[긴급조치변호단][논평] 긴급조치 발령행위는 입법행위와 달리 국가배상 책임을 져야할 불법행위다
1. 긴급조치 발령행위는 고도의 정치행위로서 국민 개개인에 대하여 국가배상 책임이 인정되지 않는다는 대법원 판결(대법원 2014.10.27.선고 2013다217962판결, 2015.3.26.선고 2012다48824판결)이 선고 된 후, 하급심 판결들은 과거 1970년대 긴급조치 판결들이 그러하듯이 고뇌 없이 손쉽게 ‘정찰제 기각판결’을 해왔다.
2. 그러던 중 지난 2.4 광주지방법원 민사 제13부(2013가합11470판결, 마은혁 부장판사, 오수빈 판사, 허준기 판사)는 긴급조치를 비방하는 유인물을 제작·배포하였다는 등의 이유로 유죄판결을 받은 전북대 대학생 피해자들이 청구한 국가배상사건에서, 대법원 판결을 조목조목 비판하면서 아래와 같이 국가배상 책임을 인정하였다.
3. 즉, 대통령은 구 국가공무원법 (1978.12.5.법률 제3150호로 개정되기 이전의 것) 상 별정직 공무원이고, 긴급조치 제9호 발령행위는 구 국가배상법에서 정하는 직무행위이라고 전제한 후,
① 대통령의 긴급조치 제9호 발령행위가 위법한지 여부를 판단하기 위해서는 개별 국민의 권리를 보호하기 위한 것인지 여부, 그리하여 긴급조치를 발령하는 과정에서 대통령에게 위 개별 국민의 권리에 대응하여 개별 국민에 대해 부담하는 법적의무가 존재하는지 여부가 문제되는데,
② 입법행위는 다수결 원리에 따라 통일적인 국가의사를 형성하는데 반해 대통령은 대통령 1인의 배타적 판단에 따라 그 의사를 형성하는 점, 입법과정의 문제들은 언론, 선거에 의한 정치적 평가에 맡겨 정치적 책임을 추궁하고 면책특권을 갖는데 반해 대통령은 재직 중 형사상 불소추권을 부여할 뿐 면책특권에 상응하는 특권을 부여하지 않는 점, 입법의 방법을 선택할 수 있는 자유 내지 재량이 있으므로 구체적인 입법행위의 적부를 법적으로 평가하는 것은 원칙적으로 허용되지 않는다고 볼 수 있는데 반해, 긴급조치는 헌법 유신헌법 제53조에 발령요건, 목적을 명시하고 있는데, 대법원이 내용적으로 위헌일 뿐만 아니라 그 발동요건, 목적의 한계를 넘었다고 평가하는 것은 그 발령권자인 대통령이 유신헌법 제52조에서 정한 요건과 목적상 한계를 준수하지 않고 긴급조치 제9호를 발령하였다는 평가를 전제로 하고 있다고 볼 수 있는 점을 종합하면,
대통령의 이러한 권력행사가 국민개개인에 대한 관계에서 민사상 불법행위를 구성한다고 볼 수 없다고 한 것은 대통령의 긴급조치권 행사와 국회의원의 입법행위의 차이를 간과하고 입법행위 판결의 법리를 무비판적으로 원용한 것으로 잘못이라고 하지 않을 수 없다.
③ 긴급조치 제9호를 발령할 당시 대통령에게는 유신헌법 제8조, 제53조에 의하여 헌법에 정하여진 긴급조치의 요건과 한계를 준수하여 국민의 기본권을 보장하여야 할 사익 보호성 있는 직무상 의미가 있었음에도 대통령이 이를 다하지 않은 채 발령요건을 갖추지 아니하고 목적상 한계를 벗어나 국민의 자유와 권리를 지나치게 제한함으로써 헌법상 보장된 원고들을 포함한 국민의 기본권을 침해하는 내용의 긴급조치 제9호를 발령한 행위는 위법행위라고 할 것이고,
④ 설령 긴급조치 제9호의 발령과 관련하여 대통령은 원칙적으로 국민 전체에 대한 관계에서 정치적 책임을 질 뿐 국민 개개인의 권리에 대응하여 법적 의무를 지는 것이 아니라고 하더라도, 긴급조치 제9호의 내용이 헌법의 문언에 명백히 위배됨에도 불구하고 대통령이 굳이 긴급조치 제9호를 발령한 행위는 구 국가배상법 제2조 제1항 소정의 위법행위에 해당된다고 봄이 타당하다고 판시하였다.
4. 그러면서, 재판부는 사정이 이러함에도 이제 와서 새삼 긴급조치 제9호의 위헌성이 명백한 점을 부인하는 것은 법치주의의 최후의 보루로서 국민의 기본권 보장을 위한 사법심사를 충실히 수행한 판결로 평가받고 있는 대법원 2010. 12. 16. 선고 2010도5986 전원합의체 판결과 대법원의 긴급조치 위헌 결정의 역사적 의미를 훼손하는 일이라 하지 않을 수 없다고 대법원 판결을 비판하였다.
5. 이번 판결은 당시 유신헌법에 명백히 위배된 긴급조치를 발령하는 행위는 국가배상법상 소정의 위법행위라고 판시함으로써 종래 대법원 판결이 입법행위에 대한 국가배상 책임 판결을 긴급조치 발령행위에 그대로 의율 적용하여 국가배상책임을 부인한 판결을 정면으로 반박한 것이다. 특히 입법부의 입법행위와 달리 대통령 등 행정기관이 국민 개개인에 대한 관계에서 불법행위 책임을 지는 기준을 설시하였다는 점에서 그 의미가 있다.
6. 지난 2015. 9. 11. 서울중앙지방법원(민사 제11부. 2013가합544225판결, 김기영 부장판사,정순열, 이호연 판사)도 긴급조치 발동행위에 대한 국가배상 책임을 인정한 바 있다. 최근 하급심재판부가 판결로써 대법원 판결들의 법리적 문제점과 더불어 역사적 책임을 추궁한 것은 너무나 당연하지만 아직까지 과거 사법부의 오류를 시정하려는 고뇌어린 판결이 적다는 점은 아쉬움을 넘어 개탄스러울 따름이다.
7. 모임은 하급심 판결을 뒤늦게나마 환영하면서, 역사적・사법적 책임을 다하는 대법원 판결을 촉구하는 바이다.
1. 인권단체와 경찰폭력 피해자단체는 오늘(9월 8일) 정부 여당의 ‘경찰법 전부개정 법률안’에 대해 성명을 발표했습니다.
2. 21대 국회 개원 이후 7월 30일, 당정청은 권력기관 개혁에 대해 의견을 모으고 올해 정기국회 내 처리를 목표로 추진하기로 했습니다. 경찰개혁과 관련해서 국가수사본부 신설과 일원화된 광역단위 자치경찰제를 도입의 내용이 담겼습니다. 이를 반영해 지난 8월 4일 더불어민주당 김영배 의원이 경찰법 전부개정법률안을 대표발의했습니다.
3. 발의된 법안의 내용은 ‘경찰위원회 실질화’와 '외부 통제기구' 등 경찰에 대한 민주적-인권적 통제에 대한 개혁이 전무하며, 이름뿐인 자치경찰과 경찰청 내부의 국가수사본부는 기존의 국가경찰의 단일한 조직구조를 유지하면서 실질적인 권한 분산을 하지 않았습니다. 또한 전직 경찰청장 3명이 재판을 받고 있는 상황임에도 정보경찰을 그대로 유지하려고 합니다.
4. 경찰은 검찰로부터 1차 수사권과 수사종결권을 가져오게 되었고, 국가정보원으로부터는 대공수사권과 그 인력을 이양받을 예정으로 경찰은 권한이 한층 강화됩니다. 경찰을 민주적으로 통제하고 권한을 축소함으로써 국민을 위한 조직으로 개혁하는 일은 매우 중요한 과제가 아닐 수 없습니다.
5. 이에 인권단체와 경찰폭력 피해자단체는 정부 여당은 발의된 법안을 철회하고 ‘민주적 통제’와 ‘경찰권한 분산과 축소’를 이룰 수 있는 경찰개혁법안을 다시 발의할 것을 요구합니다.
[성명] 정부와 경찰의 선의를 믿으라는 게 개혁인가
- 정부여당의 ‘경찰법 전부개정법률안’ 발의에 부쳐
지난 8월 4일, 정부여당의 ‘경찰법 전부개정법률안’(김영배 의원 대표발의)이 발의되었다. 정부는 출범 초부터 검찰, 경찰, 국정원 등 권력기관 개혁을 강조해왔고 이에 각 기관들은 과거사위, 개혁위 등을 구성해 활동해왔다. 경찰 역시 ‘경찰개혁위’, ‘인권침해사건 진상조사위’를 꾸렸고 각각 제도개선안과 권고조치를 내고 활동을 종료했다. 특히 경찰은 검찰로부터 1차 수사종결권을 가져오고 국정원의 국내 대공수사권을 넘겨받으면서 그 권한과 조직이 커졌고, 민주적 통제와 권한 분산, 축소의 필요성이 그 어느 때보다 대두되는 상황이었다. 하지만 지난 3년 여간의 경찰개혁 논의 과정을 거치며 정부여당이 내놓은 경찰개혁안은 ‘앞으로 정말 잘할테니 믿어달라는 것’ 이상도 이하도 아니다.
민주적 통제, 이건 절대 하지 않겠다는 정부여당
2019년 경찰청 인권침해사건 진상조사위는 용산참사, 쌍용차파업 진압, 밀양 송전탑, 강정마을 해군기지, 백남기 농민 사망, 삼성전자서비스 노조원 시신 탈취 사건에 대해 경찰의 사과와 손배 가압류 철회, 제도개선 등을 권고했다. 지난 10여 년 동안 자행된 경찰에 의한 국가폭력 진상조사가 가능했던 것은 탄핵촛불의 성과다. 하지만 이는 대통령이 탄핵을 당하는 정도는 되어야 경찰에 의한 국가폭력 사건 조사가 가능하다는 것을 보여준다.
합법의 탈을 쓴 구조적 폭력에 맞서 도심 건물에서, 거리에서, 공장에서, 산 정상에서, 해군기지 건설 부지에서 저항했던 이들은 경찰에 의해 일상이 감시당하고 모욕당하고 짓이겨졌고 죽임을 당했다. 경찰폭력은 합법적인 공권력 행사라는 사법부의 판결로 모두 정당화되었고 국가폭력의 피해자들은 오히려 현행법 위반으로 투옥되고 손해배상 책임을 떠안았다. 이는 경찰력 행사 과정에서의 개별적 일탈이나 남용이 아니었다. 정권의 지시 또는 묵인 하에 이루어지는 공권력에 의한 조직적, 의도적, 반복적 폭력이었다. 얼마나 현장을 신속하게 진압하고 정리했느냐가 경찰력 행사의 유일한 평가기준이 되었고, 그에 따라 지휘 책임자들은 승진이라는 확실한 포상을 받았다.
극우보수 정권의 특수성일까? 그렇지 않다. 노동자의 파업권, 세입자와 지역주민의 생존권, 집회 시위의 권리는 공공안전과 질서, 국책사업과 국가안보 논리, 기업과 건설자본의 이윤논리에 지금도 짓밟히는 기본권이다. 지난 5월, 사드 추가배치를 막는 성주 주민들에게 경찰은 밀양과 다를 바 없는 폭력을 행사했다. 제주에 제 2공항 공사가 시작된다면 강정과 다를까? 공권력 집행의 ‘합법’여부를 넘어, 인권침해의 가능성이 상존하는 경찰력 행사의 목적, 집행과정, 결과에 대한 민주적-인권적 통제가 경찰개혁의 핵심이 되어야 한다.
하지만 이번 정부여당의 경찰개혁법안은 ‘민주적 통제’에 대한 고민이 전혀 없다. 2018년 경찰개혁위는 ‘민주적 통제’ 방안으로 ‘경찰위원회 실질화’와 ‘외부 통제기구 설치’를 권고했지만 발의 법안의 국가경찰위원회는 자문기구에 불과한 현재 경찰위원회와 크게 다를 바 없고 독립적인 외부 통제기구에 대한 구상도 없다. 대통령을 정점으로 13만 명에 이르는 경찰력이 일사분란한 상명하복 체계로 작동하는 상황에서 경찰력은 언제나 정권의 목표와 의지에 따라 움직이게 된다. 이를 끊어내는 제도 개혁이 바로 집행력과 전문성을 갖춘 합의제행정기관으로서 ‘경찰위원회 실질화’다. 경찰위원회는 인사권과 예산배정권, 치안정책 수립과 내부 관리감독 기능을 수행함으로써 경찰 내부의 민주적 통제기구 역할을 기대할 수 있기 때문이다.
탄핵촛불의 성과로 ‘인권침해사건 진상조사위’가 구성됐지만, 조사권한 등에 있어 경찰 내부 기구라는 한계는 분명했다. 경찰이 진상조사를 거부하면 별다른 방법이 없는 것이다. 독립적이고 상설적인 외부 통제기구에 의한 조사와 감찰기구 역시 필수적이다. 그러나 정부여당 법안에는 이에 대한 방안은 전무했다. 현재 국민권익위와 국가인권위에 진정을 할 수 있지만 조사권한과 인력에 있어 그 한계가 너무나 분명하다. 정권과 경찰에게 이전 정권 시기 경찰력 행사에 대한 사과와 소소한 제도개선의지를 표명하는 건 그리 어려운 일이 아닐 것이다. 광범위한 조사권과 강력한 권고이행 기능을 갖춘 독립적인 외부 조사기구에 의한 경찰력 통제야말로 이들에게 가장 두려운 일인가보다.
경찰 권한 분산과 축소, 하는 척만 하겠다는 정부여당
정부여당은 발의법안이 경찰수사의 독립성을 확보하고 지방분권에 맞춰 자치경찰제를 전면화하는 것처럼 선전한다. 하지만 자세히 들여다보면 경찰에 대한 민주적 통제는 전무한 상태에서 국가경찰, 국가수사본부, 자치경찰, 시도 경찰위원회와 같은 복잡한 지휘체계들을 늘어놓고 있을 뿐이다. 국가수사본부나 시도 경찰위원회에 일정한 지휘권한을 부여하지만 최종인사권은 경찰청장, 청와대가 갖게 되는 구조다. 결국 복잡하게 나뉜 지휘체계를 통해 경찰권한을 분산한 것처럼 보이지만, 실제로는 단일한 조직구조를 유지하면서 실질적인 권한 분산은 하지 않는 것이다.
업무의 범위를 넘어선 정보의 생산과 수집, 감시가 정보경찰조직을 통해 광범위하게 이루어졌고, 전직 경찰청장 3명이 이와 관련한 재판을 받고 있는 상황이다. 그럼에도 이번 정부여당 법안은 ‘치안정보’ 개념을 ‘공공안녕에 대한 위험 예방과 대응’으로 변경하면서까지 정보경찰을 존속하려는 의지를 분명히 하고 있다.
정부여당의 경찰개혁법안은 한 마디로 이전 정권과 자신들은 다르니 믿어달라는 것이다. 이명박, 박근혜 정권이 경찰을 이용해 기본권 침해와 국가폭력을 자행했고, 선거까지 개입했지만 자기들은 그렇게 경찰력을 사용하지 않겠다는 다짐을 ‘경찰개혁법안’이라는 이름으로 내놓은 꼴이다. 우리는 너희를 믿지 못하겠으니 발의법안 철회하고 ‘민주적 통제’와 ‘경찰권한 분산과 축소’를 이룰 수 있는 경찰개혁법안을 다시 발의하라.
정부에서 비대면 학습지원을 위한 지원금 정책을 추진하고 있습니다. 하지만, 이주 아동은 대상에서 제외되고 있는 상황입니다. 이에, <경기이주공대위>와 <이주민을 차별하지 않는 재난기본소득을 위한 공동행동>에서 "비대면 학습지원금" 차별중단을 촉구하는 성명을 받았습니다. 짧은 시간에 400여개의 개인 및 단체가 연명에 참여해주셨습니다.
<비대면 학습지원금 차별 중단을 촉구하는 시민사회단체 성명>
코로나19로 인해 일상이 흔들리고 있습니다. 경제, 문화, 사회적 위기 전반으로 확대되고 있습니다. 그 중, 하나가 교육입니다. 코로나19로 인해 급작스레 학교가 멈추고, 온라인으로 학습이 진행되고 있습니다. 초·중·고가 등교를 제한하고 온라인 수업으로 전환하면서 학부모와 아동·청소년이 돌봄의 위기를 맞고 있습니다. 이 위기는 한 개인의 문제가 아니라, 우리 사회 모두가 겪고 있는 문제입니다. 최근, 정부는 학부모의 경제적 부담 경감 및 경제활성화, 초/중학생 지원을 위해 아동돌봄지원 예산을 편성하여, 각 학교에서 초등은 20만원, 중등은 1인당 15만원을 스쿨 뱅킹이나 학부모 신청 계좌로 지급한다 발표하였습니다. 이미 초등학생은 지원이 마무리 되었고, 중학생은 10월 8일 지급을 앞두고 있습니다. 재난 시기에 중요한 지원이지만, 한국에 거주하는 이주 아동은 정부 지원 체계에서 배제되고 있는 상황입니다.
UN아동권리협약에 따르면 모든 아동은 교육을 받을 권리(제3조,제6조)가 있고, 양육을 받을 권리(제7조)가 있습니다. 또한, “당사국은 자국의 관할권 내에서 아동 또는 그의 부모나 법정 후견인의 인종, 피부색, 성별, 언어, 종교, 정치적 또는 기타의 의견, 민족적, 인종적, 또는 사회적 출신, 재산, 무능력, 출생 또는 기타의 신분에 관계없이 그리고 어떠한 종류의 차별을 함이 없이 이 협약에 규정된 권리를 존중하고, 각 아동에게 보장하여야 한다.”(제2조)라고 규정하고 있습니다. 국제적인 약속이 존재하는 상황이지만, 정부의 지원정책은 국제사회의 약속을 무의미하게 만들고 있습니다. “비대면 학습지원금”에서 대한민국 국적자가 아닌 아동을 제외하는 것은 UN아동권리 협약 위반이며, 이주 아동에 대한 또 다른 차별일 뿐입니다.
코로나19에 따른 위기는 모두에게 동등하지 않음을 우리는 확인하고 있습니다. 재난은 일상에서 어려움을 겪고 있던 이들에게 더욱 큰 무게로 다가오고, 사회적 약자·소수자, 취약계층에게 더 큰 위기로 찾아옵니다. 대책 마련과 지원 체계에 있어서 각별히 더 우선하여 지원하고, 대안을 마련해야 합니다. 하지만, 현재 정부가 시행하고 있는 정책은 오히려, 재난에 취약한 계층을 더욱 소외 시키는 지원책입니다. 평등과 비차별에 앞장서야 할 정부의 정책이 오히려 차별을 조장하고, 누군가를 소외시키는 정책이 되어서는 안됩니다.
이에 우리는 코로나19 상황에서 “비대면 학습지원금”에서 이주 아동을 제외하는 정부의 차별적 조치에 대하여 다음의 시정 조치를 요구합니다.
1. 모든 아동에게 차별없이 “비대면 학습지원금”을 지급하라.
2. “비대면 학습지원금”을 지급함에 있어서 차별적 행정을 즉각 중단하라.
3. 코로나19 등과 같은 재난 상황에서 모든 아동이 차별을 받지 않도록 제도 개선과 행정 시스템을 구축하라.
INTERNATIONAL SAFE ABORTION DAY – 28 SEPTEMBER 2019

Thank you, President. I deliver this statement on behalf of 317 organizations[i] and 506 individuals.[ii]
In the Vienna Declaration and Programme of Action, States explicitly agreed to prioritize the realization of women’s human rights and recognized that all human rights are universal, indivisible, interdependent and interrelated. Yet, 26 years later, women and girls’ human rights and bodily autonomy continue to be routinely violated, including through the denial, criminalization and stigmatization of access to safe and legal abortion – all of which is rooted in the discrimination, oppression, violence and coercion affecting the material conditions that shape people’s lives and ability to exercise their bodily autonomy and human rights.
In 1994, Black feminists came together as the Women of African Descent for Reproductive Justice, in reaction to the white supremacy, colonialism and capitalism they observed shaping reproductive politics and inherent in the broader population control narratives. Reproductive justice is centered on the rights to bodily autonomy and self-determination, and to parent and not to parent in safe and healthy environments.[iii] It is rooted in an intersectional analysis and moving beyond an individualistic conception of “choice” to instead place emphasis on the material conditions necessary to exercise reproductive rights. Reproductive justice also addresses the legacy of population control informed by white supremacy and replacement theory, which has resurfaced in current populist politics.
Reproductive justice is achieved when all people are able to enjoy their right to bodily autonomy and sexual and reproductive self-determination. It requires people to enjoy economic, social, and cultural rights and freedoms, and the ability to make and exercise choices not limited by oppression, discrimination, stigma, coercion, violence, lack of opportunities or possible consequences. Treaty bodies and special procedures have echoed this need and recognized that the realization of women’s reproductive rights depends on the material conditions in which they are born, grow, live, work and age, and on power structures and resource distribution at all levels[iv] – in other words, the social and other determinants of health.[v] These include access to housing, safe drinking water, effective sanitation systems, access to justice, and freedom from violence, among other factors, and impact the agency that individuals can exercise with respect to their sexual and reproductive health.[vi] Our discussions on abortion and sexual and reproductive rights cannot continue ignoring these factors.
The realization of reproductive justice, the right to bodily autonomy and substantive equality also requires freedom from control and interference by State and non-State actors, including private companies, donors and multinational corporations, including criminalization of sexual and reproductive behaviors and decisions, restrictive abortion laws, punitive sanctions, and legal restrictions to regulate women’s control over their own bodies.[vii] These laws, policies and practices typically target and disproportionately impact women of color, women from the Global South, women with disabilities, women living in poverty, migrant women, ethnic minorities and indigenous women, women living with HIV, young women and adolescents, sex workers and gender-non-conforming persons based on racial, class, disability and gender stereotypes.[viii]
Today, on 28 September, International Safe Abortion Day, we urge States to respect, protect and fulfill women and girls’ human rights and realize reproductive justice for all. We call on states to:
Ensure access to available, accessible, acceptable and quality sexual and reproductive health services as part of universal health coverage and public health systems, including modern contraceptive options, comprehensive abortion and post-abortion care, financed adequately through taxation and free from control from other governments, multilateral agreements and transnational corporations.
Remove all legal and social barriers to safe abortion, including its criminalization, which is broader and including sanctions and no sanction regimes, and commit to providing safe abortion services on request.
Address social and other determinants of health in law and practice from an intersectional perspective to ensure that they enable all individuals to effectively enjoy their sexual and reproductive rights.[ix]
Hold private companies and multinational corporations accountable for unethical research practices, violations and abuses of women and girls’ reproductive rights and bodily autonomy.
Prioritize the meaningful participation of local movements, women human rights defenders and feminists demanding accountability for sexual and reproductive health and rights violations, and center their demands and recommendations for the realization of reproductive justice.

국회 정무위원회는 11월 25일 예정된 법안심사1소위와 전체회의에서 신용정보법안(김병욱의원 대표발의)를 통과시킬 것으로 알려지고 있습니다. 신용정보법안은 금융소비자들의 신용정보를 일부 정보를 삭제하거나 대체하는 등 이른바 가명처리한 후 정보주체 동의 없이도 기업들이 사고 팔고 할 수 있도록 하는 것이 주요 내용입니다. 지금도 은행, 카드, 보험, 유통업계가 개인신용정보를 집적하고 공유하는 것이 어렵지 않아서 잊을만 하면 개인정보유출사고나 보이스피싱 등의 관련범죄가 끊이지 않는데, 여기서 더 나아가 정보주체 동의없이 서로 결합하고 판매할 수 있도록 하는 신용정보법안을 통과시킨다면 금융 소비자의 개인정보보호는 포기하겠다는 것과 다르지 않습니다.
한편, 공정거래법 위반 전력을 삭제하여 주주 자격 요건을 완화하는 인터넷전문은행법안(김종석 의원 대표발의)이 어제(11/21) 정무위 법안심사소위를 통과했습니다. 2018년 은산분리 완화에 대한 거센 우려와 반대에 대해 대주주 적격성 요건을 강화하여 부작용을 최소화하겠다는 약속을 법 시행 일 년도 되지 않아 국회가 내팽개친 것입니다.
이에 개인정보보호법, 신용정보보호법 등 데이터3법의 졸속 통과와 인터넷전문은행법 개악에 반대해 온 노동시민사회단체와 정의당 추혜선 국회의원 공동으로 11월 25일(월) 오전 9시 40분 국회 정론관 기자회견을 아래와 같이 개최합니다.

올해 12. 1. 국가보안법이 제정·시행된 지 만 71년이 되었다. 일제강점기에 억압적 식민통치를 강화하고 독립운동가들을 장기간 수감시키기 위해 제정·시행한 치안유지법의 맥을 잇고, 독재정권 시기에 반민주적 권력의 유지와 불법·부당한 폭력적 지배의 도구가 되어 왔던 국가보안법이 촛불시민혁명으로 들어선 문재인 정부에서도 여전히 현행법으로서 규범력을 가진 채 존재하고 있는 것이다.
우리 국민들은 과거 국가보안법위반 사건들이 재심에 의해 무죄를 선고받는 과정에서 얼마나 많은 사건들이 공안기관의 비인간적인 고문과 조작 등으로 국가보안법위반으로 만들어져 왔는지를 목격하고 있다. 민주인사가, 노동운동가가, 나아가 평범한 일반 시민·학생들이 국가보안법위반 혐의로 연행되어 일제강점기 고등계 형사들이 독립운동가들에게 행하였던 것과 같은 고문을 당하였고, 그러한 고문과 조작, 기나 긴 수형생활과 사회적 낙인 등으로 도저히 회복되어질 수 없는 상흔을 껴안고 죽음과 별반 차이 없는 삶을 살다가 세상을 떠났다. 그의 가족들 또한 온전할 리가 없었다. 이러한 비극이 정녕 과거지사일 뿐이라고 말할 수 있을까? 결코 그렇지 않다. 이 비극을 만들어 낼 수 있었던 근거가 국가보안법이었고, 그러하기에 국가보안법이 현행법으로서 존재하는 한 이와 똑같은 비극이 언제든지 다시 만들어 질 가능성이 있다는 사실을 잊지 말아야 한다.
작금에 이르러 민주화가 어느 정도 성취되면서 공안기관에서 과거와 같은 물리적 고문이 없어지고 남영동 대공분실이 민주인권기념관으로 탈바꿈하였다 하더라도, 국가보안법의 존재 그 자체로 인한 폐해는 이 법이 제정·시행된 이래 달라진 것이 하나도 없이 여전히 현재진행형이다. 국가보안법에 의해 북한은 ‘반국가단체’이기 때문에 북한에서 발행한 간행물이나 서적 등을 임의로 입수하거나 보아서는 안 되고, 북한 주민을 함부로 만나서도 안 된다. 주한미군 철수나 연방제 통일방안에 관한 주장은 북한도 이를 주장하는 것이기 때문에, 미국에 대한 비판은 북한을 이롭게 한다는 주장과도 엮일 수 있기 때문에 공안기관의 조사 대상이 될 수 있다. 이 반도의 남쪽에 살고 있는 국민 중 70대 이상의 노년층을 제외한 모두가 태어나면서부터 지금까지 평생 동안 국가보안법에 의해 생각할 수 있는 구역, 말할 수 있는 범위 등을 강제로 제한받아 왔고, 이를 어긴 사람들을 강력히 처벌함으로써 그 제한이 학습되도록 하였으며, 처벌받지 않도록 스스로가 일상적으로 자기의 사고와 표현을 검열하도록 만들었다. 남과 북의 양 정상이 1년 동안 세 차례 만나고, 북·미의 양 정상이 두 차례나 만나 역사적인 회담을 하였지만, 우리 국민이 사고와 표현에서 자유를 잃어버리고 형사처벌을 받지 않기 위해 항상적 자기검열을 해야만 하는 상황은 국가보안법의 제정·시행 이래 전혀 변하지 않고 있는 것이다.
정부는 올해 내내 대북관계에서 독자적인 공간을 만들어내지 못하면서 북·미관계의 진전만을 학수고대하고 있는 것처럼 보인다. 미국과의 관계나 국제적 정세 등으로 인해 남북관계가 멈춰 서 있다면, 장래의 남북관계 전진을 위해 지금 당장 남측만이라도 할 수 있는 일들을 해야만 한다. 국민은 문재인 정부가 들어섰을 때 강력한 적폐청산을 주문하였다. 배금주의, 기회주의, 특권과 반칙 등으로 인해 이 사회의 각 부문에서 쌓여져 온 폐해들이 적지 않지만, 그 중에서도 분단에 기생하여 대북 적대와 갈등을 기반으로 사리사욕을 챙겨 온 이들에 의한 폐해는 매우 심각한 ‘적폐 중의 적폐’라 할 것이다. 때문에, 이를 청산하기 위한 첫걸음은 무엇보다도 이 분단적폐를 떠받치고 있는 국가보안법의 즉각적인 폐지가 되어야 할 것이다.
제20대 국회 임기가 6개월여가 남아 있지만, 300석 중 현재 108석을 차지하고 있는 제1야당인 자유한국당이 벌이고 있는 작금의 행태를 보면 이번 국회의 임기 내에 국가보안법 폐지를 기대한다는 것 자체가 난망한 일로 보인다. 공안검사 출신인 당 대표는 의원들의 활동을 지휘할 생각은 하지 않은 채 삭발과 단식 등으로 길거리 정치로만 나아가고 있고, 그 원내대표는 미국 현지에 가서 미 당국에게 내년 총선이 있는 4월까지 북·미회담을 자제하라고 요구하였다. 만약 이번 국회의 임기 내에 국가보안법이 폐지되지 않는다면, 제21대 국회에서의 첫 발의법안과 성과는 ‘국가보안법 폐지에 관한 법률’이 되어야 할 것이다.
