2월 4일 런던 시리아 공여국 회의 개최를 앞둔 가운데, 턱없이 부족한 국제적 지원과 레바논 정부의 차별 정책으로 인해 레바논의 난민 여성에 대한 착취와 인권침해를 더욱 부추기는 환경이 조성되고 있다고 국제앰네스티가 보고서를 통해 밝혔다.

보고서 <‘안전한 곳을 원해요’: 레바논에서 소외되고 보호받지 못하는 시리아 난민 여성(영문)>은 레바논 정부가 난민들의 체류 기간 연장을 거부하고, 국제적 재정 지원도 한계에 달하면서 불안정한 상황에 놓인 난민 여성들이 집주인과 고용주, 심지어 경찰과 같은 권력자들에 의해 착취당할 위험에 빠졌다고 지적하고 있다.

2015년부터 레바논은 유엔난민기구(UNHCR)를 통한 더 이상의 시리아 난민 수용을 중단하고, 난민들이 체류 기간을 연장하기 더욱 어려워지는 신규 규정을 도입했다. 합법적인 체류가 아닐 경우 임의 체포, 구금, 강제 송환까지 당할 수 있어 많은 난민이 인권침해 사실을 경찰에 신고하지 못하고 있다.

레바논에 거주하는 시리아 난민 가정 중 20%는 여성이 세대주다. 시리아에서 남편이 살해, 구금, 강제 실종, 또는 납치된 뒤로 여성이 가족의 생계를 책임지게 된 경우도 있다.

램지 조사관은 “레바논의 시리아 난민 대부분이 주로 절박한 상황에서 살아가고자 분투하고 있다. 식량이나 집, 일자리를 구하는 데도 만연한 차별과 큰 역경에 마주하게 된다. 이러한 상황에서 여성 난민들의 삶은 이보다 더 힘겨운 경우가 많은데, 특히 가족의 생계를 책임져야 하는 여성들은 직장과 거리에서 괴롭힘과 착취, 인권침해의 대상이 될 위험이 매우 크기 때문”이라고 말했다.

가난과 고용주, 집주인의 착취

시리아 난민 가정 약 70%가 레바논의 빈곤선에 한참 미치지 못하는 생활을 하고 있다. 시리아 난민 사태에 대한 유엔의 인도주의적 지원은 만성적인 재정 부족에 시달리고 있다. 지난해 유엔이 받은 국제 지원금은 레바논에서의 활동을 위해 필요하다고 요청한 액수의 57%에 불과했다. 이처럼 심각한 재정 부족으로 세계식량계획 역시 가장 취약한 난민들에게 제공하던 월간 식비를 2015년 중반부터 미화 30달러에서 13.5달러로 삭감해야 했다. 2015년 말 자금 투입으로 21.60달러로 인상되긴 했으나 하루 0.72달러에 불과한 금액이다. 국제앰네스티가 인터뷰를 나눈 여성 4명 중 1명은 지난해부터 식비를 받지 못했다.

많은 난민 여성들이 레바논의 높은 물가와 식비, 집세를 감당하기 어렵다고 했다. 이 때문에 난민 여성들은 착취의 대상이 될 위험에 노출되기 쉽다. 남성들이 부적절하게 성적인 접근을 하거나, 재정적 및 기타 지원을 대가로 성관계를 요구하는 경우도 있다고 한다.

난민 차별이 만연한 레바논에서 간신히 일자리를 구해 생계를 이어갈 수 있게 되더라도 난민 여성들은 고용주로부터 극도로 낮은 급료를 받으며 착취를 당하고 있다고 전했다. 시리아의 팔레스타인 난민 ‘하난(가명)’은 “고용주들은 우리가 절박한 상황에서 아무리 낮은 급료를 준다고 해도 받아들일 수밖에 없다는 걸 알고 있다”고 했다.

시리아에서 온 팔레스타인 난민인 56세 ‘아스마’는 베이루트 남부 교외에 있는 난민캠프 샤틸라에 거주하고 있다. 그녀는 딸들이 성추행을 당할까 걱정되어 직장에 다니는 것을 허락하지 않았다고 한다. “딸이 한 상점에서 일했었는데, 점장이 추행하고 만지기 일쑤였어요. 그래서 지금은 딸들에게 일하지 말라고 했습니다.”

고용주의 행동이 부적절하다고 느껴 직장을 그만두거나 일을 시작하지 않았다고 밝힌 여성들도 다수였다.

집세를 지불할 만큼 충분한 돈을 구하는 것도 상당히 힘든 일이다. 시리아 난민 최소 58% 이상이 임대아파트나 임대주택에 거주하고, 나머지는 다 허물어져 가는 건물이나 비공식 정착지에서 살아가고 있다. 그러나 많은 여성들이 지나치게 비싼 집세를 감당하지 못하고 결국 누추한 건물에서 살게 되었다고 말했다.

램지 조사관은 “적은 급료를 받고 일을 하거나, 불결하고 쥐가 들끓으며 물이 새는 집에서 사는 등, 재정적 불안정으로 인해 난민 여성들은 엄청난 어려움에 처하고, 권력자의 위치에 있는 사람들은 이들을 쉽게 이용할 수 있다”고 말했다.

합법적 지위 상실로 위험 더욱 커져

레바논 정부는 2015년 1월부터 번거로운 관료제적 절차와 비싼 비용을 부과해 난민들이 체류 기간을 연장하기 어렵게 하는 정책을 시행하고 있다. 합법적인 체류 허가가 없는 시리아 난민들은 체포될 것을 우려해 인권침해 사실을 경찰에 신고하지 못하는 경우가 많다.

국제앰네스티와 인터뷰를 나눈 난민 여성 대다수가 체류 허가가 없기 때문에 레바논 정부에 범죄를 신고하지 못한다고 밝혔다. 베이루트 인근의 난민캠프에서 딸 3명과 함께 사는 시리아의 팔레스타인 난민 ‘하난’은 버스 기사에게 성추행을 당했다고 경찰에 신고했지만, 거절을 당했다고 했다. ‘법적 지위’가 없으므로 신고할 자격이 없다는 것이다.

램지 조사관은 “인터뷰를 나눈 여성들이 체류 허가가 없다는 이유로 도움이나 보호를 요청할 곳이 아무 데도 없다는 사실 때문에 이들에 대한 괴롭힘과 착취가 더욱 심각해졌다는 것은 매우 명백하다”고 말했다.

또 다른 시리아 여성은 경찰에 알린 이후로 괴롭힘의 대상이 됐다고 밝혔다.

“한동안 경찰들이 우리 집 앞을 지나가거나 우리를 불러내면서 데이트를 하자고 말하곤 했어요. 우리 신고를 받았던 경찰관 3명과 같은 사람들이었죠. 합법적인 [체류] 허가가 없다는 이유로 우리를 위협했어요. 데이트해 주지 않으면 감옥에 보내겠다는 말도 했어요.”

레바논은 인구 1인당 수용하고 있는 난민 수가 세계에서 가장 많은 국가이며 국제사회가 충분한 지원을 하지 못하고 있는 것은 사실이지만, 이 때문에 난민을 착취와 인권침해로부터 보호하지 않는 것이 정당화될 수는 없다.

램지 조사관은 “몰려드는 난민으로 인한 레바논의 부담이 상당하긴 하지만, 이것이 정부가 엄격한 제한을 부과하고 난민을 위험으로 몰아넣을 정당한 이유라고 할 수는 없다”며 “레바논 정부는 공포와 위협이 만연한 분위기를 조성하기보다, 난민 여성들이 보호받을 수 있도록 보장하고, 레바논의 모든 난민이 제재 없이 쉽게 체류 기간을 연장할 수 있도록 시급히 정책을 수정해야 한다”고 말했다.

국제적 지원이 반드시 필요

레바논 난민에 대한 국제적인 재정 지원 부족은 난민 여성들을 가난과 불안정한 위치에 놓이게 하고, 이 때문에 더욱 큰 위험에 노출되게 만드는 직접적인 요인이다.

유엔난민기구는 각국에 수용된 시리아 난민 중 45만 명에 해당하는 최소 10%가 취약한 상태로, 다른 지역의 국가로 재정착해야 할 필요성이 시급하다고 파악했으며, 특히 여성들은 ‘가장 취약한’ 난민의 기준에 포함될 위험이 있다고 보고 있다.

국제앰네스티는 국제사회에 재정착지를 확충하고, 시리아 난민들에게 안전한 출국 경로를 제공할 것을 촉구한다.

더불어 재정 지원을 확대하고, 이번 주 개막하는 공여국 회의를 통해 유엔이 2016-2017년 시리아 위기를 지원하기 위해 요청한 기금을 채울 것을 약속해야 할 것이다.

캐트린 램지 조사관은 “유럽연합과 영국, 걸프 지역 국가와 미국 등 세계적인 부유국으로 꼽히는 국가들은 특히 다른 어느 국가보다도 난민 위기 해소를 위해 더 많은 역할을 해야 한다. 시리아와 난민들에 대한 인도적 지원을 확대함은 물론, 더욱 많은 난민을 재정착시킴으로써 난민 위기의 책임을 공유해야 할 것”이라며 “또한 레바논과 같은 난민 수용국과 공조해 난민이 합법적으로 체류 허가를 받고 필수 서비스를 받을 수 있도록 장벽을 제거해야 하며, 위험에 처한 여성을 포함해 모든 난민이 인권침해 대상이 되지 않도록 도와야 한다”고 말했다.

Syrian refugee women in Lebanon face heightened risk of exploitation and sexual harassment

Shortfalls in international assistance and discriminatory policies imposed by the Lebanese authorities are creating conditions that facilitate the exploitation and abuse of women refugees in Lebanon, said Amnesty International in a new report published ahead of the Syria Donors Conference in London on February 4.

The report, ‘I Want a Safe Place’: Refugee Women from Syria Uprooted and Unprotected in Lebanon, highlights how the Lebanese government’s refusal to renew residency permits for refugees and a shortage of international funding, leaves refugee women in a precarious position, and puts them at risk of exploitation by people in positions of power including landlords, employers and even the police.

“The combination of a significant shortage in international funding for the refugee crisis and strict restrictions imposed on refugees by the Lebanese authorities, is fuelling a climate in which refugee women from Syria are at risk of harassment and exploitation and are unable to seek protection from the authorities,” said Kathryn Ramsay, Gender Researcher at Amnesty International.

In 2015, Lebanon stopped the UN Refugee Agency (UNHCR) from registering any more Syrian refugees and introduced new regulations making it difficult for refugees to renew their residency status. Without proper legal status they face arbitrary arrest, detention and even deportation leaving many afraid to report abuse to police.

Twenty percent of Syrian refugee households in Lebanon are headed by women. In some cases women became the main income providers supporting the family after their husbands were killed, detained, forcibly disappeared or abducted in Syria.

“The majority of refugees from Syria in Lebanon – are struggling to survive in often desperate conditions. They face widespread discrimination and major obstacles in obtaining food, housing or a job. For women refugees surviving in such circumstances can often be even more difficult, with many – particularly women who are the heads of their households – at increased risk of harassment, exploitation and abuse at work and in the streets,” said Kathryn Ramsay.

Poverty, exploitation by employers and landlords

Around 70 percent of Syrian refugee families are living significantly below the Lebanese poverty line. The UN humanitarian response to the Syria refugee crisis has consistently been underfunded. Last year the UN only received 57 percent of the funds it requested for its work in Lebanon. The severe shortage of funds forced the World Food Program to reduce the monthly food allowance provided to the most vulnerable refugees from $30 to $13.50 in mid-2015. After an injection of funding in late 2015, it was increased to $21.60- just $0.72 a day. A quarter of the women Amnesty International spoke to had stopped receiving payments for food over the last year.

Many refugee women said they struggle to meet the high cost of living in Lebanon and to afford food or rent which has exposed them to greater risk of exploitation. Some said that they received inappropriate sexual advances from men or offers of financial or other assistance in exchange for sex.

In a climate of widespread discrimination against refugees in Lebanon, refugee women who managed to find jobs to support themselves reported being exploited by employers who paid excessively low wages.

“They know we will agree to whatever low wage they offer because we are in need,” said “Hanan” a Palestinian refugee from Syria whose name has been changed to protect her identity.

“Asmaa,” a 56-year-old Palestinian refugee from Syria living in Shatila, a refugee camp in Beirut southern suburbs said she did not permit her daughters to work for fear they would face harassment: “My daughter worked in a store. The manager harassed her and touched her. That is why I don’t let my daughters work now.”

Several women also said they had left a job or not taken a job because they felt the employers’ behavior had been inappropriate.

Finding enough money to pay for accommodation is another significant challenge. At least 58 percent of Syrian refugees live in rented apartments or houses, others live in dilapidated buildings and informal settlements. Yet many women said they were unable to afford the exorbitant rents and found themselves in squalid accommodation.

“Whether they are underpaid at work or living in dirty, rat-infested, leaking homes, the lack of financial stability causes immense difficulties for women refugees and encourages people in positions of power to take advantage of them,” said Ramsay.

Lack of legal status increases risks

Burdensome bureaucratic procedures and high costs for refugees to renew their residence permits, introduced by the Lebanese government in January 2015, have prevented many refugees from being able to renew their residency permits. Without a valid residence permit, refugees from Syria often fear arrest and fail to report abuse to the police.

The majority of refugee women who spoke to Amnesty International said the lack of a residence permit stopped them from reporting a crime to the Lebanese authorities. “Hanan,” a Palestinian refugee from Syria who lives in a refugee camp near Beirut with her three daughters, said she went to the police to complain when a bus driver harassed her and was turned away. They told her she was not eligible to present a complaint because she lacked “legal status.”

“It was very clear to the women we spoke to that the harassment and exploitation they face is made even worse by the fact they have nowhere to turn to for help and protection because they lack valid residence permits,” said Ramsay.

Another Syrian woman told Amnesty International said she became a target for harassment after going to the police: “After a while the police would pass by our house or would call us and ask us to go out with them. It was the same three police officers who took our report. Because we don’t have legal [residence] permits, the officers threatened us. They said that they would imprison us, if we didn’t go out with them.”

Lebanon has more refugees per capita than any other country in the world and the international community has failed to support the country, however this is no justification for not offering protection to refugees from exploitation and abuse.

“The influx of refugees has placed a considerable strain on Lebanon, but this is no excuse for the stringent restrictions the authorities have imposed on refugees which are putting them in danger,” said Ramsay. “Instead of contributing to the climate of fear and intimidation the Lebanese authorities must urgently amend their policies to ensure women refugees are protected, and that all refugees in Lebanon are able to easily renew their residence permits without restrictions.”

International support crucial

The lack of international funding and support for refugees in Lebanon is a direct factor contributing to the poverty and precarious circumstances of refugee women which has exposed them to greater risks.

UNHCR has identified at least 10 percent of the Syria refugee population in host countries, the equivalent of 450,000, as vulnerable and in urgent need of resettlement in another country outside the region. UNHCR considers women and girls at risk as among those who meet the criteria of “most vulnerable” refugees.

Amnesty International is calling on the international community to increase the number of resettlement places and other safe routes out of the region offered to refugees from Syria.

In addition, they must boost financial assistance and use this week’s donor conference to pledge to fulfil the UN’s funding requirements for assistance for the Syria crisis for 2016-2017.

“The world’s wealthiest countries, from the EU including the UK, Gulf states and the USA, among others all need to do much more to alleviate this crisis. As well as boosting humanitarian support to those in Syria and refugees in the region they must also offer to share responsibility for the crisis by resettling more refugees,” said Ramsay.

“They must also work with host countries such as Lebanon to remove barriers to legal registration for refugees and access to vital services and help ensure all refugees, including women at risk do not face abuse.”

중국 정부는 인권을 탄압하고 억압하기 위해 광범위한 권한을 정부에 부여하는 신규 국가보안법을 즉시 폐지해야 한다고 국제앰네스티가 밝혔다.

지난 1일 중국 입법부를 통과한 이번 국가보안법은 ‘국가 안보’를 광범위하고 모호한 단어로 규정하고 있으며 정치, 문화, 금융, 인터넷 등의 다양한 영역에 적용된다.

니콜라 베클란(Nicholas Bequelin) 국제앰네스티 동아시아 지역국장은 “이번 신규 법안에서 규정하는 ‘국가 안보’는 사실상 무한한 수준이다. 이 법은 인권활동가, 정부에 비판적인 사람, 그 외의 반정부 세력 등 정부의 마음에 들지 않는 사람은 누구나 처벌하고 감시할 수 있는 백지수표와 같은 권한을 부여하고 있다”고 밝혔다.

“이 법은 국가 안보보다는 공산당의 국가 통제력을 잃지 않으려는 것과 더욱 관계가 있음이 명백하다. 공산당의 집권과 정치력 독점은 이번 법에서 ‘국가 안보’의 일환으로 명시되어 있다”며 “중국 정부는 오래 전부터 ‘체제 전복 선동’, ‘분리주의’, ‘국가기밀 유출’ 과 같은 국가 안보 명목의 혐의를 적용해 왔다. 이번에 새롭게 마련된 국가보안법에서는 그 범위가 더욱 확대되어 이러한 경향을 악화시킬 가능성이 높다”고 말했다.

또한 “중국 정부는 이 법을 즉시 폐지하고 백지화해야 한다. 국민의 인권을 보호하기 위해 무엇보다도 필수적으로 취해야 할 조치로, 국가 안보와 개인의 인권 사이에서 균형을 맞출 수 있는 적절한 안전장치가 마련되어야 할 것”이라고 말했다.

China: Scrap draconian new national security law

The Chinese government must immediately repeal a new national security law that gives the authorities sweeping powers to crack down on and suppress human rights, Amnesty International said.

China’s legislature today passed the law which defines “national security” in broad and vague terms, covering areas including politics, culture, finance and the internet.

“The definition of ‘national security’ under this new law is virtually limitless. The law gives a blank cheque to the government to punish and monitor anyone it does not like – human rights activists, government critics and other opposition voices,” said Nicholas Bequelin, Amnesty International’s Regional Director for East Asia.

“This law clearly has more to do with protecting the Communist Party’s control of the country than with national security. The leadership of the Party and its monopoly on political power is explicitly listed as being part of ‘national security’ in the law.”

“The government has long been using national security charges, such as ’inciting subversion’, ’separatism’ and ’leaking state secrets’ to suppress and imprison activists and government critics. The expansive definition given by the new law is likely to further this trend.”

“Chinese authorities must scrap this law immediately and go back to the drawing board. Among other essential measures to protect people’s human rights, there need to be adequate safeguards put in place to balance security with individuals’ human rights.”

파키스탄이 사형집행을 재개한 이후 처형된 사람이 300명에 육박하게 되면서, 세계 최다 사형집행국이라는 불명예를 얻었다고 국제앰네스티가 24일 밝혔다.

파키스탄 정부는 11월 25일 압둘 바시트(Abdul Basit)에 대한 사형을 집행할 예정으로, 하반신마비 환자인 이 남성은 복역 중 결핵성 뇌수막염 진단을 받았다. 해당 교도소에는 교수대에 서지 못하는 사형수의 형 집행에 대한 규칙이 없기 때문에 압둘의 처형은 여러 차례 연기되었다.

국제앰네스티는 사형이 적용될 수 있는 사건마다 반드시 고려해야 할 공정재판기준과 안전조치를 상습적으로 위반하며 강행되는 이러한 사형집행이 파키스탄 인권상황에 심각한 오점으로 남게 되었다고 밝혔다.

데이빗 그리피스(David Griffiths) 국제앰네스티 동남아시아 조사국장은 “파키스탄이 이처럼 열성적으로 사형을 집행하는 것은 사형제도를 반대하는 세계적인 추세와 인권을 모욕하는 일이다. 하반신마비 환자인 압둘 바시트의 이번 사형집행이 유보된다 하더라도 파키스탄에서는 여전히 거의 하루에 한 명 꼴로 처형되고 있다”며 “이처럼 가차없는 사형집행은 파키스탄의 인권상황에 어두운 그림자를 드리우는 것은 물론, 효과적인 정책도 아니다. 파키스탄 정부가 이를 통해 테러 위협에 성공적으로 대응했다는 증거는 없다. 실제로 교도소 관계자들은 국제앰네스티에 이슬람 수니파 무장단체 라슈카르에장비(Lashkar-e-Jhangvi)가 사형이 집행된 단원의 ‘순교’를 기념하며 사탕을 나눠주기도 했다고 전했다”고 말했다.

국제앰네스티가 기록한 사형집행 건수는 현재까지 공식적으로 확인된 수치로 299건이다. 특히 2015년 10월에만 45명이 처형되며 사형집행 재개 이후 가장 많은 사형이 집행된 달이 되었다. 지금까지 처형된 사형수들은 대부분 테러 관련 범죄로 유죄가 선고된 사람들이 아니었고, 2008년 파키스탄이 사형집행 유예를 선언한 이후로 사형집행을 재개하게 된 원인이었던 지난 12월 탈레반의 페샤와르 학교 학살 사건 역시 마찬가지였다.

초기에는 테러 관련 범죄에 대해서만 사형집행을 재개했으나 수 개월이 지나자 더욱 넓은 범위의 범죄에 대해서도 사형이 집행되고 있다.

국제앰네스티는 범죄의 성격이나 정황, 개인의 유죄 여부나 기타 특성, 사형집행 방식에 상관없이 모든 국가의 모든 경우에 대해 사형을 반대한다.

데이빗 그리피스 국장은 “대부분의 사형선고가 국제공정재판기준을 만족하지 않는 재판을 통해 내려지고 있다. 이러한 재판은 피고인이 적절한 변호사를 선임하지 못하거나, 고문으로 입수한 증거와 같이 국제법상 인정할 수 없는 증거를 채택하는 것 등이 특징”이라며 “파키스탄은 즉시 모든 사형집행을 중단하고, 인권적 의무에 따라, 이제야말로 사형을 단계적으로 폐지하기 위한 조치에 나서야 한다”고 말했다.

Pakistan will imminently have executed 300 people since it lifted a moratorium on executions, shamefully sealing its place among the world’s worst executioners, Amnesty International said today.

On 25 November, Pakistani authorities are set to execute Abdul Basit, a man with paraplegia who developed tubercular (TB) meningitis while on death row. His execution has been postponed several times, since the prison has no rules on how to hang someone who cannot stand on the scaffold.

Amnesty International said the executions are a serious stain on Pakistan’s human rights record, compounding repeated violations of fair trial standards and other safeguards that must be observed in all death-penalty cases.

“Pakistan’s ongoing zeal for executions is an affront to human rights and the global trend against the death penalty. Even if the authorities stay the execution of Abdul Basit, a man with paraplegia, Pakistan is still executing people at a rate of almost one a day,” said David Griffiths, South Asia Research Director at Amnesty International.

“Not only are these relentless executions casting a large shadow over Pakistan’s human rights record, they are also ill-conceived. There is no evidence to suggest they have successfully countered the terrorism threat in the country. Indeed, prison officials told Amnesty International that the banned Lashkar-e-Jhangvi group distributed sweets to celebrate the ‘martyrdom’ of one their members executed in prison.”

Amnesty International has recorded 299 executions to date, based on publicly-reported figures. Forty-five were recorded in October 2015 alone, the deadliest month since the moratorium on executions was lifted. A majority of those executed so far were not convicted of offences related to terrorism, even though it was a Taliban massacre – of mostly schoolchildren in Peshawar last December – that prompted the authorities to lift the moratorium in place since 2008.

It was initially lifted for terrorism-related offences only – but within months, executions for a wider range of crimes were being carried out.

Amnesty International opposes the death penalty at all times in all countries, regardless of the nature or circumstances of the crime; guilt, innocence or other characteristics of the individual; or the method used by the state to carry out the execution.

“Many death sentences are handed down after trials that do not meet international fair trial standards. These trials are characterised by prisoners not receiving adequate legal counsel and by the acceptance of evidence inadmissible under international law, such as evidence obtained as a result of torture,” said David Griffiths.

“Pakistan should halt executions immediately, comply with its human rights obligations, and take steps to phase out this punishment once and for all.”

리처드 베넷(Rechard Bennett) 국제앰네스티 아시아태평양 국장은 “이번 방콕 특별회의는 난민위기를 모든 차원에서 국제인권법에 따라 해결할 수 있도록 지역적으로 진정성 있는 노력을 기울일 기회이자, 놓쳐서는 안 될 기회”라며 “배 안에 들어찬 난민 수천 명이 식량이나 마실 물도 거의 없이 방치되는 동안 정부는 거처 마련이나 그 외 기초적인 인도적 지원 제공에 늑장을 부렸던 사례를 이미 지켜본 바 있다. 즉각적인 대책이 필요하다는 점은 명백하다”고 말했다.

국제앰네스티는 난민 위기의 근본적인 원인, 즉 처음부터 이들이 자국을 떠나게 만든 원인을 해결할 수 있도록 즉시 행동에 나설 것을 모든 국가에 촉구한다.

배로 이주를 결행한 사람들 중 대다수가 이슬람계 로힝야족으로, 이들은 미얀마에서 수십 년에 걸쳐 제도화된 차별을 겪고 있는 소수민족이다. 지난 2012년 당시 이슬람계와 불교계 사이에서 빚어진 폭력사태로 인해 주로 로힝야족으로 이루어진 수만 명은 아라칸 주로 강제 이주되어, 불결한 환경의 캠프에서 생활하고 있다. 또다른 수만 명은 2012년 폭력사태 이후 배를 타고 벵골 만으로 건너간 것으로 추정된다.

2015년 5월 29일, 동남아시아 ‘선상 난민’ 위기를 해결하기 위해 17개국의 대표들은 태국 방콕에 모여 특별회의를 개최했다. 지난 수 주간 말레이시아와 인도네시아에 도착하거나 미얀마로 강제 송환된 사람은 약 3,500명에 이른다. 소집된 특별회의에서는 수색구조 작전 수행에 전념하고 있음을 재확인하는 데 그쳤다. 긴급한 인도주의적 요구사항의 해결, 난민 위기의 근본 원인과 같은 주요 제안 및 권고사항에 대한 논의는 후속 회의로 연기되었다.

이번 특별회의는 수천 명이 절박한 환경 속에 바다에 표류하고 있다는, 장기간 계속되었던 인권위기의 새로운 장을 연 문제를 해결하는 데 조금은 진전을 이룩한 것이었다. 각국 정부가 마침내 해야 할 역할에 대해 논의하고, 후속 회의 개최를 약속한 것은 환영할 일이다. 그러나 하선하기 안전한 장소 선별, 구조한 사람들의 적절한 수용 절차 마련 등에 대해 적절한 합의가 이루어져야 한다.

수색구조 작전의 세부적인 사항 외에도 여러 주요 사안에 대한 논의 역시 이루어지지 않았다.

최근 인도네시아와 말레이시아에 도착한 보트에 이주민 외에 난민 역시 타고 있었다는 사실은 회의에 참석한 각국 대표 중 누구도 거론하지 않았다. 이처럼 중요한 사안이 향후 ‘보호가 필요한 사람 선별’에 대한 논의에서 이루어지기를 기대한다. 국제난민법에 따라, 유엔 인권위원회의 지원을 통해 공정한 절차를 거치고, 장기간의 거처가 필요한 사람들에게 난민 지위를 인정하는 등의 대책이 마련되어야 한다.

또한 처음부터 이와 같은 난민 위기를 촉발시킨 근본 원인의 해결 방법에 대해서는 세부사항이 거의 완전히 누락된 상태다. ‘인권에 대한 전적인 존중을 증진’시킴으로써 근본 원인을 해결하겠다는 성명서의 표현은 미얀마의 로힝야족과 같은 소수민족 박해를 종식시키기 위한 노력으로 이어져야 한다. 그렇지 못할 경우 사람들은 여전히 본국의 견딜 수 없는 환경에서 도망칠 수밖에 없을 것이다.

South East Asia: ‘Boat people’ crisis summit an opportunity that must not be missed

Regional governments must take immediate action to save lives and address the root causes of the South East Asian refugees and migrant crisis, Amnesty International said ahead of a key summit in Thailand on Friday.

“The Bangkok summit is an opportunity to develop a genuine regional effort to address all the many dimensions of the crisis in line with international human rights law that must not be missed,” said Richard Bennett, Amnesty International’s Asia Pacific Director.

“We have seen thousands of people crammed onto boats with little or no food or water, while governments have been slow to provide shelter or other basic humanitarian assistance. There clearly needs to be immediate action.”

Indonesia, Thailand and Malaysia have taken crucial first steps by offering temporary humanitarian assistance and reversing appalling policies of turning back boats. However, efforts must be stepped up to address all forms of migration while respecting human rights. Governments have a responsibility to ensure legal and safe routes of migration.

“Countries must develop a common set of policies to ensure that refugees and migrants – including people fleeing persecution – are protected, and not criminalized or simply left to fend for themselves,” said Richard Bennett.

Representatives of 17 countries will gather in Bangkok on 29 May to discuss the current asylum seeker and migrant crisis in South East Asia. Approximately 3,500 people have over the past weeks landed in Malaysia and Indonesia or returned to Myanmar.

In an open letter this week, Amnesty International has urged governments to take immediate steps to address not only the current crisis, but also the underlying conditions that have caused it.

“The thousands who have landed in Malaysia and Indonesia must be ensured safety and dignity, including the shelter, food, water, clothing, health care and protection they need. Claims for asylum should be fairly processed and under no circumstances should people be returned to or sent to countries where their lives are at risk,” said Richard Bennett.

“People should not be detained solely on the basis of their method of arrival in a country. Prolonged periods of detention and uncertainty have a damaging impact on asylum seekers’ mental health, as we have seen through Australia’s cruel refugee policies. South East Asian countries must not repeat these mistakes.”
Amnesty International is urging all governments to take immediate steps to address the root causes of the crisis, which are driving people to flee in the first place.

A large proportion of those fleeing by boat appear to be Muslim Rohingya, a minority that has faced decades of institutionalised discrimination in Myanmar. Waves of violence between Muslims and Buddhists dating back to 2012 has left tens of thousands of people – mainly Rohingya – displaced in Rakhine state, where they live in camps in squalid conditions. Tens of thousands of others are believed to have fled across the Bay of Bengal by boat since the 2012 violence.

“Many thousands of Rohingya in Myanmar are desperate enough to risk their lives on dangerous boat journeys to escape the conditions they face at home. Myanmar’s response so far has been one of denial – even that the Rohingya even exist. This cannot be the basis on which to proceed,” said Richard Bennett.

“The international community must urge Myanmar to end systemic discrimination against the Rohingya, starting with granting them citizenship and repealing all other discriminatory laws.”

29 May 2015 a regional summit to address the South East Asia “boat people” crisis reaffirmed existing commitments to carry out search and rescue operations. Many key proposals and recommendations, including on addressing urgent humanitarian needs, and the root causes of the crisis were deferred to a follow up meeting.

The meeting missed an opportunity to develop concrete measures to address the crisis. Recommendations alone are cold comfort to thousands of people who remain adrift at sea and others who have been rescued but remain in a desperate situation.

It is critical that countries immediately address these key issues, including by intensifying search and rescue operations, stepping up humanitarian assistance and addressing the root causes of the crisis.

The summit was a small step towards addressing the latest chapter of a long-term human rights crisis that has seen thousands stranded at sea in desperate conditions. It’s welcome that governments are finally discussing what must be done and there was a commitment to another meeting. However, adequate arrangements must include identification of places of safety for disembarkation and adequate reception arrangements for those rescued.
In addition to the details of search and rescue operations, several key issues were also left off the table.
At no point did those attending acknowledge that refugees were also on the boats that recently arrived in Indonesia or Malaysia. We hope that the that the talk of ’identifying those with protection needs’ will address this key issue, by using fair proceedings and granting refugee status to those who need longer-term shelter, in full accordance with international refugee law and with assistance from UNHRC.

There was also an almost complete lack of specifics on how to address the root causes that sparked this crisis in the first place. The statement’s mention of addressing root causes by ‘promoting full respect for human rights’ must translate into steps towards ending the persecution of ethnic minorities like the Rohingya in Myanmar– otherwise people will still feel compelled to flee unbearable conditions at home.

Syria after the ‘Arab Spring’: Eight key facts

Five years ago, Bashar al-Assad’s government brutally suppressed mass protests which began on 15 March 2011. The violent response sparked the region’s most severe armed conflict.

1. More than 250,000 people have been killed, according to the UN. War crimes and crimes against humanity are rife.

2. Since then, more than 11 million people have been forced from their homes, including around 7 million people within Syria and more than 4 million who are now refugees abroad, mostly in Turkey, Lebanon and Jordan. Tens of thousands of refugees from Syria have also fled to Europe, often risking their lives in the process.

3. Government forces have repeatedly shelled and bombed civilian areas using indiscriminate weapons, including barrel bombs. They’ve also bombed hospitals, targeted medical workers and mounted long-running sieges of opposition-held areas, depriving people of food, medicines and other necessities. According to Physicians for Human Rights, 112 medical facilities were attacked in 2015 alone, the majority by government forces.

4. According to the Syrian Network for Human Rights, approximately 65,000 people have been arrested by government security forces and are now missing in a network of unofficial detention centres. Others have been jailed for helping people forced from their homes by the fighting, or for speaking out about the situation in Syria. Lawyers, doctors and journalists have been locked up just for doing their jobs.

5. Intelligence agencies and other government forces continue to use torture on a massive scale. Thousands have died in custody since 2011 due to torture and other factors, including lack of food and medical access.

6. The armed group calling itself the Islamic State (IS) has shelled civilian areas and killed scores of civilians and prisoners. The group has abducted, tortured and executed journalists, peaceful activists and other perceived opponents. IS also besieges civilian areas, which means people struggle to get food, medical supplies and other necessities.

7. Other armed groups including Jabhat al-Nusra have also attacked civilian areas, abducted suspected opponents and killed captives.

8. Russian air strikes in support of the al-Assad government have killed hundreds of civilians and struck medical facilities.

아테네 항소위원회는 EU-터키간 합의 이후 처음으로 터키를 안전한 제3국이라고 판단한 원심을 번복했는데, 이는 터키가 난민협약에서 명시하고 있는 난민 보호를 충분히 제공하지 못하고 있다고 판단했기 때문이다. 항소위원회는 또한 터키가 심각한 인권침해 위험이 있는 국가로의 강제송환을 금지하는 농르풀망 원칙도 보장하지 않고 있다고 판결했다.

항소를 제기한 시리아 난민은 EU-터키간 합의가 시행된 이후 망명을 신청했다. 항소위원회의 결정은 다시 항소할 수 있지만, 원고는 터키로 강제 송환되는 급박한 위험에서는 벗어났다. 그리스 정부 관계자는 현재 항소위원회의 판결을 기다리고 있는 사건만 100여건에 이른다고 했다.

국제앰네스티는 앞서 EU-터키간 난민송환합의가 시행된 이후 터키 정부가 아프가니스탄, 시리아 난민들을 강제 송환하는 등 국제법을 위반하고 있는 사실에 대해 기록한 보고서를 발표했다. 국제앰네스티와 휴먼라이츠워치(Human Rights Watch)는 시리아 망명신청자들이 터키 보안군에 폭행과 총격을 당한 정황을 공개하기도 했다.

그리고 국제앰네스티는 현재 그리스 섬 지역에서 망명 신청 순서나 신청 결과를 기다리며 발이 묶여 있는 8,500명이 넘는 사람들의 열악한 환경에 대해서도 기록한 바 있다.

EU-Turkey deal: Greek decision highlights fundamental flaws

A Syrian national who arrived on the Greek island of Lesvos has won an appeal against a decision that would have led to his forcible return to Turkey, underscoring the fundamental flaws in the migration deal agreed in March between the European Union and Turkey, Amnesty International said.

In the first such decision Amnesty International has seen since the deal, an appeals committee in Athens overturned an initial decision considering Turkey a safe third country on the grounds that Turkey does not afford refugees the full protection required under the Refugee Convention. The committee also ruled that Turkey does not guarantee the principle of non-refoulement, which forbids returning someone to a country where he or she is at risk of serious human rights violations.

“This decision goes to the heart of why the EU-Turkey deal was so deeply flawed to begin with,” said Gauri van Gulik, Deputy Europe Director at Amnesty International.

“Turkey is not safe for refugees, it does not offer them full protection, and assurances on paper are simply not good enough. We’ve seen the reality on the ground: until Turkey ends all violations against refugees and guarantees them full protection, nobody else should be sent back under this deal. Instead Europe should focus on its part of the deal by accepting refugees for resettlement from Turkey. It should also urgently improve conditions for refugees in Greece.”

The Syrian national applied for asylum after the EU-Turkey deal came into force. While the committee’s decision can be appealed, it removes the imminent risk of him being forcibly returned to Turkey. A Greek official confirmed to Amnesty International that about 100 cases are still pending before the appeals committee.

Amnesty International has previously documented how Turkish authorities have been violating international law, for instance by forcibly returning groups of Afghan and Syrian refugees since the EU-Turkey deal was struck. Amnesty International and Human Rights Watch have published accounts of Syrian asylum-seekers being beaten and shot at by Turkish security forces.

Amnesty International has also documented dire conditions on the Greek islands where more than 8,500 people are currently stranded while they wait to apply for asylum or receive news of their applications.
