 한반도 위기에 대해 무력 사용을 반대하고 외교적 해결을 촉구하였습니다. 전 세계 평화와 군축을 위해 활동하는 이들은 이번 서한을 통해 지금의 위기가 오판과 우연에 의해 핵전쟁으로까지 비화된다면 전 세계는 핵참화를 피하기 어려울 것이라고 우려하며 △선제적 무력 사용 반대, △도발적인 군사연습 중단, △동북아비핵지대안 검토, △한국전쟁 종전, △6자회담 재개, △유럽연합의 외교적 협상 지원 환영, △외교적 해결 우선 등 7개 요구사항을 제시하였습니다.

 

이들은 이러한 입장을 담은 서한을 지난 9월 7일 남⋅북⋅미⋅중⋅러⋅일 등 6개국 대통령(또는 수상)과 유엔주재 대표, 유엔안보리 회원국, 안토니오 구테레스 유엔 사무총장 그리고 페데리카 모게리니 유럽연합 외교안보 고위대표에게 보냈다고 밝혔습니다. 

 

이번 공동서한에는 퍼그워시 회의(Pugwash Conference), Campaign for Nuclear Disarmament(영국), Coalition for Peace Action(미국), 원수폭금지협의회(일본), 참여연대(한국) 등 전세계 24개국에서 활동하는 평화단체들과 1976년 노벨평화상 수상자인 메어리드 코리건 매과이어(Mairead Corrigan Maguire)를 비롯한 대표적 평화운동가들이 함께 하였습니다.

▣ 공동서한 국문

 

동북아 상황의 외교적 해결을 호소합니다

 

전 세계에서 평화와 군축을 위해 활동하는 ‘어볼리션(Abolition) 2000’의 회원단체들을 대신하여 미국과 북한에 동북아가 직면하고 있는 전쟁 직전의 상황에서 한 걸음 물러나, 대신 전쟁을 막기 위한 외교적 접근법을 택하라고 촉구합니다. 

 

우리는 군사 갈등이 발발하는 것을 막고 나아가 근본적인 갈등을 해결하기 위해 즉시 협상에 나설 것을 요구합니다. 그러한 협상은 양자 간은 물론 중국, 일본, 북한, 러시아, 한국, 미국을 포함하는 새로운 6자회담 틀을 통해 이뤄져야 합니다. 

 

북한의 핵‧미사일 능력을 두고 고조되는 긴장과 군사 갈등 위협은 외교적 해법이야말로 필수적이며 최우선임을 다시금 일깨워줍니다. 전쟁 위기가 높아지고 오판과 우연, 또는 의도에 의해 핵무기가 사용될 수도 있다는 사실은 매우 끔찍한 일입니다. 

 

1950년에서 1953년까지 이어진 한국전쟁에서 목숨을 잃은 사람들의 수는 남북, 중국, 미국 등 다 합해 총 300만 명을 넘습니다. 만일 전쟁이 다시 발발한다면, 특히 핵무기가 사용된다면 사망자 수는 훨씬 더 많을 것입니다. 한반도에서 발발하는 핵전쟁은 핵 참사로 전 세계를 집어 삼킬 것이며 이는 우리 모두가 알듯이 문명의 종말을 가져올 것입니다. 

 

전쟁보다 외교적 해법을 지지하며, 우리는 다음과 같이 요구합니다.

  1. 우리는 그 어느 측의 선제적 무력 사용에도 반대합니다. 이는 역효과를 낳을 것이며 상황을 핵전쟁으로 이끌 것입니다. 
  2. 우리는 모든 측에 군국주의적 수사와 도발적인 군사 연습을 그만두기를 촉구합니다. 
  3. 우리는 중국, 일본, 북한, 러시아, 한국, 미국이 3+3 방식의 동북아 비핵지대 수립을 위한 단계적이고 포괄적인 접근법을 검토하기를 권합니다. 이는 일본과 한국에서 두 개 이상의 정당의 지지를 받고 있으며 북한 정부도 관심을 가지고 있습니다. 
  4. 우리는 중국, 일본, 북한, 러시아, 한국 그리고 미국이 또한 한국전쟁(1950-1953)을 공식적으로 끝내도록 1953년 정전협정을 전환하기 위한 가능한 옵션과 양식을 고려할 것을 권합니다. 
  5. 우리는 6자회담을 재개하라는 유엔 사무총장의 요구와, 협상을 지원하겠다는 그의 제안을 환영합니다. 
  6. 우리는 이란 핵 프로그램 협상을 성공적으로 이끌었던 것처럼 외교적 협상을 지원하겠다는 유럽연합(EU)의 제안 역시 환영합니다.

Appeal for a diplomatic solution in North East Asia

 

The Abolition 2000 members and affiliated networks listed below, representing peace and disarmament organisations from around the world, call on the United States and North Korea to step back from the brink of war in North East Asia, and instead adopt a diplomatic approach to prevent war. 
 
We call for the immediate commencement of negotiations to prevent a military conflict from erupting, and to resolve the underlying conflicts. Such negotiations should take place both bilaterally and through a renewed Six-Party framework involving China, Japan, North Korea, Russia, South Korea and the United States.
 
The escalating tensions and threat of military conflict over North Korea's nuclear and missile capabilities makes a diplomatic solution of vital importance and the highest priority. The increasing risk of war - and possibly even the use of nuclear weapons by miscalculation, accident, or intent - is frightening. 
 
More than three million citizens of Korea, China, USA and other countries lost their lives in the Korean War from 1950-1953. Should a war erupt again, the loss of lives could be considerably worse, especially if nuclear weapons are used. Indeed, a nuclear conflict erupting in Korea could engulf the entire world in a nuclear catastrophe that would end civilization as we know it.
 
In supporting diplomacy rather than war, we:
 

  1. Oppose any pre-emptive use of force by any of the parties, which would be counter-productive and likely lead to nuclear war;
  2. Call on all parties to refrain from militaristic rhetoric and provocative military exercises; 
  3. Encourage China, Japan, North Korea, Russia, South Korea and the United States to consider the phased and comprehensive approach for a North-East Asian Nuclear-Weapon-Free Zone with a 3+3 arrangement*, which already has cross-party support in Japan and South Korea and interest from the North Korean government;
  4. Encourage China, Japan, North Korea, Russia, South Korea and the United States to also consider options and modalities for turning the 1953 Armistice Agreement into a formal end to the 1950-1953 Korean War;
  5. Welcome the call of the UN Secretary-General for a resumption of Six-Party talks and his offer to assist in negotiations;
  6. Welcome also the offer of the European Union to assist in diplomatic negotiations, as they did successfully in the negotiations on Iran’s nuclear program;
  7. Call on the United Nations Security Council to prioritise a diplomatic solution to the conflict

 
* The 3+3 arrangement would include Japan, South Korea and North Korea agreeing not to possess or host nuclear weapons, and would require China, Russia and the USA agreeing not to deploy nuclear weapons in Japan, South Korea or North Korea, nor to attack or threaten to attack them with nuclear weapons.

망가진 공영방송 KBS,MBC를 국민의 품으로

매주 금요일마다 국민과 함께하는 불금파뤼~~

이번엔 청계광장에서 함께 만나요.

이번 주 금요일(25일) 저녁 7시, 청계광장에서 여섯 번째 #돌마고 #불금파티 가 열립니다.

그동안 불금파티는 MBC와 KBS 앞에서 열었는데요, 더 많은 시민들과 함께 하기 위해 청계광장에서 불금파티를 엽니다. 제작중단 중인 마봉춘 아나운서 #허일후 님이 사회를 보고, #전인권 님과 #한영애 님이 초대손님으로 옵니다. 그리고, KBS와 MBC의 보도로 가슴이 무너져내렸던 #416가족합창단도 함께 합니다.

 

6번 째 불금파티는 공영방송 언론인들이 시민들과 함께 만나는 자리로 준비하고 있습니다.
그동안 KBS와 MBC에서 어떤 말도 안 되는 일들이 벌어졌는지 확인할 수 있습니다.

 

무엇보다 국민 모두가 성원했던  #마봉춘 과 #고봉순 을 하루라도 빨리 만나려면, 시민들의 응원이 절실합니다.

MBC와 KBS가 국민의 품으로 돌아올 수 있도록  많은 분들이 함께 해 주시기를 부탁합니다.

특별감찰단 신설이야말로 옥상옥, 공수처 도입해야

김형준 부장검사 접촉 검사들 면죄부만 준 검찰 셀프수사


김형준 부장검사와 서울서부지검 검사들을 조사한 검찰의 셀프수사가 결국 김형준 부장검사의 개인적 일탈로, 다른 검사들에게는 면죄부를 주는 것으로 마무리되었다. 그리고 검찰은 간부비리 전담 특별감찰단을 임명하였다. 그러나 이 수사 결과에 고개를 끄덕일 사람이 과연 몇이나 될 것인가. 신뢰받지 못하는 검찰의 셀프수사에는 특별감찰단 신설이 아니라 검사를 포함해 고위공직자 비리를 전담하는 독립적 수사기구가 답이다. 참여연대 사법감시센터(소장 : 서보학 경희대 법학전문대학원 교수)는 독립된 수사기구, 고위공직자비리수사처 신설을 재차 촉구한다.

 

김형준 ‘스폰서 비리사건’ 담당 특별감찰팀은 스폰서 김 씨의 사건 무마 청탁이 있었는지, 특히 경찰이 신청한 김 씨 계좌 압수수색 영장을 서울서부지검이 두 차례 기각한 것에 특혜가 있었는지 등을 밝혔어야 했다. 특별감찰팀은 스폰서 김 씨의 사건담당자였던 주임검사가 두 차례 식사제의를 거절하다가 담당 부장검사의 허락을 받고 김형준 검사와 식사를 한 것을 알아냈다. 그러나 그 부장검사가 김형준 부장검사의 비위 혐의를 알고 있었음에도 식사를 허락했는지, 왜 담당검사는 식사제의를 거절했는데 부장검사가 나서 식사를 하게 했는지 등 합리적 의심은 여전히 해소되지 않았다. 그 부장검사는 지난 5월 김형준의 비위혐의를 알고도 신속히 조치를 취하지 않아 이번 감찰 결과 유일하게 징계, 그것도 경징계를 받은 유일한 서울서부지검 검사이다. 그 부장검사 덕분에 김형준 비리사건은 4개월이 지나서야 언론을 통해 세상에 알려지게 되었다. 그러나 검찰에 따르면 김형준이 사건청탁을 했다고 스폰서 김씨에게 거짓말을 하고 검사들에게는 엄중한 처벌을 요청하는‘이중플레이’를 했기 때문에 사건청탁을 받은 검사는 없다고 결론 내린 것이다.

 

홍만표에 이어 김형준에 이르기까지 다른 누구도 아닌 전․현직 검찰 출신들이 비리를 저지르고 동료 검사들을 대상으로 사건 무마 청탁을 하는 실정인데, 검찰에 따르면 검찰 내부는 청렴하기 그지없다. 이러한 인식의 차이부터가 셀프수사, 셀프개혁의 한계임을 검찰은 왜 부인하는가. 독립된 수사기구, 고위공직자비리수사처 필요성이 끊임없이 제기되어 왔지만 검찰과 법무부는 옥상옥이라며 고위공직자비리수사처 설립에는 반대하고 있다. 그러나 감찰부가 있음에도 신설된 특별감찰단이야말로 옥상옥임을 지적하지 않을 수 없다. 검찰이 국민적 신뢰를 회복하는 길은  독립적 수사기구, 고위공직자비리수사처 설립 논의를 촉진하는 것임을 명심해야 한다.
