엘살바도르의 극단적인 낙태금지법에 따라 유산이나 응급상황을 겪은 여성들이 불법 낙태 시술을 받은 혐의로 갇히면서, 수백 명 자녀의 삶에 참담한 영향을 끼치고 있다고 국제앰네스티가 11월 30일 발표한 보고서를 통해 밝혔다.

보고서 <헤어진 가족, 끊어진 인연>에서는 터무니없는 낙태금지법으로 갇힌 여성의 아이들이 대부분 금전적으로 힘든 상황에 부닥치거나 어머니와 연락을 주고받지도 못하는 현실이 담겨있다.

아스트리드 발렌시아(Astrid Valencia) 국제앰네스티 중앙아메리카 조사관은 “엘살바도르 정부는 유산이나 임신 합병증을 겪은 여성을 부당하게 가둘 때마다 그 자녀들 역시 가난과 정신적 고통 속에 살아가도록 내몰고 있다”며 “임신 합병증을 겪은 여성들에게만 적용되는 엘살바도르의 ‘유죄 추정의 원칙’으로 수백 명이 희생되었고, 여성들은 최대 40년까지의 징역형에 처했으며, 의사와 환자 사이에 절대적인 공포 분위기가 조성되었다. 지금이야말로 엘살바도르의 이러한 시대착오적인 낙태금지법을 철폐해야 할 때”라고 말했다.

모든 경우에 대한 낙태 시술이 범죄화됨에 따라 최소 19명 이상의 여성들이 근거가 미약하거나 결정적이지 못한 증거로도 살인과 같은 중대한 범죄로 유죄 선고를 받고, 장기간의 징역형에 처해 현재 교도소에 갇혀 있다. 이들 중 대부분은 가정의 생계를 책임지고 있었다. 이런 여성들이 투옥되면 가족들이 벌이하고 아이들을 돌봐야 하는데, 주로 극심하게 어려운 상황에 처한 경우가 많았다.

경제적 수입이 전혀 없고, 교도소가 집에서 멀리 떨어진 탓에 대부분의 가족은 사랑하는 가족을 면회하기도 어렵다. 일부의 경우 수개월 넘게 자녀를 만나지 못하는 여성들도 있었다.

유산을 겪은 이후 ‘고의 살인’ 죄로 징역 40년형을 선고받고 현재 수감 중인 32세 여성 마리아 테레사 리베라는 2011년 갇힌 이후 지금까지 열 살 난 아들을 만난 것이 겨우 4번에 불과했다.

마리아 테레사의 아들은 그녀가 수감된 교도소로부터 수 시간 떨어진 곳에 할머니와 함께 살고 있는데, 교도소를 한번 방문하려면 엄두도 못 낼 정도로 비싼 비용이 든다. 마리아 테레사가 벌어오던 수입이 끊기고, 정부의 지원도 없어 마리아 테레사의 시어머니 역시 손자를 키우는 데 큰 어려움을 겪고 있다.

마리아 테레사는 욕실에서 거의 실신한 상태로 피를 심하게 흘리고 있는 것을 시어머니가 발견해 병원에 옮겨졌으나 그 자리에서 체포되었다. 병원 직원이 낙태한 것으로 의심하고 경찰에 신고했던 것이다.

재판 과정에서 마리아 테레사의 직장 상사 중 한 명이 그녀가 임신한 사실을 2011년 1월에 이미 알고 있었다며 불리한 증언을 했다. 이 증언이 사실이라면 유산 당시 임신 11개월째였다는 말이 된다. 이처럼 터무니없는 증언조차도 유죄를 선고하는 근거로 이용됐다.

마리아 테레사의 어린 아들은 어머니의 부당한 구금으로 유난히 힘든 시간을 보내고 있다.

마리아 테레사의 시어머니인 “이사벨”은 교도소를 방문할 때마다 겪는 고통에 대해, “손자를 데리고 처음 면회를 갔을 때는 정말 힘들었다. 손자는 심하게 울음을 터뜨렸고 나도 마찬가지였다. 아이는 교도소를 떠나지 않으려고 했다. 너무나 고통스러워서 아이를 데리고 나가는 것도 잠시 포기해야 했다. 아이에게도, 엄마에게도 너무나 힘든 일이기 때문이었다”고 전했다.

테오도라 델 카르멘 바스케스는 2008년 직장에서 사산한 후 “고의 살인” 죄로 징역 30년이 선고됐다. 그녀의 11살 난 아들은 면회를 거의 오지 못한다.

테오도라는 2008년 30년 형을 선고받았다. 11살 난 아들은 엄마를 거의 만날 수 없다.

베르타(가명) 역시 이와 비슷하게 임신 합병증을 겪고 기소되어 거의 1년간을 감옥에서 보냈다. 수감되어 있던 기간의 절반 동안은 열 살 난 아들을 만날 수 없었다.

“베르타”는 2010년 7월 출혈이 심한 상태로 지역 병원을 찾았다가 체포되었다. ‘고의 살인’ 죄로 기소되었지만 정작 본인은 임신한 사실조차 몰랐다. 재판이 시작할 때까지 변호사를 만나지도 못했다. 베르타가 기소된 죄목으로 유죄가 선고되면 최대 징역 50년형까지 처할 수 있었다. 사법절차가 시작된 지 거의 1년 만에 베르타는 무죄가 선고됐다. ‘치료 목적, 윤리적, 우생적 낙태 비범죄화를 위한 시민단체’라는 지역 인권단체의 소속 변호사들이 새로운 증거를 제출한 덕분이었다.

그러나 재판 과정과 교도소에 갇혔던 당시의 경험은 베르타와 가족들의 삶에 엄청난 상처를 남겼다.

베르타는 당시의 경험 때문에 여전히 정신적으로 힘든 상태이며, 이후 어떤 형태의 보상이나 배상도 받지 못했다고 국제앰네스티에 전했다.

베르타는 “몇 년이 지나더라도 그 때로 인한 고통은 여전히 마음속 깊은 곳에 남아 있다”고 말했다.

베르타의 어머니는 당시 베르타가 부당하게 교도소에 갇히면서 끼친 영향에 대해, “딸이 감방에서 지내는 동안 추위로 고생하고 있을 것을 생각하니 잘 때도 이불을 덮지 못했다. 이불을 덮지 않으면 함께 고통을 나눌 수 있겠다고 생각했기 때문이었다. 지금도 아무리 추워도 이불을 덮지 못하는 걸 보니 여전히 상처가 아물지 않은 것 같다. 지금은 베개도 딱딱한 바위처럼 느껴진다. 예전과는 전혀 달라졌다”고 국제앰네스티에 전했다.

아스트리드 발렌시아 조사관은 “엘살바도르 정부는 어린아이들에게 이처럼 감당할 수 없는 고통을 선고하기보다는, 여성을 그저 ‘출산 기계’로 취급하는 것만이 목적인 현행법을 재검토하는 데 여력을 집중해야 할 것”이라고 말했다.

1998년 개정형법에 따라, 엘살바도르는 강간, 근친상간에 의한 임신이거나 산모의 생명이 위험에 처한 경우에도 상관없이 모든 경우에 대한 낙태 시술을 금지했다. 이로 인해 여성들이 즉시 유죄로 몰리며 부당한 기소와 형법의 오적용이 계속되고 있다. 경제적으로 넉넉하지 못한 여성들은 특히 낙태금지법으로 더욱 큰 영향을 받았다.

EL SALVADOR’S TOTAL ABORTION BAN SENTENCES CHILDREN AND FAMILIES TO TRAUMA AND POVERTY

El Salvador’s extreme anti-abortion law is having a devastating effect on the lives of scores of children whose mothers, having suffered miscarriages or other obstetric emergencies, are being held behind bars accused of having illegal abortions, said Amnesty International in a new report today.

Separated families, broken ties, reveals how children of women jailed under the absurd anti-abortion law are often left facing difficult financial circumstances and prevented from staying in touch with their mothers.

“Each time authorities in El Salvador unfairly lock up a woman for having a miscarriage or suffering pregnancy related complications, they are also condemning her children to a life of poverty and trauma,” said Astrid Valencia, Central America Researcher at Amnesty International.

“El Salvador´s ‘guilty until proven innocent’ approach when it comes to women who suffer pregnancy-related complications has cost scores of lives, landed women in prison for up to 40 years and created an environment of absolute fear amongst doctors and patients. It is high time for El Salvador to abolish this outdated ban.”

At least 19 women are currently in jail, in the context of a total criminalization of abortion, convicted of serious offences such as homicide and sentenced to long prison terms on weak or inconclusive evidence. Most of them were their household’s main breadwinners. Since their incarceration, their extended families are responsible for providing and looking after their children, often in extremely difficult circumstances.

The lack of financial resources and the long distances between their homes and the prisons prevents many of the families from visiting their loved ones in prison. In some cases, women were not able to see their children for months.

Maria Teresa Rivera, a 32-year-old woman currently serving a 40 year prison sentence for “aggravated homicide” after having a miscarriage has only seen her ten-year-old son four times since she was jailed in 2011.

The boy lives with his grandmother several hours away from the prison and the journey is prohibitively expensive. Without Maria Teresa’s income and with no official support, her mother- in- law is also struggling to provide for her grandson.

Maria Teresa was arrested in a hospital after her mother-in-law found her in her bathroom almost unconscious and bleeding heavily. Staff at the hospital reported her to the police and accused her of having an abortion.

During the trial, one of Maria Teresa’s bosses testified against her saying she knew she was pregnant in January 2011. This would have made her 11 months pregnant by the time the miscarriage took place. The outrageous testimony was used as one of the pieces of evidence to convict her.

María Teresa´s young son is having a particularly difficult time dealing with his mother’s unfair detention.

“Isabel”, María Teresa´s mother in law, told Amnesty International of the traumatic visits to the prison: “The first time I took the child it was very hard. He cried a lot and I did too. He didn’t want to leave the prison. It was so hard that I stopped taking him for a while because it was tough for both of them.”

Similarly, Bertha (not her real name), spent nearly a year in jail also prosecuted for homicide after suffering a pregnancy-related complication. She was not able to see her 10- year-old son during half the time she was in prison.

“Bertha” was arrested in July 2010 in a local hospital, where she had arrived heavily bleeding. She was charged with “aggravated homicide” although she did not know she was pregnant. “Bertha” did not meet her lawyer until the trial started. The penalty for the crime she was accused of could be as high as 50 years in jail. Bertha was found innocent almost a year after the process against her began, when lawyers from the local human rights group Citizen Group for the Decriminalization of Therapeutic, Ethical and Eugenic Abortion provided new evidence on the case.

The trial and the time she was forced to spend in jail, however, left a profound mark on Berta’s life and her relatives.

She told Amnesty International that she is still traumatized by the experience and said she has not receive any kind of compensation or reparation measures.

“Even though several years have passed, the pain stays deep inside,” she said.

Talking about the impact of Bertha’s unfair incarceration on her family, her mother said: “To sleep, I couldn’t use the covers because during those days, when she was in the cells, I would start to think that she was suffering from the cold and so I wouldn’t cover myself so that I could experience her suffering. And now, I can’t use the covers even if I’m cold, so I know I’m still affected by it. Now, the pillow feels like a stone…I’m not the person I used to be.”

“Instead of sentencing children to this unbearable suffering, authorities in El Salvador should focus their energies in reviewing legislation that serves no purpose but to treat women as little more than ‘human vessels’,” said Astrid Valencia.

Following a change in the Penal Code in 1998, abortion in El Salvador has been banned in all circumstances – even when the pregnancy is the result of rape, incest or when the life of the woman is at risk. The change in the law has led to wrongful prosecutions and misapplication of criminal law where women are immediately assumed guilty. Women with few economic resources are particularly affected by the ban.

8월 11일 더블린에서 열린 국제대의원총회(International Council Meeting, ICM)에서 성노동자의 인권을 보호하는 중요한 결정이 통과되었다. 국제대의원총회는 국제앰네스티의 정책을 결정한다. 전세계에서 참가한 대의원들은 이번 결의를 바탕으로 국제이사회(International Board)가 성노동자 인권 보호를 위한 정책을 구체화하고 채택할 것을 승인했다.

살릴 셰티 국제앰네스티 사무총장(Salil Shetty, Secretary General of Amnesty International)은 “성노동자들은 전세계에서 가장 소외된 집단중 하나로, 끊임없는 차별과 폭력, 학대의 위험에 놓여 있다. 국제앰네스티는 성노동자의 인권을 보호하는 정책을 채택했으며 이번 결정은 이 중요한 문제에 대해 앰네스티가 어떻게 활동할지를 계획하는데 기반이 될 것이다” 고 밝혔다.

Global Movement Votes to Adopt Policy to Protect Human Rights of Sex Workers

A crucial vote to protect the human rights of sex workers was passed today in Dublin at Amnesty International’s decision-making forum, the International Council Meeting (ICM). Delegates from around the world adopted a resolution which authorized the International Board to develop and adopt a policy on the issue.

“Sex workers are one of the most marginalized groups in the world who in most instances face constant risk of discrimination, violence and abuse. Our global movement paved the way for adopting a policy for the protection of the human rights of sex workers which will help shape Amnesty International’s future work on this important issue,” said Salil Shetty, Secretary General of Amnesty International.

The resolution recommends that Amnesty International develop a policy that supports the full decriminalization of all aspects of consensual sex work. The policy will also call on states to ensure that sex workers enjoy full and equal legal protection from exploitation, trafficking and violence.

“We recognize that this critical human rights issue is hugely complex and that is why we have addressed this issue from the perspective of international human rights standards. We also consulted with our global movement to take on board different views from around the world,” said Salil Shetty.

The research and consultation carried out in the development of this policy in the past two years concluded that this was the best way to defend sex workers’ human rights and lessen the risk of abuse and violations they face.

The violations that sex workers can be exposed to include physical and sexual violence, arbitrary arrest and detention, extortion and harassment, human trafficking, forced HIV testing and medical interventions. They can also be excluded from health care and housing services and other social and legal protection.

The policy has drawn from an extensive evidence base from sources including UN agencies, such as the World Health Organization, UNAIDS, UN Women and the UN Special Rapporteur on the Right to Health. We have also conducted research in four countries.

The consultation included sex worker groups, groups representing survivors of prostitution, abolitionist organizations, feminist and other women’s rights representatives, LGBTI activists, anti- trafficking agencies and HIV/AIDS organizations.

Amnesty International considers human trafficking abhorrent in all of its forms, including sexual exploitation, and should be criminalized as a matter of international law. This is explicit in this new policy and all of Amnesty International’s work.

“This is a historic day for Amnesty International. It was not a decision that was reached easily or quickly and we thank all our members from around the world, as well as all the many groups we consulted, for their important contribution to this debate. They have helped us reach an important decision that will shape this area of our human rights work going forward,” said Salil Shetty.

지난 2013년 9월 수단 하르툼에서 긴축 정책에 반대하는 시위대를 폭력적으로 진압한 사건에 대해 수단 정부는 아직 피해자를 위한 정의구현을 하지 못하고 있다고, 아프리카 정의평화연구센터(ACJPS)와 국제앰네스티, 휴먼라이츠워치(Human Rights Watch)가 밝혔다.

모사드 모하메드 알리(Mosaad Mohamed Ali) ACJPS 이사장은 “정부가 2013년 9월 벌어진 끔찍한 폭력 사건을 숨겨버리는 데 성공한 것처럼 보이지만, 피해자 가족들은 여전히 정의를 요구하고 있다”며 “현재 수단에서 총회가 열리고 있는 유엔 인권이사회는 당시 하르툼을 비롯한 여러 도시의 거리에서 벌어진 끔찍한 유혈사태의 책임자들을 처벌하고, 살인과 폭행 등의 인권침해 피해자들에게 의미 있는 처우를 제공하도록 정부에 압력을 가해야 한다”고 밝혔다.

2013년 9월 긴축재정 발표에 따라 전국적으로 대규모 반대 시위가 벌어지자, 수단 정부는 실탄과 최루가스, 곤봉으로 무장한 보안군과 용역을 동원해 폭력적으로 진압했다.

ACJPS와 국제앰네스티는 2014년 9월 합동 조사 결과를 발표하며 당시 시위대 및 민간인 최대 185명이 숨졌고, 대부분이 머리나 가슴에 총을 맞은 시신이었다고 밝혔다. 수백여 명이 다쳤고, 800명 이상이 체포되었으며 그 중 일부는 수 주에 걸쳐 구금됐다. 휴먼라이츠워치의 조사에 따르면 기자와 인권옹호자들은 구타를 당했고 여성 시위대는 보안군에 성폭행을 당하는 등 구금자 다수가 고문 및 부당대우의 대상이 되었다.

수단 정부는 3개의 조사위원회를 마련했지만 지금까지 아무런 조사 결과도 공개되지 않았으며, 조사 내용을 알아보려는 모든 시도는 실패로 돌아갔다. 2014년 9월, 유엔의 수단 관련 독립적 전문가는 정부가 제공한 정보에 “철저하고 독립적인 조사가 이루어졌다는 증거는 없다”고 밝히기도 했다.

2015년 11월, 수단 법무부의 한 관계자는 법무부 조사 결과 단 86명의 시위대가 사망한 것으로 밝혀졌으며, 이들의 사망과 관련해 장교 4명을 체포했다고 발표했다.

많은 피해자 가족들이 개인적으로라도 기소하려 시도했지만 종결된 것으로 알려진 사건은 단 한 건도 없으며, 시위 중 옴두르만의 자택에 있다가 밖에서 쏜 총에 맞아 숨진 약사 사라 압델바지 관련 사건만이 재판까지 진행될 수 있었다. 사라의 살인 혐의로 경찰관 1명이 유죄를 선고 받았지만, 이 판결은 2014년 5월 항소심에서 증거 부족으로 번복되었다.

대니얼 베켈레(Daniel Bekele) 휴먼라이츠워치 아프리카국장은 “그간 수단 정부의 대응은 폭력의 규모를 부인하고, 폭력 가해자들을 확인 및 기소할만한 증거가 충분하지 않다고 주장하는 것에 그쳤다. 이는 피해자들의 인권을 부정하고, 가해자에게 면죄부를 주는 관행을 더욱 부추기는 것”이라며 “정부는 당시 사망자 규모와 이에 대한 보안군의 책임을 공개적으로 인정해야 한다”고 말했다.

수단 법무부는 정부 조사 결과 확인된 피해자 86명의 가족들에게 관례적 보상금인 ‘디야(diya)’를 지급하고 사건을 무마하려 시도했다. 이는 폭력의 정도에 비해 턱없이 부족한 보상이자, 같은 일을 반복하지 않겠다는 충분한 보장도 되지 못한다.

수단 정부는 전면적이고 철저하고 효과적인 조사를 수행하지도, 사망 사건의 책임자를 기소하지도 못했다. 약 16건의 사건에 대해 일부 조사가 진행 중이고 기소를 기다리고 있지만, 수많은 면죄부들로 보안군과 법집행관들은 형사기소로부터 보호받으며 정의 구현에 또 다른 장애물이 되고 있다.

사라 잭슨(Sarah Jackson) 국제앰네스티 아프리카 북동부, 대호수지역 부국장은 “2013년 9월 시위진압은 평화적인 시위대를 향한 정부의 치명적 무력 사용과 인권침해 책임성 부족의 흉한 상징으로 남아 있다”며 “수단의 충격적인 인권 상황을 고려 중인 유엔 인권이사회 회원국들은 수단 정부가 피해자의 인권을 더욱 진지하게 받아들이도록 강력히 압박해야 한다”고 말했다.

Sudan: No justice for protester killings

Sudanese authorities have yet to provide justice to victims of a violent crackdown on anti-austerity protesters in Khartoum in September 2013, the African Centre for Justice and Peace Studies (ACJPS), Amnesty International and Human Rights Watch said today.

“Although it seems like Sudan has succeeded in sweeping the horrific violence of September 2013 under the carpet, victims’ families still demand justice,” said Mosaad Mohamed Ali, Executive director at ACJPS “The UN Human Rights Council, currently holding a session on Sudan, should press Sudan to hold those responsible to account for the appalling bloodshed on the streets of Khartoum and other towns, and provide meaningful justice to victims of killings, assaults and other abuses.”

Sudanese authorities responded with a violent crackdown to large-scale protests that swept the country following the announcement of austerity measures on September 22, 2013, with security forces and armed men allied to them using live ammunition, tear gas and batons.

As many as 185 protesters and other civilians were killed, most of them shot in the head or chest, ACJPS and Amnesty International found in a joint study published in September 2014. Hundreds were injured and more than 800 others arrested, some held for weeks. Human Rights Watch research showed that many detainees were subjected to torture and other ill-treatment, that many journalists and human rights defenders were beaten andfemale protesters were sexually assaulted by security forces.
Although Sudan established three state commissions of inquiry, no findings have been made public. All attempts to gain access to the findings have been unsuccessful. In September 2014, the UN independent expert on Sudanstated that the information provided by the government “does not provide evidence of a thorough and independent investigation.”

In November 2015, a Justice Ministry official announced that an investigation by the ministry had found that just 86 protesters were killed and that four security officers had been arrested in connection with these deaths.

Many victims’ families have tried to bring private prosecutions but the groups know of no prosecutions that have concluded and only one case – involving the killing of a pharmacist, Sarah Abdelbagi, who was shot outside her home in Omdurman during the protest – that advanced to trial. A policeman was convicted of her murder, but his conviction was overturned on appeal in May 2014 for lack of evidence.

“The government’s response has been to deny the scale of the violence and to claim that there isn’t sufficient evidence to identify and prosecute the attackers, a response that denies the victims’ rights and encourages impunity” said Daniel Bekele, Africa Director at Human Rights Watch.  “The government needs to publicly admit the scale of the killings and the role of its security forces.”

Sudan’s Ministry of Justice has attempted to settle cases by paying money [diya] to the families of the 86 victims identified in government investigations, which would be an insufficient remedy for these violations and would not constitute a sufficient guarantee of non-repetition.

The government has failed to ensure full, thorough and effective investigations and prosecutions of those responsible for the killings. Even where investigations have proceeded and prosecutions pending in around 16 cases, a patchwork of immunities protect security and law enforcement officers from criminal prosecution, posing additional hurdles to justice.

“The September 2013 crackdown remains an ugly symbol of Sudan’s use of lethal force against peaceful protesters, and the lack of accountability for human rights abuses,” said Sarah Jackson, Amnesty International’s Deputy Regional Director for East Africa, the Horn and the Great Lakes. “Human Rights Council member states currently considering Sudan’s appalling rights record should loudly push the country to take victims’ rights seriously.”

국제앰네스티와 그 지지자들이 이스라엘의 팔레스타인 불법점령 정착촌에서 생산된 공산품의 수입 금지를 촉구하며 캠페인을 벌이고 있는 가운데, 그에 반발한 이스라엘 재정부가 2011년 제정된 ‘안티 보이콧(anti-boycott)법’에 따라 국제앰네스티에 보복행위를 가할 것이라는 소식이 이스라엘 언론을 통해 퍼지고 있다. 막달레나 무그라비(Magdalena Mughrabi) 국제앰네스티 중동 북아프리카 부국장은 이에 대해 다음과 같이 밝혔다.

 국제앰네스티가 이스라엘 불법 정착촌에 반대하는 캠페인을 벌인다는 이유로, 이스라엘 정부가 앰네스티에 보복을 가할 것이라는 소식이 들리고 있다. 매우 걱정스러운 상황이 아닐 수 없다. 이스라엘 정부로부터 아직 이러한 사실을 공식적으로 통보받은 것은 아니지만, 만약 이 정보가 사실이라면 그로 인해 표현의 자유는 심각한 퇴보를 겪을 것이다. 또한, 이스라엘 내 인권 NGO들의 활동 역량에 먹구름을 드리우는 신호가 될 것이다. 이로 인해 인권단체들은 정부의 독단적인 개입 없이 자유롭게 활동하지 못할 수도 있다.

이스라엘 언론 보도에 따르면, 이스라엘 정부는 국제앰네스티 이스라엘지부가 더 이상 기부금 공제를 받을 수 없도록 지부의 법적 지위를 변경할 예정이다. 앰네스티 이스라엘지부가 세금 공제 혜택을 받기 시작한 것은 불과 지난 10월부터다.

막달레나 무그라비 부국장은 “정부가 캠페인 활동을 이유로 앰네스티에 보복성 조치를 취한다면앰네스티의 정당한 인권 활동을 노골적으로 공격하는 것이나 마찬가지다. 이스라엘 정부는 정부를 비판하고 책임을 요구하는 인권단체와 활동가를 탄압해 왔다. 앰네스티에 대한 보복도 그 연장선에 있을 것”이라고 말했다.

국제앰네스티는 팔레스타인 점령지역 내부에 이스라엘 정착촌을 조성하는 것 자체가 국제법 위반이며, 이 문제에 대해 국제적 합의가 이루어졌음은 물론 유엔 안전보장이사회 결의안에도 반영된 사안이라고 거듭 강조해 왔다. 이러한 불법 정착촌 문제로 팔레스타인 점령지역에서는 수십 년 동안 수많은 사람이 고통에 시달렸으며, 대규모 인권침해가 자행되었다.

국제앰네스티는 인권단체로서 국가 정부가 국제법적 의무를 준수하고, 그와 같은 인권침해를 부추기지 않게 하는 것이 활동 목적이다. 그렇기에 앰네스티의 캠페인은 전 세계를 대상으로 이루어지고 있다. 이스라엘의 인권 침해적이고 차별적인 불법 정착촌 정책을 재정적으로 지원하며 이러한 불법적인 상황을 돕는 것은 중단해야 한다고 각국 정부에 촉구하는 것이다.

이스라엘 불법 정착촌에서 생산된 공산품의 수입을 허가하고, 자국 기업이 불법 정착촌 내에서 활동하며 상품을 유통하도록 용인하는 등, 국제사회는 불법 정착촌 내 기업들이 이익을 얻고 번성하도록 직접적인 도움을 주고 있다. 이스라엘 점령 하의 팔레스타인 사람들이 더 이상 대규모 인권침해에 시달리지 않으려면 불법 정착촌 사업을 중단시키는 것이 무엇보다 가장 중요하다.

국제앰네스티는 일반적으로 소비자 불매 운동에 찬반 의사를 밝히지 않는다. 그러나 앰네스티는 소비자들이 원하는 대로 보이콧에 참여하고 지지할 권리를 옹호하며, 그런 활동을 벌였다는 이유로 처벌받은 사람들을 위해 캠페인 활동을 한다.

12월 6일 도널드 트럼프 미 대통령이 통합 예루살렘을 이스라엘의 수도로 인정하고, 자국 대사관을 예루살렘으로 옮기겠다고 발표한 것을 두고 라에드 자라(Raed Jarrar) 국제앰네스티 미국지부 중동 어드보커시 국장(Middle East Advocacy Director)이 이를 규탄하며 다음과 같이 밝혔다.

동예루살렘 등 서안 지구는 1967년에 이스라엘에 의해 점령되어, 이스라엘의 예루살렘 행정구역으로 편입된 지역이다. 이 지역은 일반적으로 국제인도법이 적용되는 점령지역으로 인정된다.
동예루살렘 점령지에 대한 이스라엘의 불법 합병은 1980년에 이스라엘이 국내법을 제정하면서 공식화되었다. 국제사회는 여러 차례 유엔 안전보장이사회 결의를 통해 이를 반복적으로 규탄해왔다.

이란의 작가이자 인권활동가인 골로흐 에브라히미 이라에(Golrokh Ebrahimi Iraee)가 끔찍한 투석형 관행에 대한 소설을 썼다는 이유로 “이슬람 신성 모독” 등의 혐의를 받고 6년간의 징역에 처해질 예정인 가운데, 이란 정부는 즉시 에브라히미에 대한 유죄 판결과 형 집행을 취소해야 한다고 국제앰네스티가 밝혔다.

필립 루터(Philip Luther) 국제앰네스티 중동, 북아프리카 조사자문국장은 “골로흐 에브라히미 이라에에게 적용된 혐의는 터무니없는 것이다. 그는 소설을 집필했다는 이유만으로 수년간의 징역에 처해졌고, 심지어 그 소설은 출판조차 되지 않았다. 사실상 상상력을 발휘한 것만으로 처벌을 받게 된 것”이라며 “이란 정부는 투석에 반대하는 의견을 표현하며 평화적으로 권리를 행사한 젊은 여성을 수감시키는 대신, 고문에 해당하는 이러한 투석형을 폐지하는 데 집중해야 한다. 이란 정부가 여전히 투석형을 용인하고, 도덕성을 지킨다는 명목으로 이를 정당화하고 있다는 점은 충격적이다”라고 말했다.

10월 4일, 골로흐 에브라히미 이라에는 이란 선고집행센터로부터 협박조의 전화를 받았다. “이슬람 신성모독” 및 “반체제 선전 유포”죄로 선고된 6년의 징역형 복역을 위해 에빈 교도소로 직접 나오라는 명령이었다.

징역 5년이 선고된 첫 번째 혐의는 그가 집필했지만 출판되지 않은 가상의 소설에 대한 것이었다. 이 소설에서는 간통죄로 투석형을 당해 목숨을 잃은 여성의 실화에 기반한 영화 <The Stoning of Soraya M>를 보고 분노에 차 쿠란을 불태운 주인공 여성의 감정을 묘사했다.

이 소설은 2014년 9월 6일 이라에와 남편인 아라쉬 사데기(Arash Sadeghi)가 테헤란에 있는 사데기의 직장에서 혁명수비대원들로 추정되는 남성들에게 함께 체포되면서 정부에 발견됐다. 이 남성들은 체포영장도 없이 두 사람을 집까지 끌고 간 후 소지품을 수색하고 노트북, 공책, CD 등의 물건을 압수했다.

그 뒤 인권활동가였던 아라쉬 사데기는 테헤란의 에빈 교도소로, 골로흐 에브라히미 이라에는 비밀 구금시설로 이송됐다. 이라에는 이곳에서 밤을 지낸 뒤 에빈 교도소의 혁명수비대 관할 구역으로 보내졌는데, 이 구역에서 20일간 구금되어 있는 동안 가족이나 변호사와의 면회나 소송도 허용되지 않았다. 처음 3일간은 독방에 구금되기까지 했다.

골로흐 에브라히미 이라에는 구금 중 눈이 가려지고 벽을 본 채로 장시간의 심문을 받았으며, 심문관들은 계속해서 “이슬람 모독”으로 사형까지 당할 수 있다고 말했다고 밝혔다. 또한 옆방에 있는 남편이 심문관들에게 위협과 언어적 폭력을 당하고 있는 것을 확실히 들을 수 있어 더욱 괴로웠다고 했다. 아라쉬 사데기는 구금되어 있는 동안 심문관들에게 발길질과 주먹질을 당하고, 뺨을 맞거나 목을 졸리는 등의 고문을 당했다고 밝혔다.

골로흐 에브라히미 이라에는 테헤란의 혁명재판소에서 두 차례 짧은 재판을 받았고, 변호사 없이 재판에 참석해야 했다. 첫 번째로 선임한 변호사는 압력 끝에 변호를 포기했고, 두 번째 변호사는 사건 기록을 열람하지도, 변호를 맡지도 못하게 금지당했다. 그의 첫 번째 재판은 남편의 활동을 주로 다뤘고, 두 번째 재판은 큰 수술을 받고 병원에서 회복하던 중이라 참석하지 못했기 때문에 스스로 변호할 기회조차 주어지지 않았다. 법원에 의료기록을 제출하고 휴정을 요청했지만 이마저도 기각되었다.

필립 루터 국장은 “골로흐 에브라히미 이라에의 ‘재판’은 웃음거리에 불과하다. 변호할 권리도 인정받지 못했고, 그의 유죄 선고는 이전부터 이미 결정된 것이었다. 사법제도와 인권을 완전히 경시하는 이란 정부의 태도를 보여주는 또 하나의 예시일 뿐”이라며 “이란 정부는 골로흐 에브라히미 이라에와, 표현과 결사의 자유를 평화적으로 행사하고 지난 6월부터 수감되어 있는 그의 남편 아레쉬 사데기에 대한 유죄 판결을 즉시 파기해야 한다. 이란 정부는 무자비하고 억압적인 전략으로 젊은 활동가 세대를 모두 짓밟으려 하고 있다”고 말했다.

이란 정부는 이란의 인권상황에 관한 유엔 사무총장 보고서에서, 투석형은 간통에 대한 처벌로 샤리아 율법에 명시되어 있고, 이러한 처벌이 “범죄 억지와 도덕성 보호에 효과적”이라고 언급하며 입장을 확인했다.

국제앰네스티는 파리바 칼레기(Fariba Khaleghi) 등 최소 1명 이상이 현재 투석형을 앞두고 있는 것으로 파악하고 있다.

국제앰네스티는 이란 정부에 동성, 이성 성인간의 합의된 성관계를 비범죄화할 것을 지속적으로 촉구하고 있다.

아라쉬 사데기는 “반체제 선전 유포”, “국가안보에 반하는 집회 및 공모”, “이슬람 공화국 설립자에 대한 모욕” 등의 혐의로 징역 15년형을 선고받고 에빈 교도소에서 복역 중이다. 그 역시 변호사 접견이 허용되지 않았다. 심문관들은 사데기가 작성한 페이스북(Facebook) 메시지와 해외의 기자, 인권활동가 및 BBC 페르시아어 채널 등 대중매체에 보낸 이메일의 인쇄된 사본을 혐의를 입증하는 “증거”로 사용한 것으로 알려졌다.

Iran: Writer facing imminent imprisonment for story about stoning

Iranian authorities must immediately repeal the conviction and sentence of Golrokh Ebrahimi Iraee, a writer and human rights activist who is due to begin serving six years in prison on charges including “insulting Islamic sanctities” through the writing of an unpublished story about the horrific practice of stoning, Amnesty International said today.

“The charges against Golrokh Ebrahimi Iraee are ludicrous. She is facing years behind bars simply for writing a story, and one which was not even published – she is effectively being punished for using her imagination,” said Philip Luther, Research and Advocacy Director for the Middle East and North Africa at Amnesty International.

“Instead of imprisoning a young woman for peacefully exercising her human rights by expressing her opposition to stoning, the Iranian authorities should focus on abolishing this punishment, which amounts to torture. It is appalling that Iran continues to allow the use of stoning, and justifies it in the name of protecting morality.”

On 4 October Golrokh Ebrahimi Iraee received a threatening phone call from the Centre for the Implementation of Sentences ordering her to present herself to Evin Prison to begin serving her six-year prison sentence for “insulting Islamic sanctities” and “spreading propaganda against the system”.

The first charge, for which Golrokh Ebrahimi Iraee has received five years in prison, was imposed primarily in response to an unpublished fictional story that she had written. The story describes the emotional reaction of a young woman who watches the film The Stoning of Soraya M – which tells the true story of a young woman stoned to death for adultery – and becomes so enraged that she burns a copy of the Qur’an.

The story was discovered by authorities on 6 September 2014 when Golrokh Ebrahimi Iraee was arrested together with her husband Arash Sadeghi at his workplace in Tehran by men believed to be Revolutionary Guards. The men showed no arrest warrant but took the couple to their house where they searched their possessions and seized items, including their laptops, notebooks and some CDs.

They then transferred Arash Sadeghi, a human rights activist, to Tehran’s Evin Prison and Golrokh Ebrahimi Iraee to a secret detention place. She was kept there for the night and then transferred to a section of Evin Prison that is under the control of the Revolutionary Guards. She was held there for 20 days, without access to her family, a lawyer or a court. She was in solitary confinement for the first three days.

Golrokh Ebrahimi Iraee has said that during her periods of detention she was subjected to long hours of interrogations while blindfolded and facing a wall, and that interrogators repeatedly told her that she could face execution for “insulting Islam”. She could also clearly hear interrogators threatening and verbally abusing her husband in the next cell, adding to her distress. Arash Sadeghi has since said that he was tortured while in custody – his interrogators kicked him, punched him in the head, slapped him and choked him.

Golrokh Ebrahimi Iraee was tried in two brief sessions by a Revolutionary Court in Tehran, and had no legal representation at the trial. The first lawyer she appointed was put under pressure to withdraw from the case, and the second was barred from reading her court case and representing her. She was not given the chance to speak in her own defence, because the first session was focused on her husband’s activism, and at the second she was in hospital recovering from major surgery and could not be present. She provided the court with her medical records, but her request to adjourn the hearing was rejected.

“Golrokh Ebrahimi Iraee’s ‘trial’ was farcical. She was denied the right to a defence and her sentence was a foregone conclusion. This is just the latest example of the Iranian authorities’ utter contempt for justice and human rights,” said Philip Luther.

“We are urging the authorities to immediately quash Golrokh Ebrahimi Iraee’s conviction and that of her husband Aresh Sadeghi, who has been behind bars since June for peacefully exercising his rights to freedom of expression and association. The Iranian government is on the verge of stamping out a whole generation of young activists with its ruthless and repressive tactics.”

Background

The Iranian authorities confirmed in their comments on the latest report of the UN Secretary-General on the human rights situation in Iran that stoning is the punishment outlined in Shari’a law for adultery, and stated that this punishment “is effective in deterring crimes and protecting morality”.

Amnesty International is aware of the case of at least one woman – Fariba Khaleghi – who is currently facing death by stoning.

Amnesty International has consistently called on the Iranian authorities to decriminalize opposite and same-sex sexual activities between consenting adults.

Arash Sadeghi is currently serving a 15-year prison sentence in Evin Prison on charges including “spreading propaganda against the system”, “gathering and colluding against national security” and “insulting the founder of the Islamic Republic”. He was also denied access to a lawyer. His interrogators are reported to have used printed copies of his Facebook messages and emails to journalists and human rights activists abroad, as well as media outlets such as BBC Persian, as “proof” of the charges against him.
