칠레: 이중 사법제도로 인권침해 처벌 피하는 경찰

칠레의 터무니없는 이중 사법제도로 경찰이 평화적인 시위대 및 개인을 구타하거나 부당한 대우를 하고 심지어는 살해하기까지 하고 있지만 기껏해야 미미한 제재에 그친다고 국제앰네스티가 5일 신규 보고서를 통해 밝혔다.

보고서 <'정의가 두 종류인 줄 몰랐다': 칠레의 군사재판과 경찰의 가혹행위>는 보안군 소속원이 저지른 인권침해 사례의 사법절차를 전담하는 칠레 군사법원이 용의자를 제대로 수사하거나 기소하지 않는 실태를 공개했다. 군사법원에서 진행되는 재판은 보통 가장 기본적인 수준의 독립성과 공정성조차 갖추지 못하는 경우가 많다.

아나 피케르(Ana Piquer) 국제앰네스티 칠레지부 사무국장은 “칠레의 군사법원이 같은 조직에 소속된 사람들을 조사, 기소하거나 처벌할 수 있도록 해서는 안된다. 생각해볼 필요도 없다. 이는 피고인의 가족들이 판결을 내리게 하는 것과 다름없다”며 “이처럼 매우 불합리한 사법제도는 너무나 오랫동안 수많은 칠레 국민들의 정의 구현을 가로막고 있었다. 이제는 정부와 국회가 이 문제를 중요하게 다루고, 군사법원이 더 이상 인권침해 사건을 처리하지 못하게 함으로써 법을 준수하고 있다는 메시지를 전달해야 할 때”라고 말했다.

최근 수년간 칠레 전역의 시위가 격화되면서 시위대에게 가하는 경찰의 폭력은 더욱 심각해졌다. 국제앰네스티는 경찰관이 시위대를 구타하거나 최루가스와 물대포를 무차별적으로 사용한 사례를 기록한 바 있다. 평화적인 시위대와 행인 등 많은 사람들이 다쳤고, 평화적인 시위 중 목숨을 잃은 사람들도 있었다.

잔인한 통계

인권침해 용의자 경찰이 군사재판에서 유죄를 선고받은 경우는 거의 없다. 조사에 착수하는 경우가 드물게 있기는 하지만 그 절차는 비밀리에 진행된다. 선고는 매우 가벼우며 감옥에 가는 경찰은 거의 없다.

국제앰네스티가 분석한 공식적인 통계에 따르면 6개 군사법원 중 하나인 산티아고 제2 군사법원의 경우 2005년, 2008년, 2011년, 2014년에 신고된 시위대 인권침해 사건 4,551건 중 단 0.3%인 14건만이 형사 기소됐다.

가벼운 처벌

16세 소년 마누엘 구티에레즈는 2011년 8월 산티아고데칠레에서 가슴에 총을 맞고 사망했다. 그는 그날 밤 집에 가던 길에 경찰과 시위대간 마찰이 폭력적인 양상으로 번진 현장을 목격했을 뿐이었다. 정부는 경찰이 마누엘에게 총을 쏜 사실을 즉시 부인하고, 이 지역 청소년 범죄조직간의 충돌에 휘말린 것뿐이라고 주장했다.

마누엘이 병원으로 이송된 후 경찰관 한 명이 체포됐다. 마누엘이 부상으로 목숨을 잃은 지 5일이 지난 후에야 사건의 담당 검사는 자신의 소관이 아니라며 사건자료를 군사법원에 넘겼다. 2014년 5월, 군사법원은 피고 경찰이 마누엘에게 총을 쏜 것과 다른 젊은이를 다치게 한 데 책임이 있다고 판결하고 피고에게 징역 3년 61일형을 선고했지만, 얼마 지나지 않아 가택연금으로 형 집행을 대체할 수 있도록 했다. 이 경찰관은 항소 끝에 교도소에 가지 않고 461일간의 가택연금으로 감형됐다.

또다른 사건의 경우 사진기자 빅토르 살라스는 2008년 5월에 발파라이소에서 시위 현장을 취재하다 경찰관에게 맞아 오른쪽 시력을 거의 잃었다.

그로부터 약 4년 후인 2012년 1월에 군사법원은 경찰관에게 “심각한 부상을 초래한 불필요한 폭력 행사”로 징역 541일을 선고했다. 1년 후, 군사항소법원은 피고에게 전과가 없다며 징역 300일로 감형했고, 해당 경찰관은 곧 복직했다. 그 이후로 빅토르 살라스는 시력 손상으로 수입원을 잃은 것에 대해 배상받고자 투쟁하고 있다.

Chile: Two-tier justice system allows police to get away with human rights violations

Chile’s outrageous two-tier justice system is allowing police officers to beat, ill-treat and in some cases even kill peaceful demonstrators and other individuals and only face a miniscule sanction at best, said Amnesty International in a new report today.

I didn’t know there were two kinds of justice: Military jurisdiction and police brutality in Chile reveals that Chile’s military courts, which deal with cases of human rights violations committed by members of the security forces, regularly fail to adequately investigate and prosecute officers that are suspected of having committed a crime. Trials in these courts usually lack the most basic levels of independence and impartiality.

“Chile’s military courts should not be allowed to investigate, prosecute and punish members of its own ranks – that is simply a no-brainer. It is akin to courts allowing criminals to be judged by their own families,” said Ana Piquer, Director at Amnesty International Chile.

“This utterly absurd system has prevented many Chileans from accessing justice for far too long. It is time for the government and Congress to give this issue the importance it deserves, and send the message that they are on the right side of the law by stopping military courts from dealing with cases of human rights violations.”

Protests across Chile have intensified in recent years and so has the level of police violence against demonstrators. Amnesty International has recorded cases in which police officers beat or indiscriminately used tear gas and water cannons against protesters. Several people, including peaceful protesters and bystanders, have been injured, while some have been killed in the context of peaceful protests.

Brutal statistics

Military tribunals have rarely convicted security officers suspected of committing human rights violations. In the rare occasions when an investigation is actually opened, the process is handled behind closed doors, sentences are notoriously light and officers are seldom sent to prison.

According to official statistics analyzed by Amnesty International, in one of the six military courts in the country (the Santiago Second Military Court), only 0.3% of the reported cases of abuses against demonstrators in 2005, 2008, 2011 and 2014 were subject to criminal proceedings (14 out of 4,551).

Getting off lightly

Manuel Gutiérrez, 16, died of a gunshot wound to his chest in August 2011 in Santiago de Chile. He was on his way home watching a protest when clashes between demonstrators and the police taking place that night turned violent. The authorities immediately denied that a police officer was responsible for the shooting that killed Manuel and claimed instead that Manuel was got caught up in a fight between rival local youth gangs.

After Manuel was taken to hospital, a member of the police was arrested. Five days after the young man died from his injury, the prosecutor dealing with the case sent the file to the military courts, arguing she did not have the remit to pursue it. In May 2014, the military tribunal found the officer guilty of firing the gun that killed Manuel and hurt another young man. The tribunal initially sentenced the officer to three years and 61 days in prison, but later allowed him to serve the sentence under house arrest. After a further appeal, his sentence was reduced, to 461 days without having set foot in prison.

In a separate case, photojournalist Víctor Salas nearly lost the sight in his right eye after he was beaten by a police officer while covering a demonstration in the city of Valparaíso in May 2008.

Nearly four years later, in January 2012, a military tribunal sentenced the officer to 541 days in prison on charges of “unnecessary violence that caused grave injuries” (violencias innecesarias causando lesiones graves). A year later, an appeal military court reduced the sentence to 300 days in prison because the officer did not have any previous criminal record. He was later reinstated in his position. Since then, Víctor Salas has been fighting for compensation for his loss of income as a result of his injuries.

“Relying on military courts that seem only to pay lip service to justice means Chile’s security forces are getting away with serious crimes. This utter lack of justice, coupled with the growing number of cases of police abuses against peaceful demonstrators, is a recipe for disaster,” said Ana Piquer, Director at Amnesty International Chile.

“Police officers seem to be fully aware that beating and shooting civilians will have few or no consequences.”

Congress is yet to debate a draft law that would give civilian courts jurisdiction over cases of human rights violations committed by members of the armed forces and the police.

Amnesty International is calling on the Belgian authorities to conduct a prompt and thorough investigation so that those responsible for these acts are brought to justice.

Russia: Moscow authorities stonewall attempts to resolve office closure

While yesterday’s surprise sealing of Amnesty International’s long-term office by Moscow city authorities will hamper day-to-day work, its staff will continue to stand up against human rights violations and abuses committed in Russia and abroad, the organization said.

Attempts to resolve the issue have so far been stonewalled by municipal authorities, who have falsely claimed that Amnesty International was in arrears on its rent, and terminated the organization’s lease in a clear abuse of process.

“If the authorities remain unwilling to solve this issue, it will soon start to look ominously like a deliberate move to obstruct our work to defend human rights in Russia. It is becoming increasingly difficult not to see this incident through the prism of the wider crackdown on Russian civil society,” said John Dalhuisen, Amnesty International’s Europe and Central Asia Director.

“We will continue to attempt to get to the truth of why this happened and resolve the issue with the relevant authorities so we can continue our crucial and legitimate work. This is not being made any easier by the silence of the Moscow City authorities.”

On the morning of 2 November, Amnesty International’s Moscow-based staff arrived at their office to discover the locks had been changed, the electricity had been cut off, and the door had been sealed shut with a notice from Moscow’s municipal property authority. The organization received no prior warning and no explanation for the closure.

Later in the day, the municipal property authority – which has leased the property to Amnesty International for more than 20 years – issued a statement to journalists, alleging that the organization had failed to pay its rent.

This assertion is demonstrably false. The organization has documents proving the rent has been paid, up to and including October this year. This was acknowledged orally this morning by an official in the finance section of the State Property Department of the Moscow City Administration, who said that this could not be confirmed in writing as Amnesty International was no longer formally a tenant. Attempts to reach senior officials with the department have been unsuccessful.

“Changing our locks and turning off our lights has undoubtedly come as a setback, but we will not be cowed into silence or deterred from standing up for human rights in Russia,” said John Dalhuisen.

나르게스는 인권 활동으로 수감될 것이 아니라 찬사를 받아야 할 양심수다. 그가 석방되는 날까지 우리는 투쟁을 계속할 것이다.


전세계의 수많은 훌륭한 인권활동가들 잔혹한 불의와 억압의 힘에 가로막혀 있으며, 위에서 소개한 네 명은 그 중 일부에 지나지 않는다.

대절 버스 내부에 공구상자에 담긴 상태로 설치된 폭탄은 원격으로 조종되는 기폭 장치를 통해 폭발했으며, 이 버스에는 마르단에서 시내로 출근하던 공무원들이 타고 있었던 것으로 알려졌다. 아직 이번 공격이 자신들의 소행이라고 주장하는 개인이나 단체는 없다.

파키스탄 정부는 북부 지역에서 군사공격을 감행하고, ‘국가행동계획’을 시행하는 등 테러에 대응하고 있지만 여전히 각지에서는 무차별 공격이 계속되고 있다.

이 지역에서는 최근 이와 비슷한 테러 공격이 잇따른 바 있다. 지난 1월에는 차르사다의 바차칸 대학교에 총을 든 괴한들이 난입하면서 22명이 숨진 한편, 3월 8일에는 페샤와르에서 30킬로미터 떨어진 차르사다 시내의 한 지방법원에서 자살 테러가 벌어져 18명이 숨지고 31명이 다쳤다. 이슬람 극단주의 단체 파키스탄탈레반(TTP)의 분파조직 자마툴 아흐라르(Jamatul Ahrar)가 법원 테러는 자신들의 소행이라고 밝혔으나, 바차칸 대학을 공격한 주범에 대해서는 보도가 엇갈렸다.

Pakistan: Government must deliver justice for victims of Peshawar bus bombing

The Pakistani authorities must promptly, thoroughly and effectively investigate this morning’s bomb attack on a bus which killed at least 15 people and severely injured 25 in Peshawar, and bring to justice anyone suspected to be responsible in fair trials, said Amnesty International.

“There can be no justification for intentionally targeting civilians or carrying out indiscriminate attacks. Those responsible for the bombing have shown contempt for the right to life and fundamental principles of humanity,” said Champa Patel, Director of Amnesty International’s South Asia Regional Office.

Media reports indicate that explosive material was packed into a toolbox and detonated remotely inside the privately hired bus, which was carrying government employees from Mardan to the provincial capital. No individual or group has yet claimed responsibility for the blast.

“As well as providing victims and their families with access to justice or reparations, the Pakistani authorities must now ensure that their response to this atrocity is compliant with international human rights law. It is abundantly clear that putting people to death in the name of ‘fighting terrorism’ has done nothing to protect civilians from these kinds of attacks,” said Champa Patel.

Indiscriminate attacks continue in several regions of Pakistan, despite a military offensive in the north of the country and the implementation of the ‘National Action Plan’ to counter terrorism.

There have also been other attacks recently in the same region. In January, 22 people were killed when gunmen stormed Charsadda’s Bacha Khan University. On 8 March, 18 people were killed and 31 injured in the town of Charsadda, 30 kilometres from Peshawar, after a suicide attack outside the district court. Jamatul Ahrar, a splinter group of the Tehreek-i-Taliban Pakistan (TTP) claimed responsibility for the attack on the court, while there were conflicting reports about who was responsible for the attack on Bacha Khan University.

일본에서 18일 또 다시 남성 2명을 처형한 가운데, 일본 정부의 비난 받아 마땅한 사형제도 사용은 중단될 기미가 보이지 않는다고 국제앰네스티가 밝혔다. 아베 신조 총리 내각이 들어선 이후로 일본에서 사형이 집행된 것은 이번으로 총 14건이 된다.

18일 이른 아침 도쿄 교도소에서 츠다 스미토시(63)가 교수형에 처해졌다. 일본에서 참심재판을 통해 사형이 선고된 사형수 중 처음으로 형이 집행된 츠다는 2011년 이웃 주민 3명을 살해한 혐의로 유죄를 선고받았다. 같은 날 일본 북동부 센다이 교도소에서 처형된 와카바야시 카즈유키(39)는 2007년 2명의 사망자를 낸 강도와 폭행 사건으로 사형이 선고됐다.

로젠 라이프(Roseann Rife) 국제앰네스티 동남아시아 지역 조사국장은 “사람을 죽음에 몰아넣고야 말겠다는 일본 정부의 의지는 오싹할 수준이며, 더 많은 생명이 희생되기 전에 당장 이를 중단해야 한다. 사형은 범죄를 해결할 수 있는 정의나 해답이 아니며, 생명을 존중하지 않는 잔인한 처벌 형태”라며 “일본 정부는 사형제도 폐지를 향한 첫걸음으로 즉시 사형집행에 관한 유예를 공식 선포해야 한다”고 말했다.

일본은 사형제도에 있어서는 시대를 역행하며, 세계에서 사형집행을 강행하고 있는 소수의 국가들 중 하나에 속하기도 한다. 2014년 현재 22개국만이 사형을 계속 집행하고 있는 반면 2015년 11월 현재 법적 또는 실질적 사형폐지국인 국가는 총 140개국이다.

몽골의 경우 지난 12월 초, 몽골에서 사형을 폐지한다는 내용의 법안이 의회를 통과해 2016년 9월 발효될 예정이다.

로젠 라이프 조사국장은 “일본 정치인들이 몽골의 엘벡도르지 대통령과 같이 나서서 리더십을 발휘하지 않는다면 일본은 계속해서 시대에 뒤처질 수밖에 없다”며 “전 세계, 특히 동아시아 지역에서 일본은 사형제도를 계속 사용하며 잘못된 주장을 고집하고 있다”고 말했다.

배경
일본의 사형집행은 비밀리에 이루어져, 보통 사형수는 불과 몇 시간 전에 고지를 받으며 일부 경우에는 전혀 사전 고지가 없을 수도 있다. 사형수 가족이나 변호사는 형이 집행된 이후에나 연락을 받는 경우가 대부분이다.

일본에 사형수에 대한 적절한 법적 안전조치가 존재하지 않는다는 점은 유엔 관련 전문가들이 널리 비판한 문제다.
피고인은 적절한 법적 자문을 구할 수 없으며, 사형이 선고될 수 있는 사건이라면 의무적으로 거쳐야 할 필수 항소 절차도 없다. 정신적, 지적 장애가 있는 사람들도 형이 집행되거나 사형수로 복역하고 있는 것으로 알려지고 있다.

국제앰네스티는 범죄의 성격이나 정황, 가해자의 유, 무죄 여부 또는 그 외 특성, 국가의 사형집행 방식에 상관없이 모든 경우에 대해 사형을 반대한다. 사형은 생명권을 침해하는 것이며, 극도로 잔인하고 비인도적이며 굴욕적인 형벌이다.

Japan: Two men hanged as disgraceful executions continue

The Japanese authorities’ reprehensible use of the death penalty shows no sign of letting up as another two men were executed today, taking the total number of executions to 14 under the government of Prime Minister Shinzo Abe, Amnesty International said.
Sumitoshi Tsuda, 63, was hanged in the early hours of Friday morning at Tokyo detention centre, the first execution of a person sentenced to death in a lay judge trial. He was convicted in 2011 of killing three of his neighbours. Kazuyuki Wakabayashi, 39, was executed at Sendai detention centre in north-east Japan. He was sentenced to death in 2007 for robbery and violence which left two people dead.
“The Japanese authorities’ willingness to put people to death is chilling and must end now before more lives are lost. The death penalty is not justice or an answer to tackling crime, it is a cruel form of punishment that flies in the face of respect for life,” said Roseann Rife, East Asia Research Director at Amnesty International.

“Japan should immediately introduce an official moratorium on executions as a first step towards abolition of the death penalty.”
Japan is on the wrong side of history when it comes to the death penalty and among a small minority of countries around the world that continue to execute people. In 2014, only 22 countries carried out executions while, as at November 2015, 140 countries globally have abolished the death penalty in law or practice.
The Mongolian parliament passed legislation in early December that will abolish the death penalty in the country when it comes into effect in September 2016.
“If the politicians of Japan don’t step up and show some leadership, as President Elbegdorj of Mongolia did, Japan will continue to fall behind the times,” said Roseann Rife.

“Japan’s continued use of the death penalty makes it stand out for all the wrong reasons – across the world, and increasingly also in the East Asia region.”
Background
Executions in Japan are shrouded in secrecy with prisoners typically given only a few hours’ notice, but some may be given no warning at all. Their families and lawyers are usually notified about the execution only after it has taken place.
The lack of adequate legal safeguards for death row inmates in Japan has been widely criticized by UN experts.
This includes defendants being denied adequate legal counsel and a lack of a mandatory appeal process for capital cases. Several prisoners with mental and intellectual disabilities are also known to have been executed or remain on death row.
Amnesty International opposes the death penalty in all cases without exception, regardless of the nature or circumstances of the crime, the guilt, innocence or other characteristics of the offender or the method used by the state to carry out the execution. The death penalty violates the right to life and is the ultimate cruel, inhuman and degrading punishment.
