2011년 3월 15일 시리아 반정부시위가 시작된 이후, 지난 5년간 전쟁범죄와 반인도적 범죄 등 끔찍한 인권침해가 시리아를 휩쓸며 수많은 사람이 고통 속에 신음하게 되었다고 국제앰네스티가 밝혔다.

살릴 셰티(Salil Shetty) 국제앰네스티 사무총장은 “시리아 시위가 처음 시작된 이후로 지난 5년간의 세월은 엄청난 규모의 공포와 유혈사태로 얼룩져 왔다. 시리아 정부군이 평화적인 시위대를 향해 처음 발포했던 순간부터 민간인의 고통과 잔혹함은 시리아 사태를 비극적으로 상징하게 되었다”고 말했다.

또한 “시리아군을 비롯해 자칭 ‘이슬람국가(IS)’와 같은 비정부 무장단체는 인권과 전쟁법은 물론, 자신들로 인해 목숨을 잃고 상처 입거나, 피난을 떠나고, 포위당한 지역에서 굶주리는 민간인들에 대해 싸늘한 무관심으로 일관하고 있다. 시리아군은 민간 지역에 무자비한 ‘드럼통 폭탄(barrel bomb)’ 공격을 가하고, 대규모의 납치 활동과 산업 규모의 조직적 고문을 자행하는 등 끔찍한 전략을 사용하며 반인도적 범죄를 버젓이 저질렀다. 특히 IS와 같은 일부 무장단체는 세계 언론에 주목받는 점을 이용해 시리아인과 외국인을 막론한 민간인을 납치하고 약식 처형하는 등 자신들이 저지른 전쟁범죄를 아랑곳 하지 않고 홍보하고 있다”고 말했다.

다음은 지난 5년간 시리아 사태가 최악으로 치닫게 된 다섯 가지 결정적 순간을 정리한 것이다.

  • 반정부 시위가 시작된 지 3일이 지난 2011년 3월 18일, 남부 데라아(Dera’a)에서 반정부 성향의 그래피티를 그렸다는 이유로 체포, 고문당한 소년들의 석방을 요구하던 평화적 시위대를 향해 시리아군이 실탄을 발사했다. 이날 이후 시위는 유혈 사태로 번졌고, 이날의 발포는 정부군이 평화적인 시위를 탄압하는 데 치명적 무력을 광범위하게 사용하며 결국 전면적인 무장 분쟁으로까지 이어지게 되는 전조였다.
  • 2013년 8월 다마스쿠스 동부 고타(Ghouta)에서 화학무기 공격으로 고통스러워하는 주민의 모습을 담은 영상이 공개되면서 세계는 충격에 휩싸였고, 시리아에서 자행되고 있는 끔찍하고 잔혹한 인권침해에 대해 경종을 울렸다. 그러나 안타깝게도 이는 빙산의 일각에 불과했다. 화학무기 외에도 확산탄과 같은 금지 무기를 사용해 공격하거나 정기적인 미사일, 박격포 폭격을 가하면서 시리아 전역에서는 매일같이 점점 더 많은 사람들 목숨을 잃고 있다. 그런데도 유엔 안전보장이사회는 시리아 상황을 국제형사재판소(ICC) 검찰부에 회부하는 데 합의하지 못했고, 특히 러시아와 중국은 거부권을 행사해 민간인 보호 결의안 통과를 여러 차례 저지하는 등 수년째 제대로 대처하지 못하고 있다.
  • 2014년 1월 다마스쿠스 외곽 야르무크(Yarmouk)에서 봉쇄된 지역에 갇힌 주민들이 구호물품을 받기 위해 길게 늘어선 충격적인 모습은 시리아 전역의 봉쇄된 지역에서 식량과 의료 지원이 부족해 죽어가는 수천 명의 안타까운 현실을 알리는 계기가 되었다. 야르무크 외에도 모아다미야(Moadamiya), 동부 고타, 마다야(Madaya), 알포아(al-Fouaa) 등지를 봉쇄하며 정부군과 무장단체는 주민들의 굶주림을 전쟁 무기로 사용했다. 현재 시리아 15개 지역에서 40만 명 이상이 봉쇄지역에 갇혀 있다. 최근 합의된 휴전 협정의 일환으로 봉쇄지역에 한정된 수준의 구호물품이 전달되고 있지만, 여전히 이곳 주민들은 아사할 위험에 처해 있으며 제한 없는 인도적 지원이 절실히 필요한 상황이다.
  • 2014년 1월, 시리아군 출신 제보자가 비밀리에 촬영한 고문당하고, 굶주리고 불탄 시신들의 섬뜩한 사진이 공개됐다. ‘카이사르 고문 사진’으로 알려진 이 사진들은 시리아의 수용소 내에서 제도적인 고문과 비사법적 처형이 이루어지고 있다는 또 하나의 강력한 증거로, 바사르 알 아사드(Bashar al-Assad) 대통령 정권이 반대자를 무자비한 수법으로 처벌하고 있음을 전 세계에 알렸다. 아직도 수만 명이 시리아 보안정보당국에 체포된 이후 행방이 묘연한 상태다.
  • 2015년 9월 시리아 정부를 지원하는 러시아의 첫 공습이 시작됐다. 표면상으로는 IS를 노린 공격이었지만 대부분 반군 점령 지역이 폭격을 당했다. 러시아의 참전으로 공습이 더욱 격화되었고, 특히 시리아 북부 지역에서는 전쟁범죄로 추정되는 공격까지 가해지며 민간인 수백 명이 목숨을 잃었다. 최근에는 알레포 인근에서 러시아와 시리아 전투기가 전략적으로 병원을 폭격하며 명백한 국제법 위반행위를 저질렀다.

From hope to horror: Five years of crisis in Syria

A horrifying catalogue of human rights abuses including war crimes and crimes against humanity have overwhelmed Syria over the past five years causing human suffering on a vast scale, said Amnesty International, marking the five-year anniversary of the start of anti-government protests in the country on 15 March 2011.

“The five years since the uprising in Syria first began have been marred by horror and bloodshed on a colossal scale. From the moment that Syrian government forces first opened fire on peaceful protesters, brutality and civilian suffering have been the tragic hallmarks of this crisis,” said Salil Shetty, Secretary General of Amnesty International.

“Government forces and non-state armed groups, including the one calling itself the Islamic State (IS), have displayed a callous indifference to human rights and the laws of war as well as the civilians they have killed, maimed, displaced and, in some areas under siege, starved.

“Government forces have brazenly committed crimes against humanity through the use of appalling strategies such as relentless barrel bomb attacks on civilian areas, a campaign of mass disappearances and systematic, industrial-scale torture. Some armed groups, particularly IS, have exploited the international media spotlight to cynically broadcast their own war crimes, such as the abduction and summary killing of Syrian and foreign civilians.”

Here is a reminder of five key moments that saw the crisis in Syria go from bad to worse over the past five years:

On 18 March 2011, three days after the start of the uprising Syrian government forces opened fire on peaceful protesters in the southern city of Dera’a, using live ammunition against demonstrators demanding the release of boys arrested and tortured for anti-government graffiti. This marked a bloody turning point, and was a precursor to the widespread use of lethal force by government forces to suppress peaceful protests, which eventually evolved into a full-blown armed conflict.

Video footage showing civilians suffering from the effects of a chemical weapons attack in Eastern Ghouta, east of Damascus in August 2013 shocked the world, acting as a wake-up call to the horrific and cruel nature of the abuses being committed in Syria. Sadly, this was just the tip of the iceberg. Across Syria, civilians continued to be killed on a daily basis often in far greater numbers in attacks using both other banned weapons such as cluster munitions and regular bombs, missiles and mortars. However, for years the UN Security Council dragged its feet, with member states failing to unite to refer the situation in Syria to the Prosecutor of the International Criminal Court and Russia and China in particular blocking several resolutions on the protection of civilians using veto powers.

The surreal images of crowds of besieged civilians queuing for aid parcels in Yarmouk on the outskirts of Damascus in January 2014 brought to life the tragic reality that thousands of people trapped under siege across Syria were dying from lack of food and medical care. Beyond Yarmouk starvation has been used as a weapon of war by both government forces and armed groups in areas such as Moadamiya, Eastern Ghouta, Madaya and al-Fouaa. Today more than 400,000 people are under siege in 15 locations across Syria. Despite limited deliveries of aid to besieged areas as part of the ceasefire agreed in recent weeks, civilians are still at risk of starving to death and in desperate need of unfettered humanitarian aid.

Harrowing photographs showing tortured, starved and burnt bodies, known as the “Caesar” torture photos, were smuggled out of Syria by a military defector and published in January 2014. These provided the strongest evidence yet of systematic torture and extrajudicial executions taking place inside government detention centres, opening the world’s eyes to the ruthless tactics used to punish those who dare to oppose the government of President Bashar al-Assad. Tens of thousands remain missing after being arrested by one of Syria’s various security and intelligence forces.

Russia began its first air strikes in support of the Syrian government in September 2015, ostensibly targeting IS but mostly hitting areas under the control of armed opposition groups. Russia’s entry into the fray has led to intensive aerial bombardments, particularly in northern Syria, that have killed hundreds of civilians, including in attacks that appear to be war crimes. Most recently an offensive in the vicinity of Aleppo has seen Russian and Syrian warplanes bomb hospitals as part of its military strategy in flagrant violation of international law.

국제앰네스티는 2016년 6월 발표한 보고서를 통해, 백색증이 있는 사람이 신체부위를 노리는 사람들에게 ‘짐승처럼 쫓기며 살해당하는’ 실태를 공개했다. 백색증이 있는 사람의 뼈는 말라위와 모잠비크의 전통 의술사가 부와 행운을 부르는 주문 및 마법약을 만들고자 구입하는 것으로 알려져 있다.

배경정보

말라위에서 2014년 11월 이후 지금까지 최소 20명 이상의 백색증이 있는 사람이 피살되었으며, 그 중 두 사건은 올해 벌어졌다.
말라위 경찰청에 따르면 2014년 11월 이후 지금까지 신고된 백색증이 있는 사람 관련 범죄는 최소 117건이다.
*백색증이 있는 사람은 행운을 부르는 주술적인 힘이 있다는 믿음 때문에 이들의 신체부위를 노리는 사람들에게 표적이 된다.
말라위에는 약 7천명에서 1만 명의 백색증이 있는 사람들이 살고 있는 것으로 추정된다.

백색증이 있는 사람에 대한 습격 사건이 해결되지 않는다면, 이처럼 끔찍한 범죄의 가해 용의자들이 활개를 치게 된다.

2017년 살인 사건

2016년 6월부터 12월까지 6개월 정도 주춤하던 백색증이 있는 사람 대상 살인 및 습격 사건은 2017년 1월부터 다시 급증하기 시작했다.

2017년 2월 28일, 31세 여성이 머시 자이나부 반다(Mercy Zainabu Banda)는 릴롱궤에서 손과 오른쪽 가슴, 머리카락이 없는 시신으로 발견되었다.

2017년 1월 10일에는 19세 마달리초 펜술로(Madalitso Pensulo)가 오후 다과 초대를 받고 티욜로 지역 믈론다 마을에 위치한 친구 집으로 향하던 중 피살되었다. 행인이 비명소리를 들었지만 경찰이 현장에 도착했을 때 그는 이미 숨진 뒤였다.

 

그 외의 공격

길거리 습격은 물론 집의 벽을 부시고 침입해 납치 시도

가장 최근 벌어진 납치 사건은 5월 28일, 9세 소년 마예소 아이작(Mayeso Isaac)이 괴한 10명에게 끌려간 것이었다. 아이작이 친척의 초대를 받고 이웃나라 모잠비크를 방문하던 길에 벌어진 사건이었다. 말라위와 모잠비크 양국 정부는 이 소년의 실종 사건에 대해 신속하고 효과적인 수사를 보장할 의무가 있다.

2017년 3월 9일, 릴롱궤의 자택에서 잠을 자던 길버트 다이르(Gilbert Daire)는 남성 4명이 집의 벽을 드릴로 뚫고 침입한 공격에서 살아남았다. 이들 남성은 다이르의 이웃들이 개입하자 현장에서 달아났다. 용의자 중 한 명은 마을 주민들의 신고로 체포되었지만, 이후 법정에서 무죄 판결을 받았다.

“돈이 필요해서” 엄마와 함께 낮잠 자는 2살 아이 납치 시도

4월에는 은치시 콜웨 마을에서 두 살 짜리 미셰크 샘슨(Misheck Samson)이 어머니 옆에서 잠을 자던 중 납치를 당할 뻔 했다. 이 아기를 납치하려 모의한 3명의 남성이 체포됐다. 그들은 돈이 필요해서 납치를 시도했다고 경찰에 자백했다.

2월 17일, 36세 여성 에밀리 쿨리운데(Emily Kuliunde)는 도와에서 납치 당할 위기를 가까스로 면했다. 마을 주민들이 용의자들을 붙잡아 경찰에 넘긴 것이다. 용의자들은 여전히 경찰에 구속되어 있다.

아버지가 팔아버리겠다 협박하는 경우도

또다른 사례로, 2017년 2월 1일 모잠비크 국경 인근의 은체우 지역에 사는 아모스 제무스(Amos Jemus)는 아버지에게서 자신을 팔아 넘기겠다는 협박을 당했다고 한다.

 

형사정의의 실패

말라위에서 경찰은 범죄 가해 용의자들을 직접 기소하고 이들에게 유죄 판결을 내릴 수 있는 권한이 있지만, 자원이 부족해 관련 교육이 거의 이루어지지 않는다. 그 결과 대부분의 사건이 형편없이 처리되거나, 용의자에게 유죄가 선고되는 경우도 거의 없다. 백색증이 있는 사람에 대한 범죄, 특히 살인 사건 대부분이 재정 부족으로 용의자를 소송하는 경비 지원이 어려워서 재판에 이르지 못한다.

재판이 이루어지게 되더라도, 수사과정이 허술하고 인정될 만한 증거가 부족하기 때문에 용의자가 석방되는 경우가 잦다.

살인을 저지할 유일한 방법은 현행법이 효과적으로 시행되도록 보장하고, 기소 과정과 정부 부서간 협력이 효율적으로 이루어지게 하는 것이다.

“백색증이 있는 사람에 대한 극악무도한 범죄가 이처럼 증가하는 것은 범죄조직 사이에 잡히지 않을 것이라는 자신감이 높아지고 있다는 것을 보여준다. 이들 조직은 말라위의 형사사법제도가 제 기능을 하지 못하는 상황을 이용하고 있다. 정부는 이러한 공격을 완전히 뿌리뽑기 위해 결단력 있는 조치를 취해야 한다”고 말했다.

파키스탄 정부는 소위 ‘명예 살인’을 비롯한 여성 폭력을 처벌하지 않는 관행을 중단해야 할 것이라고 국제앰네스티가 밝혔다.

참파 파텔(Champa Patel) 국제앰네스티 동남아시아국장은 “콴딜 발로흐(Qandeel Baloch)가 자신의 형제에게 살해당하는 참담한 사건이 벌어진 것은 가족의 명예를 지키기 위해서라는 명목으로 정당화되는 범죄로부터 여성과 남성 모두를 보호하기 위해 시급히 행동해야 한다는 것을 보여준다.”고 말했다.

국제앰네스티는 펀자브(Punjab) 주정부가 콴딜 발로흐 살인 사건을 반국가범죄로 지정하고, 가족들로부터 아들의 선처를 호소할 법적 권리를 박탈하기로 한 결정을 환영한다.

파텔 국장은 “이는 예외적인 결정이 아니라 원칙이 되어야 한다. 파키스탄은 소위 ‘명예 살인’ 행위에 대한 면죄부를 없애기 위해, 이러한 살인을 저지를 경우 선처를 요구하지 못하도록 하고, 처벌 방식을 사형에 의존하지 않는 법안을 제정하는 등의 구조적 개혁에 임해야 한다”고 덧붙였다.

콴딜 발로흐의 오빠는 7월 15일 잠자던 콴딜의 목을 졸라 살해했다고 자백했으며, 이는 곧 전 세계적인 분노를 불러일으켰다.

파키스탄 관습법에 따라 살인 가해자는 피해자 가족에게 ‘다이얏(diyat)’ 또는 소위 ‘피 묻은 돈(blood money)’으로 불리는 보상금을 지급하면 혐의를 없앨 수 있다. ‘명예 살인’과 같이 피해자의 가족이 가해자일 경우에는 가족들에게 사면을 받고 수감 등의 처벌을 받지 않을 수 있다.

참파 파텔 국장은 “소위 ‘명예살인’의 가해자들을 처벌하지 않으면서, 파키스탄 정부는 범죄 피해자들에 대한 국가의 의무를 망각하고 불처벌 관행이 다시 만연하도록 내버려두고 있다. 이 때문에 파키스탄 전역 각계각층의 여성 수천여 명이 비슷한 범죄로 희생될 위험에 처했다”고 말했다.

파키스탄 인권위원회는 최근 발표한 연례보고서를 통해, 지난해 파키스탄에서 ‘명예’를 이유로 친족에게 살해된 여성의 수는 약 1,100명에 이른다고 밝혔다. 2014년에는 1,000명, 2013년에는 869명이었다.

국제법상 문화, 관습, 종교, 전통 또는 ‘명예’는 절대 여성에 대한 모든 폭력 행위를 정당화하는 근거가 될 수 없다고 명시하고 있다.

파텔 국장은 “어떤 상황이라도 여성을 살해하는 것으로 얻을 수 있는 명예는 없다. 정부는 여성이 보복이나 폭력을 당할 우려 없이 자신의 삶을 스스로 결정할 수 있도록 여성의 생명권과 평등권, 존엄성을 존중하고 보호해야 한다” 고 말했다.

Pakistan: End impunity for so-called ‘honour’ crimes

The Pakistani authorities must end impunity for so-called ‘honour’ killings and other violence against women, Amnesty International said today.

“The tragic killing of Qandeel Baloch, at the hands of her brother, has highlighted the need for urgent action to protect women and men from crimes that are justified as a defence of family honour,” said Champa Patel, Amnesty International’s South Asia Director.

Amnesty International welcomes the decision of the Punjab authorities to register Qandeel Baloch’s murder as a crime against the state, and refuse her family the legal right to grant their son clemency.

“This needs to become the rule rather than the exception. Pakistan needs to undertake structural reforms that end impunity for so-called ‘honour’ killings, including by passing legislation that removes the option of clemency for such killings without resorting to the death penalty as a punishment,” said Champa Patel.

Qandeel Baloch’s brother has confessed to strangling his sister to death during her sleep on 15 July, triggering global outrage.

Under Pakistan’s current laws, the family of a murder victim may pardon the perpetrator, including on payment of compensation known as ‘diyat’ or ‘blood money’. In cases of so-called honour killings, where members of the victim’s own family are responsible for the crime, the perpetrator may be pardoned by their own family and not face imprisonment or any other punishments.

“By failing to hold perpetrators of so-called ‘honour’ killings accountable for their crimes, the Pakistani state has been forfeiting its duty to the victims and letting a climate of impunity take reign. This leaves many thousands of people – mostly women and girls – from all walks of life and across the country at risk of falling victim to these crimes,” said Champa Patel.

In its latest annual report, the Human Rights Commission of Pakistan said that nearly 1,100 women were killed in Pakistan last year by relatives on so-called ‘honour’ grounds. In 2014, the figure was 1,000, and in 2013, it was 869.

Under international law, culture, custom, religion, tradition or so-called ‘honour’ cannot ever be considered a justification for any act of violence against women.

“There is no honour in killing women under any circumstances. The state must respect and protect women’s right to life, equality, and dignity so that they can make life decisions of their own without fear of retribution or violence,” said Champa Patel.

Background

The Pakistani parliament is currently debating a bill that, if passed, would lead to the removal of the option of clemency for so-called ‘honour’ crimes. While Amnesty International calls for an end to impunity for such crimes, it opposes the death penalty as a possible punishment.

Amnesty International opposes the death penalty in all cases without exception, regardless of the nature or circumstances of the crime; guilt, innocence or other characteristics of the individual; or the method used by the state to carry out the execution.

유엔 범죄예방 형사사법위원회는 22일 오스트리아 빈에서 회의를 열고 60년 전 마련되었던 수감자 대우에 관한 국제기준을 핵심적으로 개정한 신규 기준을 채택했다. 이로써 수감자 인권 존중에 새로운 시대가 시작되었음을 알리게 되었다고 국제앰네스티가 밝혔다.

‘만델라 원칙’ 이라고 명명된 이 신규 기준은 지난 1955년 제정된 ‘수감자 처우에 관한 최소한의 유엔 기준’을 대대적으로 개정하고 추가 조항을 신설한 것으로, 올해 말 열리게 될 유엔 총회에서 채택될 것으로 예상된다.

빈 회의에 참석한 유발 긴바르(Yuval Ginbar) 국제앰네스티 법률고문은 “‘만델라 원칙’은 수감자의 인권이 완전히 존중받는 새 시대의 시작을 알리게 될 것”이라며 “전면 시행될 경우 구금은 고통과 굴욕뿐인 허송세월이 아니라 석방을 앞두고 자기계발에 활용할 수 있는 시간이 될 것이며, 이는 사회 전체에도 이익”이라고 말했다.

‘만델라 원칙’은 고문과 그 외의 잔인하고 비인도적이며 굴욕적인 대우 및 처벌을 절대 금지하는 등 기본적인 원칙의 범위가 더욱 확장되었다.

또한 의료진의 독립성을 보장하고, 15일 이상의 독방 구금을 금지하는 등 처벌 방법을 대폭 제한했다.

수감자들의 방, 신체 수색, 등록 및 기록 보존, 고문 및 그 외 부당대우로 인한 사망과 항의에 대한 조사, 특정 그룹의 요구조건, 각 교도소의 독립적 조사, 법정대리인의 권리 등의 사안에 대해서도 분명하고 구체적인 지시사항을 담고 있다.

국제앰네스티는 ‘수감자 처우에 관한 최소한의 유엔 기준’의 진보적인 개정을 위해 NGO, 학계와 함께 5년간 활발한 활동을 벌였다.

국제앰네스티는 모든 국가에 만델라 원칙을 숙지하고, 법과 정책 및 관행에 전면 도입할 것을 촉구한다.

‘Mandela Rules’ on prisoner treatment adopted in landmark revision of UN standards

The United Nations Commission on Crime Prevention and Criminal Justice adopted crucial revisions of 60-year-old international standards on treatment of prisoners at a meeting today in Vienna, which Amnesty International said could herald in a new era of respect for prisoners’ human rights.

The Mandela Rules include extensive revisions and additions to the UN’s Standard Minimum Rules for the Treatment of Prisoners, which date back to 1955. It is expected the UN General Assembly will adopt the new rules later this year.

The Mandela Rules could herald in a new era in which prisoners’ human rights are fully respected. If fully implemented, they would help turn imprisonment from a wasted time of suffering and humiliation into one used for personal development leading to release, to the benefit of society as a whole.

The Mandela Rules now contain an expanded section of basic principles, including the absolute prohibition of torture and other cruel, inhuman or degrading treatment or punishment.

The independence of healthcare staff is assured, and extensive restrictions are placed on disciplinary measures, including the prohibition of solitary confinement beyond 15 days.

Clear and detailed instructions are provided on issues such as cell and body searches, registration and record keeping, investigations into deaths and complaints of torture and other ill-treatment, the needs of specific groups, independent inspections of prisons, the right to legal representation and more.

Amnesty International joined a coalition of NGOs and academics which took an active part in the five-year process, working for a progressive redrafting of the Rules.

The organization calls on all states to study the Mandela Rules and implement them fully in law, policy and practice.

It is said that no one truly knows a nation until one has been inside its jails. A nation should not be judged by how it treats its highest citizens, but its lowest ones.

카메룬 북부에서 보코하람이 민간인 약 400명을 학살했고, 이에 대한 정부군의 과잉대응과 비인도적 수감 환경으로 수십여 명이 추가로 사망했다고 국제앰네스티가 16일 신규 보고서를 통해 밝혔다.

2015년 세 차례의 현지 조사를 바탕으로 한 보고서 <포화 속에 놓인 인권: 카메룬의 보코하람 항전에서 나타난 공격과 폭력>은 지난 2014년 1월 이후 보코하람에 사망한 민간인 수가 380명을 넘었다고 기록하고 있다.

카메룬 보안군은 이에 맞서 마을을 습격하고, 주택을 파괴하고, 민간인들을 살해하고, 1,000명이 넘는 의심 인물들을 구금했으며 심지어는 5세 어린이까지도 구금 대상에 포함되었다. 구금되어 있던 사람들 중 최소 25명 이상이 숨지는 등 그 과정에서 수 차례의 심각한 사건이 발생했지만 이에 대해 실질적인 조사는 이루어지지 않고 있다. 실종자 130여명 역시 여전히 행방을 알 수 없는 상태다.

알리운 틴(Alioune Tine) 국제앰네스티 서-중앙아프리카 국장은 “보코하람이 카메룬까지 영향을 미치면서 민간인들은 더 큰 위험에 놓이게 됐다. 보코하람은 무차별 학살과 납치를 저지르고 민간 건물을 파괴하거나 자살 폭탄 테러에 어린이를 동원하는 등의 전쟁범죄를 자행하며 민간인들에게 실로 막대한 공포와 고통을 안겼다”고 밝혔다.

또한 “그와 동시에 무엇보다 절실한 민간인 보호를 제공하는 과정에서 카메룬 보안군의 대응 역시 심각한 인권침해로 얼룩져 있다. 카메룬 보안군은 과도한 무력을 동원하거나 합법적인 절차 없이 민간인을 살해하고, 자의적 체포를 일삼았으며, 이렇게 구금된 사람들 대부분이 비인도적인 환경 속에 방치되어 수십 명이 사망에 이르기도 했다”고 말했다.

보코하람의 전쟁범죄

2014년 중반부터 보코하람은 카메룬 최북단 지역의 도시와 마을 수백여 곳을 공격해 민간인을 살해, 납치하고 가옥 수백여 채를 불태웠으며 가축 등을 약탈해 왔다.

2014년 10월 15일 국경지역 암치드 마을을 습격한 보코하람 단원들은 최소 30명 이상을 사살하거나 참수했다. 당시 목격자는 국제앰네스티에 “보코하람 전사가 이웃사람 최소 두 명 이상의 목을 잔인하게 베는 모습을 봤다”고 전했다.

2015년 4월 17일에는 100명이 넘는 보코하람 단원들이 비아 마을을 습격하고 어린이 2명을 포함해 민간인 16명을 살해했다.

당시 목격자는 보코하람이 150채가 넘는 집을 불태우던 모습을 전하며 “집집마다 들이닥쳐 사람들을 죽이고 모두 불태워 버렸다”고 말했다.

2015년 7월부터는 최소 13세에 불과한 어린 소녀들의 자살 폭탄 테러가 연이어 발생하며 70명 이상이 목숨을 잃었다. 2015년 7월 22일과 23일 마루아에서 발생한 3차례의 자살 폭탄 테러로 민간인 33명이 숨지고 100명 이상이 부상을 당했다.

보안군의 과잉 진압으로 인한 인권 침해

2014년 이후 카메룬 보안군은 보코하람을 지원한 것으로 의심되는 1,000여명을 체포하고 구금했다. 이들 대부분은 보안군의 ‘집단 심사’ 또는 기습적인 ‘봉쇄 수색 작전’으로 수십 명, 또는 수백 명이 함께 집단 검거된 사람들로, 마루아 교도소의 충격적인 환경 속에 수감되어 있다. 수용 인원에 비해 좁은 방과 불결한 환경, 부족한 의료 지원으로 2015년 3월부터 5월 사이에만 최소 40명 이상의 수감자가 사망에 이르렀다.

국제앰네스티가 2015년 5월 마루아 교도소를 방문했을 당시, 수돗물은 나오지 않았고 수감자는 1,200명이 넘는 반면 화장실은 20개도 채 되지 않았다. 같은 시기 교도소 내 환자를 수용한 병원을 찾은 국제앰네스티 조사관들은 심각한 영양실조 상태인 환자들이 불결한 방에서 생활하면서, 최소 3명은 반나체로, 한 명은 자신의 배설물을 뒤집어쓴 채 바닥에서 자고 있는 모습을 목격했다. 교도소 수용 역량을 향상시키기 위한 노력이 진행 중이지만 성과를 이루기까지는 아직 수 개월이 더 필요할 예정이다.

카메룬 보안군은 작전을 수행하는 과정에서 과도하거나 치명적인 무력을 동원했다. 2014년 12월 27일 맥딤, 두블레 마을에서는 보안군의 봉쇄 수색 작전으로 어린이를 포함해 최소 8명이 목숨을 잃었고 주택 70여곳 이상이 불태워졌다.

한 목격자는 국제앰네스티에 “군인들이 우리 집 안에서 총을 쐈다. 여동생과 동생의 7살 난 딸은 침대 밑에 숨어 있다가 총에 맞아 목숨을 잃었다. 동생은 머리 오른쪽, 조카는 목에 총을 맞았다”라고 전했다.

새롭게 공개된 위성사진은 이처럼 목격자 수십 명이 증언했던 보안군의 파괴 규모를 확인할 수 있다.

이 작전으로 보안군은 살인과 파괴를 자행했을 뿐 아니라 최소 200명 이상의 남성을 체포하기도 했다. 이렇게 체포된 사람들은 마루아의 헌병대로 이송되어 2개의 창고에 갇혔는데, 이곳에서 밤새 많은 사람들이 목숨을 잃었다. 사망 사건이 발생한 지 약 3개월이 지난 뒤 정부는 임시로 마련된 감방에서 25명이 목숨을 잃었다고 밝혔으나, 사망자들의 신원이나 사인, 시신의 위치 등에 대해서는 공개하지 않았다. 다음 날 체포된 사람들 중 45명이 교도소로 이송됐으나, 2개 마을에서 체포된 130여명은 여전히 행방을 알 수 없는 상태다.

알리운 틴 국장은 “남성 200명이 집단 체포된 지 거의 9개월이 지난 지금도 여전히 대부분의 가족들이 이들의 생사조차 알지 못한다는 것은 용납할 수 없는 일이다. 철저하고 공정하고 독립적인 조사를 통해 자초지종을 확인하고 책임자를 처벌해야 할 것”이라며 “보코하람의 공격 규모와 그 잔혹성은 끔찍할 정도로, 민간인을 보호하고 이러한 범죄의 가해자를 처벌하기 위해서는 아직 해야 할 일이 많다. 그러나 시민들을 보코하람으로부터 보호해야 할 정부군 역시 잔혹행위를 저지르고 있다는 것은 충격적인 일이다. 양측 모두가 저지른 범죄에 대해 즉시 공정한 조사가 이루어져야 한다”고 말했다.

배경정보

이번 보고서를 위해 160명 이상이 인터뷰에 참여했다. 국제앰네스티는 2015년 2월과 3월, 5월 3차례에 걸쳐 카메룬 북부 지역에 조사단을 파견했고, 2015년 6월과 8월 중에도 후속 조사를 위해 재차 방문했다. 보코하람과 카메룬 보안군 양측이 자행한 공격의 목격자와 피해자들은 물론, 카메룬 법무부와 같은 정부 관계자들과 보안군 소속 군인, 기자, 인권활동가, 정치인, 인도주의 활동가 등 다양한 전문가들이 인터뷰에 참여했다.

수집된 증거를 바탕으로 국제앰네스티는 카메룬 북부 지역에서 무력 분쟁 내전이 벌어지고 있으며, 이는 나이지리아 북부 지역에서의 무력분쟁의 영향이 미친 탓으로 추정하고 있다. 또한 이제는 국제인도법과 전쟁법을 적용해야 할 것이다.

2014년 12월 20일, 카메룬 보안군은 기르비디그 마을의 이슬람 학교를 습격해 어린이 84명을 체포했는데, 이들 중 47명은 10세 이하였으며 가장 어린 아이는 5세에 불과했다. 정부는 이 학교가 보코하람의 훈련 전초기지로 이용되고 있었다고 주장하며, 가족과 만나는 것도 허락하지 않은 채 어린이들을 6개월간 구금했다가 2015년 6월 모두 석방했다.

보코하람은 자신들의 새로운 이름을 “이슬람국가 서아프리카주”로 채택했다. 카메룬 대통령은 보코하람의 폭력행위를 소탕하고자 BIR(신속대응부대) 2000개 이상을 BIM(기동부대)와 함께 배치했다. 국제앰네스티는 2015년 7월 카메룬 정부에 최근 조사를 통해 밝혀진 이와 같은 내용에 대해 답변을 요구하는 서한을 보냈지만 정부는 지금도 아무런 대응을 하지 않고 있다.

Cameroon: Hundreds slaughtered by Boko Haram and abused by security forces

Boko Haram has slaughtered nearly 400 civilians in northern Cameroon, while a heavy-handed response by security forces and inhumane prison conditions have led to dozens more deaths, Amnesty International said in a report launched today.

Based on three research missions in 2015, the report, Human rights under fire: attacks and violations in Cameroon’s struggle with Boko Haram, documents how Boko Haram has killed at least 380 civilians since January 2014.

In response Cameroonian security forces have raided villages, destroying homes, killing civilians and detaining over 1,000 suspects, some as young as five years old. Serious incidents have not been effectively investigated, including one where at least 25 people died in custody. More than 130 people remain missing.

“As Boko Haram has brought its violence to Cameroon, civilians have come increasingly under fire. By killing indiscriminately, destroying civilian property, abducting people and using children as suicide bombers, they have committed war crimes and caused untold fear and suffering to the civilian population,” said Alioune Tine, Amnesty International director for West and Central Africa.

“At the same time, while providing much needed protection to civilians, the response by Cameroonian security forces has also been marred with serious violations. Cameroon’s security forces have killed civilians unlawfully or through excessive use of force. People have been arbitrary arrested, and many held in inhumane conditions which have led to dozens of deaths.”

War crimes by Boko Haram

Since mid-2014, Boko Haram fighters have attacked scores of towns and villages in the far north region of Cameroon, killing and kidnapping civilians, burning down hundreds of houses and looting livestock and other property.

In a raid on 15 October 2014, Boko Haram fighters shot or slit the throats of at least 30 people in the border town of Amchide. One eyewitness told Amnesty International: “I saw Boko Haram fighters brutally cutting the throats of at least two of my neighbours.”

On 17 April 2015 more than 100 Boko Haram fighters stormed the town of Bia, killing 16 civilians, including two children.

One witness told Amnesty International how the insurgents set alight more than 150 houses: “Neighbourhood after neighbourhood, they killed people and burned down everything”.

Since July 2015 a series of suicide bombings using girls as young as 13 have claimed more than 70 lives. Thirty-three civilians were killed and more than 100 wounded in three suicide bombings in Maroua on 22 and 23 July 2015.

Heavy-handed response by the security forces

Since 2014, Cameroonian security forces have arrested and detained more than 1,000 people suspected of supporting Boko Haram. Most were arrested in mass “screening” operations or “cordon-and-search” raids where security forces round up dozens, sometimes hundreds, of men and boys. The majority of them are held in appalling conditions at Maroua prison. Overcrowding, lack of sanitation and inadequate health care led to the death of at least 40 prisoners between March and May 2015 alone.

When Amnesty International visited Maroua prison in May 2015, it had no running water and fewer than 20 latrines for more than 1,200 people. Visiting a hospital where sick prisoners were kept during the same period, Amnesty International researchers found that severely malnourished patients were housed in a filthy room, with at least three half-naked detainees sleeping on the floor, one in his own excrement. Work to increase prison capacity has begun, but will take many months to complete.

In carrying out security operations, the military have used excessive or lethal force. In one cordon-and-search operation at least eight people, including a child, were killed and more than 70 buildings were burnt down in the villages of Magdeme and Doublé on 27 December 2014.

One witness told Amnesty International: “Soldiers shot in the house. My sister and her seven year-old daughter were killed while hiding under the bed. My sister was shot on the right side of the head and her daughter in the neck.”

Satellite images and photos confirm the scale of destruction by the security forces described by dozens of witnesses.

In addition to the deaths and destruction, at least 200 men and boys were arrested during this operation. They were taken to the Gendarmerie Headquarters in Maroua and locked in two storerooms, where many died overnight. Nearly three months after the incident the authorities said that 25 people lost their lives in the makeshift cells, yet have failed to reveal the identities of the victims, the cause of their death, or the location of their bodies. While 45 of those arrested were taken to prison the following day, at least 130 of the men and boys arrested in the two villages remain unaccounted for.

“It is unacceptable that nearly nine months after the mass arrest of 200 men and boys, most of their families still do not know whether they are dead or alive. A thorough, impartial and independent investigation is needed to ascertain what happened and hold those responsible to account,” said Alioune Tine.

“The scale and depravity of Boko Haram’s attacks is appalling and more must be done to protect civilians and bring all those guilty of these crimes to justice. But it is shocking that an army which is supposed to protect civilians from Boko Haram has committed atrocities themselves. Crimes committed on all sides must be immediately and impartially investigated.”

Background

More than 160 people were interviewed for the report. Amnesty International conducted three research missions in northern Cameroon in February, March and May 2015, as well as follow-up research between June and August 2015. Victims of and eyewitnesses to attacks committed by both Boko Haram and Cameroonian security forces were among those interviewed, as well as government officials, including the Minister of Justice, members of the security forces, journalists, human rights defenders, diplomats, humanitarian workers, and other experts.

Based on the evidence gathered, Amnesty International believes that an internal armed conflict is taking place in the region – which appears to be a spillover of the conflict in Northern Nigeria – and that international humanitarian law, the laws of war, now apply.

On 20 December 2014, security forces raided Qu’ranic schools in the town of Guirvidig, arresting 84 children, 47 of whom were under 10 and the youngest was just five. Authorities claimed the schools were being used as fronts for Boko Haram training camps. They were held for over six months without access to their families, before being released in June 2015.

Boko Haram now calls itself the “Islamic State’s West Africa Province”. Cameroon’s President has deployed at least 2000 troops of the BIR (Rapid Intervention Battalion) alongside forces from the BIM (Mobile Intervention Battalion) to combat Boko Haram’s violence. Amnesty International wrote to the Cameroonian authorities in July 2015 requesting responses to its research findings, but received no response.

나이지리아의 치복에서 여학생 219명이 무장단체 보코하람에 납치되어 전 세계적인 공분을 일으키고, #BringBackOurGirls 캠페인을 벌이게 한 사건으로부터 2년 반이라는 시간이 흘러, 마침내 좋은 소식이 찾아왔다.

10월 17일 아부자에서는 납치되었던 소녀 21명이 가족의 품으로 돌아오는 감동적인 행사가 있었다. 아이들은 다시는 보지 못할 줄 알았던 부모와 따뜻한 포옹을 나눴다.

하지만 완전히 행복한 결말을 맞은 것은 아니었다. 돌아온 아이들은 30개월간의 포로 생활로 정신적인 충격과 고통에 시달리고 있으며, 여전히 행방을 알 수 없는 200여명의 다른 아이들은 생사조차도 거의 알려지지 않았다.

분쟁의 덫에 걸린 다른 아이들에 대해서는 더더욱 알려진 바가 없다. 보코하람이 아니라, 나이지리아 정부에게 끔찍한 인권침해를 당하고 있는 아이들이다.

국제앰네스티가 5월 발표한 조사 결과, 보르노 주의 수도 마이두구리에서는 120명이 넘는 소년들이 악명 높은 “기와(Giwa)” 수용소의 질병이 들끓는 감방에 독방 구금되어 있는 것으로 드러났다. 5세 미만의 어린이들도 여성 감방 세 곳에 구금되어 있었다.

또한 같은 조사 결과 기와 수용소에서 1월부터 5월 사이 영, 유아를 포함한 어린이 12명이 영양실조와 질병으로 숨진 것으로 밝혀졌다. (성인 약 150명 역시 목숨을 잃었다.)

이 아이들은 나이지리아와 보코하람의 전쟁으로 인한 잊혀진 피해자들이다.

정부는 기와 수용소에 수감된 사람들은 정규 구금시설로 이송될 예정인 보코하람 용의자들이라고 주장하지만, 실제로는 그저 정부군의 반군 포위망에 붙잡혔을 뿐인 민간 피난민들인 경우가 대부분이다.

아직도 기와 수용소에는 1천 명 이상이 구금되어 있을 것으로 추정되며, 대부분은 공식적인 기소 없이 집단 체포된 사람들이다.

지키지 않은 약속

5월 국제앰네스티 보고서가 발표된 후, 무하마두 부하리 나이지리아 대통령은 CNN의 크리스티안 아만푸어 앵커에게 해당 구금시설에 대해 철저한 조사를 진행할 것이라고 밝혔다.

그로부터 5개월 후, 기와 수용소에서 일부 “확인된 수감자”가 석방됐다는 소식은 있었지만 아동 구금이나, 성인 및 아동 수감자의 사망에 대한 조사는 여전히 이루어지지 않고 있다. 국제앰네스티 조사에 따르면 기와 수용소의 감방은 여전히 수감자로 들어차 있고, 이곳에서 성인과 어린이 수감자들은 여전히 죽어가고 있다.

부하리 대통령이 CNN 생방송을 통해 약속한 이후로도, 국제앰네스티는 기와 수용소에서 15명 이상의 영, 유아가 사망한 점을 확인했다. 구금 중에 새로운 아이들이 태어나기도 하는데, 올해 초 석방된 한 수감자는 그가 구금되어 있던 6개월 동안 아이 15명이 태어났다고 전했다.

최근 기와 수용소에서 석방된 어린 소년 우마르는 수용소의 구금 환경을 국제앰네스티에 전하며, 200명이 넘는 소년들이 같은 감방에 몰려 있었다고 말했다. 국제앰네스티가 5월 기록했던 120명보다 훨씬 증가한 것이었다.

이들이 지낸 감방은 너무 좁았던 나머지, 어떤 아이들은 서로 포개져 잘 수밖에 없었다고 우마르(가명)는 말했다. 아이들은 군에서 인원을 확인할 때를 제외하면 절대 감방 밖으로 나올 수 없었고, 같은 감방에 있던 아이들 중 50명은 6세 이하였다고 한다.

우마르는 가족과 함께 보코하람의 폭력과 박해를 피해 떠났다가 바마의 난민 캠프에서 체포되어 기와 수용소로 끌려갔다. 우마르의 아버지가 보코하람을 지원했다는 혐의를 받았기 때문에, 우마르 역시 기소 없이 기와에 구금된 것이다.

올해 5월까지는 기와 수용소의 성인 수감자 중 한 명이 매일 아침 소년들이 수감된 감방을 찾아와 공부를 가르쳐 주려 했다. 덕분에 아이들은 영어 알파벳과 숫자를 배우고 외웠지만, 이 수감자가 석방된 뒤로는 그저 감방에서 시간이 흐르기만을 기다렸다.

우마르는 아이들에게 주어진 것이라곤 군인들이 감방에서 차고 놀라며 준 공 몇 개가 전부였다고 말했다. 이런 공놀이와 때때로 밖에서 실시하는 인원 점검만이 구금 생활 중 지루함을 해소하는 거의 유일한 방법이었다.

아픈 아이가 의사를 만나려면 대부분 이틀은 기다려야 했다. 우마르와 같은 방에 수감된 아이들 중 많은 수가 말라리아에 걸렸고, 그 중 7세 소년 한 명은 말라리아로 목숨을 잃었다.

“군인들이 그 애를 데리고 나갔어요. 어디로 갔는지는 몰라요.” 우마르는 말했다. “물도, 식량도 부족했고, 비위생적이었어요.”

기와에 수감된 다른 수감자들과 마찬가지로, 우마르는 자신과 다른 아이들도 독방에 구금되어 있었으며 가족들이나 바깥 세상과의 접촉도 허용되지 않았다고 말했다.

더 큰 규모의 위기

납치된 치복 여학생들과 기와에서 죽어간 아이들의 참담한 실태 외에도, 나이지리아 북동부의 “자유로운” 아이들도 그보다 사정이 훨씬 좋지만은 않다.

나이지리아 북동부 지역은 아프리카 최대 규모의 인도주의적 위기를 앞두고 있다. 2009년부터 보코하람은 이 지역에 엄청난 피해를 입히고, 수천 명을 살해했다. 240만 명이 터전을 잃었고, 이들 중 대부분이 어린 아이들이다.

많은 사람들이 난민 수용소의 매우 열악한 환경 속에서, 심각한 영양실조와 탈수, 의료적 지원 부족으로 사망할 위험에 처했음에도 바깥 세계로부터 아무런 지원도 받지 못한 채 살아가고 있다.

보르노 주의 경우 특히 심각한 상황으로, 인도주의적 지원이 시급하다.

유엔아동기금(UNICEF)은 보르노 주의 어린이 약 24만 4천 명이 심각한 급성 영양실조를 앓고 있으며, 치료를 받지 못할 경우 목숨을 잃을 것으로 추정되는 어린이는 49,000명에 이른다고 밝혔다.

우마르가 지냈던 바마 캠프의 난민들은 국제앰네스티에 이곳에서의 끔찍한 생활에 대해 설명하며, 어린이들이 굶주림과 질병으로 사망하는 경우가 빈번하다고 말했다.

바마 캠프를 떠난 한 여인은 이렇게 전했다. “캠프의 여자들 대부분이 아이를 잃었어요. 내가 있던 집단에서는 한 마을에 여자가 15명 있었는데, 죽은 아이들만 20명이었어요.”

국경없는 의사회는 지난해 바마 캠프 주변에 무덤 1,233개가 있는 것으로 파악했다. 이 중 480개가 어린이가 묻힌 것이었다.

할 수 있는 일은 무엇일까?

부하리 대통령에게 약속을 지킬 것과, 기와 수용소에서의 인권침해와 사망 사건에 대해 철저히 조사할 것을 촉구한다. 기와는 반드시 폐쇄되어야 할 죽음의 수용소다. 보코하람과의 전쟁이 어린이를 수감시킬 변명은 될 수 없다.

이전 정부는 치복 여학생 납치 사건이 처음 발생했을 당시 놀라울 정도로 더딘 대응을 보였다. 이제 부하리 정부는 치복 여학생들을 비롯해 납치된 모든 피해자를 되찾아 오는 데 노력을 아끼지 말아야 한다.

이는 더 큰 규모의 위기임에도 오랜 시간 간과되어 왔다. 분쟁 피해자들의 인도주의적 요구에도 그 대응은 더뎠을 뿐만 아니라 부족하기까지 했다.

정부와 국제사회는 기와 수용소, 보르노 난민캠프와 같은 곳에서 소리 없이 고통받고 있는 아이들을 잊어서는 안 될 것이다. 우리 모두를 부끄럽게 하는, 캠프를 둘러싼 조그마한 무덤들과 함께.

Nigeria’s Forgotten Children

Two and a half years since 219 Chibok schoolgirls were abducted by Boko Haram in Nigeria, sparking a global outcry and the #BringBackOurGirls campaign, there has finally been some good news.

Yesterday, 21 of those girls were reunited with their families in an emotional ceremony in Abuja, embracing the parents they thought they’d never see again.

But it’s not a completely happy ending – the girls are traumatized and distressed after 30 months in captivity, and little is known about the fates of the almost 200 others who are still missing.

And even less is known about the other children caught in the web of this conflict, those who are suffering horrific abuses perpetrated not by Boko Haram, but by the Nigerian government.

An Amnesty International investigation in May revealed that more than 120 boys were being held incommunicado in a disease-infested cell at the notorious Giwa barracks detention center in Maiduguri, the capital of Borno state. Children under five years of age were detained in three women’s cells.

The same investigation showed that 12 children, including infants and babies, died in Giwa between January and May, falling prey to malnutrition and disease. (Nearly 150 adults also lost their lives.)

These children are the forgotten victims of Nigeria’s fight against Boko Haram.

The government claims that Giwa houses Boko Haram suspects in transit to more established detention centers, but in fact, its detainees are just as likely to be displaced civilians caught in the army’s counter-insurgency dragnet.

More than 1,000 people are still believed to be held at Giwa, most of them arrested en masse without being formally charged.

Broken promises

After Amnesty International’s report was published May, Nigerian President Muhammadu Buhari told CNN’s Christiane Amanpour there would be a thorough investigation into the detention facility.

Five months on, there have been reports of some releases of “cleared detainees” from Giwa Barracks, but there has still been no investigation into the detention of children, or into the deaths of adults and children at Giwa. Our research shows that the cells at Giwa are still being filled, and adults and children are still dying there.

Since President Buhari’s on-air promise to CNN, Amnesty International has confirmed the deaths of 15 more babies and toddlers at Giwa. Babies are also being born in detention: one former detainee who was released earlier this year told us that 15 babies were born in the six months she was detained.

Umar, a young boy who was recently released from Giwa, spoke to Amnesty International about conditions there, describing how more than 200 boys were crammed into his cell, a significant increase from the 120 boys Amnesty recorded in the same cell in May.

Their cell is so cramped that some boys have no choice but to sleep on top of each other, said Umar, whose name has been changed to protect his identity. They are never allowed outside, except to be counted by their captors. Umar said that 50 of the boys in his cell were no older than 6.

Umar was taken to Giwa from a displacement camp in Bama after he and his family fled violence and intimidation by Boko Haram militants. His father was accused of aiding the group, and so Umar was locked up in Giwa without charge.

Until May this year, an adult detainee from Giwa would visit the boys’ cell each morning to try to continue their schooling. He taught the boys the English alphabet and numbers by rote, but when he was released, the boys just waited in their cell for the day to pass.

Umar says they had nothing but a few balls provided by the soldiers to roll around the cell. That, and the occasional roll call outdoors, were almost the only things punctuating the boredom of their detention.

It often took two days to get a doctor to see those who were sick. Many of Umar’s cellmates had malaria, including a seven-year-old who died of the disease.

“They took him outside. I don’t know where to,” Umar said. “There was not enough food and water. It was unhygienic.”

As with all detainees at the barracks, Umar claims that he and the rest of the children were held incommunicado and denied access to their families and the outside world.

The wider crisis

Beyond the horror of the abducted Chibok girls and the children left to die in Giwa, “free” children in northeastern Nigeria don’t necessarily fare much better.

The region is facing one of Africa’s largest humanitarian crises. Since 2009, Boko Haram has wreaked havoc in the region, killing thousands of people. Around 2.4 million have been displaced, the majority of whom are children.

Many are living in camps in horrific conditions, at risk of dying from severe malnutrition, dehydration and inadequate medical care, and with little to no assistance from the outside world.

Conditions in Borno State are particularly dire and humanitarian assistance is urgently needed.

Unicef says there are 244,000 children suffering from severe acute malnutrition in Borno, and that an estimated 49,000 children will die if they don’t receive treatment.

Displaced people at the Bama camp where Umar stayed have given Amnesty International harrowing accounts of life there, describing how children regularly succumb to starvation and disease.

“Most of the women have lost children,” one woman told us after leaving Bama. “In our group, there are 15 women from one village — we lost 20 children.”

Médecins Sans Frontières has counted 1,233 graves near the camp in the past year. Of them, 480 were for children.

What can be done?

We call on President Buhari to keep his word and investigate thoroughly the abuse and deaths at Giwa. It’s a death camp that must be closed. The fight against Boko Haram is no excuse to imprison children.

The previous government was astonishingly slow to respond to the Chibok girls’ abduction in the first place; President Buhari’s administration must now spare no efforts to bring them back, along with all the others who have been abducted.

The wider crisis has been neglected long enough. The response to the humanitarian needs of those affected by the conflict has not only been slow, but also inadequate.

The government and international community must not forget the children who suffer in silence in places like Giwa and the displacement camps in Borno, surrounded by tiny graves that shame us all.
